Traduire consiste à faire passer la teneur d’un message exprimé dans une langue, dans une autre, avec la plus grande fidélité. Pour que la traduction soit fidèle au texte de départ il est donc nécessaire de comprendre ledit texte. Lorsque ce dernier est de nature juridique, traduire sous-tend de comparer deux systèmes de droit (tradition civiliste et Common Law pour les textes qui nous intéressent) qui généralement ne coïncident que de manière partielle. On se propose d’analyser la traduction de concepts (...) qui posent problème sur le plan du signifiant et/ou sur celui du signifié, soit parce que la graphie des mots qui les désignent est identique ou très proche en anglais et en français—ce sont des faux amis, parmi lesquels on distinguera les vrais des faux -, soit parce que l’équivalence des mots généralement posés en miroir présente des subtilités qui interdisent parfois de traduire l’un par l’autre : parmi ces «vrais amis» , moins amicaux qu’il n’y paraît, on distinguera, là encore, les vrais, des faux. On tâchera de montrer que parfois, «bien» traduire ce peut être d’opter pour une traduction descriptive; d’autres fois, c’est choisir un équivalent fonctionnel, dès lors qu’on a identifié que l’on ne se trouve pas dans l’espace non partagé par les deux concepts juridiques; d’autres fois encore, mais de manière marginale, c’est décider de ne pas traduire. Every day, students from marginalized communities disproportionately face adversity and trauma. It is well documented that exposure to adverse childhood experiences can impact children's ability to focus, learn, and even regulate their emotions. Many schools, rather than providing multi-tiered systems of support to address the root causes of behavior, place these students at greater risk of experiencing health disparities through the use of exclusionary school discipline practices. ESDs not only deny students important educational opportunities, but also can compound existing social, (...) economic, and health inequities. Thus, ESD practices must be understood as more than simply impacting what happens in the classroom. Instead, they should be conceptualized as public health policies with far-reaching impacts on a child's lifelong health and well-being. Even though school discipline has largely been overlooked by the public health community, current reform efforts are one aspect of a holistic health justice framework.This article seeks to begin to bridge current gaps in the literature and public discourse by identifying key linkages between ESD practices and health. It then presents evidence-based design principles to ensure education policy is aligned with a health justice framework. And finally, it explores a specific school-based intervention, restorative justice. (shrink)

Para lograr nuestro cometido analizamos el camino de profundización en los conceptos de solidaridad y bien común que la tradición fenomenológica nos muestra. En este caso particular analizamos a Karol Wojtyla �y en un cierto sentido a Juan Pablo II, quien, no obstante, en cuanto pontífice habla desde otra sede, la de Pedro�. Sin embargo, pensamos que (...) no hay discontinuidad en su pensamiento y el método fenomenológico, en cuanto método, tampoco está ausente de las reflexiones del pontífice, aunque la primacía aquí sea teológica y no filosófica. L’évolution de la société se traduit dans le langage. Au Moyen Âge, notairesse, tutorresse et défenderesse rendaient visibles, dans les textes, l’épouse et la femme agissant dans la société. À notre époque s’emploient des noms, tels infirmière, institutrice et vendeuse, qui ne sont pas neufs. Simultanément, comme la femme accède à des professions réservées aux hommes, s’installent des appellations féminines nouvelles telles que (la) juge, (la) pénaliste, présidente, consœur, avocate, magistrate, huissière, enquêtrice. Au Québec, en Suisse, en Belgique et en (...) France, des textes officiels recommandent la féminisation. Celle-ci suscite les passions parce qu’elle touche aux traditions, au savoir-vivre, aux préjugés, au souci d’égalité et surtout à l’identité de la personne. Même si des raisons culturelles et sociales freinent l’évolution des mentalités, la progression de la féminisation dans l’usage constitue un fait linguistique remarquable. (shrink)

Der Einladung von Bernard Tschumi folgend kommt es in den Jahren 1985 bis 1987 zu einer engen Zusammenarbeit zwischen Jacques Derrida und Peter Eisenman für ein Teilareal des Parc de la Villette in Paris. Wenige Jahre später gilt Derrida als meistzitierter Philosoph in der Architektur. Dieser hohen Präsenz im allgemeinen Diskurs steht die wissenschaftliche Auseinandersetzung bislang nach. Der vorliegende Band zum Philosophischen Entwerfen setzt sich zum Ziel, die Bedeutung der Architektur in Derridas Schriften systematisch aufzuarbeiten. Ausgangspunkt hierfür bildet (...) die eingehende Lektüre der Gesamtheit dieser Schriften. Darauf aufbauend wird nachgezeichnet, inwieweit Derrida sich der Architektur annähert, sich mit dieser auseinandersetzt und davon ausgehend Möglichkeiten eines Weiterdenkens aufzeigt. Fordert Derrida gegenüber Eisenman bisweilen eine Rückbesinnung auf ein grundlegendes Denken ein, wie er es beispielhaft bei Vitruv aufgreift, wendet er seinen Blick zugleich voraus und formuliert den Anspruch, nicht mehr allein konzeptuell, sondern im Stein zu denken: ohne Nostalgie, der lebendigste Gedächtnisakt! The self- vs. external-regulation behavior theory, SR-ER Theory model has postulated the Self-Regulation /Non or De-Regulation/Dys-regulation continuum in the person and in their context. The model also generates a behavioral heuristic that allows us to predict and explain the variability of other dependent behavioral variables in a range of scenarios. Consequently, the objective of this study was to validate the different scales prepared on the basis of the theory presented. A total of 469 students voluntarily completed at different times the (...) five questionnaires presented, to give a total of 1,385 completed questionnaires. Using an ex post facto design, descriptive, correlational, confirmatory factorial analysis, reliability, and concurrent validity analyses were carried out. The scales were analyzed individually and as a whole. The results showed the acceptable structure of scale and consistent levels of reliability. The five levels generated by the SR-NR-DR combinatory heuristic that arises from the theoretical model determined significant differences in the levels of the variables analyzed for each psychological context. We discuss the theoretical implications and the implications for the assessment and improvement of the behaviors analyzed in function of the personal and contextual regulation levels evaluated. Cet article porte sur le débat terminologique soulevé par la dénomination française droits de l’homme employée dans la majorité des pays de la francophonie, notamment en France, ainsi que dans la version française des documents onusiens. Son objet est de déconstruire cette dénomination traditionnelle en répondant aux arguments invoqués par la Commission nationale consultative française en 1998. Dans un premier temps, notre article étudie l’argument historique fondé sur l’héritage des Lumières présent dans la Déclaration des droits de l’homme et du (...) citoyen de 1789. Dans un deuxième temps, il se penche sur l’argument linguistique et procède à un examen de la langue et de la grammaire françaises. Dans un troisième temps, notre article analyse les conséquences concrètes de cette désignation dans la mise en œuvre des droits de l’homme de la femme à l’échelle internationale. Enfin, notre article propose d’abandonner la dénomination traditionnelle au profit des expressions “droits humains” ou “droits de la personne”, à l’instar des autres langues officielles des Nations Unies afin de consacrer sur les plans conceptuel, normatif et juridique les droits universels de l’homme et de la femme en langue française. There are several lessons to be learned from the COVID-19. The crisis of 2020 not only had exposed the vulnerability of populations but also several unequalities. In this sense, autonomy, equity, equality, and other ethical basic principles define what ought to be done and also the limits of action, “drawing the line”. Equity is a core principle in public health. Justice as fairness could exemplify the normative and cognitive dimensions of principles. Equality defines the line to close the gender gap, (...) dramatically exposed by pandemics. Care práctice and care ethics are basic for health policies. Beyond autonomy, ethical principles allow us to identify the best practices in public health. (shrink)

Background: Despite the reported harms and ethical concerns about physical restraint use in the critical care settings, nurses’ intention to apply them is unequal across countries. According to the theory of planned behaviour, eliciting nurses’ beliefs regarding the use of physical restraints would provide additional social information about nurses’ intention to perform this practice. Aim: To explore the salient behavioural, normative and control beliefs underlying the intention of critical care nurses to use physical restraints from the theory of planned behaviour. (...) Research design: A belief elicitation study was conducted. Participants and research context: Twenty-six critical care nurses were purposively sampled across gender, work-shift patterns and professional experience in five intensive care units of three hospitals in Spain. Data were obtained from a nine-item open-ended questionnaire and a focus group. Deductive content analysis was performed. Ethical considerations: Ethical approval was obtained from the hospital ethics committee. Participants were assured their participation was voluntary. Findings: Nurses framed the use of restraints as a way of prioritising patients’ physical safety. They referred to contextual factors as the main reasons to justify their application. Nurses perceived that their decision is approved by other colleagues and the patients’ relatives. Some nurses started advocating against their use, but felt powerless to change this unsafe practice within an unfavourable climate. Control beliefs were linked to patients’ medical condition, availability of alternative solutions, analgo-sedation policies and work organisation. Discussion: Safety arguments based on the surrounding work environment were discussed. Conclusion: Nurses’ behavioural and control beliefs were related. Nurses should be trained in alternatives to physical restraint use. The impact of analgo-sedation protocols, relatives’ involvement, leadership support and intensive care unit restraint policies on physical restraint practices need to be revised. Further research is required to explore why nurses do not act with moral courage to change this harmful practice. (shrink)

La presente investigación tuvo como objetivo realizar un análisis del procedimiento abreviado contemplado en el Código Orgánico Integral Penal (COIP), partiendo del criterio de que ciertos aspectos de este procedimiento vulneran derechos fundamentales del investigado. Se destaca particularmente el requisito para el procesado de admitir los hechos que se le imputan para acceder a este procedimiento, lo cual, según la opinión mayoritaria de doctrinarios, compromete el principio de no autoincriminación, la presunción de inocencia y el derecho a un juicio con (...) todas sus fases. El objetivo de esta investigación fue analizar el procedimiento abreviado establecido en el Código Orgánico Integral Penal (COIP), con el propósito de identificar posibles vulneraciones de derechos fundamentales del investigado. Se buscó específicamente evaluar cómo el requisito de admitir los hechos imputados para acceder a este procedimiento podría afectar principios como el de no autoincriminación y la presunción de inocencia. A través de un enfoque cualitativo y utilizando diferentes métodos de análisis, se procuró determinar si el procedimiento abreviado, tal como está configurado, garantiza un debido proceso conforme a los estándares de derechos humanos y constitucionales. La metodología aplicada se sustentó en un enfoque cualitativo, utilizando los métodos inductivo, analítico, sintético y exegético. Se llevó a cabo un análisis documental de la bibliografía relacionada con el tema investigado, así como de instrumentos internacionales de Derechos Humanos, la Constitución de la República de Ecuador, el COIP y jurisprudencia vinculada a la materia. Los resultados de la investigación determinaron que el procedimiento abreviado tal como se encuentra regulado en el COIP beneficia al Estado y al sistema de justicia al agilizar ciertos procesos legales. Sin embargo, se evidenció que este procedimiento puede vulnerar derechos esenciales del procesado, como el principio de no autoincriminación y la presunción de inocencia. Por lo tanto, se concluye que el procedimiento abreviado afecta el debido proceso al comprometer garantías fundamentales. La investigación señala que el procedimiento abreviado regulado en el COIP, si bien puede ser beneficioso para la eficiencia del sistema de justicia, también conlleva riesgos significativos de vulnerar derechos fundamentales del procesado. Por lo tanto, se destaca la necesidad de revisar y modificar este procedimiento para garantizar el respeto absoluto al debido proceso y a las garantías individuales del investigado. (shrink)

Resumen: Husserl propone una teoría sobre la intersubjetividad que parte de la conciencia trascendental como inserta en el mundo de la vida donde están los otros y donde la comunidad se construye bajo una estructura de esencias que garantiza la comunalidad. El mundo de la vida es dado y compartido por todas las conciencias intencionales y trascendentales, es condición para intuiciones empíricas y eidéticas, la epoché y las reducciones eidética y trascendental. Cada momento del método fenomenológico se basa en la (...) existencia de un mundo de la vida independiente de la subjetividad. En este mundo, hay objetos reales y, entre estos, los otros, reconocidos por analogía a través de la empatía. Desde una perspectiva metodológico-epistemológico, el yo es anterior al mundo y a los otros yos. El yo constituye, en sentido fenomenológico, la realidad. La conciencia es el lugar de evidenciación de la realidad. No obstante, en la perspectiva ontológica, es lo contrario. El mundo de la vida es anterior a la conciencia individual. El mundo de la vida está ahí, disponible, existente, independiente del sujeto, funcionando con su propio orden, con sus leyes y reglas. Es el yo el que esta insertado en el mundo de la vida y que se esfuerza por desvendarlo. La realidad se impone y el yo es, sobre todo, miembro de una comunidad de otros yos. Aun así, ¿cómo compartir las experiencias? Las vivencias pueden ser diferentes, pero hay un límite en las variaciones, un límite dado por la esencia del objeto vivido y por las leyes que rigen las relaciones de tal objeto. Así, la constitución del mundo y de sus objetos está permanentemente en progreso. Es posible donarles nuevos sentidos, en los límites de su esencia. Para Husserl, la constitución comunal del mundo es la condición de posibilidad para la existencia de sujetos separados unos de los otros, y este entendimiento recíproco solo es posible a través de la constitución trascendental de la objetividad. Así, no hay una separación entre la intersubjetividad y la constitución del mundo, es la comunidad de yos la que dona sentidos a las objetividades. En el mundo de la vida con los otros en comunidad. -/- Abstract: Husserl proposes a theory on intersubjectivity that starts from transcendental consciousness as inserted in the lifeworld where the others and where the community are built under a structure of essences that guarantees communality. The lifeworld is given and shared by all intentional and transcendental consciousnesses, it is a condition for empirical and eidetic intuitions, the epoché and the eidetic and transcendental reductions. Every moment of the phenomenological method is based on the existence of a lifeworld independent of subjectivity. In this world, there are real objects and, among these, the others, recognized by analogy through empathy. From a methodologicalepistemological perspective, the self is prior to the world and the other selves. The self constitutes, in a phenomenological sense, reality. Consciousness is the locus of evidence of reality. However, from the ontological perspective, it is the opposite. The lifeworld is prior to individual consciousness. The lifeworld is there, available, existing, independent of subjectivity, functioning with its own order, with its laws and rules. It is the self that is inserted in the lifeworld and that strives to unveil it. Reality prevails and the self is, above all, a member of a community of other selves. Even so, how to share the experiences? The experiences can be different, but there is a limit in variations, a limit given by the essence of the lived object and by the laws that govern the relation of the object. Thus, the constitution of the world and its objects is permanently in progress. It is possible to give them new meanings, within the limits of their essence. For Husserl, the communal constitution of the world is the condition of possibility for the existence of subjects separated from each other, and this reciprocal understanding is only possible through the transcendental constitution of objectivity. therefore, there is no separation between intersubjectivity and the constitution of the world, it is the community of selves that gives meaning to objectivities. Content-based authorship identification is an emerging research problem in online social media networks, due to a wide collection of issues ranging from security to privacy preservation, from radicalization to defamation detection, and so forth. Indeed, this research has attracted a relevant amount of attention from the research community during the past years. The general problem becomes harder when we consider the additional constraint of identifying the same false profile over different social media networks, under obvious considerations. Inspired by this emerging (...) research challenge, in this paper we propose and experimentally assess an innovative framework for supporting content-based authorship identification and analysis in social media networks. Addressing fatigue is useful in a variety of scenarios and activities. Fatigue has recently been studied from a psychophysiological standpoint. As a result, the expression and impact of peripheral and central fatigue has been evaluated. Driving is one occupation where tiredness has disastrous consequences. BAlert is a smartphone app that approaches exhaustion with psychophysiological measures. More specifically, it evaluates the level of fatigue via heart rate variability data and the cognitive compromise via Stroop effect. The goal of this study is (...) to determine if there are gender differences in fatigue levels among professional drivers using the BAlert app. Statistically significant differences were found in the number of hours awake, in different parameters of HRV, in the level of stress, as well as in the cognitive response evaluated through the app. The results are discussed and their implications for the management of work fatigue are presented. The concept is characterized and examples of this type of intervention aimed at understanding general questions of educational research and the production of academic texts are presented.

This book argues that nationalist violence in developed countries is the product of unresponsive political elites and nationalists blocked from attracting supporters through legal channels. Political elites are prone to ignoring a regional polity when their clout in that region is negligible and they do not rely on the region's support to maintain their positions of power. Conversely, when nationalists cannot make inroads through legal channels, incentives for violence are ripe. Thus, when nationalists in postwar Europe found elites unresponsive, it (...) was state repression that helped radicals build a new group of support around militant action. The larger this new constituency legitimizing violence grew, the longer the conflict lasted. The book elucidates this complex dynamic through a deft combination of theoretical modeling, statistical methods and comparative case studies from the Basque Country, Catalonia, Corsica, Northern Ireland, Sardinia and Wales. La question du phénomène précède de beaucoup la phénoménologie, elle s'ouvre avec la philosophie et l'accompagne tout au long de son histoire. Mais ce préalable incontournable - car être veut dire apparaître - est surdéterminé par une présupposition irréfléchie. Parce que, avant que ne se lève le monde, une Affectivité transcendantale accomplit en nous son Archi-Révélation en même temps qu'elle engendre notre ipséité, ce sont d'autres catégories, d'autres penseurs, une nouvelle phénoménologie qui sont requis si nous voulons parvenir, enfin, à l'intelligence de ce que nous sommes. We are going to analyse the issue of alterity in the philosophy of Miguel de Unamuno through the study of Abel Sánchez. In this nivola, Unamuno examines the concept of envy and establishes the bases of a theory of alterity based on the specular relationship with the other, which it is constituted by the scarcities of the one who looks. We will also look at what are the philosophical premises of this narration, in which way it is linked with the (...) organic philosophy of Unamuno, and what its relationship with the theatre piece El Otro is, released more than a decade after but of a quite similar subject. Finally, we will outline a possible theory of the alterity by Unamuno that it is formulated through the fraternity and altruistic help. (shrink)

Axel Honneth considers the contemporary political scenario in terms of a struggle for recognition among different individual or collective identities. But if recognition is based on a normative framework of intelligibility, then it can only be sensitive to those political claims that are already identified by that framework. Then the recognition paradigm is limited in terms of the possibility of making visible claims that are not intelligible. This paper discusses Honneth’s conception of recognition through two different authors and traditions: on (...) the one hand the paper uses Judith Butler's conceptions of ‘recognizability’ and ‘apprehension’ in order to re-think recognition in the political domain and, on the other hand, it uses Lacan’s conception and criticism of the recognition paradigm to argue with Honneth in the psychoanalytical domain. So, the main hypothesis of this paper is that a certain re-reading of Gorgio Agamben’s conception of testimony through Judith Butler’s criticism of the recognition paradigm can produce a new approach to exclusion in the political field as well as in psychoanalytical practice. In this sense, the act of witnessing would be a type of recognition that, instead of confirming the intelligibility framework, performs and offers to the excluded the limit of the framework. Pour finir, le contrevenant prend place dans un sac de cuir qui sera cousu après l’intromission d’un bestiaire composé d’un chien, d’un coq, (...) d’une vipère et d’un singe d’après la description donnée par Modestin au Digeste 48.9.9 pr., ceci avant que l’ensemble ne soit jeté à l’eau. Même si la symbolique précise de chaque élément est difficile à saisir en raison de leur origine diffuse, car issue de l’imagination populaire mêlée à divers substrats religieux imbriqués, cette procédure punitive forme un tout cohérent qui ne constitue pas un châtiment politisé au sens strict, c’est-à-dire déployé dans le cadre juridique de la cité. La justice humaine se borne surtout à établir la faute gravissime incombant au contrevenant, laquelle remet en cause le socle de l’organisation romaine, ainsi qu’à préparer son rejet total de la communauté humaine et du droit qui y standardise les rapports. En ce sens, l’homme se garde de donner directement la mort au parricide et la procédure d’expulsion n’est pas sans rappeler celle d’autres individus dits «monstrueux» parce que frappés d’anormalité physique, notamment sexuelle, car ceux-ci remettaient en cause le principe même de l’existence sociale. Cette priorité absolue que constitue la sauvegarde du groupe social dans le traitement du crime a pu servir de point d’ancrage à certaines positions contemporaines qui commandent d’extraire le contrevenant de l’ordre légal, afin de traiter efficacement un acte considéré comme abominable dans l’absolu. C’est l’exemple de la théorie du droit pénal de l’ennemi dont les lointaines racines peuvent être repérées dans les procédés d’expulsions socio-juridiques qui trouvaient à se déployer dans l’Antiquité romaine. A theory of collective violence must explain both why it is collective and why it is violent. Whereas my earlier work addresses the question of why collective violence is violent, here I apply and extend Donald Black's theory of partisanship to the question of why violence collectivizes. I propose in general that the collectivization of violence is a direct function of strong partisanship. Strong partisanship arises when third parties support one side against the other and are solidary among themselves. Such (...) support occurs when third parties are socially close to one side and remote from the other and when one side has more social status than the other. Third parties are solidary when they are intimate, culturally homogeneous, and interdependent. I focus in particular on lynching: Lynching is a joint function of strong partisanship toward the alleged victim and weak partisanship toward the alleged offender. Unequal strong partisanship appears in both classic lynchings and communal lynchings across societies and history. Where partisanship is weak or strong on both sides, lynching is unlikely to occur. Evidence includes patterns of lynching in various tribal societies, the American South, imperial China, and medieval Europe. (shrink)

The following analysis consider one of the most recognized movies in the history of Cinema, “A Clockwork Orange”, identifying and examining the elements of the narration, which characterize it as a satire. However, this assertion lead to ask, which type of satire represent the Film. To structure these characterizations will be allude the Satire Theory of Friedrich Schiller, which works to delimitate not only the satirical elements of the story, but the mode the movie takes to become a critic to (...) the society. This will show how the Movie operate as a moralizing reflection, whose originality lies in the employment of the Satire to carry out this reflection. (shrink)

On compte, parmi les nombreux ennemis de Kevin Mulligan, une foule de personnes bigarrées et (selon notre professeur) profondément vicieuses : les philosophes continentaux, les pharisiens, les amis de l’Europe, des Droits de l’Homme, du politiquement correct, des lettres, des études genres et bien sûr, les gauchistes. On peut faire remonter le terme "gauchiste" à Lénine (1920) qui en usait pour designer cette gauche (communiste) qui, pour rester fidèle à son idéologie, refusait de participer aux élections et, par conséquent, était (...) condamnée à rester éternellement un groupuscule. Pour Vladimir Illich, le vice des gauchistes est prudentiel : parce qu’ils sont focalisés sur leur idéologie, les gauchistes n’agissent pas pour prendre le pouvoir. Ce vice est doublé d’une faute épistémique : en s’arc-boutant (comme des enfants) sur leurs principes – quitte à ne jamais voir leurs idées aboutir –, les gauchistes sont bêtes. Le reproche de Lénine n’est pas très éloigné de celui que l’on fait habituellement à la gauche : elle a de grands rêves irréalisables qu’elle ne cherche jamais à concrétiser – ou de manière magistralement infantile. Cette vision du gauchiste comme un brave hippie un peu benêt sous-estime largement, à mon sens, les vices instanciés par les personnes atteintes de cette maladie politique. -/- Dans cet article, je vous propose d’explorer avec moi tous les vices du gauchisme en regardant, pour commencer, (I) ce que sont la gauche et la droite, puis en avançant pas à pas, (II) une définition en conditions nécessaires et suffisantes du gauchisme. Il conviendra également de ne pas oublier son opposé, tout aussi dangereux (et trop méconnu), le droitisme. C’est pourquoi, une fois que nous aurons caractérisé le gauchisme, je proposerai (III) une définition du droitisme en détaillant ses vices les plus inavouables. Nous pourrons alors (IV) identifier ce qu’est, en général, cette maladie infantile de la politique, suite à quoi (V) je vous prescrirai un vaccin pour vous en prémunir. Avant de débuter, il convient de préciser que si nous parlons ici de gauchisme et de droitisme, nous ne faisons aucune assomption concernant la gauche et la droite ; une personne de gauche n’est pas nécessairement un gauchiste ; de même, tout homme ou femme de droite qui se respecte cherche à tout prix à éviter les droitistes (et vice versa). This article explores the case of informal car parkers in Mexico City, to whom drivers regularly entrust the keys to their vehicles. In contrast to literature on social trust that expects institutional trust and interpersonal trust to support one another, the article shows that interpersonal trust improbably arises in the context of corrupt and inefficient institutions. Coercive and market dynamics undergird the interactions among car parkers, police officers, and drivers, making possible the emergence of an informal market and noncontractual agreements. (...) The exchange between car parkers and drivers depends on the performance of class—a performance that becomes legible and formulaic enough to appear safe, precisely because it coalesces classist tropes that are clearly distinct and recognizable. Interpersonal trust becomes possible not only despite class cleavages and institutional shortcomings but, paradoxically, because of them. (shrink)
