The year 2020 is facing one of the worst public health situations in decades. The world is experiencing a pandemic that has triggered significant challenges to healthcare systems in both high and low‐middle income countries (LMICs). Government policymakers and healthcare personnel are experiencing real‐life ethical dilemmas and are pressed to respond to these situations. Many possible treatments are being investigated, one of which is the use of hydroxychloroquine or chloroquine. These drugs are approved for use by patients with systemic lupus (...) erythematosus (SLE), rheumatoid arthritis, and malaria. The demand for these products has increased, and the stocks are depleting for the patient population for whom the drugs are intended initially. Although both innovator and generic pharmaceutical manufacturers are making plans for increased production, there are challenges with global supply chains disruption and the retention of supplies for local markets. This may cause countries that rely on the importation of pharmaceuticals to be out of stock of supplies for an extended period. There are allegations of off‐label prescribing and hoarding. Pharmacists are the custodians and dispensers of medications and are faced with the task of assessing prescriptions and making decisions about the allocation of these products. This paper seeks to 1) highlight some of the ethical challenges of dispensing hydroxychloroquine by pharmacists during the COVID‐19 pandemic, 2) identify some of the responses to these issues from various regulatory authorities in the USA, and 3) recommend approaches to assist pharmacists in their decision‐making process, especially in LMICs. One of the most influential arguments for realism about mathematical objects is the indispensability argument. Simply put, this is the argument that insofar as we are committed to the existence of the physical objects existentially quantified over in our best scientific theories, we are also committed to the mathematical objects existentially quantified over in these theories. Following the Quine–Putnam formulation of the indispensability argument, some proponents of the indispensability argument have made the mistake of taking confirmational holism to be an (...) essential premise of the argument. In this paper, I consider the reasons philosophers have taken confirmational holism to be essential to the argument and argue that, contrary to the traditional view, confirmational holism is dispensable. Melvin Woody FREUD'S THEORY OF UNCONSCIOUS mental processes depends upon an extremely narrow conception of consciousness. O'Brien and Jureidini rightly focus attention on the limitations of that conception and argue that it is time to dispense with the resultant conception of the unconscious. Of course, scientists often give narrower, technical meanings to (...) ordinary words like matter and space, but in the midst of all the recently revived psychological and philosophical debates about the nature and existence of consciousness, the persistence of Freud's way of distinguishing the two can only breed confusion. Attempts to shore up or defend the dynamic unconscious of psychoanalytic theory by appeal to discussions of unconscious rules and processes in cognitive psychology attests to the potential for confusion thus spawned. In an early issue of this journal, James Phillips and I charted the differences between the neurophysiologic, cognitive, and dynamic conceptions of the unconscious (1995). Like O'Brien and Jureidini, we concluded that the evidence of a cognitive unconscious does not support the postulation of a dynamic unconscious. O'Brien and Jureidini go further in arguing that the two are incompatible. Elsewhere, I have argued that the Freudian unconscious is a hermeneutic myth, the result of a misunderstanding of the nature of interpretation (2003). Because I am in substantial agreement with them and already on record with arguments convergent with theirs on both these fronts, I will focus here on the source of confusion in the dynamic conception of consciousness and on their illuminating exploration of its limitations.Toward the end of his 1915 essay, "The Unconscious," Freud explains that the difference between conscious and unconscious thought hinges on the role of language: What we could permissibly call the conscious idea of the object can now be split up into the idea of the word (verbal idea) and the idea of the thing (concrete idea)... It strikes us all at once that now we know what is the difference between a conscious and an unconscious idea. The two are not, as we supposed, different records of the same content situate in different parts of the mind, nor yet different functional states of cathexis in the same part; but the conscious idea comprises the concrete idea plus the verbal idea corresponding to it, whilst the unconscious idea is that of the thing alone.... Now too, we are in a position to state precisely what it is that repression denies to the rejected idea in the transference neuroses—namely, translation of the idea into words which are to remain attached to the object. The idea which is not put into words or the mental act which has not received hyper-cathexis then remains in the unconscious in a state of repression. (pp. 201-202) This restriction of consciousness to verbal thought processes is not simply an innocent stipulative definition. It has perniciously misleading implications. For one thing, as Antonio Damasio points out in The Feeling of What Happens, it means that all other animals are unconscious for want of any language. Damasio recalls that when he asked what produces consciousness while he was a medical student, [End Page 155] Curiously, I always got the same answer; language did it. I was told that creatures without language were limited to their uncognizant existence but not we fortunate humans because language made us know... The answer sounded too easy, far too simple for something which I then imagined unconquerably complex, and also quite implausible, given what I saw when I went to the zoo. (Damasio 1999, 107) As Damasio notes, the trouble with explaining consciousness as a function of language is not just that it denies awareness of experience to all other animals, thus perpetuating the Cartesian view of animals as automatons, but that for all its complexities, language is far too simple to encompass the full complex range of conscious experience. The ontology of (merely) intentional objects is a can of worms. If we can avoid ontological commitment to such entities, we should. In this paper, I offer a strategy for accomplishing that. This is to reject the traditional act-object account of intentionality in favor of an adverbial account. According to adverbialism about intentionality, having a dragon thought is not a matter of bearing the thinking-about relation to dragons, but of engaging in the activity of thinking dragon-wise.

In recent years, a number of contemporary proponents of psychoanalysis have sought to derive support for their conjectures about the _dynamic_ unconscious from the empirical evidence in favor of the _cognitive_ unconscious. It is our contention, however, that far from supporting the dynamic unconscious, recent work in cognitive science suggests that the time has come to dispense with this concept altogether. In this paper we defend this claim in two ways. First, we argue that any attempt to shore up the (...) dynamic unconscious with the cognitive unconscious is bound to fail, simply because the latter, as it is understood in contemporary cognitive science, is incompatible with the former, as it is traditionally conceived by psychoanalytic theory. Second, we show how psychological phenomena traditionally cited as evidence for the operation of a dynamic unconscious can be accommodated more parsimoniously by other means. (shrink)

There are cases in which, intuitively, an agent’s action is both morally right in one sense, and morally wrong in another sense. Such cases (along with other intuitions about blameless wrongdoing and action-guidance) support distinguishing between the objective moral ‘ought’ and the subjective moral ‘ought.’ This chapter argues against drawing this distinction, on the grounds that the prescriptions delivered by an adequate objective moral theory must be sensitive to the mental states of agents. Specifically, an adequate theory of the objective (...) moral ‘ought’ must respect a strong ought-implies-can principle—morally ought implies agentially can—in order to prescribe actions to real-life agents. An agent’s mental states determine what is agentially possible for that agent; thus, what an agent objectively morally ought to do is in part determined by the agent’s mental states. This chapter describes the structure of a compelling non-ideal moral theory that is both objective and mental state-sensitive. This non-ideal theory illuminates the shortcomings of extant objectivist and subjectivist moral theories, and illustrates how we can dispense with the subjective moral ‘ought.’. (shrink)

Despite the alleged roles played by structures, substances, and facts in mathematical and metaphysical theorizing, in this paper I provide a strategy to dispense with them. It is argued that one need not be committed to the existence of these posits nor with the metaphysically inflationary interpretations that support them. An alternative, deflationary approach is then sketched.

In this essay, I critically analyze Wittgenstein’s dispensation with “ = ” in a correct concept-script. I argue inter alia (a) that in the Tractatus the alleged pseudo-character of sentences containing “ = ” or = -sentences remains largely unexplained and propose how it could be explained; (b) that at least in some cases of replacing = -sentences with equivalent identity-sign free sentences the use of the notion of a translation seems inappropiate; (c) that in the Tractatus it remains (...) unclear how identity of the object as that which is expressed by identity of the sign should be understood specifically; (d) that there are = -sentences which have no obvious equivalent in Wittgenstein’s novel notation; (e) that Wittgenstein’s adherence to (non-relational) identity, although he dispenses with “ = ”, is probably motivated by his desire to ensure that the expressive power of an identity-sign free concept-script of first-order is on a par with standard first-order logic containing “ = ”. In the concluding section, I critically discuss some claims in Lampert and Säbel (The Review of Symbolic Logic, 14, 1–21, 2021) and defend Wehmeier’s account of pseudo-sentences in the Tractatus (2012) against the objections they raise. Citing grounds of conscience, pharmacists are increasingly refusing to fill prescriptions for emergency contraception, or the "morning-after pill." Whether correctly or not, these pharmacists believe that emergency contraception either constitutes the destruction of post-conception human life, or poses a significant risk of such destruction. We argue that the liberty of conscientious refusal grounds a strong moral claim, one that cannot be defeated solely by consideration of the interests of those seeking medication. We examine, and find lacking, five arguments for requiring (...) pharmacists to fill prescriptions. However, we argue that in their professional context, pharmacists benefit from liberty restrictions on those seeking medication. What would otherwise amount to very strong claims can be defeated if they rest on some prior restriction of the liberty of others. We conclude that the issue of what policy should require pharmacists to do must be settled by way of a theory of second best. Asking "What is second best?" rather than "What is best?" offers a way to navigate the liberty restrictions that may be fixed obstacles to optimality. (shrink)

Experiential acquaintance is an alleged relation between ourselves and our experiences that has sometimes been hypothesised as necessary for knowledge of our experiences. This paper begins with a clarification of ‘acquaintance’ and an explanation of ‘experience’ that focuses attention on a famous, but flawed, argument by G. E. Moore. It goes on to critically examine several recent arguments concerning experiential acquaintance and to show how internalist foundationalism can respond to a famous Sellarsian dilemma without appeal to a relation of acquaintance (...) with our experiences. The question of whether the term ”art,” or art as an array of objects, can be defined depends upon the sense of “art” and its extension. The generic sense of “art” is its broadest meaning having its widest extension. I argue that the term is very much like the generic term “science.” Uses of both terms don’t depend upon rigorous definition. Rather, the terms organize an enormous number of varied and sometimes incompatible sub-categories. Most informative topics in art and science (...) are under these sub-categories. As dynamic areas of activity, art and science continue to evolve without an efficacious generic sense. We can dispense with it for these purposes. (shrink)

The United Kingdom case R v Lee EWCA Crim 1404 resulted in a pharmacist being convicted for an inadvertent dispensing error and paved way for the decriminalisation of such errors by way of a due diligence defence enacted in 2018. In relation to Hong Kong, what is its legal position for dispensing errors, and can it follow the decriminalising steps of UK? The primary objective of this paper is to explore whether and how HK can reach the normative position for (...) a dispensing error legal regime: I posit that the normative position for healthcare professional liability for dispensing errors should prioritise the public interest of minimisation of future dispensing errors over the retribution of past wrongs; I illustrate HK’s current position for the liabilities of HCPs on dispensing errors, focusing analysis on the relatively controversial aspects of HK’s criminal liability, referencing the landmark cases Hin Lin Yee v HKSAR 13 HKCFAR 142 and Kulemesin v HKSAR 16 HKCFAR 195 to assist my analysis of the requisite mental element for relevant statutory offences; through comparison with UK’s development post-R v Lee and application of Rule of Law principles, HK’s current position is critiqued, coming to the conclusion that while there are compelling reasons for the decriminalisation of dispensing errors in HK, the prerequisite for this to happen is an overhaul of regulatory frameworks by significantly increasing levels of accountability. Recently, companions in guilt strategies have garnered significant philosophical attention as a response to arguments for moral error theory, the view that there are no moral facts and that our moral beliefs are thus systematically mistaken. According to Cuneo (The normative web: an argument for moral realism, Oxford University Press, Oxford, 2007), Das (Philos Q 66:152–160, 2016; Australas J Philos 95(1):58–69, 2017), Rowland (J Ethics Soc Philos 7(1):1–24, 2012; Philos Q 66:161–171, 2016) and others, epistemic facts would be just as (...) metaphysically problematic (or ‘guilty’) as moral facts. But since epistemic error theory is implausible, arguments for moral error theory prove too much and should be rejected. My aim is to argue that the success of this strategy is limited. In particular, the companions in guilt response fails against error-theoretic arguments motivated by concerns about explanatory dispensability, as recently developed by Joyce (The evolution of morality, MIT press, Bradford, 2005) and Olson (Moral error theory: history, critique, defence, Oxford University Press, Oxford, 2014: Ch. 7). To succeed, the response would require a prima facie plausible argument to the effect that epistemic facts are metaphysically dubious because they, too, are explanatorily dispensable. But, as I show, any such argument proves self-effacing: its premise commits us to believing in epistemic facts, while its conclusion forces us to deny their existence. Consequently, companions in guilt strategies don’t offer a panacea against arguments for moral error theory. (shrink)

I argue that the aporetic character of clemency must be understood in terms of its unmerited and merited character to achieve the underlying purposes of justice within criminal justice: justice as fairness (punishment must be deserved and proportionate) and justice as restoration (repair of the harm to victims and society and the reintegration of offenders) are paramount goals. Rather than destabilizing political order, pardons can render productive potential tensions between justice as fairness and justice as restoration. Taking as my conceptual (...) point of departure Paul Ricoeur's claims about the suprajuridical and supraethical character of pardon, I develop the argument through three central sections: an excursus into historical and contemporary practices of clemency in the United States; a critical analysis of the merited and unmerited aspects of clemency with respect to remorse and atonement theories within theological and legal discourse; and a normative engagement with pardons and felony disenfranchisement. In this paper, 1 examine the role of the delta function in Dirac’s formulation of quantum mechanics (QM), and I discuss, more generally, the role of mathematics in theory construction. It has been argued that mathematical theories play an indispensable role in physics, particularly in QM [Colyvan, M. (2001). The inrlispensability of mathematics. Oxford University Press: Oxford]. As I argue here, at least in the case of the delta function, Dirac was very clear about its rlispensability. I first discuss the (...) significance of the delta function in Dirac’s work, and explore the strategy that he devised to overcome its use. l then argue that even if mathematical theories turned out to be indispensable, this wouidn’t justify the commitment to the existence of mathematical entities. In fact, even in successful uses of mathematics, such as in Dirac’s discovery of antimatter, there’s no need to believe in the existence of the corresponding mathematical entities. An interesting picture about the application of mathematics emerges from a careful examination of Dirac’s work. (shrink)

Do UK community pharmacists encounter the high drama dilemmas of the medical ethics literature or is a 'morality of the mundane' more appropriate? This paper presents the findings of a qualitative study that asked a sample of UK pharmacists to describe their ethical issues and to establish whether these were ethical dilemmas as understood philosophically or ethical problems of a more legal or emotional nature. It emerged that although many pharmacists referred to 'dilemmas', these were often problems involving a conflict (...) between an ethical value and a legal or procedural issue and often arose in the routine minutiae of dispensing prescriptions and selling medicines. Such ethical problems remained of concern for pharmacists and the commercial environment, corporate pharmacy ownership and pharmacists' subordination to doctors, all precipitated ethical problems. Law and ethics appeared to be understood synonymously but this may reflect a modernity that increasingly brackets out ethical experiences by encouraging reliance upon law and procedure. (shrink)

Many philosophers claim that metaphor is indispensable for various purposes. What I shall call the ‘Indispensability Thesis’ is the view that we use at least some metaphors to think, to express, to communicate, or to discover what cannot be thought, expressed, communicated, or discovered without metaphor. I argue in this paper that support for the Indispensability Thesis is based on several confusions. I criticize arguments presented by Stephen Yablo, Berys Gaut, Richard Boyd, and Elisabeth Camp for the Indispensability Thesis, and (...) distinguish it from several plausible claims with which it is easily confused. Although I do not show that the thesis is false, I provide seven grounds for suspicion of our sense (if we have it) that some metaphors are indispensable for the purposes claimed by advocates of the Indispensability Thesis. Philosophers sometimes give arguments that presuppose the following principle: two theories can fail to be empirically equivalent on the sole basis that they present different “thick” metaphysical pictures of the world. Recently, a version of this principle has been invoked to respond to the argument that composite objects are dispensable to our best scientific theories. This response claims that our empirical evidence distinguishes between ordinary and composite-free theories, and it empirically favors the ordinary ones. In this paper, I ask whether (...) this response to the dispensability argument is tenable. I claim that it is not. This is because it presupposes an indefensible thesis about when two empirical consequences are distinct or the same. My argument provides some insight into what our empirical consequences are, and I conclude that empirical evidence is radically metaphysically neutral. This gives us some insight into the significant content of our scientific theories—the content that a scientific realist is committed to—and I show how this insight relates to questions about theoretical equivalence more broadly. Rorty saw the course of philosophy in the twentieth century as an effort to part from two major philosophical trends, namely historicism and naturalism, only to inevitably return at the end of a tortuous path to these very same tendencies. If we can concede without major objections Rorty’s diagnosis of the trends in contemporary continental and analytical philosophy, which seem to reveal the exhaustion of modern philosophy, based as it has been on epistemology, we must, on the other hand, examine (...) carefully the three main questions that this diagnosis leaves open: How does Rorty reconcile continental idealist subjectivism with materialistic behaviorism? Is it really inevitable that philosophy blinded by Geist are unable to question prevalent beliefs? Finally, is the acceptance of a liberalism that is not able to give reasons for itself the most effective and pragmatic liberalism? In answering these questions, it may not be possible to avoid a non-dogmatic, but pragmatic, metaphysics: a vocabulary of vocabularies that allows Rorty to speak of the problems of justice in Plato and Rawls, of the soul in Aristotle and Descartes, of the dystopias in Moro and Orwell. On pragmatic terms, perhaps a modest version of a metaphysic’s “vocabulary” turns out to be as legitimate and practical as any other vocabulary. (shrink)

Kai Wehmeier’s Wittgensteinian Predicate Logic is a formulation of first-order logic under the exclusive interpretation of the quantifiers. W-logic has a distinguished relation constant for co-reference but no sign for objectual identity. Wehmeier denies that objectual identity exists on the grounds that it cannot be a genuine binary relation. Fortunately W-logic is equi-expressive with standard first-order logic with identity and it appears that objectual identity is dispensable across the broader logical enterprise. This paper challenges the latter claim as objectual identity (...) seems to be needed in the exclusive interpretation of quantified modal logic, specifically, for implementing certain kinds of de re quantification. The principle of the best interests of children must be the main consideration in adjudicating applications for marriage dispensation. However, its implementation becomes problematic when faced with provisions on the ability to grant marriage dispensations for urgent reasons. This article examines how the best interests of children are implemented in legal applications for marriage dispensation in religious court. It employs a socio-legal approach with a maqāsid al-syarī'ah cum-mubadalah perspective. This article proposes that the principle of the best interests (...) of children is yet considered by judges effectively in deciding the cases. This does not reflect the protection of the child’s life, heredity, intellect, property, and religion, and does not consider the unique experiences of women both biologically and socially. Judges have a biased perspective in measuring the meaning of maturity and readiness of girls to marry, ignoring children's rights in education and reproductive health, and subordinate women in the spiritual realm. When the indispensability argument for mathematical entities (IA) is spelled out, it would appear confirmational holism is needed for the argument to work. It has been argued that confirmational holism is a dispensable premise in the argument if a construal of naturalism, according to which it is denied that we can take different epistemic attitudes towards different parts of our scientific theories, is adopted. I argue that the suggested variety of naturalism will only appeal to a limited number of philosophers. (...) I then suggest that if we allow for some degree of separation between different component parts of theories, IA can be formulated as an argument aimed at more than a limited number of philosophers, but in implementing this strategy the notion of indispensability needs spelling out. The best way of spelling out indispensability is in terms of theory contribution, but doing so requires adopting inference to the best explanation (IBE). IBE is however sufficient for establishing the conclusion that IA is supposed to establish. Thus, IA is a redundant argument. (shrink)

Background Antimicrobial resistance (AMR) is a global threat to human and livestock health. Although AMR is driven by use of antimicrobials, it is often attributed to “misuse” and “overuse”, particularly for antibiotics. To curb resistance, there has been a global call to embrace new forms of moral personhood that practice “proper” use, including prescription, dispensing and consumption of antimicrobials, especially antibiotics. This paper seeks to reflect on complex questions about how morality has become embedded /embodied in the AMR discourse as (...) presented in the data collected on antimicrobial prescription, dispensing and use in human and livestock health in Tanzania, primarily focusing on antibiotics. Methods This reflection is anchored on Jarrett Zigon’s morality framework that is comprised of three dimensions of discourse; the institutional, public, and embodied dispositions. The data we use within this framework are derived from a qualitative study targeting human and animal health care service providers and community members in northern Tanzania. Data were collected through 28 in-depth interviews and ten focus group discussions and analysed through content analysis after translation and transcription. In addition, a review of the Tanzania’s National Action Plans on antimicrobial resistance was conducted. Results Application of the framework demonstrates points of convergence and divergence in the institutional morality discourse articulated by the Tanzania National Action Plans, the public discourse and the embodied dispositions/ lived experiences of human and animal health care service providers and community members. We demonstrate that AMR is not just associated with “inappropriate” behaviour on the part of drug prescribers, dispensers, and users but also with shortcomings in health systems and service delivery. Conclusion Antibiotic dispensing and use practices that may be associated with the development of AMR should not be viewed in isolation from the broader health context within which they occur. In his précis of a recent book, Richard Joyce writes, “My contention…is that…any epistemological benefit-of-the-doubt that might have been extended to moral beliefs…will be neutralized by the availability of an empirically confirmed moral genealogy that nowhere…presupposes their truth.” Such reasoning – falling under the heading “Genealogical Debunking Arguments” – is now commonplace. But how might “the availability of an empirically confirmed moral genealogy that nowhere… presupposes” the truth of our moral beliefs “neutralize” whatever “epistemological benefit-of-the-doubt that might have been extended (...) to” them? In this article, I argue that there appears to be no satisfactory answer to this question. The problem is quite general, applying to all arguments with the structure of Genealogical Debunking Arguments aimed at realism about a domain meeting two conditions. The Benacerraf-Field Challenge for mathematical realism affords an important special case. (shrink)

This paper is concerned with the debate between substantival and relational theories of space-time, and discusses two difficulties that beset the relationalist: a difficulty posed by field theories, and another difficulty called the problem of quantities. A main purpose of the paper is to argue that possibility can not always be used as a surrogate of ontology, and that in particular that there is no hope of using possibility to solve the problem of quantities.

Enhanced indispensability arguments seek to establish realism about mathematics based on the explanatory role that mathematics plays in science. Idealizations pose a problem for such arguments. Idealizations, in a similar way to mathematics, boost the explanatory credentials of our best scientific theories. And yet, idealizations are not the sorts of things that are supposed to attract a realist attitude. I argue that the explanatory symmetry between idealizations and mathematics can potentially be broken as follows: although idealizations contribute to the explanatory (...) power of our best theories, they do not carry the explanatory load. It is at least open however that mathematics is load-carrying. To give this idea substance, I offer an analysis of what it is to carry the explanatory load in terms of difference-making and counterfactuals. (shrink)

During 2005-2006 I continued my longstanding practice of writing occasional studies on philosophical topics, both for formal presentation and for informal discussion with colleagues.
