La bioética clínica ha evolucionado en la afirmación de los principios generales fundamentales que protegen la salud de las personas. El manejo y alivio del dolor es un derecho humano universalmente reconocido como tal, susceptible del escrutinio ético y bioético, toda vez que implica la toma de decisiones que comprometen la calidad de vida de las personas. El dilema ético sobre el manejo del dolor suele entrañar conflictos de valores en las decisiones cruciales, sobre todo cuando no hay (...) una única alternativa, tratamiento y estrategias de intervención lo suficientemente compartidas y aceptadas. El problema ético y bioético en el manejo del dolor, sobre todo en pacientes con padecimientos crónicos y/o estado de estrés, al final de la vida sigue representando un desafío para la práctica clínica, con consecuencias diversas en los pacientes adultos y repercusiones en los sistemas de salud y el entorno familiar y social de dichos pacientes. La investigación en medicina tiene por objetivo generar nuevos conocimientos que ayuden al diagnóstico, el tratamiento y la prevención de enfermedades. Pero la medicina no es una ciencia exacta, sino una actividad humana heterogénea que se basa solo parcialmente en la ciencia, con varios factores no científicos que influyen en la forma de desarrollar esta actividad. El dolor, como síntoma o como enfermedad, es probablemente el trastorno que más afecta y preocupa a las personas y el que con mayor (...) frecuencia motiva una consulta médica. A pesar de la magnitud del problema, y del interés médico y social por el dolor, la atención y el tratamiento de las personas con dolor crónico es un tema infravalorado o tratado inadecuadamente. Con base en múltiples preguntas que se plantean a lo largo del desarrollo del presente documento, nuestro objetivo es, por un lado, el de señalar que los cambios que se han producido en el manejo del dolor crónico hacen de los llamados protocolos de consenso un ejercicio obsoleto en la medicina del siglo XXI. Por otro lado, en términos de bioética, responder a la pregunta ¿se ajustan los protocolos de consenso al principio de beneficencia del paciente individual? (shrink)

Bajo la inspiración de la performance Lips of Thomas de Marina Abramovic, se examinan en este trabajo las fisuras y las paradojas que plantea un posible circuito interpersonal del dolor, en el que se distinguen al menos cuatro momentos: experiencia álgica, expresión doliente, reconocimiento y comportamiento de ayuda. Nos detenemos especialmente en el caso de una experiencia álgica a la que no corresponde sorprendentemente una expresión, y también en el caso de una expresión doliente que ha de superar múltiples (...) dificultades para su reconocimiento. Mientras que el dolor agudo parece el verdadero actor que se despliega y manifiesta en la escena sin abrir apenas espacio a una modulación personal, el dolor crónico puede llegar a exigir una cuidadosa puesta en escena para alcanzar paradójicamente el reconocimiento de su mera realidad. Las múltiples fisuras y paradojas en la experiencia, expresión y reconocimiento del dolor pueden deberse, en definitiva, no a una disfunción casual de un circuito funcional y operante, sino al carácter disruptivo, destructivo o aberrante de una experiencia álgica que se manifiesta en último término como experiencia del mal. : Psychogenic pain is considered to be pain that has a psychological origin. In this paper, I provide a brief history of the ways in which such pain has been interpreted and classified, highlighting the problem that psychogenic pain is typically defined by excluding organic evidence that could account for the sufferer’s experience. This has led to ambiguous disease classifications, which challenges the authenticity of the patient’s suffering. Today psychogenic pain is no longer considered a valid diagnosis, because it is (...) deemed to stigmatize the patient by implying that their pain is imaginary. But such stigmatization continues in the modern approach to chronic pain. Addressing this issue requires us to understand the relationship between “emotional” and “physical” pain and acknowledge the reality of all suffering. Radden tackles these issues by showing that even though pain and suffering can be accompanied by mistaken beliefs, such experiences cannot be delusional. In questo lavoro presento una breve storia delle interpretazioni e classificazioni di questa forma di sofferenza, evidenziando che queste si sono fondate perlopiù sull’esclusione di evidenze organiche a giustificazione dell’esperienza del sofferente. Ciò ha portato ad ambigue classificazioni di malattia che mettono in discussione l’autenticità della sofferenza del paziente. Oggi, quella di dolore psicogeno non è più considerata una diagnosi valida perché ritenuta stigmatizzante, implicando che il dolore del paziente sia immaginario. Ciononostante, la stigmatizzazione persiste nell’approccio odierno al dolore cronico. Affrontare questo problema comporta la comprensione della relazione tra dolore “emozionale” e dolore “fisico” ed il riconoscimento della realtà di tutte le forme di sofferenza. Esta paradoja clásica-que la historia como disciplina y narración impida la conciencia de la historia como vida que inscribe su sentido en sus propios avatares- se ve correspondida, tras la fusión del cristianismo con la Modernidad, (...) con una paradoja inversa: aquí es justamente la convicción exacerbada de la historicidad de las criaturas, la idea de estar expuestos mortalmente al tiempo la que impedirá la constitución de la narración histórica, despachada como descripción de un mundus fabulusus y sustituida por una Filosofía de la Historia que habría de ser paralela en su exactitud y predictibilidad a la Filosofía Natural. Sólo en aquel destello genial e irrepetible constituido por la conjunción del romanticismo (Herder) y el idealismo (Kant, Hegel) se unirán de modo indisoluble historia como acontecer e Historia como disciplina. El sitio común a ambas vendrá dado por una razón capaz de soportar en su seno todo el dolor del mundo. Biobanking in Europe has made major steps towards harmonization and shared standards for the collection and processing of data and samples stored in biobanks. Still, biobanks and researchers face substantial legal difficulties in the field of data protection and sample management. Data protection law was harmonized almost 15 years ago while rights in samples fall under the competence of the Member States of the EU. Despite the Data Protection Directive the field of data protection shows a substantial degree of deviation (...) as public health was excluded from the harmonization. Biobanks seem to have substantially fewer difficulties to cope with in terms of the legal requirements in the field of sample management. This paper discusses the legal framework, experiences of different biobanks in Europe and potential ways forward. It also highlights the need for a health economic analysis of the costs and benefits of privacy protection in Europe. At the moment, policymakers seem to build their decisions on an insufficient evidence base which underestimates the potential value of biobanks for European public health. Within the past few years little progress has been achieved with regards to the development of a unified legal framework in Europe, The diversity in the legal system is also reflected in the different approaches of ethics committees towards biobanking. To secure the responsible and effective use of data and samples, more efforts are needed to come up with pathways for a solution. (shrink)

As suicide rates increase worldwide, the mental health industry has reached an impasse in attempts to assess patients, predict risk, and prevent suicide. Traditional assessment tools are no more accurate than chance, prompting the need to explore new avenues in artificial intelligence (AI). Early studies into these tools show potential with higher accuracy rates than previous methods alone. Medical researchers, computer scientists, and social media companies are exploring these avenues. While Facebook leads the pack, its efforts stem from scrutiny following (...) suicides and suicide attempts broadcasted on Facebook Live. The company continues to face scrutiny for ethical, privacy, and safety concerns associated with the quick rollout of proprietary AI technology that seems more focused on the optics of the company than the protection of its billions of users. This paper explores some of these issues, including a lack of transparency, questionable data practices, escalation to law enforcement, little to no regulation, potential for bias, increased viewership of troubling content, and worsening thoughts of suicide among vulnerable Facebook users. Despite AI tools showing promise in improving the accuracy of suicide risk predictions over traditional methods, without regulation, external review, and increased protection of users and data, these tools have the potential to cause more harm than good in the hands of powerful companies like Facebook. Interpreting intentional intervention as part of human stewardship rather than as a wrongful interference with some divine plan, he takes (...) on the sticky questions, making critical distinctions, for example, between cure and enhancement or welcoming children as they come and making them “better.” Not neglecting future implications of current tinkering with human biology, even in such taboo areas as gamete selection, he contends that engineering a baby free of harmful genes (for example, Tay-Sachs or Down syndrome) not only makes that person better, but it also eliminates an ongoing burden to family, to society, and perhaps to future generations. Treading gingerly among the sacred cows of some Christian ethicists, he advocates the implanting of selected embryos free of unwanted genes; in his view, embryos are not yet persons.Peterson considers serious concerns such as eugenics projects and racial bias but offers standards to address them. He contends that intentionally increasing choices for our children is not only acceptable but also praiseworthy. What parents would not optimize the educational and social opportunities for their child, even without the child’s consent? Interventions should be safe, offer genuine improvement, increase the recipient’s capacity, and make the best use of limited resources. Peterson is not so naive that he does not recognize that technology does not always make us better. He recognizes, too, that his standards do not eliminate risk.Fair enough, but the issue of what “improvement” may mean to the individual as well as to the greater community remains somewhat ambiguous. Peterson suggests that broadening the decision making among a variety of professional and individual cohorts would help, but his argument is not totally persuasive. In sum, Peterson’s treatment falls short of offering a totally satisfying standard for determining which characteristics should be manipulated and which should be accepted. Nor does he demonstrate definitively how a [End Page 187] Christian perspective would contribute to sorting out possible choices. Does the deaf parents’ desire for their child to be deaf like them constitute an instance where intervention should not be attempted? Can the disparate cohorts he suggests as arbiters rise above their own biases? Does Christianity and its belief system offer answers? Readers—even readers who call themselves Christian—will likely be persuaded that genetic intervention is a good, and even compatible with their religious perspective. Nonetheless, they will harbor lingering doubts about how the questions can best be solved, who should solve them, and how Christian belief helps sort among the possibilities. In his closing comments Peterson appears to agree.The book is rich in research and in provocative ideas. It is an exciting book. It is a readable and enlightened contribution to the professional conversation on gene therapy. Peterson’s research is extensive, his argumentation balanced. His attempt to locate the question within the Christian tradition is laudable. Happily, Peterson eschews a creationist approach to world and human origins. Unhappily, his approach to the scriptural text is not always nuanced. His assertion that Jesus himself was different biologically from other human beings (132) seems a stretch. If one takes the passages of Jesus’s biological origins literally, as apparently does the author, what happens to the assertion that Jesus is like other human beings “in all things but sin”? And where did Jesus get the Y chromosomes? While he persuades the reader that genetic intervention is compatible with a Christian worldview, Peterson does not offer—at least in this reviewer’s view—an adequate criterion for navigating this new world of the possible.Dolores L. En primeiro lugar, Kant, como artífice da produtiva noción dunha “fronteira [Grenze]” da razón como condición e límite do pensamento; en segundo lugar, Hegel, como o seu máximo crítico na “asunción [Aufhebung]” da negación da fronteira kantiana; e, finalmente, Kierkegaard, cuxa contribución á discusión dos seus predecesores consiste no “pathos (...) Esta nueva conceptualización de la vulnerabilidad se ha presentado como la base teórica de un paradigma alternativo a la teoría liberal del Estado y de los derechos. El presente trabajo analiza algunos puntos críticos de este nuevo paradigma en su relación (...) con la idea de igualdad, especialmente en la medida en que se presenta como una nueva formulación de la idea de igualdad sustantiva, capaz de transcender las limitaciones que se señalan a la noción liberal de igualdad formal y al derecho antidiscriminatorio construido sobre esa noción. Abstract: The proposal advanced by US theorist Martha Albertson Fineman for reconceptualising the notion of vulnerability as a human condition, universal, inherent and constant, has acquired growing academic moment in the field of human rights. This new conceptualisation has been presented as the theoretical foundation for a new political and legal paradigm, alternative to liberal theory. This essay assesses some critical points in this new paradigm in its relation with the idea of equality, especially inasmuch as vulnerability appears as a new formula for substantive equality, capable of transcending the limitations of the liberal notion of formal equality and the antidiscrimination law that is founded thereupon. En este artículo tratamos de demostrar que el término español haza procede del árabe Faḥṣ 'campo' y no del latín Fascia 'banda, tira', tesis admitida de manera unánime. Para conseguir nuestro propósito hemos reconstruido la historia de este vocablo a través del estudio de fuentes documentales y textos literarios. Como resultado de ello demostramos que haza, en su forma arcaica faza, aparece en Castilla en el siglo IX; ponemos de manifiesto que en un principio asumió los significados del étimo árabe, (...) para desarrollar más tarde nuevos sentidos y finalmente, explicamos la evolución fonética experimentada por faḥṣ hasta convertirse en haza. In this study, we investigated the relationship between mothers' psychological lexicon and children's cognitive and socio-emotive development as assessed through conceptual and semantic understanding tasks, in addition to the traditional tasks of theory of mind. Currently, there is considerable evidence to suggest that the frequency of mothers' mental state words used in mother-child picture-book reading is linked with children's theory of mind skills. Furthermore, mothers' use of cognitive terms is more strongly related to children's theory of mind performances than the (...) mothers' references to other mental states, such as desires or emotions (Rollo and Buttiglieri, 2009 ). Current literature has established that early maternal input is related to later child mental state understanding; however it has not yet clarified which maternal terms are most useful for the socio-emotional and cognitive development of the child, and which aspect of the cognitive development benefits from the mother-child interaction. The present study addresses this issue and focuses on the relationship between mothers' mental state talk and children's behavior in conceptual and semantic tasks, and in a theory of mind task. In this study fifty pairs consisting of mothers and their 3 to 6-year-old children participated in two sessions: (1) The mothers read a picture book to their children. To assess the maternal psychological lexicon, their narrative was codified according to the categories of mental state references used in literature: perceptual, emotional, volitional, cognitive, moral, and communicative. (2) After a few days, the conceptual and semantic skills of the children (tasks of contextualization and classification, memory, and definition of words) and their psychological lexicon were assessed. The results suggest close links between the frequency and variety of mothers' mental state words and some semantic and conceptual skills of children. (shrink)

Que la población mayor está bien ajustada emocionalmente es algo bien constatado en la investigación gerontológico. Este dato, puesto en relación con otros, genera una curiosa consecuencia: la denominada "Paradoja del bienestar en la vejez". Con la edad, junto al aumento de circunstancias relativas a pérdidas (de parientes, amigos, funcionamiento físico y roles sociales) se da una estabilidad en las puntuaciones de diversos indicadores de bienestar psicológico (expresión de emociones positivas, prevalencia de trastornos depresivos o ansiedad). Los aspectos explicativos que (...) se esgrimen para despejar esta paradoja son, entre otros, la mejora de mecanismos de autorregulación emocional y el carácter gradual y normativo de dichas pérdidas (Márquez-González, 2008 y Fernández-Ballesteros, 2009). Atenta-se para a atuação das facções políticas (ou hetaireías), que não se restringiam apenas ao espaço das assembleias públicas, mas consolidavam, pelo financiamento das obras dramáticas, uma forma de atingir o público politicamente de maneira persuasiva: os cidadãos que poderiam votar nas ideias debatidas dentro das assembleias. Para tanto, propõem-se uma reflexão acerca do sistema da choregía (...) como forma de dominação, uma análise acerca das orações de Andócides de 415 a.C. sobre as disputas pelo espaço político - seja atuando no teatro, seja de forma oculta, pela ação de grupos de sublevação de poder - e, por fim, uma investigação do tema no exame discursivo da comédia As rãs de Aristófanes (Bátrachoi - 405 a.C.). Among the most enduring taboos, those related to the human body are the most enduring, throughout history. Be it its re/presentation of exploration, it constituted for most cultures and epochs a very sensitive subject, ever evolving and changing, but perennially raw and open to debate and discussion. With the advent of new technologies sustaining and infiltrating society, the body is seen, explored and represented in new ways that can be, simultaneously, interpreted either as transgressive or respectful of taboos, depending on (...) the point of view or the current social norms. The question is: are we able to transcend transgression of taboos through our work or are we still far from achieving it? Our tools are computer-generated simulations based on patient-collected data. Building our arguments on Foucault’s Birth of the Clinic (1973) analysis, we approach the evolution of our own research as a ‘case study’. In the age of the life-support, stem-cell therapy and 3D organ printing, is computer simulation mimicking or mirroring organic life and phenomena, or is it creating a debatable simulacrum? From reducing the human body to a series of equations that lead to depersonalization and loss of self, to tailored modelling based on patient-collected biological data, the computer simulations took a variety of guises. At each point of the way, confronting the taboos, conventions and through controlled transgressions of established rules, we strived to transcend all historic limitations and update, adjust and fine-tune the technology and its uses to better suit the clinicians’ pursuits. Hannah Arendt and Leo Strauss were contemporary with each other; they shared courses, readings and taught at the same universities. Their lives were also affected by the same historical events, both tried to understand the crisis of Modernity, and the same thinkers and philosophical ideas influenced their works. However, their conclusions differ completely and understanding both their coincidences and their differences can illuminate not only the specificities of two of the most important works of political thought of last century, but (...) also some of the political and theoretical alternatives of our time. Thus, this work aims to show some of the most significant coincidences and differences of Arendt and Strauss, particularly those related to their understandings of the crisis of their time and its consequences. The anthropological and religious interest for the raven is present in Buddhism, in biblical stories, in North and Greek mythologies, in Arthurian legend and in Spanish epic. The occultism attributed to the raven the mission of guidance of dead human souls after death. This article tracks how the raven transfers its occult connotations to the poetic symbol analyzing the poem«The Raven» by EdgarAlan Poe in its cultural and aesthetic context. Charles Baudelaire and the French symbolists dignified the intertextual evolution of (...) Poe’s symbol and transferred it to LatinAmerican and Spanish modernists. These poets used the raven not only as a symbol but mainly as a recurrent motif or poetic topos. Even though the occultist influence appears ‘scattered’ in the process of the creative experience of this symbol, it does not take away its existence. The occultist influence of the raven explains the ultimatemeaning of some verses and clarifies the exceptions and contradictions that appear in many poems. (shrink)

The authoress questions the historiographic dogma that, tracing back to F.W. Maitland, gave the pure «Englishry» of English law for granted, thus building its history on its exceptionality with respect to European tradition, from which it would not have been contaminated at all. The Anglo-Saxon historiographical analysis of the most important English constitutional document aims at answering to the provocative question: how English is Magna Carta? What role did jus commune play in its drafting? What is its relationship with contemporary (...) Roman Canon law? Through the examination of its cultural roots, the essay shows not only the substantial influence of Roman Canon law on Magna Carta, but also, more generally, the affinities and the common elements that characterize in principle the relationship between English juridical tradition and the continental one. Frente a la violencia contra las mujeres se han generado,gracias al feminismo, una infinidad de normas que tratan de ponerle límite. No obstante esta violencia no cesa. Para el feminismo la violencia contra las mujeres no es otra cosa que la consecuencia de la dominación del macho impuesta por la cultura patriarcal. Pero hoy, en las democracias occidentales, es imposible seguir sosteniendo el mito del macho dominador propio de la era patriarcal. Hoy asistimos a un declive de lo viril concomitante (...) a la caída del Padre. La actual violencia contra las mujeres no puede explicarse por el régimen patriarcal, pero tampoco por la caída del padre, porque esta violencia ha existido en todas las épocas. La verdadera cuestión no es el Padre sino el malentendido entre los goces. Mientras que el goce todo fálico se centra en la apropiación del objeto, en lo que puede ser localizado, nombrado, medido, el goce no- todo fálico, que Lacan llama femenino, pero que también pueden experimentar algunos hombres, se presenta como sin medida, irreductible, no solo a un órgano, sino a la palabra misma. Ante la angustia suscitada frente a lo real de este goce Otro imposible de ser simbolizado, la violencia masculina es un intento ferozmente patológico de colonizar este goce innombrable. El pasaje al acto violento viene en el lugar de una palabra imposible de decir. Frente al recurso al acto violento que cortocircuita la palabra, el psicoanálisis es una invitación a poner en palabras este goce que perturba a cada ser hablante. No para decirlo todo, lo cual es imposible, sino para hacer con este imposible de decir otra cosa que la destrucción del otro y/ o la autodestrucción. (shrink)

Women's equality claims have occupied the forefront of the European debate on face-veil bans; most claims have been denounced as mere manipulation for anti-Islamic and/or anti-immigrant political agendas, and the dilemma between anti-sexist and anti-racist struggles has been argued to be false. This article examines how opportunistic manipulation of gender equality claims and the ‘ethnicisation’ of sexism have been assessed and confronted in the scholarly debate opposing the bans, as well as the impact that this debate has had on women's (...) equality claims and the intersectionality issue. I argue that the women's oppression argument has not been fully considered, because it would have disrupted the anti-racist struggle due to unresolved problems with understanding intersectionality. Research traditions on cognition and depression focus on relatively unconnected aspects of cognitive functioning. On one hand, the neuropsychological perspective has concentrated on cognitive control difficulties as a prominent feature of this condition. On the other hand, the clinical psychology perspective has focused on cognitive biases and repetitive negative patterns of thinking for emotional information. A review of the literature from both fields reveals that difficulties are more evident for mood-congruent materials, suggesting that cognitive control difficulties interact with cognitive biases (...) to hinder cognitive switching, working memory updating, and inhibition of irrelevant information. Connecting research from these two traditions, we propose a novel integrative cognitive model of depression in which the interplay between mood-congruent cognitive control difficulties, cognitive biases, and rumination may ultimately lead to ineffective emotion-regulation strategies to downregulate negative mood and upregulate positive mood. Epidemiological evidence supports a health‐promoting effect of the Mediterranean Diet (MedDiet), especially in the prevention of cardiovascular diseases. These cardiovascular benefits have been attributed to a number of components of the MedDiet such as monounsaturated fatty acids, antioxidant vitamins and phytochemicals. However, the underlying mechanisms remain unknown. Likewise, little is known about the genes that define inter‐individual variation in response to the MedDiet, although the TCF7L2 gene is emerging as an illustrative candidate for determining relative risk of cardiovascular events in (...) response to the MedDiet. Moreover, omics technologies are providing evidence supporting potential mechanisms, some of them implicating epigenetics (i.e. microRNAs, methylation), and certain data suggest that some traditional foods could contribute via microRNAs possibly acting as exogenous regulators of gene expression. Future research should aim at increasing and consolidating the nutrigenetic and nutrigenomic knowledge of the MedDiet in order to provide sound, personalized and optimized nutritional recommendations. As the ethical framework of the Catholic Church becomes incapable of accommodating the cultural diversity in Ireland, the search for a new moral discourse takes on a greater urgency. In its absence, litigation in Ireland is on the increase.

This article provides a discussion of the concepts of politics, sovereignty and man in the thinking of CARL SCHMITT and THOMAS HOBBES, clarifying certain similarities and differences between the two authors. It attempts to understand the well-known theory of the German author concerning that which is political, as drawn from the struggle and distinction between friend/foe in light of the threat posed by the Hobbesian state of nature and the meaning of war. These ideas call for a State that does (...) not arise as the result of a contract, but from unity based on exclusions, according to SCHMITT. Finally, the conflictive dimension of man is understood as essential for the political realm, which is based, precisely, on egotistical and dange rous features in human beings. The acceptance of causal closure has had a profoundly limiting effect on the philosophical treatment of sui generis mental causation in recent decades. Philosophical treatments of special divine action have been likewise hampered by a widespread commitment to closure. If fundamental reality is as closure tells us it is, then nonphysical minds—human and divine— are either causally impotent or redundant. In this paper, I reject this limitation as baseless. Specifically, I will show how Hempel’s dilemma poses a far greater challenge (...) when applied to a causal closure principle than it did to the task of defining physicalism. Reponses to the dilemma can be used to disambiguate closure, but not without significant cost. In light of Hempel’s dilemma, there is no conception of closure that can do all of the following: rule out sui generis mental causation, have a reasonable chance of being true, and avoid problematic circularity. At the end of the day, I maintain that closure, properly understood, is, or ought to be, just one methodological stance among many. If this is correct, it is a stance that a theist can freely reject.
