Immigration law is exceptional enough to deserve an administrative law focus of its own. The Administrative Procedure Act (APA) does not demand uniformity in adjudication. Therefore, it may be counterintuitive to argue that any one area of administrative adjudication is exceptional. Removal adjudication is indeed exceptional because it is an extremely dysfunctional system, it operates in a double void of fewer constitutional protections and without the protections of the APA, it relies on a vast network of civil detention, and it (...) is of a different genre than the type of regulation that drove the development of the APA. The exceptionality of removal adjudication demands a review of administrative law doctrine with this exceptionality in mind. (shrink)

She maintains that the traditional family is fragmenting in Western societies, causing serious social problems. She urges that we reconsider our attitudes to sex and reproduction in order to strengthen our most important social institution, the family.

The Origin of the Family, Private Property and the State (1884), was a provocative and profoundly influential critique of the Victorian nuclear family. Engels argued that the traditional monogamous household was in fact a recent construct, closely bound up with capitalist societies. Under this patriarchal system, women were servants and, effectively, prostitutes. Only Communism would herald the dawn of communal living and a new sexual freedom and, in turn, the role of the state would become superfluous.

In the last two decades the composition of the labor force in the United States has changed significantly. Today, most employeesare mothers or fathers of children under eighteen in families where both parents are employed or where the employed parent is a single mother. This represents a reversal of the older family ideal in which a father worked to provide income and a mother performed the domestic work that sustained families. The practices of business and much of the attention (...) of business ethicists have assumed the older ideal. However, the wage work of mothers raises serious concerns about how business should view their parent-employees. Business has responded with family friendly corporate policies. This article analyzes these policies in light of two particular values: The social equality of women and the well-being of families. Finding current policies inadequate to meet these values, this paper calls for renewed ethical attention to the issues of time demands on employees and just wages. (shrink)

ABSTRACTWe will present 12 different mixed metainferential consequence relations. Each one of them is specified using two different inferential Tarskian or non-Tarskian consequence relations: or. We will show that it is possible to obtain a Tarskian logic with non-Tarskian inferential logics, but also a non-Tarskian logic with Tarskian inferential logics. Moreover, we will show how some of these metainferential logics work better than the corresponding inferential rivals. Corporate social responsibility (CSR) is one of the ways through which companies gain legitimacy. However, CSR actions themselves are subject to public skepticism because of increased public awareness of greenwashing and scandalous corporate behavior. Legitimacy of CSR actions is indeed influenced by the actions of the company but also is rooted in the basic cultural values of a society and in the ideologies of evaluators. This study examines the legitimacy of CSR actions of publicly traded forest products companies as compared (...) to family-owned forest products companies. Results indicate a lower legitimacy for CSR actions of publicly traded companies than for family-owned companies. The study also examines the effect of social responsibility orientation (SRO) of evaluators on the legitimacy accorded to companies' CSR actions. We found that SRO was negatively associated with legitimacy, especially for women. Perceived profitability of companies was negatively associated with legitimacy of CSR actions for publicly traded but not for family-owned companies. (shrink)

The inclusion of morally binding values such as religious—or in a broader sense, spiritual—values fundamentally alter organizational decision-making and ethical behavior. Family firms, being a particularly value-driven type of organization, provide ample room for religious beliefs to affect family, business, and individual decisions. The influence that the owning family is able to exert on value formation and preservation in the family business makes religious family firms an incubator for value-driven and faith-led decision-making and behavior. They (...) represent a particularly rich and relevant context to re-assess the relationship between ethical beliefs, decision-making processes and behaviors in business organizations at the interface between family and professional logics. This Special Issue is dedicated to deepening our understanding of the role religious values and spirituality play in the formation of organizational ethical practices in faith-led family firms and resulting organizational and family-related outcomes. In this editorial, we introduce the 10 papers included in this Special Issue, which investigate the relationship between religion or spirituality and family firm ethical behavior in various geographical, cultural and religious contexts, using a multitude of qualitative and quantitative methodologies. By focusing on the effects of religious or spiritual orientations on both the business and the family, as well as on the values, norms and goals present in the family business system, further research can gain a more nuanced understanding of the relationship between religious and spiritual believes, and sustainable ethical behavior in family firms. While downsizing has been widely studied, its connection to firm ownership status and the reasons behind it are missing from extant research. We explore the relationship between downsizing and family ownership status among Fortune 500 firms. We␣propose that family firms downsize less than non-family firms, irrespective of performance, because their relationship with employees is based on normative commitments rather than financial performance alone. We suggest that their actions are related to employee- and community-friendly policies. We find that (...) family businesses do downsize less irrespective of financial performance considerations. However, their actions are not related to their employee- or community-friendly practices. The results raise issues related to the motivations of large multinationals to␣downsize and the drivers of their stakeholder management practices. (shrink)

Nursing Inquiry 2010; 17: 221–230A critical analysis of health promotion and ‘empowerment’ in the context of palliative family care-givingTraditionally viewed as in opposition to palliative care, newer ideas about ‘health-promoting palliative care’ increasingly infuse the practices and philosophies of healthcare professionals, often invoking ideals of empowerment and participation in care and decision-making. The general tendency is to assume that empowerment, participation, and self-care are universally beneficial for and welcomed by all (...) individuals. But does this assumption hold for everyone, and do we fully understand the implications of health-promoting palliative care for family caregivers in particular? In this study, we draw on existing literature to highlight potential challenges arising from the application of ‘family empowerment’ strategies in palliative home-care nursing practice. In particular, there is a risk that empowerment may be operationalized as transferring technical and medical-care tasks to family caregivers at home. Yet, for some family caregivers, a sense of security and support, as well as trust in professionals, may be equally if not more important than empowerment. Relational and role concerns may also at times take precedence over a desire for empowerment. The potential implications of ‘family empowerment’ are explored in this regard. ‘Family empowerment’ approaches need to be accompanied by a strong understanding of how to best support individual palliative family caregivers. This note attempts first to broaden the investigation of ties expressed by ?my? and ?mine?, which was initiated in ?The Concept of ?Mine?; ? (Inquiry, Vol. 7, No. 3). Socially accepted types of use ties (active and passive), worth ties and other sorts are distinguished from the previously noted ties of ownership, agency, etc. These further distinctions of ties, it is argued, also deserve the attention of philosophers and conceptually oriented social scientists. The Confucian tradition is often held to have accorded the family a prominent place in their ethics. This paper distinguishes three different senses in which the family is held to be primary in Confucian morality. It then explores Hsun Tzu's views on the family and familial relations. I argue that, while other early Confucians such as Confucius and Mencius would have held the family to be primary in all three senses, Hsun Tzu held the family (...) to be primary in only one of the three senses. In particular, there is textual evidence that Hsun Tzu holds that one's primary obligation is to the ruler of the state, rather than to the immediate family. (shrink)

The idea of moral blackmail can seem paradoxical, but moral blackmail is a coherent and indeed a familiar phenomenon. It has special significance for our intimate personal relationships and is often a force within family dynamics.
