When we say that someone knows something we are making a value judgment—we are saying that there is something intellectually good or right about the person’s belief, or about the way she believes it, or perhaps about her. We are saying, for example, that her belief is intellectually better than someone else’s mere opinion. Notice that we might make this sort of value judgment even if the two persons agree. Suppose that two people agree that the earth is the third (...) planet from the sun. Nevertheless, we might think that one person knows this while the other person merely believes it. If so, we are making a value judgment—we are saying that there is something intellectually better going on in the case of knowledge. Another way to put the point is to say that knowledge is a normative notion. There is something normatively better about the case of knowledge, as opposed to the case of mere opinion, or even the case of true opinion. Finally, saying that someone knows something is not the only sort of value judgment we can make about her belief. Even if we agree that some belief falls short of knowledge, we might nevertheless judge that it is justified, or rational, or reasonable, or responsible. This essay suggests that the accountability trends explored by Stian Øby Johansen and Gisela Hirschmann in their respective monographs should be viewed as indicating the emergence of a right to justification in global governance. Both Johansen and Hirschmann seek to advance the interdisciplinary conversation about the accountability of international organizations—Johansen by developing a normative framework assessing the quality of IO accountability mechanisms, and Hirschmann by seeking to identify the variables that shape the evolution of what she calls pluralist accountability. Recent years have seen a number of interpreters defend the claim that Nietzsche’s perspectivism is an epistemological doctrine. This interpretation of perspectivism leads to the worry that Nietzsche cannot offer any arguments for his view by means of which he may convince his opponents. To rescue Nietzsche from this justificatory problem, some interpreters have recently turned to the notion of “internal reasons,” or reasons that have force within multiple perspectives because they are based on shared standards. In this paper (...) I show that the task for supporters of Nietzsche is considerably more complex than it may seem at first sight. I argue that there is no way to know in advance of empirical investigation on a case-by-case basis whether perspectivism can be saved from undermining any compelling reasons that Nietzsche might provide in its defense. Justification as Ignorance offers an original account of epistemic justification as both non-factive and luminous, vindicating core internalist intuitions without construing justification as an internal condition knowable by reflection alone. Sven Rosenkranz conceives of justification, in its doxastic and propositional varieties, as a kind of epistemic possibility of knowing and of being in a position to know. His account contrasts with recent alternative views that characterize justification in terms of the metaphysical possibility of knowing. (...) Instead, he develops a suitable non-normal multi-modal epistemic logic for knowledge and being in a position to know that respects the finding that these notions create hyperintensional contexts. He also defends his conception of justification against well-known anti-luminosity arguments, shows that the account allows for fruitful applications and principled solutions to the lottery and preface paradoxes, and provides a metaphysics of justification and its varying degrees of strength that is compatible with core assumptions of the knowledge-first approach and disjunctivist conceptions of mental states. This comment questions the relevance of the Stag Hunt model, employed by Alan Hyde in his contribution to this volume, to the context of international labor standards. Despite Hyde's insistence to the contrary, it is argued that in some cases child labor could create a comparative advantage to developing countries. This shows the difficulty with Hyde's reliance solely on market failures to justify international labor standards. The exclusion of other justifications results in an extremely diluted international labor law.

The internalism-externalism debate is one of the oldest debates in epistemology. Internalists assert that the justification of our beliefs can only depend on facts internal to us, while externalists insist that justification can depend on additional, for example environmental, factors. Clayton Littlejohn proposes and defends a new strategy for resolving this debate. Focussing on the connections between practical and theoretical reason, he explores the question of whether the priority of the good to the right might be used (...) to defend an epistemological version of consequentialism, and proceeds to formulate a new 'deontological externalist' view. On this view, the justificatory status of a belief depends upon whether it is fit for the purposes of practical reasoning. Only beliefs that meet externalist standards are fit for such a purpose. If we want to understand how a wide range of norms (e.g., moral norms) apply to rational agents regardless of what their evidence or outlook is like, we have to embrace an externalist account of the justification. The analysis presented here lays out the ethical warrants for requiring community oversight of health research conducted in international settings. It reviews the inadequacies with the current standards of individual informed consent and research ethics committee review, and then, shows how a broader population-based public health perspective raises new demands on justice involving due consideration of the rights, harms and benefits to the community as a whole. As developed here, an ethical standard that requires community oversight of health research is (...) justified on three principled grounds: respect for community autonomy and their right to self-determination; due consideration of the consequences of the research for the community as a whole; and, a more complete understanding of human autonomy. The paper concludes with practical recommendations regarding the composition of Community Advisory Boards to ensure that they have legitimate decision-making authority in diverse socio-cultural contexts. Temporal justification logic is a new family of temporal logics of knowledge in which the knowledge of agents is modelled using a justification logic. In this paper, we present various temporal justification logics involving both past and future time modalities. We combine Artemov’s logic of proofs with linear temporal logic with past, and we also investigate several principles describing the interaction of justification and time. We present two kinds of semantics for our temporal justification logics, (...) one based on interpreted systems and Fitting models and the other based on Mkrtychev models, and further, we establish soundness and completeness. We show that the internalization property holds in some of the temporal justification logics. We further investigate the two well-known epistemic-temporal notions of no forgetting and no learning in the framework of justification logics. The Ozawa’s intersubjectivity theorem (OIT) proved within quantum measurement theory supports the new postulate of relational quantum mechanics (RQM), the postulate on internally consistent descriptions. But from OIT viewpoint postulate’s formulation should be completed by the assumption of probability reproducibility. We remark that this postulate was proposed only recently to resolve the problem of intersubjectivity of information in RQM. In contrast to RQM for which OIT is a supporting theoretical statement, QBism is challenged by OIT.

Internalization is a key property of justification logics. It states that justification logics internalize their own notion of proof which is essential for the proof of the realization theorem. The aim of this note is to show how to make use of internalization to track where an agent’s knowledge comes from and how to apply this to the problem of data privacy.

Alexander Bird and Darrell Rowbottom have argued for two competing accounts of the concept of scientific progress. For Bird, progress consists in the accumulation of scientific knowledge. For Rowbottom, progress consists in the accumulation of true scientific beliefs. Both appeal to intuitions elicited by thought experiments in support of their views, and it seems fair to say that the debate has reached an impasse. In an attempt to avoid this stalemate, we conduct a systematic study of the factors that underlie (...) judgments about scientific progress. Our results suggest that (internal) justification plays an important role in intuitive judgments about progress, questioning the intuitive support for the claim that the concept of scientific progress is best explained in terms of the accumulation of only true scientific belief. The author discusses a question related to a certain aspect of justification of legal decisions, often so-called internal justification-a legal decision is internally justified if and only if it can be deduced from the norm(s) applicable to the case, and from the statement(s) describing the facts of the case. According to this notion, infinite irrelevant logical consequences are justified. To avoid this counterintuitive conclusion, the author analyzes three notions of relevance: Sperber-Wilson's notion, Anderson-Belnap's notion, and Schurz's notion. (...) The author presents a reconstruction of the notion of relevance very close to Schurz's notion, extended to make it suitable to the particular characteristics of deontic logic. Justification logics are modal-like logics that provide a framework for reasoning about justifications. This paper introduces labeled sequent calculi for justification logics, as well as for combined modal-justification logics. Using a method due to Sara Negri, we internalize the Kripke-style semantics of justification and modal-justification logics, known as Fitting models, within the syntax of the sequent calculus to produce labeled sequent calculi. We show that all rules of these systems are invertible and the structural rules (...) (weakening and contraction) and the cut rule are admissible. Soundness and completeness are established as well. The analyticity for some of our labeled sequent calculi are shown by proving that they enjoy the subformula, sublabel and subterm properties. We also present an analytic labeled sequent calculus for S4LPN based on Artemov–Fitting models. (shrink)

This paper will develop ideas from [44]. We will generalize their work in two directions. First, we provide axioms for justification logics over the base logic B and show that the logic permits a proof of the internalization theorem. Second, we provide alternative frames that more closely resemble the standard versions of the ternary relational frames, as well as a more general approach to the completeness proof. We prove that soundness and completeness hold for justification logics over a (...) wide variety of base logics. Finally, we will strengthen Belnap’s variable sharing for the justification logic context, demonstrating that the justifications are properly relevant justifications. (shrink)

I begin by asking the meta-epistemological question, 'What is justification?', analogous to the meta-ethical question, 'What is rightness?' I introduce the possibility of non-cognitivist, naturalist, non-naturalist, and eliminativist answers in meta-epistemology,corresponding to those in meta-ethics. I devote special attention to the naturalistic hypothesis that epistemic justification is identical to probability, showing its antecedent plausibility. I argue that despite this plausibility, justification cannot be identical with probability, under the standard interpretation of the probability calculus, for the simple reason (...) that justification can increase indefinitely but probability cannot. I then propose an alternative model for prima facie justification, based on an analogy with Ross's account of prima facie obligation, arguing that this model illuminates the differences between justification and probability and, given the plausible assumption of epistemic pluralism, explains them as well. The paper explores a structural account of propositional justification in terms of the notion of being in a position to know and negation. Combined with a non-normal logic for being in a position to know, the account allows for the derivation of plausible principles of justification. The account is neutral on whether justification is grounded in internally individuated mental states, and likewise on whether it is grounded in facts that are already accessible by introspection or reflection alone. (...) To this extent, it is compatible both with internalism and with externalism about justification. Even so, the account allows for the proof of principles that are commonly conceived to depend on an internalist conception of justification. The account likewise coheres both with epistemic contextualism and with its rejection, and is compatible both with the knowledge-first approach and with its rejection. Despite its neutrality on these issues, the account makes propositional justification luminous and so is controversial. The article deals with the problem of moral justification of humanitarian intervention by modern just war theorists. At the beginning of the article, we discuss the evolution of the dominant paradigms of the moral justification of war and explain why the theory and practice of humanitarian intervention appears only at the present stage of the development of ethics and the law of war. It is noted that theorization of humanitarian intervention began in the last decades of the 20thcentury. (...) This is due to a significant transformation, a retreat in the legal and ethical studies of war from the position of radical condemnation of aggressive actions and the recognition of the political subjectivity of non-state groups. Thus, there is a rethinking of the long tradition, the Westphalian system of international relations, according to which the state was recognized as the main participant of big politics, and its sovereign right to conduct domestic policy was considered indisputable. Further, we take the works of Michael Walzer as the main source of modern conceptualization of the ethics of humanitarian interventionism, since Walzer repeatedly addressed this topic and formulated a position on this issue that is representative of the entire modern Just War Theory. The arguments of Walzer and his supporters in favor of the moral justification of humanitarian intervention are considered. Among them are the following. First, the argument about the state as an organization which goal is to protect the rights of its own citizens. If this goal is not not achieved, the state shall loose its power over these people and in this territory. Second, Walzer calls for identifying governments and armed forces involved in mass murders as criminal and, therefore, deserving of punishment. Finally, there is, perhaps the most important, demonstrative argument: an appeal to the self-evident impossibility to stand aside in cases of mass violence in any state. This is followed by a critique of these arguments, as well as a demonstration of how the modern Just War Theory can respond to these criticisms. (shrink)

Hybrid logics internalize their own semantics. Members of the newer family of justification logics internalize their own proof methodology. It is an appealing goal to combine these two ideas into a single system, and in this paper we make a start. We present a hybrid/justification version of the modal logic T. We give a semantics, a proof theory, and prove a completeness theorem. In addition, we prove a Realization Theorem, something that plays a central role for justification (...) logics generally. Since justification logics are newer and less well-known than hybrid logics, we sketch their background, and give pointers to their range of applicability. We conclude with suggestions for future research. Indeed, the main goal of this paper is to encourage others to continue the investigation begun here. (shrink)

This paper proposes a novel method for identifying the public evaluative standards that contribute to the classification of certain conditions as mental disabilities. Public evaluative standards could contribute to ascertaining disabilities by outlining characteristics whose presence beyond a threshold is fundamentally important for the life of a person and whose absence or reduced occurrence constitutes a disability. Additionally, they can participate in determining disabilities by delineating particularly grave difficulties, impairments, or incapacities. Our method relies on a model of public (...) class='Hi'>justification of evaluative standards that is inspired by Gerald Gaus’s theory of public reason. Thus, our approach recommends the justification of evaluative standards through sound deliberative routes from reasons accessible to all persons who participate in the process of justification and the convergence of what is justified in this way to each of them. We deem that disabilities could be caused both by problems in the internal characteristics of a person as well as by unfairness or a lack of hospitality in external circumstances. This is why the method of justification is applied to the assessment of those circumstances as well. If social or environmental circumstances cannot be justified through the convergence of reasons accessible to all persons involved in the process of justification, we have reasons to exclude the presence of a disability and ascertain the presence of inadequate external conditions. Much of present-day epistemology is divided between internalists and externalists. Different as these views are, they have in common that they strip justification from its dialectical component in order to block the skeptic’s argument from disagreement. That is, they allow that one may have justified beliefs even if one is not able to defend it against challenges and resolve the disagreements about them. Lammenranta (2008, 2011a) recently argued that neither internalism nor externalism convinces if we consider the argument in (...) its most interesting format. In this paper I zoom in on this debate, and fix further details of Lammenranta’s lead. He argues that a realist philosophy of science both reflects the character of science and scientific justifications, and suggests that religious belief could be given a justification of (...) the same sort. What grounds and justifies conclusions in medical ethics? Is the source external or internal to medicine? Thee influential types of answer have appeared in recent literature: an internal account, an external account, and a mixed internal / external account. The first defends an ethic derived from either the ends of medicine or professional practice standards. The second maintains that precepts in medical ethics rely upon and require justification by external standards such as those of public opinion, (...) law, religious ethics, or philosophical ethics. The third claims that distinct medical ethics have emerged from distinct cultural frameworks, each with norms that govern physicians. There is merit in each perspective, but each overreaches its supporting arguments and fails to appreciate what is legitimate in the theses of its competitors. I propose a fourth account that offers a way to escape limitations of the other three, while retaining their most attractive features. (shrink)

In this article I present a new perspective on the theological concept of justification, by focusing not on the content but on the form of this concept. I start with the semantic overabundance related to justification, with specific reference three meanings: the forensic, the effective, and the ontological-theotic. Then, I confront these meanings with Luther's idea of justification as in his De servo arbitrio. Thanks to this, I stress that the theological concept of justification plays a (...) meta-conceptual function: it affirms the priority of divine justification over any standard condition of conceptualization and thinkability of justification – in specific, the structure of imputative justice. In two papers in the previous issue of the Kennedy Institute of Ethics Journal, I contend that the form of principlist fundamentalism endorsed by American bioethicists like Tom Beauchamp and Ruth Macklin will not play on an international stage. Deploying techniques (...) of postmodern scholarship, I argue that principlist fundamentalism justifies neither the condemnation of the Nazi doctors at Nuremberg, nor, as the Report of the Advisory Committee on the Human Radiation Experiments (ACHRE) demonstrates, condemnation of Cold War radiation researchers. Principlist fundamentalism thus appears to be philosophically bankrupt. In this issue of the Journal, Beauchamp and Macklin reject this claim, arguing that I have misread the ACHRE report and misunderstood Nazism. They also argue that the form of post-postmodern negotiated human rights theory that I proffer is adequate only insofar as it is itself really fundamentalist; insofar as I take postmodernism seriously, however, I mire international bioethics in relativism. In this response, I reaffirm my anti-fundamentalism, provide further evidence in support of my reading of the ACHRE report, and defend my post-postmodern version of rights theory. I also develop criteria for a minimally adequate theoretical framework for international bioethics.Universal Morality Reconsidered 1Paradoxically, the need for content-full universal moral principles tends to be most deeply felt and most adamantly asserted in the face of striking evidence of their absence. People are inspired to claim that Nazis must accept the universal principle that doing harm is wrong because they are appalled by the horror of the Holocaust. Yet the event itself provides palpable evidence that the Nazis saw no wrong in doing harm. One has the suspicion that claims of universalism [End Page 423] confound philosophical aspirations with empirical observations. This distinction makes a significant difference because empirical claims can be disconfirmed by data, whereas philosophical claims can only be challenged on the level of theory.I am, like Tom Beauchamp and James Childress, a common morality theorist. Thus, I believe, as they do, that ethics “relies heavily on ordinary shared moral beliefs for its content, rather than relying on pure reason, natural law, a special moral sense, and the like” (Beauchamp and Childress 1994, p. 100). For most of human history sexism and slavery were considered moral. They certainly were the norm. Thus, if one looks to common morality as the source of moral content, empirical claims of moral universalism appear suspect. Insofar as one would condemn sexism and slavery, one needs to find some theoretical justification for condemnation that goes beyond a consensus on moral content (hence my embrace of the structural analogue of human rights theory).Beauchamp, however, takes a very different view. He asserts in his critique of my position, that: “it is an institutional fact about the substance of morality (not merely [as Baker claims] the formal features of the concept of morality and not merely my view of it) that it contains fundamental and shared precepts. It is by appeal to this shared moral substance that persons are enabled to make justifiable cross-temporal and cross-cultural judgments” (Beauchamp 1998, p. 395). Beauchamp is thus claiming that it is both an empirical and a conceptual truth there is common core underlying the morality of all societies. He fleshes this claim out in another passage.[T]he term morality refers to norms about right and wrong human conduct that are so widely shared that they form a stable... communal consensus.... These standards sometimes vary from society to society, but embedded in the beliefs of all moral societies are the core dimensions of morality: Persons must keep their promises, must respect the rights of others, must not kill or cause harm to innocent persons, must not abuse children, and the like. Contextualism in philosophy of language and in epistemology are two distinct but closely entangled projects. The epistemological thesis is grounded in a semantic claim concerning the context-sensitivity of the predicate “know”: we gain insight into epistemological problems by investigating our linguistic intuitions concerning knowledge attribution sentences. Our aim here is to evaluate the plausibility of a project that takes the opposite starting point: the general idea is to establish the semantic contextualist thesis on the epistemological one. According to semantic contextualism, (...) virtually no sentences of a natural language express complete propositions – meaning underdetermines truth conditions. In our paper, instead of assuming the traditional view of meaning in terms of truth conditions, we suggest that a theory of meaning as justification may shed new light on the contextualist approach. We thus show how the notion of justification can be contextualized, arguing that our attempt provides an interesting and quite straightforward way of contextualizing meaning. (shrink)

Institutionalized practices of collective justification are central for theorizing international fairness. Institutions matter because they play a significant part in the construal of fairness claims through the provision of internal standards for moral assessment. Conceptions of international fairness must spell out how collective justification works by addressing the jurisprudential and institutional issues at stake in the specification of the moral grounds for compliance with international institutions on the one hand and international civil disobedience on the other. Theoretical (...) models of institutions that do not pay attention to collective justification are inadequate on fairness grounds. More specifically, mainstream neoliberal institutionalist accounts of international regimes are deeply problematic when used in the normative evaluation of international institutions, as they offer the wrong benchmark for moral assessment, given their roots in a brand of exchange theory that is blind to the distribution of burdens and benefits from cooperation. This paper distinguishes between the concepts of justification and legitimation with a view to offering a normative standard for global justice compatible with cultural pluralism. According to this distinction, justification is presented as an idealized, substantive and top-down enterprise rooted in the moral and metaphysical substrate of a specific culture. On the other hand, legitimation has a procedural and factual connotation and derives its strength from the success of some culturally independent but historically situated practice (bottom-up approach). Starting from the trans-Atlantic divide on the issue of justification of force which became obvious after 9/11, it is argued that the differences between the Anglo-American and Continental-European standard arguments can be overcome by a moderate institutionalist cosmopolitanism. It combines a moderate institutionalist approach with a comprehensive concept of human rights and a moderate cosmopolitan stand on the issue of international distributive justice. If all three aspects are taken into account adequately in an ethical theory of international relations, both (...) the Anglo-American traditions of just war theory and a radical Kantian legalism must be revised and common ground could be revealed. This paper aims to check some Nussbaum’s reviews, in Hiding from Humanity, about Mill’s conception of liberty. The analysis frame is given by constant tension between the utilitarian justification and the justification based on per se value of liberty. This article wants to support the following hypothesis: Millean liberty cannot be criticized for reducing its value to instrumental terms. On the contrary, in order to be loyal with Mill, liberty has a double justification: one based on its (...) utilitarianism and another based on its intrinsic value. We use Bernard Williams’s suggestion about the intrinsic value of human goods for supporting the latter. He proposed an important criterion to demonstrate the intrinsic value: coherent relation with other values and other human necessities. “Having a moral right” in private and public debates probably is one of the most important arguments to bring some foundation to one’s claims. Within international law and politics, for example, one easily falls back on universal “human rights”, especially if neither a more subtle moral argument nor prudential reasons find a hold. But in some contrast to this agreement on the strong practical relevance of rights, both the conceptual analysis and normative justification of rights are rather controversial in (...) moral philosophy. There is, perhaps, a consensus on a constructivist understanding of rights, that is that rights have to be constructed from a basis of more “elementary parts” of morality. There is no agreement, however, on the exact character of these parts and their normative import within an overall construction of rights. It seems to be clear somehow that rights have to secure and promote interests — of a human and animal kind. Not so clear is the kind of foundation rights can be given within the sphere of interests, especially if this is understood in a reductive sense. It is in the interest of all beings to have their interests secured and furthered by rights. The philosophical import of the chariot images found in the Katha Upanishad and the Phaedrus is considered here. It is claimed that the resemblance in the accounts provided in these disparate texts is not merely incidental. Rather, each chariot-image should be read as contributing to a careful answer to the same thorny philosophical problem: the identification and justification of the best life for the individual. It is argued that each serves to illuminate an internal and complex account of (...) the self, which grounds and supports an effective rejection of the life spent in pursuit of the satisfaction of bodily desires in favor of the life spent in pursuit of wisdom. Philosophers have said surprisingly little about academic freedom, considering how central it is to liberal societies. This article takes a holistic approach to the topic by developing a framework for philosophical analyses of academic freedom. It treats the definition, extent, and justification of academic freedom, arguing in favor of an individualist account thereof. The complete theory is constructed using the same methods and moral arguments as in analyses of other liberal freedoms, such as freedom of speech and association, which (...) means that the account is fully integrable in all liberal societies. Through both a conceptual analysis of historical evidence in general, and a specific study of Thucydides' evidence on the Peloponnesian war, the structure of justification of historical knowledge is described and evaluated. The justification is internal in the sense of being done entirely within a network of evidential and descriptive claims about the past. This forces a coherence form of justification in which the telling epistemic standards are eliminative, indicators of what is not likely to be (...) true rather than what is. The epistemological contrast is between justification by coherence among historical claims, or by appeal to epistemic foundations. Any evidential claim in history that is informative and credible must itself be justified in the context of other things known about the past. Thus, the evidence used to support historical claims is neither foundational nor a direct report on the facts of the past, and an appeal to evidence is itself an appeal to coherence. (shrink)

Roger Shepard's proposals and supporting experiments concerning evolutionary internalized regularities have been very influential in the study of vision and in other areas of psychology and cognitive science. This paper examines issues concerning the need, nature, explanatory role, and justification for postulating such internalized constraints. In particular, I seek further clarification from Shepard on how best to understand his claim that principles of kinematic geometry underlie phenomena of motion perception. My primary focus is on the ecological validity of Shepard's (...) kinematic constraint in the context of ordinary motion perception. First, I explore the analogy Shepard draws between internalized circadian rhythms and the supposed internalization of kinematic geometry. Next, questions are raised about how to interpret and justify applying results from his own and others' experimental studies of apparent motion to more everyday cases of motion perception in richer environments. Finally, some difficulties with Shepard's account of the evolutionary development of his kinematic constraint are considered. Thinkers justify their views in a variety of ways. Operating in an alien intellectual milieu, the early Confucian Xunzi provides an intriguing counterpoint to familiar contemporary options for such reasoned support. This essay examines an idea thatis crucial to Xunzi’s justification of his larger philosophical vision, and which has been the object of incompatible and misleading interpretations. This key term of art is li, meaning “order” or “pattern,” which some scholars have translated as “principle,” and others more recently as (...) “reason” or “rationale.” Examining how, for Xunzi, li never means “reason” in the sense of a faculty of the mind, or a warrant for an action or belief, nor “rationale” in the sense of a justifying account, helps us to grasp the distinctive ways he conceived of thinking and arguing. The “dead-donor rule” states that, in any case of vital organ donation, the potential donor should be determined to be dead before transplantation occurs. In many countries around the world, neurological criteria can be used to legally determine death (also referred to as brain death). Nevertheless, there is considerable controversy in the bioethics literature over whether brain death is the equivalent of biological death. This international legal review demonstrates that there is considerable variability in how different jurisdictions have evolved to (...) justify the legal status of brain death and its relationship to the dead-donor rule.In this article, we chose to review approaches that are representative of many different jurisdictions—the United States takes an approach similar to that of many European countries; the United Kingdom’s approach is followed by Canada, India, and influences many other Commonwealth countries; Islamic jurisprudence is applicable to several different national laws; the Israeli approach is similar to many Western countries, but incorporates noteworthy modifications; and Japan’s relatively idiosyncratic approach has received some attention in the literature. Illuminating these different justifications may help develop respectful policies regarding organ donation within countries with diverse populations and allow for more informed debate about brain death and the deaddonor rule. This paper presents a justification counterpart for dyadic deontic logic, which is often argued to be better than Standard Deontic Logic at representing conditional and contrary-to-duty obligations, such as those exemplified by the notorious Chisholm’s puzzle. We consider the alethic-deontic system (E) and present the explicit version of this system (JE) by replacing the alethic Box-modality with proof terms and the dyadic deontic Circ-modality with justification terms. The belief that every dialogue has a single _skopos_ and that every aspect of the dialogue can be seen as subserving that _skopos_ is one of the most distinctive of the Neoplatonists’ intepretive principles. 1 It is also the one that is most directly responsible for the forced and artificial character of their (...) readings of Plato. The arguments offered in support of this principle are manifestly inadequate to justify the role that it plays. This is so even if we evaluate those arguments by the Neoplatonists’ own lights. If we want to understand how this practice seemed rational to them, we need to consider more than their texts and Plato’s. We need to consider the role that the shared act of reading a Platonic dialogue with the teacher had in transforming the souls of the students and in the self-understanding of Neoplatonic teachers. I. Hadot, among others, has argued that the continuous commentary was a kind of spiritual exercise. 2 I largely agree with her conclusion, though I believe her analysis of the sense in which these were spiritual exercises needs to be deepened. I argue that the justification for the assumption that each dialogue has a single _skopos_ is best understood by reference to the manner in which the practice of commentary functioned within the internal economy of their schools considered as textual communities. 3.
