Resumen: De las muchas posibilidades de lectura de Antígona de Sófocles destacamos la naturaleza del conflicto trágico, que tiene sus raíces en valores anteriores al orden social establecido y que puede considerarse material útil para una refundación del estatuto político en la posmodernidad. A partir del comentario de texto señalamos que Antígona no atenta contra el orden social, sino que espera consolidarlo en un fundamento imperturbable; que encarna la crítica de la racionalidad instrumental, inaugurada por la sofística y reavivada sucesivamente (...) en la modernidad; que afirma existencialmente una ética del amor fraterno como humanización del orden del universo. Proponemos ampliar la noción de hermano consanguíneo y extenderla a la idea de hermano como “el otro” en el marco de las sociedades posmodernas, espacios de intención multicultural, para tener un principio de rescate ético. En esta re-lectura se actualizan las nociones arcaicas de religiosidad, honra fúnebre y piedad familiar.: Of the many possible readings of Sophocles' Antigone, we highlight the nature of the tragic conflict, which has its roots in previous values to the established social order, and which can be considered useful material for re-founding the political status in postmodernity. From the text commentary, we note that Antigone does not attack the social order, but she hopes to consolidate it on an imperturbable basis that embodies the critique of instrumental rationality, inaugurated by sophistry and revived successively in modernity. This affirms existentially the ethics of fraternal love as a humanization of the order of the universe. We propose to extend the notion of consanguineous brother and extend it to the idea of brother as “the other” in the framework of postmodern societies, spaces of multicultural intention, to have a principle of ethical rescue. In this re-reading, the archaic notions of religiosity, funeral honor, and family piety are updated. (shrink)

This article aims to explore the concept of Heaven and St. Thomas Aquinas I "Summa Theologica" explained the basis of natural law and metaphysics. Then, on the Heaven and the natural law itself for comparison. Finally, the two can be dealt with through the office, and, and related concepts in Taoism. The basic concern of this paper is to compare Laozi's Heavenly Dao and St. Thomas' natural law for the purpose of bringing them to dialogue. Philosophically speaking, Laozi's concept of Dao means first, the ever self-manifesting and creative Ultimate Reality; second, the Origin giving birth to all things; third, the law of becoming of all things in the universe. For this last meaning, usually Laozi uses the term "Heavenly Dao" to represent laws of nature that all beings in the universe, including human beings , must comply with. As to human laws, he takes a critical position, to the point of saying that "The more legal objects multiply, the more robbers and thieves there will be." Nevertheless, under his influence, Huanglao daoists and legalists have developed their philosophy of positive laws.In Comparison, St. Thomas' natural laws are principles of human action according to human rational nature. The emphasis of St. Thomas is put therefore on the rational nature of human beings, which includes both the aspect of "to be" and that of "ought to be," both being closely related yet distinct. Seen from "to be," the natural law says that all human beings desire goodness by their nature; while as their "ought to be," all human beings should do good and avoid doing evil.This comparative study will focus first on how the generosity of Dao's giving birth to all things in Laozi and the wisdom and love of God in St. Thomas become order and law. Then we will compare Laozi's laws of nature, to which human beings should also live accordingly, with techniques inspired from them, and the principles of St. Thomas' natural laws. We will discuss the possible compatibility and dialogue between St. Thomas thoughts, which are essential to Catholicism , and those of Laozi as followed by lluanlao Daoism and Religious Daoism. For Thomas Aquinas, the creator of natural law is a personal, substantial, and relational God. For Laozi, it is an impersonal, non-substantial, self-manifesting dao. There are similarities, and this article will consider several of them. For Thomas, the act of creation comes from God, and for Laozi the giving birth of the universe is from the dao’s unconditional generosity. Thus it is possible to compare the way in which the world-originating generosity of God generates the moral law and the way (...) in which the self-manifesting dao generates the moral law. In Thomas’s view the natural law is the rational participation of the human being in God’s eternal law. Laozi’s heavenly dao governs all things in the universe, and for this reason human beings and their techniques should comply with dao. Thomas emphasizes human freedom of will and the responsibility to pursue what is good and to avoid what is evil. Laozi emphasizes the objectivity of heavenly dao without any reference to human freedom of will or individual responsibility. With religious Daoism there develops the idea of collective responsibility and the divinization of dao, a point that invites further comparative study of Thomism and Daoism. (shrink)

Abstract:Through an intercultural dialogue—Chinese and Western—this article explores the possibility of building cultural diversity and pluralism in philosophy. It focuses, first, on building a dialogue between Levinas' and Zhu Xi's apparent (philosophical) affinity for ethics at the level of meaning of the concept of transcendence in the Neo-Confucian and Levinasian ethical contexts and, second, on uncovering and analyzing the inapparent differences at the level of cultural presuppositions on which this apparent affinity is based. I offer that both Levinas and Zhu (...) Xi distinguish the impulse to care for the other—out of which the human relationship emerges—as rooted not in the ontological self but in an ethical transcendence: the other's face (Levinas) and the human authentic nature as mandate of heaven (Zhu Xi). A short piece exploring some arguments for mandating vaccination for Covid-19.

Scholars celebrate Dietrich Bonhoeffer as a "prophet of justice for the oppressed" who identified the need "to see the great events of world history from below." But few address the thorniest aspect of Bonhoeffer's ethics for the marginalized: the mandates or divine commissions in church, marriage, work, and government made concrete within certain orders of relationship and authority. Bonhoeffer's marriage mandate poses particular problems as it reinforces unjust social structures. Fortunately, striking similarities between Bonhoeffer's ethics and feminist thought—attention to (...) concrete contexts, the role of emotion in moral reasoning, opposition to harmful dualisms, and emphasis on relationality—suggest that feminists are well-placed to critique and reconstruct Bonhoeffer's account. Construing the mandates as contexts for "genuine communities of argument" repurposes them to combat rather than condone injustice. (shrink)

Qing, it is argued, are intersubjective, socio-culturally produced non-sensory data that act on the heart-mind and serve as the foundation for moral behavior. Qing is encoded in cultural forms such as Music (...) and poetry. Hence, there is an internal relationship between qing, xin, and xinshu. Correctly understanding the connection between these and how they shape the human being will help elucidate the nature of the Confucian moral program. In foregrounding qing, this paper presents Confucian moral philosophy as grounded in a hermeneutic and sympathetic understanding of the perspective of the other. (shrink)

Employment-based vaccine mandates have worse consequences for existing than prospective employees. Prospective employees are not yet dependent on a particular employment arrangement, so they are better positioned to respond to such mandates. Yet despite this asymmetry in consequences, Smith argues that if vaccine mandates are justified for prospective employees, they are similarly justified for existing employees. This paper responds to Smith’s argument. First, Smith holds that bona fide occupational requirements are actions that are necessary for the safe and effective completion (...) of one’s job. As such, they apply to existing and prospective employees alike. However, I argue that the existence of effective alternative interventions precludes vaccination from being considered a bona fide occupational requirement under current circumstances. Second, Smith holds that if a requirement is justified for prospective employees, it is justified for existing employees, despite the asymmetry in consequences. However, I argue that since vaccination is not a bona fide requirement, the asymmetry in the harms of mandates experienced by prospective versus existing employees entails an asymmetry in the justification required to mandate vaccination for each group. As such, vaccination can be considered a requirement for prospective employees while not being required for existing employees. (shrink)

I critically examine a common liberal egalitarian view about the justification for, and proper content of, mandatory health insurance. This view holds that a mandate is justified because it is the best way to ensure that those in poor health gain health insurance on equitable terms. It also holds that a government should mandate what a representative prudent individual would purchase for themselves if they were placed in fair conditions of choice. I argue that this common justification for (...) a mandate is incomplete. A further reason for mandated insurance is that it helps secure social egalitarian public goods that would be underprovided if insurance were optional. I also argue that rather than mandating what a representative individual would choose for themselves, we should design the mandatory package by appealing to a pluralistic egalitarian view, which cares about improving people’s well-being, reducing unfair inequality, and maintaining egalitarian social relations. A central part of Frege's logicism is his reconstruction of the natural numbers as equivalence classes of equinumerous concepts or classes. In this paper, I examine the relationship of this reconstruction both to earlier views, from Mill all the way back to Plato, and to later formalist and structuralist views; I thus situate Frege within what may be called the “rise of pure mathematics” in the nineteenth century. Doing so allows us to acknowledge continuities between Frege's and other approaches, but (...) also to understand better the motivation and the significance of his innovations, as well as their limits. For centuries, natural law was the main philosophical legal paradigm. Now, it is a wonder when a court of law invokes it. Arthur Kaufmann already underlined a modern general "horror iuris naturalis". We also know, with Winfried Hassemer, that the succession of legal paradigms is a matter of fashion. But why did natural law become outdated? Are there any remnants of it still alive today? This book analyses a number of prejudices and myths that have created a general misconception of (...) natural law. As Jean-Marc Trigeaud put it: there is a natural law that positivists invented. Not the real one(s). It seeks to understand not only the usual adversaries of natural law (like legalists, positivists and historicists) but also its further enemies, the inner enemies of natural law, such as internal aporias, political and ideological manipulations, etc. The book puts forward a reasoned and balanced examination of this treasure of western political and juridical though. And, if we look at it another way, natural law is by no means a loser in our times: because it lives in modern human rights. (shrink)
