Seeing aspects is a dominant theme in Wittgenstein's 1940s writings on philosophy of psychology. Interpreters disagree about what Wittgenstein was trying to do in these discussions. I argue that interpreting Wittgenstein's observations about the interrelations between “noticing an aspect” and other psychological concepts as a systematic theory of aspect-seeing diminishes key lessons of Wittgenstein's explorations: these interrelations are enormously complicated and “noticing an aspect” resists neat classification. Further, Wittgenstein invites us to engage in his “placing activity,” and (...) by doing so we are building a skill that is valuable for enabling us to help ourselves when we encounter conceptual difficulties. The founding articles of the discipline – such classic pieces as Ronald Coase’s “The problem of social cost” (1960), Richard Posner’s “A theory of negligence” (1972) and Guido Calabresi and Douglas Malamed’s “Property rules, liability rules, and inalienability: One view of the cathedral” (1972) – offered economic analyses of familiar (...) class='Hi'>aspects of the common law, seeking to explain, in particular, fundamental features of the law of tort in terms of such economic ideas as transaction costs (Coase), Kaldor-Hicks efficiency (Posner), or minimizing the sum of the accident costs and avoidance costs (Calabresi and Malamed). In each case, they argued that the law of torts should be understood as a set of liability rules selected for their incentive effects, rather than as a set of substantive rights and remedies for their violation. These authors claimed to be able to explain most of the features of tort law and, where features were found that did not fit with their preferred explanations, recommended modification. Although they disagreed on important questions,1 each of the pieces seems to work a manageable structure into what strikes first-year law students as an otherwise random morass of common-law judgments. Generations of legal academics were introduced to these works, and drawn into their way of looking at things. As a student studying first-year torts with Calabresi at Yale, I had the sense that I was in the presence of greatness. (shrink)

The theoretical aspects and practical application of the termination of an employment contract upon an employee’s notice are analyzed in the paper. An employee can terminate an employment contract by his/her notice either without specifying any reason or due to some serious reasons. The problems of the regulation of the grounds for the exipiry of an employment contract are discussed and analyzed by comparison with the corresponding regulations in other European countries. Rulings of the Supreme Court of the Republic (...) of Lithuania are discussed to reveal the problems existing in practice. Conclusions and suggestions for the improvement of laws providing conditions for homogeneous interpretation of legal provisions are presented. (shrink)

This study examines the grammar of moral persuasion that leads to moral outlook transformation, exploring Cora Diamond’s insights in the ‘difficulty of reality’ (2008) and Wittgenstein’s concept of aspect change. Using J. M. Coetzee’s The Lives of Animals, Diamond illustrates the gulf between the character’s experiences and the audience’s interpretive deflections, highlighting the limitations of rational arguments in moral persuasion. Drawing on Wittgenstein, Diamond argues that we should imaginatively consider what seems nonsense as sense and understand the speaker’s intention to (...) communicate. By comparing how reasons work in ethics to Wittgenstein’s methods, this study emphasizes both the difficulty educators face in persuading students to notice aspects they are blind to and the responsibility of educators to acknowledge seemingly nonsensical sentences uttered in children’s voices. It underscores the role of imaginative engagement and educators’ responsibility to share children’s sensitivities to our shared world in ethical and pedagogical approaches to moral persuasion. In this paper, I discuss some central ethical aspects of self-forgiveness. A first comparison is made between interpersonal forgiveness and self-forgiveness. It would seem that self-forgiveness follows much of the same structure as interpersonal forgiveness, although with some exceptions. One noticeable difference is that with self-forgiveness, the forgiver and forgiven is one and the same person. The main ethical question discussed is when self-forgiveness is morally permissible. I argue that self-forgiveness is only morally permissible when the wrongdoer acknowledges wrongdoing (...) and display genuine repentance. He must also, insofar as possible, ask the victim for forgiveness before contemplating self-forgiveness. (shrink)

The article discusses the peculiarities and specific features of phenomenological approach developed in contemporary analytical philosophy. Despite the fact that the trust in phenomenological approaches continue to grow in analytical philosophy, it is necessary to recognize the presence of noticeable divergence between the classical transcendental phenomenology of E. Husserl and contemporary versions of phenomenology in analytical philosophy. The article examines some of these divergences. It is shown that, unlike the skepticism of transcendental phenomenology in relation to scientific methodology in the (...) research of consciousness, the analytical tradition of phenomenology is oriented toward cooperative dialogue with science. Phenomenology in analytical philosophy places great hopes on the possibility of making consciousness a subject of joint research of neuroscientists and phenomenologists. The article claims that in the course of realization of this task, phenomenology in analytical tradition often starts to be interpreted from realistic and partly from naturalistic positions, and that does not meet the project of transcendental phenomenology. As an illustration of this idea, certain approaches of analytical phenomenology are considered, in particular: phenomena are interpreted from the point of view of logical and linguistic analysis, intentionality is connected with the activity of the brain and is located in the natural world, phenomenal consciousness is interpreted as the awareness of a high order, and the phenomena have a gradual nature and are often identified only with sensual experience, which implies a correlative correspondence of the substrate data of brain physiology. In that regard, there are reasons to interpret phenomenological theories that are funded by analytical tradition as an example of a specific phenomenology of non-transcendental origin. (shrink)

When Bloor's Knowledge and Social Imagery was first published in 1976, it was not the first time that a “strong programme” in the sociology of knowledge was treated to a hostile reception by philosophers. But never before has such a dialectically unproductive encounter with philosophers led to such a methodologically fruitful response, for, when an array of positivist, historicist, Popperian, and realist philosophers argued against Bloor and his Edinburgh colleagues that normative accounts of scientific rationality could not be refuted by (...) empirical accounts of what scientists do, an entire line of research was launched that sought to explain science without having to make reference to the philosophers' cherished norms. This is the field now known as Science and Technology Studies. Although STS is normally taken to be intellectually centered in sociology, its main practitioners are just as likely to have been drawn from philosophy and the natural sciences as from the social sciences proper. The unmistakable mark of Bloor's influence is that, unlike the sociology of science most recognizable to sociologists, the STS practitioner is committed to studying science in the same spirit of analytic detachment and epistemic neutrality as she would any other aspect of society. In practice, this has amounted to a preference for methods that incorporate “ethnographic distance”, although in recent years theoretical debate has increasingly focused on the appropriate attitude that STS practitioners should adopt toward science, given their findings to date. This essay discusses Elliott Sober’s Evidence and Evolution: The Logic Behind the Science. Valuable to both philosophers and biologists, Sober analyzes the testing of different kinds of evolutionary hypotheses about natural selection or phylogenetic history, including a thorough critique of intelligent design. Not at least because of a discussion of different schools of hypothesis testing (Bayesianism, likelihoodism, and frequentism), with Sober favoring a pluralism where different inference methods are appropriate in different empirical contexts, the book has lessons for philosophy of (...) science beyond its evolutionary focus. I criticize Sober for not including epistemic values and social aspects of scientific practice in his epistemological framework. (shrink)

Theologians of the 14th C. agreed that theology is scientific knowledge based upon the truths of revelation. But the very introduction of Aristotle's and aristotelian philosophy into theology turned out to be problematic. Above all, it was questionable to integrate theology—as a science based on revelation—within the aristotelian framework of sciences. This problem is difficult for Scotus in two ways. On the one hand, he uses the concepts elaborated in greek philosophy, but, on the other hand, his franciscan spirituality compels (...) him towards the opposite solution. Scotus only has the Aristotle's division of theoretical and practical sciences at his disposal to determine the character of theology, and he chooses to classify theology as practical science. Scotus is pouring “new wine” of Christian revelation into “old wineskins” of greek philosophy, the fact causing noticeable problems when interpreting many Scotus' ideas and views. (shrink)

The main interpretive claim of this book is that both Wittgenstein’s mature philosophical method and his much misunderstood critique of private language have their roots in his critique of the misleading metaphor of phenomenal space–that is, the misleading, figurative analogy between physical space, or space simpliciter, and phenomenal space, or the “space” of appearances. His critique of this metaphor extends from his rejection of sense-data (Chapters 2 and 3), to his investigation of the asymmetry between first- and other-person pronouns in (...) conjunction with psychological vocabulary (Chapter 4), to his discussion of noticing aspects (Chapter 3), and, of course, to his revolutionary critique of the privacy of the mental (Chapter 3) and of the related, but more general, misleading metaphor of the inner and the outer. Wittgenstein’s critique of the idea of phenomenal space is, at the same time, the prototype for his new philosophical method–the method of grammatical investigation, which holds that many of the persistent problems of philosophy arise from failing to command a clear view of the grammar of various regions of our language and finding ourselves, as a result, vulnerable to misleading pictures of our mental lives, of our linguistic practices, of mathematics, and of countless fundamental elements of our world view(s), whose misunderstanding is the locus of the traditional problems of metaphysics (Chapter 3). Chapters 5, 6 and 7 argue for the continued relevance of Wittgenstein's critique of the misleading metaphor of phenomenal space by showing how it applies to contemporary discussions of first-person authority, recent attempts to revive sense-datum theories, and the ongoing debate about sensory qualia. The main objective of this 2-week RCT study was to test the efficacy of the previously developed Noticing Nature Intervention to boost wellbeing during winter months. The NNI consists of noticing the everyday nature encountered in one’s daily routine and making note of what emotions are evoked. Community adults were randomly assigned to engage in the NNI or were assigned to one of two control conditions. Paired t-tests revealed significant increases pre- to post-intervention in the NNI group for (...) positive affect, elevation, nature connectedness, and hope agency, and a marginally significant increase in transcendent connectedness. No significant pre-post difference emerged for any aspect of wellbeing in the control conditions. Analysis of qualitative findings revealed that negative emotion themes were 2.13 times more likely to be associated with built photos than with nature photos. Feelings of peace, awe, happiness, humbleness, and hope were more likely to be associated with nature photos, while feelings of annoyance, loneliness, curiosity, uncertainty, anger, yearning, and comfortableness were more likely to be associated with built photos. Overall, results indicated that engaging in the NNI can provide a wellbeing boost, even in the cold of winter. This study is the first to test any nature-based wellbeing intervention during colder, winter months, and to directly assess the impact of a nature-based wellbeing intervention on levels of hope. This is a critical notice of José Zalabardo's recent book 'Pragmatist Semantics: A Use-Based Approach to Linguistic Representation' (2023). I raise problems about specific steps of Zalabardo’s arguments and I criticize important aspects of his positive account.

This article presents an ethnomethodological respecification of the philosophical problem of the hermeneutics of ancient texts. I analyze an interactional practice, namely, noticing an aspect of the Bible text in Seventh-day Adventist Bible study. I show how noticings are used to make the text “speak” to the participants of the Bible study and discuss how the participants show their orientation to this action in the next turn and how they rely on various cultural resources to make sense of the (...) text. The article shows how the actions of the participants are contextual, cultural and moral in nature. Cultural resources and morality are embedded in the locally produced hermeneutical achievement. I discuss how this analysis can be instructive for philosophical hermeneutics. (shrink)

This paper essays an account of William H. Poteat's teaching--both what he taught and how he taught--as an effort to bring his students to a realization of the bankruptcy of the modern critical sensibility and help them negotiate a transition to a post-critical intellectual sensibility. Enigmatic aspects of his teaching become intelligible through considering them in light of traditional disciplines of spiritual formation.

Play and Ritual – Ontological Aspects of Photography. This research aims to analyse the ontological aspects of photography that relate to its lack of objectivity, namely the concepts of play and ritual that are important parts in photography’s being in the world. Acknowledging that what appears on the surface of the picture is the result of distortions caused by the technical praxis or by the photographer’s intentional intervention, one should be bound to question photography’s realism. My claim is (...) that the apparently objective picture depicts, in fact, a constructed image that implies a creative process in which the photographer, the model and the spectator are involved. The paper follows Andre Bazin, Jean Baudrillard and Roland Barthes’ discourses about the ontology of photography, through an analysis of its ritualistic aspect, which involves a process of recreating reality through play. The importance of this paper can be highlighted by the fact that it offers an insight into a problem that is often overlooked: the photographic image’s lack of objectivity is rarely questioned on one hand, and on the other, subjectivity can be noticed through the way in which one relates to the photographic image, since it has the ability to depict a person or a scene that can trigger some sort of a personal response to that image in the spectator. In philosophical writings from Descartes’ time, the topic of attention attracted notice but not systematic treatment. In Descartes’s own writings, attention was not given the kind of extended analysis that he devoted to the theory of the senses, or the passions, or to the intellect and will. Nonetheless, phenomena of attention arose in relation to these other topics and were discussed in terms of mental operations and, where appropriate, relations to bodily organs. Although not producing a systematic account, Descartes frequently (...) noted attentional phenomena and creatively imagined intricate relations between sensory attention and brain processes. Descartes's observations of attentional phenomena show remarkable breadth, including cases of active mental control of attention and cases in which attention is drawn involuntarily to a novel event (first section). Descartes did not merely observe attentional phenomena; he also offered a framework for understanding them (second section). Part of this framework related attention to the activity of the will. Part also came from his conception of mind-body interaction. He assigned a significant functional role to brain processes in explaining mental phenomena, including aspects of attention. He sometimes moves beyond the usual notions of unidirectional activity or passivity in the process of interaction. Rather, mind and brain are mutually constraining. Mental and physiological processes form a functional unity, in which brain processes contribute to the mental functioning of attention (final section). Furthermore, Descartes was willing to speak of “attention” in the mindless machine portrayed in his Traité de l’homme. That work describes brain states that interact with mind to explain aspects of mental attention. But we must also suppose that these same brain states constitute attention as it occurs in non-human animals, which lack a mind. According to Descartes, although attention is, in the first instance, a mental phenomenon, it can also be ascribed to non-human animals that share brain mechanisms with human beings and the behavior of which can be described as attentively directed toward selected objects in the environment. This thesis examines the relation between philosopher Ludwig Wittgenstein’s 1940s writings on seeing and seeing aspects and Gestalt psychologist Wolfgang Köhler’s theory of perception as set out in his Gestalt Psychology (1929). I argue that much of the existing literature on the Wittgenstein-Köhler relation distorts Köhler’s ideas and thus also Wittgenstein’s engagement with Köhler’s ideas. This double distortion underrates Köhler’s insights, misconstrues Wittgenstein’s complaints against Köhler, and masks points of contact between the two concerning the nature and description of (...) human perceptual experience. In my view, Wittgenstein sympathizes with Köhler’s call to reflect on basic psychological categories such as “experience”, his respect for the “naïve” experience of the layperson, his method of “rediscovering” pervasive features of experience that escape our notice, and his efforts to identify intellectual prejudices that stymie inquiry. But a warning emerges from Wittgenstein’s discussions of seeing and seeing aspects: It is especially difficult to command a clear view of 'seeing' and its interrelations with other everyday, psychological concepts. I argue that Wittgenstein’s far-reaching criticism of Köhler is that the latter's account of visual “organization” overextends an analogy between seeing and seeing aspects and pushes aside other justifiable comparisons, for example between seeing and thinking and seeing and imagining. A consequence of Wittgenstein's criticism is that Kohler falls short of his aim to depict faithfully naïve visual experience. Moreover, despite Kohler's commitment to battling prejudices, the latter's emphasis on similarities between seeing and seeing aspects to the exclusion of their differences is a form of intellectual prejudice. For Wittgenstein various comparisons are justifiable by appeal to the interrelations between ‘seeing’ and other psychological concepts. A perspicuous view of the concept 'seeing' involves steady appreciation of the multitude of justifiable, criss-crossing comparisons. So although Wittgenstein does not deny Köhler’s claim that organization is a feature of visual experience rather than thinking, he does not unqualifiedly endorse it either. We have conceptual grounds for various ways of speaking about our experiences of aspects. (shrink)

The Lithuanian success of implementing international obligation in order to encourage the regulation of labour relations by means of collective agreements is analyzed in this article. It is emphasized that development of social partnership is too slow, coverage of regulation of labour relations by means of collective agreement also is low-level and collective agreements basically are made at the plant level. It is noticed that, because of the need to find a suitable balance between implementing the international obligation to encourage (...) regulation of labour relations by means of collective agreements, and the necessity to undermine the raison d’être of the regulation by means of collective agreements itself, as the process, where attitudes of social partners has to be harmonised at maximum, the state has limited scope to influence the process of making collective agreements. Among the unpublished writings of Kazimierz Twardowski so far there is an essay in which Twardowski tries to embed the concept of an intentional object' within a theory that comprises at the same time psychological, logical and grammatical aspects. This theory of actions' and products' is presented here and several applications of the theory are discussed. The central question thereby is whether the distinction between actions and products enables Twardowski to counter the objection of psychologism raised against him. Having (...) explained Twardowski's position we describe from an editorial point of view the text in which his theory is transmitted. Chinese Buddhist thought is more than a case of “Indianization” or “Sinicization,” and even less, “Distortion.” Chinese Buddhist thought should be grasped, first, in its own terms and only then in terms of the possible influences or confluences that flowed into it. The present article will seek to look into the concept of “Suchness vasana” (perfumation by the Buddhist absolute, Suchness, upon avidya, ignorance) as used by the Huayan school in China. Then it will show how, in the elaboration of (...) this idea, Fazang, the key patriarch of the Huayan school, apparently drew on a mode of thought that is derived from the Yijing, the Book of Changes. It is in the nature of the present article that only the Chinese influence will be underlined and that the Indian contributions to the formation of a theory of a “dynamic Suchness” will only be briefly touched upon. Scholars have long noticed the Daoist influence of Chinese Buddhological thinking, especially within the Ch'an and the Hua-yen circles. However, too often scholars only suggest impressionistic parallels, between, say, the book Laozi and the Platform Sutra of the Sixth Patriarch or between Mencian humanism (“Every man can be Sage Yao and Shun”) and the idea that “Every man can be Buddha.” Such presentations of Chinese influence bypass the various problems involved in the long and thorny history of conflict, compromise, mutual self-discovery, and fertilization between the two cultural traditions. The present article will try to be much more concrete by documenting and analyzing the series of incidents that led to a datable innovation on Fazang's part. (shrink)

Nursing work increasingly demands forms of expertise that complement specialist knowledge. In child and family nursing, this need arises when nurses work in partnership with parents of young children at risk. Partnership means working with parents in respectful, negotiated and empowering ways. Existing partnership literature emphasises communicative and relational skills, but this paper focuses on nurses’ capacities to facilitate parents’ learning. Referring to data from home visiting, day‐stay and specialist toddler clinic services in Sydney, a pedagogical framework is presented. Analysis (...) shows how nurses notice aspects of children, parents and parent–child interactions as a catalyst for building on parents’ strengths, enhancing guided chance or challenging unhelpful constructs. Prior research shows the latter can be a sticking point in partnership, but this paper reveals diverse ways in which challenges are folded into learning process that position parents as agents of positive change. Noticing is dependent on embodied and communicative expertise, conceptualised in terms of sensory and reported channels. The framework offers a new view of partnership as mind‐expanding for the parent and specifies the nurse's role in facilitating this process. (shrink)

Husserl’s conception of theology and God is a lesser noticed aspect in his phenomenological system. This paper is devoted to a return to Husserl’s text, reconstructing the implicit threads and essential features of his phenomenological theology. First, I will outline the general features of a phenomenology of religion and theology, arguing that it is not without historicity, which is not in conflict with the essentialism that phenomenology has always pursued. Then, Sec. 2 focuses on the analysis of teleology, considering which (...) is the true teleology leading to God, pointing out that it ultimately resorts to an ethical approach. Sec. 3 and 4 provide an in-depth textual analysis mainly based on the Grenzprobleme der Phänomenologie, concluding that they are all fundamentally ethical-relevant and capable of being in harmony with each other. Last, I will respond to some criticisms of Husserl’s conception of God, the most major of which are Mall’s and Held’s. Of course, I do not mean to suggest that Husserl has perfectly integrated his project of theology and God into the phenomenology program—it is precisely these criticisms that motivate us to reconstruct Husserl’s fragmented narrative into a self-consistent system. Intuition is frequently used in medicine. Along with the use of existing medical rules, there is a separate channel that physicians rely on when making decisions: their intuition. To cope with the epistemic problem of using intuition, I use some clues from Wittgenstein's philosophy to illuminate the decision-making process in medicine. First, I point to a connection between intuition as functioning in medicine and Wittgenstein's notions of "seeing as" or noticing "aspects". Secondly, I use Wittgenstein notion of empirical (...) regularities hardened into rules to suggest that there are two stages that should be addressed in the analysis of medical practice: the first concerns the accumulation of cases and the second pertains to the setting a rule based on these cases. I argue further that the medical context is exceptional in that the two stages are intertwined and, and explain the consequences of this fact for the physician's work. Finally, inspired by Wittgenstein's rule-following conundrum, I argue that medicine is particularly prone to difficulties in applying a general rule to a specific case represented by an individual patient. Recourse to intuition is reflects the physicians' efforts to bridge this gap. (shrink)

I rely on Frascolla's interpretation of the Tractatus ontology to develop an account of depiction in which a picture is conceived of as a visual structure constituted by pixels that are conceived of, in their turn, as elementary propositions. Then I argue that such an account is complementary to the considerations about «noticing aspects» in the Philosophical Investigations, to the extent that the visual structure constituted by pixels provides a design allowing the picture’s viewer to notice aspects. Finally I argue that a joint reading of the considerations about pictures in the Tractatus and in the Philosophical Investigations allows us to address some important issues in the contemporary philosophical debate about depiction. Certain aspects of Aquinas’s account of divine omnipresence, as presented in his Summa Theologiae, are well known and often summarized, especially in the growing literature on omnipresence in contemporary metaphysics and philosophy of religion. Even so, some of the most interesting and surprising aspects of this same account—including that God is genuinely spatially located, despite being an incorporeal substance—have yet to be noticed, much less fully understood. This chapter examines Aquinas’s account of divine omnipresence in the Summa in (...) some detail, with a view to highlighting those aspects of it that have heretofore been overlooked or ignored. Further, I argue that a proper understanding of the details of Aquinas’s account sheds new light on his views about spatial location and action at a distance. (shrink)

We notice a number of interesting overlaps between the views on personhood of Ifeanyi Menkiti and Marya Schechtman. Both philosophers distance their views from the individualistic ones standard in western thought and foreground the importance of extrinsic or relational features to personhood. For Menkiti, it is ‘the community which defines the person as person’; for Schechtman, being a person is to have a place in person-space, which involves being seen as a person by others. But there are also striking differences. (...) Schechtman sees this aspect as expanding the scope of personhood to infants and those who are severely mentally disabled. Menkiti thinks that there is a line to be drawn at some point between those humans that are persons and those who are not. We consider the cases offered in questioning how the dispute between the two views should be resolved. (shrink)

The second part of Philosophical Investigations and other contemporary writings contain abundant material dedicated to the examination of visual perception, along the lines of similarities and differences manifested in the use of concepts such as “seeing as”, “seeing aspects”, “noticing the aspect”, “aspect blindness”, among other, related ones. However, the application of these concepts to phenomena such as face perception and word perception has not received proper attention in the literature. Our interest lies in identifying the features pertaining (...) facial perception and recognition of its content in order to understand how and to what extent they contribute to shed light on perceptual (and experiential) relationships we have with language, in particular with its written form. In other words, we will try to show in what ways the “phenomenology of facial perception” or “physiognomy” helps to understand the “experience of meaning” and the “phenomenology of reading”. My interpretative hypothesis is that, in Wittgenstein’s view, the features shared by face and word perception are more profound than a mere analogy, and that, in the case of words, these features can explain specific semantic (perhaps, semantic-pragmatic) phenomena that should be included in an appropriate reconstruction of the varieties of use in natural languages. Despite recent noticeable changes in women’s educational opportunities in developing countries such as Iran, there is still much controversy surrounding the common assumption that a direct relationship exists between women’s empowerment and formal literacy. According to the social semiotic method, the present research explores the hidden side of the female educational experience and its relationship with empowerment. In the current study, we conducted 39 interviews and analyzed the collected data using Van Leeuwen’s semiotic approach. The results are based on the (...) analysis of three semiotic sources, all of which are ubiquitous in the daily life of Iranian students: uniforms, queues, and homework. The findings indicate that the emphasis on the ideological aspects of educational experiences, in the form of a ritualistic approach by the educational system’s agents, causes a gradual semantic break between students and educational goals. Such an emphasis also instills an ambiguous and contradictory understanding in the student’s mind, of which the final result is the alienation and internalization of passive patterns of social action. Key aspects of Mahatma Gandhi’s ethical theory can be understood by way of the framework provided by David Hume’s ethics. While respecting contextual differences as well as those in over all outlook between a Sanatani Hindu reformer and a Western empiricist, I show that Gandhi and Hume mutually illuminate each other’s thought on significant ethical matters. These matters are: (1) The inability of reason to produce action (2) The relationship of reason to the emotions (3) The importance of the (...) commonality of moral sentiments among humans (4) Identification (a kind of sympathy) as the proper starting place for morality. I hope to show that a greater viability in each thinker’s views can be noticed by those schooled in traditions different from what each respectively represent.David Hume’s ethics provide a framework for understanding key aspects of Mahatma Gandhi’s ethical theory. Indeed, for certain students of philosophy in the West, Gandhian ethics may gain status as a viable approach in moral philosophy when seen from a Humean standpoint. In what follows, I will examine four significant aspects of Gandhian ethics: (1) The limitations of reason to produce moral action. (2) The secondary status of reason in relation to the emotions in morality. (3) The importance of moral sentiments in the general population for devising a system of morality. (4) The place of identification (a kind of sympathy) for the origin of morality. I will show that all four are not only significant aspects of Humean ethics but that when understood from David Hume’s framework these parts of Gandhi’s philosophy should appear all the more plausible to those steeped in the analytic tradition. What has been noticed during the history of human thought and human life is that forms, figure, feelings of pleasure and aesthetic perception, are not the only subjects that belong to the sphere of art. In fact, art includes other aspects, such as themes and content. As a matter of fact, each art work could be considered as outstanding, not only because of its form, but because of its theme and content, as well. However, art works in the western (...) classical art, were inspired by mythology and religion and their form has been a reflection of that content. In this paper art is going to be discussed through its religious themes and contents. Therefore, first, I will analyze some approaches to religious themes and content in art works through discussion of religion as its background. And, second, I will try to establish a method which will distinguish between religious and non-religious themes and contents in the works of art. (shrink)

This is a critical notice/review essay on *L'embryogenèse du monde et le Dieu silencieux*, a manuscript completed by Raymond Ruyer in the early 1980s. It came out as a monograph in November 2013, with the Éditions Klincksieck in Paris. It offers a presentation in an organized fashion of many aspects of his thought. Ruyer considered that a book about God could only be churned into a series of chapters on the unachievable character of our knowledge in different domains of (...) human inquiry. The nature of this final solution on God's relationship to the world and to natural forms is here assessed critically. (shrink)

There are two aspects of the hermeneutic: the receptive and the creative. In this article, first of all, I shall identify the strengths of these two aspects of the hermeneutic in the main development of hermeneutics in Western world. Heidegger and Gadamer take ontological receptivity as the source of the meaning of existence as well as the meaningfulness of texts. In my view such a form of receptivity has shaped the predominant paradigm of hermeneutic thinking in contemporary Europe (...) or West. Therefore, I move to the creative formation and positive projection of a transformative cosmological philosophy, namely the Yijing《易經》philosophy in Chinese tradition. In these two contrasts we shall not only notice the strong divergence between the two paradigms but come to see how receptivity and creativity of the hermeneutic could be divergently identified and located in concrete understanding of nature of reality and nature of the human being. In his 1966 paper “The Strategy of model-building in Population Biology”, Richard Levins argues that no single model in population biology can be maximally realistic, precise and general at the same time. This is because these desirable model properties trade-off against one another. Recently, philosophers have developed Levins’ claims, arguing that trade-offs between these desiderata are generated by practical limitations on scientists, or due to formal aspects of models and how they represent the world. However this project is not (...) complete. The trade-offs discussed by Levins had a noticeable effect on modelling in population biology, but not on other sciences. This raises questions regarding why such a difference holds. Critical notice assessing the use of information theory in the attempt to build a design inference, and to re-establish some aspects of the program of natural theology, as carried out in this third major monograph devoted to the subject of intelligent design theory by mathematician and philosopher William A. Dembski, after The Design Inference (1998) and No Free Lunch (2002).

Characterizing different kinds of representation is of fundamental importance to cognitive science, and one traditional way of doing so is in terms of the analog–digital distinction. Indeed the distinction is often appealed to in ways both narrow and broad. In this paper I argue that the analog–digital distinction does not apply to representational schemes but only to representational systems, where a representational system is constituted by a representational scheme and its user, and that whether a representational system is analog or (...) non-analog depends on facts about that user. This aspect of the distinction has gone unnoticed, and I argue that the failure to notice it can be an impediment to scientific progress. (shrink)

We isolate some critical aspects of the reuse notion in Anderson's massive redeployment hypothesis (MRH). We notice that the actual rearranging of local neural circuits at a timescale comparable with the reactivity timescale of the organism is left open. We propose the concept of programmable neural network as a solution.

Discourse connection is a challenging aspect of writing in a second language. This study seeks to investigate the effects of two classroom instructions on discourse connection in writing for EFL college students, focusing on their argumentative writing. Three classes were exposed to different pre-task conditions: receiving reading materials that provide content support for the writing, receiving planning instructions on effective outlining, and receiving no resources. The results showed that the instructions helped students attain better overall coherence in writing. However, noticeable (...) differences between the two experimental groups emerged in terms of cohesion features. The reading group was found to employ more lexical cohesion devices in writing than the outline group, which indicated a heightened genre awareness. This inquiry helped us identify the reading group’s alignment with content support materials, particularly the change in stance as a factor that contributes to a higher level of lexical cohesion in writing. Heloise Robinson argues that pregnant women have a higher moral status than non-pregnant persons and that, for this reason, pregnant women ought to be treated ‘noticeably’ better than non-pregnant persons.1 In this commentary, we present two challenges to Robinson’s argument. First, the compounding disadvantage objection: treating involuntarily, non-pregnant women worse than voluntarily pregnant women unjustly compounds their disadvantage. Second, the identity objection: treating non-pregnant people worse than pregnant people amounts to pro tanto wrongful discrimination based on a fundamental aspect of (...) people’s identity. We conclude that either pregnant persons do not have a higher moral status than non-pregnant persons, or they do, but higher moral status so grounded does not justify better treatment. According to the standard view of moral status: (1) most human beings are persons; (2) persons have a higher moral status than non-persons; and (3) persons have an equal moral status. Many believe: (1) is true because most human beings have a sufficiently high level of personhood-generating psychological capacities; (2) is true because moral status is tied to personhood; and (3) is true because variations in the level of personhood-generating psychological capacities do not matter to an individual’s moral status once that individual’s level surpasses the threshold required for personhood.2 (3) is significant …. This book begins with a survey of various readings of Locke as a materialist, as a substance dualist, and as a property dualist, and demonstrates that these inconsistent interpretations result from a general failure of modern commentators to notice the significance of Locke’s ‘mind-body nominalism’. By illuminating this largely overlooked aspect of Locke’s philosophy, this book reveals a common mistake of previous interpretations: that of treating what Locke conceives to be ‘nominal’ as real. The nominal symmetry that Locke posits between (...) mind and body is distinct from any form of metaphysical dualism, whether substance dualism or property dualism. It is a brand of naturalism, but does not insist that the material is ontologically more basic than the mental or that the former determines the latter. On this view, the material and the mental both relate solely to a certain set of functional roles, rather than to an intrinsic property that plays these roles. The term ‘matter’ is thus rendered vague, and materialism is conceived as a precariously grounded ontological doctrine. Elaborating on this interpretation of Locke’s Essay, this book examines the insightful readings of Locke developed by seventeenth- and eighteenth-century thinkers such as Richard Burthogge, William Carroll, and Joseph Priestley. This book also seeks to clarify what Locke’s position would look like in a modern setting by noting some significant parallels with the ideas of leading contemporary philosophers such as Donald Davidson, David Lewis, and Colin McGinn. The existential, experiential, ethical, pathic and pre-pathic dimensions of education are essential for the creative composition of subjectivities in institutional spaces, yet educational research and policy tend increasingly to privilege technical discourses and prescriptive approaches both when evaluating ‘what is effective in education’ and when determining educational policy. This essay explores those aspects of the educational experience and educational institutions that are often felt and sensed pre-cognitively by students, parents and teachers, but are seldom given further elaboration or articulation (...) in educational research. We will reflect on what is meant by the experience of education and experience in education, including the struggles to make sense of or understand something, the surprises that strike pre-reflectively, and the ways in which such moments are noticed, pursued, and explored rather than reflexively ‘evaluated’. We then explore the idea of experimentation in institutions, in particular in relation to the range of concepts that Jean Oury introduces in order to move our attention and awareness to questions of experience, existence, atmosphere, and the pathic—the way in which we undergo, sense and participate in the world prior to cognition and the desire for mastery and control of our encounters. This is a critical notice of three books which discuss aspects of James Lovelock's Gaia Theory.

It has been noticed by several authors that the colloquial understanding of anonymity as mere unknown-ness is insufficient. This common-sense notion of anonymity does not recognize the role of the goal for which the anonymity is sought. Starting with the distinction between the intentional and unintentional anonymity (which are usually taken to be the same) and the general concept of the non-coordinatability of traits, we offer a logical analysis of anonymity and identification (understood as de-anonymization). In our enquiry, we focus (...) on the intentional aspect of anonymity and develop a metaphor of “anonymity game” between “perpetrator” and “detective”. Beginning from common-sense intuitions, we provide a formalized, critical notion of anonymity. (shrink)

This is a critical notice of Mario Gómez-Torrente's novel account of demonstrative reference presented in chapter 2 of the recently published book Roads to Reference. After presenting the main tenets of his view, I go on to critically examine a couple of its features. In section 2, I assess Gómez-Torrente’s assumption that demonstrative thought based on perception is less likely to succumb to indeterminacy than the others. I show that this aspect of his view invites unwelcome consequences regarding the transparency (...) of thought. I do however suggest that this problem could be overcome by individuating perceptual intentions dynamically. In section 3, I express a distinct worry regarding a case, introduced en passant by Gómez-Torrente, that involves successful demonstrative reference regardless of its utterer's conflicting intentions, a result that seems to contradict his general theory. Instead of conceiving the case as exceptional, I use it to motivate the necessity of distinguishing between a subject’s referential intentions and a subject’s merely collateral beliefs about the target of his utterance. Sensory awareness -- the direct focus on some specific sensory aspect of the body or outer or inner environment -- is a frequently occurring yet rarely recognized phenomenon of inner experience. It is a distinct, complete phenomenon; it is not merely, for example, an aspect of a perception. Sensory awareness is one of the five most common forms of inner experience, according to our results . Despite its high frequency, many people do not notice its appearance nor recognize its theoretical (...) import. We describe sensory awareness and distinguish it from other aspects of experience. We give examples and discuss how it appears when moments of inner experience are examined carefully. We note that there are large individual differences in the observed frequency of sensory awareness and consider its relationship to mental health and other aspects of psychological functioning. One important condition for a valid informed consent is the patient's competence to make autonomous health care decisions. Therefore, a proper assessment of competence to (...) make health care decisions is crucial particularly in patients with mental disorders (Vollmann 2000; Helmchen and Vollmann 2001). In recent years, several empirical studies on the assessment of competence in patients suffering from different mental disorders have been performed using the MacArthur Competence Assessment Tool-Treatment (MacCAT-T; Grisso and Appelbaum1998). This assessment tool is based on legal standards of competence such as understanding, reasoning, appreciation, and expressing a choice. Since its first publication, the MacCAT-T has been widely accepted as a "gold standard" of competence assessment in the psychiatric literature. In recent years the MacCAT-T has been applied to patients suffering from depression, schizophrenia, dementia, angina pectoris, and normal controls (for overview, see Welie [2001] and Bauer and Vollmann [2002]).Tan and her colleagues (2006) use the MacCAT-T the first time to assess competence to make treatment decisions in patients with anorexia nervosa. Coming from clinical practice, the authors have noticed that the MacCAT-T might not work in this group of patients. Therefore, they use semi-structured interviews in addition to the MacCAT-T to identify aspects of thinking that might be relevant to the issue of competence to refuse treatment. They use grounded theory techniques for a qualitative analysis of the data as well as five brief, self-administered questionnaires to ascertain levels of psychopathology.The results of the study show that anorexia nervosa can have complex and variable effects on concentration, beliefs, and thought processing without affecting the ability to perform well on the MacCAT-T. At the same time, participants also report a change in their value system as well as in their personal identity. The authors argue that the results of their studies suggest that the competence to refuse treatment might be compromised in [End Page 289] people with anorexia nervosa in ways that are not captured by the MacCAT-T. This is an interesting finding in patients with anorexia nervosa, because in all other studies with patients suffering from mental disorders such as dementia, depression, and schizophrenia, the MacCAT-T identified more patients as limited in their competence to make health care decisions in comparison with other methods of competence assessment such as clinical judgment (Vollmann et al. 2003). The authors argue on the basis on their qualitative, semistructured interviews that anorexia nervosa–specific difficulties with a thought process and the change of values are missed by the MacCAT-T.Furthermore, Tan and her associated could not find a relationship between the participants' scores on the psychopathological scales, the MacCAT-T scores, and their difficulties expressed during the qualitative interviews, although the small size of the study precludes statistical analysis. In an earlier study, clinical dementia scales but not neuropsychological testing correlated with formal (MacCAT-T) and clinical assessment of competence. Therefore, psychopathological factors might play a different role in different subgroups of patients suffering from different mental problems. However, the idea of an objective neuropsychological model of competence assessment, again, finds no support in the presented empirical data.The qualitative data from patients with anorexia nervosa underline the problem of the cognitive bias of the MacCAT-T assessment and the illusion of value-free categories. It has been argued that the cognitive focus for the MacCAT-T is in itself a normative convention and that the MacCAT-T is missing the complexity of the process to make health care decisions in real life. In this study caring is shown to be a membershipbound activity to kin and gender categories with strong moral connotations. Being a daughter or being a son are good enough reasons for becoming a caregiver, more so for women than for men. Caregivers were interviewed within the research project The role of women in family care of disabled elderly conducted by the Social and Economic Research Department of INRCA, Ancona, Italy. Transcripts of the interviews were analyzed through a detailed discourse (...) analysis within an ethnomethodological framework. Interview data are treated as interactional encounters that occasion members to display relevant aspects of their identities and morally adequate images of being a caregiver. In the interview interaction, interlocutors display an orientation towards the production of a moral order in which duty and responsibilities are allocated on the basis of gender distinction. Males are generally described as not being responsible for caring tasks, except for situations in which females are absent or sick, that is, for serious reasons. Caregivers'' perception of time dedicated to caring is pervasive. Most caregivers said it occupied all their time, but gender differences were noticeable. Caring tasks are recognized as gender specific practices, thus failing to carry out these tasks is morally sanctionable when women are involved, but not so for men. Many caregivers described caring for older relatives as an intense source of stress, involving serious physical and psychological problems. The study on moral and identity issues related to caregiving highlights endangering constructions of caring. (shrink)
