In this position statement it is argued that educational neuroscience must necessarily be relevant to, and therefore have implications for, both educational theory and practice. Consequently, educational neuroscientific research necessarily must embrace educational research questions in its remit.

The use of charged-particle radiation therapy is an increasingly important development in the treatment of cancer. One of the most pressing controversies about the use of this technology is whether randomised controlled trials are required before this form of treatment can be considered to be the treatment of choice for a wide range of indications. Equipoise is the key ethical concept in determining which research studies are justified. However, there is a good deal of disagreement about how this concept is (...) best understood and applied in the specific case of CPRT. This report is a position statement on these controversies that arises out of a workshop held at Wolfson College, Oxford in August 2011. The workshop brought together international leaders in the relevant fields , including proponents on both sides of the debate, in order to make significant progress on the ethical issues associated with CPRT research. This position statement provides an ethical platform for future research and should enable further work to be done in developing international coordinated programmes of research. (shrink)

In August 2011, a group of medical doctors, ethicists, academic and medical physicists were asked to debate and reach consensus on the potential need for randomised control trials to test charged particle radiation therapy for treating tumours. The outcome of the meeting was a paper recently published in the Journal of Medical Ethics entitled “Position statement on ethics, equipoise and research on charged particle therapy” by Sheehan et al. However 6 of the 30 meeting participants withdrew from authorship (...) of the ‘position statement’ because their views were not adequately represented. The ‘position statement’ did not state our reasons for withdrawing from the statement, which is a considerable omission. We had two principal objections: the case for the benefits to patients and society of randomized trials to test CPRT was not adequately represented, and the complexities and potential harms of CPRT were not clearly stated. In this response we explain and justify our objections. Patients, doctors and policymakers seeking to make independent judgments about whether equipoise exists for the relative benefits of CPRT should therefore read this document alongside the ‘position’ statement. Australian immigration detention has been called state sanctioned abuse and a crime against humanity. The Australian healthcare community has been closely involved with these policies, calling for their reform and working within detention centres to provide healthcare. As well as having a devastating impact on health, immigration detention changes the scope and nature of healthcare, with its delivery described as a Sisyphean task. In this article I will explore the guidance that is available to clinicians who work within detention centres (...) and argue that codes, guidelines and positions statements provide little help in relation to ethical decision making. First I will outline guidance that can be found in codes of ethics and position statements, focusing on particularly relevant principles, such as advocacy, clinical independence and the clinicians’ relationship to human rights. I will then highlight the disparity between this guidance and the delivery of healthcare within detention by drawing on the testimony of clinicians who formerly worked in these environments. While this disparity should be cause for alarm and at a minimum call into question how codes and positions statements are being used, there are more fundamental reasons why codes and position statements fail to provide guidance in these circumstances. I will outline a more general criticism of codes of ethics and use this to suggest a way forward, including looking beyond codes and position statements to guide action within Australian immigration detention. BackgroundAn analysis of the position statements of secular US medical and surgical professional societies on physician-assisted suicide (PAS) and euthanasia have not been published recently. Available statements were evaluated for position, content, and sentiment.MethodsIn order to create a comprehensive list of secular medical and surgical societies, the results of a systematic search using Google were cross-referenced with a list of societies that have a seat on the American Medical Association House of Delegates. Societies with position statements were (...) identified. These statements were divided into 5 categories: opposed to PAS and/or euthanasia, studied neutrality, supportive, acknowledgement without statement, and no statement. Linguistic analysis was performed using RapidMinder in order to determine word frequency and sentiment respective to individual statements. To ensure accuracy, only statements with word counts > 100 were analyzed. A 2-tailed independentttest was used to test for variance among sentiment scores of opposing and studied neutrality statements.ResultsOf 150 societies, only 12 (8%) have position statements on PAS and euthanasia: 11 for PAS (5 opposing and 4 studied neutrality) and 9 for euthanasia (6 opposing and 2 studied neutrality). Although the most popular words used in opposing and studied neutrality statements are similar, notable exceptions exist (suicide,medicine, andtreatmentappear frequently in opposing statements, but not in studied neutrality statements, whereaspsychologists,law, andindividualsappear frequently in studied neutrality statements, but not in opposing statements). Sentiment scores for opposing and studied neutrality statements do not differ (mean, 0.094 vs. 0.104;P = 0.90).ConclusionsFew US medical and surgical societies have position statements on PAS and euthanasia. Among them, opposing and studied neutrality statements share similar linguistic sentiment. Opposing and studied neutrality statements have clear differences, but share recommendations. Both opposing and studied neutrality statements cite potential risks of PAS legalization and suggest that good palliative care might diminish a patient’s desire for PAS. (shrink)

Within the context of global debates about safety and ethics of supporting women to give birth at home, it is important to analyse documents governing midwifery and obstetric practice and influence decision‐making around place of birth. In Australia, the United States and the United Kingdom, relatively small numbers of women choose to give birth at home despite their midwifery colleges' support. In the United States and Australia, the obstetric colleges do not support homebirth and these countries have lower numbers of (...) women who birth at home, compared with the United Kingdom. There are numerous regulatory and industry challenges for midwives attending homebirths. This paper reports on a Foucauldian analysis of Australian obstetric and midwifery colleges' position statements about homebirth, who have conflicting views, with the view to understanding their arguments and underlying assumptions. The documents highlighted tensions between competing discourses of risk and autonomy and differences in academic argument. Opportunities for strengthening their statements are highlighted. The methodology is applicable for future analysis of similar documents governing practice in other countries. (shrink)

Assisted dying is a divisive and controversial topic and it is therefore desirable that a broad range of interests inform any proposed policy changes. The purpose of this study is to collect and synthesize the views of an important stakeholder group—namely people with disabilities —as expressed by disability rights organisations in Great Britain. Parliamentary consultations were reviewed, together with an examination of the contemporary positions of a wide range of DROs. Our analysis revealed that the vast majority do not have (...) a clear public stance; those that do exhibit a significant diversity of opinion. DROs opposing legislation on assisted dying have argued that it would be premature, misguided, inequitable and culturally undesirable. Some specify conditions that would have to be satisfied before they could support legalisation, such as radical improvements in health and social care services and the elimination of discrimination against PwD. DROs supporting assisted dying maintain that a change in the law would promote autonomy, end intense suffering, can be delivered safely and is supported by the DRO’s membership. The discussion considers the reasons why several DROs adopt a neutral stance and the argument is made that, whatever their overarching stance on the issue, DROs need to be involved in the policy debate so that the crucial perspectives of PwD are heard and addressed. This is an important message for countries around the world that permit, or are considering legalising, assisted dying. (shrink)

Facing the possibility of a surge of COVID-19-infected patients requiring ventilatory support in Intensive Care Units, the Singapore Hospice Council and the Chapter of Palliative Medicine Physicians forward its position on the guiding principles that ought to drive the allocation of ICU beds and its role in care of these patients and their families.

How nursing as a profession is valued may be changing and needs to be explored and understood in a global context. We draw on data from two empirical studies to illustrate our argument. The first study explored the value of nursing globally, the second investigated the experiences of overseas trained nurses recruited to work in a migrant capacity in the UK health care workforce. The indications are that nurses perceive themselves as devalued socially, and that other health care professionals do (...) not give nursing the same status as other, socially more prestigious professions, such as medicine. Organizational and management structures within the NHS and the independent care home sector devalue overseas nurses and the contribution they make to health care. Our conclusions lead us to question the accepted sociocultural value of the global nursing workforce and its perceived contribution to global health care, and to consider two ethical frameworks from which these issues could be discussed further. Had the limit of this zone been the same for all words and had the accent been allowed to stand anywhere within it , there would have been no problem. Unfortunately, the length of the accentuable zone did vary whatever the unit we use and there was a place within it where the (...) accent was prohibited . The broaden‐and‐build theory (CitationFredrickson, 1998, Citation2001) hypothesises that positive emotions broaden the scope of attention and thought‐action repertoires. Two experiments with 104 college students tested these hypotheses. In each, participants viewed a film that elicited (a) amusement, (b) contentment, (c) neutrality, (d) anger, or (e) anxiety. Scope of attention was assessed using a global‐local visual processing task (Experiment 1) and thought‐action repertoires were assessed using a Twenty Statements Test (Experiment 2). Compared to a neutral state, positive emotions broadened the scope (...) of attention in Experiment 1 and thought‐action repertoires in Experiment 2. In Experiment 2, negative emotions, relative to a neutral state, narrowed thought‐action repertoires. Implications for promoting emotional well‐being and physical health are discussed. (shrink)

In order to think and talk about time, people often use the ego- or time-moving representation. In the ego-moving representation, the self travels through a temporal landscape, leaving past events behind and approaching future events; in the time-moving representation, the self is stationary and temporal events pass by. Several studies contest to the psychological ramifications of these two representations by, inter alia, demonstrating a link between them and event valence. These studies have, however, been limited to English speakers, even though (...) language has been found to affect time representation. The present study therefore replicated Margolies and Crawford’s experiment on event valence and time representation amongst speakers of Dutch. Unlike Margolies and Crawford, we do not find that positive valence leads to the endorsement of an ego-moving statement. Future studies will need to determine the ways through which language might moderate the relation between event valence and time representation. (shrink)

In this article, I argue that professional healthcare organizations such as the AMA and ANA ought not to take controversial stances on professional ethics. I address the best putative arguments in favor of taking such stances, and argue that none are convincing. I then argue that the sort of stance-taking at issue has pernicious consequences: it stands to curb critical thought in social, political, and legal debates, increase moral distress among clinicians, and alienate clinicians from their professional societies. Thus, because (...) there are no good arguments in favor of stance-taking and at least some risks in doing so, professional organizations should refrain from adopting the sort of ethically controversial positions at issue. This study examines the effects of publication of financial statements, the risk of a takeover of the auditee and the auditee's financial position on auditors' willingness to allow material errors in financial statements in case of management pressure. The results show that all factors significantly influence auditors' willingness to allow errors in financial statements.

Statements’ rated truth increases when people encounter them repeatedly. Processing fluency is a central variable to explain this truth effect. However, people experience processing fluency positively, and these positive experiences might cause the truth effect. Three studies investigated positivity and fluency influences on the truth effect. Study 1 found correlations between elicited positive feelings and rated truth. Study 2 replicated the repetition-based truth effect, but positivity did not influence the effect. Study 3 conveyed positive and negative correlations between positivity and (...) truth in a learning phase. We again replicated the truth effect, but positivity only influenced judgments for easy statements in the learning phase. Thus, across three studies, we found positivity effects on rated truth, but not on the repetition-based truth effect: We conclude that positivity does not explain the standard truth effect, but the role of positive experiences for truth judgments deserves further investigation. The book Ecclesiastes has been regarded as one of the most profound pieces of ‘wisdom’ literature in the ancient Orient. It rivals in depth and the courage to challenge the institutional status quo with the literature from Mesopotamia and Egypt. It has puzzled readers in the last three millennia with its unparalleled courage to ask uncomfortable questions about faith, Gods and humanity. Ironically, many of the questions that Ecclesiastes asked have found reverberations in the hearts of post-modern men and women (...) today. On the one hand, the author affirms his belief that one can discern the ‘hand of God’ dispensing justice even in the most tragic of circumstances. On the other hand, Ecclesiastes confesses that, even though he applied his heart ‘to know wisdom and to know madness and folly,’ in the end he perceived ‘that this also is but a striving after wind.’ His conclusion? ‘Vanity of vanities: all is vanity!’ Statements like these have compelled us to approach Ecclesiastes in order to find the equilibrium in his vision between ‘despair’ and ‘hope.’ To do so, we will select a number of divine attributes that offer clarity not only to the vision of God in Ecclesiastes, but also to the sensitive issues of the meaning of life, suffering, justice, death and eternity. In the course of our analysis we will examine the views of contempoerary scholars who have written on this subject. We will show how Ecclesiastes’ vision takes into account human suffering and despair, without sacrificing the integrity of hope. (shrink)

Public accusations of corruption leveled against public figures and institutions in Jordan have recently become a prominent feature of public discourse in the country. Informed by positioning theory as an analytical framework, this study focuses on public responses to such accusations through a discourse analysis of two major apologetic statements, or apologiae, issued in Jordan in 2018 and 2019: one by a controversial former royal court chief and minister of planning in response to public accusations of corruption and appropriation of (...) public funds, and the other by the Office of Queen Rania of Jordan in response to accusations of wardrobe extravagance and overspending. The analysis shows that these two apologiae employed discourses that not only positioned the accused as blameless, but also as victims of defamation. Reference to one’s history, such as public service to the nation and one’s accomplishments, was exploited. In contrast, the accusers were explicitly or implicitly positioned as unjust, biased, vindictive, or motivated by hidden agenda. A variety of discursive strategies were deployed, particularly invoking cultural moral orders, resorting to banal nationalism, expressing pride in one’s public service and allegiance to the monarchy, and invoking a constellation of religious, professional and national identities. In the case of the royal apologia, it was implicitly positioned in western discourses, such as invoking feminine ‘corporeal modernity’, to respond to the wardrobe overspending accusations. (shrink)

The main claim of this paper is that a general theory of negative concord (NC) should allow for the possibility of NC involving scoping of a universal quantifier above negation. I propose that Greek NC instantiates this option. Greek n-words will be analyzed as polarity sensitive universal quantifiers which need negation in order to be licensed, but must raise above negation in order to yield the scoping ∀¬. This gives the correct interpretation of NC structures as general negative statements. The (...) effect is achieved by application of QR, and the account is fully compositional, as only sentence negation is the vehicle of logical negation ¬. The aim of this paper is to describe the views of Henri Poincaré concerning axiom of choice, of which the statement by Zermelo in 1904 launched a sharp polemic. Shaking the mathematical society of the time, this controversy had its roots into the diversity of philosophical conceptions that mathematicians held about mathematics. Poincaré had a particular point of view; a few letters from him to Zermelo (1906?1907), together with papers published in Revue de métaphysique et morale at the same time, throw light on this view. Hegel draws a distinction between ‘judgements’ and ‘posits’. Judgements serve to explicate a unified subject matter, while posits do not. Because different forms of judgement are marked by specific combinations of logical constants with certain types of predicates, statements combining logical constants with predicates not ‘suited’ for each other cannot express judgements, but only posits. Current accounts of Hegel’s concept of judgement tend either to ignore or reject his conception of posits. This article shows that Hegel’s exclusion of a vast (...) variety of well-formed statements from the realm of judgements contains a valuable insight rather than a flaw. It demonstrates that certain statements, even if correct, cannot contribute to the explication of a non-arbitrarily unified subject matter. Doing justice to Hegel’s notion of posit thus serves to motivate his general conception of judgement as well as his classification of particular types of judgement. (shrink)

The probability of some generalizations can be lowered by positive instances. The change in probability can depend on factors other than the new evidence, the statement, and the probability of the statement given the old evidence.

The orthodox presentation of quantum theory often includes statements on state preparation and measurements without mentioning how these processes can be achieved. The often quoted projection postulate is regarded by many as problematical. This paper presents a systematic framework for state preparation and measurement. Within the existing Hilbert space formulation of quantum mechanics for spinless particles we show that it is possible (1)to prepare an arbitrary state and (2)to reduce all quantum measurements to local position measurements in an asymptotic (...) way by unitary evolution processes without recourse to the projection postulate. A generalization to spin-1/2particles is also given. The theory presented provides a general mathematical and theoretical foundation for many practical schemes for state preparation and measurement. In his undertaking to articulate the manifold of Leibnizian thought in view of a unified focal point, Kaehler concentrates on the relation between logic and metaphysics, which was inaugurated in the beginning of metaphysical thinking and which at the same time takes on special relevance in modern metaphysics. In light of the tendency, evident in post-Leibnizian metaphysics, to deprive logic of the status of a mere organon, of an ars, and to grant it a closer relation to metaphysics, this viewpoint (...) can lay claim to eminent interest. Kaehler’s main thesis is that Leibnizian logic as the science of the formal structures of truth points beyond itself to material presuppositions that can be realized only in a theology of reason. The simple and extremely composite concepts, which are inaccessible to the finite mens, demand as their correlate the establishment of the concept of a perfect reason. The ground of the investigation is laid by situating Leibniz’s logic within the framework of his metaphysics and by working out the ambivalence of the independence, “autonomy”, and reliance of natural reason on an infinite reason: “for natural reason, which metaphysically represents it, the ultima ratio has to be not only the cause of its being, but in the end also the ground of its knowledge”. A comprehensive and detailed reconstruction of Leibniz’s logic constitutes the main part of this work, a reconstruction which is centered on the aforementioned transition from the scientia generalis to metaphysics. The reconstruction of the systematic context of the logical forms, in that it articulates the genesis of these from one another out of their mere juxtaposition, goes beyond, on the one hand, what Leibniz himself achieved, but remains, on the other hand, within the bounds of the Leibnizian position insofar as the claim to a unified organization of the totality of natural reason’s knowledge of the forms of truth lies in the validity of the principium rationis itself—the fundamental presupposition of his logic. Kaehler surveys the region of Leibniz’s logic as a singular exposition of the natura veritatis; it must in the end always be possible to trace the forms of truth back to the relation of the containedness : “The predicate or the consequent is always in the subject or the antecedent. And the natura veritatis in general, or the connection between the terms of the statement, consists therein.” The procedure of the reconstruction is revealed in nucleo already in the presentation of the principal fundament of logic. It is easy to follow Kaehler’s reading of the principle of reason as the unfolding of the nature of truth. Yet the reconstructive intention first becomes manifest in the presentation of the principle of non-contradiction. Although Leibniz does not extensively discuss the interconnection of these principles, Kaehler takes the principle of non-contradiction to be a further determination of the principle of reason insofar as identity can be thought as identity only via its relation to contradiction: “The negation of the negation of truth, as the latter’s contradiction, first achieves the principal affirmation of reason as identity”. Kaehler’s systematization of Leibniz’s logic thus seems to pursue two objectives. First, it aims at the reduction of the entirety of logical knowledge to the natura veritatis—first of all at the reduction of the “two great principles” to the latter, then at the reduction of the inferences to statements and of statements to concepts. But second, the manifold of logical forms is not merely reduced to its principle; rather, their interrelation is posited as one of reflection, and here reflection means: the more developed and differentiated forms make explicit that which the simple forms contain. In order to indicate how these two objectives of the reconstruction intersect, we shall take up the elementary transition from categorical to hypothetical statements. (shrink)

In this essay I try to give some overall statements in order to show that new realism is to be understood as a kind of positive philosophy. Against constructivism, I argue that there is a prevalence of the objects themselves on our understanding of them because reality offers a resistance to our attempt to grasp it depending on its level of dependence from our own understanding, which is different in the case of natural objects, ideal object and social object. This (...) negativity leads to an ontological necessity of facticity. In the second part of this paper I will describe – through the exposition of three key concepts of new realism, i.e. “unamendability”, “interaction” and “affordance” – an ascending path for which the negative and the resistance turn into positivity. The leaders of many prominent health and mental health organizations have issued policy statements about the appropriateness of members of their professions being involved in assisted suicide, whether assisted suicide is ever an acceptable option for people, and what roles a professional can or should play when a client is considering assisted suicide. This article argues that only the latter focus-providing suggestions about how a professional can assist a person considering hastening death-is appropriate for an organization whose members are clinical (...) practitioners rather than theorists. The former 2 positions, it is contended, are merely political posturing and are counterproductive to providing proper care to clients in need. (shrink)

John King-Farlow's ‘The Positive McTaggart on Time’ brings out extremely important likenesses between ‘abstract’ metaphysicians and ‘concrete’ philosophers of science. These striking similarities illustrate a perennial human quest for Something More Basic than Time, a quest which characterizes not only mystics who rejoice in contradictions but hard-headed philosophers who submit to the rigours of logic. King-Farlow is largely concerned with the McTaggart of 1908 and his motivation for writing ‘The Unreality of Time’. I should like to explore further the surprising (...) bond between the Search for Something Deeper in the later McTaggart of The Nature of Existence and the writings on Time of Hans Reichenbach and Adolf Grünbaum. Reflection on this similarity should enable us better to evaluate the view that our vulgar, if practically useful, assertions about Time's Arrow must be reinterpreted by the wise in terms of chastened logical constructions out of statements about Something Deeper—logical constructions which are alleged, if chaste enough, to be eliminable. Many Faculties of Education in the UK and elsewhere have ‘social justice’ written into their mission statements. But are they concerned by questions of social justice in education, or has the term become somewhat vacuous and devoid of substantive meaning? The present article subjects recent discourses about social justice in education to scrutiny and finds them wanting in various respects, in particular when juxtaposed with historical accounts of justice by philosophers such as Aristotle or Aquinas. Among the complaints made here (...) is that most educational accounts (a) make do with a ‘negative’ conception of social justice as focused on specific cases of injustices without any positive conception of what social justice means in its entirety, (b) foreground institutional justice at the expense of justice as a moral or civic virtue, (c) fail to connect the identification of justice or injustice to an account of phronesis or practical wisdom for integrating values, (d) shy away from associating social justice with the ‘common good’ and (e) fail to get to grips with some thorny normative questions about the role of justice in the ordering of goods in a hierarchy towards the highest good. In the following the details of a state-of-affairs semantics for positive free logic are worked out, based on the models of common inner domain - outer domain semantics. Lambert's PFL system is proven to be weakly adequate (i.e., sound and complete) with respect to that semantics by demonstrating that the concept of logical truth definable therein coincides with that one of common truth-value semantics for PFL. Furthermore, this state-of-affairs semantics resists the challenges stemming from the slingshot argument since logically equivalent (...) statements do not always have the same extension according to it. Finally, it is argued that in such a semantics all statements of a certain language for PFL are state-of-affairs-related extensional as well as salva extensione extensional, even though their salva veritate extensionality fails. Terry Horgan has put forward an original account of truth as correct assertibility. That statement suggests that he defends some version of the epistemic conception of truth. However, this is not his intention. Horgan wants to overcome the familiar opposition between the robust correspondence theories of truth and the epistemic theories of truth by elaborating an intermediate or middle-of-the-road position. After presenting the main ideas of that position, I argue that it is less distinctive than Horgan maintains, (...) and may be accommodated to the epistemic theories of truth, provided they are construed widely enough. Being a relatively new practice started by Gerd Achenbach no more than 40 years ago, the methods and techniques implied in philosophical counseling, as well as the qualities a philosophical counsellor should possess are still up for debate. The theme of the current paper revolves around the traits of the philosophical counselor, starting from Roger Paden’s statement that the three characteristics identified by Carl Rogers as being essential for a counsellor are also suitable when it comes to philosophical counsellors (...) as well, with the mention that the approach should nonetheless be modified when it comes to unconditional positive regard, as he believes it to be incompatible with the nature of philosophical counselling. Our thesis is that the two are not incompatible and that, at least in the case of alienation, the philosophical counsellor should also grant the client unconditional positive regard. In support of our thesis, we will bring Rogers’ own ideas, Ran Lahav’s view of philosophical counselling as creating a link between philosophical discourse and everyday life, as well as the perspectives developed in the area of community philosophy. Discrepancies between the Uniform Determination of Death Act (UDDA) and the adult and pediatric diagnostic guidelines for brain death (BD) (the “Guidelines”) have motivated proposals to revise the UDDA. A revision proposed by Lewis, Bonnie and Pope (the RUDDA), has received particular attention, the three novelties of which would be: (1) to specify the Guidelines as the legally recognized “medical standard,” (2) to exclude hypothalamic function from the category of “brain function,” and (3) to authorize physicians to conduct an apnea (...) test without consent and even over a proxy’s objection. One hundred seven experts in medicine, bioethics, philosophy, and law, spanning a wide variety of perspectives, have come together in agreement that while the UDDA needs revision, the RUDDA is not the way to do it. Specifically, (1) the Guidelines have a non-negligible risk of false-positive error, (2) hypothalamic function is more relevant to the organism as a whole than any brainstem reflex, and (3) the apnea test carries a risk of precipitating BD in a non-BD patient, provides no benefit to the patient, does not reliably accomplish its intended purpose, and is not even absolutely necessary for diagnosing BD according to the internal logic of the Guidelines; it should at the very least require informed consent, as do many procedures that are much more beneficial and less risky. Finally, objections to a neurologic criterion of death are not based only on religious belief or ignorance. People have a right to not have a concept of death that experts vigorously debate imposed upon them against their judgment and conscience; any revision of the UDDA should therefore contain an opt-out clause for those who accept only a circulatory-respiratory criterion. Attempting to determine solutions for unethical practices in the field, this research was designed to assess the effectiveness of public relations firms’ ethics statements in decreasing the incidence of malpractice. This study revealed an encouraging finding that practitioners working in firms with ethical parameters were significantly more likely to engage in ethical practices. Moreover, educating public relations practitioners about the content of ethics statement could positively influence their ethical practices. At the same time, this study’s findings suggest further questions (...) for consideration in future scholarship and in the application of ethics statements to practice within the field. (shrink)

Public accounting firms must balance conflicting goals, including returning a profit for their owners (commercialism) and serving the public interest (professionalism). However, little is known about how these firms address this conflict and how it impacts financial performance. This study examines how accounting firms identify themselves in their mission statements through communicating their commercial or professional orientation. Our results suggest mission statements vary based on the service line from which accounting firms derive the majority of their revenue and firm size. (...) The mission statements of Tax and Management Advisory Services-dominant firms include more references to the commercial aspects of the public accounting enterprise, while Auditing and Accounting firms focus more on the professional aspects. Additionally, smaller (_larger_) firms are more likely to have mission statements that use language consistent with a professional (_commercial_) identity. We also find that commercialism-oriented components are positively associated with firm revenue growth and professionalism-oriented components are associated with lower revenue generation. We contribute to the mission statement literature by highlighting the association between mission statements and firm performance and to the accounting literature by providing empirical evidence of the role of mission statements in establishing the tone at the top of public accounting firms. In September 1998 the Bundesrztekammer, i.e., the German Medical Association, published new principles concerning terminal medical care. Even before publication, a draft of these principles was very controversial, and prompted intense public debate in the mass media. Despite some of the critics' suspicions that the principles prepared the way for liberalization of active euthanasia, euthanasia is unequivocally rejected in the principles. Physician-assisted suicide is considered to violate professional medical rules. In leaving aside some of the notions customarily used in the (...) euthanasia debate, e.g., passive euthanasia, the principles emphasize the obligation of physicians to offer and the right of patients to receive palliative care. The principles explicitly list modalities of basic treatment that are indispensable in all cases, such as the obligation to satisfy hunger and thirst. This statement is meant to resolve the dispute on nutrition and hydration at the end of life, as it shifts the focus of care from maintaining physiological parameters to satisfying subjective needs. For patients in a persistent vegetative state, artificial feeding is held to be obligatory. Yet, the principles make reference to recent German jurisdiction which permit the stopping of artificial feeding if it is in accordance with the patient's presumed will. Additionally, the wording concerning this issue is found to remain unclear. Patients' autonomy is strengthened by explicitly welcoming advance directives as a means to ascertain patients' wills. The principles mark some changes compared to earlier documents. They deserve careful analysis and should be considered in the international debate on issues concerning the end of life. (shrink)

Nursing Inquiry 2012; 19: 247–258 Patients’ statements and experiences concerning receiving mechanical ventilation: a prospective video‐recorded studyProspective studies using video‐recordings of patients during mechanical ventilator treatment (MVT) while conscious have not previously been published. The aim was to describe patients’ statements, communication and facial expressions during a video‐recorded interview while undergoing MVT. Content analysis and hermeneutics inspired by the philosophy of Gadamer were used. The patients experienced almost constant difficulties in breathing and lost (...) their voice. The most common types of communication techniques patients used were nodding or shaking the head. Their expressions were interpreted as stiffened facial expression, tense body position and feelings of sadness and sorrow. Nursing care for patients’ conscious during MVT is challenging as it creates new demands regarding the content of the care provided. In caring for patients undergoing MVT while conscious, establishing a caring relationship, making patients feel safe and helping them to communicate seem to be most important for alleviating discomfort and instilling hope. Speech and thought about what the law is commonly function in practical ways, to guide or assess behavior. These functions have often been seen as problematic for legal positivism in the tradition of H.L.A. Hart. One recent response is to advance an expressivist analysis of legal statements (Toh), which faces its own, familiar problems. This paper advances a rival, positivist-friendly account of legal statements which we call “quasi-expressivist”, explicitly modeled after Finlay’s metaethical theory of moral statements. This consists in a (...) descriptivist, “rule-relational” semantics combined with a pragmatic account of the expressive and practical functions of legal discourse. We argue that this approach is at least as well-equipped as expressivism to explain the motivational and prescriptive features of “internal” legal statements, as well as a fundamental kind of legal disagreement, while being better positioned to account for various “external” uses of the same language. We develop this theory in a Hartian framework, and in the final part of the paper argue (particularly against Toh’s expressivist interpretation) that Hart’s own views in The Concept of Law are best reconstructed along such quasi-expressivist lines. First, I show that the semantic thesis of scientific realism may be relaxed significantly—to allow that some scientific discourse is not truth-valued—without making any concessions concerning the epistemic or methodological theses that lie at realism’s core. Second, I illustrate how relaxing the semantic thesis allows realists to avoid positing abstract entities and to fend off objections to the “no miracles” argument from positions such as cognitive instrumentalism. Third, I argue that the semantic thesis of scientific realism should be relaxed because (...) it is possible for scientific statements to be partially true, and hence approximately true, without being false. This article is based on a Lecture given as part of the Franklin J. Matchette Foundation Lecture Series on Truth at the Catholic University of America, School of Philosophy, in 2002. It explores what theorists in the natural law tradition and modern legal theorists have argued about what makes propositions of morality and law true, focusing on the rubric of "reason" as opposed to "will." It seems probable, and perhaps inevitable, that theorists about the nature of truth in morality must (...) choose between reason and will - that morality, at its core, is either one or the other. What makes law distinctive is that it is, as a practical matter if not by conceptual necessity, a mixture of both. And it is this intertwining of reason and will, of normative system and practical reasoning, which makes assertions about the nature of legal truth, and theories about the nature of law, so difficult. The arguments about truth in law are as much disagreements about what it means to say that a legal proposition is truth as they are about what makes legal propositions true. Are declarations of truth in law statements about legal norms and legal sources, or are they statements about the results of particular disputes or particularized inquiries? There are obvious complilcations in speaking of truth in a context like law, where there is simultaneously an effort to create a coherent normative system and a decision-making procedure that can modify that system in the course of resolving disputes.
