According to the theory theory of metalinguistic disputes, disagreements in metalinguistic disputes are based on diverging underlying theories, opinions, or world views. An adequate description of metalinguistic disagreement needs to consider the compatibility and topics of such theories. Although topic continuity can be spelled out in terms of measurement operations, it is argued that even metalinguistic disputes about a term used in different, mutually compatible theories can be substantive because the dispute is indirectly about the virtues of the (...) underlying theories. This short paper begins with a summary of the views of a sympathetic game theorist on the current state of play in what is still called the New Institutional Economics. It continues with a much abbreviated summary of my own attempts to treat justice as a kind of institution in the hope that this will serve as a case study in how game theory can serve as a useful intellectual framework for the study of human institutions.

Our present moral traits are unable to provide the level of large-scale co-operation necessary to deal with risks such as nuclear proliferation, drastic climate change and pandemics. In order to survive in an environment with powerful and easily available technologies, some authors claim that we need to improve our moral traits with moral enhancement. But this is prone to produce paradoxical effects, be self-reinforcing and harm personal identity. The risks of moral enhancement require the use of a safety framework; such (...) a framework should guarantee practical robustness to moral uncertainty, empirical adequacy, correct balance between dispositions, preservation of identity, and be sensitive to practical considerations such as emergent social effects. A virtue theory can meet all these desiderata. Possible frameworks incorporate them to variable degrees. The social value orientations framework is one of the most promising candidates. (shrink)

Scientific realism is the position that success of a scientific theory licenses an inference to its approximate truth. The argument from pessimistic meta-induction maintains that this inference is undermined due to the existence of theories from the history of science that were successful, but false. I aim to counter pessimistic meta-induction and defend scientific realism. To do this, I adopt a notion of success that admits of degrees, and show that our current best theories enjoy far higher degrees of (...) success than any of the successful, but refuted theories of the past. Proponents of causal decision theories argue that classical Bayesian decision theory (BDT) gives the wrong advice in certain types of cases, of which the clearest and commonest are the medical Newcomb problems. I defend BDT, invoking a familiar principle of statistical inference to show that in such cases a free agent cannot take the contemplated action to be probabilistically relevant to its causes (so that BDT gives the right answer). I argue that my defence does better than those of (...) Ellery Eells and Richard Jeffrey; and that it applies, where necessary, to other types of Newcomb problem. (shrink)

I argue that disputes within constitutional theory about whether recent supreme court decisions exceed the scope of legitimate judicial review and disputes within legal theory about the nature and determinacy of law are best seen and assessed as disputes over the nature of legal interpretation. I criticize the interpretive assumptions on which these disputes generally depend and defend a theory of interpretation which tends to vindicate the determinacy of law even in hard cases and the style of (...) recent court decisions which many critics find troublesome. The traditional use of ergodic theory in the foundations of equilibrium statistical mechanics is that it provides a link between thermodynamic observables and microcanonical probabilities. First of all, the ergodic theorem demonstrates the equality of microcanonical phase averages and infinite time averages (albeit for a special class of systems, and up to a measure zero set of exceptions). Secondly, one argues that actual measurements of thermodynamic quantities yield time averaged quantities, since measurements take a long time. The combination of (...) these two points is held to be an explanation why calculating microcanonical phase averages is a successful algorithm for predicting the values of thermodynamic observables. It is also well-known that this account is problematic.

This survey intends to show that ergodic theory nevertheless may have important roles to play, and it explores three other uses of ergodic theory. Particular attention is paid, firstly, to the relevance of specific interpretations of probability, and secondly, to the way in which the concern with systems in thermal equilibrium is translated into probabilistic language. With respect to the latter point, it is argued that equilibrium should not be represented as a stationary probability distribution as is standardly done; instead, a weaker definition is presented. Scientific realists contend that theory-conjunction presents a problem for empiricist conceptions of scientific knowledge and practice. Van Fraassen (1980) has offered a competing account of theory-conjunction which I argue fails to capture the mercenary character of epistemic dependence in science. Representative cases of theory-conjunction developed in the present paper show that mercenary reliance implies a "principle of epistemic symmetry" which only a realist can consistently accommodate. Finally, because the practice in question involves the conjunction of theories, a (...) version of realism more robust than the "entity realism" of Cartwright (1983, 1989) and Hacking (1983) is required to explain the success of theory-conjunction. Until recently, many philosophers took Causal Decision Theory to be more successful than its rival, Evidential Decision Theory. Things have changed, however, with a renewed concern that cases involving an extreme form of decision instability are counterexamples to CDT :392–403, 1984; Egan in Philos Rev 116:93–114, 2007). Most prominent among those cases of extreme decision instability is the Psychopath Button, due to Andy Egan; in that case, CDT recommends a seemingly absurd act that almost certainly results in your (...) death. This renewed attention to decision instability has spurned an array of modifications to and rejections of CDT. I argue, however, that the Psychopath Button and its ilk are no counterexamples to CDT. That is, given the causalist’s commitments in Newcomb Problems, they already have the tools to justify CDT’s verdict in Egan-style cases of extreme decision instability. I first argue that there is no reason to think the Psychopath Button is a counterexample to CDT; in particular, many philosophers have placed too much weight on pre-theoretic intuition in Egan-cases, and apart from pre-theoretic intuition, arguments against CDT in cases of extreme decision instability are flawed. My second claim is that the causalist can provide good reasons for following CDT in cases of extreme decision instability. I present a new case, the Two Button Defense, that highlights precisely why the causalist can reasonably follow CDT in even the Psychopath Button. CDT therefore stands as a viable decision theory, without need for modification, restriction, or rejection. (shrink)

An understanding of the origins of earnings distributions is of central importance for any public policy which has the aim of combating economic inequality. The aim of this book is to provide a satisfactory theoretical foundation which could serve as the rational basis for such policies. The approach, strongly influenced by human capital theory, is especially novel in that it permits individual analyses at three interconnecting levels of aggregation using the same basic microeconomic model: the level of earnings distribution (...) within age groups; the level of the overall earnings distribution across all age groups; and the distribution of lifetime earnings. The analysis demonstrates the interdependence between age composition, inequality, and public distribution policy. In this article, I comment on Stephen White’s version of critical theory as presented in A Democratic Bearing. I specifically focus on his version of the “colonization thesis” and the social analysis this leads to. I also scrutinize his normative framework, especially the claim of non-foundationalism and the difference between his view and Kantian discourse theory.

The theory of mind (ToM) deficit associated with autism has been a central topic in the debate about the modularity of the mind. Most involved in the debate about the explanation of the ToM deficit have failed to notice that autism’s status as a spectrum disorder has implications about which explanation is more plausible. In this paper, I argue that the shift from viewing autism as a unified syndrome to a spectrum disorder increases the plausibility of the explanation of (...) the ToM deficit that appeals to a domain-specific, higher-level ToM module. First, I discuss what it means to consider autism as a spectrum rather than as a unified disorder. Second, I argue for the plausibility of the modular explanation on the basis that autism is better considered as a spectrum disorder. This article works across multiple disciplinary boundaries, especially queer theory, to examine critically the controversial, and often socially controlling, role of biomedical knowledge and interventions in the realm of human sexuality. It will attempt to situate scientific/medical discourses on sexuality historically, socially, and culturally in order to expose the ways in which “proper” sexual health in medical research and clinical practice has been conflated with prevailing social norms at particular historical junctures in the 20th and 21st centuries. How might (...) the relationship between clinical and cultural spheres be better engaged in biomedical knowledge and clinical practice in understanding sexual health, given the impact of homophobic and transphobic assumptions in the diagnostic histories of homosexuality and Gender Identity Disorder in Childhood, a new diagnostic category introduced into the DSM following the removal of homosexuality from the DSM-III? The article will argue further that biomedical knowledge is always already mediated through culture by analyzing normative racial, gender, class, and sexual ideologies that regulated early understandings of the epidemiology of the HIV/AIDS pandemic in the West and in the postcolonial world while informing global health policy on HIV/AIDS. The article concludes by examining the implications of medical education for both LGBTQI patients and medical professionals, for understanding gender and sexual rights as human rights, and for thinking about new kinds of interventions, contestations, and struggles to resist continued homophobic and transphobic assumptions in biomedical practice today and their ongoing effects in the everyday world. Originally published in 1987 and re-issued in 2020 with a new Preface, this book presents and elaborates interrelated solutions to a number of problems in moral philosophy, from the location of intrinsic value and the nature of a worthwhile life, via the limits of obligation and the nature of justice, to the status of moral utterances. After developing a biocentric account of moral standing, the author locates worthwhile life in the development of the generic capacities of a creature, whether human (...) or nonhuman, and presents an account of relative intrinsic value which later generates a theory of interspecific justice. This value-theory also informs a consequentialist understanding of obligation, of moral rightness and of supererogation. The understanding thus supplied is shown to cope with the problems of integrity, of justice and of the 'Repugnant Conclusion' in population ethics. A cognitivist account of ethical conclusions such as those so far reached is then defended against non-cognitivist and relativist objections and a far-reaching naturalist theory is defended, integrating earlier conclusions with an account of the logic of the fundamental ethical concepts. Physicists and philosophers argue whether quantum theory has spiritual implications. The vast majority of opinions are at two extremes: Some contend that quantum theory has absolutely no spiritual implications whatsoever, whereas others assert that it forms the very basis of a modern spirituality and can be directly applied to the human condition. It is this article's contention that neither extreme is correct. Quantum theory does have spiritual implications - a fact that its founders intuited and its enemies, (...) Einstein preeminent among them, considered prima facie evidence of its as yet undiscovered flaws. Quantum theory has proven itself against all challenges more successfully than any other scientific theory, but its spiritual implications are extremely subtle. It provides a boundary to the materialistic, deterministic worldview and shows that there must be more to reality than that, but is inherently incapable of providing evidence as to the nature of what lies beyond that boundary. As a post-Gricean pragmatic theory, Relevance Theory (RT) takes as its starting point the question of how hearers bridge the gap between sentence meaning and speaker meaning. That there is such a gap has been a given of linguistic philosophy since Grice’s (1967) Logic and Conversation. But the account that relevance theory offers of how this gap is bridged, although originating as a development of Grice’s co-operative principle and conversational maxims, differs from other broadly Gricean accounts in (...) certain fundamental respects, and leads to a stance on the nature of language, meaning and communication which is at odds, not only with the view of Grice himself, but also with the view common to most post-Fregean philosophy of language. Habermas absorb and integrate the achievements of contemporary philosophy of language, formed their own philosophy of language - in the form of pragmatics. This theory of speech acts by the meaning of the effectiveness of its intrinsic correlation between the demands of the analysis, pointed out the significance of speech acts only in the order presented in communicative action. Interpretation of speech acts in the ultimate source of the problem, Habermas introduces Husserl's "life-world" theory, and it was the (...) transformation of the form of pragmatics. Form pragmatics of life-world theory digestion of Husserl's life-world theory, a priori, while broadening the theory of Weber's rationalization of the behavior of sight. Habermas has absorbed and integrated many kinds of contemporary philosophy of language and constituted his own one, which is named formal linguistics. By analyzing the internal connection between the meaning of speech act and its validity claims, Habermas has emphasized that the meaning of speech act can be only demonstrated in communicative action. In the final analysis to the origin of meaning of speech act, he introduces Husserl's theory of lifeworld and reformulates it from the point of the formal linguistics. Habermas' theory of lifeworld removes the transcendental element existing in Husserl's theory , it enlarges Weber's theoretical horizon on rationalization of action at the same time. (shrink)

Amartya Sen argues that for the advancement of justice identification of ‘perfect’ justice is neither necessary nor sufficient. He replaces ‘perfect’ justice with comparative justice. Comparative justice limits itself to comparing social states with respect to degrees of justice. Sen’s central thesis is that identifying ‘perfect’ justice and comparing imperfect social states are ‘analytically disjoined’. This essay refutes Sen’s thesis by demonstrating that to be able to make adequate comparisons we need to identify and integrate criteria of comparison. This is (...) precisely the aim of a theory of justice (such as John Rawls’s theory): identifying, integrating and ordering relevant principles of justice. The same integrated criteria that determine ‘perfect’ justice are needed to be able to adequately compare imperfect social states. Sen’s alternative approach, which is based on social choice theory, is incapable of avoiding contrary, indeterminate or incoherent directives where plural principles of justice conflict. (shrink)

According to Adorno, an evil star hangs over the theory of natural beauty. The essay examines the reasons for this neglect of the beautiful of nature by confronting Kant's account of natural beauty with Hegel's theory about the fundamental deficiencies of beauty in nature and locates them in the essential indeterminacy of everything that belongs (...) to nature. Inquiring into what Adorno seeks to achieve by playing Kant and Hegel off against one another, it is shown that this indeterminacy of nature is both an index of nature's interconnectedness with mythical violence and the promise of a freedom from myth. If it can be agreed that health care resources are finite, it follows that choices between competing needs must be made. Cost utility analysis is an application of decision theory which has been proposed as a strategy for making difficult social decisions about health resource allocations. This method is heavily dependent upon the measurement of social utilities for various health outcomes. Recent work in cognitive psychology suggests that there are important sources of distortion in such measurement. The Complete Theory of Everything (CTE) is based on certain axioms of indiscernibility. Such axioms of indiscernibility have been given a philosophical justification by Kit Fine. I want to report on an attempt to give strong indiscernibility axioms which might also be subject to such philosophical analysis, and which prove the consistency of set theory; i.e., ZFC or more. In this way, we might obtain a (new kind of) philosophical consistency proof for mathematics.

The task of mapping the reception of mimetic theory in Latin America presents two challenges. On the one hand, rather than looking at just one country, this study has to take into account a mosaic of nations making up a continent, each with their own local diversities and particular complexities. Such circumstances impose specific rhythms onto the assimilation of Girardian thought, and being aware of these rhythms is vital to understanding the precise impact of mimetic theory.
