This paper examines Fichte's conception of the freedom of choice in Das System der Sittenlehre of 1798 as a solution to the dilemma posed by determinism and indeterminism. It show that Fichte does not simply affirm an indifferent power of voluntary choice, but demonstrates how such a power might co-exist with the measure of regularity and lawfulness we normally admit of human choices. Particular choices do not occur at random, but are based on general reasons. These reasons are in turn (...) based on the extent to which we have freely reflected on our original drive. Thus our choices can be comprehended and predicted from the point of reflection from which we choose. This does not lead to the denial of the freedom of choice, but only to rethinking it in terms of the freedom of reflection: Though we cannot choose other than what we choose from the point of reflection we occupy, we can choose other than what we choose by raising or lowering ourselves through reflection to a higher or lower point of reflection. Every year, the Vietnamese people reportedly burned about 50,000 tons of joss papers, which took the form of not only bank notes, but iPhones, cars, clothes, even housekeepers, in hope of pleasing the dead. The practice was mistakenly attributed to traditional Buddhist teachings but originated in fact from China, which most Vietnamese were not aware of. In other aspects of life, there were many similar examples of Vietnamese so ready and comfortable with adding new norms, values, and beliefs, even contradictory (...) ones, to their culture. This phenomenon, dubbed “cultural additivity”, prompted us to study the co-existence, interaction, and influences among core values and norms of the Three Teachings –Confucianism, Buddhism, and Taoism–as shown through Vietnamese folktales. By applying Bayesian logistic regression, we evaluated the possibility of whether the key message of a story was dominated by a religion (dependent variables), as affected by the appearance of values and anti-values pertaining to the Three Teachings in the story (independent variables). Our main findings included the existence of the cultural additivity of Confucian and Taoist values. More specifically, empirical results showed that the interaction or addition of the values of Taoism and Confucianism in folktales together helped predict whether the key message of a story was about Confucianism, β{VT ⋅ VC} = 0.86. Meanwhile, there was no such statistical tendency for Buddhism. The results lead to a number of important implications. First, this showed the dominance of Confucianism because the fact that Confucian and Taoist values appeared together in a story led to the story’s key message dominated by Confucianism. Thus, it presented the evidence of Confucian dominance and against liberal interpretations of the concept of the Common Roots of Three Religions (“tam giáo đồng nguyên”) as religious unification or unicity. Second, the concept of “cultural additivity” could help explain many interesting socio-cultural phenomena, namely the absence of religious intolerance and extremism in the Vietnamese society, outrageous cases of sophistry in education, the low productivity in creative endeavors like science and technology, the misleading branding strategy in business. We are aware that our results are only preliminary and more studies, both theoretical and empirical, must be carried out to give a full account of the explanatory reach of “cultural additivity”. This paper aims to clarify how, as Fichte himself claims in a 1800 letter draft, the theory of intersubjectivity he presents in the 1800 Vocation of Man marks an improvement over the theory he presents in the 1798 System of Ethics. Taking my departure from Marco Ivaldo’s suggestion that Fichte ceases to rely on the “good” but still “rather dogmatic” Leibnizian hypothesis of preestablished harmony in the former work in the way that he does in the latter, I argue that (...) the difference lies in his no longer counting on the hypothesis to secure the agreement of each of our worlds and our perception of each other’s actions in it. Fichte attempts to dispense with this last vestige of dogmatism in the Vocation of Man by employing the ethical drive in its material determinateness (in other words, each of our final end) as a transcendental ground for the agreement of our worlds, and thereby the possibility of intersubjectivity. The communal conception of our final end which Fichte develops in the last part of the System of Ethics prepares it for its role as such a ground. For it is in the demand of the “voice of conscience” in us to co-operate with others to bring about “one great free moral community” that he finds in the Vocation of Man a transcendental source and basis for our conviction that the worlds of others’ perceptions agree with the world of our perception. We make some beginning observations about the category Eq of equivalence relations on the set of natural numbers, where a morphism between two equivalence relations R and S is a mapping from the set of R-equivalence classes to that of S-equivalence classes, which is induced by a computable function. We also consider some full subcategories of Eq, such as the category Eq(Σ01) of computably enumerable equivalence relations (called ceers), the category Eq(Π01) of co-computably enumerable equivalence relations, and the category Eq(Dark*) (...) whose objects are the so-called dark ceers plus the ceers with finitely many equivalence classes. Although in all these categories the monomorphisms coincide with the injective morphisms, we show that in Eq(Σ01) the epimorphisms coincide with the onto morphisms, but in Eq(Π01) there are epimorphisms that are not onto. Moreover, Eq, Eq(Σ01), and Eq(Dark*) are closed under finite products, binary coproducts, and coequalizers, but we give an example of two morphisms in Eq(Π01) whose coequalizer in Eq is not an object of Eq(Π01). El presente ensayo es una puesta a punto del anterior artículo del autor, que publicado en español en una revista francesa, apenas tuvo difusión en España. Lo fundamental de este, además de aclarar algunos aspectos de aquel, es sacar las consecuencias morales que de él se derivan. En el primer apartado se insiste en la ruptura fenomenológica de la brecha entre la sensibilidad y el entendimiento en la medida en que este vive de la sensibilidad. En el segundo se aclara (...) mediante el recurso a la trascendentalidad animal la ruptura con todo residuo medieval en la palabra “trascendental”, lo que se llama el “carácter profiláctico” del texto. En el tercero, que incluye el grueso del ensayo, se expone cómo los campos objetivos que se analizan en Ideas II, entre ellos los animales, de ser objetos constituidos se convierten en sujetos co-constituyentes. Por fin en el último apartado se plantea el alcance de esa que Husserl llama articulación intencional (de la animalidad y la humanidad), y que yo llamo “articulación trascendental”, interna y externa, gracias a la cual estamos incluidos en la intersubjetividad total de la vida, por la que se hace patente nuestra responsabilidad ante la vida animal. Background: Frailty is a common syndrome among older adults and patients with several comorbidities. Grip strength is a representative parameter of frailty because it is a valid indicator of current and long-term physical conditions in the general population and patients with severe mental illnesses. Physical and cognitive capacities of people with SMIs are usually impaired; however, their relationship with frailty or social functioning have not been studied to date. The current study aimed to determine if GS is a valid predictor (...) of changes in cognitive performance and social functioning in patients with type-2 diabetes mellitus and SMIs. Methods: Assessments of social functioning, cognitive performance, and GS were conducted in 30 outpatients with type 2 diabetes mellitus, 35 with major depressive disorder, 42 with bipolar disorder, 30 with schizophrenia, and 28 healthy controls, twice during 1-year, follow-up period. Descriptive analyses were conducted using a one-way analysis of variance for continuous variables and the chi-squared test for categorical variables. Differences between groups for the motor, cognitive, and social variables at T1 and T2 were assessed using a one-way analysis of covariance, with sex and age as co-variates. To test the predictive capacity of GS at baseline to explain the variance in cognitive performance and social functioning at T2, a linear regression analysis was performed. Results: Predictive relationships were found among GS when implicated with clinical, cognitive, and social variables. These relationships explained changes in cognitive performance after one year of follow-up; the variability percentage was 67.7%, in patients with type-2 diabetes mellitus and 89.1% in patients with schizophrenia. Baseline GS along with other variables, also predicted changes in social functioning in major depressive disorder, bipolar disorder, and schizophrenia, with variability percentages of 67.3, 36, and 59%, respectively. Conclusion: GS combined with other variables significantly predicted changes in cognitive performance and social functioning in people with SMIs or type-2 diabetes mellitus. Interventions aimed to improve the overall physical conditions of patients who have poor GS could be a therapeutic option that confers positive effects on cognitive performance and social functioning. Generics are exception-admitting generalisations, which find expression in apparently diverse linguistic forms. A standard claim is that there is a hidden linguistic unity to genericity in the form of a covert operator, Gen. This article surveys and rejects a range of considerations that purport to show Gen to be syntactically essential to the explanation of a range of linguistic phenomena connected to genericity. The conclusion reached is that genericity is not a specifically linguistic property insofar as it does not supervene (...) upon any especial linguistic device; rather, genericity supervenes on broader cognitive competencies within linguistic constraints. Cette étude contrastive français-allemand porte sur les structures constituées d’un groupe nominal – parfois seulement d’un lexème nominal – et d’un nom anthroponyme, comme Le capitaine Haddock / Kapitän Haddock ; l’oncle Charles /Onkel Karl ; Le poète Gottfried Benn /der Dichter Gottfried Benn. L’usage de l’article n’étant pas identique en français et en allemand, la comparaison de ces constructions donne des indications sur le fonctionnement différent de certains noms, notamment de fonction / statut / métier. L’étude ne porte donc (...) pas uniquement sur les GN sans déterminant, mais plutôt sur la présence ou l’absence du déterminant défini dans les constructions N1N2. Ces structures, traditionnellement appelées « appositions liées », sont comparées à des appositions et constructions détachées recourant aux mêmes classes sémantiques de noms, où le GN employant un nom commun peut être dépourvu de déterminant, et pour lesquelles l’emploi d’une virgule dépend de conditions co- et contextuelles qui seront mises en lumière. La comparaison des différents types d’apposition laisse apparaître la ténuité de leurs frontières et permet d’observer, entre autres, la différence entre emploi désignatif et emploi dénominatif de N1. Over the last decade, cities, counties, and states across the United States have enacted higher minimum wages, paid sick leave and family leave, domestic worker protections, wage theft laws, “Ban the Box” removal of questions about conviction history from job applications, and fair scheduling laws. Nevertheless, vulnerable workers still do not trust government to come forward and report labor law violations. The article argues that while increasing the size of the labor inspectorate and engaging in strategic enforcement are necessary, they (...) are not sufficient. It argues that co-enforcement, in which government partners with organizations that have industry expertise and relationships with vulnerable workers, has the potential to manage the shifting and decentralized structures of twenty-first-century production, which were explicitly designed to evade twentieth-century laws and enforcement capabilities. The article aims to contribute to a broader understanding of the role of organizations in enforcement and the circumstances in which their effectiveness can be maximized. It sets forth a set of scope conditions and mechanisms and examines empirical cases of co-enforcement in Austin, Los Angeles, and San Francisco. The main findings are that co-enforcement is most enduring when government agencies and worker organizations recognize each other’s unique capacities, rather than attempt to substitute for one another ; the effort focuses on a specific industry; and the collaboration receives strong political support. Sustaining the impacts of co-enforcement is found to require greater formalization of the partnership and funding streams. (shrink)

Aussi bien, le lieu de la réalité humaine est délimité par la frontière qui la sépare du monde des simples vivants et de la simple vie. Par toute son existence, l’homme est cet être qui est de part en part un être biologique, et toute son existence se construit dans l'écart creusé et maintenu a l'endroit de la simple vie. Il n’у а раs d’homme sans la vie et l'humain commence, dans l'homme, au moment ou l'existence prend ses distances á l'éndroit de la simple vie. Par toute son existence, il appartient au monde de la communauté de ses semblables, et tout est en lui faqonné par son appartenance à cette communauté, mais c’est dans la proximité de ce semblable que l'homme découvre la realité des l'inhumain qui nait de l'irruption de la violence engendrée par la cohabitation. L'homme est enfin cet être qui se reconnait proche du divin et il ne découvre la grandeur de l'humain en lui qu'en découvrant dans l’eclat de la beauté et de la pensée comme une trace ď'une realité d’un autre ordre, ce qu’ il nomme le divin. Mais à ne pas savoir reconnaitre qu’il n’est qu’un homme et non pas un dieu, il se voue á la folie de la démesure et a se vouloir trop grand, il se perd. Le lieu propre de l'humain de l'homme doit donc être recherché en cette relation toujours complexe où le plus proche ne peut se laisser comprendre que dans la distance, et la proximité dans ľécart. À partir de l'analyse de la trajectoire de la technologie RFID est posée l'hypothèse qu'il n'existe pas d'innovation réussie sans co-construction de connaissances partagées par l'ensemble des acteurs intéressés au sein d'un espace public. Travailler sur l'innovation nécessite donc de parcourir cette chaîne qui transforme l'information en connaissances par un processus complexe de communication.The adoption of innovative technology can not be explained simply by the adequacy (...) of an offer to a request. From the analysis of the trajectory of the RFID is raised the hypothesis that there is no successful innovation without co-construction of knowledge shared by all stakeholders in a public space. Poètes, comme Maurice Roche pour la France et Rein Bloem pour les Pyas-Bas. Psychanalyste: Anton Mooij. Sociologues: le néerlandais Pieter Nijhoff et le français Jean Duvignaud. Historiens: Robert Muchembled. Professeurs de littérature (...) française (Roger Kempf) et de linguistique (Teun van Dijk).Cette diversité dans la formation, cette convergence des points de vue, voilà peut-être ce qui a permis de cerner le difficile concept d'enfermement. S'agit-il bien d'ailleurs d'un concept? N'est-ce pas là un mythe à la mode? Toutes les civilisations, toutes les sociétés définissent et suscitent, chaque fois d'une manière différente et pour elles-même, une certaine expérience de l'enfermememnt. Pour la mort ou la sexualité sans doute, mais aussi pour l'art et le savoir: les idéologies ou les doctrines ne sont-elles pas aussi des formes de l'enfermement? Il s'agit alors de se demander pourquoi notre époque, et plus particulièrement une certaine situation de la société intellectuelle, valorise, non sans complaisance, cet "enfermement". (shrink)

Les coocurrences ont surtout servi jusqu’ici à établir les relations, principalement sémantiques, que les mots ont entre eux. On les relevait certes dans un corpus, mais de façon indifférenciée, sans opposer les textes les uns aux autres. Or la comparaison des textes est la démarche habituelle quand la lexicométrie s’occupe des mots simples. On se propose ici d’étendre aux données cooccurrentielles les méthodes et les outils statistiques qui ont fait leurs preuves au niveau lexical. New Statistical Processing of Co-occurences by (...) HYPERBASE. The co-occurrences have mainly been studied to establish semantic relations, i.e., the relation in-between words. Certainly, they use to be extracted from a corpus, but indiscriminately, without taking into consideration the text divisions. When dealing with simple words, the usual approach is the comparison of texts. Here, we propose to extend those methods, approved at the lexical level, and to enlarge the application of statistical tools even to co-occurrential data. (shrink)

By Norman Fischer, et al. Edited by Patrick Hart, with an afterword by David Steindl-Rast and a translation of the Rule by Patrick Berry. New York: Riverhead Books, 2001. xvi + 222 pp. When Buddhist and Christian monastics meet, they recognize each other as brothers and sisters engaged in a (...) similar quest, despite their doctrinal differences. The nature of this quest is explored in Benedict's Dharma, in which four Buddhists (Norman Fischer, Joseph Goldstein, Judith Simmer-Brown, and Yifa, representing the Zen, Theravadin, Tibetan, and Chinese Buddhist traditions) ruminate on their fraternal and sororal feelings.Venerable Yifa, a nun of the prominent Taiwanese monastery Fo Guang Shan, is the only one of the four in monastic vows, and the reader may wonder what the three non-monastics could offer to a discussion on the monastic life. This is not a new problem. Patrick Henry and Donald Swearer's groundbreaking study, For the Sake of the World: The Spirit of Buddhist and Christian Monasticism (1989), spends a great deal of time on Zen monks, even though there are no Zen monks, theVinaya is kept by the Zen nuns or by the monastics of the parent and sibling lineages of Chan, Son, and Thien. (See my review article, "Why Are There Monks and Nuns?" in Buddhist-Christian Studies 12.) The monastic, it seems, is not confined to the habit.Brother David Steindl-Rast, a monk of Mount Saviour Monastery, grapples with this problem in his afterword, "Conclusions about a Beginning." It was at Mount Saviour that the phrase "the monastic dimension" was coined, to refer to those of monastic bent who for one reason or another did not or could not live in the cloister. One of Brother David's books was to be called, he told me, The Monk in Us, "us" meaning laypeople, but the title had an odd sound and was dropped. So, what is the monastic dimension? Brother David suggests that it is mindfulness, and he comes close to saying that wherever there is mindfulness, there is monasticism. "If mindfulness is all that matters, the monastery is merely a most convenient environment for this kind of life, but it can be lived anywhere, by anyone" (126). He goes on to discuss the phenomenon of monasteries shrinking in size at the same time as the number of long- and short-term visitors to monasteries grows, and proposes that we are moving toward a new understanding of the terms "contemplative," "monastic," and "lay."This insight may point to the most important contribution of this book. It is not about monasticism per se, and it is not a comparative study of the Rule and the Vinaya, with practical suggestions for their mutual reform; rather, it is a meditation on how anyone, monastic or lay, might live the contemplative or mindful life. Throughout the history of the Church and the sangha, laypeople have been in the majority, but attention has been focused on the priests and monastics. Pope Pius X [End Page 159] put it bluntly: the laypeople are the sheep who are to be led, and the clergy are the shepherds who lead. The Church, he added, is not a democracy. I do not know of a Buddhist who has been quite this straightforward, but many have come close, and the history of Buddhism is not that of a democracy. Occasionally, lay movements in both traditions have arisen, basing themselves on the doctrine of the priesthood of all believers or on the teaching of universal Buddha-nature, but they have quickly been co-opted by leaders who proclaimed themselves to be more equal than their fellows. The tragedy for both Buddhism and Christianity is that the contemplative or mindful life has become restricted to a group of professionals, with the attendant belief that such a life is unattainable by most Buddhists and Christians. S'il est une séduction littéraire, elle réside dans l'invention d'une subjectivité impersonnelle: on ne parle pas de soi en littérature. ABSTRACT Recently, in a series of papers, Joshua Spencer has introduced, defended, and developed a modified version of Neo-Russellianism, namely Plenitudinous Russellianism, according to which there are structurally identical but numerically distinct singular Russellian propositions. PR claims to provide novel semantic solutions to all the major problems that NR faces with no radical revision in NR. In this paper, I introduce a semantic puzzle for PR: the view leads to the violation of the principle of substitutivity of co-referential proper names (...) within simple ‘that’-clauses. I consider different responses to my argument, and show that none of them is fully satisfactory for the Russellian. I conclude that PR needs to depart from NR more radically. RÉSUMÉ Récemment, Joshua Spencer a publié une série d'articles où il expose, défend et développe une version modifiée du Néo-Russellianisme, appelée Russellianisme de plénitude, selon laquelle il y a des propositions Russelliennes singulières structurellement identiques mais numériquement distinctes. In lieu of an abstract, here is a brief excerpt of the content:Dialogue and Liberation:What I Have Learned from My Friends—Buddhist and ChristianPaul KnitterMy co-coordinator for this conference, Kyeongil Jung, has given me a rather daunting assignment for this lecture: within no more than forty minutes, I am supposed to (1) draw some insightful conclusions for our conference, (2) bid farewell to Union Theological Seminary as I sail off into retirement, and (3) reminisce on the past fifty years of my (...) life. The easiest and most enjoyable of these assignments will, I suspect, be the most effective in covering them all: I’m going to focus on reminiscing.It all started for me more than fifty years ago as I stood in the Piazza San Pietro on October 11, 1962, having just arrived in Rome two weeks earlier to begin my theological studies at the Gregorian University. There, awestruck and euphoric, I watched Pope John XXIII lead some two thousand bishops into the Basilica of St. Peter to begin the Second Vatican Council. That council, especially in its revolutionary “Declaration on the Church’s Attitude toward Non-Christian Religions” (Nostra Aetate), is where for me things took off—where I first felt the challenge of religious diversity and the inspiration to take up the challenge. Vatican II opened the door and beckoned Christians to enter into a life-giving dialogue with other religious communities—and to work out a theology that would support and animate such a dialogue. That, essentially, has been the business I have been about over these past fifty years: laying the foundations for, and then trying to engage in, an interreligious dialogue that will be truly life-giving and world-healing.But on the occasion of this conference and of this lecture, surrounded by so many old and new friends, I’ve come to realize, with a stunning clarity that I did not have before, that what has inspired and guided me in my efforts to respond to religious diversity over these past five decades has been friends much more than books. Yes, over the years, I have tried to put in my required academic hours of study: I have developed a sizeable amount of what Germans call Sitzfleisch. But tonight, as I look upon the faces of so many old friends with whom I have walked, and of so many new, younger friends with whom I try to keep pace, it is clear to me that most of the theological convictions and spiritual discoveries that have sustained my professional and personal life have become true for me—really true and trustworthy—because I have [End Page 173] seen them embodied in the lives of my friends and fellow searchers. Other people, in the kind of lives they live, have inspired me, challenged me, convinced me, more than any coherent, creative theological, philosophical, or political argument. It is my purpose to explore some of the problems concerning the relation between divine creation and creaturely freedom by criticizing various versions of the Free Will Defense (FWD hereafter).1 The FWD attempts to show how it is possible for God and moral evil to co-exist by describing a possible world in which God is morally justified or exonerated for creating persons who freely go wrong. Each version of the FWD has its own story to tell of how it is (...) possible that God be frustrated in his endeavor to create a universe containing moral good sans moral evil. The value of free will is supposed to be so great that God is morally exonerated under such circumstances for creating the Mr. Rogers type persons you know, the very same people who are good sometimes are bad sometimes. If it is objected that God could not be unlucky in this manner, that it necessarily is within his power to create goody-goody persons, either by supernaturally willing in his own inimitable manner that it be so, which is the theological compatibilist objection, or by a judicious selection of the initial state of the universe and operant causal laws which together entail that every free action be morally right, which is the causal compatibilist objection, the response is that it is logically incompatible that a creaturely free action be determined by God or by anything external to the agent, such as causes outside of the agent. Then, every "therapy" is plunged into a "pathos-with" whose concrete exercise reveals itself in this "transcendental view" on the other's suffering, without ignoring the possibilities of the medical science, that remains, however, subjected to this primordial "intropathic community". Objectives: This study attempts to analyse the ethical dilemmas arising from the microallocation of scarce health care resources, in terms of deontology and utilitarianism.Methods: A group of 395 people were interviewed in the region of Diadema, greater San Paulo, Brazil, while visiting patients in the only state hospital in town. Each interviewee was given a list of eight simulated emergencies . In each of the eight cases the interviewee had to choose which of the two patients described, both of whom (...) suffered from exactly the same problem, should receive the only hospital bed currently available. The differences between the hypothetical patients were as follows: age, gender, family dependency, and lifestyle. Each interviewee was asked to justify one of their responses. These responses were then analysed.Results: The results pointed to the co-existence of deontological and utilitarian orientations among the people interviewed. A tendency to give priority to the destitute was revealed throughout the research, contradicting the idea that society, valuing only productive people, wishes only such people to receive the most resources, thus maximising the benefits to be gained from resources. The results showed that people’s disapproval of the alcoholic was stronger than that of the nicotine abuser. (shrink)

It represents an identifying habit, an incorrigible feature (...) of style and sensibility. His texts in which theologians, philosophers, poets, dramatists, and saints are christianly praised give testimony to a catholicity that barely brooks limits. Not only in true Gospel fashion are a multitude invited to the eschatological banquet, they constitute the vast medium of tradition, in which Maximus the Confessor rubs shoulders with Plato, in the company of Claudel, Calderon, and Therese of Lisieux. At different times Balthasar thinks of the tradition as one huge symphony in which notes sound only to be transcended and as a conversation between particular perspectives on the great mystery of redemption, no one of which is final and which meet only in the infinity of their object. It is this prohibition of excessive difference in Balthasar's reading of tradition that I would like to examine here. I take as my case study of Balthasar's rhetoric of reading his conflicted response to Meister Eckhart, about whose inclusion in the Christian tradition Balthasar expresses no doubts, yet whose theological message is such as to cause anxiety. We shall occupy ourselves in this paper with the way in which Eckhart's nonnegotiable inclusion within the tradition serves to repress the account of those features that present a fundamental challenge, that represent difference that would make the Christian field radically heterogeneous. In the first two sections, focusing mainly on the fifth volume of The Glory of the Lord (=GL),3 I shall offer outlines of both the positive and negative contributions Eckhart is deemed to have made to the theological tradition. Though I do not wish to give the impression of Scholastic pro and contra, Balthasar's positive remarks being imbricated with the negative and vice versa, it will be suggested that the elements adduced in both cases constitute mirror images of each other. Balthasar takes a bifocal, though not stereoscopic, view of a group of five elements: aesthetic disposition, the sameness of Being and God, the whylessness of the divine, Gelassenheit, and Gottesgeburt. This group is in effect read twice, once in a way that affirms and confirms Eckhart's unproblematic inclusion in the tradition (section 1), and again in a way that, in the light of basic Christian principles, raises serious questions about such inclusion (section 2). In a final section the question is raised whether the conflict in interpretation suggests a deeper underlying conflict between Balthasarian commitment to Catholic theological principles and catholicity. Reactualizando una disciplina relativamente descuidada en nuestro medio como lo es la Filosofía del Derecho, el libro La violencia del derecho y la nuda vida estudia la compleja relación entre la violencia jurídica y la vida, e indaga por las condiciones a las que se puede reducir la vida humana cuando el ejercicio del poder se vale del control de la vida misma. En este marco general, el libro desarrolla la ruta trazada por Walter Benjamin en su famoso ensayo Para (...) una crítica de la violencia (1921), al establecer la indisoluble imbricación entre derecho y violencia en la que la segunda le ofrece a la primera su fundamentación. Con este presupuesto, el libro se orienta en primer lugar a desmentir la opinión corriente según la cual el derecho es justicia, para movilizar en su lugar otro fundamento según el cual el derecho es fuerza, poder o violencia, nociones que a efectos de la argumentación resultan sinónimas. En apoyo de esta tesis, la autora reconstruye dos tradiciones de la Filosofía del Derecho como son las doctrinas del derecho natural principalmente en San Agustín y en Santo Tomás de Aquino, y la tradición del derecho positivo cuyo origen losó co se remonta a las obras de Pascal, Hobbes y Spinoza. Third, considering the historical horizon as ontologically constitutive of Da-sein, we try to explain from real life what does this temporality mean and what does create mean, as well as why the creation of a work of art occupies an important place in relation to Heidegger’s proposal. We finally ask what is poetry to Heidegger and in what ways it is inseparable from the truth (aletheia). And we try to interpret the scope of Poetry (Dichtung) in relation to aesthetics and of language in relation to the truth.
