We often assume that religious beliefs are no different in kind from ordinary factual beliefs—that believing in the existence of God or of supernatural entities that hear our prayers is akin to believing that May comes before June. Neil Van Leeuwen shows that, in fact, these two forms of belief are strikingly different. Our brains do not process religious beliefs like they do beliefs concerning mundane reality; instead, empirical findings show that religious beliefs function like the imaginings that guide make-believe (...) play. -/- Van Leeuwen argues that religious belief—which he terms religious “credence”—is best understood as a form of imagination that people use to define the identity of their group and express the values they hold sacred. When a person pretends, they navigate the world by consulting two maps: the first represents mundane reality, and the second superimposes the features of the imagined world atop the first. Inspired by Bas van Fraassen’s Stance Empiricism, Anjan Chakravartty has developed a pluralistic account of what he calls epistemic stances towards scientific ontology. In this paper, I examine whether Chakravartty’s stance pluralism can exclude epistemic stances that licence pseudo-scientific practices like those found in Scientology. I argue that it cannot. Chakravartty’s stance pluralism is therefore prone to a form of debilitating relativism. I consequently argue that we need (1) some ground or constraint in relation to which epistemic stances can be (...) ranked by degrees, and (2) some way to demarcate science from pseudo-science so that we know what epistemic stances are about. Regarding (1), I argue that empirical detectability can serve as the ground in relation to which epistemic stances are ranked by degrees. Regarding (2), I argue for ranking sciences on a continuum according to established institutional criteria, rather than attempting to draw a strict demarcation. (shrink)

Abstract This paper argues that in modern (agro)biotechnology, (un)naturalness as an argument contributed to a stalemate in public debate about innovative technologies. Naturalness in this is often placed opposite to human disruption. It also often serves as a label that shapes moral acceptance or rejection of agricultural innovative technologies. The cause of this lies in the use of nature as a closed, static reference to naturalness, while in fact “nature” is an open and dynamic concept with many different meanings. We (...) propose an approach for a dynamic framework that permits an integrative use of naturalness in debate, by connecting three sorts of meaning that return regularly in the arguments brought forward in debate; cultural, technological, and ecological. We present these as aspects of nature that are always present in the argument of naturalness. The approach proposes a dynamic relation between these aspects, formed by gradients of naturalness, which in turn are related to ethical concerns. In this way we come to an overview that makes it possible to give individual arguments a relative place and that does justice to the temporality of the concept of nature and the underlying ethical concerns stakeholders have in respect to innovation in agriculture. William Whewell’s 19th-century views are seldom given a prominent place in the history of the philosophy of science. There is, however, a key feature of his account that is, upon historical analysis, prescient of later developments, notably in pragmatism. Whewell calls this the “fundamental antithesis of philosophy”, which centres around the idea that there is no clear demarcation between subject and object (between mind and world or theory and fact). In this paper, I trace this notion’s genealogy. It originated with (...) Kant, who influenced Whewell. Whewell then developed it into a detailed thesis, one that influenced Peirce. It is identifiable in Quine, then (middle) Putnam, and now Cheryl Misak and Steven Levine (aka the new pragmatists). The purpose is to identify a previously overlooked lineage of influence running through the history of philosophy. Whewell’s antithesis might also offer a way to resist both the relativism that tends to accompany post-modern styles of pragmatism and the pretensions to a God’s-eye view latent in analytic metaphysics. Metaphors for the encounter between God and humanity and a roaming theologian’s reflective journey. This article maps the theology of Christo van der Merwe as a mobilising theology which aided the Netherdutch Reformed Church in Africa in discerning its character, role and purpose. The core of Van der Merwe’s theology consists of a journey with God as encountered in the narratives about Jesus and the Spirit told in the Christian Bible. The article shows that the mobilising core of his theology (...) is due to an ‘interoperational relationship’ between ‘knowing and believing’. In the article, the metaphor ‘roaming’ is used to illustrate this biographical journey as contextual theology which equips pastors with ministerial skills to take care of people who are haunted by trauma. The introduction of the concept of strategic maneuvering into the pragma-dialectical theory makes it possible to formulate testable hypotheses regarding the persuasiveness of argumentative moves that are made in argumentative discourse. After summarizing the standard pragma-dialectical approach to argumentation, van Eemeren, Garssen, and Meuffels explain what the extension of the pragma-dialectical approach with strategic maneuvering involves and discuss the fallacies in terms of the extended pragma-dialectical approach as derailments of strategic maneuvering. The Report's editorial mandate is both to examine issues of current importance and to invite bioethics to broaden the range of issues it probes. Thus along with articles exploring the relationship between patients and doctors, or health policy, or any of the myriad other familiar concerns of ethics in medicine, from time to time the Report has published articles about public health, animal experimentation, or “environmental ethics” broadly construed. The most recent was the special supplement Nature, Polis, Ethics in the (...) November‐December (1998) issue. Some, of course, have argued that “bio‐ethics” ought always to encompass concern for issues beyond the bedside. When the biologist Van Rensselaer Potter proposed the term bioethics nearly thirty years ago, the field he had in mind lay at the intersection of ethics and the biological sciences in general. In light especially of Nature, Polis, Ethics's call for a substantive “humans‐nature ethics” it seems appropriate, therefore, to invite one of the earliest proponents of a generous understanding of bioethics to reflect on the character of the field and the questions with which it should grapple. We study a logic for deontic necessity and sufficiency, as originally proposed in van Benthem :36–41, 1979). Building on earlier work in modal logic, we provide a sound and complete axiomatization for it, consider some standard extensions, and study other important properties. After that, we compare this logic to the logic of “obligation as weakest permission” from Anglberger et al. :807–827, 2015).

How much room should we give a party for rephrasing or revising her adversary’s standpoint in a manner that suits her individual purposes in the dialogue? Certainly, as textbooks in argumentation and (...) critical thinking make clear, we should steer clear of erecting and attacking straw men (Ennis 1996, 172; Govier 1985, 109–12; Groarke, Tindale, and Fisher 1997, 123). Still, a critic in a discussion or debate should be given some room to maneuver in order to rephrase the arguer’s position in her own words or to get at the underlying position of the arguer. In this article, I will be dealing with this issue from the pragma-dialectical perspective of strategic maneuvering between the shared dialectical objective of resolving a difference of opinion and the individual rhetorical objective of persuading the other side. According to existing accounts of the straw man fallacy (Talisse and Aikin 2006; Van Eemeren and Grootendorst 1992; Walton 1996), the criterion for fallaciousness resides in whether or not the critic misrepresents or distorts the arguer’s actual position. In this article I intend to provide more detailed guidelines for critics: a critic distorts or [End Page 195] misrepresents a position when she changes the formulation or nature of the arguer’s standpoint, even though this contribution by her cannot be reconstructed as containing a proposal for a change that might be acceptable to the arguer.In section 2 I will elaborate on the notion of confrontational maneuvering, that is, of strategic maneuvering between the dialectical and rhetorical goals that arise from the confrontation stage of a critical discussion. In section 3 I will characterize the form of maneuvering where an antagonist reformulates or modifies the protagonist’s standpoint in an opportune way. In section 4 I will examine the conditions under which applications of maneuvering of this kind can be sound and legitimate from a dialectical perspective and relate these conditions to the straw man fallacy. In section 5 the results of the preceding sections will be applied to a case.2. Confrontational ManeuveringIn argumentative discourse, participants typically try to achieve two kinds of objectives. First, they try to be dialectically reasonable, and second, they are out for some kind of personal triumph. The act, by the critic, of reformulating or revising the arguer’s standpoint will be dealt with from this dual perspective of strategic maneuvering (Van Eemeren and Houtlosser 2000, 2003). In order to analyze and evaluate the maneuver under discussion, I will elaborate in this section, first, on the notion of critical discussion in order to clarify the meaning of dialectical reasonableness and fallaciousness; second, on the importance of reconstruction for understanding argumentative discourse; third, on the notion of a confrontation stage; and fourth, on the distinction between direct and indirect maneuvering. These notions will be applied as follows: critics have some room for maneuvering when raising critical doubt, even when they change the arguer’s position or formulation, because there are contexts of utterance within confrontations where such a contribution does allow for a reconstruction in such a way that the result is not a direct and fallacious confrontational maneuver but, rather, an indirect and dialectically reasonable one.According to the pragma-dialectical methodology developed by Van Eemeren and Grootendorst (1984, 1992, 2004), an argumentative discourse must be reconstructed and evaluated from the perspective of a critical discussion. Ludwig Feuerbach is traditionally regarded as a significant but transitional figure in the development of nineteenth-century German thought. Readings of Feuerbach's The Essence of Christianity tend to focus on those features which made it seem liberating to the Young Hegelians: namely, its criticism of reification as abstraction, and its interpretation of religion as alienation. In this book, Van Harvey claims that this is a limited and inadequate view of Feuerbach's work, especially of his critique of religion. The author argues that (...) How do we measure happiness? Focusing on subjective measures as a proxy for welfare and well-being, this book finds ways to do that. Subjective measures have been used by psychologists, sociologists, political scientists, and, more recently, economists to answer a variety of scientifically and politically relevant questions. Van Praag, a pioneer in this field since 1971, and Ferrer-i-Carbonell present in this book a generally applicable methodology for the analysis of subjective satisfaction. Drawing on a range of surveys on people's satisfaction (...) with their jobs, income, housing, marriages, and government policy, among other areas of life, this book shows how satisfaction with life "as a whole" is an aggregate of these domain satisfactions. Using German, British, Dutch, and Russian data, the authors cover a wide range of topics, even some not usually considered part of economic study.The book makes a distinction between actual satisfaction levels and individual norms, and in this way complements Van Praag's earlier work within the Leyden School with his later work in "happiness research". Smith and van Dijk explore the relationship between the emotions schadenfreude and gluckschmerz, and why people experience these emotions. Their perspective is valuable and adds to a better understanding of how people respond to the fortunes of others. In this manuscript I try to further these ideas by arguing that schadenfreude and gluckschmerz are best seen as signals that indicate that a balance in how we would want the world to be is restored or violated.

This paper surveys the contributions to the study of argumentation in the two decades since the work of Toulmin and Perelman. Developments include Radical Argumentativism (Anscombre and Ducot), Communication and Rhetoric (American Speech Communication Theory), Informal Logic (Johnson and Blair), Formal Analyses of Fallacies (Woods and Walton), Formal Dialectics (Barth and Krabbe), and Pragma-Dialectics (van Eemeren and Grootendorst). From the survey it is concluded that argumentation theory has been considerably enriched. If the contributions can be made to converge, a sound (...) basis will be created for developing educational methods for producing, interpreting and evaluating argumentative discourse. Thus, argumentation theory may be instrumental in improving the quality of democracy by furthering a reasonable management of differences of opinion. (shrink)

In dit artikel betwist ik het gangbare idee dat de rede ontoereikend is voor morele motivatie, met name in relatie tot universele ethische kwesties. Door een uitgebreide verkenning van de Dual-Process Theory (DPT) stel ik dat onze morele intuïties zowel trainbaar zijn als een inherente neiging hebben naar universalistische overwegingen. Ik betoog dat sociale rechtvaardiging en de drang naar rationele argumentatie een cruciale rol spelen in het vormen en veranderen van onze morele standpunten. There is widespread understanding of the close connection between religion and the ecological crisis, and that in order to amend this crisis, theological resources are needed. This monograph seeks to contribute to this endeavor by engaging the theology of Dietrich Bonhoeffer. His theology is particularly suitable in this context, due to its open-ended nature, and to the prophetic and radical nature of the questions he was prepared to ask--that is why there are many other attempts to contextualize Bonhoeffer's theology in (...) areas that he himself has not directly written about. In this monograph, Steven van den Heuvel first of all addresses the question of how to translate Bonhoeffer's theology in a methodologically sound way. He settles on a modified form of the general method of correlation. Then, secondly, van den Heuvel sets out to describe five major concepts in Bonhoeffer's work, bringing these into critical interplay with discussions in environmental ethics and eco-theology. In making the correlations he thoroughly describes each concept, situating it in the historic and intellectual background of Bonhoeffer's time. The Faculty of Theology at the University of Pretoria celebrates its centenary in 2017. Theological training at the university started in 1917 when the Nederduitsch Hervormde Kerk van Afrika decided to train its own ministers. In 1937 the Dutch Reformed Church decided to establish a faculty of its own at the university. This led to a faculty with two sections: Section A for the Nederduitsch Hervormde Kerk and Section B for the Dutch Reformed Church. This was the situation until 2000 (...) when the two faculties merged to become one. Although theological training by the Dutch Reformed Church only started in 1938, their faculty, Section B was an important partner through the 100 years of theological training. Much of this dedication and efforts never reach the limelight whilst the journal enjoys increasing visibility and impact, ranking currently seventh among 328 philosophy journals and featuring on the 94th percentile. We may attribute this achievement to the authors of PPP, but behind this success story, John has been the vital oxygen in the breathing and energy production of PPP.Our senior editors who have been working under John's leadership for some time, attest as follows in reversed alphabetical order: Michael Wong writes,I once wondered how a psychiatric ethicist like John operates as a journal chief editor? Does he always ask three questions for every submission? Could I publish it? Would I publish it? Should I publish it? I found out very soon after I joined PPP as a Senior Editor that John is actually an editor of empathy and compassion, if there is indeed such an entity in academic publishing, who also has an objective and critical mind. In 2014, I inherited from Bill Fulford – the founding editor – the role of UK editor of what was, at the time, a dual UK-USA edited journal. 2014 was a bad year for me – my parents both died and I spent a term living in a dark cell in a castle in the University of Durham – and I leant very heavily on John's help, assisted by the very capable Linda Muncy. Editing an interdisciplinary journal seemed to me at the time an almost [End Page 93] impossible task. Balancing clinical, philosophical and relevant other reviews was difficult and time consuming. One paper – a very fine submission taking a theologically informed look at depression – had been in the review process seemingly forever though its author was very understanding of the delays. But John (and Linda) graciously and practically accommodated my apprenticeship. John wisely pressed for both the move to a modern electronic submission system and the recruitment of more senior editors. Both of these seem necessary for the smooth running of a modern journal and are a marked contrast with the time when even using a spreadsheet and a Psion Organiser seemed the height of technology.But the mark of a good editor is not just practical and technological but rather making difficult decisions balancing widening access to publication with high academic standards. De auteur concludeert dat het werken in de Algemene Asielprocedure beperkingen aan de medewerker oplegt die maken dat zorgvuldig en onpartijdig werken en het toepassen van de menselijke maat in het gedrang komen. Het werken onder tijdsdruk en met een complex juridisch regelstelsel dragen hieraan bij. Hierdoor (...) ontstaat het risico van robotisering van het beslisproces. This article represents the genre of auto-ethnographic, autobiographical research. It consists of questions which evoke narrative responses because the questions register a life story in itself. Pieter G.R. de Villiers is the interpellator and Andries G. van Aarde the respondent. They are long-standing friends and both professors of New Testament studies. De Villiers is presently the editor at LitNet Academic (Religious Studies), and Van Aarde is the editor of HTS Theological Studies. His surviving relectiones (the lectures given in Salamanca at the end of each university term) cover a wide range of issues from (...) the morality of cannibalism to the legality of Henry VIII’s divorce. 1 Yet modern scholarly interest in Vitoria and his disciples (collectively known as “the School of Salamanca”) has focused mainly on issues relevant to the moral and legal problems of secular nation-states. Between this century’s two great wars Spanish and American scholars took a renewed interest in Vitoria’s published relectiones, seeing in them early expressions of the doctrine of international law, and arguing that Vitoria deserved some of the credit generally given to Hugo Grotius as the inventor of this concept. 2 Since then Spanish, American, and British scholarship on Vitoria and the School of Salamanca has continued to center mainly on such issues as just war, conquest, and slavery. 3 In the 1980s Anthony Pagden [End Page 597] revisited these questions, interpreting the School of Salamanca’s neo-Scholastic teachings as part of the “ideological armature of what [was arguably] the first early modern nation state.” 4 From a similar methodological perspective, Richard Tuck and Quentin Skinner have described the neo-Thomist revival of natural law as an important influence on the development of modern legal and political concepts like the subjective theory of natural rights and the Lockean contractual theory of political obligation. 5 Most recently, Pagden and Jeremy Lawrance have edited and translated into English a selection of Vitoria’s “political writings,” which will serve as a welcome aid for future research on any of these themes. 6Yet Vitoria’s end-of-term lectures in Salamanca also discussed a number of other themes apart from the political theory of secular states. Among these, the theme of the structure and power of ecclesiastical government has so far received less attention than it deserves. 7 Ecclesiastical power, or “the power of the Church,” was one of only two subjects to which Vitoria devoted two relectiones each (the other being the famous debate about Spanish rights to dominion in America). Vitoria delivered his two lectures on ecclesiastical government, both entitled De potestate ecclesiae, in 1532 and 1533. In 1534 he lectured on the closely related theme of “the power of the pope and the council” (De potestate papae et concilii). 8 Vitoria’s treatment, in these three lectures, of the authority of the Church, the pope, and the general council is worth examining more closely not only for the intrinsic interest of these issues but perhaps even more for the light it sheds on the formation of Vitoria’s thinking about secular political power. All three relectiones preceded the two famous Relectiones de indiis (“On the American Indians”) which Vitoria delivered in [End Page 598] 1538 and 1539. For churchmen like the Dominican Vitoria, ecclesiastical and secular political power were inextricably linked; theories posited in one sphere had implications in the other, and in some cases these implications proved politically or theologically awkward enough to force a thinker back to the drawing board. The political theories about the natural origins of secular political power which Vitoria articulated in the late 1530s in his Relectiones de indiis reflect this painful process. They were not only inspired by Vitoria’s awareness of the plight of the American Indians under Spanish colonial rule; they were also shaped by his protracted struggle with the theological implications of natural law theory, a struggle which can be observed in his lectures of the early 1530s on ecclesiastical power.Observing this intellectual struggle in Vitoria’s writing affords more than just one more illustration of how all political thought is rooted in particular social contexts. Prof. W.A. Dreyer played an important role in the continuous reformation of the Nederduitsch Hervormde Kerk van Afrika (NHKA). This contribution to his Festschrift is not about him. He would not want that. It is about the church and how his understanding of reformed ecclesiology became the basis on which the transformation from ‘ Volkskerk ’ to missional church took place. According to himself, that was his calling and his life’s work. The importance of his contribution cannot be understood without (...) the historical background in which it played out. Neither is it possible to envisage what really happened without acknowledging the theologians who played an important part in his life. This article therefore starts with a short overview of the history of the NHKA. It then proceeds with an overview of how important theologians in the NHKA influenced his ecclesiology. It concludes with three specific contributions that Prof. W.A. Dreyer made which makes him a key role player which led the NHKA on the way of Ecclesia reformata semper reformanda. Contribution: Prof. W.A. Dreyer became an important church leader in the Netherdutch Reformed Church. His leadership resulted in important changes in the church and especially in the ecclesiology of the church. This article, which is part of his Festschrift, gives an overview of his theological contribution through the lens of semper reformanda. This book raises in a new way a central question of Christology: what is the divine motive for the incarnation? Throughout Christian history a majority of Western theologians have agreed that God's decision to become incarnate in the person of Jesus Christ was made necessary by "the Fall": if humans had not sinned, the incarnation would not have happened. This position is known as "infralapsarian." A minority of theologians however, including some major 19th- and 20th-century theological figures, championed a "supralapsarian" (...) Christology, arguing that God has always intended the incarnation, independent of "the Fall." Edwin Chr. van Driel offers the first scholarly monograph to map and analyze the full range of supralapsarian arguments. He gives a thick description of each argument and its theological consequences, and evaluates the theological gains and losses inherent in each approach. Van Driel shows that each of the three ways in which God is thought to relate to all that is not God -- in creation, in redemption, and in eschatological consummation -- can serve as the basis for a supralapsarian argument. He illustrates this thesis with detailed case studies of the Christologies of Schleiermacher, Dorner, and Barth. He concludes that the most fruitful supralapsarian strategy is rooted in the notion of eschatological consummation, taking interpersonal interaction with God to be the goal of the incarnation. He goes on to develop his own argument along these lines, concluding in an eschatological vision in which God is visually, audibly, and tangibly present in the midst of God's people. (shrink)

The sentence (464F) invites one naturally to apply the method of classical hermeneutics (as understood by Babilas 1961, 30, 51–52), consisting in the confrontation of an author's oeuvre (its inventio, dispositio, and elocutio) with all the elements of (...) its generating "context" (historical circumstances, literary antecedents, biography and psychology of the author, immediate reasons for the composition, etc.) that might shed some light on the work in question and help to understand it. In the case of De Tranquillitate Animi Plutarch himself mentions his hypomnemata as one of the elements that contributed to this work, thus provoking his reader to investigate the relationship between these hypomnemata and the text in hand.Under the positivist paradigm generated and promoted by the physical sciences, the interpretation of texts suffered from reduction: its aim became explanation by reducing the thematic, structural, and stylistic data of a text to its antecedents, that is, by simply equating text and context; moreover, this context was frequently reduced to literary antecedents. In the present case, it was the conviction of several scholars that De Tranquillitate Animi could be explained by reducing it to an amalgamation of literary sources (Quellen) and by assuming that the hypomnemata represented these sources without further ado.The consequences of this approach were considerable: in general, Quellenforschung created the image of "Plutarch the eclectic," copying and pasting together literary sources, and De Tranquillitate Animi in particular became a textbook case of his modus operandi—it was but a patchwork of the opinions of Panaetius, or Ariston, or Epicureanism,1 [End Page 575] and one even finds a meritorious scholar who is indignant because Plutarch "mutilates" his source by disturbing its composition!2 From the conflicting scholarly opinions, from their highly hypothetical nature, and from such awkward appreciations as that just mentioned, it is easy to see that the positivist approach failed really to understand Plutarch: his personality and writing activity were so utterly neglected that one wonders why ultimately even the sentence μνημάτων was not regarded as "aliunde petita"!3Nowadays the assumptions of Quellenforschung are rejected: Plutarch's personal contribution in the invention, composition, and style of his works in general is widely recognized. In regard to his writing technique, and especially the role of the hypomnemata in it, it has been observed that the very mention of the hypomnemata in De Tranquillitate Animi does not mean that Plutarch was simply copying, let alone copying only one source;4 moreover, we are not entitled to view hypomnemata as sources5 without any qualification. As to the general tendency of the work, Stoic influences in the presentation of its theme have been seriously questioned.6While fully agreeing with the critique of Quellenforschung and sympathizing with the more positive results of our recent understanding of Plutarch, I cannot but consider the question of Plutarch's hypomnemata a continuing challenge: their importance for his "Compositionsweise"7 cannot be doubted, even if we are somewhat at a loss concerning their size, content, and nature. With the aim of advancing our [End Page 576] knowledge in this matter,8 I here identify a hypomnema, make some observations on Plutarch's treatment of it, and consequently show its relevance for the interpretation of the meaning intended by Plutarch. But before doing so, an analysis of the "hypomnemata statement" and its immediate context seems appropriate: the sentence may trigger our search and condition our expectations.An Analysis of the "Hypomnemata Statement" and its ContextThe composition of De Tranquillitate Animi took place in urgent circumstances:9 Paccius, we are told, has asked for some exegesis of Pla-to's Timaeus and (apparently in dire need)10 for some advice on tranquility of mind. The obvious messenger, Eros, has been called away urgently to Rome by Fundanus, another representative of the genus irascibile.11 Plutarch adopts emergency measures: First, he does not want to disappoint his friend Paccius completely. ADHD is a psychiatric disorder characterised by persistent and developmentally inappropriate levels of inattention, impulsivity and hyperactivity. It is known that children with ADHD tend to produce incoherent discourses, e.g. by narrating events out of sequence. Here the aetiology of ADHD becomes of interest. One prominent theory is that ADHD is an executive function disorder, showing deficiencies of planning. Given the close link between planning, verb tense and discourse coherence postulated in van Lambalgen and Hamm (The proper treatment of events, (...) 2004), we predicted specific deviations in the verb tenses produced by children with ADHD. Organisational change is one of the most frequently recurring organisational phenomena of our time, yet despite this, organisations are not succeeding in instituting change processes effectively; dismal "change success rates" are recorded. Van Tonder and Van Vuuren have argued that the adoption of an ethical framework from within which change practices are to be approached and "managed", would significantly reduce the negative consequences of change initiatives. As a first step in this direction, the current study set out to establish the (...) meaning that employees attribute to "ethical" and "unethical" change. Data obtained from a sample of 111 respondents from seven companies were subjected to basic content analysis and key themes extracted. The results indicate a limited understanding of ethics concepts among employees. A clear need for both intensified education and research is indicated. (shrink)

Filosofie in de rechtszaal Naar aanleiding van het optreden van Paul Cliteur in het Wilders II-proces rijst de vraag hoe de inzet van een rechtsgang zich verhoudt tot de eigen aard van de filosofie. Aan de ene kant vertolkt filosofie precies dat register van waarheid dat in het recht aan de orde is. Aan de andere kant is die vertolking zo oneindig open dat ze strijdt met het gesloten karakter van het recht als een proces dat conflicten moet beëindigen door (...) gezagvolle beslissingen. Socrates’ optreden in zijn eigen proces toont aan: de slechtste dienst die de filosofie het recht kan bewijzen, is het verlengstuk te worden van het positieve recht en zich bij voorbaat beschikbaar te stellen als een vindplaats van argumenten wanneer de juridische argumenten op zijn. De slotparagraaf argumenteert dat Cliteur deze socratische les terzijde legt.
