The genetically manipulated organism crisis demonstrated that technological development based solely on the law of the marketplace and State protection against serious risks to health and safety is no longer a warrant of ethical acceptability. In the first part of our paper, we critique the implicitly individualist social-acceptance model for State regulation of technology and recommend an interdisciplinary approach for comprehensive analysis of the impacts and ethical acceptability of technologies. In the second part, we present a framework for the analysis (...) of impacts and acceptability, devised—with the goal of supporting the development of specific nanotechnological applications—by a team of researchers from various disciplines. At the conceptual level, this analytic framework is intended to make explicit those various operations required in preparing a judgement about the acceptability of technologies that have been implicit in the classical analysis of toxicological risk. On a practical level, we present a reflective tool that makes it possible to take into account all the dimensions involved and understand the reasons invoked in determining impacts, assessing them, and arriving at a judgement about acceptability. Philosophers of religion are often caught up with the epistemic justification of their religious beliefs, rather than the qualities of the religious life that make it valuable. Mark Bernier argues theory of hope, which involves the distinction between mundane and authentic hope, and makes three principal claims. Firstly, while despair involves the absence of hope, a rejection of oneself, and a turn away from one's relation to God, despair is fundamentally an unwillingness to hope. This unwillingness is directed toward authentic (...) hope, conceived of by Kierkegaard as an expectation for the possibility of the good. Secondly, hope is not simply an ancillary activity of the self; rather, the task of becoming a self is essentially constituted by hope. Thus, when in despair one is unwilling to hope, one is in fact rejecting one's task of becoming a self. Thirdly, faith stands in opposition to despair precisely because it is a willingness to hope. An essential role of faith is to secure the ground for hope, and in this way faith secures the ground for the self. In short, authentic hope is not merely a fringe element, but is essential to Kierkegaard's project of the self. (shrink)

: Watsuji Tetsurō defined ethics as being generated by a double negation: the individual's negation of the community and the self-negation of the individual who returns to the community. Thus, ethics for him is based on the individual's sacrifice for the collectivity. This position results in the conception of the community as an absolute. I contend that there is a congruence between Watsuji's conception of ethics as self-sacrifice and the way he perceived the Japanese political system. To him, the imperial (...) system in Japan is based on the organic unity of the Japanese people, represented by the emperor, who embodies the general will of, and is therefore coterminous with, the Japanese nation. Free will and determinism have recently attracted the attention of Buddhist scholars who have defended conflicting views on this issue. I argue that there is no reason to think that this problem cannot arise in Buddhist philosophy, since there are two senses of ‘free will’ that are compatible with the doctrine of non-self. I propose a reconstruction of a problem of free will and determinism in Early Buddhism, given a) the assumption that Buddhist causation entails universal causal determinism, and b) (...) a crucial passage suggesting that Early Buddhism is committed to the principle of alternative possibilities which is arguably incompatible with a determinist interpretation of causation. This passage suggests that Early Buddhism must leave room for a robust, incompatibilist form of free will, and that a conception of indeterminist free will in the spirit of Robert Kane’s theory allows us to make sense of that notion. According to a representational theory of phenomenal consciousness (RTPC), the phenomenal character of a conscious experience is completely exhausted by its representational content. Some considerations suggested by Christopher Peacocke raise an important problem for the RTPC. In his recent bookConsciousness, where he defends a version of the RTPC, Christopher Hill argues that to solve Peacocke’s problem, visualqualiamust be identified with “visual appearances” understood as relational properties of external objects. The integration of ethical analysis in Health Technology Assessment (HTA) has proven difficult to implement even though it is explicitly recognized as an important component of such assessments in HTA literature. When compared to the standardized scientific method for systematic reviews in HTA, the diversity of ethical analysis has been characterized as a fundamental barrier to the integration of ethics. The present paper aims to identify the theoretical and practical differences between the approaches underpinning ethical analysis in HTA and clarify (...) the reasons for such diversity. Our systematic review of HTA literature pertaining to the barriers to the integration of ethics in HTA identified nine ethical approaches: Principlism, Casuistry, Coherence Analysis, Wide Reflective Equilibrium, Axiology, the Socratic approach, the Triangular model, Constructive Technology Assessment and Social Shaping of Technology. Citations pertaining to each approach were extracted and categorized according to three constitutive components of ethical argumentation established in a previous research evaluating nanotechnologies: i) the disciplinary foundation that grounds the validity of the ethical evaluation, ii) the characteristics of such evaluation, iii) the operational process involved in applying it to a particular case (i.e., its practical reasoning). This comparison shows that, 1) the difference between these approaches rests primarily on their disciplinary foundation (rooted in philosophy, philosophy/theology, or sociology), 2) their complexity can be observed in the distinct characteristics of ethical evaluation deriving from their differing disciplinary foundation, and 3) although four different types of operationalization procedure were identified, little information was available in regards to the practical reasoning associated with these approaches. Several researchers point to disorganized attachment as a core feature of borderline personality disorder (BPD). However, recent studies suggest that specific internal working models (IWMs) of each parent combine to account for child outcomes and that a secure relationship with one parent can protect against the deleterious effects of an insecure relationship with the other parent. It was thus hypothesized that adolescents with BPD are more likely to be disorganized with both their parents, whereas non-clinical controls are more secure with (...) at least one of their caregivers. Thirty-six adolescents with BPD and 30 control participants (aged 13-19) were included. Psychiatrist diagnosis was verified with the SIDP-IV and comorbidity was assessed using the Kiddie-SADS. Reported trauma was assessed with the Childhood Trauma Questionnaire. Attachment IWMs of each parent were assessed with the Attachment Multiple Model Interview (AMMI), which enables separate coding for each attachment figure and in which disorganization is conceptualized as conflicting attachment strategies within a specific relationship. Results of a logistic regression analysis suggested that beyond insecure attachment, being disorganized not just with one but with both parents is particularly characteristic of adolescents with BPD. Conversely, belonging to the non-clinical group was predicted by higher security scores with the father and lower deactivation with the mother. Although higher levels of childhood abuse or neglect were reported by adolescents with BPD, the retained attachment dimensions predicted group membership over and above reported trauma. These findings have important implications for clinical intervention and highlight the protective role fathers may have. (shrink)

Since Hume, some philosophers deny that conscious thinking requires the existence of a thinking subject. This claim is well illustrated by LichtenbergI thinkThinking is going on” (Es denkt). Bernard Williams has argued that the claim that there can be thinking without a thinking subject is incoherent. My purpose, in this paper, is to suggest an interpretation of that claim which overcomes the problem raised by Williams.

The worldwide COVID-19 pandemic has shed more light on the difficulty of making health care decisions integrating scientific knowledge and values associated to life and death issues, human suffering, quality of life, economic losses, liberty of movement, etc. But the difficulties related to health care decisions and the use of innovative drugs or technologies are not new, and many countries have created agencies that have the mandate to evaluate new technologies in health care. Health Technological Assessment (HTA) reports’ aim is (...) to guide the decision makers in these difficult matters. There are two ethical components in HTA. The first is the report’s presentation of an ethical evaluation of the technology. The second is the value-ladenness of the HTA decision-making process itself. When implicit value judgments are not elicited, the justification of the final decision cannot be transparent. The present paper aims to identify and elicit the implicit value-judgments related to each step of the HTA process. This research is grounded on an applied ethics decision-making paradigm based on the role of value judgments in the decision-making process. The first part discusses two different approaches to values and value judgments in HTA. In the second part, citations mentioning value judgments extracted from a systematic review on the integration of ethics into HTA were categorized to elicit the value judgments and their criteria for each different HTA decision-making steps. The results show that there are 18 decision-making steps in the HTA process where 23 implicit value-judgments can be recognized. The range of these value judgments encompasses the whole HTA process: from the initial request, the presenting of the principal issues, to the final report’s dissemination. Since stakeholders need to understand which value judgments the conclusion of a report relies on, eliciting the implicit value judgments in the HTA decision-making process should yield more transparency. This article centers on the modes of maintaining an equivalence of the moral and the good that lies behind and within Augustine’s and Aquinas’ understandings of beauty. Beauty, in the medieval experience of it, never derived exclusively from sense impression; it was neither purely pleasure in the sensuous nor a wholly intuitive contemplation of the transcendent occurring exclusively in the mind. Rather, beauty was the intelligible form of some higher reality, the quality of things that reflects their origin in the (...) divine. Beauty, then, like meaning itself, could never be fully present in its material sign, as it appears to us only as a promise of presence through embodied absence, neither fully here and now nor entirely elsewhere and beyond. This, ultimately, may be the very purpose of beauty, a hopeful pull toward the perfect and yet never fully knowable God who is beauty. (shrink)

Adorno alors que ce dernier, de quatorze ans son cadet, n’était encore que lycéen. Une amitié s’est nouée à travers le singulier rituel hebdomadaire d’une lecture de la Critique de la raison pure. Ce rituel qui a duré plusieurs années a tissé une durable amitié que des différends théoriques, survenus plus tard, ont néanmoins mise à rude épreuve. Je crois qu'il est utile, avant de passer à une étude historique des théories de l'évolution, de préciser quelques notions de sémantique. Aujourd'hui, on extend par « théorie scientifique » dans le domaine des sciences naturelles une explication soit d'une structure, soit d'un mécanisme, d'un lien causal, présentant un caractère plus ou moins hypothétique mais de toute façon basée sur les faits et vérifiée par eux. Or, la première grande théorie de l'évolution biologique, celle de Lamarck, se veut expérimentale mais (...) est en réalité beaucoup plus spéculative qu'expérimentée. Et pourtant cette explication lamarckienne est une des pièces les plus importantes de l'histoire de la théorie de l'évolution et ne saurait être négligée dans notre étude. Je n'ai pas l'intention de faire ici le procès de la valeur d'une théorie scientifique biologique mais je peux simplement souligner qu'il m'apparaît nécessaire d'élargir pour les besoins de la présente analyse la signification actuelle du terme « théorie », de restreindre les exigences de rigueur interne d'une démonstration et de savoir accepter à l'occasion ce qui—en regard de l'usage actuel du terme—ne peut être considéré que comme une intuition ou même une idée assez vague et imprécise. Le débat scientifique sur la réalité du changement climatique a ses imposteurs. Mais, en matière d'environnement, les plus grandes impostures se situent dans le champ politique.Lorsque l'écologie émerge dans le débat public au début des années 1970, les grandes puissances économiques comprennent qu'un danger se profile. Alors que la mondialisation du capitalisme se met en place grâce à la stratégie du libre échange, l'écologie politique pourrait remettre en cause le productivisme, l'intensification du commerce international et les délocalisations de l'industrie vers (...) les pays à bas coût de main-d'ouvre. Avant même que la communauté internationale ne se réunisse pour débattre des crises environnementales, les tenants de la mondialisation rédigent les conclusions : aucune mesure de protection de l'environnement ne devra entraver le commerce.Depuis plus de quatre décennies, depuis que la question environnementale a émergé dans les débats nationaux et dans les préoccupations internationales, un pacte tacite s'est instauré, qui n'a pas manqué de duper : au sein des gouvernements, des institutions internationales, lors des grands sommets, ne seraient prises que des mesures cosmétiques, ne portant pas atteinte au libre échange et à la mondialisation. Il est grand temps de faire tomber les masques et de raconter en détail l'histoire politique, totalement méconnue, qui révèle la supercherie d'une prétendue conversion à l'écologie des grands de notre monde. As it has been pointed out in the literature, a Theory of Consciousness should satisfy two desiderata: i) account for the particular qualitative character of any particular conscious state, and ii) account for the fact that a conscious state is conscious ‘for the subject’.. Many have claimed that the RepresentationaI Theory of Consciousness can satisfy the first desideratum. It obviously fails, however, to meet the second desideratum. Higher-Order Approaches to Consciouness satisfy the second desideratum straightforwardly, but it remains unclear whether (...) they satisfy the first desideratum. In the first section, I underscore some problems indicating that RTC fails to satisfy the first desideratum. These problems suggest that qualitative character should be understood not as a non-mental represented feature of the world, as RTC suggests, but as a represented feature of the very conscious state itself. This suggests that HOAC are, after all, in a better position than RTC to satisfy the first desideratum, and hence both desiderata. I argue, however, that insofar as HOAC are supposed to satisfy the first desideratum, they are faced with an intolerable vicious regress. I propose that an alternative approach, the Self-Representational Theory of Consciousness is in a better position than HOAC to satisfy both desiderata. (shrink)

I argue that the main rival theory, the Higher-Order Theory of Consciousness (HOTC) should be preferred. Notre these porte sur le probleme des etats mentaux intentionnels, te'l qu'il se pose dans le cadre de la philosophie de l'esprit contemporaine, plus prteisement dans la tradition analytique. Nous nous interessons particulierement a la notion de contenu etroit qui a recemment ete suggeree pour faire face a des difficultes importantes que rencontre la notion d'etat mental intentionnel, telle que concue dans le cadre general du fonctionnalisme. La problematique generale de cette these emerge d'une tension entre deux aspects importants des (...) etats mentaux intentionnels, soit leur intentionalite - c'est-a-dire le fait qu'ils visent le monde--et leur utilite pour expliquer les comportements humains, en raison de laquelle une psychologie scientifique aurait interet, semble-t-il, a caracteriser de facon adequate de tels etats mentaux. ;Notre propos s'organise autour d'un probleme pose par des intuitions emergeant d'experiences de pensee qui ont fait l'objet de nombreuses discussions en theorie de l'esprit . Un des objectifs importants de notre these est de clarifier les principales positions qui ont ete adoptees relativement a ces intuitions problematiques, de les evaluer en discutant les principaux arguments qui ont ete suggeres pour les defendre, et d'endosser une position qui nous parai t coherente, dans ce debat concernant l'individuation des etats mentaux intentionnels. De facon generale, cette discussion s'appuie sur l'hypothese selon laquelle les etats mentaux doivent etre individues en respectant des contraintes de pertinence explicative. Or, nous sommes amene a rejeter les principales positions qui ont ete defendues dans ce debat, a savoir les theses individualiste et anti-individualiste, puisqu'elles s'appuient sur des arguments auxquels nous nous objectons. Ainsi, relativemient au probleme de l'individuation, nous arrivons a endosser une position pluraliste, voulant que certains etats mentanux soient individues de facon compatible avec la these lndividualaliste, tandis que d'autres etats mentaux devraient l'etre en accord avec I'anti-individualisme. ;Dans la mesure ou nous acceptons le principe d'une individuation etroiet de certains etats mentaux, l'autre objectif majeur de notre these est de clarifier les principales suggestions qui ont ete faites, dans le but de caracteriser l'individuation d'etats mentaux etroits, et d'en faire une evaluation critique. Nous rejetons la suggestion d'une individuation purement syntaxique, telle que proposee par S. Stich, ainsi que l'individuation par le contenu etroit, tel que concu selon l'approche de J. Fodor. Nous endossons, finalement, une individuation qui s'appuie sur la notion de role conceptuel, telle que caracterisee dans le cadre d'une these de la bifurcation. De plus, nous soulignons que le cadre general de la these de la bifurcation a l'avantage d'etre compatible avec notre position pluraliste relativement au probleme de l'individuation. Notre principale conclusion est que la notion de contenu mental est une notion ambigue que permet de clarifier la these de la bifurcation. Cette discussion et les positions que nous sommes amene a adopter semblent avoir des implications importantes, notamment en relation aux problemes que pose la notion d'explication psychologique, mais egalement pour la problematique de l'anallyse des enonces d'attitudes propositionnelles. Virtually all schools of Buddhism do not accept a permanent, substantial self, and see everything as non-self. In the first part of this article I recall some arguments traditionally given in support of this perspective. Descartes’ cogito argument contradicts this, by suggesting that we know infallibly that the self, understood as a substantial enduring entity, does exist. The German aphorist Lichtenberg has suggested that all Descartes could claim to have established was the impersonal ‘There is thinking’, which would support the (...) perspective of non-self. Bernard Williams has argued that Lichtenberg’s impersonal version of the cogito is conceptually incoherent, which would entail that the Buddhist perspective of non-self is also incoherent. I propose to defend the coherence of the Buddhist perspective of non-self against Williams’s argument. (shrink)

En prenant appui sur des théories et des exemples tirés principalement du contexte nord-américain, il s’agit d’examiner la présentation d’une œuvre d’art contemporain, No Woman, No Cry, de Chris Ofili, sélectionnée par la Tate Britain dans le Google Art Project. L’étude de ce cas récent montre comment l’institution muséale reconduit, sur le Web, les principes de pratiques qu’elle applique, depuis longtemps, dans les salles d’exposition (...) et dans les messages adressés au public.This article explores the use made in certain museums of the very latest advances in communication and technology. Drawing on primarily North-American theories and examples, we examine the presentation of a particular work of contemporary art, Chris Ofili’s No Woman, No Cry, selected by Tate Britain from the Google Art Project. Our study of this recent case shows how museums apply the same principles of practice on the web as those they have applied for years in their exhibitions and their messages to the public. (shrink)

Nous voulons mieux comprendre les lois circonscrivant le rôle social de l’Évaluation des technologies en santé (ETS) et les raisons empêchant l’inclusion de l’éthique en ETS. Nous avons ciblé un débat qui est au coeur du rôle perçu du droit réglementaire dans le développement de technologies en santé : l’opposition entre les enjeux environnementaux, sécuritaires et sanitaires (EHSI) et les enjeux éthiques, légaux et sociaux (ELSI), issus de la gouvernance technologique. La collecte de données est basée sur une revue de (...) la littérature issue de travaux antérieurs, et sur une analyse de cas où trois agences d’ETS ont été sélectionnées en utilisant différentes catégories d’obligation légale selon leur degré de force contraignante. La revue de littérature a révélé cinq thèmes relatifs au rôle social de l’ETS et une distinction entre le rôle/utilisation du droit dur et du droit souple dans le droit réglementaire, permettant ainsi de comprendre comment les agences ont utilisé le droit pour intégrer (ou non) l’éthique en ETS. Les deux approches ont démontré que le débat, EHSI/ELSI observé initialement dans la gouvernance et l’évaluation de technologies est reproduit en ETS. La principale tendance confirmée par ces analyses est la présence d’un pacte entre la science et le droit réglementaire. La demande sociale d’intégrer les ELSI, particulièrement l’évaluation éthique en ETS, n’est pas prise en compte par le droit réglementaire traditionnel régissant l’ETS et doit plutôt être considérée par le droit souple. Les difficultés d’intégration de l’éthique en ETS démontrent la nécessité de repenser la gouvernance juridique de l’ETS. (shrink)

In the first part of my analysis, I wish briefly to clarify the different modes of relation found in the living being, and point out the multiplicity of disciplines in which biologists use (explicitly or implicitly) the notion of laws. In the second part, I shall analyse the notion of universal laws in biology and examine successively: (1) accidental generalizations; (2) non-causal biological correlations; (3) the meaning of 'necessity' in these correlations; and (4) causal connections. I shall examine statistical laws and probabilistic laws in biology, in particular: (1) chance in biology; (2) probabilistic theories; and (3) relations between logical probability and statistical probability. RÉSUMÉ Dans la foulée de divers arguments antiphysicalistes visant à montrer que les qualia ne sont pas fonctionnalisables, Ned Block a proposé un autre argument de ce type, qui repose sur son expérience de pensée de la Terre inversée. L’argument de Block montrerait qu’un sujet peut avoir deux expériences de couleur du même type « phénoménal » qui seraient de deux types fonctionnels distincts puisque, selon lui, elles auraient des contenus intentionnels distincts. Il existerait donc une différence fondamentale entre le (...) contenu phénoménal des expériences sensorielles et leur contenu intentionnel et, dans la mesure où le contenu phénoménal ne pourrait être fonctionnalisé, le fonctionnalisme serait ainsi réfuté, à tout le moins en ce qui concerne les expériences sensorielles. Je soulève une objection qui, si elle est correcte, montre que la distinction que Block tente d’établir entre le contenu phénoménal et le contenu intentionnel des expériences est incohérente. ABSTRACT Following the popular trend of antiphysicalist arguments which aim at showing that qualia cannot be functionalized, Ned Block has suggested yet another antiphysicalist argument, on the basis of his Inverted Earth thought experiment. The purpose of his argument is to show that a subject could have two color experiences which are of the same phenomenal type but of different functional types, insofar as they have different intentional contents. This argument would support the idea that there exists a substantial distinction between the phenomenal content of sensory experiences and their intentional content, and that functionalism is false, at least with respect to sensory experiences. I raise an objection to Block's argument which, if correct, shows that the distinction he proposes between the phenomenal and the intentional content of sensory experiences is incoherent. (shrink)

Les médias ont longtemps exercé un contrôle sur le discours public pouvant les concerner. Cela n’est plus le cas. Elle est révolue l’époque où la critique des médias pouvait très difficilement se faire entendre sur la place publi­que, dont les journalistes étaient les gardiens incontournables. Jusqu’à récem­ment, les médias dominaient le jeu et sélectionnaient les sources qui les criti­quaient publiquement. Ils pouvaient exercer une sorte de monopole de l’autocritique en se dotant de dispositifs d’autorégulation , dont l’efficacité, l’indépendance et la (...) crédi­bilité sont mises en cause dans plusieurs pays. Avec Internet et l’interactivité pro­pre aux médias sociaux, plus rien ne peut endiguer le flot de critiques. Les médias ne peuvent plus prétendre que l’autorégulation suffit à assurer la qualité et l’inté­grité de l’infor­mation, puisque leur production souffre de carences rapide­ment décelées par les citoyens, que l’on doit désormais considérer comme des agents de la corégulation. Il semble que la mise en oeuvre des droits reconnus par les législateurs et les tribunaux en contexte d’avortement tardif et d’aide médicale à mourir connaît, en pratique, un problème d’effectuation. En effet, nous nous trouvons actuellement dans une ère où le droit accorde énormément d’importance à l’autonomie individuelle dans le domaine médical, mais où les pratiques et les autres normativités viennent considérablement limiter cette autonomie. Il convient, dès lors, de poser un regard critique sur le concept d’autonomie en contexte (...) d’avortement tardif et d’aide médicale à mourir. Ces constats soulèvent des questionnements sur le rôle et les limites du droit étatique lorsque transposé en contexte clinique, ainsi que sur le peu d’attention que porte le droit aux destinataires de la norme. Le défi consiste alors à faire cohabiter les différentes normes et valeurs afin que les mécanismes de prises de décisions traduisent un souci réel d’assurer le vivre ensemble. (shrink)

The first aim of this article is to show the necessity of approaching differently the question of the origin of the hypothesis as pertaining to a purely deductive science or to an experimental one, such as biology. The paper also analyzes the rôle played by the hypothesis in: 1) the formation of definitions; 2) the establishment of laws; 3) explanations. It shows that in 1) and 2) the hypothetical character is relevant both to the amplifying induction and to the still (...) incomplete state of our biological knowledge. Finally, it distinguishes between the two different processes used in the hypothetico-deduction depending on the possibility - or impossibility - to link the phenomena to be explained to some known principles. It has been disputed whether an externalist conception of the individuation of intentional states, such as beliefs and desires, is compatible with self-knowledge, that is, the claim that one's judgments about one's intentional states are non-evidential, non-inferential, and authoritative. I want to argue that these theses are indeed incompatible, notwithstanding an important objection to this incompatibility claim. The worry has been raised that if externalism is true, then for a subject to know, say, that he or she believes that p, (...) the subject would need to know, on the basis of some evidence, the external conditions which determine the belief's content. Thus, externalism would be incompatible with self-knowledge. But many philosophers have accepted an objection suggesting that this worry is mistaken because in order to have a belief one need not know the metaphysical conditions determining its content, even if they are externalist. And thus, the subject's reflexive judgment about the belief would not need to rest on evidence about those external conditions. But this objection rests on a crucial assumption according to which mental content is reflexively transparent in the sense that a subject could not judge that she or he has an intentional state and be mistaken about the content of her or his state, even if the content is externally determined. My main purpose is not reflexively transparent on the assumption of externalism and, thus, self-knowledge and externalism are incompatible. (shrink)
