Les auteurs dont il est principalement question dans cet ouvrage (Durkheim, Weber, Habermas et Bourdieu) poursuivent, quoi qu'on en pense, le même objectif. Chacun est soucieux de la spécificité et de la relative autonomie des sciences humaines et sociales. Chacun emprunte cette nouvelle voie dans l'histoire des sciences en reconnaissant de facto les liens qui continuent exister entre sociologie et philosophie. Lorsqu'il est question de problèmes moraux, ils les situent dans le cadre général de l'action, si bien que (...) leur sociologie de la morale est intimement intégrée à leur théorie propre de l'action. La réticence vis-à-vis des particularismes et vis-à-vis d'un pur relativisme, réputés indépassables, leur est pour l'essentiel commune. Aucun d'eux ne fait basculer la morale dans l'irrationnel et ceci en raison du rapport à leurs yeux indestructible qui existe entre raison et morale. On peut penser que cette proximité saisissante de quatre sociologies par ailleurs divergentes indique une affinité avec la philosophie kantienne et, plus loin, avec l'éthique aristotélicienne. C'est pourquoi la première partie de l'ouvrage débute par une lecture de l'Ethique à Nicomaque et de la Critique de la raison pratique. Ces lectures sont celles d'un sociologue à la recherche des racines de sa propre discipline et d'un parcours possible de la raison pratique. La seconde partie de l'ouvrage procède à une mise au point critique de concepts nécessaires à l'élaboration d'une sociologie de l'éthique : la personne, l'espace public, la responsabilité, le long terme. L’article propose de cerner quelques rationalités temporelles entourant des pratiques revendicatives à Moscou. Il est issu d’une enquête de terrain en partie filmique sur des coalitions protestataires qui se sont formées à la charnière des années 2000 et 2010 autour d’événements saillants. L’objectif est double : l’article décrit, tout d’abord, les contraintes pragmatiques et normatives variées qui pèsent sur les activités protestataires, envisagées dans leur ancrage spatial et leur épaisseur temporelle. Dans un second temps, il retrace la pluralité des façons (...) des collectifs militants de maîtriser leur temps. L'Histoire de la folie l'âge classique de Michel Foucault a produit, au montent de sa publication, une onde de choc. Cet ouvrage, foisonnant, baroque, labyrinthique, est apparu aussitôt comme insituable. S'agissait-il d'histoire, de philosophie, de littérature, de sociologie? Les partages disciplinaires traditionnels furent emportés par le courant impétueux de ce livre impossible. Mais il n'y eut pas que les cercles universitaires pour se trouver inquiétés par ces thèses tumultueuses (l'exclusion de la folie par l'âge classique, l'hypocrisie atroce de la (...) libération des fous par les médecins modernes, etc). Le récit épique de l'enfermement des fous dans les prisons de l'ordre moral, des nouveaux partages imposés par les révolutionnaires, altérait la bonne conscience d'une psychiatrie qui se pensait, fondamentalement, et par la vertu d'une fondation originaire jamais interrogée, humaniste. histoire de la folie préparait ainsi les révoltes de l'anti-psychiatrie. Cinquante ans après la parution de ce qui, au départ, était une simple thèse de doctorat, l'éclat de la rupture est intact. Ce livre continue à troubler, fasciner, irriter. Notre culture ne l'a toujours pas digéré. On découvre sans cesse de nouvelles apories, de nouveaux problèmes, de nouvelles perspectives pour interroger l'avenir. Ces rencontres, provoquées à l'occasion de cet anniversaire ne sont pas des commémorations. Il ne s'agit pas d'établir scientifiquement ici ce que Foucault a vraiment voulu dire, mais d'entendre jusqu'à quel point, encore aujourd'hui, ce texte réinvente notre rapport à la folie. (shrink)

La désignation de risques comme problèmes publics ainsi que la sélection et la hiérarchisation de ces risques s’expliquent souvent de trois grandes façons : soit comme le résultat d’arbitrages opérés par les autorités publiques ; soit comme le résultat de confrontations entre « société civile » et autorités publiques ; soit encore comme le résultat de la manière dont de multiples acteurs définissent et construisent les problèmes. Correspondent-elles à des modes d’analyses ou bien sont-elles avant tout des discours intégrant les contraintes rhétoriques propres à tout problème public faisant l’objet de nombreuses appropriations, comme c’est le cas aujourd’hui avec les risques collectifs ?The designation of risks as public problems as well as the selection and the grading of these risks are often explained in three great ways : either like the result of arbitrations operated by the public authorities ; either like the result of confrontations between « civil society », and public authorities ; or still as the result of the way in which multiple actors define and build the problems. Les nombreuses études de publics réalisées dans les musées et les expositions depuis un quart de siècle en France mettent en évidence une institution muséale aussi plurielle que ses publics. Elles montrent comment les caractéristiques de la visite se sont transformées, qu’il s’agisse du contexte, de l’organisation, de la nature de l’expérience de visite ou de son usage après coup. Elles relativisent également la thèse d’une reproduction sociale mécanique de l’intérêt pour les musées et par là même de (...) la nature des publics. Pour autant, le scepticisme persiste. Trois nouveaux analyseurs des changements à l’œuvre sont mobilisés pour achever de convaincre : la gratuité d’accès aux collections, la compagnie du visiteur, les temps sociaux de la visite.The many studies undertaken on museum visitors in the last quarter of a century in France clearly show that museums are as widely diverse as their visitors. They show how far the characteristics of museum visits have changed, whether in terms of context, organisation, or the nature and experience of a museum visit and its aftermath. They also bring a more relative perspective to the idea that interest in museums, and therefore types of museum visitors, are mechanically reproduced in society. Scepticism on this point nevertheless remains, and this study brings in three new analytical criteria to help overcome this: free access to museum collections, the company of the visitor and the social moments of museum visits. Cet article propose de considérer les produits des industries culturelles comme des formes particulières de représentation de la « réalité » du monde social, c’est-à-dire comme un de ses avatars. Pour saisir sociologiquement ces avatars, l’auteur propose d’abord une approche compréhensive destinée à montrer en quoi les produits de la culture de masse sont typiques . Il propose ensuite de les réinscrire dans une théorie générale de l’action qui montre que ces avatars sont en permanence, dans les sphères privée et (...) publique, l’objet de conflits de définition et de querelles d’interprétations. D’où la complexité méthodologique de saisie d’objets que le sociologue, par ses recherches, contribue à configurer.This paper proposes to consider the products of our cultural industries as specific forms of representation of the « reality » of the social world, in other words, as one of its « avatars ». In order to comprehend these avatars through a sociological approach, the author will start from an insider’s standpoint which shows how mass culture products are typical . The author then suggests to re-inscribe them within the frame of a general theory of action, pointing out how these products are continually the object of a struggle for definition and interpretation within the private and the public spheres. À l'occasion du débat sur le traité constitutionnel pour l'Europe, on communique enfin davantage sur les valeurs communes, l'horizon idéal auquel aspirent les Européens. L'existence d'une communauté de valeursbasée principalement sur un consensus autour de la culture politique partagée fait office de certitudes dont la remise en cause s'apparente à un pêché contre le code moral moderne qui est celui de l'ordre démocratique et des droits de l'homme. Or, l'Europe est le lieu par excellence de la diversité et des conflits (...) qui en résultent et qui ont souvent été sanglants. Toute cette dimension de confrontation de paradigmes culturels, de l'altérité difficilement tolérée, de la difficile négociation entre ce qui unit et ce qui sépare est souvent occultée dans la communication sur l'Europe. Une approche interdisciplinaire, puisant dans les recherches de l'anthropologie culturelle, de la sociologie des relations interethniques et de la communication interculturelle semble plus à même de répondre à ce type de questionnements nécessaires à l'heure de la crise de la construction européenne.Public debate about the European constitutional treaty provided an opportunity to discuss common values that are ideals for all Europeans. Any criticism of the existence of a community based on a consensus constructed around a certain shared political model is not allowed. In fact, such criticism would be seen as a sin against the modern moral code which is based on a democratic order and the respect of human rights. The problem is that Europe is a place of diversity and, often, of violent conflicts. This aspect of cultural confrontation, lack of tolerance for otherness and the difficulty in negotiating what unites and what divides nations very often remains hidden in public communication about Europe. An interdisciplinary approach, inspired by cultural anthropology, inter-ethnic relations, sociology and cross-cultural communication, is more adapted to analyze such problems which need to be dealt with now while European integration is underway. When many people are involved in an activity, it is often difficult, if not impossible, to pinpoint who is morally responsible for what, a phenomenon known as the ‘problem of many hands.’ This term is increasingly used to describe problems with attributing individual responsibility in collective settings in such diverse areas as public administration, corporate management, law and regulation, technological development and innovation, healthcare, and finance. This volume provides an in-depth philosophical analysis of this problem, examining the notion of moral (...) responsibility and distinguishing between different normative meanings of responsibility, both backward-looking and forward-looking. Drawing on the relevant philosophical literature, the authors develop a coherent conceptualization of the problem of many hands, taking into account the relationship, and possible tension, between individual and collective responsibility. This systematic inquiry into the problem of many hands pertains to discussions about moral responsibility in a variety of applied settings. (shrink)

Nowadays, on national and international levels, the law has been increasingly considering local and traditional communities’ role for achieving conservation. In Brazil, for instance, one can see how recent legal rules promote benefits for those local groups who practice low environmental impact activities. Nevertheless, regarding traditional fishing communities that live on the coastal zone, a region where many protected areas have been created lately in Brazil, the positive social effects of those measures are often undermined by the economic and political (...) pressure they suffer. This becomes particularly clear when the problem is seen under the different grades of citizenship people face in Brazil: that is, considering how people can be over-included in the legal system to have mainly access to its benefits, while others are under-included to be mainly dependent on it. It seems that Brazilian coastal fishing communities fall into the latter case, and that would explain how they are subject to many different types of restrictions and responsibilities due to the new legal instruments that are being developed to protect such areas, sometimes causing, for instance, a pressure to remove them from their homes. Conservation in this context, then, is to be understood beyond legal texts and, especially, under the evaluation of the social conditions these populations are submitted to. Therefore, this paper sketches the legal development of Brazilian marine protected areas, points out some examples of conflicts involving traditional fishing communities affected by conservation policies, and conceptualizes the relations of over- and under-inclusion they can be considered as part of. À partir d'ouvrages inventoriés sur une longue période, principalement les trente dernières années, l'épistémologie des sciences sociales s'interroge sur elle-même, sur ce qu'elle produit : des traces (...) d'objectivation, mais aussi de réflexion. Cet ouvrage est destiné aux chercheurs et enseignants chercheurs, mais aussi à tous ceux, et ils seront de plus en plus nombreux, qui, à l'écart des parti-pris et des dogmatismes, tentent de tracer leur chemin à des légitimations sociales et politiques en train de se faire. Mais, dès maintenant, elles tracent le chemin contre des illégitimations et des illégitimités globales advenues, dont la toute puissance serait apparemment le gage de leur pérennité. (shrink)

Réédition d'une importante inscription publiée en 1965 par A. Orlandos : souscriptions d'une trentaine de notables locaux, Grecs et Romains, en vue de rafraîchir plusieurs édifices publics. Ces réparations, modestes si l'on considère les sommes recueillies, étaient peut-être liées à l'introduction du culte d'Auguste à Messène, à la fin du Ier siècle av. J.-C. ou au début de notre ère. A noter la présence des Romains, naturelle dans la région à cette époque, et l'usage du denier comme monnaie de (...) compte. Plusieurs des monuments mentionnés le sont aussi par Pausanias ou peuvent être identifiés sur le site de l'Asclépieion. L'embarras financier de la cité, à ce moment, doit probablement s'expliquer par un manque de fonds disponibles plutôt que par des problèmes économiques ou sociaux. 3) il amorce enfin une redistribution chronologique des inscriptions financières de la dernière décennie de l'Indépendance en fixant plusieurs jalons sûrs ou probables, notamment la date d'une stèle de 174 avant J.-G. dont les deux sections, ID 440 et ID 456, ont été rapprochées et raccordées matériellement. The notion of “responsibility gap” with artificial intelligence (AI) was originally introduced in the philosophical debate to indicate the concern that “learning automata” may make more difficult or impossible to attribute moral culpability to persons for untoward events. Building on literature in moral and legal philosophy, and ethics of technology, the paper proposes a broader and more comprehensive analysis of the responsibility gap. The responsibility gap, it is argued, is not one problem but a set of at least four interconnected (...) problems – gaps in culpability, moral and public accountability, active responsibility—caused by different sources, some technical, other organisational, legal, ethical, and societal. Responsibility gaps may also happen with non-learning systems. The paper clarifies which aspect of AI may cause which gap in which form of responsibility, and why each of these gaps matter. It proposes a critical review of partial and non-satisfactory attempts to address the responsibility gap: those which present it as a new and intractable problem (“fatalism”), those which dismiss it as a false problem (“deflationism”), and those which reduce it to only one of its dimensions or sources and/or present it as a problem that can be solved by simply introducing new technical and/or legal tools (“solutionism”). The paper also outlines a more comprehensive approach to address the responsibility gaps with AI in their entirety, based on the idea of designing socio-technical systems for “meaningful human control", that is systems aligned with the relevant human reasons and capacities. The publication of scientific papers has become increasingly problematic in the last decades. Even if we agree that a renewed model is needed for peer-reviewed scientific publication, we think the problem does not essentially lie in professional publishing—with economic incentives—but in the publish-or-perish culture that dominates the lives of researchers and academics.

Many have argued that allowing and encouraging public avenues for dissent and critical evaluation of scientific research is a necessary condition for promoting the objectivity of scientific communities and advancing scientific knowledge . The history of science reveals many cases where an existing scientific consensus was later shown to be wrong . Dissent plays a crucial role in uncovering potential problems and limitations of consensus views. Thus, many have argued that scientific communities ought to increase opportunities for dissenting views to (...) be heard and taken seriously. Such opportunities are necessary for both limiting the influence .. (shrink)

La connaissance du social ne va pas de soi. Historiquement, la plupart des fondateurs de la sociologie ont réexaminé l'ensemble du système des sciences : en suivant, ou en rejetant, les modèles issus de la physique ou de la biologie, ils cherchent à constituer une autonomie de cette connaissance qui reste fidèle à l'idée qu'ils se font d'une science. C'est toute la question d'une sociologie bâtie et défendue à l'aune du modèle des sciences de la nature que ce (...) volume cherche à explorer, à la fois sous l'angle historique de sa constitution, et sous l'angle épistémologique de sa relation avec son objet. En effet, l'épistémologie classique, fondée dans une très large mesure sur l'étude des sciences de la nature, n'a pas vraiment été à même de rendre compte de la spécificité des sciences sociales, souvent accusées de ne pas satisfaire de critères suffisants de justification. Or la sociologie établit un lien propre avec son objet, car elle s'adresse à lui, et s'occupe des problèmes qui sont l'actualité même du monde social. A cause de ce lien, la sociologie n'est donc ni un strict équivalent d'une physique du social, ni une simple discipline historique qui se centrerait sur le monde contemporain : elle est engagée, d'une certaine manière, dans un dialogue avec la société, et l'analyse historique du développement de la sociologie permet de montrer comment elle a construit cette relation, à travers les métamorphoses de la question sociale. Dès lors, à la logique de la découverte et à celle de la justification, traditionnelles dans la philosophie des sciences, il faut adjoindre ce que l'on pourrait appeler une logique de la réception. C'est ce qui est proposé ici, à travers une approche phénoménologique et dans la ligné des travaux, entre autres, de Gadamer, Habermas et Jauss, sous le terme plus générique d'épistémologie de la réception. In their recent article, Brownet alanalyse several ethical aspects around immunity passports and put forward some recommendations for implementing them. Although they offer a comprehensive perspective, they overlook two essential aspects. First, while the authors consider the possibility that immunological passports may appear to discriminate against those who do not possess them, the opposite viewpoint of immune people is underdeveloped. We argue that if a person has been tested positive for and recovered from COVID-19, becoming immune to it, she cannot (...) be considered a hazard to public health and, therefore, the curtailment of her fundamental rights (eg, the right to freedom of movement) is not legitimate. Second, they omit that vaccine distribution will create similar problems related to immunity-based licenses. Vaccine certificates will de facto generate a sort of immunity passport. In the next phases of the pandemic, different immunity statuses will be at stake, because the need to identify who can spread COVID-19 is unavoidable. If a person does not pose a threat to public health because she cannot spread the infection, then her right to freedom of movement should be respected, regardless of how she acquired that immunity. Science is our most reliable producer of knowledge. Nonetheless, a significant amount of evidence shows that pluralities of members of publics question a variety of accepted scientific claims as well as policies and recommendation informed by the scientific evidence. Scientific misinformation is considered to play a central role in this state of affairs. In this paper, I challenge the emphasis on misinformation as a primary culprit on two grounds. First, the phenomenon of misinformation is far less clear than what (...) much discussion about the topic would lead one to believe. The evidence regarding the amount of misinformation that exits as well as its role in people’s harmful behaviors is at best conflicting and at worst completely useless. Second, the prominence given to misinformation and its harms on people’s behaviors disregards the role of values in policymaking and treats scientific information as if it were the only information necessary to make policy decisions. At a minimum, these problems call for caution regarding the emphasis on this phenomenon. After all, if the problem is incorrectly diagnosed, the solutions that are being offered to address the problem of misinformation are bound to at best inadequate and at worst dangerous. (shrink)

The paper uses two historical examples, public health (1840-1880) and town planning (1945-1975) in Britain, to analyse the challenges faced by goal-driven research, an increasingly important trend in science policy, as exemplified by the prominence of calls for addressing Grand Challenges. Two key points are argued. (1) Given that the aim of research addressing social or global problems is to contribute to improving things, this research should include all the steps necessary to bring science and technology to fruition. This need (...) is captured by the idea of practical integration, which brings this type of research under the umbrella of collective practical reason rather than under the aegis of science. Achieving practical integration is difficult for many reasons: the complexity of social needs, the plurality of values at stake, the limitation of our knowledge, the elusive nature of the skills needed to deal with uncertainty, incomplete information and asymmetries of power. Nevertheless, drawing from the lessons of the case studies, it is argued that (2) practical integration needs a proper balance between values, institutions and knowledge: i.e. a combination of mutual support and mutual limitation. Pursuing such a balance provides a flexible strategy for approximating practical integration. (shrink)

Charles-Saget ; et d’autres, enfin, se sont penchés sur l’espace grec païen: deux études sont consacrées à Plotin ; J. Carlier étudie le thème de l’après mort chez Porphyre, C. Despite widespread and worldwide efforts to eradicate vector-borne diseases such as malaria, these diseases continue to have an enormous negative impact on public health. For this reason, scientists are working on novel control strategies, such as gene drive technologies (GDTs). As GDT research advances, researchers are contemplating the potential next step of conducting field trials. An important point of discussion regarding these field trials relates to who should be informed, consulted, and involved in decision-making about their design and launch. It (...) is generally argued that community members have a particularly strong claim to be engaged, and yet, disagreement and lack of clarity exist about how this “community” should be defined and delineated. In this paper, we shed light on this “boundary problem”: the problem of determining how boundaries of inclusion and exclusion in (GDT) community engagement should be drawn. As our analysis demonstrates, the process of defining and delineating a community is itself normative. First, we explicate why it is important to define and delineate the community. Second, we demonstrate that different definitions of community are used and intermingled in the debate on GDTs, and argue in favor of distinguishing geographical, affected, cultural, and political communities. Finally, we propose initial guidance for deciding who should (not) be engaged in decision-making about GDT field trials, by arguing that the definition and delineation of the community should depend on the rationale for engagement and that the characteristics of the community itself can guide the effective design of community engagement strategies. Le renouveau de la sociologie économique et de la microéconomie semble ouvrir la voie à une tentative de réconciliation entre ces deux disciplines autour d’une définition commune de l’action économique. Néanmoins, la persistance des controverses et des malentendus épistémologiques se traduit par l’impossibilité même de construire une coopération entre économistes et sociologues. Cet article examine les raisons de ce paradoxe et tente de démontrer que le dialogue entre la « Nouvelle Sociologie Économique » et la « Nouvelle Micro-Économie (...) » aboutit à une impasse parce qu’il oscille en permanence entre des références épistémologiques et conceptuelles inconciliables. L’objet que partagent a priori ces deux champs disciplinaires devient alors insaisissable. Une approche socio-anthropologique en termes de formes de transactions « économiques » semble néanmoins ouvrir une perspective pour sortir de ce « piège épistémologique » parce qu’elle aborde cet objet en s’affranchissant, provisoirement, des finalités et des formes de rationalité de l’action économique.The resurgence of economic sociology and of micro-economics seems to offer possibilities for the reconciling of these disciplinary fields around a common definition of economic action. Nevertheless, the persistence of epistemological misunderstandings and controversies underlines the apparent impossibility of the task of constructing a common programme between sociologists and economists. This paper proposes to examine and explain this paradox and seeks to demonstrate that the dialogue between the « New Economic Sociology » and the « New Micro-Economics » has reached a dead end because it fluctuates between epistemological and conceptual assumptions which are irreconcilable. This oscillation makes it impossible to define a common object of study shared by both disciplinary fields. However, a socio-anthropological approach focusing on « economic » forms of transaction seems to offer a way out of this impasse, addressing the problem by temporarily placing in parentheses the ends and the types of rationality of economic action. The evolution and maintenance of cooperation in human and animal societies challenge various disciplines ranging from evolutionary biology to anthropology, social sciences, and economics. In social interactions, cooperators increase the welfare of the group at some cost to themselves whereas defectors attempt to free ride and neither provide benefits nor incur costs. The problem of cooperation becomes even more pronounced when increasing the number of interacting individuals. Punishment and voluntary participation have been identified as possible factors to support cooperation and (...) prevent cheating. Typically, punishment behavior is unable to gain a foothold in a population, while volunteering alone can efficiently prevent deadlocks in states of mutual defection but is unable to stabilize cooperation. The combined effects of the two mechanisms have surprisingly different consequences in finite and infinite populations. Here we provide a detailed comparison of the two scenarios and demonstrate that driven by the inherent stochasticity of finite populations, the possibility to abstain from social interactions plays a pivotal role, which paves the way for the establishment of cooperation and punishment. The interdisciplinary analysis of today's drug policy in Brazil, marked by its prohibitionist character, leads to the conclusion that it has frustrated the expectations of all of those who believed that the publication of law 11.343/06 would lead to a different treatment of drug users and traffickers. It is possible to observe some difficulties in the access to the medical use of substances that are considered illicit today, as well as the absence of legal, objective criteria to distinguish users from (...) traffickers. The focus of penal prosecution is not directed toward the great traffickers of drugs, who are still profitting, in a context in which there is no reduction in consumption or commerce. The model of public security has been removed from the principles and guarantees present in the Federal Constitution by identifying black and poor people as potentially criminal. Therefore, starting from the premise that today's drug policy has been managed in irrational fashion and has violated human rights, we propose paths to overcome the problems we have identified. In one of his key publications on the harmful dysfunction analysis of mental disorder (HDA), Jerome Wakefield acknowledged that he has “explored the value element in disorder less thoroughly than the factual element. This is in part because the factual component poses more of a problem for inferences about disorder and in part because the nature of values is such that it requires separate consideration” (Wakefield 1992, 384). More than twenty years have passed since this remark, and yet a thorough (...) consideration of the value component in Wakefield’s HDA is still lacking. Quite a few contributions to this volume promise to change that situation, and ours is one of these. In this contribution, we will analyze the harm or value component and argue that Wakefield’s dealing with it is so problematic that it undermines, at least indirectly, the viability of the HDA. In the first section, we explore Wakefield’s emphasis on the subjective nature of harm and his exclusive focus on social values. The second section is devoted to an analysis of Wakefield’s examples of conditions that are dysfunctional but harmless (fused toes, albinism, reversal of the heart, dyslexia in illiterate societies, etc.). We argue that these examples are quite problematic because they do not exemplify what they are supposed to exemplify. In the third section, we show how these two problems are connected: Wakefield uses the harmfulness of a condition as an implicit criterion to distinguish normal variation from dysfunction. In doing so, he blurs the distinction between the harm component and the dysfunction component, even though this distinction is central to his HDA. (shrink)

The student of Spinoza is faced by a peculiar difficulty. On opening the Ethics —Spinoza's chief work, completed for publication shortly before his death in 1674—he finds a system of metaphysics set forth in geometrical form, starting from definitions, axioms, and postulates, and advancing synthetically from first principles to a detailed interpretation of the universe. The difficulty lies not in the language— Spinoza's Latin is easy to construe, and there are translations—nor in the lack of literary graces; his style indeed (...) is singularly impressive in its austere dignity. It lies rather in this, that the method of exposition conveys a misleading suggestion of dogmatism and finality, and conceals almost all traces of the patient inquiries that issued in the finished structure. If once the principles of the system are admitted, the rest appears to follow by logical necessity. But by what processes of thought was Spinoza led to those principles? This is the problem that besets the reader: in order to understand the Ethics , he must penetrate behind the text of the propositions to their significance as answers to the questions that were stirring in Spinoza's mind. This article discusses the issue of Christianity in a pluralistic society on the basis of the book "If God Were a Human Rights Activist", by Boaventura de Sousa Santos. In this book the author confronts the challenges that the "movements that demand the presence of religion in the public sphere" place for human rights in the context of ”ecology of conceptions of human dignity." This article begins by presenting the problem of Christianity in a pluralistic society and indicating two fundamental (...) forms of dialogue and interaction between religious traditions and society as a whole. The text goes on to show, from the aforementioned book, how traditions and religious movements are a privileged place of affirmation and defense of human dignity and how theologies that sustain them constitute a 'defense grammar of human dignity. The article concludes by showing how the affirmation and defense of human dignity, understood and lived in the context of social struggles for justice, constitute the core of the Christian experience of God or, in any case, one of its fundamental features or marks. There is a view that the U.S. Supreme Court has acted as a “republican schoolmaster,” defining and educating the public on the permissible interaction between government and religion. The Court gave government, especially state governments, considerable latitude until incorporation of the religion clauses in the 1940s. In Everson v. Board of Education (1947), the Court articulated a rigid conception of church and state which set precedents for decades. Those precedents restricted accommodation to religion by government, based on an incomplete reading (...) of the Founding debates on religion. It has been gradually corrected since Justice William Rehnquist’s dissent in Wallace v. Jaffree (1985). The implications of the separationist interpretation have had consequences that remain. The most obvious being forestalling experimentation with school choice for non-public school students and precluding the use of public facilities for religious groups until a series of corrective rulings beginning, for the most part, in the 1990s. The republican schoolmaster is now accountable for the intellectual lineage it uses. (shrink)

Leibniz’s role en current political and social thought is complex. On the one hand, he represents the last great synthesis built on the idea of the World as a creation of God and man as his cooperator in history. However his notion of contingency can help to explain some of the problems facing social sciences today in so far as he understandsthis concept not only from an ontological but also from an epistemological point of view. To this one should add (...) that criticisms of classical and modern philosophy such as those of Isaiah Berlin and Hannah Arendt leave intact the need of reason to organise society and we can see in Leibniz use of reason a forerunner of public choice postions. In sum, his vision of reason is very much alive though in new contexts. (shrink)

This dissertation critically examines the writings of Max Stirner, especially his masterpiece The Ego and Its Own, as a discourse of resistance against modern forms of domination and, in particular, against the modern political State. I begin by examining Stirner's inversion of the Hegelian concept of the State, from the “actualization of freedom”to an instance of domination. The State appears, to Stirner as to Hegel, as the guardian of order and cohesion in modern societies. While both recognize the genesis of (...) sovereign power as violent, Hegel sustains that, with the progress of civilization, force is eradicated from the public order and private interests and common interest are reconciled. Stirner, on the contrary, insists that force is the other face of right, as the hidden pillar of the norm, which only reveals itself in moments of crisis. Stirner’s focus on the extreme case, largely anticipated and devalued by Hegel as unilateral and equivocal, seems to be anchored on the conviction that conflict is ineradicable, that between my own will and the (political, social) representation of that will there is always a gap, which cannot be filled by any collective arrangement. From this follows that, if conflict is scarcely manifest in modern societies, it is not because it was truly solved, but because it is effectively masked, due to the dissymmetry of power and the internalization of authority. The “unique one” appears, in this environment of great suspicion, as the one who cannot be represented, who surpasses every representation, threatening the authority of every representative. Accordingly, the “unique one” reclaims his own power, without allowing the satisfaction of his will to be mediated by obedience to collective institutions, affirming himself instead as sovereign over himself. Stirner suggests that the self-affirmation of the “unique one” inevitably leads to confrontation with the external powers that organize his existence. Stirner, nonetheless, chooses to think this confrontation in terms of a “revolt”, of a reflexive and individual act by which the individual emerges from the situation in which he finds himself, rather than as a “revolution”, a political or social act directed towards the systemic transformation of the status quo. Even if we admit the validity of the Stirnerian critique of the legitimizing discourses of modernity, the problem remains if this critique can be sustained on the “unique one”, “a thoughtless word”, an openly self-contradictory and self-destructive name, subject or principle (?). The possibility of founding a discourse of resistance on the egoism of Max Stirner seems to depend upon the answer that we choose to give to two intimately connected questions: what remains after the destructive vortex of the “unique one” that may sustain the resistance against a state that Max Stirner deems oppressive? Can this resistance be realized in the revolt of a unique one without the recognition of another one with whom to build the conditions of freedom? (shrink)

Resumen: Uno de los mayores retos a superar por las democracias representativas electorales contemporáneas pasa por paliar la desafección ciudadana y, consecuentemente, suturar la brecha entre gobernantes y gobernados. Se podría llegar a un cierto consenso, si afirmáramos que la profesionalización de los políticos se está convirtiendo en uno de los obstáculos a los que se enfrenta la ciudadanía a la hora de confiar en el sistema político. En este sentido, el objetivo principal del presente artículo pasa por reflexionar sobre (...) los efectos nocivos de la profesionalización de la clase política, y analizar el potencial del sorteo como mecanismo neutralizador. A su vez, averiguar si este, a través de minipúblicos deliberativos, tiene o no la capacidad de minimizar sus excesos nocivos y, con ello, aumentar el grado de confianza de la ciudadanía con sus representantes políticos. Abstract: One of the greatest challenges to be overcome by contemporary electoral representative democracies is to alleviate citizen disaffection and, consequently, bridge the gap between the rulers and the ruled. A certain consensus could be reached if we affirmed that the professionalization of politicians is becoming one of the obstacles that citizens face when it comes to trusting the political system. I In this sense, the main objective of this article is to reflect on the harmful effects of the professionalization of the political class and analyze the potential of the sortition as a neutralizing mechanism. In turn, find out if this, through deliberative mini publics, has or not the ability to minimize its harmful excesses and, with it, increase the degree of trust of citizens with their political representatives. The discussion about the concept of enlightenment runs through the conception of Immanuel Kant, who thematized it as an exit from the individual from his condition of intellectual minority and guardianship of those who prevent the exercise of thinking for himself, impelling the achievement of autonomy that requires freedom and to make public use of reason. Such problematization about the difficulties interposed to the process of enlightenment can be related to the problem of estrangement in Marx, making the necessary considerations (...) in relation to the historical and social context of both philosophers. In this way, through philosophical investigation, it is possible to establish correlations of complementarities, differences and counterpoints between the different conceptions of Kant and Marx. Thus, we realize that the search for enlightenment depends on overcoming the material determinations of the set of alienations produced by the capitalist mode of production, aiming at the achievement of human emancipation understood as effective autonomous freedom. We study the extension of public announcement logic PAL by public assignments, which we call PALA. Just as in the case of PAL, the standard procedure for deciding PALA validity, i.e. the use of so-called reduction axioms to translate PALA formulae into formulae in epistemic logic EL, may lead to exponential growth. In this paper, we show that such a price is not mandatory, for we provide a polynomial translation of PALA into EL. This is based on abbreviations of subformulae (...) by new propositional letters. Such optimal translation also enables us to show the computational complexity of the problem of deciding PALA validity, which turns out to be coNP-complete in the single-agent case and PSPACE-complete in the multiagent case. "L'ouvrage que nous propose aujourd'hui Mme Delphine Espagno est peut-être la plus belle des invitations qui ait été écrite afin d'inciter le lecteur, citoyen et/ou juriste, à comprendre la pensée du doyen de Bordeaux. Léon Duguit méritait effectivement le présent ouvrage et hommage car le doyen, comme Jean-Jacques Rousseau avant lui, a longtemps été et est encore souvent présenté soit comme un marginal de la pensée juridique, soit est même dédaigné de façon méprisante comme si sa qualité de juriste lui (...) était déniée. Hauriou, nous rappelle l'auteure, ira même ainsi jusqu'à affubler Duguit d'être un "anarchiste de la chaire" ce qui n'avait manifestement pas totalement déplu à ce dernier! Car, ce que rappelle Mme Espagno dès son introduction, c'est bien une nouvelle manière de penser et de réinventer le Droit dans son ensemble que nous invite à accomplir Léon Duguit. Il n'est pas qu'un faiseur de théorie(s) (comme celles du service public, des agents publics ou encore de l'Etat), il est - pour reprendre l'expression de Chenot désormais consacrée - un véritable "faiseur de système dans son sens le plus noble et mélioratif. Duguit assume en effet son rôle de guide et nous a donné à voir une nouvelle façon d'appréhender le Droit non pas tel qu'il est mais tel qu'il devrait être. Un Droit qu'il a comme réinventé en chaussant de nouvelles lunettes tel le spectateur qui verrait en deux dimensions et désormais en découvrirait - grâce à lui - une troisième. Après Léon Duguit, les juristes n'ont ainsi pu feindre de ne concevoir le Droit qu'à l'instar d'un artifice fictif, technique et juridique : le Droit est devenu indissociable de la sociologie. Ce "droit duguiste" nous offre alors grâce à la lumière qu'y dépose avec délicatesse Mme Delphine Espagno la vision renouvelée des relations existantes entre Droit, individu et collégialité ou société. En outre, ce que va construire le doyen de Bordeaux n'est pas - comme on le lit encore souvent - une "simple" théorie du service public mais une théorie réaliste de l'Etat par le service public", Mathieu Touzeil-Divina. Online gambling companies claim that they are ethical providers. They seem committed to corporate social responsibility (CSR) practices that are aimed at preventing or minimising the harm associated with their activities. Our empirical research employed a sample of 209 university student online gamblers, who took part in an online survey. Our findings suggest that the extent of online problem gambling is substantial and that it adversely impacts on the gambler's mental and physical health, social relationships and academic performance. Online problem (...) gambling seems to be related to the time spent on the Internet and gambling online, parental/peer gambling and binge drinking. As our findings show that there are harmful repercussions associated with online gambling, we argue that companies in this controversial sector cannot reach the higher level of CSR achieved by other industries. Nevertheless, they can gain legitimacy on the basis of their CSR engagement at a transactional level, and so, by meeting their legal and ethical commitments and behaving with transparency and fairness, the integrity of the company can be ensured. We also argue that current failures in the implementation and control of CSR policies, the reliance on revenue from problem gamblers' losses, and controversial marketing activities appear to constitute the main obstacles in the prevention or minimisation of harm related to online gambling. As online gambling companies must be responsible for the harm related to their activities, we suggest that CSR policies should be fully implemented, monitored and clearly reported; all forms of advertising should be reduced substantially; and unfair or misleading promotional techniques should be banned. The industry should not rely on revenue from problem gamblers, nor should their behaviour be reinforced by marketing activities (i.e. rewards). We realise, however, that it is unrealistic to expect the online gambling industry to prioritise harm prevention over revenue maximisation. Policy makers and regulators, therefore, would need to become involved if the actions suggested above are to be undertaken. CSR is paramount to minimise harm and provide a healthier user experience in this business sector, but it also poses marketing dilemmas. We support a global collaborative approach for the online gambling industry, as harm related to gambling is a public health issue. (shrink)

La sociologie de l’action publique s’est régulièrement intéressée aux temporalités. L’action publique est perçue comme pesant très fortement sur les temporalités sociales tandis que celles-ci représentent une contrainte dont doit tenir compte toute action publique. Les analyses des chercheurs ont mis en évidence que la perception d’un temps linéaire et séquentiel ne rendait que très imparfaitement compte des processus en jeu, et que l’action publique correspondait davantage à des alternances irrégulières et peu prévisibles entre un temps long de la (...) stabilité et un temps plus bref et ramassé de la rupture. L’émergence du nouveau management public a cependant transformé radicalement cette question, en imposant une autre logique de rationalisation des temporalités dont le droit lui-même porte désormais la marque. Si la littérature rend compte des processus d’accélération de l’action publique et de la multiplication des ruptures, notre article réinterroge l’alternance et l’hétérogénéité des temps ainsi que les tensions qui en résultent. Cette hétérogénéité se trouve tout d’abord confortée par la sectorisation de l’action publique. Ensuite, il reste des domaines dans lesquels le temps long résiste, contribuant ainsi à une lecture différenciée de l’action publique contemporaine. (shrink)

Cet article entend participer à l’étude de l’inscription du Régime de Vichy dans l’histoire de la mise en forme et de l’institutionnalisation des sciences sociales autour d’une Science de l’Homme. Le modèle d’une science sociale unifiée est en particulier porté par la Fondation française pour l’étude des problèmes humains (dite Fondation Carrel) et son secrétaire général, l’économiste François Perroux. Cette institution, créée et financée de manière substantielle par le régime de Vichy, s’inscrit non seulement dans l’histoire longue de l’émergence (...) des sciences sociales en France, mais constitue également un point de rupture important dans ce processus. Cette rupture profite particulièrement à l’alliance de circonstance entre traditionalistes et certains pans des sciences les plus modernistes de l’époque, ceci en opposition avec une sociologie durkheimienne qui, dès les années 1930, perd de son influence.
