The rapid growth in consumption of bottled water across the globe has drawn attention of policy makers and academicians alike. However, its consumption practices have been examined primarily in the context of industrialized countries. Drawing on studies of Science, Technology and Society, Public Understanding of Science, and institutions, this article explores the nuances of the consumption conundrum of bottled water in India. This mixed method study relies on data collected through surveys and ethnography of consumption practices at selected sites (...) in Delhi. We find reasons for bottled water consumption to vary with the site of consumption. Although the notions of “purity” and “scarcity” drive consumption behavior, these attributes are far from being objective. Rather, they are shaped by a complex mix of sociocultural factors, public understanding of science, and trust on various institutional mechanisms of water provisioning. (shrink)

Lanarkshire Health Board, the Supreme Court of the United Kingdom overruled the long-standing, paternalistic prudent doctor standard of care in favour of a new reasonable patient standard which obligates doctors to make their patients aware of all material risks of the recommended treatment and of any reasonable alternative treatment. This landmark judgment has been of interest to the rest of the common law world. A judicial trend of invoking Montgomery to impose more stringent (...) requirements on doctors is discernible in subsequent decisions since then.Main bodyIn this narrative review, without questioning the idea that properly informed patients should play a more active role in procedures affecting their own health in furtherance of their autonomy, safety, and consumer rights, we identify and analyse, with the aid of realistic clinical thought experiments, three practical conundrums that the Montgomery standard may inflict on the daily work of doctors, unfairly exposing them to arbitrary legal risks.ConclusionsThese conundrums pertain to the ascertainment of the risks that must be disclosed to the patient under the test of ‘materiality’; the legal uncertainty as to the scope of the exceptions; and the actual ability of doctors to cope with the pressures of time. The impending implementation of pre-exposure prophylaxis has prompted complicated bioethical and public health ethics concerns regarding the moral distribution of antiretroviral medications to ostensibly healthy populations as a form of HIV prevention when millions of HIV-positive people still lack access to ARVs globally. This manuscript argues that these questions are, in part, concerns over the ethics of the knowledge production practices of epidemiology. Questions of distribution, and their attendant cost-benefit calculations, will rely on a number of presupposed, and therefore, normatively (...) cultural assumptions within the science of epidemiology specifically regarding the ability of epidemiologic surveillance to produce accurate maps of HIV throughout national populations. Specifically, ethical questions around PrEP will focus on who should receive ARVs given the fact that global demand will far exceed supply. Given that sexual transmission is one of the main modes of HIV transmission, these questions of ‘who’ are inextricably linked to knowledge about sexual personhood. As a result, the ethics of epidemiology, and how the epidemiology of HIV in particular conceives, classifies and constructs sexual populations will become a critical point of reflection and contestation for bioethicists, health activists, physicians, nurses, and researchers in the multi-disciplinary field of global health. In this paper, I expose a conundrum regarding divine creation as Leibniz conceives of such creation. What energizes the conundrum is that the concept of omnibenevolence—“consequential omnibenevolence”—that the Leibnizian argument for the view that the actual world is the best of all possible worlds presupposes, appears to sanction the conclusion that God has no practical reasons to create the actual world.

Kundakunda’s handling of several basic ideas cannot be omitted when one deals with the following concepts in Jaina philosophy: 1. Sy_āt/siya, syādvāda_ or _saptabhaṅgī_. 2. _Nayas_, _vyavahāra_ and _niścaya nayas_ and _naya_vāda. 3. _Sapta_ and _Nava tattvas/padārtha_ and 4. _Anekāntavāda_. No doubt his dates are a major conundrum; recent research regards him to have lived around the fourth or fifth centuries (Brill’s Encyclopedia of Jainism, BEJ: Brill’s Encyclopedia of Jainism (Handbook of Oriental Studies. Section 2 South Asia), edited by (...) Knut Jacobsen, John A. Cort, Paul Dundas and Kristi L. Wiley. Leiden | Boston: Brill, 2020., p. 853). Moreover, it has been said that Kundakunda “_thread a somewhat new path on which he virtually remained a lone traveller_”, evident by the fact that hardly, if any, Digambara or even Śvetāmbara scholar elaborates on his ideas, let alone crediting him for significant basic insights into Jaina philosophy. Moreover, it seems to be evident, as will be attempted to show, that some ideas appear to be taken over from Kundakunda. Together with Kundakunda’s ‘legacy’, this article will highlight several conundrums regarding the philosophical impact of several concepts in his works that fortunately have not been relegated to oblivion. India now constitutes approximately 17% of the world’s population and has a high proportion of younger people. Philosophy for school children aims to create better citizens of the future. In this article, I establish the need to teach philosophy to children in schools, especially in India. Subsequently, I discuss the readiness of Indians to accept philosophy in the school curriculum, their conundrum in understanding the need for philosophy in a school setting, and the East-West dilemma concerning the teaching of (...) philosophy in schools. The concept of self-realization is important in education. Socrates claimed that an unexamined life is not worth living. However, the self-realization concept of the West differs from that in India. While the former perceives self-realization as a way to construct a good individual, the latter has always emphasized the cessation of the individual and focused on the incomprehensible truth human languages cannot capture. Western philosophy is concerned with questioning, inquiry, and the problems of philosophy. The East is concerned with bringing such questioning to an end. Matthew Lipman focuses on increasing curiosity, accelerating the thinking process, teaching logic and formal reasoning, and the intellectual enhancement of children. Indian philosophy, yoga, and meditation are all concerned with the cessation of consciousness. The key question concerns the approach one may choose to adopt in teaching philosophy – accelerating or decelerating the thought processes of children? Indian parents are the primary decision-makers in their children’s education, and sometimes throughout their careers and lives. Unless clarity emerges in the Indian and global community regarding this issue, there is no clear starting point for teaching philosophy to children in India. This article aims to raise critical awareness among global citizens regarding this conundrum in the collective Indian psyche. Unless the world’s psyche is inserted into the place of the Indian psyche, the great barrier between the West and the East regarding philosophy in the school curriculum cannot be bridged. (shrink)

This is the conundrum that gives rise to the issue of tax avoidance: Although governments always seem to lack sufficient funds to support the needs of society, tax codes are often written that offer “a way out” of paying taxes for some but not all constituents. The ways out are referred to as loopholes that allow taxpayers to avoid taxes. This paper first defines the basic terms of tax avoidance and tax evasion and then offers an ethical review of (...) the morality of aggressive tax avoidance. Aggressive tax avoidance is then addressed in relationship a corporate entity’s tone at the top. The conclusion is drawn that use of the letter of the law to avoid payment of taxes sorely needed by governments for the good faith provision of public goods and services is ethically unacceptable. Several suggestions for change are provided, including a new financial statement disclosure and the possibility of a published corporate ethics report. (shrink)

The deteriorating situation of migrant workers’ health rights protection was once again highlighted in the case of Tseng Hei-tao. This case explicitly and implicitly showed that four conundrums—the Employment Restriction Conundrum, the Occupational Safety and Health (OSH) Legal Conundrum, the Morality Conundrum and the Identity Conundrum—are barriers to migrant workers’ right protection. The health rights of migrant workers could be safeguarded by abolishing the outdated household registration system designed in the planned economy era, improving the rule (...) of law, and strengthening administrative supervisions. Background In the last years, there has been an increase in publication of systematic reviews of normative literature or of normative information in bioethics. The aim of a systematic review is to search, select, analyse and synthesise literature in a transparent and systematic way in order to provide a comprehensive and unbiased overview of the information sought, predominantly as a basis for informed decision-making in health care. Traditionally, one part of the procedure when conducting a systematic review is an appraisal (...) of the quality of the literature that could be included. Main text However, while there are established methods and standards for appraising e.g. clinical studies or other empirical research, quality appraisal of normative literature in the context of a systematic review is still rather a conundrum – not only is it unclear how it could or should be done, but also the question whether it necessarily must be done is not settled yet. Based on a pragmatic definition of “normative literature” as well as on a typology of different types of systematic reviews of normative literature/information, this paper identifies and critically discusses three possible strategies of conducting quality appraisal. Conclusions The paper will argue that none of the three strategies is able to provide a general and satisfying solution to the problems associated with quality appraisal of normative literature/information. Still, the discussion of the three strategies allows outlining minimal conditions that elaborated strategies have to meet in future, and facilitates sketching a theoretically and practically promising strategy. This paper draws from critical data studies and related fields to investigate police officer-involved homicide data for Los Angeles County. We frame police officer-involved homicide data as a rhetorical tool that can reify certain assumptions about the world and extend regimes of power. We highlight the possibility that this type of sensitive civic data can be investigated and employed within local communities through creative practice. Community involvement with data can create a countervailing force to powerful dominant narratives and supplement activist (...) projects that hold local officials accountable for their actions. Our analysis examines four Los Angeles County police officer-involved homicide data sets. First, we provide accounts of the semantics, granularity, scale and transparency of this local data. Then, we describe a “counter data action,” an event that invited members of the community to identify the limits and challenges present in police officer-involved homicide data and to propose new methods for deriving meaning from these indicators and statistics. In this paper I examine in detail the continued – and curious – popularity of religious schools in an otherwise ‘secular’ twenty-first century Europe. To do this I consider a number of motivations underwriting the decision to place one’s child in a religious school and delineate what are likely the best empirically supported explanations for the continued dominant position of Protestant and Catholic schools. I then argue that institutional racism is an explanatory variable that empirical researchers typically avoid, though it (...) informs both parental assessments of school quality as well as selective mechanisms many mainstream religious schools use to function as domains of exclusion. I then distinguish between religious schools in a dominant position from those serving disadvantaged minorities and argue that the latter are able to play a crucially important function other schools only rarely provide and hence that vulnerable minorities may have reason to value. The role of metaphysics in critique stands as a defining issue for the Frankfurt School theorists. Max Horkheimer himself claims that metaphysics serves as an instrument of domination, leading him to develop an interdisciplinary mate- rialism as a postmetaphysical alternative. Critics such as Georg Lohmann con- tend, however, that Horkheimer’s critique of instrumental reason is aporetic insofar as it undermines all metaphysical claims while implicitly making them. Since Horkheimer narrowly equates metaphysics with identity thinking, this article argues that his appeal (...) to nonidentity thinking as the foundation for critique is better understood as a form of antimetaphysics. This, however, leaves Horkheimer no better situated, since antimetaphysics remains a variant of metaphysics. While Horkheimer reproduces the techniques of domination he sought to avoid, this lapse into metaphysics warns of the difficult path that postmetaphysical thinking must navigate between the antipodes of metaphys- ical and antimetaphysical positions. Charles Dickens began one of his many great works of literature with this seemingly paradoxical, self-contradictory statement. Reflecting on a jury verdict in Northern California in June of 2001, in the context of what has transpired during the decade of the 1990s with regard to the care of dying patients, observations in the genre of Dickens come readily to mind. In 1991, two of the most compelling books on the subject of pain, medicine, and society were published: Eric Cassell's The (...) Nature of Suffering and the Goals of Medicine and David Morris's The Culture of Pain. Both works unflinchingly recognized and explored the implications of the vast clinical literature documenting the failure of modern medicine to respond compassionately and effectively to what had by then become an epidemic of undertreated pain. In this article, we consider how certain types of contemporary biosocial psychiatric research conceptualise and explicate biology-social relations. We compare the historic biopsychosocial model to recent examples of social defeat research on schizophrenia and cultural neuroscience work on affective disorders. This comparison reveals how the contemporary turn towards the ‘biosocial’ within psychiatric research relies upon ideas of the psychological as an interface. This is problematic because psychological notions of ‘experience’ are used as the central mechanics of biosocial processes, but lack (...) any meaningful engagement with considerable debates within psychology and cognitive science about what the mind, and indeed the psychological, actually is, its relationship to social life, and how we should study it. The psychological interface is therefore vital to these biosocial hypotheses but is remarkably underdeveloped in comparison to its biological and sociological components. We argue that biosocial psychiatric research could gain a great deal from engaging with contemporary theorisations of experience and being more critical of vague appeals to psychological phenomena. Faced with the serious threat of the deadly coronavirus, governments of different nations were swift to respond to the pandemic by declaring national lockdowns. Having confirmed fewer than ten cases of coronavirus that had tested positive, Zimbabwe called for a national lockdown which initially lasted three weeks before declaring it ‘indefinite’. Despite the fact that the lockdown declared in Zimbabwe was in the interest of public health, anecdotal evidence indicates that there has been an inextricable nexus between the lockdown and (...) increased corrupt tendencies. This paper, which is a product of qualitative research, utilised a narrative research approach and documentary analysis to explicate the relationship between Zimbabwe’s coronavirus lockdown and corruption. The paper looks at the different forms of corruption that occurred during the coronavirus lockdown in Zimbabwe and the implication of these on the well-being and welfare of economically vulnerable groups. In conclusion, the paper indicates the role that can be played by pro-human rights professionals such as social workers in the fight against corruption during emergency times to ensure transparency and accountability. This article reviews the feminist theorization of the concept of citizenship in an attempt to contextualize it in a situation where the basic ingredients for a sovereign state do not exist. The formation of the Palestinian Authority included the reconstruction of the Palestinian ‘imagined’ community within which approaches to gender policies were reformulated to suit a new era. However, the feminist use of the concept of citizenship itself comes into question under conditions of prolonged Occupation. In this analysis, I submit (...) that while women’s NGOs and grass-roots organizations have an important role to play in creating space for women to politicize their demands in advocating full citizenship rights, there are serious limits to what institutions of civil society can achieve when the basic foundations for the state are in a precarious situation. Biology can inspire robotic simulations of behavior and thus advance robotics, but the validity of drawing conclusions about real behavior from robotic models is questionable. When I was asked to propose a topic for my presidential address, the subject I chose, moral imperatives and conundrums of conscience, seemed to me particularly appropriate and timely. This was in part because of the problems of conscience caused for many members of the Academy by the decision to hold the annual meeting in Arizona, whose restrictive laws on immigration seemed to many to violate basic principles of right and justice and hence to warrant a boycott. Long, thoughtful, and (...) impassioned discussion of the issues revealed their complexity. Although the final decision disappointed many members, all recognized its virtue in supporting the Arizonans who were struggling to accomplish revocation of legislation they believed wrong. There was more. The crises in the leadership of the Academy during two of my years as a presidential officer raised issues of conscience and morality for all who worked to achieve equitable, just, and rational solutions to our problems and conflicts. On both issues, the site of the meeting and the governance of the Academy, colleagues adopted and defended positions that demonstrated the variety and strength of their convictions and the diversity of their reasons for holding them. There are also ethical, legal and social implications from the handling of sensitive patient information. The paper explores the concerns, expectations and implications of the National Health Service England care.data programme: a national data sharing initiative of linked electronic health records for healthcare and other research purposes. Using Nissenbaum’s contextual integrity of privacy framework through a critical Science and Technology Studies lens, it examines the (...) way technologies and policies are developed to promote sustainability, governance and economic growth as the de facto social values, while reducing privacy to an individualistic preference. The state, acting as a new, central data broker reappropriates public ownership rights and establishes those information flows and transmission principles that facilitate the assetisation of NHS datasets for the knowledge economy. Various actors and processes from other contexts attempt to erode the public healthcare sector and privilege new information recipients. However, such data sharing initiatives in healthcare will be resisted if we continue to focus only on the monetary and scientific values of these datasets and keep ignoring their equally important social and ethical values. Sociologists have challenged the discipline to account for and incorporate biological factors in their analyses. Heeding this call, this article asks how chimeras, a particularly puzzling biological organism, are being officially classified in the interrelated sites of endangered species preservation and the zoo. Based on a qualitative study of endeavors to clone endangered animals, I contend that biology alone cannot determine the classification of these interspecies organisms. Rather, categorizing chimeras requires metaphoric, schematic references to more familiar entities. Here culture and (...) biology are tools for classification, which has consequences for preservation practices and the materiality of endangered wildlife. Drawing on the sociology of culture, I show that positions on classification represent an intermediary space for interpreting the relationship between meaning and action in discourse elaboration. Building on the sociology of science and technology, I show the epistemological limitations of understanding the biological as an a priori factor. (shrink)

The past decade has seen a sizable increase in scholarship on Kant’s Religion. Yet, unlike the centuries of debate that inform our study of his other major works, scholarship on the Religion is still just in its infancy. As such, it is in a particularly vulnerable state where errors made now could hinder scholarship for decades to come. It is the purpose of this paper to mitigate one such danger, a danger issuing from the widely assumed view that the Religion (...) is shaped by “two experiments.” We will begin with a survey of the four current interpretations of the experiments, and then propose one further interpretation, one that hopefully will help dismantle this alleged “conundrum” and thereby help scholarship on the Religion move beyond this early misstep. The discovery of mouse embryonic stem cells in 1981 transformed research in mammalian developmental biology and functional genomics. The subsequent generation of human pluripotent stem cells (PSCs) and the development of molecular reprogramming have opened unheralded avenues for drug discovery and cell replacement therapy. Here, I review the history of PSCs from the perspective that long‐term self‐renewal is a product of the in vitro signaling environment, rather than an intrinsic feature of embryos. I discuss the relationship between pluripotent states captured (...) in vitro to stages of epiblast in the embryo and suggest key considerations for evaluation of PSCs. A remaining fundamental challenge is to determine whether naïve pluripotency can be propagated from the broad range of mammals by exploiting common principles in gene regulatory architecture. The recurrent clashes between Dhaka University (DU) students and those from its seven affiliated colleges highlight deeper issues beyond mere administrative inefficiencies, pointing to a significant crisis of identity and governance. Central to this crisis is the duality within the faculty—DU professors rooted in academic autonomy versus BCS cadre teachers entrenched in civil service hierarchy, exacerbating tensions and undermining collaboration. For the students, the affiliation with DU has deepened feelings of alienation, as they are caught in a liminal status, neither (...) fully part of DU nor detached. The suggested "respectful separation" fails to address these underlying issues, making it a short-term solution at best. Serious reforms are needed to address both the identity crisis and the structural divides, possibly involving significant changes in administrative practices or reconsidering the educational role of these colleges. Addressing these challenges is crucial for stability in the educational framework and for the students' sense of belonging and recognition. (shrink)

To win this battle, humanity needs innovations and non-linear thinking. Nature has long been a substantial information source for unthinkable discoveries that save human lives. The paper suggests that by understanding the nature, emergence, and mechanism of serendipity, the survival skill of humans, humanity can capitalize (...) on it to learn from nature and generate nature-based innovations that can address the climate and environmental degradation crises. In the era of Artificial Intelligence (AI) proliferation, AI will be a vital tool providing navigational and useful information to leverage the power of serendipity in climate and sustainability science. However, an eco-surplus culture that incorporates core values pertaining to nature and sees environmental sustainability as the conscience of the times needs to be built to direct and control the immense power of AI-leveraged serendipity. Managers tasked with organizational change often face irreconcilable demands on how to enact justice—situations we call _justice conundrums_. Drawing on interviews held with managers before and after a planned large-scale change, we identify specific conundrums and illustrate how managers grapple with these through three prototypical paths. Among our participants, the paths increasingly diverged over time, culminating in distinct career decisions. Based on our findings, we develop an integrative process model that illustrates how managers grapple with justice conundrums. Our contributions are (...) threefold. First, we elucidate three types of justice conundrums that managers may encounter when enacting justice in the context of planned organizational change (the justice intention-action gap, competing justice expectations, and the justice of care vs. managerial-strategic justice) and show how managers handle them differently. Second, drawing on the motivated cognition and moral disengagement literature, we illustrate how cognitive mechanisms coalesce to allow managers to soothe their moral (self-) concerns when grappling with these conundrums. Third, we show how motivated justice intentions ensuing from specific justice motives, moral emotions, and circles of moral regard predict the types of justice conundrums managers face and the paths they take to grapple with them.
