The article suggests that a distinction between ‘republicans’ and ‘democrats’ more usefully describes competing constitutional and economic reformers in Restoration France than the distinction between ‘ancients’ and ‘moderns’ made famous by Benjamin Constant. It shows that Constant’s description of Rousseau as an ‘ancient’, and the blaming of his political theory for the excesses of the 1790s, is historically questionable, and masks Constant’s broader aim of bringing into disrepute contemporary strategies for the moralization of politics and commerce. Such strategies are (...) evident in the writings of Jean-Baptiste Say, and reveal the profound divide between reformers who have traditionally been described as ‘liberals’. Say and Constant disagreed about the extent to which the people could be trusted to act as political agents, about the capacity of the state to make property relations more legitimate, about religion, and the relevance of the example of Britain to French economic and political reform projects. The writings of William H. Whyte do not loom large in the literature of my field: environmental ethics, the branch of ethics devoted to consideration of whether and how there are moral reasons for protecting non-human animals and the larger natural environment. Environmental ethics is a very new field of inquiry, only found in academic philosophy departments since the early 1970s. While there is no accepted reading list of indispensable literature in environmental ethics, certainly any attempt to create such a (...) list would begin with Henry David Thoreau, John Muir, Aldo Leopold, Rachel Carson, and a more recent handful of senior scholars who had been writing on these topics early on, such as J. Baird Callicott, Val Plumwood, Peter Singer, Richard Sylvan, Tom Regan, and Holmes Rolston III (for a review of contemporary environmental ethics, see Light 2002, Palmer 2003, and Wenz 2001). This brief essay contrasts two modes of constitutional change: abusive constitutional projects that seek to erode democracy and restorative constitutional projects that aim to repair eroded democratic constitutional orders. Constitutional democracies are eroded and restored via the same mechanisms: formal processes of constitutional amendment and replacement, legislative amendment, changes to executive policies and practices (or respect for conventions), and processes of judicial decision-making. Under the right conditions, abusive uses of these mechanisms for antidemocratic ends can be reversed by prodemocratic (...) or restorative uses. The more difficult question is what kinds of political discourses are most likely to sustain successful processes of democratic rebuilding. In recent work, we have pointed to the role sometimes played by liberal democratic discourses as purported justifications for processes of abusive constitutional change: we label this the rise of “abusive constitutional borrowing.” Less well understood are the kind of discourses likely to sustain successful democratic healing or rebuilding. Often, the most popular discourse is a restorative one, which focuses on repairing damage caused by authoritarians and returning to a constitutional status quo ante. In this essay, we discuss the advantages and disadvantages of restorative constitutionalism as a response to prior episodes of democratic erosion. (shrink)

Can Catharine Macaulay’s enlightenment, democratic, republicanism be justified from the point of view of contemporary naturalism? Naturalist accounts of political authority tend to be realist and pessimistic, foreclosing the possibility of enlightenment. Macaulay’s utopian political philosophy relies on belief in a good God, whose existence underpins the possibility of moral and political progress. This paper attempts a restoration of her optimistic utopianism, in a reconciliation, grounded in a revision of natural law, of naturalist and utopian attitudes to political (...) theory. It is proposed that the co-evolution of language, moral law, and conscience (the disposition to judge one’s own actions in the light of moral principles) can be explained as solutions to the kinds of tragedy of the commons situations facing our ancestors. Moral dispositions evolved, but, in the light of its function, law is subject to rational critique. Liberal democracy plausibly offers the best prospect for developing rationally justifiable law. This article examines the views of Burke, Tocqueville, and Marx on the nature and extent of modern revolution and its restorative logic. I argue that, while all three supported the introduction of changes in society, they differed on how to steer the course of such changes, which resulted in a peculiar meaning of modern revolution. Each of them proposed good and bad versions of modern revolution, offered specific ways of protecting the good versions from producing perverse effects, and warned against (...) the ugly consequences of a failed revolution. Burke’s conservative revolution favored incremental change against radical social transformations. Contra Burke, Tocqueville acclaimed the egalitarian tendency as a preordained path and advocated democratic revolutions insofar as political liberty could be rescued from the ills of social equality. Marx drew the possibilities of a proletarian revolution from the future the history of class conflicts had prepared. Particularly in his later works, Marx rejected Blanqui’s abortive version of conspiratorial revolution and social revolution without democratization. Overall, each of these thinkers—Burke, Tocqueville, and Marx—reconciled political and social revolutions in their own way, acknowledging that in order to prevent social and moral decay, modern revolutions inevitably gravitate to the Christian logic of restoration. The dubious relation of “subjective” experience to “objective” reality finds its correlate in the opposition we often suppose between culture and nature. Twentieth century theorists, most notably Freud, have claimed various methods for interpreting the illusions of one realm that hide the truths of the other. Ricœur has famously called the psychoanalytic method of dream interpretation a “hermeneutics of suspicion,” which he sees as a threat to the “mytho-poetic core of imagination.” John Dewey regarded the binary opposition between culture/nature as (...) particularly dubious, preferring to see them as reciprocal phases of a continuous process; if cultural life is an interpretation of the biophysical environment, that environment surely has its say. However, in the century since Freud, the tactics of suspicion have proven themselves to be indispensable for developing of critiques that reveal the subtle operations of anti-democratic ideologies, perhaps at the expense of democratic faith. This paper considers if there are less suspicious, more Deweyan possibilities for the interpreting and sharing of dreams, not for the benefit of the psychic health of the individual dreamer, but for the sake of a recovery of democratic life. ABSTRACT:Democracy—as a form of governance, a moral community, and a way of life—is under great stress. The prospects for democracy and bioethics are linked because bioethics relies on an open society and a democratic cultural environment in order to flourish. For its part, democracy can be restored and strengthened by widespread cultural and psychological support for the values of mutual recognition, equal dignity and respect for persons, and solidarity, interdependence, and the common good. Promoting values such as these is (...) in keeping with the founding vision of bioethics, which was a civic vision. At the present time, bioethics can and should continue to be a bioethics for democracy by engaging directly in civic learning and civic place-making. The Republic of Korea (Korea hereinafter) has been widely regarded as one of the most vigorous and analytically interesting third-wave democracies (Diamond and Shin, 2000: 1). During the first decade of democratic rule, Korea has successfully carried out a large number of electoral and other reforms to transform the institutions and procedures of military-authoritarian rule into those of a representative democracy. Unlike many of its counterparts in Latin America and elsewhere, Korea has fully restored civilian rule by extricating the (...) military from power. As is the case in established democracies of North America and Western Europe, free and competitive elections have been regularly held at all the different levels of the government. In the most recent presidential election, held in December 1997, Korea also established itself as a mature electoral democracy by elevating an opposition party to political power. Shame, shame management and reintegrative shaming feature in some restorative justice literature, and may have implications for schools. Restorative justice in schools is effective when perpetrators of wrong-doing can accept and take ownership of their wrongful acts, are appropriately remorseful, and seek to make amends. Shame may be understood as an ethical matter if it is regarded to arise because of the contradiction between the wrongful act and the individual’s sense of self and self-worth. Shame management (that is, seeking reintegrative (...) over stigmatising shaming) can be regarded to reflect a form of social responsibility as it contributes to community restoration by repairing ruptured social relationships. The notion of shaming and acknowledgement of harm thus assumes norms of acceptable community behaviour, attitudes and relationships, and is therefore also an ethical matter. Successful restorative practices in schools depend on the school-wide existence and practice of such norms, and mesh with virtues education, stimulated by the contemporary demand of many national curricula to promote so-called key competencies. Although the concepts of restorative justice and reintegrative shaming serve as a context for this article, its chief impetus was provided by an evaluative study of a group of New Zealand schools, in the course of which notions such as shame, reintegration and exclusion became evident. The chief purpose of this article is to consider and problematise shame from the perspective of the philosophy of education, and ask whether the concept of shame has a place in schools, whose important aims ought to include the development of democratic citizenship. The necessary starting point in an analysis of Yugoslavia is the level of development of self-management. The 1973 law on collective work, the goal of which was to contain growing technocratic tendencies in the enterprises, has disciplined the powers of the “work units,” the democratic cells which are directed from below (in practice, they are something similar to department assemblies) and which were supposed to provide the most authentic foundation for self-management. These productive units can be compared to Western (...) capitalist firms whose goal, as we know, it to strengthen control over production costs, increase economic efficiency, facilitate management and create a more congenial atmosphere for work. Ernesto Laclau and Chantal Mouffe’s post-Marxist analysis pushed Gramsci’s anti-determinism to its limits, embracing a post-structuralist, discourse-centred politics. Mouffe’s subsequent programme for radical democracy has sought a renewed democratic left project. While radical democracy’s post-structuralism enables important insights into political subjectivity and antagonism in contemporary democracies, it also weakens its own critical and strategic capacity. By recuperating its Gramscian heritage, radical democracy could be more theoretically and politically effective. In contrast to discourses operating in an entirely open and contingent (...) political field, Gramscian theory offers a more realist – but non-determinist – account of the structural, enabling and constraining properties of ideologies. It also allows for a distinctive institutional space for society. Society is the site upon which political identities are articulated, and from which existing power relations are challenged. But a conception of society also points to the institutional limits to politics, notable by their absence in post-structuralism and radical democracy. (shrink)

In recent years, artificial intelligence has been deployed by online platforms to prevent the upload of allegedly illegal content or to remove unwarranted expressions. These systems are trained to spot objectionable content and to remove it, block it, or filter it out before it is even uploaded. Artificial intelligence filters offer a robust approach to content moderation which is shaping the public sphere. This dramatic shift in norm setting and law enforcement is potentially game-changing for democracy. Artificial intelligence filters carry (...) censorial power, which could bypass traditional checks and balances secured by law. Their opaque and dynamic nature creates barriers to oversight, and conceals critical value choices and tradeoffs. Currently, we lack adequate tools to hold them accountable. This paper seeks to address this gap by introducing an adversarial procedure— – Contesting Algorithms. It proposes to deliberately introduce friction into the dominant removal systems governed by artificial intelligence. Algorithmic content moderation often seeks to optimize a single goal, such as removing copyright-infringing materials or blocking hate speech, while other values in the public interest, such as fair use or free speech, are often neglected. Contesting algorithms introduce an adversarial design which reflects conflicting values, and thereby may offer a check on dominant removal systems. Facilitating an adversarial intervention may promote democratic principles by keeping society in the loop. An adversarial public artificial intelligence system could enhance dynamic transparency, facilitate an alternative public articulation of social values using machine learning systems, and restore societal power to deliberate and determine social tradeoffs. Summary The article deals with the political thought of the young Spanish philosopher and intellectual, José Ortega y Gasset (1883?1955). The main aim is to examine to what extent his political thought was articulated in a systematic manner, and to understand if it was meant to be practically implemented. Ortega's political thought has been described as liberal on the one hand, and anti-democratic and conservative on the other. The disparities regarding Ortega's politics usually arise from his declarations, which aimed (...) to confront the changing social and political situation in Spain. To many researchers, these declarations seem incoherent, evolutionary, or ideas that can be directly deduced from the evolution of his philosophical theory. The extent to which Ortega's political theory was systematic will be understood through focusing on the role designed for the Spanish intellectuals in Ortega's declarations and works. Instead of considering his political thought in relation to either his philosophy or the political events and changing circumstances in Spain, I will attempt to examine how, during the years of his youth, his political declarations were always guided by a consistent feature with a practical political purpose: to challenge the Spanish intellectuals to promote social awareness of and reflection on the country's problems, and to consider potential solutions to these problems. The article deals with the legal acts which were adopted by the Supreme Council Reconstituting the Seimas of the Republic of Lithuania on 11 March 1990, and which are related to the restoration of the independent State of Lithuania. The author discloses the chronology of the legal acts adopted on that day and investigates why some particular act was adopted first, and only later another act was passed; he investigates the circumstances which determined the content of the legal acts (...) and shows the interconnection between these acts. The sequence and content of the legal acts of restoration of independence were determined by the fact that the independent State of Lithuania could not arise from the so-called “Lithuanian SSR” which had never been a form of Lithuanian statehood. The restoration of independence could and had to be grounded only upon the continuation of the pre-war Republic of Lithuania. One had to draw a boundary line between the Supreme Soviet of the Lithuanian SSR, which was elected in democratic and free elections on 24 February 1990, and which was a genuine representation of the Nation, from the former Supreme Soviets of the Lithuanian SSR—the essence and formation procedure of which was completely different. This was done by adopting the Declaration “On the Powers of the Supreme Soviet of the Lithuanian SSR” in which it was held that in the 24 February 1990 elections the Nation vested to the deputies of the Supreme Soviet of the Lithuanian SSR the mandate and the duty to restore the State of Lithuania and express the sovereign will of the Nation through this body, which, from 11 March 1990, 6 p.m., would be referred to as the Supreme Council of Lithuania. Although many phrases are invoked to describe the precarity of democracy today, perhaps none resonates more than "post-truth." The rapid rise of disinformation, conspiracy theories, and the loss of confidence in the possibility of impartial evidence has led to a situation in which highly partisan opinions threaten to devolve into a state where no one believes anything anymore. In the face of this danger, it seems imperative to affirm the existence of objective Truth. However, falling prey to the ideal of (...) Truth is as dangerous for democracy as being truth denialists. In this book, political theorist Linda M. G. Zerilli considers what happens when we take seriously the Socratic idea that there is truth in opinion. Drawing on the work of Arendt, Foucault, and Wittgenstein, A Democratic Theory of Truth critically interrogates the concept of truth presupposed in the "post-truth" debate. Whatever their disagreements, the critical literature on post-truth sees in the ongoing hemorrhaging of objective facts to subjective opinion a genuinely new threat to democracy. In Zerilli's reading, the part played by citizen subjects in determining the existence or value of truth is given in the structure of truth itself. Most people do not want to think very hard, and some lack the capacity to do so. Many make decisions on the basis of narrow (...) self-interest, and most lack vision. Given that this is so, it is not surprising that Athenian democracy has come in for a good deal of criticism. What is striking about this criticism, however, is its origins in the writings of Athens' own intellectuals. In this carefully argued and beautifully written book Josiah Ober explores in depth the critiques of democracy in several texts of the fifth and fourth centuries. His theses are several and extend from the centrality of the democracy debate in Athenian intellectual life to the interactive relationship between Greek history and contemporary political writing: the obvious contrast between the bloodthirstiness of the Thirty and the restraint shown by the restored democracy, he contends, mandated that analysis of democracy and its flaws become increasingly sophisticated and in some cases downright labyrinthine. The core of the book, however, is not what Ober sees as sociological analyses of Athenian democracy--the early work of the so-called Old Oligarch and the late work of Aristotle--but rather those critiques that focused, he suggests, on the Athenians' preoccupation with words, and on their efficacy as Austinian "speech acts." It is the middle chapters, tied together by the thread of this preoccupation, that are the most ingenious.Since the logos/ergon relationship is, I would suggest, more nuanced in Thucydides' work than in that of the other authors Ober examines, I leave discussion of it for last and begin with the chapter on Aristophanes' Ecclesiazusae. This chapter offers an exciting reading of the play, one in which the potentially trendy Austinian speech-act theory proves an excellent tool of analysis. Like most readers of the play, Ober sees Aristophanes raising the question whether "the attributes essential for the exercise of citizenship" were "unique to Athenian biological males" (135); what is distinctive about his approach is the emphasis on questions that the playwright raises about the relationship of speech to reality. Can words create equality? This is the question, Ober argues, to which Aristophanes is directing his democratic audience's attention. Are there limits to the sociopolitical realities that the Assembly can enact? Does saying make it so? To what extent are notions of male and female fixed by nonverbal physis, and to what degree are they social constructions made by spoken (and [End Page 479] then written) psephismata? Could a decree of the Assembly create female participatory citizens in the way it could create a state of war? (Questions, of course, do not presuppose answers, and in this respect Aristophanes remains maddening to classicists trying to reconstruct the political views of this important thinker on the Athenian scene.)Moving ahead to Plato, Ober explores the word/fact nexus in the Apology, Crito, Gorgias, and the Republic. Americans today are far less likely to trust their institutions, and each other, than in decades past. This collapse in social and political trust arguably fuels our increasingly ferocious ideological conflicts and hardened partisanship. Many believe that our previously high levels of trust and bipartisanship were a pleasant anomaly and that we now live under the historic norm. Seen this way, politics itself is nothing more than a power struggle between groups with irreconcilable aims: contemporary American politics is war because (...) political life as such is war. -/- Must Politics Be War? argues that our shared liberal democratic institutions have the unique capacity to sustain social and political trust between diverse persons. In succinct, convincing prose, Kevin Vallier argues that constitutional rights and democratic governance prevent any one ideology or faith from dominating all others, thereby protecting each person's freedom to live according to her values and principles. Illiberal arrangements, where one group's ideology or faith reigns, turn those who disagree into unwilling subversives, persons with little reason to trust their regime or to be trustworthy in obeying it. Liberal arrangements, in contrast, incentivize trust and trustworthiness because they allow people with diverse and divergent ends to act with conviction. Those with opposing viewpoints become trustworthy because they can obey the rules of their society without acting against their ideals. Therefore, as Vallier illuminates, a liberal society is one at moral peace with a politics that is not war. (shrink)

Is there a principled way to understand what liberal democratic states owe, as a matter of justice, to the victims of disasters? This article shows what is normatively special and distinctive about disasters and argues for the view that there are substantial duties of justice for liberal democratic states. The article rejects both a libertarian and a utilitarian approach to this question and, based on broadly Rawlsian principles, argues for a ‘political definition’ of disasters that is concerned with (...) the restoration of citizens' dignity and their capacities for effective citizenship. This stimulating volume considers whether the Founding Fathers' vision of the American democratic republic has been transformed and if so, in what ways. Krason looks to the basic principles of the Founding Fathers, then discusses changes that resulted from evolving contemporary attitudes about and approaches to government. He considers how contemporary law and public policy might be reshaped in accordance with the religious principles and cultural norms of the eighteenth century and earlier. Krason's exploration of the possibilities of (...) class='Hi'>restoration is fashioned with reference to philosophical principles and the thought of great Western political thinkers. He offers a variety of modest proposals that could begin to forge a foundation for restoration. His analysis proceeds with full awareness that the American political order grew out of a heritage rather than being invented. It is evident that any attempt to revive the Founders' thinking about the principles and conditions necessary to sustain a democratic republic must start in the public sphere. Krason focuses on concerned, public-spirited citizens who are aware of the extent to which our current political structures deviate from the vision of the Founders, and who see this as a problem and want to do something about it. Ultimately, a democratic republic can exist, be sustained, and flourish only when there is a deep commitment to it in the minds and norms of its people. Social reintegration of self-demobilised child combatants can be seriously imperilled by the lack of accountability for human rights violations allegedly carried out during their soldiering life and the failure to pursue reconciliation with their respective communities. This paper examines the circumstances leading young soldiers to voluntarily exit armed groups and militias and the extent to which resettling in the community can be facilitated by restorative justice mechanisms. The findings suggest a large support by war-affected communities for restorative justice peacemaking circles (...) as potential accountability and reconciliation measures to help reintegrate self-demobilised soldiers into society. These results were obtained from interviews, focus group discussions and descriptive statistics in which 1447 respondents participated. These included young ex-soldiers, students, educators, government official, members on NGOs, traditional leaders and councils, Security Services, and the Police. The inquiry was conducted between 3 May and 17 December 2014 in North Kivu Province, Democratic Republic of Congo. (shrink)

The abandoment of the use of local natural resources has caused serious ecological degradation in some parts of the world. Such situations highlight the importance of a democratic approach to the revitalization of commons. According to traditional systems of resource management, a clear boundary should be set between users and non-users: a closed community has been regarded as the basis for appropriate governance of resources. To the contrary, when restoring commons, it is more important to create an open platform (...) that gathers people from various backgrounds and generations and to consider together possible means for sustainable resource governance. In terms of field research in environmental restoration conducted on Sado Island, Japan, there are three conditions that need to be stressed in the process of establishing a collaborative platform: accepting a variety of participants, maintaining a fair and neutral stance, and respecting various sorts of knowledge. In addition to these conditions, cultivating the ability to engage in adaptive rule making is crucial to the realization of an autonomous community for sustainable resource governance. (shrink)

In societies like Bosnia or Rwanda, deep divisions along ethnic and religious lines and the legacy of years of atrocities and violence pose serious challenges to liberal forms of consensus. People do not recognise themselves asmembers of a political community, and identity politics is pursued at the expense of liberal democratic projects and reconciliation programmes. This book explores the nature and role of civil society in deeply divided societies. Civil society is presented here as the spherewhere a shared 'culture (...) of civility' emerges. The 'culture of civility' enables individuals to become part of a community of citizens and accept to reciprocate on the basis of some basic universal values, such as the protection of human dignity. The last chapter on Bosnia shows that relevance of civil society crucially depends on its capacity to represent the sphere where individuals are able to recognize and deal with transitional issues by appealing to the Bosnian 'culture of civility' and developing a sense of justice based on a shared understanding of the idea of human dignity. This study analyzes the ideals of responsibility and accountability, asking such questions as when it is legitimate to blame top officials of an organization for mistakes made by personnel below them in the bureaucratic hierarchy; when things go wrong in a large and complex organization like the Canadian Forces, who is responsible and accountable; and whether a plea of ignorance is a good excuse. The study also analyzes the doctrine of ministerial responsibility in both the British and Canadian parliamentary traditions, (...) asking whether it is realistic to expect that a government minister should be held responsible for everything that goes wrong in his/her department. Finally, traditional military values are examined, considering the kinds of attitudes and values expected from Canada's armed forces and the differences between the military and civilian sectors. Marxism as a normative position is critical of liberalism. However, the problems of justice and alienation that Marxism draws attention to can be solved by liberalism without the implementation of a Marxist political project. The purpose of the article is to substantiate the thesis that Martha Nussbaum's capabilities approach (one of the versions of political liberalism) is a more inclusive and rational method of theorizing about the basic principles of justice than Marxism. "democratic equality", I show that some of Marxist approaches that (1) do not deny the existence of justice and (2) are concerned with the problem of alienation, can apply the arsenal of the moral theory of political liberalism to solve these problems. I also criticize Rawls's and Nussbaum's theories of political liberalism for their procedural vagueness and non-inclusive theory of justice. I present an outline of my position, which I propose to call «extended political liberalism» (hereafter EPL). EPL is currently represented by two arguments: 1) the paideia argument and 2) the argument of the interdependence of the good and the right. The first allows talking about the actual implementation of basic rights and freedoms only when citizens are aware of them and have the opportunity to change their views regarding the personal conception of the good. This is impossible without qualitative basic education. Also, one of the central concepts of EPL is presented within the framework of Paideia's argument - the interpretation of the political conception of justice. Because of this concept, it makes sense to talk about the possibility of citizens' reflection on the reconciliation of the current political conception with the personal conception of the good. This can also be done through the analysis of other conceptions of the good. The second argument is a continuation of the first, appearing as a theoretical mechanism that allows supplementing the existing political conception in case of serious social changes. In conclusion, if we take into account the advantages of the capabilities approach and my criticism of its weaknesses, then a theoretical position will emerge that is quite acceptable to some representatives of Marxism. Moreover, the latter will not have to give up their basic beliefs. The peculiarity of my concept presented in this text is that it is not so much a critique of Marxism as an analysis of the basic normative judgments of political liberalism, with which some Marxists can agree. With this article, I also want to illustrate the strengths of such a concept and point to its prospects for further attempts to interpret the political conception by other normative positions. Within the current debates about Euro‐constitutionalism, the conventional options are either to defend a vision of the European Union (EU) which separates global economic law from national sovereignty, and thus relies on the legitimizing powers of free markets, or to regard the legitimation problem (at least under current conditions) as beyond solution: This view argues that any further progress towards an ever closer Union would inevitably increase the legitimation deficit and that therefore the capacity for political action of the nation (...) state should be protected or restored. This paper seeks to break the stranglehold of the, as is argued, false dichotomy (global markets vs. national democracy), and it argues that an extension of democracy beyond the nation state is possible. This paper addresses the reception of Hegel’s philosophy in Argentina from an exploratory point of view. For this, it offers a preliminary state of the art in which the sources and materials for a study of this type are determined, and a periodization of the reception is proposed that includes the following periods: 1) from the 19th century to the Argentine University Reform of 1918, the time of Hegel’s indirect presence; 2) from 1918 to the First National Congress of Philosophy (...) in 1949, the true beginning of the reception of Hegel; 3) from 1949 to 1982/83, a period of dispute between the existentialist, Marxist, theological and Peronist interpretations of Hegel; and 4) from the democratic restoration to the present, when an institutional consolidation of Hegelian Studies is perceived in the country. As first conclusions, the federal character of the reception of Hegel’s philosophy and the two main moments of the institutionalization of Hegelian Studies in 1931 and 1983 stand out. The first one, in the context of the anti-positivist reaction and the vindication of German philosophy, and the second one, in the framework of the stabilization of academic activity due to the democratic transition. Focusing democratic theory on the pressing issue of punishment, Punishment, Participatory Democracy, and the Jury argues for participatory institutional designs as antidotes to the American penal state. Citizen action in institutions like the jury and restorative justice programs can foster the attunement, reflectiveness, and full-bodied communication needed as foundations for widespread civic responsibility for criminal justice.

Democratic conceptions of politics are tacitly or explicitly predicated upon a functioning arena for the formation of public opinion in an associated media-space. Policy-making thus requires a reliable connection to processes of ‘public’ will formation. These processes formed the focus for Habermas’s influential study on the public sphere. This contribution presents a look at more recent ‘structural transformation’, the causes of which are by no means limited to social media communication, and examines its consequences. It proceeds in three steps: (...) 1) in some proximity to Habermas, but also by means of the theory of resonance, it seeks to determine the kind of public sphere that a democratic polity requires; 2) an analysis of problems within the contemporary public sphere will feed into 3) a discussion of the conditions for the restoration of a ‘functioning political public sphere’. The Yazidi community is one of the largest minority groups in Iraq, who have suffered the most. They have been subjected to marginalization and trauma for decades, which has not been documented adequately in the past. The study adopted a descriptive exploratory research to collect and investigate historical evidence regarding the marginalization and traumatic experience of the Yazidi minority in Iraq and explore whether the western secularism could be helpful in achieving restorative justice and rehabilitation. Through the study of available (...) data in interdisciplinary sources, an attempt was made to fill the literature gap. The current study perceived whether the western so-called secularism could be effective in bringing reconciliation of the Yazidi minority with the Government of Iraq and the KRG. The study also found out that the Yazidi community does not need a European-style revolutionary and atheistic secularism which does not recognize any social, religious or political affiliation in the name of democratic principles. What the Yazidi community needs is a region specific, US-led political-religious initiative, equipped with principles of non-violence, peaceful coexistence, justice, and accessibility to equal human rights and a shared vision along with the majority of the Iraqi population and recognition by the KRG, failing which the Yezidi will continue to be considering themselves as a separate ethnic group and represent as the failure of western secularism. Building, restoring and maintaining well-placed trust between scientists and the public is a difficult yet crucial social task requiring the successful cooperation of various social actors and institutions. Kitcher’s takes up this challenge in the context of liberal democratic societies by extending his ideal model of “well-ordered science” that he had originally formulated in his. However, Kitcher nowhere offers an explicit account of what it means for the public to invest epistemic trust in science. Yet in order to understand (...) how his extended model and its implementation in the actual world address the problem of trust as well as to evaluate it critically, an explicit account of epistemic public trust in science needs to be given first. In this article we first present such an account and then scrutinize his project of building public trust in science in light of it. We argue that even though Kitcher’s ideal model and his proposals for its implementation in the real world face a number of problems, they can be addressed with the resources of our account. The ArgumentIn the liberal democratic capitalist societies of “the West,” psychological know-how has made itself indispensable, not only in the regulation of domains from the factory to the family but also in the ethical systems according to which citizens live their lives. We cannot fully understand the role that psychology has come to play in terms of the application of science, the diffusion of ideas, or the entrepreneurial activities of a profession. Rather, we need to see psychology as making (...) possible forms of expertise that have a particular capacity to graft themselves onto the practices of all those concerned with the conduct of conduct. Psychology operates within these practices to make individuals who are calculable, to make intersubjective spaces that are manageable, to simplify the heterogeneous tasks of authorities and to underpin them with an ethico-therapeutic rationale. Psychology has also come to infuse contemporary “technologies of the self,” with its promises to restore persons to freedom and autonomy. These features of the “techne” of psychology are intrinsically linked to the problematics of liberal democracies, which seek to govern through privacy, rationality, and autonomy. And if the expert technologies of psychology have come to play such a significant role in the regulation of conduct in the West, we should not be surprised if psychological expertise is a beneficiary of current transformations of the societies of Eastern Europe. Democracy has been hailed as a global phenomenon and the most popular feature of modern political thought. Several notable efforts have been made by the global community to promote and extend democracy to cover billions of people, with their varying histories, cultures, and disparate levels of affluence. In 2007, the United Nations General Assembly resolved to support the efforts of governments to promote and consolidate new or restored democracies. The GA in this regard stated that “democracy is a universal value (...) based on the freely expressed will of people to determine their own political, economic, social and cultural systems and their full participation in all aspects of their lives. Also, while democracies share common features, there is no single model of democracy, and that democracy does not belong to any country or region, reaffirming further the necessity of due respect for sovereignty, the right to self-determination, and territorial integrity. In 2005, the United Nations Democracy Fund was created to implement projects aimed at enhancing democratic practice, promoting human rights, and encouraging participation of all groups in democratic processes. In contrast to its growing popularity, democracy has also been closely looked at with suspicion by experts- academic, political, and otherwise. Skeptics assert that “ the meaning of democracy is contested with no universal definition that is applicable.”. (shrink)

The British political theorist and architect Arthur J. Penty (1875-1937) is today remembered as the co-originator of ‘post-industrialism’ and as the first guild socialist. His writings evince a lifelong aversion to the evils of commercial society, as well as an intense appreciation for Medieval life. Yet Penty's conservative tendencies belie his attentiveness to what Harold Perkin would call ‘professional society.’ Though he abhorred capitalism, Penty believed in assigning status to workers on the basis of social function and technical expertise. Most (...) surprisingly, given his reputation, he held that the guarantee of such status represented the first step towards a more democratic society. This essay accordingly recasts Penty as a political theorist of the professions. It does so through the analysis of not only his core interventions in political theory, but also his lesser-known trade writings. The first section focuses on Penty's early life and context. The second explains his historical understanding of architectural decline through his contrasting narratives of Classical and Gothic aesthetics. The third section outlines his theory of how to restore democratic architecture in modernity. The fourth section comments on Penty's larger significance in the history of ideas at a time of increasing populist references to ‘traditional’ aesthetics. (shrink)

In the second half of the 80s of the twentieth century communist omnipotence that prevailed in the Soviet Union during the seventy years put the country regularly in the framework of the system of social and economic crisis. In making efforts to keep the pro-government monopoly the Central Commitee of CPSU dares to introduce redecorating of the economic mechanism of the Soviet Union in implementing the policy of acceleration. However, its negative results made the Communist Party elite resort to deepen (...) innovations and apply reforms in the political system of the Soviet Union, known at that time as reconstruction perestroika. Having caused the general public democratization, it called to a policy of openness, which brought out the numerous communist crimes of the past decades that greatly weakened the Communist Party regime. This led to the revival of democracy, and eventually the national liberation movement in the western regions of the USSR, especially in Halychyna and its components - the Pre-Carpathians, where the state-forming bases have deep historical roots. The speaking trumpet of establishment of the communist regime was the Communist Party press, which in this period has launched a massive advertising campaign for undeniable expediency of reconstructive innovations. However, the rapid growth of the national liberation movement led openly to opposing the Communist Party media at all levels, trying to stop a national renaissance in Pre-Carpathians. The opposing range included both promotional measurements and intimidation pressure of power structures. The opposition at that time consisted of illegal anticommunistic publications and periodicals of newly appeared Soviet institutions. Objectively covering events they were promoters of striving patriotic-oriented public of the land to restore the state independence of Ukraine. (shrink)

This clause, absent (...) from earlier editions, while implicating the comic cowardice of the narrator also adumbrates a tragic sense of prudence. In the early years of the sixteenth century, not just Rabelais but the rest of his Renaissance world had come increasingly to know the heavy hand of censorship and persecution. Bookburning, of course, had lost its traditional source of terror with the invention of the printing press: no longer could a single bonfire extinguish all versions of a single manuscript. Instead, Church and State authorities had in the course of the Renaissance to invent new practices for controlling and regulating the circulation of dangerous words: bans on publication, excision of offensive passages prior to printing, indices of prohibited books, and so on. Written at a time, over half a century ago, when another wave of explicit attacks on writers shocked the intellectual world, Strauss’s essay, on the one hand, struck a hopeful chord by evoking the kinds of techniques available to writers in their efforts to evade or foil censorship, that is, by demonstrating that no censorship can fully succeed in terroristically bringing about an end to heterodox forms of expression. On the other hand, he posits at least the possibility for every text that it has an inexorable core that is esoteric. No censorship can be total, but there is also no such thing as a pristine state of letters prior to censorship. How has reason, believed since the Enlightenment to be the ally of freedom in the search for a better, more humanly satisfying world, been reduced to a technical rationality that has actually impoverished the bases of human freedom? What might be the options and obligations for sociologists who wish to restore reason to its proper status? -/- Working within the tradition of C. Wright Mills and Jurgen Habermas, Frank Hearn sets out to answer these questions. The review of activity of local governments of Leningrad on the solution of social problems is presented in article in the period of the Great Patriotic War and restoration of municipal economy during the post-war period. The considerable attention is paid to questions of ensuring activity of the population and the main directions of social policy. Consequences of the public regress caused by war, which detained for many decades development of the social sphere in the country, are not studied (...) yet. In this regard, the judgment of process of overcoming of these consequences, research of the principles of work, methods and forms of administrative activities for the organization of full-fledged life of citizens during the recovery post-war period and in the next decades is of special interest. Completion of World War II entailed changes in a control system of the country - as it is known, extraordinary bodies of authority and management of a wartime in the capital and on places were abolished. Management of restoration and maintenance of full functioning life support system of the cities and areas transferred to local governments of the Soviet power - to city and regional councils of deputies and their constantly operating executive committees. The role of the social sphere in modern conditions more and more increases in improvement of economy, development of democratic processes. The scientific analysis of activity of the central and local authorities for protection and providing the population in years of war and the post-war period gives more deep understanding of role and importance of social questions in life of society. It reveals historical experience of creation, development and implementation of effective mechanism of such activity, that experience is useful for modern management practice of state and local authorities. Hermann Heller’s critique of liberalism was both theoretical and conjunctural. He derided liberalism’s erosion of the concept of sovereignty and lamented liberalism’s complicity with the substantive inequality of his time. It its place, he argued for a restoration of the concept of popular sovereignty, as a dialectical formation of political unity and material equality through the democratic process. As a matter of political practice and strategy, however, Heller equivocated in his stance on the constitutional politics of the Weimar (...) Republic. He initially tolerated the abrogation of parliamentary democracy due to his faith in the neutrality of the state, before diagnosing the regime as a form of authoritarian liberalism determined by the capitalist economy. This article examines Heller’s theoretical and political critique of liberalism. It outlines Heller’s conception of popular sovereignty against both Kelsen’s legal rationalism and Schmitt’s political decisionism. It also examines the significance of the interwar conjuncture, highlighting that the turn of the bourgeoisie to authoritarianism and ultimately to fascism represented a continuity of the liberal elision of the principle of popular sovereignty. "The Federalist" is commonly read as an exemplar of political realism. However, alongside Publius' arguments against the enthusiastic imagination --its tendency to inflame the passions, betray the intellect, and subvert political authority--are formative appeals to the imagination 's role in reconstituting the public authority shaken during the postrevolutionary years. This essay explores three central aspects of Publius' restorative appeal to the imagination : the appeal to the public veneration required for sustaining political authority across time; the strategies for shifting citizen (...) loyalty from the state and local level to that of a newly energized federal government; and the rhetorical elicitation of the public's imagination in aestheticized portrayals of Providential nationality. These aspects of Publius' argument make up the core of "The Federalist's aesthetics of rule. In each instance, Publius invokes the imagination as a heteronomic support to navigate familiar dilemmas of democratic self-authorization. (shrink)

ABSTRACTThis article probes Jonathan Israel’s theory about ‘Radical Enlightenment’ inaugurating political modernity by way of explicating the thought of Joseph Priestley. In Israel’s view, despite the inconsistencies plaguing Socinian thought, Priestley, a monist, emerged as an ardent supporter of religious toleration and democratic republicanism. This article seeks to restore the fundamental coherence of Priestley’s theological and metaphysical views, arguing that they were produced as parts of a system founded on the simultaneous adherence to providentialism and necessitarianism. Prized as a (...) prerequisite of the unfolding of the divine plan, the unobstructed expression of religious opinions was the centre of the conception of civil society and civil liberty that Priestley articulated based on these premises and his forays into politics aimed to secure its permanence. A comparison of Priestley’s stance on the issue of manhood suffrage with that of Richard Price reveals not the materialist Priestley, but Price, a dualist, as an advocate of democratization and casts into doubt the applicability of Israel’s scheme in the case of England. The article closes with some suggestions towards reappraising the relationship between Enlightenment and modernity. (shrink)

To renowned Buddhologist Heinz Bechert, Buddhist modernism was a manifestation of religious revivalism applied to the context of post-colonial society, bearing the following features which are relevant for the current discussion, amongst others: (1) an emphasis on Buddhism as a philosophy, rather than a creed or a religion; (2) an emphasis on ‘activism’ and setting great store by social work; (3) the claim by modernists that Buddhism has always included a social component described as a philosophy of equality…and that a (...) Buddhist society must be democratic; (4) the emergence of Buddhist nationalism; (5) a strong tendency towards the reassertion of women’s rights in contemporary Buddhism and attempts and actions taken to restore the order of nuns; (6) the emergence of a new type of Buddhist syncretism, viz., the combination of various Buddhist traditions (comp. 213-214, Bechert’s Obituary, 2011). The paper discusses the reactions of different political and constitutional systems reactions to the pandemic and also the impact of COVID to populism, constitutionalism, and autocracy. Beyond the choice between economic and health considerations also applied in liberal democratic countries, which have lead either to “under-” or “overreaction” to the pandemic, certain illiberal regimes used the crisis situation as a pretext to strengthen the autocratic character of their systems. In some cases, this needed an “underreach,” like in Poland to (...) insist on the presidential election, which has been important to entrench the power of the governing party’s incumbent, elsewhere “overreach,” like in Hungary, where an unlimited emergency power of government has been introduced after the very first cases of contagion. These autocratic “overreactions” have breached the formerly used authoritarian legalistic approaches by openly violating their own illiberal constitutions. New “conservative” theories on “common good constitutionalism” emerged to legitimize the necessity of authoritative rule by the executive power. The paper concludes that one possibility to overcome authoritarian populism and restore constitutionalism in crisis situation such as the COVID-19 pandemic would be to rely on the involvement of the well informed public, one that is capable to understand and assess the advice of the meritocratic elite. This kind of participation would also help build up a constitutional culture necessary to preserve the values of constitutionalism. (shrink)

Amidst all the headlines about the Democrats gaining control of the United States Congress in the November elections, one big election result was largely ignored. Although it illuminated the flaws of America’s political system, it also restored my belief in the compassion of ordinary Americans.
