This article reports the findings of AI4People, an Atomium—EISMD initiative designed to lay the foundations for a “Good AI Society”. We introduce the core opportunities and risks of AI for society; present a synthesis of five ethical principles that should undergird its development and adoption; and offer 20 concrete recommendations—to assess, to develop, to incentivise, and to support good AI—which in some cases may be undertaken directly by national or supranational policy makers, while in others may be led by other (...) stakeholders. In this paper, it is argued that the most fruitful approach to developing normative models of argument quality is one that combines the argumentation scheme approach with Bayesian argumentation. Three sample argumentation schemes from the literature are discussed: the argument from sign, the argument from expert opinion, and the appeal to popular opinion. Limitations of the scheme-based treatment of these argument forms are identified and it is shown how a Bayesian perspective may help to overcome these. ABSTRACT:The UN Framework on Human Rights and Business comprises the State’s duty to protect human rights, the corporate responsibility to respect human rights, and the duty to remedy abuses. This paper focuses on the corporate responsibility to respect. It considers how to overcome obstacles, arising out of national and international law, to the development of a legally binding corporate duty to respect human rights. It is argued that the notion of human rights due diligence will lead to the creation (...) of binding legal duties and that principles of corporate and tort law can be adapted to this end. Furthermore, recent legal developments accept an “enlightened shareholder value” approach allowing corporate managers to consider human rights issues when making decisions. The responsibility to respect involves adaptation of shareholder based corporate governance towards a more stakeholder oriented approach and could lead to the development of a new, stakeholder based, corporate model. The pragmatic framework developed by H.P. Grice in “Logic and Conversation” explains how a speaker can mean something more than, or different from, the conventional meaning of the sentence she utters. But it has been argued that the framework cannot give a similar explanation for cases where these pragmatic effects impact the understood content of an embedded clause, such as the antecedent of a conditional, a clausal disjunct, or the clausal complement of a verb. In this paper, I (...) show that such an explanation is available. One of the central arguments of the paper is that in a significant subset of cases, local pragmatic effects are a consequence of a global pragmatic requirement. In these cases, local pragmatic effects are a consequence of ‘acting locally’ to resolve a potential global pragmatic violation. These cases do not require us to posit application of pragmatic principles to the contents of embedded clauses. The account does, though, require the assumption that interpreters can identify and reason about the contents of unasserted sub-parts of sentences, an assumption that I motivate in section 3. Building on this, in section 4 of the paper, I argue that once we have recognized that interpreters can, and do, reason independently about the contents of non-asserted clauses, it becomes unproblematic to assume that in some cases, Gricean conversational principles do apply directly to these contents, providing an alternative route to account for local pragmatic effects. In revisiting the ideas of this paper in my response to the commentaries, I consider in more detail the revisions to Grice’s broader program that are necessitated by these moves, in particular acknowledging the problematicity of Grice’s notion of what is said. I argue that the starting point for Gricean reconstructions should instead be merely what is expressed, which carries no pragmatic commitments regarding what is speaker meant. (shrink)

In this paper we address the issue of how to think about immunity. Many immunological writings suggest a straightforward option: the view that the immune system is primarily a system of defense, which naturally invites the talk of strong immunity and strong immune response. Despite their undisputable positive role in immunology, such metaphors can also pose a risk of establishing a narrow perspective, omitting from consideration phenomena that do not neatly fit those powerful metaphors. Building on this analysis, we argue (...) two things. First, we argue that the immune system is involved not only in defense. Second, by disentangling various possible meanings of ‘strength’ and ‘weakness’ in immunology, we also argue that such a construal of immunity generally contributes to the distortion of the overall picture of what the immune system is, what it does, and why it sometimes fails. Instead, we propose to understand the nature of the immune system in terms of contextuality, regulation, and trade-offs. We suggest that our approach provides lessons for a general understanding of the organizing principles of the immune system in health and disease. For all this to work, we discuss a wide range of immunological phenomena. (shrink)

Research on the concept of affordance generated different interpretations, which are due to different stories aimed at describing how this notion accounts for visually guided motor behaviors. On the one hand, _dispositional accounts of affordances_ explain how affordances emerge from the encounter of the agent’s perceptual-motor skills, with an object offering possible interactions, as _behavioral dispositional properties_. On the other hand, _cognitive neuroscience_ explains what neural mechanisms are required for agents to detect affordances, resulting from an internal _processing_. As the (...) literature recognized, it would be beneficial to connect these two stories. We propose an important step into this connection, showing how a _dispositional notion_ of affordance can be distinguished into two versions, the _Dispositional Account of Nomological Affordance Response_ and the _Dispositional Account of Probable Affordance Response_, and how to complement different aspects of _visuomotor processing_ for affordance extraction, discussed in _neuroscience_, with them. An important benefit of our proposal is that it suggests, for the first time, that we should not prefer one _dispositional_ account at the expense of the other. Indeed, we show that different _dispositional_ accounts can capture distinct aspects of the plethora of complex manifestations, at the neurocognitive level of visuomotor-processing, that affordances can display in humans, both in healthy and pathological subjects. A simple tool is provided to assist researchers in assessing contributions to a scientific publication, for ease in evaluating which contributors qualify for authorship, and in what order the authors should be listed. The tool identifies four phases of activity leading to a publication—Conception and Design, Data Acquisition, Analysis and Interpretation, and Manuscript Preparation. By comparing a project participant’s contribution in a given phase to several specified thresholds, a score of up to five points can be assigned; the contributor’s scores (...) in all four phases are summed to yield a total “contribution score”, which is compared to a threshold to determine which contributors merit authorship. The European Medical Information Framework project, funded through the IMI programme, has designed and implemented a federated platform to connect health data from a variety of sources across Europe, to facilitate large scale clinical and life sciences research. It enables approved users to analyse securely multiple, diverse, data via a single portal, thereby mediating research opportunities across a large quantity of research data. EMIF developed a code of practice to ensure the privacy protection of data subjects, protect the interests (...) of data sharing parties, comply with legislation and various organisational policies on data protection, uphold best practices in the protection of personal privacy and information governance, and eventually promote these best practices more widely. EMIF convened an Ethics Advisory Board, to provide feedback on its approach, platform, and the EcoP. The most important challenges the ECoP team faced were: how to define, control and monitor the purposes for which federated health data are used; the kinds of organisation that should be permitted to conduct permitted research; and how to monitor this. This manuscript explores those issues, offering the combined insights of the EAB and EMIF core ECoP team. For some issues, a consensus on how to approach them is proposed. For other issues, a singular approach may be premature but the challenges are summarised to help the community to debate the topic further. Arguably, the issues and their analyses have application beyond EMIF, to many research infrastructures connected to health data sources. (shrink)

Appeals to the miraculous are common in healthcare, and arguments about end-of-life decision-making can quickly become theological. Assessments of hope have been recommended within the biopsychosocialspiritual model of medicine, but these assessments fail to account for the theological dimension of hope. Examples of failed assessments include recent efforts in palliative care and classic works, such as On Death and Dying by Elisabeth Kübler-Ross. In this empirical paper, we present a model of the dynamic legitimizing processes involved in the receiving and giving of compassion. We focus on the idea of being ‘worthy of compassion’ and show how ideas on giving and receiving compassion are highly contestable. Recognition of a worthy recipient or giver of compassion constitutes a socially recognized claim to privilege, which has ethical managerial and organizational implications. We offer a model that assists managers in fostering ethical strength in their performance by (...) encouraging reflection on the ethical complexity involved in compassion relations. The model emphasizes the dynamics of both the givers and receivers of compassion and so can also be used by organizations to both assess how others may view the legitimacy of their compassion relations and also to develop a positive organizational ethic of compassionate conduct. Nursing is frequently described as practical or pragmatic and there are many parallels between nursing and pragmatism, the school of thought. Pragmatism is often glancingly referenced by nursing authors, but few have conducted in-depth discussions about its applicability to nursing; and few have identified it as a significant theoretical basis for nursing research. William James's pragmatism has not been discussed substantially in the nursing context, despite obvious complementarities. James's theme of pluralism fits with nursing's diversity and plurality; his emphasis on (...) social conscience in our actions matches nursing's fundamental purpose of improving the lives of others; his continuous testing of pluralistic truths in critically reflective practice pairs well with nursing's focus on developing best-available, holistic evidence; and his conceptualization of truth as being born in practice and becoming an instrument in practice is entirely compatible with nursing's theory–practice identity. The oft-discussed theory–practice gap is seen to hinder the development of nursing knowledge. If nursing is to find its identity in knowledge development and potentiate the knowledge developed, it is imperative to identify and address that which is impeding progress. By way of the pragmatic tenets of William James, I will argue that a significant part of the theory–practice gap lies in how nursing knowledge development is operationalized, creating a false dichotomy between practice and research. I will also argue that the research–practice schism has been widened by continued philosophical and methodological infighting in the research community. I will describe how Jamesian pragmatism can be 'what works' for rebuilding relationships and supporting an engaged plurality within nursing research and bring research and practice together into a collaborative and iterative process of developing nursing knowledge. Because previous scholars have offered few comprehensive models to understand the benefits of corporate social responsibility image in terms of customer behaviour, the authors of this paper propose a hierarchy of effects model to study how customer perceptions of the social responsibility of companies influence customer affective and conative responses in a service context. The authors test a structural equation model using information collected directly from 1,124 customers of banking services in Spain. The findings demonstrate that corporate social responsibility image (...) influences customer identification with the company, the emotions evoked by the company and satisfaction positively. Identification also influences the emotions generated by the service performance and customer satisfaction determines loyalty behaviour. The findings have significant implications for service managers because they demonstrate that there are two paths to explain the satisfaction and loyalty of service customers. The first path is composed of the beliefs and emotions generated by the company at the institutional level. The second path is composed of the thoughts, attitudes, emotions and feelings generated by the company’s services. (shrink)

This paper concerns an information extraction process for building a dynamic legislation network from legal documents. Unlike supervised learning approaches which require additional calculations, the idea here is to apply information extraction methodologies by identifying distinct expressions in legal text in order to extract network information. The study highlights the importance of data accuracy in network analysis and improves approximate string matching techniques to produce reliable network data-sets with more than 98% precision and recall. The goal of this article is to offer a new model for the study of ocularization in film grounded in the semiotic pragmatism of Charles Sanders Peirce. We first present a literature overview addressing the state of research regarding the theorization of ocularization in film studies. Second, we discuss Peirce’s three universal categories (Firstness, Secondness, and Thirdness) on which our model will be based. Third, we argue how the theme of ocularization in film, as outlined in the first part, can (...) be theorized anew through these categories. This will result in the introduction of a nine-field matrix that will allow us to systemize all kinds of instances of subjectivity in cinema. Lastly, we will demonstrate the empirical usefulness of this model by illustrating each of the matrix’ nine categories through a discussion of Steven Soderbergh’s film Kimi (2022). (shrink)

The integrity of the patient–physician relationship depends on maintaining professional boundaries. While ethicists and professional organisations have devoted significant consideration to the subject of sexual boundary transgressions, the subject of non-sexual boundaries, especially outside the mental health setting, has been largely neglected. While professional organisations may offer guidance on specific subjects, such as accepting gifts or treating relatives, as well as general guidance on transparency and conflict of interest, what is missing is a principle-based method that providers can use to (...) assess non-sexual interactions with patients that transcend norms of practice. This paper attempts to offer an operational model for such assessment that considers not only the traditional emphasis on beneficence, but also incorporates concerns over entanglement and concordance. We provide a conceptual framework and a case study of how an organization links its mission and espoused values with its operating practices. Conceptually, we locate this mission integration theme within Simons’ management accounting and control framework, and then adapt Schatzki’s site ontology of social practice to develop general research expectations for case studies of espoused values/practice linkages. Empirically, we apply the conceptual framework to a case study of linkages among an actual company’s espoused values, human resource (...) practices, and financial management during its 40-plus year history. Douglas Husak contends that both criminalization and punishment can serve preventive goals, so long as they respect retributive culpability constraints. This Essay draws on Husak’s work to argue that, while Husak is right to defend the legitimacy of criminal law as a preventive endeavor, preventive coercion is also permissible on consequentialist grounds alone, outside the culpability constraints of the criminal law. The Essay presents a unified consequentialist theory of preventive coercion, addresses deontological objections to ‘pure’ preventive detention, and argues that (...) a consequentialist approach to prevention might ultimately be more protective of liberty and equality interests than the deontological ‘mad or bad’ approach that currently dominates Anglo-American jurisprudence and legal theory.
