In recent years, the Minnesota Attorney General’s Office and the Minnesota Department of Health have cultivated a productive partnership to strengthen the state’s multidisciplinary response to overlapping health equity and social justice issues. This article describes shared efforts in three areas: post-conviction justice, drug overdose, and human trafficking/exploitation.

Hamilton (bio)For most of the 1980s, the specter of scientific fraud popped into public view every few years, usually only to submerge again. Faced with several well-publicized cases of scientists who blatantly faked their data—among the best-known being Harvard cardiologist John Darsee (whose colleagues watched him forge data) (Broad and Wade 1982, p. 14) and Sloan-Kettering Institute immunologist William Summerlin (who painted black (...) spots on white mice to simulate tissue grafts) (Broad and Wade 1982, p. 155)—the scientific community as a whole tended to dismiss the phenomenon as the work of a few deviants. Called in 1981 to testify before then-Representative Albert Gore Jr.'s subcommittee on investigations and oversight, Philip Handler, then-president of the National Academy of Sciences, told the panel that science was perfectly capable of regulating itself, and that the problem of scientific fraud had been "grossly exaggerated" by the press (Broad and Wade 1982). The message was clear: Congress should stick to its knitting, and science would take care of itself.Now, however, scientists are faced with a very different situation: a permanent federal bureaucracy, known as the Office of Scientific Integrity (OSI), devoted to the investigation of alleged scientific wrongdoing. The transition from the days of laissez-faire, when universities were entrusted with all investigations unless they were handled so badly that the federal government was forced to take notice, has been an uncomfortable one for many researchers. Lately, this discomfort has taken shape as a vocal protest against OSI. Largely as a result of this protest, federal officials recently promoted a plan to restructure OSI and change some of its operating procedures, a move with unpredictable consequences for universities and researchers alike.OSI was born largely because of investigations by two influential congressmen: Representatives John Dingell of Michigan and Ted Weiss of New York. While both claimed they acted mainly to make sure taxpayer dollars were not spent on fraudulent research, both also maintained a strong interest in protecting "whistleblowers," the often vulnerable, and usually junior, scientists who first raise questions about bad research. And Dingell seemed to take special pleasure in pointing up the deficiencies of investigations run by universities and by the National Institutes of Health (NIH) itself. As a result, NIH, which funds most biomedical research in the United States, has held ultimate responsibility for most prominent cases of fraud.) Plagued as they often were by conflicts of interest, shoddy methodologies, and, in some cases, a willingness to believe any excuse by the accused, no matter how far-fetched, these investigations made easy targets. And the notion that science could "govern itself" grew harder to sustain.In late 1988, Dingell and other congressmen began circulating draft bills that would have created a new office for investigating scientific fraud. Dingell would have placed such an office under the aegis of the Inspector General of the Department of Health and Human Services, raising the possibility that scientific fraud might be probed by the same criminal investigators who unravel Medicare fraud. Unsettled by this vision of the "science police," NIH officials moved quickly to pre-empt Congress. The ArgumentSoon after finishing his studies in 1900, Einstein makes a tactical retreat to the Patent Office in Bern where he develops a plan for returning to the academic fold. He is assisted in this by a central figure in the Zurich establishment, Alfred Kleiner, who grooms him for the return. More generally, I argue that Einstein's role in the emergence of theoretical physics as a discipline results from the interaction of two developments, one external and institutional, the other internal (...) and personal. Certain institutional constraints influence Einstein's early academic career by providing a professional opportunity to which he can adjust his career plans. The existence of this professional context for Einstein's early work in physics plays a role in encouraging him to pursue the speculative work in physics that became his distinctive hallmark. The other side of the coin is that Einstein's personal legitimation as professor of theoretical physics in 1909 also confers legitimacy on his speculative research, which in turn infuses the term “theoretical physics” with new meaning. The key factor uniting Einstein's personal development with institutional opportunities is the special relationship that he enjoys with Kleiner, who serves as the focus of interactions between the external and internal developments described in the paper. This article examines the cultural practices through which a group of professionals infuse their work and community with charisma. Although previous research has theorized the “charisma of office” (Weber 1978), we know little about how the occupants of such offices sustain it. I focus on a group of psychoanalytically-inclined psychotherapists, whose field, despite its early charismatic beginnings, has been especially embattled in recent decades. Drawing on ethnographic and interview data, I reveal how they share stories emphasizing their “idealization” by others, (...) draw boundaries between their professional and private lives to manage their work identities, and perform interpersonal affective work that shores up their claims to extraordinary abilities. Together, these cultural practices constitute charisma within the professional group. This article thus makes a case that, as expertise becomes increasingly contested, we must look beyond social organization and the evidentiary bases of knowledge to understand professional authority. This study examines the consequences of computerization for women who do information work. Syntheses of research findings from both the general social science literature and the business and management periodical literature are compared with each other. The two bodies of research results converge with respect to employment consequences and shifts in work, but differ markedly when it comes to control of the labor process and training. In contrast to social scientists, management researchers pay scant attention to differential gender effects (...) of microcomputer deployment. Similarities and differences between the two research traditions show that social science and business research, if combined, yield a better understanding of the changes prompted by new information technology. A new reading of Plato’s political thought Plato famously defends the rule of knowledge. Knowledge, for him, is of the good. But what is rule? In this study, Melissa Lane reveals how political office and rule were woven together in Greek vocabulary and practices that both connected and distinguished between rule in general and office as a constitutionally limited kind of rule in particular. In doing so, Lane shows Plato to have been deeply concerned with the roles and relationships (...) between rulers and ruled. Adopting a longstanding Greek expectation that a ruler should serve the good of the ruled, Plato’s major political dialogues—the Republic, the Statesman, and Laws—explore how different kinds of rule might best serve that good. With this book, Lane offers the first account of the clearly marked vocabulary of offices at the heart of all three of these dialogues, explaining how such offices fit within the broader organization and theorizing of rule. Lane argues that taking Plato’s interest in rule and office seriously reveals tyranny as ultimately a kind of anarchy, lacking the order as well as the purpose of rule. When we think of tyranny in this way, we see how Plato invokes rule and office as underpinning freedom and friendship as political values, and how Greek slavery shaped Plato’s account of freedom. Reading Plato both in the Greek context and in dialogue with contemporary thinkers, Lane argues that rule and office belong at the center of Platonic, Greek, and contemporary political thought. For much of the last 50 years, a key platform animating public sector reform in Canada and elsewhere has been that efficiency and effectiveness can be achieved by adapting private sector financial management methods and practices. We argue that the recent re-establishment of the Office of the Comptroller General (OCG) of Canada represents a key element of a program of strengthening financial accountability that has emerged within the Canadian Federal Government. Although this program is longstanding and is associated Canada’s (...) implementation of new public management initiatives, it has recently drawn particular sustenance from the sponsorship scandal in Canada. We demonstrate that the reincarnated OCG, re-established amid a rhetoric of “modernization” and of “strengthening” accountability, has a wide-ranging mandate to enhance financial and audit controls, create financial standards, nurture professional development, and oversee government spending. We explore some of the consequences of this development and of the broader financial accountability mechanisms introduced in response to the Sponsorship scandal within the Canadian public sector. Functional diversity is related to functional areas in which CFOs are experienced. It reflects their number of general managerial skills or social ties to some extent. In this paper, we try to examine whether there is an association between CFO functional diversity and the timeliness of annual reports. Using data on Chinese listed firms from 2009 to 2017, we found that in state-owned enterprises, there is a negative relationship between this diversity and timeliness. However, the promotion incentive of CFOs (...) with functionally diverse experience can weaken this negative relationship. We also found that there is a positive relationship between the two factors in private enterprises whose offices are headquartered in regions with a low degree of marketization. We use difference-in-differences method to test the hypotheses again. The conclusions remain robust. (shrink)

The ongoing Post Office scandal in the UK and the 2021 Child Daycare Benefit Scandal in the Netherlands make up exemplary cases of how digital automation has changed and in fact severely harmed trust relations ranging from trust in oneself over trust in social roles, trust in institutions, trust in technology and general trust. By looking closer at how digital automation in these cases generated ruptures in the lives of ordinary citizens and also affected the involved institutions and society (...) at large I discuss how we may begin to discuss the impact of digitalization on trust in societies. I start with an introduction to the panoramic view of trust, followed by a short description of the two scandals. Based on the exploration of the two cases I take an ex post facto perspective on the dynamic social events as they unfolded in the scandals in order to analyze how the introduction of digital automation tools affected trust relations. I draw attention to some of the most noticeable changes in the four relations of trust, which is trust in institutions, interpersonal trust, trust in oneself and trust in technology. (shrink)

This paper deals with what a government funded development agency should do when a developing country imposes restrictions on the development process which discriminate on the basis of gender against some members of the development agency’s staff. The conclusion is that there are circumstances in which development agencies should continue their work in the face of gender discrimination but they should not instigate development projects if doing so would involve them in gender discrimination. A set of procedures for a development (...) agency to follow in these difficult circumstances is outlined. It is argued that an agency is entitled to violate a moral principle when so doing will reduce violations of that same principle. (shrink)

Many studies in big data focus on the uses of data available to researchers, leaving without treatment data that is on the servers but of which researchers are unaware. We call this dark data, and in this article, we present and discuss it in the context of high-performance computing facilities. To this end, we provide statistics of a major HPC facility in Europe, the High-Performance Computing Center Stuttgart. We also propose a new position tailor-made for coping with dark data and (...) general data management. We call it the scientific data officer and we distinguish it from other standard positions in HPC facilities such as chief data officers, system administrators, and security officers. In order to understand the role of the SDO in HPC facilities, we discuss two kinds of responsibilities, namely, technical responsibilities and ethical responsibilities. While the former are intended to characterize the position, the latter raise concerns—and proposes solutions—to the control and authority that the SDO would acquire. (shrink)

Generally, rational decision-making is conceived as arriving at a decision by a correct application of the rules of logic and statistics. If not, the conclusions are called biased. After an impressive series of experiments and tests carried out in the last few decades, the view arose that rationality is tough for all, skilled field experts not excluded. A new type of planner's counsellor is called for: the normative statistician, the expert in reasoning with uncertainty par excellence. To unravel this view, (...) the paper explores a specific practice of clinical decision-making, namely Evidence-Based Medicine. This practice is chosen, because it is very explicit about how to rationalize practice. The paper shows that whether a decision-making process is rational cannot be assessed without taking into account the environment in which the decisions have to be taken. To be more specific, the decision to call for new evidence should be rational too. This decision and the way in which this evidence is obtained are crucial to validate the base rates. Rationality should be model-based, which means that not only the isolated decision-making process should take a Bayesian updating process as its norm, but should also model the acquisition of evidence (priors and tests results) as a rational process. Under Article 74 of the Constitution, for gross violation of the Constitution or breach of oath, or if it transpires that a crime has been committed, the President of the Republic may be removed from office under procedure for impeachment proceedings. In the article the content of the constitutional delict is analysed. The President of the Republic may be brought to constitutional responsibility only for the actions which he committed while in office of the President of the Republic. The President (...) of the Republic may be removed from office not for any violation of the Constitution, but only for gross violation thereof. While implementing the powers established to him in the Constitution and laws, the President of the Republic may not breach the oath. Under Article 74 of the Constitution, the President of the Republic may be removed from office “if it transpires that a crime has been committed” – this provision means that the Constitution provides for the right of the Seimas to remove the President of the Republic from office in the absence of a court judgement recognising that the President of the Republic is guilty of commission of a crime. The Constitution commissions only the Constitutional Court to establish the fact of violation of the Constitution – whether there has been a gross violation of the Constitution and breach of oath by actions of the person. The Seimas may not change or question the conclusion of the Constitutional Court. On the grounds of the conclusion of the Constitutional Court that the actions of the President of the Republic are in conflict with the Constitution, it is only the Seimas that decides whether to remove the President of the Republic from office. The removal of the President of the Republic from office under procedure of impeachment proceedings due to a suspicion that the crime has been committed is not binding upon a court of general jurisdiction which considers the criminal case. Ethics and compliance officers (ECOs) are organizational agents who are responsible for ensuring employees’ ethical and legally compliant behavior. In their ethical organizational roles, ECOs impose ethical expectations on others. In our study, we find that doing so provokes a challenging interpersonal dual threat dynamic where ECOs are perceived as threatening and feel threatened in return, which is a dynamic that ECOs must navigate to be successful. To better understand how ECOs navigate this dynamic, we explore the ethical role identity (...) work that ECOs engage in and demonstrate how ECOs make sense of and respond to the threat dynamic that occurs as they enact their roles. We found two types of identity work: (1) tensions that pull role incumbents toward personalized or impersonalized approaches in their interactions with others and (2) tactics that address the threats and tensions. We also find that ECOs’ identity work facilitates ethical and identity growth for the role incumbent. To make these contributions, we employ grounded theory methods and draw primarily upon a rich qualitative dataset of interviews with ethics and compliance officers. The model we derived from our research contributes to the behavioral ethics literature by illustrating the challenges yet growth possible in enacting ethical organizational roles. (shrink)

Despite numerous chief executive officers (CEOs) citing their religious convictions as the primary guiding framework for their decision-making, leadership behavior, business philosophy, and motivation to contribute to society, the impact of CEOs’ religious convictions is relatively limited in the business literature. However, the widespread yet potentially ambiguous impact of CEO religiosity, encompassing both a CEO’s religious denomination and level of religiosity, on individual, organizational, economical, and societal levels remains a neglected area of research. This gap is attributed to challenges in (...) conceptualizing and measuring this multifaceted construct, with existing research scattered and predominantly confined to the ethics domain. Notably, this oversight is significant given the pivotal role that CEOs, as primary decision-makers, play in organizational dynamics. This article aims to address this gap by conducting a systematic literature review of 50 articles focused on CEO religiosity, seeking to enhance the understanding of personal religion in the business world. Through an analysis of publication trends, methodological approaches, theoretical frameworks, and empirical findings, the review not only offers insights for future research and theorizing but also proposes a conceptual framework for understanding and advancing CEO religiosity research. Additionally, this review identifies specific areas warranting further investigation, thereby highlighting existing research gaps and providing explicit starting points for future research. Through these contributions, this article provides a blueprint for future research on CEO religiosity and holds significant implications for management practice. (shrink)

This article explores the relevance of the Theory of Planned Behavior to whistleblowing research, and considers whether its widely tested validity as a model of the link between attitudes, intention, and behavior might make it an appropriate candidate for a general theory to account for whistleblowing. This proposition is developed through an empirical test of the theory's predictive validity for whistleblowing intentions. Using a sample of 296 Korean police officers, the analysis showed that attitude, subjective norm, and perceived behavioral (...) control all had significantly positive main effects on internal whistleblowing intentions, but for external whistleblowing intentions only subjective norm was significant. The implications of these findings for applying the Theory of Planned Behavior to whistleblowing research are discussed. (shrink)

Many criminal law scholars have criticized the responsible corporate officer doctrine as a form of strict and vicarious liability. It is neither. It is merely a doctrine that supplies a duty in instances of omissions. Siding with Todd Aagaard in this debate, I argue that a proper reading of the cases yields that the responsible corporate officer doctrine is just duty supplying, and does not allow for strict liability when the underlying statute requires mens rea. After analyzing Dotterweich, (...) Park, and their progeny, I probe the depths of this duty-supplying doctrine, including to whom the duty is owed, whether the duty is grounded in statute, cause of peril, or contract, and what the content of the duty is. Although the responsible corporate officer doctrine unveils questions we may have about duty generally, it is no more problematic than other duty-supplying doctrines in the criminal law. (shrink)

Scholars in ancient East Asian society tried to practice humanities by going on the path of public office after polishing their studies. In particular, Confucianism viewed study and public office as a virtuous cycle. Among ancient thinkers, Zhuangzi is usually regarded as having a negative attitude towards this. Of course, employment today is wider than public offices in that it encom-passes public offices, public and private enterprises, and self-employed businesses. Employment can be said to have a more general characteristic (...) in that it does not require only the will of Confucian scriptures(四書五經) according to individual choices. In addition, employment is basically focused on profits and aims at individual self-realization. Zhuangzi tends to oppose public office, just as he might refuse an offer from the prime minister. In addition, Zhuangzi does not directly discuss employment. How-ever, Zhuangzi suggests a third way beyond the confrontation between usefulness and dance. Here, the possibility of public office can be derived. Furthermore, Zhuangzi actually presents a master sage(至人) engaged in various livelihoods. This can be extended to activities that engage in livelihood and enjoy hobbies according to Dao(道). In this paper, I would like to draw a meaning-ful proposal for a person considering employment today through the perspective of Zhuangzi's public office and employment. (shrink)

Effective implementation and committed practice of sustainable procurement remain a significant challenge for many organisations across the globe. This paper sought to understand the extent to which employees’ perceptions influence the practice of sustainable procurement in the context of a developing country where sustainability awareness is low. Drawing on the Diffusion of Innovation theory, procurement officers’ perceptions of sustainable procurement were examined relative to the attributes of complexity, compatibility and relative advantage. Empirical data from 322 Ghanaian organisations were analysed using (...) descriptive statistics and structural equation modelling to determine the nature of procurement officers’ perceptions of sustainable procurement and the effects of the perceptions on relevant organisational practices. The findings indicate that whereas perceptions of relative advantage did not significantly influence the practice of sustainable procurement, perceptions of compatibility had a significant positive effect, and perceptions of complexity had a significant negative effect on sustainable procurement. This study offers insights into the link between employees’ perceptions and organisational sustainable procurement practice, thereby providing a conceptual basis for effective management of the pertinent relationships with implications for enhanced ethical practices in procurement and supply chain management. With advances in technology and the popularity of the Internet, consumers increasingly rely on various sources of electronic word-of-mouth, such as online user reviews and critical reviews, in their decision-making processes. Despite general consensus on the importance of eWOM and the ability of critical reviews to influence product sales, very little is known about the mediation between critical reviews and user reviews. Therefore, we used path analysis to examine how critical reviews and user reviews simultaneously affect box office revenues (...) using eWOM data collected from Metacritic.com and IMDb.com, and box office revenue information collected from BoxOfficeMojo.com. The results showed that critical reviews valence not only directly affects box office revenues but also increases active postings in the community and user reviews volume, thus indirectly leading to greater box office revenues. In the profound silence that ensued, he cried: "I have received the order to fire upon the rabble; but as I perceive before me many honest people, I ask them to depart so that I may execute this order." In a few moments, the square was vacant. In circumstances such as these, a decision that saves both others and oneself is not easy to achieve. In such a repressive framework where legal violence is permitted, it is the duty of an officer to obey the order of his superiors, and when we hear or read this story for the first time, we do not see how a happy outcome is possible. The story ought to be dramatic, but what is astonishing is precisely that it is not. We expect the worst, which is what usually happens, the most optimistic among us perhaps hoping secretly for a happy end. But happy endings belong to the universe ofthe marvelous, and life does not resemble a story, as the pessimist murmurs within us. Still, it is the happy ending that in fact occurs, and our astonishment is bound to its improbability. Is it chance? Luck? Inspiration? Premeditation? No doubt there is something of all of this in the officer's decision, and his elegant intervention raises a smile in our skeptical hearts. It is clear that what is most striking in this story is the moment ofthe face-to-face between the officer and the crowd. It is worthwhile to back up a little, however. From the moment he receives his order to the moment of the face-to-face, the officer must live through some very bad moments: it is no little thing to fire upon a crowd even if legality is on our side. We all know that the worst crimes have been perpetrated under the cover of obedience. Such refuge within authority is rather a hell where one abdicates a part of oneself. The function ofan officer does not stop him from being equally a man, one with feelings, beliefs, values. He knows that the rioters, whatever their fight, cannot be reduced to the term "rabble." Rabble, "rabid," dog. These people deserve no doubt a bit more consideration than that. Who can assert that the riot does not express real sufferings, legitimate rights, slighted dignities? Who could feel comfortable executing the individual who claims his due? A praiseworthy indignation. From that point to justify an heroic ethics of non-violence, is only a small step. "No, I will not fire upon a crowd whose wrong or right deed is to be angry." The officer must undoubtedly have in mind similar thoughts. Inversely, perhaps he justifies himself by saying to himselfthat after all, the rioters disturb the public order. Ifone does not react vigorously and repressively, the riot could degenerate into a general revolution. The order is justified not only by legality but also by a morality ofthe common good. And anyway, ifhe does not empty the square by firing upon the crowd, someone else will. So he might as well do the dirty job himselfto avoid shifting the weight ofthis responsibility onto someone else. And thus, to the devil with such qualms. Life is sufficiently complicated as it is. According to the Psychological Account of personal identity, personal identity across time is maintained by some form of psychological overlap or continuance. I show that the Psychological Account has trouble accommodating cases of transient retrograde amnesia. In such cases, the transitivity of psychological continuity may break down. I consider various means of responding to this problem, arguing that the best available response will undercut our ability to rely on intuitions about brain transplantation to support the Psychological Account. When the Psychological (...) Account is re-interpreted in such a way as to overcome the problems posed by cases of transient retrograde amnesia, it turns out that standard brain transplantation cases involve details which are strictly irrelevant according to the theory. On the other hand, these features seem to drive our intuitions about survival in these cases. In this way, my argument undermines one of the key motivations for adopting the Psychological Account. Normally, we would accuse anyone who holds inconsistent beliefs of irrationality. However, Keenan apologists may claim that in some circumstances it does seem perfectly rational to hold inconsistent beliefs. And we are not alone in this assertion. A small band of philosophers, led most notably by Graham Priest, have also championed this cause, the cause of paraconsistency.

In the context of office work, learning to handle an Enterprise Resource Planning system is important as implementation costs for such systems and associated expectations are high. However, these expectations are often not met because the users are not trained adequately. Electronic Performance Support Systems are designed to support employees’ ERP-related problem-solving and informal learning. EPSS are supposed to enhance employees’ performance and informal workplace learning through task-specific and granular help in task performance and problem-solving. However, there is little empirical (...) research on EPSS. Two survey studies addressed this research gap. In the first study, 301 people working in Human Resource -related positions and functions evaluated the learning potential of EPSS as well as potential advantages and obstacles concerning the implementation and use of EPSS. Though other measures are currently assessed as more important for learning, HR employees expect a strong increase in the significance of EPSS for employee learning. In the second study, 652 users of ERP software completed a questionnaire on characteristics of their daily work tasks, team characteristics, individual dispositions, their coping with ERP-related problems, and characteristics of EPSS. Findings indicate that the most frequently available and used approach when dealing with an ERP-related problem is consulting colleagues. Three EPSS types can be distinguished by their increasing integration into the user interface and their context-sensitivity. While external and extrinsic EPSS are available to many users, intrinsic EPSS are less common but are used intensively if available. EPSS availability is identified to be a strong positive predictor of frequency of EPSS use, while agreeableness as well as the task complexity and information-processing requirements show small negative effects. Moreover, more intensive ERP users use EPSS more frequently. In general, ERP users value, features such as context-sensitivity, an integration of the EPSS into the ERP system’s user interface, the option to save one’s own notes, and information displayed in an extra window. Using a unique dataset of deceased certified public accountants (CPAs) in China, we document that auditors who have experienced the death of a peer CPA from the same office are less likely to issue modified audit opinions, indicating impaired audit quality. Accordingly, we argue that heightened death awareness and corporate social responsibility (CSR) awareness, triggered by the death of a work peer, lead to death anxiety, intrinsic-value pursuit, and reduced commitment to the employer, thereby hindering both work ability and work (...) commitment during the audit process. Moreover, the power of peer death is amplified by both self-relevance and self-exposure to deaths perceived by living auditors. Since most of the deceased CPAs in our sample are not signing CPAs who lead audit projects, our results illustrate the significant negative impact of peer death on work performance at the rank-and-file employee level. As employee deaths are frequently linked to the prevalent burnout culture and show a growing trend in recent years, our findings timely reveal the economic costs of the toxic workplace environment. This practically implies the critical importance of promoting a safe and healthy working environment ex ante and providing appropriate bereavement support for employees affected by a colleague’s death ex post. This article analyzes the origins of the “responsible corporate officer” doctrine: the trial of Joseph Dotterweich. That doctrine holds that an officer may be personally liable for the criminal act of a subordinate if the officer was, in some indefinite way, able to prevent the violation. Applying this doctrine, the prosecution of Dotterweich entailed strict liability for a strict liability offense. The underlying offenses—the interstate sale of one misbranded and adulterated drug and one misbranded drug—were said to (...) be strict liability offenses. And then, with respect to Dotterweich as the corporation’s general manager, the government argued that he was strictly liable because he stood in “responsible relation” to the company’s acts. The government never tried to prove that the company, Buffalo Pharmacal, was negligent, nor did it try to prove that Dotterweich was negligent in his supervision of the employees of Buffalo Pharmacal. The prosecutor and judge were candid about this theory throughout the trial, although the judge conceded that it seemed bizarre and unfair. The defense lawyer repeatedly sought to inject what became known throughout the trial as the “question of good faith,” but was circumvented at almost every turn. What would thus seem to be the crux of any criminal trial—the personal fault of the defendant—was carefully shorn from the jury’s consideration. The government’s theory was so at odds with intuitive notions of liability and blame that, as one probes into the case, and looks at the language used in the government’s appellate briefs, imputations of moral fault inevitably crept in. Yet the government was not entitled to make such accusations, as it had pruned moral considerations from the trial. The article argues that the responsible corporate officer doctrine can never enjoy a secure place in our legal system. First, the doctrine is at a minimum in tension with, and often in direct opposition to, basic principles of the criminal law; and second, the doctrine fails, when followed to its logical conclusions, to accord with basic notions of fair play. The article concludes that the responsible corporate officer doctrine is either unnecessary, in cases in which the evidence establishes personal fault, or unjust, in cases in which it creates liability in the absence of personal fault through the unspecified notion of “responsibility.” The Dotterweich case illustrates what is contemplated by the latter possibility, and why it is problematic in any judicial system that purports, in the words of the Model Penal Code, “to safeguard conduct that is without fault from condemnation as criminal.”. Human organizations’ adoption of the paradigm of the Fourth Industrial Revolution is associated with the growth of techno-empowerment, which is the process of transferring autonomy in decision-making to intelligent machines. Particular persuasive strategies have been identified that may coax people to use intelligent devices. However, there is a substantial research gap regarding what antecedents influence human intention to assign decision-making autonomy to artificial agents. In this study, ethological and evolutionary concepts are applied to explain the drivers for autonomous assistants’ techno-empowerment. (...) The method used in the study was a 4 × 2 between-subject experiment made with 278 persons. The research tool used to collect the data was an online survey. The results show that more positive attitudes and higher trust, perceived usefulness, and perceived ease of use are correlated with higher intention to allow the autonomous assistant independence in decision-making. Second, the results suggest that the more human-like a non-human agent is, the higher the intention to empower it—but only if this agent simultaneously provides functional and visual anthropomorphic cues explainable by the mimicry effect. This article questions the commonly assumed prevalence of women in Greek Hellenistic priesthoods, often considered to put them on equal footing with men in this sphere, through the particular case study of Rhodes, a state whose religious organisation appears entirely dominated by male priests. It suggests that it is time to revise some of the general assumptions about women and Greek religion by placing greater emphasis on regional variations. Consequently, it argues that local organisation and the epigraphic habit likely (...) played a role, and examines in detail the evidence that does survive for Rhodian priestesses. Do these appear in particularly “feminine” cultic contexts? Can we find any evidence for a “gender-rule” of priesthoods? Finally, this article considers the limited public representation of women in Hellenistic Rhodian society, and what light this casts on our understanding of priesthoods. (shrink)

Readers of reports on ethical failures by four-star general officers must wonder, “Don’t they have staffs to ensure that the general follows ethics rules?” The Department of Defense publishes robust ethics guidance in several documents; however, a staff’s best efforts to implement this guidance may fail to make an impression on a senior leader who is susceptible to the “Bathsheba syndrome,” an allusion to the biblical account where the prophet Nathan rebuked King David for his moral failings. This (...) paper proposes a methodology to enable senior headquarters staffs to play the role of Nathan in supporting ethical behaviors by high-level officers. It examines the mechanisms that embed ethical behavior within members of those staffs in carrying out their three principal roles of advising, scheduling, and transporting the four-star officer. The authors offer a framework based on an ethical infrastructure of organizational climate that focuses the staff’s daily efforts to mitigate risk across seven ethical “danger areas” that threaten ethical failures by senior officers. This is the first full-length biography of John Langshaw Austin (1911–60). The opening four chapters outline his origins, childhood, schooling, and time as an undergraduate, while the next four examine his early career in professional philosophy, looking at the influence of Oxford Realism, Logical Positivism, Pragmatism, and the later Wittgenstein. The central twelve chapters then explore Austin’s wartime career in British Intelligence. The first three examine the contributions he made to the campaigns in North Africa; the next seven the seminal (...) role he played in ensuring the outstanding accuracy of the D-Day Intelligence; while the final two explore his contributions to Arnhem, the Ardennes, and the post-war administration of Germany. The last main section of the book then outlines and assesses Austin’s contributions to post-war Oxford Ordinary Language Philosophy. The first three chapters discuss the impact on Oxford philosophy of the cultural atmosphere of post-war Britain and the later Wittgenstein’s ideas. The next four look at Austin’s influence on post-war Oxford, particularly his Saturday morning discussion group and his perception lectures. The next five chapters concentrate on America’s influence on Austin and vice versa, paying particular attention to Austin’s work on speech-acts and his semesters in Harvard and Berkeley.
