Executive power in the European Union consists of various bits and pieces that have been cobbled together across a spectrum of institutions, sub‐actors, and policy areas. No fewer than three institutions of the European Union and its predecessors can claim to exercise executive authority within the Union, albeit to varying degrees and with varying emphasis: the Commission, the Council, and the European Council. This chapter provides a brief overview of the three core executive institutions, followed by a (...) discussion on recent executive constructions outside the EU legal framework. It highlights the pressing need for accountability mechanisms on all levels of Union governance. The European Council has gradually reinforced its own role, becoming in effect the most important agenda setter of the larger developments of the European Union, in spite of the Commission's monopoly of legislative initiative. This paper investigates the conceptual and empirical possibility of non-executed, non-conscious proximal intentions, i.e., non-conscious proximal intentions to act that do not turn into a final act, but perhaps are vetoed or overcome by an alternative action. It constructs a conceptual framework in which such cases are justifiably considered ‘proximal intentions’. This is achieved by combining Alfred Mele’s notion of non-conscious proximal intentions together with the notion of trying or striving taken from Brian O’Shaughnessy’s model of action. With this framework (...) in hand we analyze empirical electroencephalography (EEG) findings regarding ‘change of intention’ scenarios. Prior to EEG development (and other brain imaging techniques), one would never consider non-executed, non-conscious proximal intentions a case of intention at all. However, with technological and interpretable development of EEG, a whole group of so called ‘intentions’ appears, and the main aim of the paper is to justify this expanded usage. (shrink)

Human capital, the knowledge, skills, and abilities of employees, can be a powerful driver of firm performance, yet the mobility of human capital raises questions over how to protect it. Employee non-compete agreements, which limit an employee’s ability to start or join a rival firm, have received recent attention. While past research considers whether non-competes are effective tools at limiting employee mobility, few have considered if non-competes should be used. Filling this gap, I propose a normative schema for when employee (...) non-competes can be considered ethical. A review of the limited existing literature on the ethics of employee non-competes finds that prior research has mostly focused on questions of property rights, which I propose as being nested within other ethical constructs. Analysis of two real-world illustrative examples of employee non-competes leads to a three-prong approach to evaluating non-competes based on ethical dimensions of power, autonomy, and fairness. I end by proposing—although further research is warranted—a measure of employee-level absorptive capacity, which is closely coupled with an employee’s pre-employment human capital, as an employee-level attribute independent of, although likely coincidental with, the tripartite requirements of power/autonomy/fairness for ethical employee non-compete agreements. Despite the compelling subjective experience of executive self-control, we argue that ‘consciousness’ contains no top-down control processes. We propose that ‘consciousness’ involves no executive, causal or controlling relationship with any of the familiar psychological processes conventionally attributed to it. In our view all psychological processing and psychological products are non-conscious. In particular, we argue that all ‘contents of consciousness’ are generated by and within non-conscious brain systems in the form of a continuous self-referential personal narrative that is not (...) directed or influenced in any way by the ‘experience of consciousness’. This continuously updated personal narrative arises from selective ‘internal broadcasting’ of outputs from non-conscious executive systems that have access to all forms of cognitive processing, sensory information and motor control. The personal narrative provides information for storage in autobiographical memory and is underpinned by constructs of self and agency, also created in non-conscious systems. The experience of consciousness, is seen as a passive accompaniment to the non-conscious processes of internal broadcasting and the creation of the personal narrative. In this sense personal awareness is analogous to the rainbow which accompanies physical processes in the atmosphere but exerts no influence over them. Though at an individual level it is an end-product created by non-conscious executive systems, the personal narrative serves the powerful evolutionary function of enabling individuals to communicate (externally broadcast) the contents of internal broadcasting. This in turn allows the recipients to generate potentially adaptive strategies, such as predicting the behavior of others and underlies the development of social and cultural structures, that promote species survival. Consequently, it is the capacity to communicate to others the contents of the personal narrative that confers an evolutionary advantage – not the experience of consciousness (personal awareness) itself. The present essay focuses on problematizing the European Union's claim that intercultural dialogue constitutes an advocated method of talking through cultural boundaries—inside as well as outside the classroom—based on mutual empathy and non‐domination. More precisely, the aim is to analyze who is being constructed as counterparts of the intercultural dialogue through the discourse produced by the EU in policies on education, culture and intercultural dialogue. Within the Union, Europeans are portrayed as having an a priori historical existence, while the ones (...) excluded from this notion are evoked to demonstrate its difference in comparison to the European one. The results show that subjects not considered as Europeans serve as markers of the multicultural present of the space. Thus, intercultural dialogue seems to consolidate differences between European and Other—the ‘We’ and ‘Them’ in the dialogue—rather than, as in line with its purpose, bringing subjects together. This chapter compares the institutional setting and integrations processes in Switzerland and the EU. The major findings are that EU integration is trying to achieve more political integration and accommodation of a much higher degree of diversity in much less time than has ever been the case in Switzerland. Integration and expansion processes that were slower and non-linear in Switzerland and that happened in separate phases (e.g. religious diversification, linguistic diversification, territorial expansion, etc.) are all going on at the same (...) time in the EU. Especially integration and accession with enormous shocks of diversification are engineered at the same time in the EU. From this point of view, the EU has already tried to go beyond many stages that took centuries to be completed in Switzerland. The institutional design of the European Union seems to echo quite well the federal state formation process in Switzerland. The following precisions are however necessary in the comparative perspective. First, the momentary stage of European Integration, characterized by intergovernmental crisis management, resembles the (dysfunctional) intergovernmental centralism of the Swiss cantons during the decades before the formation of the federal-state in 1848. Second, due to the greater diversity of the European Union, this quasi-federal system has derived in extreme asymmetries between the member states. Since EU identity is not well entrenched among European citizens (and politicians), it has been hard to design institutions and policies of common territorial protection and redistribution and there is mistrust towards centralistic EU institutions (specially in the countries more affected by the economic crisis). Most European citizens do not feel that their interests are taken into account by the European Union. Third, it is important to note that in Swiss federalism the municipalities play an important role, they are much more than just administrative districts. This city-centred and bottom up construct of citizenship is guaranteed by the Swiss federal constitution. Citizens feel that their most immediate and local identity is not jeopardized but rooted in and guaranteed by the Swiss federal constitution. Compared to sub-national Swiss federalism, EU federalism is entirely focused on the nation-state and the EU institutions. Serious consideration ought to be given to the idea that European citizenship is not only about bringing citizenship to a higher European level but also about bringing it more to the root-level of citizenship: the city. Direct democracy has acted as a federator in the Swiss context. Switzerland made direct democracy and direct democracy made Switzerland. There has been a slow and iterative process of adaptation of structurally similar institutions of direct democracy at all levels (communal, cantonal, federal) of all units (all communes, all cantons, confederation roughly between 1830-1891. To the contrary, the EU is only incipiently in a process of introducing direct democracy (in some member-states and ECI), and so far direct democracy is mainly practiced as national plebiscitary democracy. Under this guise it is seen as a threat to EU integration and probably not without good reason. While in Switzerland the coherent introduction of direct democracy at all levels of the polity in the long run served as an important unifier, direct democracy has even not been considered as integrative part of all levels of political integration in the EU. It is of great interest that the one element in which the European Union has based the construction of EU citizenship and identity – mobility of residence – has been implicitly discouraged in Switzerland. The institutional design as incorporated in Swiss multicultural identity (which aims fundamentally at the protection of cantonal autonomy, culture and language) has facilitated that Switzerland is called today a successful multicultural society. Most citizens identify with Switzerland as a country and they like it as it is, but they do not want to take advantage of their formal right to move to other parts of the country, especially not across language borders. The same institutional design that has made of Switzerland a successful case of multiculturalism and democracy poses important barriers that make it difficult for the Swiss to move their residence across their country. Considering that one of the main features of European citizenship is the freedom of movement and residence, this poses a main concern. The Swiss compromise between the formal right and economic necessity of mobility on the one hand and the protection of political and cultural sub-identities on the other hand, is commuting. Due to the vast size, this is of limited applicability in the EU. However, in a Europe of cities and trans-border regions, commuting is an important option provided that every European citizen lives reasonably close to an important economic centre. In short, the Europe of commuters deserves attention in the context of EU citizenship. (shrink)

The aim of this research was to establish linear relations (association and prediction) and inferential relations between three constructs at different levels of psychological research –executive dysfunction(microanalysis),self-regulation(molecular level), andself-vs.external regulation(molar level), in the prediction of emotion regulation difficulties. We hypothesized that personal and contextual regulatory factors would be negatively related to levels of executive dysfunction and emotion regulation difficulties; by way of complement, non-regulatory and dysregulatory personal, and contextual factors would be positively related to these same difficulties. To (...) establish relationships, we used a retrospective,ex postfacto design, where 298 university students voluntarily participated by completing standardized self-reports. Linear and structural correlational, predictive analyses were performed, as well as inferential analyses. Results were consistent and validated the proposed hypotheses, for both association and prediction. The most important result refers to the discriminant value of the five-level combination heuristic for predicting Executive Function and External (contextual) Dys-Regulation. In conclusion: (1) both personal and contextual regulation factors must be analyzed in order to better understand the variation in executive functions and emotion regulation difficulties; (2) it is important to continue connecting the different levels of the constructs referring to self-regulation, given their complementary role in the behavioral analysis of regulation difficulties. This article aims to shed some light on the concepts embedded in the expressions ‘services of general interest’ (‘SGI’), ‘services of general economic interest’ (‘SGEI’), ‘non-economic services of general interest’ (‘NSGI’) and ‘social services of general interest’ (‘SSGI’). It is submitted that the expression ‘SGI’ conveys a general concept which comprises both SGEI and NSGI. SGEI may be distinguished from NSGI in that only the former involve an economic activity. In contrast to SGI, SGEI and NSGI, the expression ‘SSGI’ is (...) nowhere to be found in primary EU law. This means that it is for the EU legislator and, as the case may be, for the Member States to define such expression. Furthermore, this article supports the contention that a definition of the principles and conditions underpinning the operation of SGI must be capable of adapting to changing times and social perceptions, whilst being respectful of the vertical and horizontal allocation of powers set out in the Treaties. Vertically, a definition of SGI must not impinge upon the powers retained by the Member States. In the absence of harmonisation, it is for the Member States to define the services they consider to be of general interest, unless they commit a manifest error of assessment. In the presence of EU harmonising measures, the margin of discretion enjoyed by the Member States is, if still existent, narrowed down, given that national authorities are required to comply with the objectives pursued by the EU legislator. Horizontally, a definition of SGI must not encroach upon the prerogatives of the Commission in the realm of competition law. Moreover, in light of Article 9 TFEU and secondary EU legislation, the specific features of SSGI must be taken into consideration when determining the compatibility with EU State aid rules of public service compensation awarded to the providers of those services. An EU conceptual framework for the SGI must thus be the result of a constructive dialogue between the different levels of governance, as well as of a balanced solution among different policy areas in relation to which the EU enjoys competences. Many individuals with developmental language disorder (DLD) and individuals who are deaf or hard of hearing (D/HH) have social–emotional problems, such as social difficulties, and show signs of aggression, depression, and anxiety. These problems can be partly associated with their executive functions (EFs) and theory of mind (ToM). The difficulties of both groups in EF and ToM may in turn be related to self-directed speech (i.e., overt or covert speech that is directed at the self). Self-directed speech is thought (...) to allow for the construction of non-sensory representations (i.e., representations that do not coincide with direct observation). Such non-sensory representations allow individuals to overcome the limits set upon them by the senses. This ability is constrained by the development of word meaning structure (i.e., the way words are understood). We argue that the greater ability to construct non-sensory representations may result in more enhanced forms of EF and ToM. We conclude that difficulties in EF, ToM, and social–emotional functioning in those with hearing and language problems may be accounted for in terms of word meaning impairments. We propose that word meaning structure and self-directed speech should be considered in assigning EF and ToM treatments to individuals with DLD and those who are D/HH. (shrink)

ABSTRACTGiven the centrality of corporations in distribution of income and wealth studies, discursive constructions of corporate taxation are essential to understanding the production of inequality. The focus of this study is an interview with Apple’s Chief Executive Tim Cook on the Irish state broadcaster, Raidió Teilifís Éireann’s flagship news programme, Morning Ireland, following the ruling by the European Commission on the corporation tax arrangements between Apple Inc. and Ireland. Drawing on a Critical Discourse Analysis approach, a frame analysis (...) is provided. The significance and extent of the EC’s ruling has potential implications for corporation taxation policy, within and beyond the European Union, which provides a timely reflection in the Brexit era and in the context of rising economic nationalism generally. Thus, the discursive construction of this ruling in the media is of importance in understanding how inequality is produced and reproduced, and journalism’s role therein. (shrink)

This article examines three key aetiological theories of autism (meta-representations, executive dysfunction and weak central coherence), which emerged within cognitive psychology in the latter half of the 1980s. Drawing upon Foucault’s notion of ‘forms of possible knowledge’, and in particular his concept of savoir or depth knowledge, two key claims are made. First, it is argued that a particular production of autism became available to questions of truth and falsity following a radical reconstruction of ‘the social’ in which human (...) sociality was taken both to exclusively concern interpersonal interaction and to be continuous with non-social cognition. Second, it is suggested that this reconstruction of the social has affected the contemporary cultural experience of autism, shifting attention towards previously unacknowledged cognitive aspects of the condition. The article concludes by situating these claims in relation to other historical accounts of the emergence of autism and ongoing debates surrounding changing articulations of social action in the psy disciplines. In recent years, marriage migration as a form of family reunification has become a growing policy concern for migration governance in European member states and is seen as ‘the last loophole’ in EU migration policy in the face of a supposedly large and increasing number of sham marriages through which the non-European spouse is granted a residency permit. Several European nations have therefore legislated legal-administrative measures to battle marriages of convenience by investigating cross-border marriage applications prior to celebrating or recognising (...) the marital union. In this article, I draw on a linguistic ethnographic empirical study of legal-administrative investigations conducted by Belgian municipal authorities to determine whether cross-border marriage applications to their civil registry office are ‘genuine’ or ‘fake’. In particular, I examine how the legal framework and guidelines for investigation are bureaucratically implemented in practice in Belgian civil registry offices with a particular focus on the role of a discursively constructed notion of genuine cross-border love and a bureaucratically acceptable relationship in both policy documents and interviewing practice. This article involves a qualitative research undertaken to elucidate how Ukraine’s European identity is constructed by Carl Bildt, Sweden’s Minister for Foreign Affairs. Specifically, the paper’s aim is to identify conceptual metaphors used by Carl Bildt in his political online discourse concerning Ukraine within the timeframe from 1 April 2013 until 1 April 2014. In addition to this objective, the article explores whether or not concepts SELF as the EU and OTHER as non-EU respectively are embedded in conceptual metaphors identified (...) in Bildt’s discoursal space involving Ukraine’s European identity. Results of the data analysis reveal several types of conceptual metaphors which are present in the corpus of Bildt’s online discourse involving Ukraine: “EU as a Path”, “EU as a Nurturant Parent”, “EU as a House”, “Ukraine’s Politics towards EU as a Stock Market Crash”, “Ukraine’s Path to EU as Poland’s EU Path” and “The EU Flag as a Symbol of the Better Future”, respectively. These conceptual metaphors seem to be exacerbated by the presence of the concept SELF. (shrink)

We investigate whether the geographic concentration of non-EU immigrants in the various Italian provinces affects labour tax avoidance practices adopted by firms located in the same provinces, as well as in the neighbouring provinces, and operating in construction and agriculture industries that mostly employ immigrants in Italy. For this purpose, we develop a LTAV proxy based on the financial accounting information of a sample of 993,606 firm-years, disseminated throughout the 108 Italian provinces, over the period 2008–2016. Our results, based on (...) a Spatial Durbin Model panel regression, reveal a statistically significant positive association between the concentration of non-EU immigrants and LTAV at province level, as well as the presence of spillover effects among neighbouring provinces. Our findings are robust to several additional analyses, including instrumental variable estimations. Our study provides empirical support to previous structuralist or marginalization theories holding that socioeconomically marginalized groups, such as non-EU immigrants, are more likely to be involved in labour exploitation practices, which could underlie our LTAV outcomes. Furthermore, it supports the need for tax authorities to strengthen labour inspections, coordinated at national level, especially in those contexts where non-EU immigrants are mostly employed. On the other hand, a greater social integration, assistance, and recognition of rights of immigrants may help to alleviate their situation of weakness that makes them more vulnerable to LTAV practices. Finally, tackling LTAV, associated with the underemployment of immigrants, may prevent its negative effects for society arising from the reduction of public resources to sustain the social welfare and finance public goods and services. This paper explores the UK’s legal interventions in the arena of forced marriage. Three key initiatives have been considered in the last 5 years: creating a specific crime of forced marriage; civil rather than criminal protection for victims; and an increase in the age of entry for non-EU spouses, with a corresponding increase in age for sponsoring such spouses. Our key focus is on the last of these interventions and we draw upon a research study conducted in the UK in (...) 2006/2007 exploring the risks and benefits associated with increasing the age of sponsorship and entry. The UK government’s argument is that the increased maturity which comes from being older acts as a protective factor, thus making it easier to resist forced marriage. This view of maturity gains its saliency from developmental psychology. Here, we critically analyse the construct of age and the link between age and ability to resist forced marriage. We illustrate through the accounts of victims of forced marriage and of stakeholders the difficulties of adopting age as a central organising feature of protection for potential victims of forced marriage. In a dynamic (sequential) framework, departures from the independence axiom (IND) are reputed to induce violations of dynamic consistency (DC), which may in turn have undesirable normative consequences. This result thus questions the normative acceptability of non expected-utility (non-EU) models, which precisely relax IND. This paper pursues a twofold objective. The main one is to discuss the normative conclusion: usual arguments linking violations of DC to departures from IND are shown to be actually based on specific (but usually remaining implicit) (...) assumptions which may rightfully be released, so that it is actually possible for a non-EU maximizer to be dynamically consistent and thus avoid normative difficulties. The second objective is to introduce a kind of `reality principle' (through two other evaluation criteria) in order to mitigate the normative requirement when examining adequate moods for non-EU decision making. The execution of the prophet Mani by the Sasanian king Bahram I received sharply different treatments in the historiography of three of the confessional groups of the Sasanian empire. Variously a persecuted prophet, a blasphemous lunatic or a sinister heresiarch the representations of this moment sought to establish its meaning in the context of communal narratives predicated on the claims of sacred history. Despite this, it is notable that Manichean, Christian and Perso-Arabic accounts clearly share features. This indicates not only (...) that Mani’s death became a site of competition between the constituent groups of the Sasanian empire, but that the internal historiographies of these groups were in some sense entwined, or at least sensitive to the historical claims made by their opponents. This is particularly relevant in the case of the Perso-Arabic narrative. This version, which almost certainly descends from a priestly Zoroastrian source, presents a picture of a confident priesthood stiffening the spine of a wavering king. It is contended that the source of this story was composed as a counterstrike in a historical debate in which Christian and Manichean authors had successfully propagated an image of Bahram’s court as religiously tepid and his priests as slanderers or non-entities. That such an intervention was required signals a disjuncture between early and late forms of Sasanian ideology. Moreover, it presents more evidence in support of theories of a late and deliberate construction of Zoroastrian “orthodoxy”. (shrink)

Television regulation is increasingly Europeanized. While the transposition of community law into national legislation in EU member states has been widely discussed, scholarly attention is less frequently devoted to the Europeanization of non-member states. This paper investigates how television regulation in non-EU members has been influenced by European audiovisual policy since the liberalization of broadcasting. Focusing on the case of Switzerland and putting it into a wider context, changes in television regulation and their connection to the European level were analyzed (...) by performing a qualitative document analysis. Results indicate that the degree of Europeanization in Switzerland differs remarkably from other non-member states like Norway. While advertising regulation was brought in line with less-strict EU directives, a public value test or compliance with state aid rules were not even discussed. Yet similar to other non-members, rules were adopted without having a say in their development. (shrink)

Despite a constitutional and oft-stated political commitment to an undefined notion of non-racialism, South Africans continue to operate in formal and informal ways with ‘race’ as the common-sense organizing principle of legal systems, ways of thinking, social identities, constructing arguments or closing debate, organizational and mobilizing strategies, policy development and execution, and interaction in daily life. This state of affairs is regrettable and dangerous, often questioned and rejected, but objections are waged and alternatives suggested against the tide of societal trends. (...) What the organizing principle of race thinking does is to close the mind to alternative possibilities – of thought, social practice and ways of living. Here I explore an overview of racialism as it permeates and shapes the life cycles of citizens from birth to death. I make an argument for a way of thinking that is necessarily utopian, as one of few options of escaping a social world made in the image of apartheid. (shrink)

This work presents a computational interpretation of the construction process for cyclic linear logic and non-commutative logic sequential proofs. We assume a proof construction paradigm, based on a normalisation procedure known as focussing, which efficiently manages the non-determinism of the construction. Similarly to the commutative case, a new formulation of focussing for NL is used to introduce a general constraint-based technique in order to dealwith partial information during proof construction. The theme of this issue of Ethical Perspectives is the French tradition in liberal thought, and the unique contribution that this tradition can make to debates in contemporary liberalism. It is inspired by a colloquium held at the Katholieke Universiteit Leuven in December of 2008 entitled “In Search of a Lost Liberalism: Constant, Tocqueville, and the singularity of French Liberalism.” This colloquium was held in conjunction with the retirement of Leuven professor and former Dean of the Institute of Philosophy, André (...) Van de Putte, who found much inspiration in this tradition. A revised version of his valedictory lecture from the conference serves as the final contribution to this issue. Much contemporary liberal political philosophy is currently done in conversation with a line of liberal thinkers starting with John Locke, running through Immanuel Kant and John Stuart Mill, and culminating in the work of John Rawls and his followers. The reasons for the enormous appeal of this philosophical tradition are, among other things, the combination of the central role of the intuitively appealing value of individual liberty with a strong rationalistic, universalistic, and normative character. The thread running through most of these liberal theories is a commitment to what the French liberal Benjamin Constant referred to as “the liberty of the moderns,” that is, liberty in a negative sense, as a lack of interference in one’s activity from others and from government. This focus has expanded over time to include a richer body of civil, political, social, economic and cultural rights, for instance, in the work of liberal thinkers who have tried to integrate the insights of communitarian thought and discourse ethics in their work. However, the emphasis on individual liberty in the negative sense continues to be the normative and theoretical touchstone and default position for many contemporary liberal theories. The limitation of the canon of liberal thought to the aforementioned authors and themes deprives the contemporary debate of a rich source of ideas: the French liberal tradition. Montesquieu, considered to be the father of this tradition, provides a good example of how it can enrich current debates in liberal theory. Montesquieu’s work evinces a keen eye for the dynamics of power relations and the limitations of the power of the better rational argument. His insight that power can sometimes only be checked by an equal and opposing power, so that a system of separation and balance of powers is necessary in order to preserve liberty, is reflected in the foundations of most modern democracies. Montesquieu also argues that contingent environmental, historical, social and economic conditions play a dramatic role in determining what kind of government is appropriate for a particular society. On his view, ignoring these facts when framing a government can inadvertently end in despotism. Montesquieu’s observations challenge us to reexamine some of contemporary liberalism’s universalist and rationalist claims. Benjamin Constant is most famous for his distinction between two kinds of liberty: the liberty of the ancients and the liberty of the moderns. The ancient form of liberty manifested itself in the active political participation of citizens in the ancient republic. While this form of government and decision-making was suitable for small, homogeneous city-states, Constant argues that it is impracticable for large modern nation-states. Hence, the concept of modern liberty shifts to an emphasis on the rule of law and the non-interference of the state in private matters. This form of liberty is familiar to us from contemporary liberalism – and Constant cherishes this form of freedom as much as any liberal does today. However, his position is complex: he also argues that the liberty of the ancients should not be neglected. Active political participation is needed to ensure that the government is executing its duty of preserving the modern form of liberty by publicly pointing out violations. The contemporary relevance of Constant’s work is clear when we consider the alleged “democratic deficit” that plagues the EU and international institutions such as the UN, the IMF, and the World Bank. Not only does this democratic deficit threaten the modern form of liberty by placing decision-making processes out of sight of the people, it also threatens citizens’ sense of self-respect derived from self-governance. Constant’s argument for the necessity of combining the liberty of the ancients with that of the moderns provides a fruitful resource for confronting these contemporary issues. Tocqueville’s work on liberalism benefits from his opportunity to observe a society founded on liberal democratic principles – the United States of America – in action. In his Democracy in America, he examines the social consequences, both intended and unintended, of building a society on ‘the equality of conditions’, as he defines ‘democracy’. Tocqueville sees a tension between the democratic value of equality and the aristocratic value of the rule of the best. He observes that democratic societies do not necessarily choose the best leaders and instead promote mediocrity instead of virtue, talent, and excellence. Democracy also confronts citizens with the threat of ‘soft despotism’, where a government that preserves the outer signs of the liberty of the moderns nevertheless controls the behavior of its citizens in minute detail through a system of detailed rules ostensibly aimed at their welfare. This paternalism is an even more insidious threat to liberal values than the hard variety of despotism, since it is so difficult to detect and done in the name of liberal values themselves. Taking Tocqueville’s observations seriously would add complexity to attempts to theorize about the modern social-democratic welfare state. The contributions to this issue supplement and critique mainstream liberal thought and its relation to contemporary issues through a serious engagement with the French liberal tradition. Annelien De Dijn’s contribution discusses Bertrand de Jouvenel, a lesser-known 20th Century representative of the French political tradition she terms ‘aristocratic liberalism’. This tradition has its roots in the work of Montesquieu, and emphasizes the importance of intermediary bodies, most importantly the aristocracy, in providing a check to the top-down power of despotic state authorities and the bottom-up power of revolutionary leveling tendencies, both of which threaten liberty. De Dijn situates Jouvenel in this tradition, but then indicates an important difference between his thought and that of his predecessors: his most significant work, On Power, is not only on French history, but on European history. Pointing to the enthusiastic reception of this work in the Anglophone world, she suggests that the rise of totalitarianism in Europe gave the anti-totalitarian features of aristocratic liberalism a broader appeal. Valentino Lumowa’s paper concerns Constant’s classic text, The Liberty of the Ancients Compared with that of the Moderns. Lumowa argues that in order to understand Constant’s piece, we must be aware that its two parts were written under different historical circumstances and decipher the argumentative thrust inherent in the text. Following Stephen Holmes, he argues that to understand the shift Constant made in the second part of the text, we should read it within the context of the increasing influence of the ultra-Royalists in the legislature during the Bourbon Restoration. However, in contrast to Holmes, he contends that the spirit of both civic and individual freedom, which enlivens representative system, is the backbone of the text in its unity. Demin Duan’s essay investigates an apparent ambivalence between liberal and imperialist tendencies in the work of Alexis de Tocqueville, which has already drawn some attention from Tocquevillian scholars. These interpretations of Tocqueville and his writings on empire generally agree that Tocqueville stands in a recognized tradition of liberalism, which is characterized by respect for human rights, individual freedom and a sense of universal humanism. On this standard view, Tocqueville’s support of imperialism represents nothing but an unfortunate breach of his own otherwise consistent liberal thinking. Duan’s article questions this standard position. By questioning the assumption of Tocqueville’s liberalism in the first place, he tries to gauge the influence of both the old republican tradition and the new liberal perspective on his thinking. In conclusion, he argues that Tocqueville’s overall thought, especially his notion of freedom, is very much informed by an old republican tradition. His support of French imperialism could be better understood from this perspective rather than be rendered simply as a deviation from liberal norms. Pawel Marczewski’s contribution is an attempt to show that Tocqueville’s conception of liberty transcends the divisions between negative and positive aspects of freedom. He begins by juxtaposing this conception with the opposition drawn by Constant between liberty of the ancients and liberty of the moderns. While Tocqueville and Constant shared a concern for the preservation of individual rights, Tocqueville was much more reluctant to accept the modern loss of the communal dimension of liberty. He did not accept the view that jouissances privées, private pleasures, are the main compensation that the modern world has to offer for the lost ancient treasure of political participation. The essay then looks into the relevance of Tocqueville’s standpoint for current debates between liberal defenders of negative freedom and republican advocates of freedom as non-domination. Participants on both sides of the debate seem to be so devoted to showing that their particular approach provides the best guarantees against actual and possible threats to liberty that they overlook the fact that their definitions of freedom remain significantly similar. By arguing that ‘to be free is to be guided by one’s own will’, contemporary republicans, as well as their liberal counterparts, move along the lines drawn by Constant towards private pleasures. By questioning the inevitability of this turn, Tocqueville provides us with a valuable contribution to these discussions in contemporary political philosophy. Finally, André Van de Putte’s contribution, an adaptation of his emeritus speech that closed the conference on French Liberalism, appeals to Tocqueville in order to draw attention to the importance of intermediary, dialogical bodies in mitigating the implicit despotic tendencies of the democratic drive to equality. In Tocqueville’s view, the transition from the feudal corporate inequality to democratic individual equality was not a clean break. Rather, this transition is a continual process of democratization that is driven by a desire for equality, or egalité des conditions. This dissolution of distinctions of estate, class and status has the unintended consequence of concentrating the diffuse power of these entities into a centralized state, which is responsible for ensuring the equality of all under the law. This process leaves increasingly isolated and atomized individuals to face the power of a monolithic state in defense of their freedom, and moves toward a soft, paternalistic despotism. Constant’s freedom of the moderns is not sufficient to protect individuals from this centralized power. Democracy also requires the political freedom of the ancients. Van de Putte argues for a system in which atomized individuals organize themselves into intermediary bodies that, in a Montesquieuian balance of powers, can enter into dialogue with each other and the state on more equitable terms. Van de Putte’s contribution closes with a plea for a conception of democracy as a regime of dialogue. (shrink)

For the first time since the end of the second World War, the United States were being attacked on their own territory, without prior notice, by a non-state military force which was globally organised, for religious and ideological reasons. The terrorist attacks planned and executed by the terrorist organisation Al-Qaeda on American military and civilian targets have reconfigured (...) the international security environment. The author remarks that the security of the European continent is inextricably linked to what happens outside its external borders. Transnational organized crime, illegal human trafficking, illegal migration, traffic of drug, weapons, ammunition and portable vectors, the proliferation of illegal trade of radioactive and other "sensible" technologies, the expansion of terrorist networks – they all represent threats to the Eastern border of Romania and concern the security of the EU Eastern neighbourhood. Automated neuropsychiatric batteries have been used in research and clinical practice, including for chronic diseases, such as Systemic Lupus Erythematosus. The Pediatric Automated Neuropsychological Assessment Metrics battery, originally developed for use in American-English speaking individuals, allows tracking of cognitive functions. It can be applied to people over 9 years old. The aim of this study was to translate and present initial validation data from the Ped-ANAM into Brazilian-Portuguese. We translated the battery according to Beaton’s guidelines. Psychometric properties were tested, internal (...) consistency was analyzed by Cronbach’s alpha coefficient, test-retest reliability by the intraclass correlation coefficient. Further, we measured the test execution speed at both times as a temporal stability. Principal component analysis was used for structural validity. Evidence of construct validity was assessed through assessment of the relationships with the Wechsler Intelligence Scales. All participants prior to the start of study related activities signed an informed consent form approved by the local ethics committee. A sample of 230 individuals [mean of age: 23 years; 65% females] was included; a subset of 51 individuals [mean of age: 18 years, 59% female] completed the Ped-ANAM twice to assess test-retest reliability, and another subset of 54 individuals [mean of age: 20.4 years; 67% female] completed the Wechsler Intelligence Scales for Children and Adult for assessment of the Ped-ANAM’s construct validity. Our results suggest that the internal consistency of the Ped-ANAM and its subtest test-retest reliability were excellent. There was no clustering in the Principal Components Analysis, suggestive of non-grouping of the evaluated variables. Construct validity assessment to the Wechsler Scales showed expected ranges of low to strong correlations. We concluded that, based on the results of this study, a cross-culturally validated Brazilian-Portuguese version of the Ped-ANAM has been developed and it is a reliable tool for the screening cognitive function. This article discusses the English construction variously known as Locative Inversion or Stylistic Inversion. It shows that the construction displays a unique ensemble of grammatical and usage properties that can be stated but not motivated through purely grammatical means. In search of an explanatory approach, an analysis is presented that draws on concepts of Artificial Intelligence, in particular plans viewed as complex mental attitudes. It is claimed that utterances of Locative Inversion are associated with a particular communicative plan on the (...) speaker's part that motivates the grammatical and usage properties of the construction where grammar alone cannot. The final section of the article presents corpus examples showing that Locative Inversion is indeed used in the contexts predicted by the plan associated with the construction. This result is both theoretically and methodologically significant, insofar as it constitutes a case where the grammatical properties of a syntactic construction are better explained through its typical conditions of use than through grammatical means proper. What sort of a model for education does pragmatism, after the manner of Charles Peirce's pragmaticism, offer? How would the infusion of a pragmatic mode of inquiry into (...) education affect the way teaching and learning are understood and practiced? rgen Habermas' response to the European Union democratic deficit calls for a minimal threshold of democratic legislation through an explicit constitutional founding. He defends a model of freedom as autonomous self-determination by proposing to tie basic rights in the EU to a univocal form of European-wide popular sovereignty. Instead of constructing a common European political identity, I appeal to the novel democratic potential of institutions in the EU such as the Open Method of Coordination for mediating overlapping sovereignties in accord (...) with freedom as non-domination. The concluding example of basic rights to effective participation for immigrants and permanent minorities illustrates the strengths of Iris Young's and James Bohman's republican views of non-domination over Habermas' call for a European-wide collective willing. The paper offers a survey of the debate on the introduction, in the Preamble of the Treaty establishing a Constitution for Europe, of references to God and Europe’s Christian tradition. It examines the question of European identity and values which motivates these proposals in relation to (1) the nature of the EU as an essentially political construction; (2) the issue of human rights in the EU; (3) the protection of cultural and religious diversity within the EU. The study shows that (...) the confessionalization of Europe promoted by strong churches on the Continent, which are legitimate actors of civil society, betray a failure to understand the logic of the European construction. To the extent to which they represent an attempt to secure a privileged position with respect to other religious or non-religious actors, they run against the functional principles and values of the Union. Several accounts of representation in cognitive systems have recently been proposed. These look for a theory that will establish how a representation comes to have a certain content, and how these representations are used by cognitive systems. Covariation accounts are unsatisfactory, as they make intelligent reasoning and cognition impossible. Cummins' interpretation-based account cannot explain the distinction between cognitive and non-cognitive systems, nor how certain cognitive representations appear to have intrinsic meaning. Cognitive systems can be defined as model-constructers, or systems that (...) use information from interpreted models as arguments in the functions they execute. An account based on this definition solves many of the problems raised by the earlier proposals. (shrink)

Dans le présent article, nous examinons la façon dont la coutume et le droit coutumier ont été construits par les juristes britanniques durant l’époque colonial en Inde à la fin du xviiie et aux xixe siècles. À travers l’explication de la transmission juridique, nous analysons les arguments théoriques employés par John Austin et Sumner Maine dans leur définition du droit en tant que « commandement du souverain ». Tout en décrivant les tentatives administratives coloniales de codification des droits coutumiers dans (...) le sous-continent indien, nous argumentons que deux voies de pensée ont dominé dans ce processus. D’un côté, la codification était conçue dans la tradition du droit civil au xviiie siècle par la création des « digestes » des traités juridiques hindoues et musulmanes. De l’autre côté, la position dominante au xixe siècle a accentué la codification des pratiques coutumières existantes dérivées des études anthropologiques et des enquêtes réalisées dans les régions conquises par les Britanniques tels que le Pendjab. Quoi qu’il en soit, nous évaluons les aspects épistémologiques intrinsèques au discours colonial, qui ont été soutenus par une conception particulière de la souveraineté prémoderne en Inde. Ces idées du droit coutumier se sont élaborées non seulement à travers la logique du discours colonial mais aussi dans le cadre plus large de la science du droit et de l’autorité politique impliquées dans les débats européens au xixe siècle sur la codification du droit. Based on a critical reading of Jürgen Habermas’s journalistic writings on the European Union, the article argues that Europe’s current crisis is also a crisis of its narratives, and hence a crisis of meaning. The German philosopher has revised his political vision of a united Europe but has done so without abandoning his neo-Kantian ‘soft revolutionism’. The EU of the future is not only envisaged as an alternative to the allegedly defunct European nation-state, but also as the antithesis to US-style (...) federalism and to what is called ‘post-democratic executive federalism’. What is more, Habermas no longer fully trusts in the power of the better argument, as championed in his critical social theory. Instead, his hope of normative progress towards a socially and politically more integrated Europe is founded on a belief in the power of the crisis itself – aided by a convincing pro-European narrative – to drive us in the same direction as that indicated by reason. The conclusion contrasts Habermas’s utopian Europeanism, which has failed to find favour with the wider European public, with a less utopian alternative inspired by the highly specific, non-universal situation of the Old Continent. Or, il ľà des insights inconscients, áľœuvre par exemple dans ľacquisition des réflexes conditionnels, des habiletés motrices (...) et de certaines réactions pathologiques. Conscient ou inconscient, ľinsight implique un groupement sľstématique des données sensorielles, non plus considérées isolément, mais mises en relation les unes avec les autrès.La manifestation la plus simple ?insight est la construction ?un champ cognitif qui choisit et groupe les données élémentaires, et fait répondre, non plus à ces données séparément, mais à leur groupement. Le cognitive field peut demeurer purement cognitif. II prend le nom de champ intégratif lorsqu'il exerce une influence régulatrice sur le comportement. Ces champs intégratifs ne restent pas isolés. lis interfèrent et se combinent entre eux, par exemple dans ľaction à long terme, par un processus de résonance ou ?induction mutuelle. Ceci joue notamment dans les cas ou ľindividu fait des plans relativement à un but éloigné. Une induction mutuelle s'établit alors entre le champ de ľimagination et celui de la réalité et de la perception.Champs cognitifs et intégratifs sont activeés par des pressions motivationnelles ?intensité variable. II faut ici distinguer entre pressions purement négatives, qui poussent ľindividu àéchapper à un état de dissatisfaction et tendent à se décharger en activités musculaires diffuses, et pressions positives, stimulées par ľespoir et par la présence ou le souvenir ?une satisfaction possible dans ľenvironnement. Besoins et espoirs jouent dans le comportement un rôle complémentaire. Ľespoir substitue á la primitive décharge motrice caractéristique des besoins, une activité canalisée et orientée vers le but. Ceci, qui peut être inné dans les espèces animales inférieures, est chez ľhomme matière ?apprentissage. Pour atteindre un but, ľhomme doit apprendre á inhiber les décharges motrices originelles, et á leur substituer une conduite guidée par ľespoir, les mécanismes ?intégration et la construction de plans.Le succès de cette entreprise dépend de ľintensité de la pression motivationnelle. Si celle‐ci dépasse certaines limites , les mécanismes ?intégration et ?élaboration de plans sont rendus plus difficiles et Ľindividuperd la tête, c'est‐à‐dire que Ľinsight régulateur ne peut plus contrôler les décharges motrices. Comme c'est ľespoir du succès qui déclenche le travail ?intégration et de prévision, la capacityé?intégration ?un individu dans une circonstance donnée augmente en proportion de ses espoirs de succès et diminue en proportion de ses appréhensions ?échec.Ces considérations nous acheminent jusqu'aux réactions pathologiques, névrotiques et psychotiques, dont s'occupe la psychanalyse. _Riassunto_: Il dibattito contemporaneo sull’impatto causale degli stati mentali e delle decisioni consce sui fenomeni naturali e sociali fa largo uso di dati ricavati da test neurofisiologici e comportamentali, che esplorano il ruolo di processi cognitivi inconsci e interpretazioni post-hoc caratterizzate da intenzionalità dichiarativa. I dati neuroscientifici sono spesso utilizzati per sostenere una prospettiva fisicalista che privilegia il determinismo neurocognitivo rispetto alle discussioni sul libero arbitrio. Tuttavia, questa impostazione tende a ignorare, almeno parzialmente, il dibattito sui limiti epistemologici e tecnici (...) nella generazione dei dati e i pregiudizi filosofici insiti nelle interpretazioni. Questo lavoro evidenzia tali limiti, proponendo un’analisi filosofica della relazione complessa tra razionalità, esercizio del libero arbitrio e costruzione dell’identità personale. Distinguendo il concetto di scelta autentica da quello di impulso o spinta ad agire, si sostiene una concezione enattiva e fenomenologica dell’azione umana libera, offrendo così un’interpretazione del libero arbitrio che respinge l’eliminativismo come inadeguato. Rifiutando un dualismo semplicistico, il libero arbitrio viene definito come la capacità di una soggettività incarnata, situata ed enattiva di interagire con un ambiente naturale e sociale attraverso compiti che implicano processi stratificati di valutazione e decisione. In conclusione, si argomenta che, sebbene le scienze fisiche e psicologiche possano indagare le basi dell’esecuzione dell’azione, non sono in grado di risolvere né di spiegare l’aspetto più complesso del processo decisionale stratificato ed esteso. Questo riguarda la relazione intenzionale tra la persona, considerata nella sua interezza, e un mondo ricco di valori, che conferisce senso e orientamento alle scelte individuali. The role of person in decision-making_ _Abstract_: The contemporary debate on the causal impact of mental states and conscious decisions on natural and social phenomena extensively relies on data derived from neurophysiological and behavioral tests. These tests investigate the role of unconscious cognitive processes and post-hoc interpretations characterized by declarative intentionality. Neuroscientific data are often employed to support a physicalist perspective that prioritizes neurocognitive determinism over discussions of free will. However, this approach tends to partially overlook the epistemological and technical limitations inherent in data generation and the philosophical biases embedded in interpretations. This paper highlights these limitations by proposing a philosophical analysis of the complex relationship between rationality, the exercise of free will, and the construction of personal identity. By distinguishing the concept of genuine choice from that of impulse or urge to act, it advocates for an enactive and phenomenological conception of human free action, offering an interpretation of free will that rejects eliminativism as inadequate. Rejecting a simplistic dualism, free will is defined as the capacity of an embodied, situated, and enactive subjectivity to engage with a natural and social environment through tasks involving layered processes of evaluation and decision-making. In conclusion, it is argued that while physical and psychological sciences may explore the foundations of action execution, they cannot resolve nor explain the more complex aspect of the stratified and extended decision-making process. Cet article vise à réintégrer la question du langage intérieur dans les idées linguistiques de l’énonciation, notamment celles sur le mode de signifiance et l’opération énonciative. En nous référant aux études de Benveniste, de Merleau-Ponty et de Culioli, nous examinons dans quelle mesure le langage intérieur se distingue du monologue intérieur au sens de se parler à soi-même : ce langage intérieur en tant qu’expression pure et naturelle du sens général, implique une réflexivité non consciente et non verbale, dans la (...) genèse du sens ainsi que dans la construction dynamique des formes discursives. Eu égard à ces valeurs, nous procédons à l’analyse énonciative du discours littéraire de la conscience. Plusieurs faits de discours, liés à la non-coïncidence entre le mot et la chose vécue dans la conscience, tels que la nomination, l’indéfinition, la négation, manifestent les traces du langage intérieur global, non construit, inconscient et silencieux, qui mobilise le langage extériorisé. Underpinned by the polemical idea that governments have redefined their role as a penal actor that prioritizes the practices of repressing, punishing, and confining people (instead of tackling the very complex root causes), this study scrutinizes how the press discursively collaborates with the State in ‘governing through crime’ (Simon, J. (2007). Governing through crime: How the war on crime transformed American democracy and created a culture of fear. Oxford University Press.). Drawing upon a corpus of Thai newspapers, the study analyzes (...) representational choices and identifies polarizing strategies in execution reports that serve to legitimize and neutralize the harshness of executions. The findings reveal that state-inflicted violence is mystified and downplayed by agent suppression and non-aggressive, judicially administered material processes. In contrast, executed individuals are dehumanized and their agency in sensational material processes foregrounded, which in turn constructs ideal victims. It is argued that this exaggerated, at times disturbing, dichotomy between ‘us’ and ‘them’ serves to project an image of the State as the champion of citizens’ and victims’ interests. A shift from the use of fault-assigning and consequence-imposing discourses to more holistic ones that attend to offenders’ and victims’ commonalitiesshould be adopted. (shrink)

An adequate theory of the nature of belief should help us explain the most obvious features of belief as we find it. Among these features are: guiding action and reasoning non-inferentially; varying in strength in ways that are spontaneously experience-sensitive; ‘aiming at truth’ in some sense and being evaluable in terms of correctness and warrant; possessing inertia across time and constancy across contexts; sustaining expectations in a manner mediated by propositional content; shaping the formation and execution of plans; generalizing spontaneously (...) projectively; and being independent of the will and resisting instrumentalization. Using the method of ‘creature construction’, I attempt to show how we can build an attitude with these features step-by-step from simpler components, thereby avoiding the problems of regress or circularity affecting a number of influential accounts of belief. This article argues that the courts, not the Home Secretary, should be empowered to issue Terrorism Prevention and Investigation Measures. It explains that at the heart of the debate are three questions: whether measures like TPIMs should be viewed primarily from the perspective of security or liberty; how we should conceive the executive and the courts; and the empirical question of how these two arms of government answer these questions. The non-mechanistic nature of legal reasoning means that legal reasons (...) may be constructed to fit one’s normative viewpoint on each of the first two questions. Importantly, however, the case law on judicial scrutiny of control orders consistently demonstrates that the courts themselves regard TPIMs as being primarily a restriction on liberty, which require a fair hearing before an independent court. Whilst this does provide some protection of individual rights, the nature of law as an unfinished practice means that for stable protection of individual rights judicial independence must be promoted and nurtured in both the legal and political realms. The failure of the Terrorism Prevention and Investigation Measures Act 2011 to vest the power to issue TPIMs in the courts thus represents a missed opportunity to secure political endorsement of enhanced legal protection of individual liberty in cases involving national security. The significance of private standards and associated local level initiatives in agri-food value chains are increasingly recognised. However whilst issues related to compliance and impact at the smallholder or worker level have frequently been analysed, the governance implications in terms of how private standards affect national level institutions, public, private and non-governmental, have had less attention. This article applies an extended value chain framework for critical analysis of Private Standards Initiatives (PSIs) in agrifood chains, drawing on primary research on PSIs (...) operating in Kenyan horticulture (Horticulture Ethical Business Initiative and KenyaGAP). The paper explores the legislative, executive and judicial aspects of governance in these southern PSIs highlighting how different stakeholders shape debates and act with agency. It is argued that governance is exercised ‘beyond the vertical’ in that one can identify wider horizontal processes of governance, including how the scope of key debates is constructed (especially in legislative governance) but analysis of executive governance emphasises the dominant role of the lead buyers. En visant des données non-standard illustrant ce qu’il est de coutume d’appeler « parler jeune », MPF repose sur une réflexion quant à la façon d’appréhender les situations propices à leur émergence, au-delà d’informations généralement retenues, d’ordres sociodémographiques ou ethniques, ou du degré de formalisme de l’échange. Si ces considérations ne sont évidemment pas évacuées, (...) elles sont combinées à d’autres qui concernent les effets de la relation entre locuteurs au moment de l’enregistrement. The necessary but not sufficient conditions for biological informational concepts like signs, symbols, memories, instructions, and messages are (1) an object or referent that the information is about, (2) a physical embodiment or vehicle that stands for what the information is about (the object), and (3) an interpreter or agent that separates the referent information from the vehicle’s material structure, and that establishes the stands-for relation. This separation is named the epistemic cut, and explaining clearly how the stands-for relation is (...) realized is named the symbol-matter problem. (4) A necessary physical condition is that all informational vehicles are material boundary conditions or constraints acting on the lawful dynamics of local systems. It is useful to define a dependency hierarchy of information types: (1) syntactic information (i.e., communication theory), (2) heritable information acquired by variation and natural selection, (3) non-heritable learned or creative information, and (4) measured physical information in the context of natural laws. High information storage capacity is most reliably implemented by discrete linear sequences of non-dynamic vehicles, while the execution of information for control and construction is a non-holonomic dynamic process. The first epistemic cut occurs in self-replication. The first interpretation of base sequence information is by protein folding; the last interpretation of base sequence information is by natural selection. Evolution has evolved senses and nervous systems that acquire non-heritable information, and only very recently after billions of years, the competence for human language. Genetic and human languages are the only known complete general purpose languages. They have fundamental properties in common, but are entirely different in their acquisition, storage and interpretation. (shrink)

This study investigated the roles of the executive functions of inhibition and switching, and of verbal and visuo-spatial working memory capacities, in insight and non-insight tasks. A total of 18 insight tasks, 10 non-insight tasks, and measures of individual differences in working memory capacities, switching, and inhibition were administered to 120 participants. Performance on insight problems was not linked with executive functions of inhibition or switching but was linked positively to measures of verbal and visuo-spatial working memory capacities. (...) Non-insight task performance was positively linked to the executive function of switching (but not to inhibition) and to verbal and visuo-spatial working memory capacities. These patterns regarding executive functions were maintained when the insight and non-insight composites were split into verbal and spatial insight and non-insight composite scores. This paper provides a constructive topological semantics for non-deducibility of a first order intuitionistic formula. Formal topology theory, in particular the recently introduced notion of a binary positivity predicate, and co-induction are two needful tools.

Salman Rushdie posed the question, ?What kind of idea are you?? We have borrowed his provoking question and held it up to ?Europe.? In this article, we suggest that ?Europe? cannot be primarily identified or located in terms of geographies, histories, religions, cultures or values, and that attempts to do so diminish the idea of ?Europe.? We also contest the vision of ?Europe? as a series of concentric circles emanating from Brussels and suggest that this conception indefensibly marginalizes vital portions (...) of ?Europe.? We propose that, while the European Union (EU) is attempting to define core concepts of ?Europe,? ?Europe's? frontiers and borders (wherever or whatever they may be, inside or outside ?Europe?) are actively constructing, contesting and resisting ?Europe.? The peripheries and perimeters are no less important than the core. On the contrary, they give substance to the idea of ?Europe.? Finally, we argue that ?Europe? can best be understood as a non-teleological construct, a narrative à la Roland Barthes. Inspired by Barthes, we propose a ?Europe? Theory of Classification operating at the levels of functions, actions and narration. (shrink)

Consciousness as used here, refers to the private, subjective experience of being aware of our perceptions, thoughts, feelings, actions, memories including the intimate experience of a unified self with the capacity to generate and control actions and psychological contents. This compelling, intuitive consciousness-centric account has, and continues to shape folk and scientific accounts of psychology and human behavior. Over the last 30 years, research from the cognitive neurosciences has challenged this intuitive social construct account when providing a neurocognitive architecture for (...) a human psychology. Growing evidence suggests that the executive functions typically attributed to the experience of consciousness are carried out competently, backstage and outside subjective awareness by a myriad of fast, efficient non-conscious brain systems. While it remains unclear how and where the experience of consciousness is generated in the brain, we suggested that the traditional intuitive explanation that consciousness is causally efficacious is wrong-headed when providing a cognitive neuroscientific account of human psychology. Notwithstanding the compelling 1st-person experience that convinces us that subjective awareness is the mental curator of our actions and thoughts, we argue that the best framework for building a scientific account is to be consistent with the biophysical causal dependency of prior neural processes. From a 3rd person perspective,, we propose that subjective awareness lacking causal influence, is than our experience of being aware, our awareness of our psychological content, knowing that we are aware, and the belief that that such experiences are evidence of an agentive capacity shared by others. While the human mind can be described as comprising both conscious and nonconscious aspects, both ultimately depend on neural process in the brain. In arguing for the counter-intuitive epiphenomenal perspective, we suggest that a scientific approach considers all mental aspects of mind including consciousness in terms of their underlying, preceding biological changes, in the realization that most brain processes are not accompanied by any discernible change in subjective awareness. Hallucinatory states are experienced not only in connection with drugs and psychopathologies but occur naturally and spontaneously across the human circadian cycle: Our nightly dreams bring multimodal experiences in the absence of adequate external stimuli. The current study proposes a new, tighter measure of these hallucinatory states: Sleep onset, REM sleep, and non-REM sleep are shown to differ with regard to motor imagery indicating interactions with a rich imaginative world, and cognitive agency that could enable sleepers to recognize their hallucinatory (...) state. Mentation reports from the different states were analysed quantitatively with regard to two grammatical–semantic constructs, motor agency and cognitive agency. The present results support earlier physiological and psychological evidence in revealing a decline in cognitive functions and an increase in simulated interactions with a hallucinatory world, en route to normal REM sleep. This leads us to introduce the hypothesis that REM sleep, which exhibits remarkably high levels of sensorimotor processes, may have evolved to serve as a virtual laboratory for the development and rehearsal of embodied cognition. The new measure of hallucinatory states presented here may also hold implications for the study of executive functions and cognitions, which might be interesting, for example, for the investigation of lucid dreaming. The Cameron government has recently negotiated a deal with the EU which permits the UK to restrict access to in-work benefits for recent EU migrants in the first four years of residence. Withdrawing access to in-work benefits will lead to significant inequalities in pay between British workers and their EU equivalents working at the same job, in the same general situation. The proposal has been widely decried as discriminatory. Is it? I do not, in this article, ask the legal question: (...) Does it violate anti-discrimination norms implicit in the treaties? Rather, I will ask the moral question underlying the legal one: Would, say, Polish citizens denied in-work benefits that British citizens receive be victims of wrongful discrimination? This question deserves consideration not simply because it will help us to evaluate some of the central concerns at stake in the Brexit debates but also because it will allow us to explore the role of norms against discrimination according to nationality within the EU, to address the nature of the European commitment to freedom of movement, and, in the reverse direction, to better understand our own moral commitment to anti-discrimination norms.
