How does a biblical narrative shape the life and action of its readers ? This question is receiving a wide interest in contemporary theology. Reading the 'Bible as literature' has provided a renewed interest in the creation of meaning in biblical narrative. Moreover, there is a current of narrative theology and ethics, which views human life and action as a form of narrative. narrative is approached through the philosophy of Paul Ricoeur. The narrative theory of this hermeneutic philosopher offers the (...) means for comprehending the formative force of narrative, as well as the limits of narrative figuration. Ricoeur's interest in the relation between narrative and ethics and his view of the tensions between text and reader are applied to an interpretation of the biblical Joseph narrative from Genesis. The results of this interpretation are used to treat problems of narrative ethics and narrative theology. similarities between biblical narrative and the narrative of one's life, a narrative does not answer all problems for its readers. As a story of reconciliation and providence the Joseph narrative makes a strigent appeal of transformation to its readers. It is up to the reader to answer this call by reading for good. (shrink)

‘Justice’ is spoken of in two ways: the lawful and the fair. The law is a human construct that is devoted to the advantage of all, or to the advantage of the best, or to the advantage of those in power or to the advantage of those representing it – let it be the politician, the media, the TV presenter, the filmmaker. Thus, the law serves the production or the preservation of happiness within politics and business. The law commands us (...) to act according to the mean. A well-written law follows the mean well and a poorly written law does not. On the other hand, fairness is a principle sometimes materialised through the law and the given justice system. Fairness is the ultimate value pursued by both the common law and civil law traditions. However, its distribution through the law and the representation of this delivery varies. Does this mean that a different kind of justice is distributed? Through the teachings of Aristotle, this essay aims to deconstruct the notion of justice, by breaking down its two ingredients, the lawful and the fair, and by analysing the effect of their representation in modern European society. The relativity attached to the notion of justice is not a modern phenomenon, but a philosophical matter that can be analysed and indeed explained through the teachings of Aristotle and its contemporary students. The analysis will be developed in the context of convergent Europe, focusing on the role of the media and courts especially in relation to criminal justice. (shrink)

In earlier publications of the first author it was shown that intentional explanation of actions, functional explanation of biological traits and causal explanation of abnormal events share a common structure. They are called explanation by specification (of a goal, a biological function, an abnormal causal factor, respectively) as opposed to explanation by subsumption under a law. Explanation by specification is guided by a schematic train of thought, of which the argumentative steps not concerning questions were already shown to be (...) logically valid (elementary) arguments.Independently, the second author developed a new, inferential approach to erotetic logic, the logic of questions. In this approach arguments resulting in questions, with declarative sentences and/or other questions as premises, are analyzed, and validity of such arguments is defined. (shrink)

Why do agent-relative reasons have authority over us, reflective creatures? Reductive accounts base the normativity of agent-relative reasons on agent-neutral considerations like ‘having parents caring especially for their own children serves best the interests of all children’. Such accounts, however, beg the question about the source of normativity of agent-relative ways of reason-giving. In this paper, I argue for a non-reductive account of the reflective necessity of agent-relative concerns. Such an account will reveal an important structural complexity of practical reasoning (...) in general. Christine Korsgaard relates the rational binding force of practical reasons to the various identities or self-conceptions under which we value ourselves. The problem is that it is not clear why such self-conceptions would necessitate us rationally, given the fact that most of our identities are simply given. Perhaps, Harry Frankfurt is right in arguing that we are not only necessitated by reason, but also, and predominantly by what we love. I argue, however, that “the necessities of love” (in Frankfurt’s phrase) are not to be separated from, but should be seen as belonging to the necessities of reason. Our loves, concerns and related identities provide for a specific and important structure to practical reflection. They function on the background of reasoning, having a specific default role: they would lose their character as concerns, if there was a need for them to be cited on the foreground of deliberation or if there was a need to justify them. This does not mean that our deep concerns cannot be scrutinised. They can only be scrutinised in an indirect way, however, which explains their role in grounding the normativity of agent-relative reasons. It appears that this account can provide for a viable interpretation of Korsgaard’s argument about the foundational role of practical identities. (shrink)

"When a country legalizes active euthanasia, it puts itself on a slippery slope from where it may well go further downward." If true, this is a forceful argument in the battle of those who try to prevent euthanasia from becoming legal. The force of any slippery slope argument, however, is by definition limited by its reference to future developments which cannot empirically be sustained. Experience in the Netherlands—where a law regulating active euthanasia was accepted in April 2001—may shed light on (...) the strengths as well as the weaknesses of the slippery slope argument in the context of the euthanasia debate. This paper consists of three parts. First, it clarifies the Dutch legislation on euthanasia and explains the cultural context in which it originated. Second, it looks at the argument of the slippery slope. A logical and an empirical version are distinguished, and the latter, though philosophically less interesting, proves to be most relevant in the discussion on euthanasia. Thirdly, it addresses the question whether Dutch experiences in the process of legalizing euthanasia justify the fear of a slippery slope. In this article we will address the issue of obtaining insight into the way in which teachers deal with the normative side of their profession. We outline the problem that forms the context of our question (the difference in the meaning of good teaching in the process–product model and in ethical models) and we discuss Oser's discourse approach as a solution for that problem. His discourse approach appears to be a step forward, but at the same time leaves (...) class='Hi'>questions unanswered. As a contribution we introduce the concepts of pragmatic, ethical and moral. We show in what sense this conceptual framework provides a refinement of the discourse approach. (shrink)

Though the art of compromise, i.e. of settling differences by mutual concessions, is part of communal living on any level, we often think that there is something wrong in compromise, especially in cases where moral convictions are involved. A first reason for distrusting compromises on moral matters refers to the idea of integrity, understood in the basic sense of 'standing for something', especially standing for the values and causes that to some extent confer identity. The second reason points out the (...) objective nature of moral values, which seems to make them immune from negotiation and barter. If one sincerely holds some moral conviction to be true, than compromising on that belief must be a sign of serious confusion.In order to reach a better understanding of these two reasons, I analyse what is involved in personal integrity and how this relates to moral integrity. I argue that the search for moral integrity naturally brings us to the question of how one could accept moral compromises and still uphold the idea that moral values and principles have an objective authority over us. To address this question I will present a version of moral pluralism which tries to capture the enormous complexity of what should matter to us as moral persons, and which explains why value-rankings are often deeply indeterminate. The general position I defend in this paper is that compromises involving moral values and norms may be morally required and, therefore, be laudable. To sustain this position I will arrive at a view of ethical objectivity that allows the possibility to negotiate about the truth of moral beliefs. (shrink)

Managers are most likely to turn to the board of directors for guidance during a period of crisis. But can good corporate governance prevent an organization from reaching that critical point in the first place? In light of the recent global financial crisis, this question has become all the more pressing, and so to prevent future crises, we argue that corporate boards of directors need to be keenly aware of the potential social harms that might arise from the value-creating activities (...) of the firm they are tasked with monitoring. Boards of directors must be vigilant in understanding the firm’s value proposition, perceiving the potential harms that managers tend to overlook, and inserting themselves into the strategy-making process. We offer a typology of scenarios involving potential social harm and benefit and analyze when boards of directors must take a more active role in shaping firm strategy despite resistance from management. Medical research involving human subjects can be risky and burdensome. Therefore, such research must be reviewed and approved by a Research Ethics Committee (REC). To guarantee the safety of the subjects, it is very important that these studies be conducted in accordance with the approved protocol. An important issue in this respect is whether studies include the requisite number of subjects based on the research question. The research question is unlikely to be answered reliably if the requisite number of subjects (...) is not met. In such cases, subjects are exposed to unnecessary risks and burdens. In this descriptive study, the authors evaluated how frequently studies are completed with the required number of subjects. Moreover, the authors identified the characteristics of research that does and does not include the required number of subjects. The results of this study show that a considerable proportion of studies (41/107) were terminated although they failed to recruit a sufficient number of subjects. Furthermore, the authors found that investigator-initiated studies have significantly (p=0.028) more problems in recruiting the requisite number of subjects than studies initiated by pharmaceutical companies. Potential solutions are discussed to reduce the number of studies that do not include a sufficient number of subjects. (shrink)

IN CRITICALLY ANALYZING THE DEADLY VIPER CONTROVERSY AND MARY Queen of Vietnam Catholic Church's social activism in the aftermath of Hurricane Katrina, we consider questions concerning the ability of Asian Americans to participate in public discourse in meaningful ways that spur social change while fostering solidarity with other marginalized ethnic groups in the United States. Drawing on Christian theo-ethical reflection on the racial or social identity of Jesus as a hybridized concept, we argue for a robust public (...) discourse that recognizes Asian Americans as a social group without succumbing to the ghettoization of Asian American identity or a withdrawal from engagement with other justice-seeking social groups. In doing so, we look toward constructive modes of public discourse carried out by multiple counterpublics that both give voice to the Asian American community and open the space for collaboration across ethnic, racial, class, religious, and national boundaries. The meaning of this expression in Plato is clear: it is soul's ( psych é ), not god's the responsibility to choose a kind of life and its consequences. But, what is this, the soul? We start with that classic definition of soul in Plato, as moving principle and site of knowledge, but will not stop in it. What would be soul's origins? Based upon cosmogony refered to in Timeu , we shall attempt to evidence that formation and autonomy of human soul are affected by, or determined by demiurgical conditions: by existence of alogic precosmic elements, by interference in the regularity of cosmic cycles of the World Soul, by mimetic activity of secondary gods; and, above all, by the presence of an intelligent design ( nous) which operates in a teleological manner. Timeu's reading, besides explaining by cosmology the question of divine justice in Plato, will present an admirable ethical prototype, based upon notions of order and proportion to guide human choices, reinvigorating the platonic presupposition of the unavoidable responsibility that human being has about his fate. The relationship between ethics and science has been discussed within the framework of continuity versus discontinuity theories, each of which can take several forms. Continuity theorists claim that ethics is a science or at least that it has deep similarities with the modus operandi of science. Discontinuity theorists reject such equivalency, while at the same time many of them claim that ethics does deal with objective truths and universalizable statements, just not in the same sense as science does. I propose (...) here a third view of quasi-continuity (or, equivalently, quasi-discontinuity) that integrates ethics and science as equal partners toward the uncovering of new knowledge. In this third way, a program envisioned by William James but made practicable only by contemporary scientific advancement, science can and must inform ethics at a deep level, and ethical theory— while going beyond science—cannot do without it. In particular, I identify four areas of ethics-science collaboration: neurobiological research into the basis of moral judgment, comparative anthropol- ogy, comparative evolutionary biology of primates, and game-theo- retical modeling. I provide examples within each of these fields to show how they link to ethical theories (including prescriptive work) and questions. The essay concludes with a brief discussion of the light that a scientifically informed ethics can shed on some classical problems in moral theory, such as the relationships between rational- ity and selfishness, egoism and altruism, as well as the concept of social contract. A joint research program involving both philosophers and scientists is called for if we wish to move ethical theory into the twenty-first century. (shrink)

This article is a critique of Chinese public theologians with a particular focus on their Christological notions as ambivalent responses to Communist violence, a specific form of extreme violence in postcolonial China. The critique is historical as well as theological. As a historical inquiry, the problem of guerrilla warfare as a constant form of Communist violence is discussed, exploring its historical roots and philosophical manifestations. As a theological critique, it is demonstrated how this issue penetrates mainstream theo-political readings of (...) Christ in the formation of Chinese public theology. The article thus seeks to contribute to the moral reflections of the Chinese church and the critical response to a unique form of postcolonial violence for Christian ethics. (shrink)

In the times preceding the emergence of Neo-Platonism, the philosophers now known as Middle Platonists elaborated an extensive reflection on the possibility of knowing God, and the ways that could lead to acquiring knowledge about the transcendent. According to Plato, “To discover the Maker and Father of this Universe were a task indeed; and having discovered Him, to declare Him unto all men were a thing impossible” ​​. The Middle Platonists believed that God, whom they sometimes identified with the Platonic (...) One and Good, is possible to know but not possible to express. Even though the knowledge of God is accompanied by all the difficulties associated with the process of intellectual and ethical improvement, and although what one comes to know in this process is ultimately impossible to express in human language, gaining knowledge of God and becoming like Him is nevertheless the goal of all Platonic philosophy. Jewish and Christian thinkers working at this time came to similar conclusions. These include Philo of Alexandria, Clement of Alexandria, and Origen, who are themselves sometimes deemed Middle-Platonic philosophers. Unlike their pagan colleagues, they believed that man’s process of coming to know God would go on forever. They thought that the finite human mind would never be able to contain the infinite, and they held that the essence and power of God are indeed infinite. The goal of this article is to expose the relationship between the infinity and the unknowability of God, and at the same time to point out the differences in the theses put forward on this question by pagan Middle Platonists and those who accepted Judeo-Christian revelation. Abstract:Since Homeric times, psychotherapy has been an essential part of the medical act. Initially, the word of physicians had a magical character. Plato rationalizes this in many of his dialogues. In "Charmides," he dives deeper into this matter and proposes to apply it to every disease. Analysing this dialogue has fundamental consequences for psychotherapy: 1) Remedy and epodé (charm) must be applied in every doctor–patient relationship. 2) The body can only be healed if the soul is cured first by a (...) charm. Patients must "offer" their souls to the physician, which implies the need for confidence and the unavoidable asymmetry which characterize doctor–patient relationships. 3) The openness of the patient's soul to the physician and the physician's "beautiful speech" to the patient will enable the latter to reach the state of sophrosyne (temperance), the condition of the possibility of true health. In the discussion of the meaning of sophrosyne, Socrates questions every one of the disciples' propositions and concludes that the only thing one can be sure of is that sophrosyne is a way of searching for virtue (areté). Later, in Theaetetus, Plato adds another element: temperance is a homoiosis theó, that is, the assimilation of patient with God. With this, Plato seals the ethical character of psychotherapy forever. HIV/AIDS has changed from a disease of white gay men in the United States to a pandemic that largely involves women and dependent children in developing countries. Many theologies of disease are necessary to cope with the variety of expressions of this pandemic. Christian theoethical reflection on HIV/AIDS has been largely focused on sexual ethics, with uneven and mainly unhelpful results. Among the ethical issues that shape future useful conversations are globalized economics and resource sharing, the morality and economics (...) of the pharmaceutical industry, and the need for sex education and access to reproductive choice. Considering such issues in international, interreligious, multiscientific contexts is a concrete next step for the religion‐and‐science dialogue. Although increasing in usage, surrogacy remains the most controversial method of assisted reproductive technology. Many Christian ethicists have either objected tout court or expressed strong reservations about the practice. Behind much of this caution, however, lies essentialist assumptions about pregnant women or an overemphasis on the statistical minority of well-publicized disasters. The question remains whether Christian ethical reflection on surrogacy might change if informed by social scientific studies on the surrogacy triad. I offer a feminist Christian framework for surrogacy (...) comprised of seven principles drawn from this literature, the reproductive justice paradigm, human rights, and Reformed theo-ethical norms. I ultimately advance surrogacy under certain conditions as a moral good and focus on “altruistic” arrangements—including my own—without concluding that only non-commercial contracts could pass ethical muster. Ethics is highly relevant to grand technological interventions into basic planetary systems on a global scale (roughly, “geoengineering”). Focusing on climate engineering, this chapter identifies a large number of salient concerns (e.g., welfare, rights, justice, political legitimacy) but argues that early policy framings (e.g., emergency, global public good) often marginalize these and so avoid important questions of justification. It also suggests that, since it is widely held that geoengineering has become a serious option mainly because of political inertia, there (...) are important contextual issues, especially around the paradoxical question, “What should we do, ethically speaking, given that we have not done, and will continue not to do, what we should be doing?” Taking such issues seriously helps to explain why some regard geoengineering as ethically troubling and highlights the largely neglected threat of interventions that discriminate against future generations (“parochial geoengineering”). We should take seriously the risk that, far from being simply a welcome new tool for climate action, geoengineering may become yet another manifestation of the underlying problem. (shrink)

Recent corporate disgraces and corruption have heightened concerns about ethically questionable behavior in business. The construct of ethically questionable behavior is an under-portrayed area of management field research, and deserves further studying, especially in sales positions. This study uses four variables from the human resource management field to explain the ethically questionable behavior of sales representatives in the pharmaceutical industry. These variables include frame pattern, commission structure, behavior control type, and marketing norm perceptions. This work uses a 2  2 (...)  2  2 subject experimental design, and 328 fully completed questionnaires for logistic regression analysis. Results suggest that a medical representative in a loss frame, in a high commission structure, in loose behavior control, and in a low perception of marketing norm, is more likely affected by heuristic biases and make an ethically questionable choice. The legal system seems to have reached a position on this matter without obvious ethical reflection. Noting that a child should be able to know and relate to his or her parents, this article argues that a person's capacity to contribute to the conception of new life should cease with that person's death.

National electronic health record initiatives are in progress in many countries around the world but the debate about the ethical issues and how they are to be addressed remains overshadowed by other issues. The discourse to which all others are answerable is a technical discourse, even where matters of privacy and consent are concerned. Yet a focus on technical issues and a failure to think about ethics are cited as factors in the failure of the UK health record system. (...) In this paper, while the prime concern is the Australian Personally Controlled Electronic Health Record (PCEHR), the discussion is relevant to and informed by the international context. The authors draw attention to ethical and conceptual issues that have implications for the success or failure of electronic health records systems. Important ethical issues to consider as Australia moves towards a PCEHR system include: issues of equity that arise in the context of personal control, who benefits and who should pay, what are the legitimate uses of PCEHRs, and how we should implement privacy. This study was an exploratory investigation of ethically questionable behaviors among supervisees. Two hundred thirty supervisees and 97 supervisors completed an online survey containing 31 ethically questionable behaviors and 15 possible reasons supervisees engage in ethically questionable behaviors. Ethically questionable behaviors were rated for ethicality, and supervisees reported their relative frequency of personally engaging in the behavior. There was substantial agreement between supervisees and supervisors on the ethicality of the vast majority of ethically questionable behaviors. Reported frequencies among supervisees tended (...) to be low for the behaviors rated to be the most unethical and tended to increase as ethicality ratings increased. A number of possible reasons tended to be endorsed more frequently than others and were correlated with several ethically questionable behaviors. Implications for supervision are discussed. (shrink)

In recent decades there has been a great expansion in the number, size and influence of International Non-Governmental Organisations involved in international relief and development. These changes have led to increased scrutiny of such organisations, and this scrutiny, together with increasing reflection by INGOs themselves and their staff on their own practice, has helped to highlight a number of pressing ethical questions such organisations face, such as: should INGOs attempt to provide emergency assistance even when doing so risks (...) helping to fuel further conflict? How should INGOs manage any differences between their values and those of the people they seek to benefit? How open and honest should INGOs be about their own uncertainties and failures? This book consists of sustained reflections on such questions. It derives from a workshop held at Melbourne University in July 2007 that brought together a group of people – for the most part, reflective practitioners and moral and political philosophers – to discuss such questions. It explores honestly some of the current challenges and dilemmas that INGOs face, and also suggests some new ideas for meeting these challenges. Our hope is that the kind of explicit reflection on the ethical issues INGOs face exemplified in this publication will help to promote a wider debate about these issues, a debate that in turn will help INGO managers and others to make better, wiser, more ethically informed decisions. Throughout our history there are numerous cases of unheeded environmental warnings. This paper provides an overview of earlier era forewarnings, to illustrate how understanding of past responses to natural predicaments may help enhance future curriculum and policy discussions.

ZusammenfassungEthische Fragen der Pflegepraxis haben sich in den letzten Jahren zugespitzt. Sie sind häufig verbunden mit einer grundsätzlichen Sorge um eine kompetente und verantwortliche Pflege, die den Bedürfnissen von Patient*innen gerecht wird. Forschungen aus drei Jahrzehnten zeigen, dass strukturelle Beschränkungen, Konflikte mit Kolleg*innen, Patient*innen und Angehörigen sowie eine Managementorientierung und die Unsichtbarkeit der Pflegearbeit, Ursachen für die grundsätzlichen Sorgen sind. Sie führen zu moralischem Stress, fehlenden Beziehungen und einer Fragmentierung der Pflege. Teilweise reagieren Pflegende widerständig, indem sie beispielsweise die Regeln (...) beugen und eine passive „wait and see“ Position einnehmen. Einige Pflegende erheben ihre Stimme und suchen ein Klinisches Ethikkomitee auf. Klinische Ethikkomitees bieten eine Möglichkeit, die komplexen ethischen Fragen der Pflegepraxis zu thematisieren. Unquestionably, Restorative Justice (hereafter RJ) has finally gathered some real momentum. It has become a sine qua non topic in many national and international policy and statutory agendas. However, as the restorative practice expands to deal with crimes, ages and situations it has never addressed before (at least in its contemporary version), and as its application starts to make sense not only to national but also to regional and international bodies and fora, new theoretical problems are posed. In the fast-growing (...) literature many theories and Schools have been evoked to support RJ's claims. This paper will take the discussion a step back by looking at questions of meta-theoretical character. In particular, the paper will ask: Does RJ have a place in the “world of theories,” and if it does, then what kind of theory is it, and on what level should it be placed? Second, does RJ theory need a philosophy, and why? Finally, how can restorative practices be morally justified? (shrink)

This case for discussion highlights some of the ethical difficulties that may arise in the use of molecular typing techniques in the control of infectious diseases. Molecular typing techniques offer evidence (stronger than regular epidemiological exploration of sources and contacts) for claims about infection routes. Such evidence will mean that public health authorities need to think about how to respond ethically to causal responsibility for contagion. Many philosophers have attempted to answer the ‘ethical question’: can the ethical value of an artwork ever contribute to its aesthetic value, and if so, how? In this paper, I consider a methodological question that arises out of this discussion: should attempts to address the ethical question use analytic tools found in contemporary philosophical literature, art criticism, or some combination of the two? I concur with arguments proposed elsewhere, which suggest that art criticism has an important role (...) to play in addressing the ethical question. However, I argue that any fruitful attempt to answer the question must defend some particular way of understanding the ethical value of artworks, which suggests that we should address what I label the ‘art question’: what is the role and importance of art? This question, I suggest, is one with which philosophers can usefully engage. This division of labour offers a way forward in addressing this important issue. (shrink)

As a result of the publicly funded Human Genome Project (HGP), and an increasing number of private enterprises, a new form of eugenic theory and practice has emerged, differing from previous manifestations. Genetic testing has become a consumer service that may now be purchased at greatly reduced cost. While the old eugenics was pseudoscientific, the new eugenics is firmly based on DNA research. While the old eugenics focused on societal measures against the individual, the new eugenics emphasizes the family as (...) a control agent. Eugenics is now voluntary, with the promise of abortion for those afraid of producing genetically damaged children. The ethical concepts of beneficence, avoidance of maleficence, autonomy, and equity are discussed in terms of aspects of the HGP. One major issue is the need for an ethical system available to health consumers that will empower them and assist in their biogenic decisions. “The concentration on the genes implicated in cancer is only a special case of a general genomania (emphasis added) that surfaces in ... the weekly announcements in The New York Times of the location of yet another gene for another disease. The revealing rhetoric of this publicity is always the same; only the blanks need to be filled in: ‘It was announced today by scientists at [Harvard, Vanderbilt, Stanford] Medical School that a gene responsible for [some, many, a common form of] [schizophrenia, Alzheimer’s, arteriosclerosis, prostate cancer] has been located and its DNA sequence determined. This exciting research, say scientists, is the first step in what may eventually turn out to be a possible cure for this disease.’”. (shrink)

We examine an article of Paul Ricoeur on autonomy and vulnerability. Ricoeur presents the two notions in the field of justice as intricately woven into each other. He analyzes their interdependence on three levels of human agency. Ricoeur’s exposition has a focus on judicial judgment. After presenting Ricoeur’s argument and an analysis of his main points, the author argues that Ricoeur’s reflection lines up with some essential intentions of care ethics. The new field of neuroethics has recently emerged following unprecedented developments in the neurosciences. Neuroimaging and cognitive enhancement in particular are demanding ethical debate. For example, neuroscientists are able to measure, with increasing accuracy, intimate personal biases and thoughts as they occur in the brain. Smart drugs are now available that can effectively and safely enhance mental functioning in both healthy and clinical populations. This article describes the scientific principles behind these technologies, and urges the development of ethical (...) principles based on a clear understanding of them. In 1992, when Li Yinhe and I had completed our collaborative study of male homosexuality in China, we published a monograph and wrote a few articles. We remained in touch with some of the friends we had made in the course of the research, and also received many letters from readers. Over the past few years, even though we have not carried out any more detailed research into it, we have been constantly thinking about this social issue.

Wer stellt die Angemessenheit der Psychopharmakagabe im Bedarfsfalle fest? Der vorliegende Beitrag diskutiert ethische Probleme im Zusammenhang mit der Psychopharmakagabe, aber auch Alltagsverrichtungen im Altenpflegheim, die oftmals durch Konflikte zwischen den Fürsorgepflichten und Verantwortlichkeiten der Pflegenden für die alten Menschen geprägt sind und (...) ihren Bemühungen, der individuellen Autonomie der Heimbewohnerin bzw. -bewohners gerecht zu werden. Für viele Probleme im Altenpflegeheim bieten sich keine raschen, einfachen Lösungen an. Der Blick auf einen individuellen Menschen und seine Bedürfnisse und Rechte verlangt neben der professionellen Fortbildung eine beständige Auseinandersetzung mit moralischen Handlungsbegründungen. Der offene Austausch im geschützten Raum einer Ethik-Beratung kann die ethische Entscheidungskultur fördern und transparent machen und damit zur Zufriedenheit und zum Wohlergehen aller beitragen. As more young people feel safe to outwardly identify as transgender or gender expansive (TGE), meaning that their gender identity does not align with the sex they were assigned at birth, an increasing number of youth who identify as TGE seek gender-affirming medical care (GAMC). GAMC raises a number of ethical questions, such as the capacity of a minor to assent or consent, the role of parents or legal guardians in decisions about treatment, and implications for equitable access (...) to care when differing parental or custodial viewpoints are present. These questions are further complicated by the difficulties in explaining the limits of long-term research in GAMC, with regard to the preservation of fertility, for example. We present two de-identified composite case studies to highlight dilemmas that may arise and offer recommendations to better support patient- and family-centered decision making for GAMC. These include employing a multidisciplinUniverary shared decision-making approach, disentangling informed consent and assent from chronological age, developing a consistent approach to the assessment of decisional capacity, and developing age-appropriate informational materials. ABSTRACT:A fundamental question of global business ethics is, “When moral business conduct standards conflict across borders, whose standards should prevail?” Western scholarship and practice tends to depict home country standards as “higher” or more “restrictive” or “well-ordered” than the “lower” standards of emerging market actors. As much as the question appears culturally neutral, many who ask it do so with a culturally-specific lens shaped by prevailing conditions of Western economic strength. However, the dominant economic powers of the future are not (...) likely to be the same North American and Western European markets that have reigned supreme in the recent past. As corporations increasingly re-examine their political roles in global governance, we need also to re-examine the moral authority of global ethical norms so they do not merely reflect the dominant ideologies of the most economically powerful market actors. Current research has identified five discrete US negotiation tactics, a traditional one considered to be ethical, and four considered to be ethically questionable. Scholars have independently used culture to explain how the endorsement of these five negotiation tactics varies across nations. They have also independently used interpersonal trust and ethics propensity to explain antecedents of the endorsement of those five negotiation tactics. This research combines all those variables into one model that investigates the influence of horizontal and vertical individualism–collectivism, (...) ethical idealism, and trust propensity on employees’ attitudes toward ethically questionable negotiation tactics in Israel and Kyrgyzstan. A survey questionnaire was translated from English to Hebrew and Kyrgyz, and 615 responses were collected from employees in various industries in the two countries. We empirically confirmed three types of questionable negotiation tactics discovered in previous one-nation studies, namely, pretending, deceiving, and lying. Vertical individualism was found to be positively, and horizontal collectivism was found to be negatively, related to pretending, deceiving, and lying. Ethical idealism was found to be negatively related to the endorsement of the lying tactics, while trust propensity was negatively related to the pretending tactics. Compared with Israel, employees’ endorsement of ethically questionable negotiation tactics was significantly higher in Kyrgyzstan. Contribution to theory and practice is discussed. (shrink)
