In this article, the author argues that it would be valuable to look into less paradigmatic manifestations of forgiveness in schools, that is, pedagogical approaches that acknowledge the complexity of forgiveness in socio-political contexts ? namely, how forgiveness might be ambivalent, intermingled with both positive and negative emotions, and concerned with the standpoints of both the victim who offers forgiveness and the perpetrator who seeks forgiveness. The meaning and value of ambivalent forgiveness is presented through an extended reflection on a (...) vignette from the author's ethnographic research on forgiveness in a troubled society ? his home country, Cyprus. The vignette will highlight the complexity of forgiveness and provide a specific instance where traditional models of interpersonal forgiveness may fail or, at the very least, need to be expanded to account for the socio-political or inter-group dynamics. This article ends with a discussion of the pedagogical implications of the notion of ambivalent forgiveness for troubled societies. (shrink)

The Trouble with America critiques the theory and practice of American government—government too weak to solve our public problems, restrained more in its ability to do good than in its ability to do harm, and grossly unfair to the poor and middle classes. As a result, we Americans find ourselves with poor leadership, inadequate representation, failing policies, and a pathological culture.

In the wake of two decades in which postmodern theory has become very popular in university humanities and social science departments around the world, Gavin Kitching claims that postmodernism is causing harm to students intellectually. Postmodern theory has engaged the hearts and heads of the brightest students because of its apparent political and social radicalism. Yet Kitching writes: “At the heart of postmodernism is very poor, deeply confused, and misbegotten philosophy. As a result even the very best students who fall (...) under its sway produce radically incoherent ideas about language, meaning, truth, and reality.” This is not another conservative attack on postmodern theory. Rather, it is a carefully considered analysis from a dedicated university teacher who is convinced that we have gone terribly astray. He analyzes why typical postmodern theoretical approaches simply aren’t effective tools for dealing with the realities of people and their activities, and he describes the philosophical confusion that lies at the heart of the problem. This article focuses on the representation of youth as a key moment of transition in contemporary western societies, set between the dependent state of childhood and the supposed maturity and independence of adult status. Young people are viewed as gendered, racialized and sexualized beings who also occupy specific class locations, and are assumed to move through crucial points of transition as they leave full-time education and enter the job market, as well as the (hetero)sexual and marriage marketplaces. The article (...) examines some of the main discursive configurations and treatment regimes through which ‘troubled teens’ are constructed and managed, especially in relation to notions about disordered patterns of consumption and transition. The paper considers the moment of the ‘discovery’ of adolescence in the late nineteenth century, going on to examine young women's particular relationships to discourses around consumption in the contemporary British youth research literature, and to debates about ‘disrupted transitions’ and citizenship in the 1990s. The article ends with a brief examination of one approach to the ‘problem of troubled teens’ in the USA: Specialty Schools that offer a combination of educational, therapeutic and correctional regimes aimed at young people who have been identified in relation to various disorders of transition and consumption. J. S. Mill is typically thought of as a liberal utilitarian disciple of Jeremy Bentham, and in other readings as a modern Socratic or even a modern Epicurean. Mill and the Epicureans are alike in several respects: they theorize personal freedom and active character versus determinism and passivity, they oppose excessive love and praise friendship, and they are critical of traditional religiosity. In spite of these similarities, Mill and the Epicureans have a different conception of active character and citizenship, stemming (...) from a difference in first principles. Mill's philosopher does not share the Epicurean aim of untroubledness (ataraxia), and Mill accepts the demanding task of educating and regenerating a mass democratic society. Below, I assess Mill's troubled hedonism, that is, his acceptance of often intense and long-term mental perturbations, justified by a decidedly non-Epicurean social reform project. (shrink)

Genetic and other biotechnologies are starting to impact significantly upon society and individuals within it. Rose and Novas draw on an analysis of many patient groups to sketch out the broad notion of biocitizenship as a device for describing how the empowered and informed individual, group or network can engage with bioscience. In this paper, we examine critically the notion of biocitizenship, drawing on both sociological fieldwork that grounds the debate in the views of a large and varied group of (...) concerned actors. Using work within green politics, we identify shortcomings in the concept of biocitizenship as it has so far been explicated. The value assumptions lying behind an account of biocitizenship, and its tendency to see issues through a reductive lens, are examined. Alternative views of values and goals, which may undermine any alleged rights and duties, are explored using interviews and other ethnographic data that illustrates the complexity of the terrain. The reductive lens of biocitizenship is explored through contrast with the wider scope of concerns emanating from various sources, including many within green politics. If such complexities are not recognised, there is a danger that a concept of biocitizenship may serve to create and amplify inequalities. Problems with identity issues are key: the construction of identity is complex and many groups are explicitly rejecting the ‘biological’ label. We discuss the multiple relations of citizens with the biotech and pharmaceutical industries. Arguably, existing inequalities in power relationships, exploitation, commodification and ownership patterns are being perpetuated in novel ways through the new biosciences. We pose the question of whether it is possible to construct a concept of biocitizenship that overcomes these problems. (shrink)

The capacity of contemporary forensic genetics has rendered “race” into an interesting tool to produce clues about the identity of an unknown suspect. Whereas the conventional use of DNA profiling was primarily aimed at the individual suspect, more recently a shift of interest in forensic genetics has taken place, in which the population and the family to whom an unknown suspect allegedly belongs, has moved center stage. Making inferences about the phenotype or the family relations of this unknown suspect produces (...) suspect populations and families. We discuss the criminal investigation following the Marianne Vaatstra murder case in the Netherlands and the use of forensic technologies therein. It is in many ways an interesting case, but in this paper, we focus on how race surfaced in science and society. We show that race materializes neither in the technologies used nor in the bodies at stake. Rather, race emerges through a material semiotic relation that surfaces in the translation that occurs as humans and things move across sites. We argue that race is enacted, firstly, in the context of legislation as biology reduced to bodily characteristics; secondly, in the forensic analyses as patterns of absent presence; and, thirdly, in society as a process of phenotypic othering. What is the trouble with schools and why should we want to make ‘school trouble’? Schooling is implicated in the making of educational and social exclusions and inequalities as well as the making of particular sorts of students and teachers. For this reason schools are important sites of counter- or radical- politics. In this book, Deborah Youdell brings together theories of counter-politics and radical traditions in education to make sense of the politics of daily life inside schools and explores a (...) range of resources for thinking about and enacting political practices that make ‘school trouble’. The book offers a solid introduction to the much-debated issues of ‘intersectionality’ and the limits of identity politics and the relationship between schooling and the wider policy and political context. It pieces together a series of tools and tactics that might destabilize educational inequalities by unsettling the knowledges, meanings, practices, subjectivities and feelings that are normalized and privileged in the ‘business as usual’ of school life. Engaging with curriculum materials, teachers’ lesson plans and accounts of their pedagogy, and ethnographic observations of school practices, the book investigates a range of empirical examples of critical action in school, from overt political action pursued by educators to day-to-day pedagogic encounters between teachers and students. The book draws on the work of Michel Foucault, Judith Butler, Ernesto Laclau and Chantel Mouffe, and Gilles Deleuze and Felix Guattari to make sense of these practices and identify the political possibilities for educators who refuse to accept the everyday injustices and wide-reaching social inequalities that face us. _School Trouble_ appears at a moment of political and economic flux and uncertainty, and when the policy moves that have promoted markets and private sector involvement in education around the globe have been subject to intense scrutiny and critique. This book analyzes such symbolic designs of the modern troubled imagination as the conspiracy theory of society, deterministic concepts of identity and order, antisemitic obsessions, self-hatred, and the myth of the loss of roots. It offers, among other things, the unique East-Central European materials incorporated in a broad, imaginative synthesis and critique of contemporary social analysis.

The main aim of this dissertation is to examine whether or not Judith Butler’s feminist philosophy (Queer theory) can be interpreted as what Theodor W. Adorno called a dialectical or immanent critique of dialectics. The rationale behind this examination can be found in two essays published by Carrie Hull (1997) and Marcel Stoetzler (2005). In these essays, both authors suggest that Butler’s argument (Gender Trouble 1999[1990]) would benefit significantly from being juxtaposed with Adorno’s reconceptualisation of dialectics as ‘negative dialectics’ (Negative (...) Dialectics 1990[1966]). However, while Hull and Stoetzler provide convincing arguments, their claims are, at best, superficial. Thus, this dissertation addresses this particular lack in state-of-the-art by thoroughly examining Hull’s and Stoetzler’s suggested reading of Butler with Adorno (and vice versa). ; The first chapter deals exclusively with Adorno’s theoretical development and negative dialectics. It focuses on how Adorno’s general philosophical outlook can be interpreted as a critical enterprise aimed at correcting the ‘wrongness of the present’, to show how and where society, politics, or philosophy has failed to live up to what they claim to have achieved e.g. how the notion of a shared national identity fails to consider the diverseness of the individuals it encompasses. Adorno’s central issue is thus with ‘Identity Thinking’ (1990), a mode of thinking aimed at providing an account of everything from a unified perspective. ; The second chapter, as preparation for the third (on Butler), is divided into two shorter examinations of Michel Foucault and Jacques Derrida, two figures whose works have greatly inspired Butler. Foucault and Adorno converge around their shared criticism of social structures, which permits nothing but themselves. Derrida and Adorno converge in their shared mode of criticism that seeks to, in Derrida’s words, deconstruct a text or a theory from within. Hence, by juxtaposing Foucault’s and Derrida’s critical philosophies with Adorno’s negative dialectics, the notion that Butler can be juxtaposed with Adorno is secured by drawing a straight line from Butler’s theoretical inspirations. ; The third chapter engages in a close reading of Butler and subsequently (relying heavily on Hull and Stoetzler) in a critical reinterpretation that reads Butler not as an anti-dialectical thinker but instead as an ambiguous dialectical thinker. Butler interpreted this paves the way for reading Butler’s feminism firmly within Adorno’s negative dialectics. Adding Adorno’s account of materiality to Butler, while still keeping Butler’s criticism of feminism’s ‘totalizing gestures’ (1999) intact, makes it more apparent how Butler’s argument contains a materialist account and gives materiality a more prominent place in Butler’s argument. The lack of materiality in Butler has been criticised by other feminists (New Materialism) since the publication of Gender Trouble. Thus, by adding Adorno to Butler, this criticism is met head-on. ; The conclusion goes beyond the initial scope of the dissertation by showing how Butler, with Adorno, can be juxtaposed with those critics who want to turn contemporary feminism away from the notion that ‘everything is culture/language’ (Butler) and instead focus on materiality and matter (New Materialism; Karen Barad). By reading Butler not against but with New Materialism, the dichotomy between culture and nature turns into a productive difference rather than something that is an unsurmountable contradiction. In his justly celebrated Expert Political Judgment, Philip E. Tetlock evaluates the judgment of economic and political experts by rigorously testing their ability to make accurate predictions. He finds that ability profoundly limited, implying that expert judgment is virtually useless, if not worse. He concludes by proposing a project that would seek to improve experts' performance by holding them publicly accountable for their claims. But Tetlock's methods severely underestimate the value of expert opinion. Despite their notorious disagreements, experts have highly (...) pertinent information and advice in many areas of public policy. The main problem with experts is that political actors seize on their most extreme views in one direction or the other, and overlook their areas of general agreement and the core of relatively reliable information that they provide. Although Judith Butler’s theory of the performativity of gender has been highly influential in feminist theory, queer theory, cultural studies, and some areas of philosophy, it has yet to receive its due from critical social theorists. This oversight is especially problematic given the crucial insights into the study of power – a central concept for critical social theory – that can be gleaned from Butler’s work. Her analysis is somewhat unique among discussions of power in its attempt to theorize simultaneously (...) both the features of cultural domination in contemporary societies and the possibilities of resistance to and subversion of such domination. Although I will maintain here that this attempt is not entirely successful, I nevertheless argue that Butler’s account makes crucial contributions to a feminist critical theory of power; as a result, it merits much more serious attention from critical theorists. Many researchers from robotics, machine ethics, and adjacent fields seem to assume that norms represent good behavior that social robots should learn to benefit their users and society. We would like to complicate this view and present seven key troubles with norm-compliant robots: (1) norm biases, (2) paternalism (3) tyrannies of the majority, (4) pluralistic ignorance, (5) paths of least resistance, (6) outdated norms, and (7) technologically-induced norm change. Because discussions of why norm-compliant robots can be problematic are noticeably absent (...) from the robot and machine ethics literature, this paper fills an important research gap. A new generation of environmental satellites, the Sentinels, has recently been launched by the European Space Agency. Part of ESA’s Copernicus Programme, the sentinel mission has adopted an Open Data policy which intends to make different levels of data freely available via an online data hub. Sentinel data will support applications including land monitoring, emergency management and security and will thus form the evidence-base for a wide-range of local, regional, national and international decisions, from individual insurance claims to humanitarian interventions. (...) By providing ever more data streams for monitoring and managing the planet, the sentinels institute a novel mode of visibility in terms of resolution, coverage and frequency. At the same time, they are co-constitutive of the increasing datafication of the environment. In the entwinement of heavenly gaze and data visions, I want to recover the work of ‘data fictions’ in order to demystify notions of visibility and calculability associated with “earth observation” and trouble its unquestioned pursuit of total monitoring. The main response to the multiple crises besetting Western societis in the past decades has been the attempt of the academic and scientific as well as political circles to gain a sense of orientation—and of social cohesion—by two main modes of thinking: identity politics and evidence-based knowlegde. Regarding the latter, I argue that if scientific knowledge is reduced to facts, data and numbers, as the basis for political decisions without any alternatives, it would become a dogma propagating the truth—that is, (...) a new religion. Politicians will no longer have to struggle with other perspectives, once there is a consensus about following the line that “the numbers or the facts speak for themselves.” While many people would perhaps find in this new religion a guarantee of security in an insecure world, this sense would be illusionary. I argue that the role intellectuals should play in a spiritual crisis of this kind is paradoxically to cultivate a sense of more security by strengthening a culture of “insecureness” or docta ignorantia against the dogmas within science and religion. To create and encourage a new art of questioning and listening, and of learning to appreciate non-knowledge as the basis of coming together. This notion is found in the Greek and Christian as well as the Jewish tradition of European thought, and it continues in the works of modern thinkers such as Paul Ricoeur, Hermann Cohen, Martin Buber, Hartmut Rosa, and of philosophers who focus on the question of the ineffable. My aim is to present this quality of certainty within uncertainty by examples from different fields, including philosophy, art and psychotherapy, and to elaborate on the paradoxical question: does a troubled Geist need more trouble in order to help us find a sense of orientation through disorientation? This paper presents the findings of two surveys conducted in April 2003 of Chartered Life Underwriters (CLUs) and Chartered Financial Consultants (ChFCs) who are members of the Society of Financial Service Professionals. The first survey of 3000 CLUs and ChFCs – the life insurance industry’s most highly regarded professionals – was aimed at identifying the key ethical issues faced by professionals working in the life insurance industry today. A comparison of these findings with those of earlier studies conducted in (...) 1990 and 1995 suggests that while the key ethical issues facing those working in the life insurance business today are essentially the same as those encountered during industry’s highly troubled ethical environment of the early 1990s, these issues are perceived as presenting somewhat less serious problems than in the past. The second survey of 3000 CLUs and ChFCs was aimed at determining the extent to which these professionals perceive the industry created Insurance Marketplace Standards Association (IMSA) as having contributed to any change in the ethical environment that has taken place. The findings suggest that IMSA has played an important role in influencing senior managers to more strongly encourage and support ethical market conduct, a critical step in improving the industry’s ethical environment. Sea of Troubles shows teachers how literature and informational texts can work together to enhance each other and, by extension, enhance students’ abilities to critically think and respond to the sea of troubles that pervades society.

Like other forms of debris in terrestrial and marine environments, space debris prompts questions about how we can live with the material remains of technological endeavors past and yet to come. Although techno-societies fundamentally rely on space infrastructures, they so far have failed to address the infrastructural challenge of debris. Only very recently has the awareness of space debris as a severe risk to both space and Earth infrastructures increased within the space community. One reason for this is the (...) renewed momentum of interplanetary space exploration, including the colonization of the Moon and Mars, which is part of transhumanist and commercially driven dreams of the so-called New Space age. Understanding space infrastructures as inherently linked to earthly infrastructure, we attend to the ways in which space debris, a once accepted by-product of scientific-technological progress, economic interests, and geopolitics, increasingly becomes a matter of concern. Drawing on qualitative interviews with European space sector representatives and work in Science and Technology Studies on infrastructures, we argue that their discursive efforts and visual representation strategies coproduce space debris as a boundary infrastructure. We suggest considering this boundary infrastructure as relating orbital environments and the planet through enacting sustainability and responsibility for beyond-planetary environments. (shrink)

Autonomy, understood as self-rule, is almost routinely accepted as one of the core liberal concepts. Still, a closer view reveals that both the status and meaning of autonomy are controversial. The text departs from a short summary of the main theoretical disputes surrounding the concept. A critique of the standard internalist account is followed by an attempt to offer reasons for accepting a relational reading of autonomy. The central question of the text is context-specific. It asks about the possibility and (...) meaning of liberal autonomy in a society whose past is marked by mass regime-sponsored crimes. The background assumption is that mass crime leaves actors in heteronomous condition. At stake is reestablishing individual autonomies of two types of actors, whose group-specific identities have been created by crime: the ethical community of those who share collective identity with victims, and the ethical community of those who share collective identity with perpetrators. nema. In this paper I highlight certain logical and metaphysical issues which arise in the characterisation of functionalism-in particular its ready coherence with a physicalist ontology, its structuralism and the impredicativity of functionalist specifications. I then utilise these points in an attempt to demonstrate fatal flaws in the functionalist programme. I argue that the brand of functionalism inspired by David Lewis fails to accommodate multiple realisability though such accommodation was vaunted as a key improvement over the identity theory. More standard accounts (...) of functionalism allow, by contrast, for far too much multiple realisability. Specifically, functionalist structures will be massively reduplicated in the human brain; so functionalism yields the absurd consequence that each human harbours large numbers of minds and exemplifies virtually all mental states. Some of the most celebrated theories of nationalism exemplify the self‐confirming, evidence‐averse, deterministic, and ideological aspects of social science as we know it. What has gone wrong? The social sciences have modeled themselves on physics, failing to grasp the essential difference between the contingent, historical development of cultural particularity and the universal, law‐like regularities of inanimate matter. The physicist's tools for conducting the method Popper called “conjecture and refutation” are largely inappropriate when dealing with imaginative and therefore unpredictable human beings. (...) Obsessive quantification and the assumption of universal “social” laws, in particular, need to be de‐emphasized in favor of a Weberian willingness to make conjectures about the causes of unique events, and to test those hypotheses by comparing them to apparently similar cases. What role should legislation or policy play in avoiding the complications of in-vitro fertilization? In this article, we focus on single versus double embryo transfer, and assess three arguments in favour of mandatory single embryo transfer: risks to the mother, risks to resultant children, and costs to society. We highlight significant ethical concerns about each of these. Reproductive autonomy and non-paternalism are strong enough to outweigh the health concerns for the woman. Complications due to non-identity cast doubt on the extent (...) to which children are harmed. Twinning may offer an overall benefit rather than burden to society. Finally, including the future health costs for children in reproductive policy is inconsistent with other decisions. We conclude that mandatory single embryo transfer is not justified and that a number of countries should reconsider their current embryo transfer policy. (shrink)

The purpose of the text is to engage in a well thought critique of the Enlightenment project carried out by Nicholas Maxwell and to reflect upon the proposal of its reconstruction. Maxwell’s intellectual position is not at all obvious: he is neither a radical rationalist, nor a defender of scientific rationality, nor a postmodern and social constructivist. Postmodernists and social constructivists opposed the very idea of reason and rational inquiry, and have been thoroughly critical of what knowledge-inquiry represents. Indeed, such (...) criticisms could not be further from Maxwell’s position. According to Maxwell, what is wrong with knowledge-inquiry is not its embodiment of reason but, to the contrary, its gross and damaging irrationality. From Maxwell’s point of view we suffer not that much from the excess of rationality, but its deficit. Maxwell does not share open criticism of anti-Enlightenment thinkers from Nietzsche to Foucault, but more so he escapes the beliefs of a scientifically focused group of philosophers who see the main force of emancipation of humanity in a narrowly understood science followed by physics, the methodology of verification, and naturalism as a basic ideology. The author of the text thus poses the question: what can save our culture if it is neither sciencenor the rejection of science? Does the replacement of the category of knowledgeinquiry with wisdom-inquiry—which Maxwell converts us to—bring us any closer to a solution in our consideration of knowledge and life, science and politics, facts and values, nature and society? In Western culture wisdom has always been an object of desire, and it was so, inter alia, because unlike knowledge it has never been precisely defined and further specified. Philosophers developed a warm feeling towards wisdom and sought for wisdom, but had they lived by wisdom? Finally, the author challenges the most difficult question: can we rationally excuse our hopes for wisdom and hope that it may one day be embodied in the work of institutions and the actions of individuals? Probabilistic predictions of future risk govern much of society: healthcare, genetics, social media, national security, and finance. Both policy-makers and private companies are increasingly working to design institutional structures that seek to manage risk by controlling the behavior of citizens and consumers, using new technologies of predictive control that comb through past data to predict and shape future action. These predictions not only control social institutions but also shape individual character and forms of practical reason. Risk-based decision theory shifts people's (...) relationships to the future through knowledge of possible dangers and foregone opportunities, thus inspiring anxious solicitude and deceptive hopes for total security. This book uses virtue ethics to analyze these problems and to suggest ways to enjoy these technologies' positive benefits while constraining their dangerous aspects through a better understanding of practical reasoning and a theological analysis of our responsibility for future risks. Simulation software used for modeling has become as ubiquitous as computers themselves. Despite growing reliance on simulation in educational and workplace settings, users encounter frustration in using simulation software programs. The authors conducted a study with 26 engineering students and interviewed them about their experience learning the simulation software Arena for optimization modeling. These students experienced frustration with the process of learning to “think” like the simulation software. Students explained their difficulty with learning the software in a way that implied (...) human dialogue with a machine and negotiation with Arena in an attempt to overcome this frustration. Rather than being gender specific, frustrations were experienced by most male and female students equally, specifically those who held a perception of difference between human and machine “thinking.” The authors contend that communication difficulty with the embedded assumptions of the software is the source of frustration rather than deficiencies of users. External economic aid has played an important role in Northern Ireland’s peacebuilding process, particularly by funding community-based intervention projects.As a consequence of the Troubles, Northern Ireland suffered from severe socioeconomic inequality. These locally funded projects have fostered social cohesion by encouraging cross community interaction aimed at reducing violence and sectarianism. The NGO projects also promote social justice, reduce inequality, and provide the means to meet people’s basic human needs. The field research for this article was conducted during the summer of (...) 2010 and explores the perceptions of 120 civil society leaders and funding agency development officers on the effectiveness of the aid from the IFI and EU Peace III Fund in creating local social-economic NGOs to promote equity, equality, and social justice. The findings of this study reveal significant diversity in the respondents’ descriptions of the aids’s role in promoting equality, equity, and social justice as well as their expressed hopes and frustrations regarding its overall effectiveness. According to tradition, logic is normative for reasoning. According to many contemporary philosophers of logic, there is more than one correct logic. What is the relationship between these two strands of thought? This paper makes two claims. First, logic is doubly normative for reasoning because, in addition to constraining the combinations of beliefs that we may have, logic also constrains the methods by which we may form them. Second, given that logic is doubly normative for reasoning, a wide array of (...) logical pluralisms are inconsistent with the normativity of logic as they entail contradictory claims about how agents ought to reason. Thus, if logic is normative for reasoning, these pluralisms are untenable. (shrink)

When men and women cannot attain idealized gendered forms of economic provision and dependence, how do they make sense of this perceived failure? In this article, we posit that poor health narratives serve as a gendered tool to make sense of inadequate livelihoods, even when that inadequacy is attributable to structural conditions. We draw on survey and life-history interview data from middle-aged and older rural South Africans. The survey data show that even after adjusting for biometrically measured health differences, working-age (...) men report poorer health when they are unemployed, and women and pension-age men report poorer health when they live without household earners. Life-history interviews show parallel patterns: When their economic circumstance is not troubled, individuals regularly minimize health concerns; conversely, when they have a troubled livelihood, individuals draw on poor health to explain it. When women and men cannot perform idealized gendered practices in the family, poor health becomes a tool to reduce the resulting cognitive dissonance. Poor health narratives recast perceived gender failures to an individualized, biological explanation. Our study illustrates how the epidemiological context can be a resource that forestalls a redefinition of gender norms when the gender order is in crisis. (shrink)

Oral testimony, oral tradition and documents, as represented by written accounts of the facts and the material instruments of the acts and the records, are all ways of indirectly accessing the past. In both cases of oral and written records, what is considered ‘true’ is entirely dependent on the trustworthiness of its source. African societies have been communicating and storing valuable information through memory, murals and rock art paintings since time immemorial. The dominant Western canons have previously classified this (...) memory as prelegal and nonlegal. This study, using a literature review, mainly through previous work of this author, explores oral memory as a trusted record in troubled times. It is concluded that, like digital records, oral memory requires proactive efforts to be preserved, as in both instances the content migrates from one carrier to another. Therefore, oral memory is trustworthy when transmitted in its context. Oral memory, it is argued, perfectly fits the description of a record and thus cannot be classified as either prelegal or nonlegal. The transmitter of information through oral history is no different from other media of records.Contribution: The study contributes to the ongoing academic discourse of decolonising and Africanising archives. Ahmad Fardid, the 'anti-Western' philosopher known to many as the Iranian Heidegger, became the self-proclaimed philosophical spokesperson for the Islamic Republic, famously coining the term 'Westoxication'. Using new materials about Fardid's intellectual biography and interviews with thirteen individuals, Ali Mirsepassi pieces together the striking story of Fardid's life and intellectual legacy. Each interview in turn sheds light on Iran's twentieth-century intellectual and political self-construction and highlights Fardid's important role and influence in the creation of Iranian modernity. The Fardid phenomenon was (...) unique to the Iranian story, and yet contributed to a broader twentieth-century Heideggerian tradition that marked the political destiny of other countries under a similar ideological sway. Through these accounts, Mirsepassi cuts to the nerve of how deadly political 'authenticity movements' take hold of modern societies and spread their ideology. We are spurred into action by our troubles and fears; but all too often our action fails to address the true causes of our worries. When trying to make sense of our lives, we tend to blame our own failings and weaknesses for our discomforts and defeats. And in doing so, we make things worse rather than better. Reasonable beings that we are, how does this happen and why does it go on happening? These are the questions addressed in this (...) new book by Zygmunt Bauman - one of the most original and perceptive social thinkers writing today. For Bauman, the task of sociology is not to censor or correct the stories we tell of our lives, but to show that there are more ways in which our life stories can be told. By bringing into view the many complex dependencies invisible from the vantage point of private experience, sociology can help us to link our individual decisions and actions to the deeper causes of our troubles and fears - to the ways we live, to the conditions under which we act, to the socially drawn limits of our imagination and ambition. Sociology can help us to understand the processes that have shaped the society in which we live today, a society in which individualization has become our fate. And sociology can also help us to see that if our individual but shared anxieties are to be effectively tackled, they need to be addressed collectively, true to their social, not individual, nature. The Individualized Society will be of great interest to students of sociology, politics and the social sciences and humanities generally. It will also appeal to a broader range of readers who are interested in the changing nature of our social and political life today. (shrink)

This study constitutes an ethical analysis through the lens of distributive justice in the case of the Troubled Asset Relief Program (TARP), which was enacted in the midst of the Great Recession of 2007–2009. It begins by engaging with the visions of justice constructed by John Rawls and Robert Nozick, using their insights to locate the injustices of TARP according to their moral imaginations. However, this study argues that Rawls’ and Nozick’s theories of justice primarily envision the nature of (...) law as being restrictive of vice, not as instructors of virtue. Thus, it resources the legal philosophy of St. Thomas Aquinas to demonstrate how the positive pedagogy of law can enable a more just construction of economic rescue legislation, one that not only prevents future repetitions of economic vices and injustice, but is also formative for a society that prizes economic justice and virtues. In doing so, the study proposes two criteria for a more just consideration of economic rescue legislation that embraces law’s positive pedagogy. (shrink)

We recently conducted a Quebec-wide postal survey designed to assess major stakeholders’ attitudes toward extending medical assistance in dying (MAiD) to non-competent patients with dementia. This paper reports the results of qualitative analyses of the comments left by the respondents at the end of the questionnaire. The questionnaire was mailed to randomly selected representatives of four stakeholder groups: adults 65 years old and over (n=621), informal caregivers of persons with dementia (n=471), nurses (n=514) and physicians (n=653) caring for such patients (...) at the time of the survey. A total of 1,050 questionnaires were returned, of which 420 included comments. Comments were coded into categories, themes and subthemes, and the frequency of categories compared across the four stakeholder groups. Coding enabled identification of 23 themes and five sub-themes clustered into seven major thematic categories. These relate to: 1) the respondent, 2) the survey and questionnaire, 3) persons with dementia, 4) their informal caregivers, 5) the healthcare system, 6) the legal framework governing end-of-life care, and 7) society in general. These categories were identified in all stakeholder groups, although to a varying degree for five of the seven categories. This study highlights the host of factors that may influence a person’s attitude toward extending MAiD to non-competent patients with dementia. It also illustrates how making systematic use of free-text comments can provide valuable insight into attitudes toward complex social policy issues and extend understanding of postal survey findings.
