Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

Collision sports pose a high risk of concussion. How to respond to this risk is more ethically complex when considering children and adolescents due to a) incomplete evidence regarding the impact of concussion on developing brains, b) physiological and social vulnerability, and c) the young person’s reliance on proxy decision-makers, usually parents. There is also a lack of clear definitions of (a) collision sport (vs. contact sport) and (b) what constitutes a child or adolescent. We consider whether parents should be (...) free to allow their children/adolescents to play contact or collision sport. The article analyses the harms and benefits of collision sport and methods of determining risk, before outlining our support for the precautionary principle. We then consider whether the ‘best interests’ or ‘right to an open future’ framework ought to be applied to the issue of childhood participation in collision sport. Rather than supporting a ban of child/adolescent participation in collision sport, we argue that permissibility should be decided on a sport-by-sport basis. Moreover, we apply the ‘Accountability of Reasonableness’ framework to ensure that sound ethical values guide and support protections for this vulnerable group in the absence of high-quality evidence. This article explores some of the concerns which are being raised about algorithms with recourse to Habermas’s theory of communicative action. The intention is not to undertake an empirical examination of ‘algorithms’ or their consequences but to connect critical theory to some contemporary concerns regarding digital cultures. Habermas’s ‘colonization of life-worlds’ thesis gives theoretical expression to two different trends which underlie many current criticisms of the insidious influence of digital algorithms: the privatization of communication, and the particularization of knowledge and (...) experience. Habermas’s social theory therefore offers a useful framework for exploring some of the normative and political problems that are attributed to ‘algorithmic culture’ and ‘big data’. (shrink)

Recent scholarship has drawn on Koselleck’s methods of conceptual history and his diagnosis of ‘crisis’ in modernity to make sense of 21st-century developments in political, social and economic life and thought. This review essay looks at two texts that, in different ways, test Koselleck’s ideas in challenging and innovative ways. Lara’s use of conceptual history to shed light on the debates over secularization demonstrates how concepts become central to struggles over the definition of politics – definitions which thereafter disclose the (...) possibilities and set the agenda for future political action. Roitman continues Koselleck’s interest in the concept of crisis and shows how conceptual history can be used to sharpen our awareness of undisclosed content and theoretical blind spots. Both show how conceptual history serves as a ‘semantic check’ on political concepts, demanding greater reflexivity and the setting of realistic political goals. (shrink)

This ambitious and sweeping book presents a powerful argument against moral relativism and in favor of the objectivity of a theory of democratic individuality. Unlike much recent work in this field, the book does not simply adumbrate such a view. Rather, it develops the parallels between various versions of scientific and moral realism, and then reinterprets the history and internal logic of democratic theory, maintaining, for example, that the abolition of slavery represents genuine moral progress. The book also recasts the (...) clashes between Marxist and Weberian, radical and liberal sociologies in the light of these moral claims, and sketches the institutions of a radical democracy. Daniel Bell’s The Cultural Contradictions of Capitalism lies at the intersection of the three main theoretical currents of sociological thought, those of Karl Marx, Émile Durkheim and Max Weber. His ‘three realms’ methodology moves away from deterministic accounts that subordinate the political and cultural to the economic realm. By granting each realm an autonomy and principles of their own, Bell locates the contradictions of capitalism in the friction between them. With constant innovation, individual expressiveness and libertarian social values becoming forces (...) in-and-of-themselves, prevailing social structures and the roles within them are left looking increasingly incoherent, illegitimate and meaningless. Likewise, the shift from Protestant asceticism to modernist hedonism creates a sharp tension between the demand for a disciplined and responsible workforce and the demand for economic growth through unrestrained and instantly gratifying consumerism. The result is a complex of crisis scenarios which were manifest with the end of the post-war boom. However, as other commentators have pointed out, Bell’s prophetic theses often seem to fail under the light of subsequent history. (shrink)

Well-stated modern political or democratic theory is rights-based. Meaningful democracy rests as a precondition on the equal rights of citizens. This idea stems from Rousseau’s distinction between a general will*one which is impersonal and tends toward equality, that is, the equal basic rights of citizens*and a transitory will of all. For instance, absent equal basic rights, one might imagine a possible world in which what I have called a self-undermining series of wills of all, or the results of socalled majority (...) rule, disenfranchises the population. In the USA, one might think, contrahistorically, of a regime in which the women, as a majority, disenfranchise the men, the Black, Latin, and Asian women disenfranchise the White women, and by a series of reductions by further ‘majorities,’ three people still have the suffrage, two of whom disenfranchise one. Based on Rousseau, John Rawls’ Theory of Justice thus emphasizes the priority of the equal liberty principle over an economic difference principle.1 The difference principle permits those inequalities which also benefit the least advantaged. But the priority of the equal liberty principle rules out any inequality, otherwise beneficial to the least advantaged, which enables the rich to control the government. This priority makes equal basic rights the inescapable precondition for any decent majority rule or distribution of income. Note that in principle, such a regime may be international*even a democracy of demoi in James Bohman’s phrase - rather than national. Why does symbolic communication in humans develop primarily in an oral medium, and how do theories of language origin explain this? Non-human primates, despite their ability to learn and use symbolic signs, do not develop symbols as in oral language. This partly owes to the lack of a direct cortico-motoneuron control of vocalizations in these species compared to humans. Yet such modality-related factors that can impinge on the rise of symbolic language are interpreted differently in two types of evolutionary storylines. (...) 1) Some theories posit that symbolic language originated in a gestural modality, as in “sign languages”. However, this overlooks work on emerging sign and spoken language showing that gestures and speech shape signs differently. 2) In modality-dependent theories, some emphasize the role of iconic sounds, though these lack the efficiency of arbitrary symbols. Other theorists suggest that ontogenesis serves to identify human-specific mechanisms underlying an evolutionary shift from pitch varying to orally-modulated vocalizations (babble). This shift creates numerous oral features that can support efficient symbolic associations. We illustrate this principle using a sound-picture association task with 40 learners who hear words in an unfamiliar language (Mandarin) with and without a filtering of oral features. Symbolic associations arise more rapidly and accurately for sounds containing oral features compared to sounds bearing only pitch features, an effect also reported in experiments with infants. The results imply that, beyond a competence to learn and use symbols, the rise of symbolic language rests on the types of signs that a modality of expression affords. (shrink)

Im Laufe der letzten Jahre lässt sich allerdings beobachten, dass der einstmals verpönte Werkbegriff schrittweise wieder zu einer zentralen und produktiven Analysekategorie avanciert ist. Der vorliegende Band untersucht, welche Formen und Funktionen der Werkbegriff in den Geisteswissenschaften des 21. Jahrhunderts annehmen kann.

Literature published en masse via print-on-demand platforms is outlined here, borrowing from the ›Auchbuchhandel‹, as a subset of an ›Auchliteratur‹ that bears witness to a unique democratization of bookmaking. At the same time, it struggles with a lack of appreciation and transmission, as well as the particular precariousness of the publishing model.

For many contemporary liberals, Anglo-American democracy seems unimpeachably the best political form. In contrast, adherence to democratic values seems an area in which most Marxian regimes, and perhaps Marx himself, are strikingly deficient. Further, Marxian theory insists on the existence of oppressive ruling classes in all capitalist societies and on the need for class struggle and violent revolution to achieve a more cooperative regime – theses which liberal social theories tend to dismiss peremptorily. From the perspective of modern liberal democratic (...) theory, Marxian arguments seem prima facie outlandish and even morally objectionable. (shrink)

Ausgehend von den Rändern der gegenwärtigen literarischen Praxis wirft Annette Gilberts komparatistische Studie neues Licht auf eine zentrale Kategorie der Literatur(wissenschaft): das Werk als pragmatische Instanz literarischer Kommunikation. Unter Anwendung eines erweiterten Literaturbegriffs werden avantgardistische und experimentelle Positionen im Grenzbereich von Literatur und Kunst seit den 1950er Jahren gesichtet, die eine starke Reflexion ihres eigenen Werkseins erkennen lassen. Entsprechende Versuchsanordnungen - etwa von Elfriede Jelinek, Timm Ulrichs, Sherrie Levine, Elaine Sturtevant, Marcel Broodthaers - werden als substantieller Beitrag zur literaturtheoretischen Grundlagenforschung (...) gelesen. Zugleich werden Traditionslinien zu historischen Vorgängern wie Stéphane Mallarmé und Jorge Luis Borges sowie Parallelen zu ähnlichen Tendenzen und Problemstellungen in der bildenden Kunst aufgezeigt.
