I argue that the concept of 'longitudinal form', which Poplawski and Gillett have introduced into ethical discussions about embryos and gametes, involves too many metaphysical subtleties to be a useful aid to making moral decisions. I conclude by suggesting a criterion for relevance in medical ethics.

Context: Doctors have been known to treat or give consultation to patients informally, with none of the usual record keeping or follow up. They may wish to know whether this practice is ethical.Objective: To determine whether this practice meets criteria of medical ethics.Design: Informal medicine is analysed according to standard ethical principles: autonomy, beneficence and non-maleficence, distributive and procedural justice, and caring.Setting: Hospital, medical school, and other settings where patients may turn to physicians for informal help.Conclusion: No generalisation can be (...) made to the effect that informal medicine is or is not ethical. Each request for informal consultation must be considered on its own merits.Guidelines: Informal medicine may be ethical if no payment is involved, and when the patient is fully aware of the benefits and risks of a lack of record keeping. When an informal consultation does not entail any danger to the patient or others, the physician may agree to the request. If, however, any danger to the patient or others is foreseen, then the physician must insist on professional autonomy, and consider refusing the request and persuading the patient to accept formal consultation. If a reportable infectious disease, or other serious danger to the community, is involved, the physician should refuse informal consultation or treatment, or at least make a proper report even if the consultation was informal. Since his 1977 The Idol and Distance, Jean-Luc Marion has almost continually drawn upon the work of the 5th-6th century Christian mystic Pseudo-Denys the Areopagite, not only within his explicitly theological considerations, but throughout his Cartesian and phenomenological work as well. The present essay maps out the influence of Denys upon Marion’s thinking, organizing Marion’s career into a three-part periodization, each of which corresponds to a distinct portion of the Dionysian corpus—in Marion’s work of the seventies the Celestial Hierarchy and (...) the Ecclesiastical Hierarchy are foregrounded, in the eighties this emphasis is shifted to the The Divine Names, and in the nineties The Mystical Theology takes center stage. Insofar as these emphases directly correlate to the unique tasks that Marion has set himself in each of these various periods, Dionysius is revealed as a hermeneutical key, unlocking and clarifying crucial aspects of Marion’s theologically-inflected phenomenology. Colorado has consistently had one of the highest rates of suicide in the United States, and El Paso County has the highest number of suicide and firearm-related suicide deaths within the state. Community-based solutions like those of the Suicide Prevention Collaborative of El Paso County may be more effective in preventing suicide as they are specific to local issues, sensitive to local culture, and informed by local data, community members, and stakeholders.

The Profound Limitations of Knowledge explores the limitations of knowledge and argues that neither reasoning nor direct or indirect observations can be trusted. We cannot even assign probabilities to claims of what we can know. Furthermore, for any set of data, there are an infinite number of possible interpretations. Evidence suggests that we live in a participatory universe--that is, our observations shape reality.

Quentin Meillassoux’s 2006 After Finitude offered a sharp critique of the phenomenological project, charging that phenomenology was one of the “two principal media” of correlationism—ultimately reducible to an “extreme idealism.” Meillassoux grounds this accusation in an account of givenness that presupposes that “every variety of givenness” finds its genesis within the positing of the subject. However, this critique fails to hit its mark precisely because it presupposes an account of intuitive givenness that is entirely foreign to the phenomenological project. Quite (...) against Meillassoux’s conflation of givenness, the world-for-us, and the positing subject—the very centre of the phenomenological project is the recognition that intuitive givenness cannot be reduced to the constructive activity of the subject. Leavitt It is always good to try to make peace, to try to resolve differences between whatsomebelieveare conflictingpoints ofview. Nevertheless, sometimes the points ofview which are believed to be opposed to each other really do oppose one another and so the most ingenious attempts at reconciliation turn out to have been ill-conceived. Wim Klever has brought considerable scholarship to bear in (...) his attempt to show that Hume and Spinoza were not so far apart as we thought.2 It was an especially pleasant surprise to see the comparison of their views on personal identity,3 for example. And he has made a convincing case for doubt that Hume's "sharp anti-Spinözistic utterings"4 in Treatise 1.4.5 were really sincere. In my opinion, however, Klever has gone too farin trying to bring together what should have been left asunder. Some ofhis points ofthe purportedly common ground shared by Hume and Spinoza are based on what I believe to be a blatant misreading ofSpinoza. Other points show a failure to appreciate a fundamental disagreement between Hume and Spinoza on central issues in the old Aristotelian tradition. Hume and Spinoza, like other philosophersofthe seventeenth and eighteenth centuries, can be best understood when one is aware ofthe Aristotelian background against which they were writing and with which they expected their readers to be familiar. Hume shows familiarity with Aristotelianism in his discussion of the "antient philosophy" at Treatise 1.4.3 as well as in his various remarks about scholasticism.6Spinoza'srelationshipto ChristianAristotelianism has been discussed by Wolfson6 and by myself,7 among others. And his relationship to Maimonides, who was his link to Jewish Aristotelianism, has been discussed by Harvey.8 1 shall base my claim that Hume and Spinoza were much further apart than Klever makes them out to be upon an attempt to identify some scholastic and Aristotelian issues and doctrines with respect to which Hume and Spinoza took very different stands. The firstthing which I wanttodraw attention toisKlever'sreading ofthe scholia to 2 Ethics 40, which bears on medieval disputes over the nominalistic, conceptualistic and realistic approaches to Aristotle's treatment of the problem of the universels. Since Spinoza allows that universal notions "are notformed by all men in the same way,"9 Klever Volume XVII Number 2 203 FRANK J. LEAVITT makes him out to be holding the same position which Hume expresses when he adopts Berkeley's opinion that "all general ideas are nothing but particular ones, annexed to a certain term" (T 17). And Klever claims "Hume and Spinoza are both thorough nominalists."10 But Klever misses the point that Hume denies that there are, in addition to particular ideas, universal ones, that is, common notions, while Spinoza clearly admits, in the second scholium to 11 Ethics 40, the difference which Hume denies. According to Spinoza we have (1> confused representations of particular things, and (2) remembered ideas which are "similar to those through which we imagine things." These latter are ideas of the sort which Hume recognized. But in addition tothese two, which Spinoza calls "opinion" and "imagination," Spinoza claims that we have (3) "notions common to all men, and adequate ideas ofthe properties ofthings." These are notions of"those things which are common to all, and which are equallyin a part and in the whole [and which] cannotbe conceived exceptadequately"(2Ethics 38). These notions, which parallel Descartes' "clear and distinct ideas" are the general abstract ideas which Hume denies in Treatise 1.1.7. There Hume denies that ideas can be general "in their nature" but allows that they can be general "in their representation." To the extent to which Hume's position can be called "nominalism," the passages to which I have referred show that Spinoza, who basically accepted the Cartesian doctrine ofclear and distinct ideas, was not a nominalist. Aristotle drew a sharp distinction between imagination and thought in De anima 2.3. Descartes preserved the distinction between imagination and intellection at the beginningofthe fourth Meditation, among other places. Heinrich Popitz’s Phenomena of Power aims to uncover power as “a universal component in the genesis and operation of human societies”. In order to uncover this “universal” concept of power, Popitz employs Husserl’s method of the “imaginative variation” [Phantasievariation]. Yet, contrary to phenomenology’s traditionally descriptive posture, Phenomena of Power’s project is at once descriptive and normative—seeking not only to describe power, but to also describe the way in which power can be remade. In the present paper it is argued that (...) this normative component of Popitz’s project offers the burgeoning field of critical phenomenology an illustration of the way in which Husserl’s “imaginative variation” might be employed not only as a descriptive tool of pure essences, but also as an instrument in the refashioning of social reality. The emerging new multidisciplinary and crosscultural field of bioethics will require sen sitive, open-minded professionals to take the lead in hospital ethics, in genetic coun selling, and in the teaching of bioethics to students in nursing, medicine and the basic sciences. Nurses with ward experience who return to university to gain an MA or PhD in bioethics are eminently suited for this leadership role, for they may be more likely than physicians to study for a liberal education to supplement their (...) professional know ledge ; their first-hand experience in nursing is an antidote to the pointless subtleties into which philosophical ethics so often degenerates. When teaching ethics to nurses one must remember that, while some will simply use this knowledge in their own clinical work, others will go on to be teachers and researchers in bioethics. Their training must therefore be broad and interdisciplinary, including real substantive philosophy (as opposed to philosophical ethics), as well as mystical bioethics, religious law, ethics of genetic counselling, clinical approaches to ethical pseudo prob lems, research skills, etc. (shrink)

Since Husserl’s phenomenological analyses of the living body (Leib) in Ideas II, the subjective experience of the body, what later French thinkers will name the flesh, has been particularly marked by its capacity for action—its potency. This privileging of the acting flesh, the potent organ, is echoed throughout the subsequent phenomenological tradition. For this tradition, from de Biran and Husserl, to Merleau‑Ponty and Henry, the flesh is distinguished from the mere body (Körper) by its unique capacity to act. For the (...) later French tradition to be flesh is to be will, and to be will is to be action. Impotence (impuissance) appears as external resistance. In the present investigation, I challenge this trajectory of the flesh through a phenomenological investigation of the unique phenomenon of acute sexual impotence. In this way, it will be shown that l’impuissance (impotence) can be located not only in the objectivity of opposition within the world, on the organic or objective body (le corps, Körper), but within the immanence of the flesh (la chair, Leib) itself. Indeed, the experience of incarnate l’impuissance provides a unique phenomenological access to the incomplete synthesis of the carnal flesh—a synthesis that remains, by phenomenological necessity, run through with ruptures and gaps that function as its constitutive excess. First, it attempts to tell us the personal stories of two individuals who were working at the highest level in a very abstract Weld, namely G.yH. Hardy (1877–1947) and Srinivasa Ramanujan (1887–1920) during their collaboration on pure mathematics between spring 1914 and spring 1919. Obviously the same problems would arise in trying to tell the personal story of Bertrand Russell’s supervision of Ludwig Wittgenstein in mathematical logic, which occurred at Cambridge University in the years just before the start of the Great War. It is a great challenge to try to tie personal dynamics and abstract thought into a single coherent narrative. There are implications for the philosophy of mathematics and the history and sociology of science. So, of course, we have to ask: how does author David Leavitt rise to this challenge? The second lecture was expanded into the remaining published lectures, all considering speciWc mathematical topics. plishment possible for an academic institution: its fellows and masters had managed to attract and then recognize the genius of Ramanujan and Wittgenstein and to admit them to advanced studies without any real academic credentials. Wheatley had been the chair of the Committee on Social Thought at the University of Chicago; so, he knew something about such matters, as he did about many things involving humans, human settlements, and their arrangement in the world. Incidentally, Wheatley himself appeared as a character, Battle, in Ravenstein, Saul Bellow’s roman à clef about Allan Bloom. So, to the extent that Cambridge University just before and during the Great War plays a role here, we want to learn as much as we can about the atmosphere of the place. The Indian Clerk is a historical novelz—zin this case naming actual names, elaborating what we know about real people and occasionally adding Wctional charactersz—zall centered on the extraordinary mathematical genius Ramanujan and his equally extraordinary importation from India to Cambridge. The story is told largely in the third person, by an omniscient narrator, but repeatedly we also have the inner voice of G.yH. Hardy: there are a number of chapters with the indication “New Lecture Hall, Harvard University”, dated 1936, in which Hardy speaks in the Wrst person. In these passages David Leavitt uses parts of the published lectures, along with G.yH. Hardy’s private thoughtsz—zas imagined by Leavittz—zabout this “one romantic incident in my life” and about other matters that still haunt him.2 The novel is thus in some sense more about G.yH. Hardy and his inner life than it is about Srinivasa Ramanujan. The triumph of the novel is its ability to reconstruct and convey in a lively manner the circumstances of the time, the look and smell of the place, the crosscurrents, dynamics, and dislocations of people during these years. Leavitt has woven together a great deal, from many diTerent realms: pre-war meetings of the Apostles, the high table, the pre-war mathematics tripos, the method of collaboration between Hardy and J.yE. The United States Court of Appeals for the District of Columbia Circuit held that the district court did not have jurisdiction over the American Chiropractor's Association's federal question claims brought under the Medicare Act, despite affirming the ACA's prudential standing to pursue its claims. The Appeals Court reversed the lower court's decision allowing a doctor of medicine or osteopathy to perform manual manipulations of the spine on Medicare beneficiaries to correct a subluxation.The Medicare program “subsidizes medical insurance for elderly and (...) disabled persons.” An enrollee selects a physician or obtains medical services through a managed-care provider, such as a health maintenance organization. The total longitudinal form view of human beings is a metaphysical view which aims to locate our moral judgements about human embryos in a broader set of attitudes and characterisations. On this basis it has explanatory power and a real function in that it grounds our ethical discussion of embryos in other discourses. Contra Leavitt, this grounding suggests a broader criterion of relevance for metaphysical discussion than asking 'what comes out of' such a discussion for a particular ethical dilemma.

Some eminent scholars like Stuart Hampshire and Martial Gueroult (I confess: not all ofthem) pretend that Spinoza is a true nominalist. I think the texts (and the whole structure of the system) enforce us to confess that they are right. 3.In the case of common things, that is, (elementary) things common to all beings, the human body included, the ideas of these things are, though particular, common too.4 In spite ofand in line with Hume's agreement with Spinoza's nominalism he does not deny, as Leavitt pretends, the existence of common notions. In "Of the Passions," part 1, section 10, he writes that "according to common notions a man has no power, where very considerable motives Ue betwixt him and the satisfaction of his desires, and determine him to forbearwhathe wishes toperform."5Thispassageis notatallinconflict with Treatise 1.1.7 in which the real existence ofabstract ideas in our mind is refuted. The ideas of things we have in common with other natural beings, may not be called abstract for that reason. I take issue with Frank Leavitt's sketch of a pragmatic criterion for the relevance of metaphysics to medical ethics. I argue that appeal to the potential for confusion generated by metaphysical subtlety establishes a need for better communication rather than shows philosophical insight beside the point. I demonstrate that the proposed Criterion of Relevance has absurd consequences, and I claim that the relevance of philosophical doctrines, whether ethical or metaphysical, is best accounted for in terms of improved understanding.

Louveau, A., S. Shelah and B. Velikovi, Borel partitions of infinite subtrees of a perfect tree, Annals of Pure and Applied Logic 63 271–281. We define a notion of type of a perfect tree and show that, for any given type τ, if the set of all subtrees of a given perfect tree T which have type τ is partitioned into two Borel classes then there is a perfect subtree S of T such that all subtrees of S of type (...) τ belong to the same class. This result simultaneously generalizes the partition theorems of Galvin-Prikry and Galvin-Blass.
