The pedagogical technique of the playful Plato, especially his ability to create living discourses that directly address the student, is the subject of Plato the Teacher. “The crisis of the Republic” refers to the decisive moment in his central dialogue when philosopher-readers realize that Plato’s is challenging them to choose justice by going back down into the dangerous Cave of political life for the sake of the greater Good, as both Socrates and Cicero did.

Most ethics guidelines for distributing scarce medical resources during the coronavirus pandemic seek to save the most lives and the most life‐years. A patient’s prognosis is determined using a SOFA or MSOFA score to measure likelihood of survival to discharge, as well as a consideration of relevant comorbidities and their effects on likelihood of survival up to one or five years. Although some guidelines use age as a tiebreaker when two patients’ prognoses are identical, others refuse to consider age for (...) fear of discriminating against the elderly. In this paper, I argue that age is directly relevant for maximizing health benefits, so current ethics guidelines are wrongly excluding or deemphasizing life‐stage in their triage algorithms. Research on COVID‐19 has shown that age is a risk factor in adverse outcomes, independent of comorbidities. And limiting a consideration of life‐years to only one or five years past discharge does not maximize health benefits. Therefore, based on their own stated values, triage algorithms for coronavirus patients ought to include life‐stage as a primary consideration, along with the SOFA score and comorbidities, rather than excluding it or using it merely as a tiebreaker. This is not discriminatory because patients ought to have equal opportunity to experience life‐stages. The equitable enforcement of that right justifies unequal treatment based on age in cases when there is a scarcity of life‐saving resources. A consideration of life‐stage would thus allow healthcare workers to responsibly steward public resources in order to maximize lives and life‐years saved. (shrink)

The year Leo Strauss published "Persecution and the Art of Writing" (1941), he prepared a lecture ("German Nihilism") that he never published. An analysis of this lecture shows that Strauss hadn't fully mastered the art of writing he'd discovered in others: his secrets are too exposed. In the context of "German Nihilism," it becomes clear that "Persecution and the Art of Writing" is about liberal persecution of authoritarianism, no the reverse, as liberals would assume. In response to recent apologias presenting (...) Strauss as a liberal who didn't "write between the lines," a Strauss-style reading of "German Nihilism" disproves both claims. (shrink)

In this chapter, Altman gives two separate arguments that, in conjunction, support a mixed theory of punishment. First, he shows that consequentialism is insufficient on its own because it cannot capture the condemnatory function of the law as an expression of the community’s resentment. Second, he shows that retributivism is insufficient on its own because any plausible legal arrangement must be committed to some non-retributivist values. He then argues that the institution of punishment is justified by its costs and (...) benefits, and the distribution of punishment—who is punished and how much—is justified by what offenders deserve. This two-tiered model of punishment makes more sense than an alternative scheme, according to which retributivist reasoning informs criminal lawmaking and consequentialist reasoning informs criminal judgments and sentencing. Parents resemble trustees, conservators, and other fiduciaries; they exercise broad discretion while making choices for vulnerable people. Like other fiduciaries, parents can be tempted to neglect their duties or pursue self-interest at the expense of those they should protect. This article argues against treating parents as fiduciaries for three reasons. First, the scope of parental fiduciary duties cannot be narrowed enough to make them tolerable. Arguments limiting fiduciary duties to cases where parents exercise delegated powers or act within parenting roles (...) fail. Most parental decisions involve dual powers or roles. Efforts to address these dual-role cases produce principles that are unduly demanding, complex, arbitrary, and morally unappealing. Second, we could limit parental fiduciary duties by designing parental roles to benefit children. Since children need devoted, happy, well-rounded parents, the principle of designing parental roles to benefit children would produce rules that leave room for parents to flourish. However, this principle does not justify specific legal or moral fiduciary norms. Third, we could redefine fiduciary duties so parents can balance their interests against children’s interests, making fiduciary duties less burdensome. However, expanding the definition of fiduciary threatens to encompass many duties within the fiduciary category, rendering the description almost meaningless. (shrink)

Two of the major arguments against performance-enhancing drugs (PEDs), appealing to fairness and the protection of athletes’ health, have serious flaws. First, there is no relevant moral distinction between the use of PEDs and the use of other performance enhancers that introduce unfairness and that we accept nonetheless. Second, prohibiting PEDs for athletes’ own good ignores the fact that adult athletes are constantly making tradeoffs to improve performance and pursue excellence, including sacrificing their health. We should not paternalistically impose our (...) values on them. On the other side, arguments to allow ‘safe’ PEDs provide no normative criterion to determine the acceptable level of risk, thus begging the question. The reasonable athlete argument solves both sets of problems: it justifies a ban on some performance-enhancing drugs based on health and fairness, while avoiding paternalism, and it also establishes a non-arbitrary standard to determine which drugs ought to be allowed. First, if unsafe PEDs were allowed, some athletes would refuse to take them out of concern for their health. This is a reasonable decision even though it would put them at a competitive disadvantage against athletes who choose to use unsafe PEDs. It would be unfair for clean athletes to suffer a competitive disadvantage for acting reasonably. Therefore, PEDs that pose significant health risks should be prohibited for all athletes. Second, it would be unreasonable for athletes to refuse, on principle, relatively safe and effective PEDs, so a blanket prohibition is also unjustified. Which drugs and which doses to allow should be determined not by athletes’ actual choices but by the hypothetical choices of the reasonable athlete. The resulting sport-specific drug policy would carve a justifiable middle path between complete prohibition and complete permission. (shrink)

This book argues that Cicero deserves to be spoken of with more respect and to be studied with greater care. Using Plato’s influence on Cicero’s life and writings as a clue, Altman reveals the ineffable combination of qualities—courage, originality, intelligence, sparkling wit, subtlety, deep respect for his teacher, and deadly seriousness of purpose—that enabled Cicero not only to revive Platonism, but also to rival Plato himself.

This paper reinterprets a child’s right to an open future as justified by authenticity rather than autonomy. It argues that authenticity can be recognized as valuable by people whose conceptions of the good do not value autonomy. As a running example, the paper considers ultra-Orthodox Jews who lead separatist lives and who deny their sons secular education beyond an elementary school level. If their adult sons want to have careers and participate in life outside the religious enclave, they cannot easily (...) do so. The parents see no reason to protect their child’s autonomy or to prepare their child for a life that conflicts with their values. This paper provides one response to their concerns. Following a political-liberal project of seeking overlapping consensus, it tries to base demands that children be prepared for varied futures on values that reasonable religious people can embrace. This book advances a novel theory of international justice that combines the orthodox liberal notion that the lives of individuals are what ultimately matter morally with the putatively antiliberal idea of an irreducibly collective right of self-governance. The individual and her rights are placed at center stage insofar as political states are judged legitimate if they adequately protect the human rights of their constituents and respect the rights of all others. Yet, the book argues that legitimate states have a moral (...) right to self-determination and that this right is inherently collective, irreducible to the individual rights of the persons who constitute them. Exploring the implications of these ideas, the book addresses issues pertaining to democracy, secession, international criminal law, armed intervention, political assassination, global distributive justice, and immigration. A number of the positions taken in the book run against the grain of current academic opinion: there is no human right to democracy; separatist groups can be morally entitled to secede from legitimate states; the fact that it is a matter of brute luck whether one is born in a wealthy state or a poorer one does not mean that economic inequalities across states must be minimized or even kept within certain limits; most existing states have no right against armed intervention; and it is morally permissible for a legitimate state to exclude all would-be immigrants. During the coronavirus pandemic, communities have faced shortages of important healthcare resources such as COVID-19 vaccines, medical staff, ICU beds and ventilators. Public health officials in the U.S. have had to make decisions about two major issues: which infected patients should be treated first, and which people who are at risk of infection should be inoculated first. Following Beauchamp and Childress’s principlism, adopted guidelines have tended to value both whole lives and life-years. This process of collective moral reasoning has revealed (...) our common commitment to both Kantian and utilitarian principles. For Kant, respecting people’s rights entails that we ought to value whole lives equally. Therefore we ought to allocate resources so as to maximise the number of patients who survive to discharge. By contrast, the principle of utility has us maximise life-years so that people can satisfy more of their considered preferences. Although people are treated impartially in the utilitarian calculus, it does not recognise their equal worth. Subjecting Kantian ethics and utilitarianism to the process of reflective equilibrium lends support to the idea that we need a pluralistic approach that would accommodate our moral intuitions regarding both the equal value of whole lives and the additive value of life-years. In accordance with Leo Strauss’s ingenious suggestion, the Athenian Stranger of Plato’s Laws is best understood as an alternative ‘Socrates’, fleeing from the hemlock to Crete. Situated between Crito and Phaedo, Laws effectively tests the reader’s loyalty to the real Socrates who obeys Athenian law and dies cheerfully in Athens. Having separated Plato from the Stranger, a nuanced defence of Karl Popper’s suspicions about Laws confronts the apologetic readings of both Strauss and Christopher Bobonich. As hinted by his preference for (...) wine, the antidote for hemlock, the Athenian Stranger repeatedly proves himself the opposite of Socrates, particularly with respect to piety. Once the Stranger is recognized as ‘an unreliable narrator’, this apparently ponderous product of Plato’s senility becomes the taut thriller of an innovative teacher at the peak of his powers. This article offers a timely, critical analysis of the male gaze upon sportswomen in male Chinese fans’ consumption of sporting megaevents. We use the most popular Chinese-language sports fandom platform, Hupu, as the data repository and scrutinise the threads of male Hupu users’ postings about two elite sportswomen at the Tokyo 2020 Olympics as the case studies. Drawing on feminist critical discourse analysis (FCDA), we elucidate the discursive strategies that male Chinese fans adopt to sexualise sportswomen and trivialise their accomplishments. (...) Once we realize that the indivisible and infinitely repeatable One of the arithmetic lesson in Republic7 is generated by διάνοια at Parmenides 143a6-9, it becomes possible to revisit the Divided Line’s Second Part and see that Aristotle’s error was not to claim that Plato placed Intermediates between the Ideas and sensible things but to restrict that class to the mathematical objects Socrates used to explain it. All of the One-Over-Many Forms of Republic10 that Aristotle, following Plato, attacked with the Third (...) Man, are equally dependent on Images and above all on the Hypothesis of the One. (shrink)

We give a complete characterization of the class of upward monotone generalized quantifiers Q1 and Q2 over countable domains that satisfy the scheme Q1 x Q2 y φ → Q2 y Q1 x φ. This generalizes the characterization of such quantifiers over finite domains, according to which the scheme holds iff Q1 is ∃ or Q2 is ∀ (excluding trivial cases). Our result shows that in infinite domains, there are more general types of quantifiers that support these entailments.

Kantian defenders of suicide for the soon-to-be demented claim that killing oneself would protect rather than violate a person’s inherent worth. The loss of cognitive functions reduces someone to a lower moral status, so they believe that suicide is a way of preserving or preventing the loss of dignity. I argue that they misinterpret Kant’s examples and fail to appreciate the reasons behind his absolute prohibition on suicide. Although Kant says that one may have to sacrifice one’s life to fulfill (...) a moral duty, suicide is not morally equivalent to self-sacrifice because it involves treating oneself merely as a means. Furthermore, people facing the onset of dementia would not protect their dignity by killing themselves while they are still rational and would not avoid a demeaning existence. (shrink)

Not only was it a reference to Ismenias the Theban (Men. 90a4-5) that allowed nineteenth-century scholars to establish a date of composition for Plato’s Meno on the basis of Xenophon’s Hellenica but beginning with “Meno the Thessalian” himself, immortalized as a scoundrel in Xenophon’s Anabasis, each of the four characters in Plato’s dialogue is shown to have a Xenophontic resonance, thus revealing Meno to be Plato’s tombeau de Xénophon.

Using the concept of purposeful action, I define the necessary and sufficient aspects of any property. These qualities are derived though noticing that property is those things which are the object of a set of past, present, and future actions of individuals. The result is that property is the result of a change in the physical world which lends itself to control and is expected to grant a future value to the actor. By deconstruction, these qualities are used to show (...) that aggression upon another actor is equivalent to a property claim in that other actor, enforcement of a property claim may involve an aggression, and conflicting aggressions may only be compared subjectively. Thus the novel concept of net coercion is introduced to delineate which actors are making an over-reaching property claim. This incorporates the common term of aggression as used by modern libertarian theorists, but allows for a further analysis when there are conflicts of possible or perceived aggressions; certainly attempting to minimize the net coercion of a system of actors is equivalent to the special case of striving for zero-aggression. After establishing the value-free concepts that entail property regimes I define the seeking of justice as trying to minimize the net coercion of any system. From this single necessary definition of justice, a number of problems are analyzed including the stereotypical commons, a construction equivalent to hostile encirclement, and claims of property in intellectual creations. The ultimate conclusion of this analysis is that property regimes with a positive net coercion are unjust and equivalent to property claims in the individual actors subject to the more aggressive actors, in essence, that they are the chattel slaves of the dominant actors in proportion to the amount of net coercion used against them. From these foundations, a philosophical system by which to analyze particular property claims is created and a suggestion of how law and economics should treat property claims is implicit. (shrink)

After explaining the so-called “standard definition” of punishment, he poses several questions, including whether any definition can be value-neutral, whether punishments (as opposed to mere penalties) must include an expressive dimension, and whether punishment must intend to cause suffering. Altman then examines the traditional dichotomy between consequentialism and retributivism, and their different versions. Writing in 1935 as "Hugo Fiala," Karl Löwith not only connected Martin Heidegger and Carl Schmitt to an apparently contentless "decisionism" but drew attention to the fact that his correspondent Leo Strauss had attacked Schmitt—like Heidegger an open Nazi since 1933— from the Right in 1932. In opposition to the views of Peter Eli Gordon, Heidegger's bellicose stance at the Davos Hochschule of 1929 is presented as "political" in Schmitt's sense of the term while Strauss's embrace of Heidegger, never regretted, (...) showed that he ceased to be Nietzsche's "Good European" in his thirtieth year. A more significant "change of orientation" is revealed in Strauss's 1932 version of the "second cave," a pseudo-Platonic image of Verjudung . Revelation had disrupted a nihilistic "natural ignorance" that could only be reversed by an elite's secret decision for a self-contradictory content: only an atheistic religion provides a post-liberal solution to "the theological-political problem.".
