In this paper, Kate Kirkpatrick argues that the recent return to moral exemplars in exemplarist moral theory might benefit from engaging with existentialists' use of exemplars in two ways: first, by considering the role of negative exemplars and the power of emotions other than admiration in moral formation; and second, by considering objections to exemplarist education, in particular Simone de Beauvoir's objection that narrative exemplars often serve an ideological function and perpetuate oppressive ideals — especially (but not only) about (...) women. After situating this discussion in ancient and recent debates about the role of literary narratives in moral formation, Kirkpatrick outlines a moral perfectionist reading of Beauvoir and an objection to exemplarist moral theory's reliance on exemplars that “we” admire on the basis that “the admirable” often serves to promote the interests of the powerful rather than the flourishing of all human beings. Finally, while agreeing with this symposium's editors that efforts to improve our understanding of how to use narrative exemplars in educational settings are valuable, she asks how, given the force of the Beauvoirian objection, their criterion of “appropriate critical reflection” might be met. Under the Human Rights Act, British courts are for the first time empowered to review primary legislation for compliance with a codified set of fundamental rights. In this book, Aileen Kavanagh argues that the HRA gives judges strong powers of constitutional review, similar to those exercised by the courts under an entrenched Bill of Rights. The aim of the book is to subject the leading case-law under the HRA to critical scrutiny, whilst remaining sensitive to the deeper constitutional, political (...) and theoretical questions which underpin it. Such questions include the idea of judicial deference, the constitutional status of the HRA, the principle of parliamentary sovereignty and the constitutional division of labour between Parliament and the courts. The book closes with a sustained defence of the legitimacy of constitutional review in a democracy, thus providing a powerful rejoinder to those who are sceptical about judicial power under the HRA. This article is a jurisprudential analysis of the idea of a ‘living Constitution’, as a common feature of the constitutional practice in democratic countries. The main argument of the article is that constitutional interpretation encompasses, rather than excludes the judicial power to develop and change the content of constitutional guarantees. The metaphor of the ‘living Constitution’ is appropriate to the nature of constitutional adjudication because it suggests gradual, incremental change on a case-by-case basis. This first full-length study of the Arabic reception of Plato's Timaeus considers the role of Galen of Pergamum in shaping medieval perceptions of the text as transgressing disciplinary norms. It argues that Galen appealed to the entangled cosmological scheme of the dialogue, where different relations connect the body, soul, and cosmos, to expand the boundaries of medicine in his pursuit for epistemic authority – the right to define and explain natural reality. Aileen Das situates Galen's work on disciplinary boundaries (...) in the context of medicine's ancient rivalry with philosophy, whose professionals were long seen as superior knowers of the cosmos vis-à-vis doctors. Her case studies show how Galen and four of the most important Christian, Muslim, and Jewish thinkers in the Arabic Middle Ages creatively interpreted key doctrines from the Timaeus to reimagine medicine and philosophy as well as their own intellectual identities. This research presents findings from a study of gender-based differences in an ethical decision situation. The study focuses on gender as it relates to situational factors and accounting experience. The primary element of interest is how the gender of the actor (the person described in each vignette) influences the evaluation/assessment of the ethical/unethical decisions. While previous research has provided evidence of ethical differences relating to the gender of the responding subjects, limited evidence has been presented relating to situational issues that (...) may influence assessments of ethical decisions.This research uses four accounting environment vignettes to survey the responses of accountants and accounting students to the ethical/unethical nature of the actions that are taken. In addition, how likely the accountants believe they are to take the same actions is also surveyed. The subjects are a representative sample of practicing accountants in the U.S. and senior/graduate accounting majors at a state university in the southwestern United States. (shrink)

ABSTRACTThis article explores the relationship between the operation of combat drones and the martial virtue courage. The article proceeds in three parts. Part one develops a brief account of virtue generally, and the martial virtue courage in particular. Part two discusses why critics suggest that drone operation does not fit the orthodox conceptualization of courage and, in some instances, even erodes the virtue. Part three explores how these criticisms are flawed. This section of the paper goes on to argue that (...) the criticisms are predicated on a twofold misunderstanding. The first involves improperly truncated conceptualizations of courage, which are, in part, predicated upon a narrow definition of risk. From this narrow definition of risk springs the conclusion that drone operation must be riskless. The second misunderstanding follows from the first and involves the failure to grasp properly how courage can be cultivated and required in drone operation. In the decades after the Second World War, learned society publishers struggled to cope with the expanding output of scientific research and the increased involvement of commercial publishers in the business of publishing research journals. Could learned society journals survive economically in the postwar world, against this competition? Or was the emergence of a sales-based commercial model of publishing – in contrast to the traditional model of subsidized journal publishing – an opportunity to transform the often-fragile finances of learned societies? (...) But there was also an existential threat: if commercial firms could successfully publish scientific journals, were learned society publishers no longer needed? This paper investigates how British learned society publishers adjusted to the new economic realities of the postwar world, through an investigation of the activities organized by the Royal Society of London and the Nuffield Foundation, culminating in the 1963 report Self-Help for Learned Journals. It reveals the postwar decades as the time when scientific research became something to be commodified and sold to libraries, rather than circulated as part of a scholarly mission. It will be essential reading for all those campaigning to transition academic publishing – including learned society publishing – away from the sales-based model once again. (shrink)

It has been argued that the primary acquisition of genericity in early child speech poses a problem for standard quantificational approaches to generics and instead motivates the claim that generics give voice to an innate, default mode of generalising. This article argues that analogous puzzles involving the acquisition of A‐quantifiers undermine the empirical support for a purely cognition‐based approach to generics. Instead, these acquisition puzzles should be solved by generalising the core insight of the cognitive defaults theory to these expressions, (...) reconciling formal semantic approaches with the role that cognitive development plays on lexical competence. Challenging the assumption that the concept of divine action is necessarily paradoxical, on the grounds that God is radically transcendent of finitude, or can perform only a master act of creating and sustaining the universe, Frank Kirkpatrick defends as philosophically credible the Christian conviction that God is a personal Agent who also acts in particular historical moments to further the divine intention of fostering universal community. Kirkpatrick claims that God and the world are distinct realities "together bound" in (...) a mutual relationship of reciprocal historical action. In this relationship, God both acts upon and responds to human beings in specific moments in their history. What was once the factory is now the university. As deindustrialization spreads and the working class is decentralized, new means of social resistance and political activism need to be sought in what may be the last places where they are possible: the university and the art world. Gerald Raunig's new book analyzes the potential that cognitive and creative labor has in these two arenas to resist the new regimes of domination imposed by cognitive capitalism. Drawing on Gilles Deleuze's concept of (...) "modulation" as the market-driven imperative for the constant transformation and reinvention of subjectivity, in Factories of Knowledge, Industries of Creativity, Raunig charts alternative horizons for resistance. Looking at recent social struggles including the university strikes in Europe, the Spanish ¡Democracia real YA! organization, the Arab revolts, and the Occupy movement, Raunig argues for a reassessment of the importance of cultural and knowledge production. Paul of Aegina's (fl.c. 630)Pragmateiais the only extant Greek medical text from antiquity that discusses the extraction of arrows and small missiles. In his book on surgery, Paul details how to extract arrows according to their properties and the parts of the body which they have wounded (6.88). He prefaces his instructions by describing how arrows differ in their material, figure, size, number, mode, and power. Paul's account of arrow varieties appears to reflect the environment of his medical practice, seventh-century (...) In this "concise philosophy of the machine," Gerald Raunig provides a historical and critical backdrop to a concept proposed forty years ago by the French philosophers Félix Guattari and Gilles Deleuze: the machine, not as a technical device and apparatus, but as a social composition and concatenation. This conception of the machine as an arrangement of technical, bodily, intellectual, and social components subverts the opposition between man and machine, organism and mechanism, individual and community. Drawing from an unusual range of (...) films, literature, and performance--from the role of bicycles in Flann O'Brien's fiction to Vittorio de Sica's Neorealist film The Bicycle Thieves, and from Karl Marx's "Fragment on Machines" to the deus ex machina of Greek drama--Raunig arrives at an enhanced conception of the machine as a social movement, finding its most apt and concrete manifestation in the Euromayday movement, which since 2001 has become a transnational activist and discursive practice focused upon the precarious nature of labor and lives. ABSTRACTUsing a frame analysis approach this paper examines how The Irish Times and the Irish Independent portrayed public sector workers during Ireland's economic crisis. Using a sample of coverage from 2009 and 2010 it discusses the five media frames identified in this analysis, three of which were hegemonic and two of which were counter hegemonic. In this paper, I argue that coverage of the public sector by each newspaper was imbalanced and inaccurate. This paper also finds that both newspapers were (...) strong advocates of austerity cutbacks in the public service as a solution to Ireland's financial crisis, frequently representing this idea as ‘fact’ while simultaneously delegitimising those opposing this viewpoint. In this summary of my recent book , I outline a general theoretical approach for the psychology of religion and develop one component of it in detail. First I review arguments and research demonstrating the utility of attachment theory for understanding many aspects of religious belief and behavior, particularly within modern Christianity. I then introduce evolutionary psychology as a general paradigm for psychology and the social sciences, arguing that religion is not an adaptation in the evolutionary sense but rather a (...) byproduct of numerous psychological systems that evolved for other adaptive purposes, of which the attachment system is just one example. I conclude by summarizing numerous advantages of this framework over other extant approaches to the psychology of religion. (shrink)

Several recent works in political theory argue that exit, rather than being a coward’s choice, is a potent mode of resistance that is particularly well suited to the current political era. These works reclaim exit, seeing it as a method of political opposition. While innovative and illuminating, these accounts are limited because they tend to treat all exits as resistance, regardless of context or content, and they are inclined to over-saturate exit with oppositional political meaning. I argue that resistant exit (...) should be more narrowly defined. By examining a range of empirical cases, I identify and explore three distinctive characteristics of this particular type of opposition. In addition to clarifying a recently developed idea in current scholarship, this article provides a systematic way for scholars to understand and interpret the intersection between resistance and exit. The French existentialists Simone de Beauvoir and Jean‐Paul Sartre are renowned philosophers of freedom. But what “existentialist freedom” is is a matter of disagreement amongst their interpreters and, some argue, between Beauvoir and Sartre themselves. Since the late 1980s several scholars have argued that a Sartrean conception of freedom cannot justify the ethics of existentialism, adequately account for situations of oppression, or serve feminist ends. On these readings, Beauvoir disagreed with Sartre about freedom—making existentialist ethics, resistance to oppression, and feminism (...) coherently defensible. This article identifies four conceptions of freedom in order to clarify the questions of whether and how they disagreed, arguing that some incompatibilist readings of Sartre and Beauvoir conflate or confuse these conceptions in ways that render their conclusions unconvincing. However, there are stronger grounds on which to claim that Beauvoir disagreed with Sartre about morality—and the conditions of its possibility. (shrink)

This paper considers the development and judicial application of the Public Sector Equality Duty now found in section 149 Equality Act 2010, previously in a variety of forms in the Race Relations Act 1976, the Disability Discrimination Act 1995 and the Sex Discrimination Act 1975. It identifies a number of emerging themes in the jurisprudence concerned, in particular, with the relationship between the PSED and Wednesbury review, the extent of the information-gathering obligation it imposes, the delegability of PSED decision-making and (...) the timing of PSED challenge. It then considers the uncertainties which remain including, in particular, the application of the duty to various categories of decision-making, and concludes by assessing the impact of the PSED on challenges to ‘cuts’ cases arising from the reductions to public sector funding, and on domestic equality jurisprudence. Sentences with impersonal pronouns, like 'You do it like this', seem to make both statistical and prescriptive claims, that a certain way of behaving is common and that it is prescriptively good. We argue that these kinds of sentences are closely related to another kind of sentence, namely, indefinite singular generics, like 'A person does it like this'. We propose that there is a single underlying mechanism that allows both kinds of sentences to express mixed statistical/prescriptive readings. Sartre on Sin: Between Being and Nothingness argues that Jean-Paul Sartre's early, anti-humanist philosophy is indebted to the Christian doctrine of original sin. On the standard reading, Sartre's most fundamental and attractive idea is freedom: he wished to demonstrate the existence of human freedom, and did so by connecting consciousness with nothingness. Focusing on Being and Nothingness, Kate Kirkpatrick demonstrates that Sartre's concept of nothingness (le néant) has a Christian genealogy which has been overlooked in philosophical and theological discussions (...) of his work. Previous scholars have noted the resemblance between Sartre's and Augustine's ontologies: to name but one shared theme, both thinkers describe the human as the being through which nothingness enters the world. However, there has been no previous in-depth examination of this 'resemblance'. Using historical, exegetical, and conceptual methods, Kirkpatrick demonstrates that Sartre's intellectual formation prior to his discovery of phenomenology included theological elements-especially concerning the compatibility of freedom with sin and grace. -/- After outlining the French Augustinianisms by which Sartre's account of the human as 'between being and nothingness' was informed, Kirkpatrick offers a close reading of Being and Nothingness which shows that the psychological, epistemological, and ethical consequences of Sartre's le néant closely resemble the consequences of its theological predecessor; and that his account of freedom can be read as an anti-theodicy. Mainly known for its links to the periodical market and radical politics, this article recontextualizes the editorship of William Nicholson (1753–1815) in terms of its roots in the metropolitan natural philosophical circles of the second half of the 18th century as well as its impact on experimenters and men of science after 1797. The article argues that Nicholson's editorship of the Journal of Natural Philosophy, Chemistry, and the Arts was a means to expand his philosophical significance among natural philosophers at (...) home and abroad—and was, in fact, a form of epistemological subversion that challenged the “Banksian Learned Empire.”. This article presents an axiological reading of Simone de Beauvoir’s The Second Sex, reframing its most famous sentence ‘one is not born, but becomes, a woman’ as a claim about femininity, love, and alienation under particular conditions of sexual hierarchy. Because this sentence is often taken to express the thesis of The Second Sex on social constructionist readings, Section 1 rejects the aptness of this approach on three grounds. Section 2 outlines an alternative, axiological reading, which better attends to all (...) of the work’s parts, and to Beauvoir’s emphasis on the concrete inseparability of the physiological, sexual, economic, legal, religious, moral, and aesthetic dimensions of women’s situations. Section 3 turns to the sister ‘one is not born’ clause, in Volume I—‘one is not born, but becomes, a genius’—to show that Beauvoir’s account of frustrated freedom in The Second Sex concerns not only alienated labour, sex, and love, but also aesthetic creativity and moral invention. This essay gives more detailed content to the widespread view that the Human Rights Act 1998 (HRA) has changed the traditional role of parliamentary intention in statutory interpretation. It begins by outlining the various ways in which legislative intent has featured in traditional (pre-HRA) statutory interpretation. This is followed by an examination of the interpretive principles developed by the senior judiciary under the HRA case-law, focusing on the extent to which they seem to depart from traditional principles. It is argued (...) that although the traditional role of parliamentary intention is partly preserved post-HRA, the interpretive obligation under s 3(1) HRA nonetheless shifts the interpretive focus away from what Parliament originally intended in enacting the legislation under HRA scrutiny, towards fulfilling the overriding goal of achieving compatibility with Convention rights. In recent case-law under the Human Rights Act 1998, the senior judiciary have reiterated the view that their task under section 3(1) of the Act is one of ‘interpretation rather than legislation’. This article has two main aims. The first is to provide a general, theoretical analysis of the extent to which it is possible (if at all) to distinguish between interpretation and legislation. A central principle of bioethics is “subject autonomy,” the acknowledgement of the primacy of the informed consent of the subject of research. Autonomy requires informed consent — the assurance that the research participant is informed about the possible risks and benefits of the research. In fact, informed consent is difficult when a single drug is being tested, although subjects have a baseline understanding of the testing of a pharmacological agent and the understanding that they can stop taking the drug if (...) there were an adverse event. However, informed consent is even less easily achieved in the modern arena of complex new molecular and cellular therapies. In this article, we argue that as science confronts new issues such as transplantation of stem cell products, which may live within the participant for the rest of their lives, researchers must carefully consider and constantly re-examine how they properly inform subjects considering participation trials of these novel therapeutic strategies.For example, the manufacture of a vial of a cell product that consists of a collection of growing cells is very different than the production of a vial of identical pills, which can be presumed to be identical. The scientific concepts on which these cellular approaches are based may seem alien and incomprehensible to a research subject, who thinks of a clinical trial as simply the selection and testing of the most efficacious pharmaceutical agent already proven to work in preclinical animal studies. This article investigates the textual strategies with which Maeve Murphy's Silent Grace addresses viewers in contemporary Northern Ireland. Borrowing Eric Santner's concept of `narrative fetishism', the analysis examines how the film's representation of the past obscures the historical realities experienced by female political prisoners in Armagh jail in the late 1970s and early 1980s. From this standpoint, its ethical relation to historical `truth' and responsibilities to its local audience are debated.

RésuméLe « Synopsis du Timée de Platon » de Galien, ouvrage clé pour l’étude du platonisme prémoderne, survit uniquement dans une édition dite « imparfaite » de 1951 qui présente pour la première fois le texte arabe survivant accompagné de sa traduction en latin. Les rédacteurs de la série « Plato Arabus » du Corpus Platonicum, à laquelle l’édition appartient, ont attribué les défauts de cette édition à la mort inopportune de Paul Kraus, qui l'a préparée, aidé par un autre (...) réfugié juif, Richard Walzer, pendant la période de la seconde guerre mondiale. Notre analyse de sources tirées d'archives démontrera que le travail sur ce volume était majoritairement celui de Kraus. Qui plus est, nous démontrons que Walzer et le rédacteur du Corpus Platonicum Raymond Klibansky ont marginalisé le travail de Kraus sur le projet dans l'optique d'avancer leurs propres carrières universitaires en tant que Juifs réfugiés en Grande-Bretagne. Nous allons également examiner la manière dont Walzer et Klibansky ont remanié le projet initial de Kraus – celui d'un corpus sémitique du platonisme – en un « Plato Arabus » plus étroit qui s'alignerait sur une étude du platonisme latin, projet qu'ils présumaient plus susceptible d'intéresser leurs mécènes britanniques. This article offers the first edition and translation of two heretofore unpublished pharmacological treatises by Abū Bakr al-Rāzī, namely Fī ittikhādh māʾ al-jubn and Fī manāfiʿ māʾ al-jubn, which seem to have formed part of a lost volume on dairy products. As it demonstrates, al-Rāzī’s examination of whey is connected to his philosophical interest in the complex nature of simple substances such as milk. The article also highlights how these two treatises built on the Greek pharmacological tradition by incorporating ingredients (...) from Persia and India. (shrink)

In the beginning, there was Dava Sobel and Longitude: The True Story of a Lone Genius Who Solved the Greatest Scientific Problem of His Time . Others followed, in a veritable flood which D. P. Miller recently dubbed the ‘Sobel Effect’. Academic historians of science have been concerned by this flood, partly because people other than them are making money out of ‘their’ subject, but also because of the ways it might affect the public perception of the history of science. (...) Like the scientists they study, historians fear that popularizers will distort in the process of simplifying. But, knowing how difficult it has been for scientists to control the popularization of their subject, historians may not expect a great deal more success. (shrink)
