In the field of Conflict Transformation, Restorative Justice is often perceived as a transformative process focused on healing relationships after a specific harm. The parties considered in a RJ setting are those harmed, those responsible and the community impacted. This is particularly true in the field of criminal and transitional justice, and in an extended and spiritual view, there is reconciliation with the parties and God. Despite cultural differences, RJ theory and concepts have been accepted favorably in the many countries. (...) From a viewpoint focused on methodology and process, however, cultural differences have a significant effect for implementation. For example, important concepts such as control, choice, harm, responsibility, apology, shame, reconciliation and forgiveness vary greatly in the manner in which they are perceived from culture to culture and may create obstacles for successful implementation of a successful process when one culture’s process and definitions are forced upon another. Therefore, promotional factors and the implication of semiotics are an absolute consideration in developing a RJ process within a particular culture. This paper discusses the cultural differences between the United States and Japan with regard to semiotic obstacles in the implementation of a RJ model in the Japanese criminal justice system. While the exploration of cultural differences, particularly between the United States and Japan is not new and has been the focus of many disciplines, little has been considered regarding the assimilation and implementation of a Western RJ model into the Eastern culture of Japan. In sum, is an attempt to clarify and integrate the effects of cultural differences for some factors as they apply to a RJ based reconciliation process focused in Semiotics, Social psychology and the Sociology of law as they apply to the United States and Japan. Today Asia is attracting attention in the area of bioethics. In fact, the potential of bioethics is beginning to be discussed seriously at academic centers across Asia. Background Ethics committees and their system of research protocol peer-review are currently used worldwide. To ensure an international standard for research ethics and safety, however, data is needed on the quality and function of each nation's ethics committees. The purpose of this study was to describe the characteristics and developments of ethics committees established at medical schools and general hospitals in Japan. Methods This study consisted of four national surveys sent twice over a period of eight years to two separate (...) samples. The first target was the ethics committees of all 80 medical schools and the second target was all general hospitals with over 300 beds in Japan (n = 1457 in 1996 and n = 1491 in 2002). Instruments contained four sections: (1) committee structure, (2) frequency of annual meetings, (3) committee function, and (4) existence of a set of guidelines for the refusal of blood transfusion by Jehovah's Witnesses. Results Committee structure was overall interdisciplinary. Frequency of annual meetings increased significantly for both medical school and hospital ethics committees over the eight years. The primary activities for medical school and hospital ethics committees were research protocol reviews and policy making. Results also showed a significant increase in the use of ethical guidelines, particularly those related to the refusal of blood transfusion by Jehovah's Witnesses, among both medical school and hospital ethics committees. Conclusion Overall findings indicated a greater recognized degree of responsibilities and an increase in workload for Japanese ethics committees. (shrink)

L’article explore le tai chi, art martial d’origine chinoise aujourd’hui majoritairement suivi pour ses bienfaits sur la santé et ses implications spirituelles. Notre intérêt porte sur le fait que l’entraînement à des « formes », une série de mouvements exécutés en solitaire, souvent lentement, s’observe non seulement dans la plupart des écoles focalisées sur la santé, mais aussi dans une minorité portée sur l’aspect martial. Pour analyser le rôle des formes dans l’apprentissage des techniques de combat, l’article s’appuie sur l’émersiologie, (...) l’étude de l’activation involontaire du corps, permettant la focalisation sur les éléments propices à la transformation du schéma corporel. Recent metaphor research has revealed that metaphor comprehension involves both categorization and comparison processes. This finding has triggered the following central question: Which property determines the choice between these two processes for metaphor comprehension? Three competing views have been proposed to answer this question: the conventionality view (Bowdle & Gentner, 2005), aptness view (Glucksberg & Haught, 2006b), and interpretive diversity view (Utsumi, 2007); these views, respectively, argue that vehicle conventionality, metaphor aptness, and interpretive diversity determine the choice between the categorization (...) and comparison processes. This article attempts to answer the question regarding which views are plausible by using cognitive modeling and computer simulation based on a semantic space model. In the simulation experiment, categorization and comparison processes are modeled in a semantic space constructed by latent semantic analysis. These two models receive word vectors for the constituent words of a metaphor and compute a vector for the metaphorical meaning. The resulting vectors can be evaluated according to the degree to which they mimic the human interpretation of the same metaphor; the maximum likelihood estimation determines which of the two models better explains the human interpretation. The result of the model selection is then predicted by three metaphor properties (i.e., vehicle conventionality, aptness, and interpretive diversity) to test the three views. The simulation experiment for Japanese metaphors demonstrates that both interpretive diversity and vehicle conventionality affect the choice between the two processes. On the other hand, it is found that metaphor aptness does not affect this choice. This result can be treated as computational evidence supporting the interpretive diversity and conventionality views. AbstractThe Belmont Report continues to be held in high regard, and most bioethical analyses conducted in recent years have presumed that it affects United States federal regulations. However, the assessments of the report’s creators are sharply divided. Understanding the historic reputation of this monumental report is thus crucial. We first recount the historical context surrounding the creation of this report. Subsequently, we review the process involved in developing ethical guidelines and describe the report’s features. Additionally, we analyze the effect of (...) unfolding events on the subsequent creation of federal regulations, especially on gene therapy clinical trials. Moreover, throughout this paper we evaluate the ethical principles outlined in this report and describe how they overlap with the issue of protecting socially vulnerable groups. Based on the analysis, we conclude that the features of the Belmont Report cannot be considered as having affected the basic sections of the federal regulations for ethical reviews that were made uniform in 1981. Nevertheless, regarding the regulations on gene therapy clinical trials—which were at first expected to be applicable to research involving children—in addition to implementing policies regarding the public review of protocols that passed ethical review, this report’s principles are clearly reflected in the key notes that should have been referred to when the report was created. In this article, we address the problem of how people understand predicative metaphors such as “The rumor flew through the office,” and argue that predicative metaphors are understood as indirect (or two-stage) categorizations. In the indirect categorization process, the verb (e.g., fly) of a predicative metaphor evokes an intermediate entity, which in turn evokes a metaphoric category of actions or states (e.g., “to spread rapidly and soon disappear”) to be attributed to the target noun (e.g., rumor), rather than directly evoking (...) a metaphoric category as argued by CitationGlucksberg's (2001) categorization theory. We test our argument using two experiments, namely, offline comprehension and online priming. The offline comprehension experiment showed that interpretation of predicative metaphors had greater overlap with words indirectly associated with the verb than those directly associated with the verb. The online priming experiment demonstrated that indirectly associated words were activated during predicative metaphor comprehension, but directly associated words were not. These results provide convergent evidence for our argument, and thus the psychological validity of two-stage categorization as a process of predicative metaphor comprehension was confirmed. (shrink)

The trolley problem is a classic thought experiment that evokes an ethical dilemma. Thomson’s “bystander” and “footbridge” versions of the trolley problem induce different intuitive judgments about what to choose in the ethical dilemma. However, we can question how robust these intuitive judgments are. We thus conducted an online survey experiment of Thomson’s versions of the trolley problem which showed that more respondents tended to choose not pulling the lever in the bystander version and pushing a person off the bridge (...) in the footbridge version when they believed they were not being watched. These results illustrate that people’s decisions deviate from the social norms in the absence of the public’s attention. To activate the practice of holding the manufacturers to a normative expectation based on the social norms, we suggest the law must be changed. (shrink)

Die Frage, ob das Absolute dem Wissen gegenüber in Erscheinung tritt, -- dieser Schatten des Skeptizismus -- kommt im Bezirk des deutschen Idealismus nie auf.

The author points out that there is an essential difference as well as correspondence between the idea of the absolute in Fichte’s philosophy and that of the emptiness in Mahayana Buddhism. Both ideas treat the origin of the subject which goes beyond the relation of subject and object. In this point they are in agreement. But if we pay attention to the point that the absolute in Fichte’s philosophy is completely closed and therefore includes no negation in itself, it becomes (...) clear that it is, however, different from the Buddhist emptiness which consists in selfaffirmation through selfnegation. According to the author, the consciousness which works as a creator of the world in Fichte’s system remains out of the absolute. In this sense, Fichte’s idea of the absolute is insufficient as a principle of philosophy.Der Verfasser weist darauf hin, dass es zwischen dem Begriff des Absoluten bei Fichte und dem der Leere im Mahayanabuddhismus neben einer Übereinstimmung auch einen wesentlichen Unterschied gibt. Beide Begriffe stimmen darin überein, dass es ihnen um den Ursprung des Subjekts geht, der über die Relation von Subjekt und Objekt hinausgeht. Wenn man aber die Aufmerksamkeit darauf richtet, dass das Absolute bei Fichte als ein in sich Geschlossenes keine Negation in sich enthält, wird deutlich, dass es sich von der buddhistischen Leere unterscheidet, die in Selbstaffirmation durch Selbstnegation besteht. Was Nāgārjuna a thinker of philosophy or religion? This must be a question of the kind to which the answer depends heavily on the definition of “philosophy” and “religion”. Therefore, we may prefer to rephrase this question as: “Can Nāgārjuna legitimately be called a thinker of philosophy or religion?” Although it has been and may still be defined by its method or the objects of “philosophical thinking”, philosophy is, in most cases, expected to have the following characteristics: (1) Philosophy is (...) a type or product of human thought. (2) It is motivated by the human inclination for inquiry into the fundamental basis of being, whether human, social, or natural. (3) It is, theoretically at least, free from any types of dogmatic premises, whether traditional, social, or religious. (4) It requires a thoroughly logical and unequivocal usage of words and sentences. Likewise, although it has been and may still be defined by the existence or number of the absolute(s), be they god(s), spirit(s) or mental state(s), religion is, in most cases, expected to have the following characteristics: (1) Religion is a type of human beliefsystemor a product thereof. (2) It is motivated by the human inclination for ultimate reliance upon the absolute being or state. (3) It is, in practice, not completely free from some types of authoritative premises, whether traditional, customary, or founded by a certain individual. (4) It requires a purified mind, a deep understanding oftradition, constant practice and a careful observance of certain rules and regulations. Taking into account of the above characteristics of philosophy and religion, can we legitimately regard Nāgārjuna as a thinker of philosophy, religion, both, or neither? Let me focus on this question with an analysis of Nāgārjuna’s discussion as found in his magnum opus, Mūlamadhyamakakārikā, and related works. (shrink)

In this paper, we propose a new method to deal with continuously varying quantity in the situation calculus based on the concept of the nonstandard analysis. The essential point of the method is to devise a new model called nonstandard situation calculus, which is an interpretation of the situation calculus in the set of hyperreals. This nonstandard model allows discrete but uncountable (hyperfinite) state transition, so that we can describe and reason about the continuous dynamics which are usually treated with (...) differential equations. In this enlarged perspective of the nonstandard situation calculus, we discuss about an infinitesimal action, infinite plan and an abnormality theory for the temporal prediction based on the differentiability. It is often argued that relational egalitarianism has a fundamental problem with intergenerational justice when compared to other theories of justice such as utilitarianism, prioritarianism, and luck egalitarianism. Recently, Timothy Sommers argued that there is no such comparative disadvantage for relational egalitarianism. His argument is quite modest: it merely aims to reject the claim that there could be no way to extend relational egalitarianism to intergenerational justice. This may be called the ‘No Comparative Disadvantage Thesis’. The present article challenges Sommers’s (...) argument in two ways. First, I show that Sommers fails to provide a reasonable constraint on causal efficacy, which is crucial to his argument for our relation (not relationship) to future generations. Second, I show that the chain-relatedness problem casts a shadow over Sommers’s argument for the No Comparative Disadvantage Thesis. More specifically, compared to the other theories of justice, relational egalitarianism (as it stands) can less easily justify that present persons have duties to future others. This is because relational egalitarianism cannot appeal to a specific principle in regard to the duties in question, because its principle is sensitive to current context and practice. I conclude that the No Comparative Disadvantage Thesis does not hold much promise. (shrink)
