This book aims to distil the essentials of liberal constitutionalism from the jurisprudence and practice of contemporary liberal-democratic states. It argues that the model liberal-democratic constitution is best understood as a unity of three constitutional frameworks: libertarian, egalitarian, and communitarian. When viewed in this light, the liberal constitution embodies a surprising synthesis. It reconciles a commitment to individual liberty and freedom of conscience with the perfectionist idea that the state ought to cultivate a type of personality whose fundamental ends are (...) the goods essential to dignity. It is difficult to say in a few words how much I owe to Hans Albert. It all began with invitations to the wonderful Alpbach European Forum, where for many years Hans helped to organize [i. e. organized] the regular Philosophy Seminar. He first invited me there in 1975, and again in 1980, 1987, 1993, 1995, 1998 and 2001. Hans really was the ‘Spirit of Alpbach’, as somebody once described him to me, and these were all memorable occasions in many (...) ways. I also met Gretl there, and their sons. Illness creates a range of negative emotions in patients including anxiety, fear, powerlessness, and vulnerability. There is much debate on the ‘therapeutic’ or ‘helping’ nurse–patient relationship. However, despite the current agenda regarding patient-centred care, the literature concerning the development of good interpersonal responses and the view that a satisfactory nursing ethics should focus on persons and character traits rather than actions, nursing ethics is dominated by the traditional obligation, act-centred theories such as consequentialism and deontology. I critically examine these theories (...) and the role of duty-based notions in both general ethics and nursing practice. Because of well-established flaws, I conclude that obligation-based moral theories are incomplete and inadequate for nursing practice. I examine the work of Hursthouse on virtue ethics’ action guidance and the v-rules. I argue that the moral virtues and a strong (action-guiding) version of virtue ethics provide a plausible and viable alternative for nursing practice. I develop an account of a virtue-based helping relationship and a virtue-based approach to nursing. The latter is characterized by three features: (1) exercising the moral virtues such as compassion; (2) using judgement; and (3) using moral wisdom, understood to include at least moral perception, moral sensitivity, and moral imagination. Merits and problems of the virtue-based approach are examined. I relate the work of MacIntyre to nursing and I conceive nursing as a practice: nurses who exercise the virtues and seek the internal goods help to sustain the practice of nursing and thus prevent the marginalization of the virtues. The strong practice-based version of virtue ethics proposed is context-dependent, particularist, and relational. Several areas for future philosophical inquiry and empirical nursing research are suggested to develop this account yet further. (shrink)

The Dutch Book argument, like Route 66, is about to turn 80. It is arguably the most celebrated argument for subjective Bayesianism. Start by rejecting the Cartesian idea that doxastic attitudes are ‘all-or-nothing’; rather, they are far more nuanced degrees of belief, for short credences, susceptible to fine-grained numerical measurement. Add a coherentist assumption that the rationality of a doxastic state consists in its internal consistency. The remaining problem is to determine what consistency of credences amounts to. The Dutch Book (...) argument, in a nutshell, says that if your credences do not obey the probability calculus, you are ‘incoherent’—susceptible to sure losses at the hands of a ‘Dutch Bookie’—and thus irrational. Conclusion: rationality requires your credences to obey the probability calculus. And like Route 66, the fortunes of the Dutch Book argument have been mixed. Opinions on the argument are sharply divided. The list of its proponents is quite a ‘who’s who’ of philosophers of probability; they include de Finetti (1937, 1980), Carnap (1950, 1962, and more fully, 1955), Kemeny (1955), Lehman (1955), Shimony (1955), Adams (1962), Mellor (1971), Rosenkrantz (1981), van Fraassen (1989), Jeffrey (1983, 1992). In the United States and elsewhere, there is substantial controversy regarding the use of race and ethnicity by police in determining whom to stop, question, and investigate in relation to crime and security issues. In the ethics literature, the debate about profiling largely focuses on the nature of profiling and when (if ever) profiling is morally justifiable. This essay addresses the related, but distinct, issue of whether states have a duty to collect information about the race and ethnicity of persons (...) stopped by police. I argue that states in the U.S. do have such a duty on the grounds that such information collection would help secure the value of persons’ human rights against discrimination and unfair policing. Nonetheless, a large number of states do not require it. I begin by distinguishing rights from the value of rights, and arguing that under certain conditions persons have claims to the value of rights themselves, and that states have duties to secure that value. I then turn to the issue of profiling and offer the value of rights argument in favor of information collection about the race and ethnicity of persons stopped by police. (shrink)

As one who writes from “the milieu of American university philosophy,” I should no doubt be grateful that Thomas O’Meara, a scholar who has “a slightly different perspective — one derived from medieval, German, and theological study” — has condescended to review my book Schelling: An Introduction to the System of Freedom. Indeed, I am grateful, for Father O’Meara has revealed to me some of the shortcomings of my own perspective. Limited by my “optic of the Enlightenment and modern American (...) philosophy,” I approached Schelling by reading what he wrote, developing interpretations, and arguing in favor of them. O’Meara’s “slightly different” perspective apparently grants him direct access to Schelling’s thought, allowing him to dispense with the tedious business of citation and argumentation. O’Meara’s revelations also bring to light some surprising differences between what Schelling thought and what he wrote. (shrink)

K. C. Klauer, J. Musch, and B. Naumer (2000) presented a general multinomial model of belief bias effects in syllogistic reasoning. They claimed to map a particular mental model account of belief bias (J. V. Oakhill, P. N. Johnson-Laird, & A. Garnham, 1989) onto this model and to show empirically that it is incorrect. The authors argue that this mental model account does not map onto the multinomial model and that it can account for the data presented by Klauer et (...) al. (Experiments 1–4). The authors further argue that additional data Klauer et al. presented in support of a new model of their own (Experiments 5– 8) are explained by this mental model account. The mental model account is, therefore, refuted neither by Klauer et al.’s theoretical analysis nor by any of the results they presented. Furthermore, the account can accommodate more recent findings on belief bias in a more satisfactory way than can alternative models that have been proposed. (shrink)

Hegel and the Spirit explores the meaning of Hegel's grand philosophical category, the category of Geist, by way of what Alan Olson terms a pneumatological thesis. Hegel's philosophy of spirit, according to Olson, is a speculative pneumatology that completes what Adolf von Harnack once called the "orphan doctrine" in Christian theology--the doctrine of the Holy Spirit. Olson argues that Hegel's development of philosophy as pneumatology originates out of a deep appreciation of Luther's dialectical understanding of Spirit and that Hegel's (...) doctrine of Spirit is thus deeply interfused with the values of Würtemberg Pietism. Olson further maintains that Hegel's Enzyklopdie is the post-Enlightenment philosophical equivalent of a Trinitätslehre and that his Rechtsphilosophie is an ecclesiology. Thus Hegel and the Spirit demonstrates the truth of Karl Barth's observation that Hegel is the potential Aquinas of Protestantism. Exploring Hegel's philosophy of spirit in historical, cultural, and personal religious context, the book identifies Hegel's relationship with Hölderlin and his response to Hölderlin's madness as key elements in the philosopher's religious and philosophical development, especially with respect to the meaning of transcendence and dialectic.
