All the rest is commentary.a (TM) These words at the beginning of the preface of this book perfectly indicate what On Law and Reason is about. It is a theory about the nature of the law which emphasises the role of reason in the law and which refuses to limit the role of reason to the application of deductive logic. (...) In 1989, when the first edition of On Law and Reason appeared, this book was ground breaking for several reasons. It provided a rationalistic theory of the law in the language of analytic philosophy and based on a thorough understanding of the results, including technical ones, of analytic philosophy. That was not an obvious combination at the time of the booka (TM)s first appearance and still is not. The result is an analytical rigor that is usually associated with positivist theories of the law, combined with a philosophical position that is not natural law in a strict sense, but which shares with it the emphasis on the role of reason in determining what the law is. If only for this rare combination, On Law and Reason still deserves careful study. On Law and Reason also foreshadowed and influenced a development in the field of Legal Logic that would take place in the nineties of the 20th century, namely the development of non-monotonic (a defeasiblea (TM)) logics for the analysis of legal reasoning. Procrastination as putting off until tomorrow what one had intended to do today is well-known tendency in everyday life. In an attempt to understand the character of procrastination in different life-domains, a large body of research has been accumulated over the last decades. This article was aimed to evaluate a specific decisional procrastination of school-to-work transition that is treated as maturity postponement. Two studies are reported examining SWT procrastination defined as career indecision among Polish students graduating universities. In Study 1, (...) attitudinal and identity statuses were analyzed as correlates of career procrastination. A path analysis conducted for the model, which was aimed to explain the influence of career self-efficacy and occupational commitment on career indecision, revealed its very good fitness. Those two independent variables explain 10% of career indecision variance. Stepwise multiple regression analyses conducted to ascertain relationship of five identity statuses to procrastination measure showed that Commitment Making and Ruminative Exploration are strongest predictor variables. In study 2, the stepwise multiple regression analyses conducted to ascertain the independent relationship of each of Big Five personality factor revealed that Neuroticism and Extraversion accounts of the most of explained variance of school-to-work transition procrastination. According to international longitudinal studies, the quality of preschool education is of great importance for children’s further development. The modern research’s greatest interest in the field of studying the quality of preschool education is precisely the assessment of the relationship between the teacher and children as well as the teaching quality in kindergarten groups. In this regard, the Classroom Assessment Scoring System (CLASS) seems to be the one of the most relevant for the educational environment quality evaluation. The CLASS methodology (...) (which includes emotional support, classroom organization, and instrumental support) is based on the cultural-historical approach, which shows the interaction between students and adults as the main mechanism for child’s development. The aim of this study is to investigate the relationships between different aspects of the classroom organization quality in kindergarten groups and executive functions components (such as cognitive flexibility, inhibitory control, and working memory) in 5–6-year-old children. The quality of classroom interaction was measured by the CLASS. The study used the Dimensional Change Card Sort (DCCS) method to assess cognitive flexibility and the NEPSY-II subtests “Inhibition” to assess inhibitory control and “Memory for Designs” and “Sentences Repetition” to assess visuo-spatial and verbal working memory, respectively. The study was approved by the Ethics Committee of the Faculty of Psychology at Lomonosov Moscow State University. The study involved 26 kindergarten groups in Moscow. While conducting the research, extreme groups were identified (5 with low quality and 10 with high-quality levels of classroom interaction). Then, three kindergarten groups with low level (65 children) and three groups with high level (68 children) of interaction within classroom were selected and compared. The results revealed that children from groups with low level of classroom interaction have higher results in cognitive flexibility tasks when compared with children from groups with high level of interaction. Also, children from groups with high-quality classroom interaction demonstrated higher results in visuo-spatial working memory tasks and inhibitory control tasks as contrasted with children from low-quality groups. These findings attest to the importance of classroom interaction quality for the executive functions development in the preschool age. (shrink)

The aim of this paper is to illustrate some difficulties connected with the global ethic. The author shows mutual relations between socio-economic domain and the public health. Beginning with Peter Singer’s argumentation, the author points that the inequality is the main factor hampering moral action. The inequality generated by contemporary capitalism has an immediate influence on the health of people. Individual charity is not sufficient to solve such problems like life expectancy, health care, starvation or global warming. Epistemicism associates vagueness with ignorance produced by semantic plasticity: the shiftiness of intensions in our language resulting from small changes in usage. The recent literature (Caie 2012; Magidor 2018; Yli-Vakkuri 2016) points to a missing piece in the epistemicist theory of vagueness, namely a clear account of the semantics of the definiteness operator Δ. The fundamentals of the epistemicist theory are well understood. However, the technical work of defining the definiteness operator has proven difficult. There are several desiderata that we (...) would like Δ to satisfy. For instance, we would like the epistemicist notion of ‘definiteness’ to interact well with modal operators and validate intuitive principles like ‘necessarily, if φ is definitely true, then φ is true’. Providing an account that would meet all such desiderata has eluded the epistemicists so far. In this paper, I present a novel version of a multidimensional model inspired by the work of Robert Stalnaker and David Kaplan. Using this model, I provide an account of epistemicist definiteness that meets our desiderata. (shrink)

This paper relates to a formal statement of the mechanisms that are thought minimally necessary to underpin consciousness. This is expressed in the form of axioms. We deem this to be useful if there is ever to be clarity in answering questions about whether this or the other organism is or is not conscious. As usual, axioms are ways of making formal statements of intuitive beliefs and looking, again formally, at the consequences of such beliefs. The use of this style (...) of exposition does not entail a claim to provide a mathematically rigorous formal deductive system. Conventional mathematical notation is used to achieve clarity, although this is elaborated with natural language in an attempt to reduce terseness. In our view, making the approach axiomatic is synonymous with building clear usable tests for consciousness and is therefore a central feature of the paper. The extended scope of this approach is to lay down some essential properties that should be considered when designing machines that could be said to be conscious. In the broader discussion about the nature of consciousness and its neurological mechanisms, it may seem to some that axiomatisation is premature and continues to beg many questions. However, the approach is meant to be open- ended so that others can build further axiomatic clarifications that address the very large number of questions which, in the search for a formal basis for consciousness, still remain to be answered. Of course, in discussions about consciousness many will also argue that the subject is not one that may ever be formally addressed by means of axioms. The view taken in this paper is 'let's try to do it and see how far it gets'. (shrink)

In the period between Turing’s 1950 “Computing Machinery and Intelligence” and the current considerable public exposure to the term “artificial intelligence ”, Turing’s question “Can a machine think?” has become a topic of daily debate in the media, the home, and, indeed, the pub. However, “Can a machine think?” is sliding towards a more controversial issue: “Can a machine be conscious?” Of course, the two issues are linked. It is held here that consciousness is a pre-requisite to thought. In Turing’s (...) imitation game, a conscious human player is replaced by a machine, which, in the first place, is assumed not to be conscious, and which may fool an interlocutor, as consciousness cannot be perceived from an individual’s speech or action. Here, the developing paradigm of machine consciousness is examined and combined with an extant analysis of living consciousness to argue that a conscious machine is feasible, and capable of thinking. The route to this utilizes learning in a “neural state machine”, which brings into play Turing’s view of neural “unorganized” machines. The conclusion is that a machine of the “unorganized” kind could have an artificial form of consciousness that resembles the natural form and that throws some light on its nature. (shrink)

The main stream of legal theory tends to incorporate unwritten principles into the law. Weighing of principles plays a great role in legal argumentation, inter alia in statutory interpretation. A weighing and balancing of principles and other prima facie reasons is a jump. The inference is not conclusive.To deal with defeasibility and weighing, a jurist needs both the belief-revision logic and the nonmonotonic logic. The systems of nonmonotonic logic included in the present volume provide logical tools enabling one to speak (...) precisely about various kinds of rules about rules, dealing with such things as applicability of rules, what is assumed by rules, priority between rules and the burden of proof. Nonmonotonic logic is an example of an extension of the domain of logic. But the more far-reaching the extension is, the greater problems it meets. It seems impossible to make logical reconstruction of the totality of legal argumentation. (shrink)

Legal dogmatics in Continental European law (scientia iuris, Rechtswissenschaft) consists of professional legal writings whose task is to systematize and interpret valid law. Legal dogmatics pursues knowledge of the existing law, yet in many cases it leads to a change of the law. Among general theories of legal dogmatics, one may mention the theories of negligence, intent, adequate causation and ownership. The theories produce principles and they also produce defeasible rules. By means of production of general and defeasible theories, legal (...) dogmatics aims at obtaining a system of law that is both internally coherent and harmonized with its background in morality and (political) philosophy. Legal dogmatics is necessary in the context of constitutional constraints on the majority rule. Only if the courts act on the basis of Reason they can be a legitimate counterpart of the majority rule. And Reason cannot be exhausted by particular decision making. It also needs a more abstract deliberation, given by expert jurists. However, legal dogmatics has been a target of several kinds of criticism: empirical, morally-political, epistemological, logical, and ontological. The position taken in this article is to answer such criticism by mutually adjusting philosophy and the practices of the law. (shrink)

This paper explores Nicholas of Cusa’s framing of the De pace fidei as a dialogue taking place incaelo rationis. On the one hand, this framing allows Nicholas of Cusa to argue that all religious rites presuppose the truth of a single, unified faith and so temporally manifest divine logos in a way accommodated to the historically unique conventions of different political communities. On the other hand, at the end of the De pace fidei, the interlocutors in the heavenly dialogue are (...) enjoined to return to earth and lead their countrymen in a gradual conversion to the acceptance of rites which would explicitly acknowledge the metaphysically presupposed transcendent unity of all true faiths. In light of these two aspects of the literary framing of the De pace fidei, the question that motivates this paper concerns the extent to which the understanding of history subtending Cusanus’ temporal political aims is consistent with the understanding of history grounded in his metaphysical presupposition that there is una religio in omni diversitate rituum. In addressing this question, I shall argue that the literary strategy of the De pace fidei sacrifices Nicholas of Cusa’s apologetic doctrinal aims insofar as the text creates an allegorical space in which the tension between its literal and figurative dimensions assigns to its readers the task of choosing their own orientations to the significance of history as a foundation for future action. This paper compares the capability approach (CA) and libertarian paternalism (LP) to see whether they are compatible. The comparison focuses on rationality, wellbeing, and freedom. The main theoretical framework is Sen’s ‘reason to value’ (RtV). The relevance of this to CA, and LP is analysed, and whether the primacy that CA and LP both accord to reason leads to paternalism is examined. Although the principal focus is on Sen’s, Sunstein’s and Thaler’s original ideas, their key concepts are analysed in the (...) context of the contemporary critical literature on the topic. This critical analysis not only makes it possible to assess whether CA and LP are compatible, but also to see how they perceive rationality, wellbeing, and freedom. The critical analysis further differentiates the various interpretations of RtV in the literature and explains how CA and LP function. (shrink)

Legal doctrine is a kind of legal research, occupying the central position in professional legal writing, e.g., handbooks, monographs, commentaries and legal textbooks etc. It consists of a description of the literal sense of legal statutes, precedents etc., intertwined with many moral and other substantive reasons. Legal doctrine has normative components, and produces coherence in the law in many aspects. It also produces some justice. However, legal doctrine has faced repeated criticism, not least from minimalist philosophers.The author proposes a “Copernican (...) revolution” as regards the relation of legal theory to philosophy. Instead of attempting to make legal theory follow one of the notoriously controversial moral theories, he tries to adjust philosophy to legal theory. In the search for philosophy adjusted to legal doctrine, he prefers cautious (weak) philosophical positions to courageous (strong) ones. He also assumes a society‐centered theory of normativity, a coherentist theory of legal knowledge and a coherentist theory of justice.However, a law theorist has no chance to elaborate such theories in detail. Hence, the author poses the following questions to philosophers: How can a law theorist assume society‐centered normativity without being forced to enter the controversies around collectivism? How can a law theorist assume the common core of morality for society without being forced to enter technical controversies in political philosophy? How can the law theorist base his thinking on the coherence theory of law without being forced to enter technical controversies around the concept of coherence? How can the law theorist avoid hopeless ontological controversies? (shrink)

The epistemicist theory aims to explain ignorance due to vagueness by semantic plasticity: the shiftiness of intensions across close possible worlds resulting from shiftiness in usage. This explanation is challenged by the Omniscient Speaker Puzzle (Sennet in Philos Stud 161(2):273–285, 2012). Suppose that an omniscient speaker, Barney, who knows all the facts about usage and how these facts determine the intensions of expressions, cooks up a scheme to stabilise the intension of a normally semantically plastic term like ‘rich’. It seems (...) that ‘rich’ would display all the phenomena associated with vagueness without being semantically plastic, thus making the epistemicist explanation of ignorance due to vagueness insufficient. Although considerations regarding the political sphere do not occupy much space within Immanuel Kant’s system, the influence of his concepts on our contemporary critical thinking is enormous. The coherence of Kant’s political concept also remains a problem, where the highest good to be achieved by humanity is eternal peace, within the entirety of critical philosophy. In this article, I attempt to show that such a connection exists, and the vision of political order can be interpreted as the highest form of (...) realization of rationality, whose source is reason. The realization of such a goal can only be thought of hypothetically, but most surprisingly, it is conditioned on the assumption of the existence of God as the creator of a universal community of people of good will. Źródła w językoznawstwie są rozpatrywane z punktu widzenia funkcjonalnej teorii kultury B. Malinowskiego. Typologia źródeł ma charakter zespołu opozycji dychotomicznych, które zawierają takie kategorie, jak lingwistyczne vs. językowe, eksplicytne vs. implicytne, naturalne vs. sztuczne itd. Specjalną uwagę poświęca się czynnikom odmienności źródeł lingwistycznych, a mianowicie takim jak: 1) wewnętrzna dyferencja dyscyplin lingwistycznych; 2) dynamika paradygmatów lingwistyczno-filozoficznych; 3) specyfika stylów naukowych w tradycjach narodowych i geokulturowych.
