This paper examines whether firms strategically legitimize large labor dismissals by performing ex-ante downward earnings management. We further assess whether the effect is larger under stakeholder pressure and whether these practices influence the external perception of firms’ behavior. As laying off employees without an economic reason is perceived as a breach of the social contract, stakeholders pressure firms to provide economic justification for LLDs. We argue that firms strategically legitimize LLDs by artificially worsening their financial performance through downward earnings management. (...) From a sample of European listed firms for the period 1998–2014, using a propensity score matching model to control for differences in observable characteristics between LLD and non-LLD firms, we find that firms manage their earnings downward in the year prior to LLDs. These results are more pronounced in the presence of high stakeholder pressure. As such, firms with stronger trade unions, higher visibility, stricter employment protection legislation, and more stakeholder-oriented legal environments have stronger incentives to manage earnings downward before LLDs. Finally, we document that downward earnings management prior to LLDs is effective at legitimizing LLDs, offsetting the negative external perceptions of firms in the aftermath of LLDs. This study contributes to the business ethics literature by identifying unintended consequences of stakeholder pressure around LLDs. It also brings important empirical insights into how ethically questionable decisions are strategically legitimized through further unethical practices. (shrink)

Within social psychology, group identification refers to a mental process that leads an individual to conceive of herself as a group member. This phenomenon has recently attracted a great deal of attention in the debate about shared agency. In this debate, group identification is appealing to many because it appears to explain important forms of intentionally shared actions in a cognitively unsophisticated way. This paper argues that, unless important issues about group identification are not illuminated, the heuristic function ascribed to (...) this notion for an understanding of shared agency remains dubious at best and unfulfilled at worst. This paper offers such a clarification by distinguishing and describing two different mental processes that constitute group identification: adoption of the group perspective and transformation in self-understanding. It is claimed that the latter process consists in the production of what Ruth Millikan labels “Pushmi-Pullyu representations” and that it is developmentally prior with respect to the ability of adopting the group perspective. When you and I share an experience, each of us lives through a we-experience. The paper claims that we-experiences have unique phenomenality and structure. First, we-experiences’ phenomenality is characterised by the fact that they feel like ours to their subject. This specific phenomenality is contended to derive from the way these experiences self-represent: a we-experience exemplifies us-ness or togetherness because it self-represents as mine qua ours. Second, living through a we-experience together with somebody else is not to have this experience (...) in parallel with the experience of the other. Rather, the paper argues that a we-experience is partly co-constituted by the experience of the other. After offering an account of the phenomenality and constitution of we-experiences, which traces these two elements back to the subject’s self-understanding as a group member, the paper argues for the claim that an experience’s for-us-ness is committal to this experience being co-constituted by another we-experience. PA is Peano arithmetic. The formula $\operatorname{Interp}_\mathrm{PA}(\alpha, \beta)$ is a formalization of the assertion that the theory PA + α interprets the theory PA + β (the variables α and β are intended to range over codes of sentences of PA). We extend Solovay's modal analysis of the formalized provability predicate of PA, Pr PA (x), to the case of the formalized interpretability relation $\operatorname{Interp}_\mathrm{PA}(x, y)$ . The relevant modal logic, in addition to the usual provability operator `□', has a (...) binary operator ` $\triangleright$ ' to be interpreted as the formalized interpretability relation. We give an axiomatization and a decision procedure for the class of those modal formulas that express valid interpretability principles (for every assignment of the atomic modal formulas to sentences of PA). Our results continue to hold if we replace the base theory PA with Zermelo-Fraenkel set theory, but not with Gödel-Bernays set theory. This sensitivity to the base theory shows that the language is quite expressive. Our proof uses in an essential way earlier work done by A. Visser, D. de Jongh, and F. Veltman on this problem. In a recent paper, Thomas Szanto develops an account of hatred, according to which the target of this attitude, paradigmatically, is a representative of a group or a class. On this account, hatred overgeneralises its target, has a blurred affective focus, is co-constituted by an outgroup/ingroup distinction, and is accompanied by a commitment for the subject to stick to the hostile attitude. While this description captures an important form of hatred, this paper claims that it does not do justice to (...) the paradigmatic cases of this attitude. The paper puts forward a “singularist” view of hatred, the core idea of which is that, in its simpler form, hatred is to aversively target the other qua this individual person, where the adverb “aversively” expresses the subject’s desire for the target to be annihilated. The conclusion develops some general considerations on the distinction between paradigmatic and marginal instances of an attitude by highlighting its importance for the study of affective phenomena. Massive amounts of data are collected and stored on a routine basis in virtually all domains of human activities. Such data are potentially useful to biomedicine. Yet, access to data for research purposes is hindered by the fact that different kinds of individual-patient data reside in disparate, unlinked silos. We propose that data cooperatives can promote much needed data aggregation and consequently accelerate research and its clinical translation. Data cooperatives enable direct control over personal data, as well as more democratic (...) governance of data pools. This model can realize a specific kind of data economy whereby citizens and communities are empowered to steer data use according to their motivations, preferences, and concerns. Policy makers can promote this model by recognizing citizens’ rights to access and to obtain a copy of their own data, and by funding distributed data infrastructures piloting new data aggregation models. Many types of part-whole relations have been proposed in the literature to aid the conceptual modeller to choose the most appropriate type, but many of those relations lack a formal specification to give clear and unambiguous semantics to them. To remedy this, a formal taxonomy of types of mereological and meronymic part-whole relations is presented that distinguishes between transitive and intransitive relations and the kind of entity types that are related. The demand to use it effectively brings afore new requirements (...) for automated reasoning over a hierarchy of relations. To ensure logically and ontologically correct inferencing over both the class and role hierarchy, the new reasoning service RBox compatibility for Description Logics reasoners is introduced. The proposed combination of formal semantics and the new reasoning service will improve the representation of the application domain when using part-whole relations in conceptual models and ontologies. The dominant conception of delusion in psychiatry (in textbooks, research papers, diagnostic manuals, etc.) is predominantly epistemic. Delusions are almost always characterized in terms of their epistemic defects, i.e., defects with respect to evidence, reasoning, judgment, etc. However, there is an individualistic bias in the epistemic conception; the alleged epistemic defects and abnormalities in delusions relate to individualistic epistemic processes rather than social epistemic processes. We endorse the social epistemological turn in recent philosophical epistemology, and claim that a corresponding turn (...) is needed in the study of delusions. It is a turn from the (purely) individualistic conception, which characterizes delusions only by individualistic epistemic defects and abnormalities, to the (partially) social epistemic conception, which characterizes delusions by individualistic as well as social epistemic defects and abnormalities. This paper is intended as an initial step toward such a social epistemological turn. In particular, we will develop a new model of the development of delusions according to which testimonial abnormalities, including testimonial isolation and testimonial discount, are a causal factor in the development of delusions. This paper explores the ontology of musical improvisation (MI). MI, as process in which creative and performing activities are one and the same generative occurrence, is contrasted with the most widespread conceptual resource used in inquiries about music ontology of the Western tradition: the type/token duality (TtD). TtD, which is used for explaining the relationship between musical works (MWs) and performances, does not fit for MI. Nonetheless MI can be ontologically related to MWs. A MW can ensue from MI and (...) MI can be required for performing a MW faithfully. As performance on a MW, MI can offer versions of a MW, manifest a MW, and, especially, use it as one of its ‘ingredients’. Recordings of MI present special challenges and an unexpected ontological revival. (shrink)

This article reconstructs and systematically assesses Else’s Voigtländer’s theory of self-feelings. In the first section, I introduce the reader to the basic ideas of this theory by supporting the exegetical claim that the notion of self-feeling encompasses two distinct kinds of experiences: (i) a subject’s long-standing and enduring self-feeling, which is innate and biologically grounded, should be distinguished from (ii) the plurality of episodic self-feelings (or self-conscious emotions) this subject can experience. In the second section, I focus on the particular (...) class of self-feelings that Voigtländer labels as “inauthentic:” these are feelings where the evaluation of the self depends on the evaluations that others have about the self. After elaborating on the morally and epistemically negative connotation Voitgländer attaches to the notion of a feeling’s “inauthenticity,” I reject the generality of her claim in the third section: some social self-feelings are not inauthentic. Let M be an o-minimal expansion of an ordered field. Let φ be a formula in the language of ordered domains. In this note we establish some topological properties which are transferred from $\varphi^M$ to $\varphi^R$ and vice versa. Then, we apply these transfer results to give a new proof of a result of M. Edmundo-based on the work of A. Strzebonski-showing the existence of torsion points in any definably compact group defined in an o-minimal expansion of an ordered field.

This article explores self-esteem as an episodic self-conscious emotion. Episodic self-esteem is first distinguished from trait self-esteem, which is described as an enduring state related to the subject’s sense of self-worth. Episodic self-esteem is further compared with pride by claiming that the two attitudes differ in crucial respects. Importantly, episodic self-esteem—but not pride—is a function of social esteem: in episodic self-esteem, the subject evaluates herself in the same way in which others evaluate her. Furthermore, social esteem elicits episodic self-esteem if (...) the values at the basis of the others’ evaluation are shared by the subject. Such sharing of values suggests that only the evaluations of those others that the subject frames as her in-group members are relevant to episodic self-esteem. (shrink)

Para ello voy a traer a colación las obras de dos autores clásicos en este tema: Las cartas sobre la educación estética de la humanidad (1795) de J. C. F. Schiller, y el H. Marcuse de los escritos sobre la dimensión estética, en particular de los ensayos titulados La dimensión estética (...) (1978), Ensayo sobre la liberación (1969) y Arte y revolución, que es un capítulo del libro Contrarrevolución y revuelta (1972). Se trata de textos muy vinculados a las épocas en las cuales fueron escritos, los años sucesivos a la Revolución francesa en el caso de Schiller, y, por lo que concierne a Marcuse, los años de los movimientos libertarios juveniles de protesta, es decir, los años sesenta y setenta del siglo pasado. En ellos, sin embargo, y como en todo buen clásico, aparecen temas y argumentaciones que todavía hoy constituyen una buena herramienta para discutir filosóficamente la relación entre arte, estética y política. Mereological atomism is the thesis that everything is ultimately composed of atomic parts, i.e., parts without proper parts. Typically, this thesis is characterized by an axiom stating that everything has atomic parts. The present paper argues that the success of this standard characterization depends on how the notions of sum and composition are defined. In particular, we put forward a novel definition of mereological sum that: (i) is not equivalent to existing definitions in the literature, if no strong decomposition principle (...) is assumed; (ii) can be used to argue that the standard characterization of atomism fails, because having atomic parts is not sufficient to be a sum of atoms; and (iii) provides a purely mereological distinction between structured and unstructured wholes, contributing to the ongoing debate on this crucial topic. This paper describes a class of social acts called “violent acts” and distinguishes them from damaging acts. The former are successfully performed if they are apprehended by the victim, while the latter, being not social, are successful only as long as the intended damage is realized. It is argued that violent acts, if successful, generate a social relation which include the aggressor, the victim and, if the concomitant damaging act is satisfied, the damage itself.

In recent years a certain emphasis has been put by some scholars on Leibniz’s concern about empirical sciences and the relations between such concern and the development of his mature metaphysical system. In this paper I focus on Leibniz’s interest for the microscope and the astonishing discoveries that such instrument made possible in the field of the life sciences during the last part of the Seventeenth century. The observation of physical bodies carried out by the “magnifying glasses” revealed a matter (...) swarming everywhere with life and activity, contrary to the cartesian and atomistic view of matter as something sterile and passive. Moreover, the discovery of uncountable complete “animalcula” living in the smallest drop of water provided evidence for the idea of the preformation of every organism. During his lifetime, Leibniz was extremely watchful about the new microscopical discoveries and came into contact with some of the major “observers” of his time, such as Hooke, Leeuwenhoek, Swammerdam and Malpighi. Relying both on some passages in Leibniz’s texts and on recent critical studies, I will argue that important aspects of his metaphysics have been strongly affected by the empirical observation of the “invisible world” which the microscope made possible. In the last part of the paper I show how the concept of “preformation”, originally drawn from the context of the life sciences, comes to play in Leibnizʼs philosophy a very general role, going far beyond the scope of biology and shaping important aspects of his overall philosophical system. In a recent series of important papers, Søren Overgaard has defended a disjunctivist reading of Edmund Husserl’s theory of perception. According to Overgaard, Husserl commits to disjunctivism when arguing that hallucination intrinsically differs from perception because only experiences of the latter kind carry singular content and, thereby, pick out individuals. This paper rejects that interpretation by invoking the theory of intentionality developed by Husserl in the Logical Investigations. It is claimed that this theory not only lacks the notion of singular (...) content, but it also entails the idea that perceptions and hallucinations belong to the same kind of experience. If that is correct, a commitment to conjuctivism on Husserl’s end follows, pace Overgaard. (shrink)

The paper recognizes the failure of contemporary non-aesthetic theories of art and aims at recovering the phenomenological notion of derealization – which re-emerges in A. Dantoʼs idea of the ʻbracketting effectʼ of art –, in order to explain art and art-experience. The main point is that art makes us free from the ʻreal worldʼ through an act of derealization that leads to the establishment of possible or fictional worlds different from the one we live in. Artworks are primarly imaginary, unreal (...) objects, due to the fact that they interest us only for its appearance and as appearance. Therefore, art cannot be understood without the frame of a particular kind of experience that we can understand in terms of Kantʼs notion of disinterestedness. This notion is still productive to understand why art has a certain power to free us from the needs of reality, although through art we do have profound views of certain aspects of reality and our life. Some objections against Kantʼs theory of aesthetic disinterestedness are discussed and refused, in order to understand the transcendental significance of the aesthetic theory of art. (shrink)

In the present paper a new semantic framework for modelling the distinction between implicit and explicit belief is proposed and contrasted with the currently standard framework based on the idea that explicit belief can be construed as implicit belief accompanied by awareness. It is argued that within this new framework it is possible to get both a more intuitive interpretation of the aforementioned distinction and a straightforward solution to two critical problems to which the standard view is subjected. This article explores the connection between habits and the performing arts, arguing that habits are not only fundamental to the practice and appreciation of these arts but also inherently performative in nature. Drawing on insights from various philosophical traditions (including cognitive science, pragmatism, and phenomenology), it examines how habits function within artistic processes as resources for creativity and adaptation. Engaging critically with Noë’s interpretation of the entanglement between art and life, this article highlights the dual nature of habits: as routine (...) practices that scaffold artistic expression and as dynamic, transformative elements responsive to specific cultural and performative contexts. By focusing on key notions such as gesture, style, and rituality in the performing arts, this article discusses the role of habits in aesthetic experiences, highlighting how habits shape both artistic performances and audience engagement. This perspective challenges traditional views that oppose habits to creativity, defending instead the idea that habits are creatively operative in both the performing arts and their reception. The purpose of this study, which is part of a wider study of professional ethics, was to describe nurses’ perceptions of their rights in Italy. The data were collected by open-ended focus group interviews and analyzed with inductive content analysis. Based on the analysis, three main themes were identified. The first theme “Unfamiliarity with rights” described nurses’ perception that their rights mirrored historical roots, educational content, and nurses’ and patients’ position in the society. The second theme, “Rights reflected in legislation” (...) highlighted that working and professional Italian legislation played a strong role. The third theme, “Managerial barriers for nurses’ rights” underlined the nurses’ perceptions that nursing management had the responsibility to create the conditions where nurses’ rights could flourish. Robert Kane’s libertarian theory of freedom is frequently attacked in the free will literature by the “luck objection”. Alfred Mele’s articulation of the objection is a very influential formulation as it captures the spirit of Kane’s critics and their complaint with Kane’s view. Mele argues that without a contrastive explanation that highlights aspects of the agent their free choices are reducible to luck. I argue that the lack of a contrastive explanation does not establish that there is no explanation for (...) self-forming actions. Building on the explanation that Kane offers in his rebuttal, I claim that there are neglected dimensions to Kane’s view that, when put together, mitigate the force of the objection. These elements are value experiments, teleological intelligibility and liberum arbitrium voluntatis. I claim that through adopting a narrative view of the self, we can place value experiments in a broader teleological framework that allows us to see self-forming choices are not just a matter of luck. The aim of this paper is to present a system of modal connexive logic based on a situation semantics. In general, modal connexive logics are extensions of standard modal logics that incorporate Aristotle’s and Boethius’ theses, that is the thesis that a sentence cannot imply its negation and the thesis that a sentence cannot imply a pair of contradictory sentences. A key problem in devising a connexive logic is to come up with a system that is both sufficiently strong to (...) fulfill some specific connexive theses and sufficiently well-motivated from a semantical point of view. The approach proposed here tries to address this problem by defining an appropriate connexive relation in terms of more basic notions. The result is a well-motivated system of modal connexive logic that nicely fits in both with the traditional ideas concerning the connexive conditional and with the current developments in connexive logic. The idea of a ‘true’ account of pluralism is ultimately contradictory. Liberal political philosophers often fell prey to a special version of this fallacy by presupposing that there might be only one correct argument for justifying the acceptance of pluralism as the core of a liberal democratic polity. Avoiding this trap, Rawls’s ‘political liberalism’ has offered a more sophisticated view of reasonable pluralism as linked with the ‘burdens of judgement’. His philosophical agenda, however, left some questions underexplored: What is the (...) relation of pluralism to relativism? How can a conception of pluralism avoid being either one view among others with no special claim to truth, or a foundationalist claim? If pluralism is a fact, in what sense can it bind us? These questions – crucial for grasping the distinctiveness of ‘political’ liberalism – are addressed by revisiting Plato’s simile of the cave, in order to make it accommodate the groundbreaking Rawlsian notion of the ‘r...
