Evidence from functional neuroimaging of the human brain indicates that information about salient properties of an object¿such as what it looks like, how it moves, and how it is used¿is stored in sensory and motor systems active when that information was acquired. As a result, object concepts belonging to different categories like animals and tools are represented in partially distinct, sensory- and motor property-based neural networks. This suggests that object concepts are not explicitly represented, but rather emerge from weighted activity (...) within property-based brain regions. Reductionism is a widely endorsed methodology among biologists, a metaphysical theory advanced to vindicate the biologist's methodology, and an epistemic thesis those opposed to reductionism have been eager to refute. While the methodology has gone from strength to strength in its history of achievements, the metaphysical thesis grounding it remained controversial despite its significant changes over the last 75 years of the philosophy of science. Meanwhile, antireductionism about biology, and especially Darwinian natural selection, became orthodoxy in philosophy of mind, philosophy (...) of science, and philosophy of biology. This Element expounds the debate about reductionism in biology, from the work of the post-positivists to the end of the century debates about supervenience, multiple realizability, and explanatory exclusion. It shows how the more widely accepted 21st century doctrine of 'mechanism' - reductionism with a human face - inherits both the strengths and the challenges of the view it has largely supplanted. This paper offers and defends a particular version of the view that it is the intentions with which it is performed that determine the truth conditions of an utterance. A competing version, implied by Grice's work on meaning, is rejected as inadequate. This latter is incompatible with the phenomenon of anti-lying: performing a true utterance with the intention that one's audience believe it to be false. In place of the quasi-Gricean version, the paper maintains that an utterance is true-iff-p just (...) in case it is performed with the intention that its intended audience recognize it as true-iff-p. Delicacy is called for in the interpretation of 'recognition' if this biconditional is to be plausible. Moreover, since truth conditions are extensional and intentions intensional, this simple statement of the view requires qualification. And finally, some methodological self-awareness is needed to see off the charge of analytical circularity (since the analysans contains the analysandum). This intention-based view is proffered as an attractive and viable alternative to any view according to which the semantics of utterances are determined by the semantics of expressions, where the latter can largely float free from the intentions of a particular utterer. This paper considers a form of scepticism according to which sentences, along with other linguistic entities such as verbs and phonemes, etc., are never realized. If, whenever a conversational participant produces some noise or other, they and all other participants assume that a specific sentence has been realized (or, more colloquially, spoken), communication will be fluent whether or not the shared assumption is correct. That communication takes place is therefore, one might think, no ground for assuming that sentences are realized (...) during a typical conversation. I reject both this ‘folie-a-deux’ view and the arguments for it due to Georges Rey. I do so by drawing on Gilbert Harrnan’s no-false-lemmas principle. Since testimony is a form of knowledge and, according to the principle, knowledge cannot depend essentially on false assumptions, testimony is incompatible with the claim that sentence realization is but an illusion. Much of the paper is given over to defending this appeal to the no-false-lemmas principle. After all, a more attractive option might seem to be to infer instead that the principle is itself falsified by the folie-a-deux view. (shrink)

When we open our eyes, the world seems full of colored opaque objects, light sources, and transparent volumes. One historically popular view, _eliminativism_, is that the world is not in this respect as it appears to be: nothing has any color. Color _realism_, the denial of eliminativism, comes in three mutually exclusive varieties, which may be taken to exhaust the space of plausible realist theories. Acccording to _dispositionalism_, colors are _psychological_ dispositions: dispositions to produce certain kinds of visual experiences. According (...) to both _primitivism_ and _physicalism_, colors are not psychological dispositions; they differ in that primitivism says that no reductive analysis of the colors is possible, whereas physicalism says that they are physical properties. Recent debates over the use of sham surgery as a control for studies of fetal tissue transplantation for Parkinson’s disease have focused primarily on rival interpretations of the US federal regulations governing human-subjects research. Using the core ethical and methodological considerations that underwrite the equipoise requirement, we nd strong prima facie reasons against using sham surgery as a control in studies of cellular-based therapies for Parkinson’s disease and more broadly in clinical research. Additionally, we believe that these reasons can be (...) generalized to apply to the use of other placebo controls that carry signi cant risks of positive harms in and of themselves. As a result, our arguments are centrally relevant to the emerging drive to subject therapies with a surgical component to the same rigorous standards of evaluation as those governing the approval of new pharmaceuticals. 1 In 1954 Karl Popper published an article attempting to show that the identification of the quantitative concept degree of confirmation with the quantitative concept degree of probability is a serious error. The error was presumably committed by J. M. Keynes, H. Reichen bach and R. Carnap. 2 It was Popper's intention then, to expose the error and to introduce an explicatum for the prescientific concept of degree of confirmation. A few months later Y. Bar-Hillel published an article attempting to (...) show that no serious error had been committed (particularly by Carnap) and that the problem introduced by Popper was simply a "verbal one. "3 Popper replied immediately that "Dr. Bar-Hillel forces me [Popper] now to criticize Carnap's theory further," and he [Popper] introduced further objections which, if accepted, destroy Carnap's theory. 4 About eight years after this exchange took place I was in graduate school at the University of Chicago in search of a topic for a doctoral dissertation. An investigation of the issues involved in this exchange seemed to be ideal for me because I had (and still have) a great ad miration for the work of both Carnap and Popper. This paper develops an update semantics for weak necessity modals like ‘ought’ and ‘should’. I start with the basic approach to the weak/strong necessity modal distinction developed in Silk 2018: Strong necessity modals are given their familiar semantics of necessity, predicating the necessity of the prejacent of the actual world (evaluation world). The apparent “weakness” of weak necessity modals derives from their bracketing the assumption that the relevant worlds in which the prejacent is necessary (deontically, epistemically, etc.) need be candidates (...) for actuality. ‘Should φ’ can be accepted without needing to settle that the relevant considerations (norms, preferences, expectations, etc.) that actually apply, given the facts, verify the necessity of φ. I formalize these ideas within an Update with Centering framework. The meaning of ‘Should φ’ is explained, fundamentally, in terms of how its use updates attention toward possibilities in which φ is necessary. The semantics is also extended to deontic conditionals. The proposed analyses capture various contrasting logical properties and discourse properties of ‘should’ and ‘must’ — e.g., in sensitivities to standing contextual assumptions, entailingness, and force — and provide an improved treatment of largely neglected data concerning information-sensitivity. In Ep. 50, Spinoza argues at length that “someone who calls God one or unique does not have a true idea of God, or is speaking improperly about him.” This text is striking, given the declarations in many writings, including the Ethics, that God is the one, unique substance. While recent commentators have attempted to render Ep. 50 consistent with the rest of Spinoza’s corpus, I instead argue that Spinoza’s stance on God’s oneness evolved over the course of his career. This evolution, which in fact contains a number of twists and turns, is driven not only by consideration of the proper meaning of ‘one’ and ‘unique’ but also by the question of whether God’s essence and God’s existence are numerically identical. Regarding the latter, I argue that Spinoza came to reject this identity claim late in life, and that this explains his final change in viewpoint regarding God’s oneness in Ep. 83. (shrink)

IN BOTH THE EUDEMIAN ETHICS AND THE NICOMACHEAN ETHICS, Aristotle says that the aim of ethical inquiry is a practical one; we want to know what virtue is so that we may become good ourselves and thereby do well and be happy. By classifying ethical inquiry as a practical endeavor, Aristotle is rejecting a view that he attributes to Socrates according to which ethics is a kind of theoretical science. In theoretical sciences, such as geometry or astronomy, the knowledge of (...) a particular subject matter is sought as an end in itself, and the possession of such knowledge is sufficient to make one a geometer or an astronomer. In rejecting this model Aristotle argues that the knowledge of virtue is sought not solely for itself but in order to inform praxis and in order that we become virtuous and good, not by knowing what the virtues are but by cultivating them in practice. This paper contrasts the personal experiences of a man with learning disabilities and autism with staff in two different settings: a long-stay institution for people with learning disabilities, and the community. These experiences highlight some of the potential personal, professional and ethical conflicts facing staff working in learning disability services.

This review essay takes stock of the state of the field and speculates on its future. I highlight three themes. First, as the field has expanded, theorists come to migration from different methodological stances. While liberalism, broadly construed, continues to be the dominant framework, theorists increasingly find resources in feminist thought and philosophy of race. Second, normative theorists now engage much more deeply with the empirical literature, in some cases combining fieldwork and normative theory. This has led to a shift (...) from broad questions about the morality and legitimacy of border controls to more specific issues such as the ethics of refugee camps and repatriation, the realities of immigration enforcement and surveillance regimes, and the role of race and racialization in immigration policy, as well as challenges specific to particular geographical regions. Third, migration raises broader issues of political theory, challenging us to reimagine political and social boundaries for a mobile world. (shrink)

A privileged element of contemporary law, confession as a means of proof in criminal proceedings is the object of analysis in this research. Based on a bibliographic review, the study will seek to decompose and reorganize the object on two fronts, constructing a theoretical hypothesis that proposes to observe confession as an inquisitorial practice of an institution, but which also has a traceable genealogical depth in the modulations of subjectivation techniques. The notion of the care of the self that Michel (...) Foucault referred to unfolds in Christian ethics and asceticism, reorganizing the sense of care of the self and slowly, as Christian philosophy developed and the influence of the Catholic Church in the state grew, make the act of confession loaded with an institutional-subjective double, elements that allow Zaffaroni to observe the apparent neutrality of contemporary justice as a facade for an authoritarian state and adept at inquisitorial practices, especially in matters of criminal justice. Some societies used to impose liability on inanimate objects, a practice we’d now regard as silly and confused. When we punish corporations today, are we making similar mistakes? Here I consider some important sources of philosophical skepticism about imposing criminal liability on corporations, and I argue that they admit of answers, which places punishing corporations on stronger footing than punishing inanimate objects. First, I consider the eligibility challenge, which asserts that corporations are not the right kind of thing to be (...) punished. Second, the reductionist challenge insists that corporate culpability always reduces to individual culpability. I suggest that progress can be made in addressing these challenges by asking the right law-focused questions and attending to recent developments in criminal law theory and moral philosophy. Prominent normative theories for accommodating minority national groups appeal to the value of national cultures and/or the psychology of group recognition. This article aims to show that an argument from political authority provides a better justification. Building on Joseph Raz's theory of authority, the article argues that members of minority national groups are disadvantaged in relation to their majority counterparts under standard democratic institutions; such institutions do not provide minority national groups with comparable access to the conditions for legitimate political (...) authority. Constitutional arrangements for accommodating minority national groups—such as territorial self-government or power-sharing—are justified insofar as they might offset this disadvantage. (shrink)

This fascinating and thought-provoking book provides much-needed philosophical background for counselors, therapists, and healthcare workers looking for broader, deeper foundations in the struggle to help and make sense of others. While examining the best among 20th century philosophy it shows the wealth of inspiration of earlier centuries, and demonstrates with remarkable clarity the way in which the ideas of, and the relations between, these philosophers can inspire, inform, and underpin much of counseling and psychotherapy.

Innovation is disruptive and a deeply social phenomenon. As a result, discussions of innovation in the Anglo-American philosophical tradition are often tightly bound up with concerns about individual freedom and pluralism, including pluralism about ethical values. In response, stakeholders looking to evaluate and assess ethical aspects of the innovation ecosystem are often driven to pragmatic approaches that utilize a set of ethical values that can be regarded as “free-standing,” or “thin” in the sense that they are not tied to any (...) particular, substantive conception of the good. This set often includes values such as beneficence, nonmaleficence, respect for autonomy, fairness, and justice. Discussions focused on justice, however, are the least extensive and least well-developed. As a result, most approaches are well-suited to surfacing first-order or direct effects of the discrete activities of a relatively narrow set of stakeholders. Paradoxically, however, such analyses are often not well-suited to identifying and evaluating (a) quintessentially social or higher-order effects (such as network-level or institutional level effects), (b) the role of a larger number of stakeholders who shape the innovation ecosystem in more indirect ways, and (c) some of the positive ethical claims of individuals that are relevant to evaluating innovation. After articulating these shortcomings, I argue that they might be overcome by adopting a justice-led framework for evaluating innovation. (shrink)

The high rates of attrition that occur in drug development are widely regarded as problematic, but the failure of well-designed studies benefits both researchers and healthcare systems by, for example, generating evidence about disease theories and demonstrating the limits of proven drugs. A wider recognition of these benefits will help the biomedical research enterprise to take full advantage of all the information generated during the drug development process.

When Mathew Lipman first introduced Philosophy for Children (P4C) to the world, his goal was not to sneak a little academic philosophy into the typical school curriculum, as one might expect from the titles of his first books: Philosophy in the Classroom (Lipman et al., 1980) and Philosophy Goes to School (Lipman, 1988). His goal, rather, was to create a paradigm shift in the field of education itself: namely, to transform the typical hierarchical model into one in which the teacher/facilitator (...) solicits responses from students and hence, in that sense, meets them where they “are at.” This non-hierarchical model, however, has stumbled in taking root, which is, perhaps, not surprising given that the hierarchical model, whether in school, in sport or in the home, appears to be so much easier and so much more efficient. If those of us who support a non-hierarchical model in all these arenas are serious about furthering this approach, it would appear that the onus lies with us to articulate precisely in what ways a hierarchical model falls short. In so doing, we will not only provide ourselves with a precise framework by which to make the case for the importance of adopting a non-hierarchical approach, we will also provide ourselves with a metric whereby we can measure whether our own non-hierarchal practice is true to its justification; and that the approach is not simply non-hierarchal for sake of being non-hierarchical, nor quasi-authoritarianism for the sake of more wide-spread acceptance. It is the articulation of the flaws of a hierarchical model that non-hierarchal model can (and should) correct that will be the focus of the analysis here. (shrink)

Neste sentido, fala-se de uma mudança de paradigma do estado positivo ao estado regulador, dentro do surgimento deste Estado regulador, acende-se o debate se algumas matérias seriam exclusivas do agente regulador com modelo de governança regulatória. O presente estudo (...) científico faz-se necessário ao trazer à arena o debate sobre a possibilidade de se falar ou não de reserva de regulação no âmbito das terapias gênicas, já que a matéria que seriam submetidas a essa reserva técnica não seriam taxativamente delimitadas pela Constituição, devendo ser discutida caso a caso, dentro deste novo ramo do direito chamado direito da regulação. Para consecução e atingimento do objetivo desejado, a metodologia de pesquisa utilizada foi a de revisão da bibliografia sobre a matéria, bem como da legislação correlata. (shrink)

We are pleased to once again present to the readers of Theoretical Medicine and Bioethics papers from the Philosophy of Medicine Roundtable. Previous issues have followed the 3rd and 4th Roundtables, and the current issue presents a selection from the more than 20 papers presented at the 5th Philosophy of Medicine Roundtable, which took place in New York, at Columbia University, in November 2013. Like its predecessors, held in Birmingham, AL, Rotterdam, and San Sebastian, this Roundtable attracted speakers from around (...) the world. It also featured keynote presentations from Rita Charon of Columbia University and Ross Upshur of the University of Toronto.It may seem somewhat odd to feature a special issue on philosophy of medicine in a journal that effectively has philosophy of medicine in its title. However, a review of the contents of this journal and similar ones, such as the Journal of Medicine and Philosophy, will quickly reveal such an issue’s purpose. The dominant content of these j .. A number of imposing problems now have our best minds in thrall. These include questions regarding the unity or plurality of the races of Man, whether his creation ought to be dated thousands of years or thousands of centuries past, whether species are fixed, or rather undergo a slow, progressive transformation into new species, how supposedly eternal matter relates to the nothingness outside of it, and whether the idea of God is useless. These are just a few of the issues (...) now subject to learned debate. You need, however, have no fear that my address tonight has any pretensions toward resolving any one of these earnest questions. But in the neighborhood of such mysteries lies another question, more or less closely related, to which I may, perhaps, venture to direct your attention; for its complexities, which I have made the object of concerted and conscientious study, are accessible to experiment. This is the question of what we call "spontaneous generations." Mightn't matter, perhaps, organize itself? Or posed differently, mightn't creatures enter the world without parents, without forebears?
