Von dem Gesetzestraktat der Summa Halensis lag bislang nur der lateinische Text in einer kritischen Edition aus dem Jahr 1948 vor. Mit der dreibändigen Publikation werden nun erstmals zusammen mit dem lateinischen Text auch eine deutsche Übersetzung und ein Kommentar zu diesem bedeutenden Werk im Übergang von der Früh- zur Hochscholastik vorgelegt. In konzeptioneller Hinsicht war dieser Traktat mit seiner Begründung und Entfaltung der unterschiedlichen Ausprägungen des Gesetzes - als ewiges Gesetz, Naturgesetz, mosaisches Gesetz und evangelisches Gesetz - grundlegend. Seine (...) umfangreiche Auslegung des mosaischen Gesetzes weist zudem konkrete Bezüge zur Lebens- und Glaubenswelt auf, die für die Kultur- und Sozialgeschichte dieser Zeit aufschlussreich sind. Auch im Blick auf die Hinwendung zur Tora in der gegenwärtigen Theologie und im Zusammenhang mit den interreligiösen und gesellschaftspolitischen Diskursen über das Gesetzesverständnis verdient der Gesetzestraktat der Summa Halensis Beachtung, weil er in vielfältiger Hinsicht zur Reflexion über die Funktion des Gesetzes sowie den Zusammenhang von Theologie und Recht anregt. This paper takes on several distinct but related tasks. First, I present and discuss what I will call the “Ignorance Thesis,” which states that whenever an agent acts from ignorance, whether factual or moral, she is culpable for the act only if she is culpable for the ignorance from which she acts. Second, I offer a counterexample to the Ignorance Thesis, an example that applies most directly to the part I call the “Moral Ignorance Thesis.” Third, I argue for a (...) principle—Don’t Know, Don’t Kill—that supports the view that the purported counterexample actually is a counterexample. Finally, I suggest that my arguments in this direction can supply a novel sort of argument against many instances of killing and eating certain sorts of animals. (shrink)

While standard first-order modal logic is quite powerful, it cannot express even very simple sentences like “I could have been taller than I actually am” or “Everyone could have been smarter than they actually are”. These are examples of cross-world predication, whereby objects in one world are related to objects in another world. Extending first-order modal logic to allow for cross-world predication in a motivated way has proven to be notoriously difficult. In this paper, I argue that the standard accounts (...) of cross-world predication all leave something to be desired. I then propose an account of cross-world predication based on quantified hybrid logic and show how it overcomes the limitations of these previous accounts. I will conclude by discussing various philosophical consequences and applications of such an account. (shrink)

Though most neomaterialists share a commitment to the Copernican decentring of humans from the world stage, there is disagreement on the purposes of such an endeavour. The polemic stems from a fundamental discrepancy about what the return to materiality entails: is matter the principle of the non-thinking as such, or is it always already imbued with some sort of subjectivity? Is the new materialism’s goal to come to terms with the non-living origin of life? Or is it rather to recognize (...) that seemingly dead materials are always in some sense incipiently alive? For convenience, we can think of two neomaterialist perspectives: the rationalist or eliminative neomaterialism, and the vitalist or panpsychist neomaterialism. I explore some of the conceptual problems faced by both camps and, drawing from the recently developed theory of consciousness as integrated information, as well as its quantum physical construal by Max Tegmark, I suggest some provisional ways to address those issues. Organisation studies based on qualitative methodologies continually seek legitimacy in relation to positivist research formulating nomological knowledge on administrative practices. One of the key features regularly praised in qualitative research is the idea of reflexivity, the ability of the qualitative researcher to critically examine his or her own analysis. This paper argues that the notion of reflexivity is an uncontested area of qualitative organisation research which merits critical study. In contrast to the reflexivity model which assumes an autopoietic double hermeneutic (...) of the examined empirical material, it draws on Kierkegaard’s notion of subjective thinking. For Kierkegaard it is not reflexivity that serves as the primus motor for subjective thinking but doubt, paradox and passion. A critique of the notion of reflexivity opens up alternative accounts of qualitative research which need not assume self-correcting and self-directed analysis. (shrink)

In this paper we define n+1-valued matrix logic Kn+1 whose class of tautologies is non-empty iff n is a prime number. This result amounts to a new definition of a prime number. We prove that if n is prime, then the functional properties of Kn+1 are the same as those of ukasiewicz's n +1-valued matrix logic n+1. In an indirect way, the proof we provide reflects the complexity of the distribution of prime numbers in the natural series. Further, we introduce (...) a generalization K n+1 * of Kn+1 such that the set of tautologies of Kn+1 is not empty iff n is of the form p , where p is prime and is natural. Also in this case we prove the equivalence of functional properties of the introduced logic and those of n+1. In the concluding part, we discuss briefly a partition of the natural series into equivalence classes such that each class contains exactly one prime number. We conjecture that for each prime number the corresponding equivalence class is finite. (shrink)

Theocritus' twenty-second idyll is cast in the form of a hymn to the Dioscuri, who are addressed in the proem as saviours of men, horses, and ships. This opening section of the idyll is modelled loosely on the short thirty-third Homeric hymn, and like that hymn contains an expanded account of the twins' rescue of ships about to be lost in a storm. As is hardly surprising, Theocritus in reworking the Homeric hymn draws on other literary antecedents as well, and (...) like other Alexandrian poets makes prominent use of diction borrowed and adapted from the Homeric epics. At the same time, the proem also shares several points of contact, largely overlooked or disputed by previous scholarship, with the poetry of Theocritus' own contemporaries. In the present paper, I shall suggest that in the storm scene of the proem references to Aratus' Phaenomena and Apollonius Rhodius' Argonautica occur in a carefully arranged pattern with potentially significant implications for our understanding of the proem and the idyll as a whole. According to the Russo-Williamson Thesis, causal claims in the health sciences need to be supported by both difference-making and mechanistic evidence. In this article, we attempt to determine whether Evidence-based Medicine can be improved through the consideration of mechanistic evidence. We discuss the practical composition and function of each RWT evidence type and propose that exposure-outcome evidence provides associations that can be explained through a hypothesis of causation, while mechanistic evidence provides finer-grained associations and knowledge of entities that ultimately explains (...) a causal hypothesis. We suggest that mechanistic evidence holds untapped potential to add value to the assessment of evidence quality in EBM and propose initial recommendations for the integration of mechanistic and exposure-outcome evidence to improve EBM by robustly leveraging available evidence in support of good medical decisions. No serious attempt to answer the question ‘What is hate speech?’ would be complete without an exploration of the outer limits of the concept(s). This book critically examines both the ordinary and legal concepts of hate speech, contrasting social media platform content policies with national and international laws. It also explores a range of controversial grey area examples of hate speech. Part I focuses on the ordinary concept and looks at hybrid attacks, selective attacks, reverse attacks, righteous attacks, indirect attacks, (...) identity attacks, existential denials, identity denials, identity miscategorisations, and identity appropriations. Part II concentrates on the legal concept. It considers how to distinguish between hate speech and hate crime and examines the precarious position of denialism laws in national and international law. Together the authors draw on conceptual analysis, doctrinal analysis, linguistic analysis, critical analysis, and diachronic analysis to map the new frontiers of the concepts of hate speech. In The LEGO Movie, Vitruvius's notion of the "The Special" introduces what will be a central motif for the film. As it turns out, the one who finds this "Piece of Resistance" is not quite the hero he was expected to be. Emmet Brickowoski, a construction worker, will find this "Piece of Resistance". Throughout the film, others suggest to Emmet both implicitly and explicitly that he brings nothing of value to any particular individual or to society, and that consequently he (...) himself has no value. If one interpret The LEGO Movie as being driven by Emmet's quest for discovering his value, the real philosophical turning point in the film is not when Emmet's double‐decker couch permits the Master Builders to escape from the sinking submarine and they realize that Emmet's ideas actually are useful. Rather, it is when Emmet realizes their approval is irrelevant to his value. (shrink)
