AS IS WELL KNOWN, one of Kant's major concerns was the reconciliation of Newtonian science and metaphysics, a preoccupation made particularly acute by the need to provide a satisfactory explanation of organisms. It is in light of his claim that only the mechanistic principles of Newton's physics can provide scientific knowledge that the role to be played by purposiveness becomes problematic. Purpose appears to resist mechanistic explanation and is therefore a major impediment to unifying science under one set of principles. (...) Kant concludes that although organisms cannot be explained mechanistically, the impossibility is due to a limitation of reason. By appealing to the critical turn Kant thus avoids an antinomy between mechanism and finality while allowing that it is possible for mechanism and finality to be reconciled in the supersensible. Although introns in 5′‐ and 3′‐untranslated regions (UTRs) are found in many protein coding genes, rarely are they considered distinctive entities with specific functions. Indeed, mammalian transcripts with 3′‐UTR introns are often assumed nonfunctional because they are subject to elimination by nonsense‐mediated decay (NMD). Nonetheless, recent findings indicate that 5′‐ and 3′‐UTR intron status is of significant functional consequence for the regulation of mammalian genes. Therefore these features should be ignored no longer.

Many critics of libertarian freedom have charged that freedom is incompatible with indeterminism. We show that the strongest argument that has been provided for this claim is invalid. The invalidity of the argument in question, however, implies the invalidity of the standard Consequence argument for the incompatibility of freedom and determinism. We show how to repair the Consequence argument and argue that no similar improvement will revive the worry about the compatibility of indeterminism and freedom.

The principle of beneficence directs healthcare practitioners to promote patients’ well-being, ensuring that the patients’ best interests guide treatment decisions. Because there are a number of distinct theories of well-being that could lead to different conclusions about the patient’s good, a careful consideration of which account is best suited for use in the medical context is needed. While there has been some discussion of the differences between subjective and objective theories of well-being within the bioethics literature, less attention has been (...) given to the questions of what work a theory of well-being needs to do in bioethics and which standards of success ought to be used in selecting a theory of well-being for use in medicine. In this article, I argue that traditional theories of well-being developed in philosophy are not well suited to meet the needs of the medical context. For the principle of beneficence to be most useful, the underlying account of well-being should satisfy two conditions: first, it needs to lead to a concrete, action-guiding determination of the patient’s good; and, second, any recommendations it offers need to be justifiable to patients. Standard accounts of well-being have difficulty satisfying both conditions. Exploring the limitations of these theories when applied to treatment dilemmas helps point the way toward the development of an account of well-being better suited to healthcare. (shrink)

Recent research has provided compelling evidence that children experience the negative counterfactual emotion of regret, by manipulating the presence of a counterfactual action that would have led to participants receiving a better outcome. However, it remains unclear if children similarly experience regret’s positive counterpart, relief. The current study examined children’s negative and positive counterfactual emotions in a novel gain-or-loss context. Four- to 9-year-old children (N = 136) were presented with two opaque boxes concealing information that would lead to a gain (...) or loss of stickers, respectively. Half of the children chose between two keys that matched each box, whereas the other half were compelled to select one box because only one of the two keys matched. After seeing inside the alternative, non-chosen box, children were significantly more likely to report a change in emotion when they could have opened that box than when they could not have. The effects were similar for children who lost stickers and won stickers, and neither effect varied with age. These findings suggest that children may become capable of experiencing regret and relief around the same time, although their expression of these counterfactual emotions may vary with actual and counterfactual gains and losses. This essay re-examines the disability critique of prenatal and pre-implantation screening in light of evidence about the larger context in which fertility and reproductive healthcare is rendered in the U.S. It argues that efforts to identify acceptable criteria for trait-based selection or otherwise impose reasons-based limitations on reproductive choice should be avoided because such limitations tend to perpetuate the discrimination encountered by adults with disabilities seeking fertility and reproductive health services.

This paper studies the relationship between organizational ethical climate and the forms of organizational citizenship behavior (OCB), including in-role and extra-role behaviors, and examines the mediating effect of employee loyalty. A sample of employees from a traditional Hong Kong-based company was used as a study group. The purpose of this study was to examine the causes and implications of how various ethical work climates affect employee performance. Based on a model proposed by Victor and Cullen, ethical climate is arranged from (...) lower levels to higher levels. The results suggest that lower levels of ethical climate (instrumentality and independence), characterizing a weak relational contract between employee and employer, are associated with negative extra-role behavior. In contrast, higher levels of ethical climate (caring and law-and-code), symbolic of a strong relational contract at work, are associated with positive extra-role behavior. Moreover, normative commitment mediated a positive relationship between caring and identification with the company, whereas attitudinal loyalty mediated the negative relationship between independence and altruism. Literature on epistemic injustice has grown tremendously as an increasingly rich and diverse body of work in recent years. From the point of view of intercultural and anticolonial discussions, contemporary contributions have also helped to illuminate how epistemic injustice and other forms of cultural domination might be related to essential processes within the structures of colonial and racial supremacy. -/- This proposal aims to contribute to such relevant and illuminating discussions by focusing on the role that language and culture might (...) have in phenomena of epistemic injustice, particularly, hermeneutical injustice. Despite the central role played by semantics in epistemic injustice studies, the question about whether certain languages could also themselves be the recipients of epistemic injustice has been rather undertheorized. Simultaneously, recent movements to advocate for minority language rights, such as the Linguistic Human Rights Movement (LHR), raise important questions in this connection. -/- In the present paper, I argue that attending to the intercultural context reveals a new sort of hermeneutical injustice, one that, surprisingly, has never been articulated before. In particular, I am referring to a kind of HI that is essentially “linguistic” and “culture-specific”. I will be presenting two different subtypes for this kind of hermeneutical injustice: The first concerns the possibility of considering certain languages themselves as genuine objects of hermeneutical injustice, while the second has to do with certain specific culturally-established expressions or forms of talking. Nuestra aproximación al fenómeno saturado en J.-L. Marion se realizará mediante los ejemplos de mandato y anuncio que se dan en el ámbito de la revelación. Con ellos justamente se pretende llamar la atención sobre la necesidad de una fenomenología de la donación que abarque lo que desde nuestra comprensión humana se rechaza como intolerable, e incluso imposible, atendiendo sin embargo a fenómenos saturados que no se limitarían a un determinado ámbito, como algunas críticas parecen sugerir cuando se refieren al (...) “giro teológico” en la fenomenología (Janicaud, 1991). La donación exige ser reconocida, y que no nos opongamos a ella de entrada por nuestras inclinaciones metafísicas hacia la objetividad, el cálculo, el control, la predicción, etc. En este sentido nos referimos a un sacrificio de la metafísica, acreditando la oportunidad para que pudiera desmentirse lo que parece hacerla imprescindible (más que meramente necesaria), y a favor de nuevas posibilidades del pensar y del enriquecimiento de la experiencia. Para ello sería de suma relevancia proteger la confianza en la donación, incluso en los casos más extremos, que en nuestros ejemplos también dan crédito a la libertad. (shrink)

After a brief summary of Alvin Goldman’s theory of the “level-generation” of complex act-tokens from basic acts, it is argued that if the occurrent want which causes the basic act becomes deactivated in medias res, or during the interval between the basic act and the generated events, the latter do not qualify as actions proper. A discussion follows of Steven Davis’s at tempts to provide a counterexample to GoIdman’s theory by suggesting an example in which the Goldman conditions are met (...) and yet intuition tells us that the generated event is not an action. After concluding that Davis’s counterexamples are men of straw, a series of legitimately generated events which terminate in non-action is offered. (shrink)

The article aims at integrating the cultural psychology perspective of into the multidisciplinary field of border studies. It analyses the border phenomenon as a co-genetic system. The authors investigate the psychological side of people who relate to the border out of different motives. Then, it expands some of the theoretical concepts current in border studies by introducing psychological dimensions such as intentionality and directionality. Finally, the framework is applied to two case-studies representing the northern and southern European Union frontiers: the (...) case of Estonian officer Eston Kohver in the Setumaa region on the Estonian–Russian border; and the experiences of border guards in the re-bordering process on the Spanish–Moroccan border. It offers an innovative conceptual resource based on a triadic co-genetic epistemological approach, which allows us to overcome the binary oppositions still very present in the contemporary debates in borders studies. This paper reports on an action research project about organizational change by a regional food bank in New York State’s southern tier. While the project team initially included a sociologist, food bank leadership and staff, it expanded to involve participants in food access programs and area college students. This paper combines findings from qualitative research about the food bank with findings generated through a collaborative inquiry about a ten-year process of organizational change. We ask how a regional food bank can (...) change its approach to address root causes of hunger. Acknowledging that narrow, pragmatic definitions of hunger promote charitable responses, our collaboration is grounded in structural understandings of poverty that refuse to blame the poor or treat poverty as an accident. Decades-long economic restructuring, deindustrialization and a rise in the service economy have resulted in growing inequality and long-term demand for “emergency” food in New York State. We outline critiques by scholars and practitioners of the emergency food regime. Description and analysis of the organizational change efforts of the Food Bank of the Southern Tier combine discourse analysis, collaborative inquiry, interviews, and participant observation. Discourse analysis of the agency’s strategic plans documents changes in aspirations, exposure to new epistemic communities and repertoires of actions. Interviews with participants evidence impacts of the organization’s advocacy and education programs on people with lived experience in poverty. Through a participatory process, we developed a collaborative chronology of phases of organizational change. Collaborative analysis of organizational changes demonstrates new definitions of the problem, a shift in service focus, changing outcomes and increased funding for advocacy. While recognizing substantial constraints, this project contributes to evidence that food banks may shift their discourse and practices beyond charity. (shrink)

We then offer a more robust presentation of Ockhamism, responding to obvious objections and teasing out the implications of the view. At this point, we discuss presentism and eternalism in more detail. We then present our argument for the claim that the libertarian cannot take Ockham’s way out of the fatalism argument unless she rejects presentism. The consequence argument for the incompatibility of free action and determinism has long been under attack, but two important objections have only recently emerged: Warfield’s modal fallacy objection and Campbell’s no past objection. In this paper, I explain the significance of these objections and defend the consequence argument against them. First, I present a novel formulation of the argument that withstands their force. Next, I argue for the one controversial claim on which this formulation relies: the trans-temporality thesis. This thesis (...) implies that an agent acts freely only if there is one time at which she is able to perform an action and a distinct time at which she actually performs it. I then point out that determinism, too, is a thesis about trans-temporal relations. I conclude that it is precisely because my formulation of the consequence argument emphasizes trans-temporality that it prevails against the modal fallacy and no past objections. (shrink)

It is well established that nursing practice produces considerable anxiety, and it can also give rise to envy and jealousy. While envy in nursing was identified in the literature more than 50 years ago, there remains a paucity of articles addressing either envy or jealousy for nurses. In a recent research study on current experiences of clinical practice, we analysed a fragment of nurses’ speech via Klein's theory of jealousy. The results revealed that the nurses expressed jealousy at the privilege (...) afforded to doctors. We argue that it is important to acknowledge jealousy in nursing practice because it has the potential for ‘spoiling’ effective care delivery and as such, can have detrimental ramifications in the health system. Also, jealousy may keep the nurse from fully focusing on their nursing practice in that it divides the nurse's attention and so limits the nurse's treatment of the patient. Nurses’ jealousy of doctors is a taboo topic in nursing, and yet it warrants serious consideration due to the potential deleterious consequences that can arise when this dynamic is present. (shrink)

The paper concentrates on the Chinese philosophical strand of Daoism and analyses in how far this philosophy can contribute to new directions in management theory. Daoism is an ancient Chinese philosophy, which can only be traced back roughly to about 200 or 100 BC when during Han dynasty the writers Laozi and Zhuangzi were identified as “Daoists”. However, during Han dynasty Daoism and prevalent Confucianism intermingled. Generally, it is rather difficult today to clearly discern Daoist thought from other philosophical strands (...) as in the same period also Buddhism, Mohism and Legalism shaped contemporary thinking. Furthermore, there is a difference between the religious practice of Daoism in the sense of popular religion and the theoretical basis of Daoist thought presented in Laozi and Zhuangzi. The religious practice in contrast can have very mystical elements, which are linked to superstition. Moreover, there is also the question of in how far Daoist thought and practice is still prevalent at all in Chinese society today. Hence, the picture of Daoism is heterogeneous, first, regarding the question of what can be defined as the “original core” of Daoism, second, the difference between thought and religious practice, and third, the question of the prevalence of Daoist thought in China today. This paper offers a broader discussion regarding the potential ways of application of Daoist thought today over five parts. First, it illuminates the most important values taught under the name of Daoism. Thereby, it focuses on the Daoist thought and leaves out the actual religious practice together with its mystical elements. Second, these values are then put into the management context to analyse in how far Daoism can broaden our contemporary understanding of management in general and different management styles in particular. Third, Daoism in a management context is then contrasted with the comparably rigid Confucian doctrine also applied in a business context. Here, the application of Daoist and Confucian thought in the fields of leadership, management and corporate ethics is presented and compared. Fourth, insights into the real business practice in China regarding Chinese philosophies like Daoism and Confucianism in fields like management, strategy or corporate ethics are provided. Fifth, an outlook is presented where Daoism is discussed in the context of contemporary debates on sustainability and CSR. Here, the proposed paper illuminates in how far the philosophy of Daoism can also contribute to a more holistic understanding of sustainability and CSR today, thereby contributing to more innovative solutions in management. El presente trabajo parte del planteamiento del enfoque radical e inclusivo en el que, entre otros aspectos, se señala que hay determinados temas, denominados radicales, que no son socialmente demandados, pese a que su inclusión en educación es clave para la formación. Este es el caso del “amor”, un tema que no se suele tener en cuenta, aunque se puede intuir su impacto significativo en nuestra educación. Desde este enfoque, se entiende el amor como opuesto al egocentrismo, y considera la (...) importancia de incluir estos temas como forma de alcanzar una educación plena. Por ello, nuestro trabajo se centra en comprobar la presencia de este tema radical (el amor) en la legislación educativa vigente en España. El estudio se realiza a través de una metodología de análisis documental, considerando la normativa referente al desarrollo curricular de la Ley Orgánica 3/2020 (LOMLOE), así como sus concreciones a nivel autonómico, utilizando como unidades de análisis la palabra amor y derivadas. El análisis se realiza a través de técnicas cuantitativas, registrando la frecuencia de la presencia del concepto en los Reales Decretos por los que se establecen la ordenación y las enseñanzas mínimas, así como en los documentos derivados del desarrollo posterior que realizan de estas normas las comunidades autónomas en las diferentes etapas educativas (Infantil, Primaria, Secundaria Obligatoria y Bachillerato), asimismo se atendió a los ámbitos de conocimiento donde está este término presente. Los resultados obtenidos indican que el marco normativo curricular estatal y autonómico apenas incluye el concepto amor. Por este motivo, este estudio detecta que los temas relacionados con el amor no son prioritarios en los documentos analizados, por lo que se plantea la necesidad de que desde el ámbito educativo se incluya en los currículos, de las diferentes etapas educativas, el tema del amor que es primordial para la formación. The overwhelming majority of action theories have relied on a Humean model of causality and of explanation; even those theories that explicitly reject aspects of that model uncritically adopt others. The atomistic presuppositions embodied in the model are unable to account for either the dynamic and fabric-like nature of action or the features of control and meaning present therein. It is these atomistic presuppositions that give rise to the “Gettier-like vexations” that are common counterexamples in action theory. The Humean requirement (...) that cause and effect be only contingently connected and generalizable into a covering law is also discussed with respect to the explanation of action.Representatives of the three major approaches to the problem of action: causal (including intentional, volitional, as well as agent causation and reasons-as-causes theories), behaviorist, so-called “contextual”, and teleological theories are examined.
