Pauline Kleingeld and Marcus Willaschek, in a co-authored article, declare that their purportedly new interpretation of Immanuel Kant's writings on autonomy reveals that his moral philosophy is neither realist nor constructivist. However, as I explain here, John Rawls already occupies the area of intellectual territory to which Kleingeld and Willaschek attempt to lay claim: Rawls interprets Kant's moral philosophy as neither realist, as Kleingeld and Willaschek evidently construe this term, nor constructivist, as they evidently construe this term. Contra Kleingeld and (...) Willaschek, the moral constructivism attributed to Kant by Rawls is not voluntarist, and Rawls's account of Kant's concept of autonomy is not paradoxical. In order to understand autonomy, it is necessary to understand Kant's complex conception of the will, which structures his moral philosophy (as Rawls, unlike Kleingeld and Willaschek, explains). Rawls, like Kant, but unlike Kleingeld and Willaschek, clearly distinguishes between certain importantly different questions about normativity and obligation. Kant's moral philosophy, according to Rawls's insightful interpretation, is a form of objective moral constructivism. (shrink)

How can respect for cultural and religious differences be reconciled with the conviction that everyone has basic human rights that must be secured? Should liberal states require that non-liberal states secure human rights, and can they do so without being intolerant and oppressive? Is there a human right to democracy, and should a liberal hold that all states must become modern liberal democracies and may be pressured to reform their traditional practices and institutions? Do human rights include only the classical (...) liberal civil and political rights, and no economic rights? ;In this dissertation I defend a conception of human rights derived from John Rawls's Political Liberalism, which comprises both Justice as Fairness, the view he presented in A Theory of Justice , and the Law of Peoples, the view he presented in The Law of Peoples . According to this conception, human rights are binding on all societies, and cannot be rejected as peculiarly liberal or politically parochial. Outlaw states that violate them are to be condemned and may in grave cases be subjected to sanctions or intervention. Moreover, human rights include not only basic civil and political rights but also basic economic rights. However, while there may be a human right to live under a procedurally democratic government, it would not be a basic right but a derivative one. ;The conception of human rights that I here defend is a rational reconstruction of Rawls's view. In Chapters 1--3 I argue against the most natural interpretation of The Law of Peoples, defend a different interpretation, and expose and bridge a logical gap in that text. I then develop new responses to objections by Charles Beitz and Thomas Pogge, who hold that liberals who endorse Justice as Fairness must reject the Law of Peoples as insufficiently egalitarian. I also respond to the additional objection that the set of human rights cannot include economic rights. As I show, endorsing Justice as Fairness requires endorsing the Law of Peoples, and public reason can reconcile respect for cultural and religious differences with the conviction that everyone has basic human rights that must be secured. Non-suicidal self-injury is a complex behaviour, routinely engaged for emotion regulatory purposes. As such, a number of theoretical accounts regarding the aetiology and maintenance of NSSI are grounded in models of emotion regulation; the role that cognition plays in the behaviour is less well known. In this paper, we summarise four models of emotion regulation that have repeatedly been related to NSSI and identify the core components across them. We then draw on social cognitive theory to unite models of cognition (...) and models of emotion in developing a new cognitive-emotional model of NSSI. Our model articulates how emotion regulation and cognition can work in concert to govern NSSI, and offers several new research questions that can be addressed within this framework. (shrink)

Knobe argues in his target article that asymmetries in intentionality judgments can be explained by the view that concepts such as intentionality are suffused with moral considerations. We believe that the “culpable control” model of blame can account both for Knobe's side effect findings and for findings that do not involve side effects.

It’s been argued that there are no diachronic norms of epistemic rationality. These arguments come partly in response to certain kinds of counterexamples to Conditionalization, but are mainly motivated by a form of internalism that appears to be in tension with any sort of diachronic coherence requirements. I argue that there are, in fact, fundamentally diachronic norms of rationality. And this is to reject at least a strong version of internalism. But I suggest a replacement for Conditionalization that salvages internalist (...) intuitions, and carves a middle ground between conservatism and evidentialism. (shrink)

A number of philosophers maintain that the destruction of an embryo in the first 2 weeks after fertilization is not morally problematic as it is metaphysically impossible for any human organism to then have existed. We contend that the typical adult human organism was once a zygote so there is no metaphysical shortcut to justify early abortion. We show that five arguments against human organisms ever having been zygotes fail. All of the arguments have to do with one variant or (...) another of the zygote or early embryo dividing. They do not provide any reason to believe that since some adult organisms are not identical to zygotes due to earlier divisions, none could have been. (shrink)

Before there was the digital divide there was the analog divide– and universal service was the attempt to close that analogdivide. Universal service is becoming ever more complex in terms ofregulatory design as it becomes the digital divide. In order to evaluatethe promise of the next generation Internet with respect to the digitaldivide this work looks backwards as well as forwards in time. Byevaluating why previous universal service mechanisms failed andsucceeded this work identifies specific characteristics ofcommunications systems – in particular (...) in billing and managinguncertainty – and argues that these characteristics underliesuccess or failure in terms of technological ubiquity. Developing a setof characteristics of services rather than a set of services is afundamental break with the tradition of universal service. In fact, theimplications of our proposal is that basic characteristics in theoffering of the service rather than the absolute price are critical toclose the digital divide: certainty of total charge, ability to avoiddeposits or disconnection via best effort service, and payer-basedcontrol of all charges. While all of these principles sound obvious infact none of these hold in the telephony network. Universal service hasevolved from common carriage (serve all with no discrimination) to aright to basic services (100% penetration). Universal service isnow discussed as the digital divide, as the access to information asopposed to services becomes increasingly critical. However, we arediscussing in this paper access to the bits and the network rather thanaccess to the information (or intellectual property) once connected. Theprovision of universal service is seen as a technical problem only in thatthe technology costs money – universal service debates have longbeen the domain of economists. Yet the design of protocols has been thedomain of engineers, the building of systems the corporate domain, andthe discussion of equity the interest of ethicists. The design ofprotocols can define the parameters of the corporate decision-makers,the variables of the economist, and the questions for the ethicist. Thedesign decisions made at the fundamental levels can make communicationsequity more or less likely. In this work I focus on the design ofprotocols for the next generation Internet, protocols which willfundamentally change the best-effort nature of Internet services.Building on the economic and ethnographic work of others I argue thatthe effects of protocols adoption on universal service can be predictedto some degree. By examination of past and current technologies Iexamine a set of technical mechanisms to determine how such mechanismsmight harm or enhance universal service. I define each mechanism (e.g.denial of entry) and offer observations about each particularmechanism''s implicit pricing assumptions. I close with a discussion ofinterest to ethicists and regulators on evaluating communicationsprotocols with respect to universal access. Protocols for developingmultiple qualities of service for packet-switched networks have focusedon economic efficiency (e.g. Mackie-Mason, 1995; Choi, Stahl &Winston, 1997; Shapiro & Varian, 1998), billing to encouragewidespread adoption of network innovations (e.g. Xie & Sirbu, 1985)and billing in a manner consistent with the underlying network (e.g.Clark, 1996). Here we examine a set of protocols which include varyingquality of service mechanisms with respect to the compatibility of theprotocols with universal access. (shrink)

In response to the Covid‐19 pandemic, health care systems worldwide canceled or delayed elective surgeries, outpatient procedures, and clinic appointments. Although such measures may have been necessary to preserve medical resources and to prevent potential exposures early in the pandemic, moving forward, the indirect effects of such an extensive medical shutdown must not outweigh the direct harms of Covid‐19. In this essay, we argue for the reopening of evidence‐based health care with assurance provided to patients about the safety and necessity (...) of high‐value vaccinations, screenings, therapeutics, and procedures. To ensure that virtually all non‐Covid‐related services do not come to a halt again, health care systems and physician practices must preemptively increase their capacity, secure adequate personal protective equipment to safeguard health care personnel, and develop a measured approach to reclosing such routine health care, should it become necessary in the future. In vol. xxxii of this Journal, pp. 220 ff., we published a rejoinder to Dr. L. R. Palmer's ingenious article in which he derived macte, mactare, and macula from a hypothetical verb *macio ‘to sprinkle’. We objected to this construction, holding that the traditional derivation of macte from the root of magnus was more satisfactory, and discussing in some detail the evidence brought forward by Dr. Palmer in support of his theory. Alas! Dr. Palmer has taken our criticism neither kindly (...) nor seriously, and, while accusing us in his spirited reply of using ribaldry instead of argument, he is himself rather selective in answering our objections. Both this circumstance and the fact that his article contains a number of mistaken assertions compel us to restate our case. (shrink)

The function of REM, or any other stage of sleep, can currently only be conjectured. A rational evaluation of the role of REM in memory processing requires systematic testing of hypotheses that are optimally derived from a complete synthesis of existing knowledge. Our view is that the large number of studies supporting a relationship between REM-related brain activity and memory is not easily explained away. [Vertes & Eastman].

I. It has long been a standing puzzle why the women at the festival of Mater Matuta prayed, not for their own children, but for their sisters' offspring. The attempts to connect it with any sociological phenomenon are purely absurd, and would not have been noticed but for their association with one or two famous names and the complete ignorance of non-European systems of relationship prevailing among the scholars of an older generation. There is no system under which a woman (...) is closer akin to her sister's children than to her own; for under father-right a nephew or niece is further off than an own child, and if the system be pushed to the most logical and most absurd extremity, so as to make a child kin to his father only, not his mother, then he is also no kin to his mother's sister; under mother-right, which Rome never had in any form whatsoever, the mother is still nearer kin than the maternal aunt; while if ever there was, anywhere in the world, a classificatory system so pure and rigorous as to make no distinction between the actual mother and any other woman of the same age-class, then mother and aunt were in the same degree of kinship to every member of the younger generation. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. ROSE Josiah ober has taken on the very ambitious task of analyzing a vast swath of ancient Greek history— precisely the periods—as his opening quotation from Byron (1) implies—most admired by those who have devoted any time to the study of Greek antiquity: Fair Greece! sad relic of departed worth! Immortal, though no more! Though fallen, great!1 At the same time, again (...) as suggested by the repetition of Byron’s lines (206, also mentioned on 293), Ober’s book falls within the large category of celebratory works about ancient Greece—like Werner Jaeger’s once popular three volumes of Paideia or, at the outset of the twentieth century, Alfred Zimmern ’s The Greek Commonwealth.2 It does not, on the other hand, fit in with a plethora of relatively recent, relatively short (as opposed to George Grote’s twelve volumes) histories of Greece aimed at the potentially lucrative textbook market for general more comprehensive overviews of Greek civilization.3 As such, the basis on which Ober celebrates ancient Greece merits close scrutiny. history and the overriding thesis ober’s conception of “history” here is heavily weighted towards the theoretical elaboration and justification of an Josiah Ober, The Rise and Fall of Classical Greece (Princeton University Press 2015), hardback, 415 pages. Five initial chapters of a total of eleven are devoted to that task before five chronologically focused chapters, which offer a cursory romp through Greek history from ca. 1000 BCE to 334 BCE and some brief suggestions about the period down to the decisive takeover of Greece by Rome, usually dated to 31 BCE. The volume is capped by a final summary and overview chapter. Ober is admirably forthright about his agenda. Immediately in his preface he declares, “in states where citizens keep rulers in check, public authority protects individual rights and the rule of law pertains most of the time. These political conditions promote economic growth. The conjunction of democratic politics and a strong economy is, in practice, available only to affluent citizens of highly developed countries.... Democracy and growth define the normal, although not yet the usual, conditions of modernity” (xiii, my emphasis).4 This somewhat utopian conception of the present-day interface of democratic institutions and economic growth—posited as an unquestioned desideratum in sublime disregard of “ecology” in the literal sense5—underlies Ober’s whole project. While acknowledging the obvious negatives of ancient slavery,6 “denial of rights to women, and glorified war,” he argues “if we are interested in the conjunction of political and economic exceptionalism, we must start somewhere, and classical Greece was the society in which the wealth-and-democracy package first emerged in a form that can be studied in depth” (xv). Athenian democracy has been at the center of Ober’s impressive scholarly career at least since the publication of his study of fourth-century BCE Athenian rhetoric, Mass and Elite in Democratic Athens (Princeton 1989). “Athens” or “democracy” have featured in the titles of all his subsequent book publications7—not to mention the extraordinary output of more specialized essays in multiple venues. One overriding question about his latest book is whether the unique phenomenon of Athenian democracy is being unduly generalized to “Classical Greece.” 142 capitalism in “wealthy hellas”? The special focus of his interest here in ancient Greece, the “conjunction of political and economic exceptionalism,” is further clarified in his opening chapter which begins with the quotation from Byron cited above: “Byron’s vision of greatness was inspired by ancient Greek cultural and intellectual achievement: art and architecture, literature, visual and performance art, scientific and moral thought.... Hellas was great because of a cultural accomplishment that was supported by sustained economic growth. That growth was made possible by a distinctive approach to politics” (1–2). L’accès à la grand-parentalité engage des remaniements identitaires profonds du fait notamment de l’inscription dans une nouvelle forme de filiation et de la découverte d’un rôle social et familial inédit. L’ensemble de ces mouvements psychiques reconvoque des liens conscients et inconscients du sujet à lui-même, à ses enfants mais aussi à ses propres parents et grands-parents. Cet article propose d’exposer le cas de Catherine, rencontrée dans le cadre d’une recherche longitudinale auprès de patients migraineux, ceci à titre d’illustration du parcours (...) individuel d’un sujet devenu grand-parent pendant la période de ladite recherche. L’épreuve projective Rorschach lui a été proposée à deux temps différents, au début de la prise en charge de sa symptomatologie migraineuse et huit mois plus tard. Entre temps, la symptomatologie s’est très nettement améliorée et les protocoles Rorschach ont révélé des remaniements psychiques denses sous-tendus par l’accès à la grand-parentalité. (shrink)

Afferent feedback can appreciably alter the pharyngeal phase of swallow. In order to measure the stability of the swallow motor pattern during several types of alterations in afferent feedback, we assessed swallow during a conventional water challenge in four anesthetized cats, and compared that to swallows induced by fixed (20 Hz) and stochastic (1-20Hz) electrical stimulation applied to the superior laryngeal nerve. The swallow motor patterns were evaluated by electromyographic activity (EMG) of eight muscles, based on their functional significance: laryngeal (...) elevators (mylohyoid, geniohyoid, and thyrohyoid); laryngeal adductor (thyroarytenoid); inferior pharyngeal constrictor (thyropharyngeus); upper esophageal sphincter (cricopharyngeus); and inspiratory activity (parasternal and costal diaphragm). Both the fixed and stochastic electrical stimulation paradigms increased activity of the laryngeal elevators, produced short-term facilitation evidenced by increasing swallow durations over the stimulus period, and conversely inhibited swallow-related diaphragm activity. Both the fixed and stochastic stimulus conditions also increased specific EMG amplitudes, which never occurred with the water challenges. Stochastic stimulation increased swallow excitability, as measured by an increase in the number of swallows produced. Consistent with our previous results, changes in the swallow motor pattern for pairs of muscles were only sometimes correlated with each other. We conclude that alterations in afferent feedback produced particular variations of the swallow motor pattern. We hypothesize that specific SLN feedback might modulate the swallow central pattern generator during aberrant feeding conditions (food/liquid entering the airway), which may protect the airway and serve as potentially important clinical diagnostic indicators. For the first time, this book compiles original documents from Science for the People, the most important radical science movement in U.S. history. Between 1969 and 1989, Science for the People mobilized American scientists, teachers, and students to practice a socially and economically just science, rather than one that served militarism and corporate profits. Through research, writing, protest, and organizing, members sought to demystify scientific knowledge and embolden "the people" to take science and technology into their own hands. The movement's (...) numerous publications were crucial to the formation of science and technology studies, challenging mainstream understandings of science as "neutral" and instead showing it as inherently political. Its members, some at prominent universities, became models for politically engaged science and scholarship by using their knowledge to challenge, rather than uphold, the social, political, and economic status quo. Highlighting Science for the People's activism and intellectual interventions in a range of areas -- including militarism, race, gender, medicine, agriculture, energy, and global affairs -- this volume offers vital contributions to today's debates on science, justice, democracy, sustainability, and political power. Physicians, scholars, and policymakers continue to be concerned about conflicts of interests among health care providers. At least two main types of objections to conflicts of interest exist. Conflicts of interests may be intrinsically troublesome if they violate providers’ fiduciary duties to their patients or they contribute to loss of trust in health care professionals and the health care system. Conflicts of interest may also be problematic in practice if they bias the decisions made by providers, adversely impacting patient outcomes (...) or wastefully increasing health care costs. This latter objection may be observed in differences in the prescriptions written, procedures performed, or costs billed by health care professionals who have conflicting interests, when compared to those that do not have such financial relationships. The very ingenious and closely reasoned article of Mr. L. R. Palmer seems to us to deserve examination, the more so as we totally disagree with his views, both from the point of view of etymology and that of Religionsforschung. To put his conclusions briefly, he supposes mactus to be derived from a hypothetical verb macio, signifying ‘bespatter, sprinkle’; mactus then would properly mean ‘sprinkled’, and might also be used of the substance which was sprinkled or poured, thus accounting for (...) the double construction of the secondary verb mactare. In particular, Mr. Palmer supposes that macte uirtute alludes to the blood with which the warrior thus addressed is besprinkled, and so to his tabu condition. To the whole of this construction we object, holding that the old derivation from the root MAG is correct and that mactus signifies ‘increased’, ‘made greater or stronger’, mactare properly ‘to put someone in the condition of being mactus’, and by an easy transition ‘to sacrifice a victim’.
