This paper was written for a forthcoming Cambridge University Press anthology titled "On Philosophy in American Law" that commemorates the 75th anniversary of Karl Llewellyn's essay of the same name. Karl Llewellyn was a founder of the Legal Realist movement in American jurisprudence, and his essay is most obviously read as a brief for that movement, in which he argues that a Realist focus on underlying social needs better explains the course of American legal history than do (...) the competing natural law, positivist and formalist schools. Without contesting the merits of this conventional reading, I argue that Llewellyn's essay also makes an implicit case for another, quite different point: the need for Continental philosophical approaches to law in contemporary American jurisprudence. In particular, I argue that the conception of philosophy upon which Llewellyn relies is, with one exception, deeply Hegelian. The one exception lies in Llewellyn's residual belief that, at least to a limited extent, philosophy can change the world as well interpret it. This belief places him squarely in the camp of post-Hegelian thinkers, the camp that also includes contemporary Continental political and legal philosophers. I conclude by suggesting how the post-Hegelian tradition responds to some of the deepest conundrums of contemporary American jurisprudence, using the problem of affirmative action as an example. Kropotkin's anarchism looked to a future defined by communalism. However, his understanding of this potential communal future has rarely been subject to analysis. Particularly important was his distinction between communalism and the tradition of communal experimentation in the US, which drew heavily on the ideas of Charles Fourier. Kropotkin was influenced by Fourier, but thought that attempts to found phalanstèries had been disastrous, vitiating the power of communalist propaganda. To defend the idea of a communal future, Kropotkin therefore advanced a (...) tripartite critique of the US model of utopian experimentation. The image of American utopianism he created consequently served as a useful rhetorical device, allowing him to advance a counter-image of the anarchist communal theory that lay at the heart of his political theory. We live in a world in which we are socially, politically, economically, and environmentally connected with other people. Online communication has facilitated people coming together from different parts of the world. In terms of social justice movements, people have come together to share ideas about how they perceive social inequality and how to address it, which is what academics call critical consciousness. While scholars have explored critical consciousness in the American context, whether it operates on a global scale is (...) under-explored. To address this question, we administered the Critical Consciousness Scale (a validated survey) with students from the United States, Iran, and Ukraine. Our findings demonstrate that critical consciousness maintains its factor structure across the entire sample, meaning that students from these three countries share some notions of critical consciousness. However, when comparing national groups, we find that critical consciousness is defined differently by students in different countries. In a practical sense, these findings mean that some aspects of critical consciousness are shared, but there are important differences in how it is perceived and how its components relate to one another. By attempting to understand critical consciousness internationally, this study serves as a cautionary narrative for international solidarity movements organized around the goal of social justice. Questions and analyses centered on race have become more prominent in philosophy. By employing a ‘critical philosophy of race’, thinkers become enabled to address how race and racism continue to operate in subtle and unintended ways, including within concepts, theories, principles, practices, and methodologies otherwise purported to be race-neutral. Yet, North American sports philosophy provides few examples of work that grapples with race, racism, or theories of race. In this essay, I ask why and conclude that the shortage of (...) discussions that include explicit references to race or ethnicity in North American sport philosophy is due to the dominance and normalization of white epistemologies – white ways of experiencing, seeing, and knowing the world. American Catholics during the 1850s expressed deep concerns about the legacy of the 1848 revolutions in Europe, fearing that radicalism was spreading to the United States and would harm both the Church and the state. This paper explores the reception of Fr. Antonio Bresciani’s novel The Jew of Verona in the diocesan newspapers of Pittsburgh, Pennsylvania and Charleston, South Carolina. Both papers reacted to the book in a similar fashion and used it as a lens to understand domestic politics. (...) Bresciani’s themes of international conspiracy and the dangers of secret societies resonated with Catholics in both dioceses and led some to propose a Catholic conservative alliance to prevent the spread of radical revolution. Fears of revolution, then, drove the American Catholic responses in these dioceses even as sectional concerns ripped the nation apart. (shrink)

This paper presents a novel framework for evaluating racial profiling, including 'rational profiling' that does in fact decrease crime rates. It argues that while profiling some groups, such as African Americans and Muslims, is impermissible, profiling others, such as white men, may be permissible. The historical and sociological context matters significantly. Along the way, the paper develops a new theory of what expressive harms are, why they matter, and when it is the responsibility of the state to correct them.

Though the use of the word “spirituality” abounds, the meaning can vary greatly. Three increasingly narrow categories seem to cover the essence of “spirituality” within American culture: general, Christian, and biblical. General spirituality is broad and all-inclusive. Christian spirituality introduces the necessity of Christ and the Holy Spirit, but has been undermined to a degree by the elevation of personal subjectivism. As a result the need has arisen for a third category. Biblical spirituality emphasizes the Bible as the basis (...) for shaping one's understanding of and experience with God, as well as determining what is and is not of the Spirit of God. The Bible is still relevant and should be the spiritual basis for determining what appropriate expressions of faith are, grounding spirituality in an objective standard. Biblical spirituality should be advocated today within the church in capturing the essence of New Testament spirituality. (shrink)

It is a problem of controlling and civilizing economic power in order that it may be used for the public good within the framework of democratic institutions. It is a problem of striking a delicate balance between individual freedom and centralized control. It is a problem for which there is no monistic solution and which transcends the clichés of popular controversy between conservatives and liberals.

Research has established that the burdens of externalities associated with industrial production are disproportionately borne by socially and politically vulnerable groups, and this is particularly true for farmworkers who are at high risk for environmental exposures and illnesses. The impacts of these risks are often compounded by farmworker communities’ social vulnerability. Yet, less is known about how the intersection of race, class, and gender can position some farmworkers to be at higher risk for particular types of oppressions. We extend the (...) literature by analyzing the case of Black women farmworkers in Apopka, Florida, which was historically home to a large agricultural community. Drawing on the concept of critical environmental justice, we investigate the lived experiences of these women in the context of racialized, gendered, and economic oppressions during their time working on the farms. We use the case of Apopka to ask: how the policies and socio-historical context of the agricultural industry in the American South contributed to injustices experienced by Black women farmworkers in Apopka, Florida; and how race, gender, and class intersected and intersect to create and legitimize environmental injustices in the workplace for these farmworkers. Our data include semi-structured in-depth interviews, newspaper and media coverage, and archival materials. Our analysis advances work on critical environmental justice and intersectionality by mapping the relationship between structural and environmental intersectional oppressions for Black women farmworkers. Most accounts of “logical empiricism in America” take logical empiricism to be a monolithic, or at least a one-dimensional, philosophical group. This picture of logical empiricism has come under well-reasoned attack during the past two decades, but some of the relevant conclusions for the reception-history of the movement were not drawn, or were not drawn as thoroughly as they could have been. Thus, if we want to understand the reception of logical empiricism, we should not talk about the reception of (...) logical empiricism as such; rather, we should provide a more stratified and differently balanced account. This article aims to draw the contours of one more stratified account by pointing out differences in the reception-history of logical empiricism with respect to pragmatism in particular. Namely, I will examine and defend an account according to which the more pragmatist-naturalist wing of logical empiricism was welcomed by the majority of American pragmatists while the more technical wing came immediately under pragmatist attack from various sides. This paper traces the application of information theory to philosophical problems of mind and meaning from the earliest days of the creation of the mathematical theory of communication. The use of information theory to understand purposive behavior, learning, pattern recognition, and more marked the beginning of the naturalization of mind and meaning. From the inception of information theory, Wiener, Turing, and others began trying to show how to make a mind from informational and computational materials. Over the last 50 years, (...) many philosophers saw different aspects of the naturalization of the mind, though few saw at once all of the pieces of the puzzle that we now know. Starting with Norbert Wiener himself, philosophers and information theorists used concepts from information theory to understand cognition. This paper provides a window on the historical sequence of contributions made to the overall project of naturalizing the mind by philosophers from Shannon, Wiener, and MacKay, to Dennett, Sayre, Dretske, Fodor, and Perry, among others. At some time between 1928 and 1948, American engineers and mathematicians began to talk about `Theory of Information' and `Information Theory,' understanding by these terms approximately and vaguely a theory for which Hartley's `amount of information' is a basic concept. I have been unable to find out when and by whom these names were first used. Hartley himself does not use them nor does he employ the term `Theory of Transmission of Information,' from which the two other shorter terms presumably were derived. It seems that Norbert Wiener and Claude Shannon were using them in the Mid-Forties. (shrink)

Slurs such as spic, slut, wetback, and whore are linguistic expressions that are primarily understood to derogate certain group members on the basis of their descriptive attributes (such as their race or sex) and expressions of this kind have been considered to pack some of the nastiest punches natural language affords. Although prior scholarship on slurs has uncovered several important facts concerning their meaning and use –including that slurs are potentially offensive, are felicitously applied towards some targets yet not others, (...) and are often flexibly used not only derogatorily to convey offense towards out-group members but also non-derogatorily to convey affiliation with in-group members– the literature remains largely focused on slurs that typically target African Americans (nigger), male homosexuals (faggot), and sexually active females (slut). Since no account of slurs that typically target Hispanics or Mexican-Americans has so far been proposed, here I offer the first systematic and empirically informed analysis of these that accounts for both their derogatory and appropriative use. Importantly, this article reviews over a dozen Spanish stereotypes and slurs and explains how the descriptive attributes involved in a stereotype associated with a slur can contribute to the predication of certain content in the application of that slur toward its target in context. This article further explains how the psychological effects of stereotype threat and stereotype lift can be initiated through the application of a relevant slur towards its target in context as well. The Rhetorical Presidency places great importance on the transformative power of political ideas. For Tulis, Progressive ideas informed the rhetorical practices of Theodore Roosevelt and Woodrow Wilson—practices that reconstituted the American presidency. They did so, in part, by trading on the ambiguous nature of the concept of “publicity”—which at once evoked liberal ideals of public deliberation and transparency, and modern practices of manipulative communication. Polarization often happens asymmetrically. One political actor radicalizes, and the results reverberate through the political system. This is how the deep divisions in contemporary American politics arose: the Republican Party radicalized. Republican officeholders began to use extreme legislative tactics. Republican voters became animated by contempt for their political rivals and by the defense of their own social superiority. The party as a whole launched a wide-ranging campaign of voter suppression and its members endorsed violence in the face of electoral (...) defeat. This paper is about how such asymmetric polarization affects everyone else’s obligations. My core claim is that two kinds of relationship – civic friendship and non-subordination – underpin critical democratic norms. Republican misbehavior has severed cross-partisan civic friendships. Their authoritarianism forfeits their claim to non-subordination. The former means that non-Republicans need not justify policy on public grounds. The latter undercuts Republicans’ claim to enjoy minority vetoes when out of power and it gives their rivals reason to disobey the laws that Republicans make when they are in power. More generally, when one political actor contravenes the proper norms of democratic politics, their opposition is not bound by those norms. (shrink)

This book theorizes aesthetic classroom management through a hermeneutical approach with three fields of literature: history and philosophical foundations of chivalry, chivalry’s promulgation through the Victorian Age, and parallel issues of identity in twenty-first century teacher education. The aim of the book is to examine the relationship between chivalric ethos and education. The presented case study addresses more specifically the following question: how can chivalry be re-imagined or theorized in an educational setting? Few studies address the concept of aesthetics and (...) hermeneutical context in American classroom management and classroom life, and Attwood pinpoints and traces the medieval social concept of chivalry through the centuries and argues it has manifested itself in classroom social construction in the twenty-first century. ABSTRACT Edward Bellamy's influential utopian novel Looking Backward dramatizes the epistemological impact of an increasingly media-saturated urban environment on turn-of-the-century American culture and identity. Bellamy's fanciful adaptation of the telephone receives particularly careful analysis in this essay. Deprived of its transmitting function, this denatured instrument both disrupts Bellamy's utopian project and, more subtly, registers the effect of mass media technologies on the construction and coherence of subjectivity. Lowenstein ultimately argues that Bellamy's novel rehearses the displacement of an epistemology rooted (...) in the search for ontological certainty by what Anthony Giddens calls an epistemology of social reflexivity. What accounts for the offensive character of pejoratives and slurs, words like ‘kike’ and ‘nigger’? Is it due to a semantic feature of the words or to a pragmatic feature of their use? Is it due to a violation of a group’s desires to not be called by certain terms? Is it due to a violation of etiquette? According to one kind of view, pejoratives and the non-pejorative terms with which they are related—the ‘neutral counterpart’ terms—have different meanings or senses, (...) and this explains the offensiveness of the pejoratives. We call theories of this kind, semantic theories of the pejoratives. Our goal is broadly speaking two-fold. First, we will undermine the arguments that are supposed to establish the distinction in meaning between words like ‘African American’ and ‘nigger’. We will show that the arguments are suspect and generalize in untoward ways. Second, we will provide a series of arguments against semantic theories. For simplicity, we focus on a semantic theory that has been proposed by Hom and Hom and May. By showing the systematic ways in which their view fails we hope to provide general lessons about why we should avoid semantic theories of the pejoratives. (shrink)

In this essay I outline core themes in the political geology of twentieth-century volcano science. The essay explores volcano science at the intersection of cross-disciplinary preoccupations with the role of the earth sciences in shaping the social and environmental crises of the present and how to find a way out of them. The essay then turns to volcanology in Indonesia at the turn of the twentieth century to destabilize persistent narratives in the historiography of volcano science that center European and (...) North American actors. I show how starting an account of twentieth-century volcano science from the slopes of Indonesia’s volcanoes reveals the roles of Indonesian intellectuals and knowledge traditions in shaping volcano science and, more broadly, modern theories of the earth, its evolution, and structure. The aim and provocation of starting from Indonesia are to open new epistemic pluralisms in the earth sciences, in particular around conceptualizations of the relationship between geological matter and society, history and ancestrality, and the politics of the earth. Recent research on the semantics and pragmatics of slurs has offered insight into several important facts concerning their meaning and use. However, prior work has unfortunately been restricted primarily to considerations of slurs that typically target females, homosexuals, and African Americans. This is problematic because such a narrowly focused attention to slurs in prior work has left theorizing of how slurs generally function relatively uninformed by facts of actual language use. As a result, theoretical accounts of slurs that have so (...) far been proposed have largely failed to accurately reflect actual usage, account for the empirical findings about slurs and general pejoratives from the social sciences, and offer any informative predictions to help guide future research. At this time more empirically oriented homework on the variety of ways that different slurs have been used in different cases would be helpful for theorists to consider so that they can proceed to develop more nuanced and empirically informed theories about slurs, their usage, and their effects. Accordingly, since no account of slurs for Italian Americans has so far been offered, this article provides a systematic and empirically informed analysis of slurs for Italian Americans that accounts for both their derogatory and appropriative use. Further, this article demonstrates that the family resemblance account of slurs maintained here has major advantages over previous accounts insofar as it is flexible yet robust enough to accommodate both the derogatory and appropriative use of slurs, can explain many of the psychological effects that slurs actually have on both their users and targets, and is more in accord with the real rather than ideal nature of our organic human psychology. In a recent study on indirect reports published in Journal of Pragmatics, Capone (2010) points out how several leading pragmatic theorists have recently argued that utterance interpretation incorporates societal information such that the final result of semantic and pragmatic interpretation takes sociocultural defaults into account (e.g., Jaszczolt, 2005a). Croom (2013) for one has pointed out how different in-group and out-group speakers have in fact used slurs in different ways, and further suggests that several salient cultural markers can aid in the (...) interpretation of whether a slur is being used derogatorily or nonderogatorily in a given context (p. 200). Thus, for pragmatic theorists concerned with the semantics and pragmatics of slurs more specifically, several highly important yet currently unexplored questions include the following: Are racial slurs always used to express offense, and are racial stereotypes always concerned with negative characteristics? How might the stereotypical features of members that a slur typically targets influence the meaning that slur communicates in context, and how might racial slurs and stereotypes differentially affect members of different races? Concerned with such questions, Embrick and Henricks (2013) recently argued that racial slurs and stereotypes function as symbolic resources that exclude nonwhite or non-European American minorities, but not whites or European Americans, from opportunities or resources, and so are necessarily negative or derogatory irrespective of the particular context of their use (pp. 197–202). They accordingly advocate an account of racial slurs and stereotypes that is consonant with the context-insensitive accounts of Fitten (1993) and Hedger (2013), yet dissonant with the context-sensitive accounts of Kennedy (2002) and Croom (2011). The purpose of this chapter is to first briefly explicate the context-insensitive and context-sensitive accounts of racial slurs and stereotypes, consider reasons for why issues concerning the semantics and pragmatics of slurs have often appealed to stereotypes and stereotypical features, and then critically evaluate the main claims that Embrick and Henricks (2013) recently proposed in support of their context-insensitive account by drawing upon empirical evidence on (in-group and out-group uses of) racial slurs and stereotypes (for European Americans and ­African Americans) from recent research in linguistics, sociology, and psychology. The chapter concludes by discussing implications of the present findings for future work in pragmatics on racial slurs and stereotypes. (shrink)

The use of algorithms and automated systems, especially those leveraging artificial intelligence (AI), has been exploding in the public sector, but their use has been controversial. Ethicists, public advocates, and legal scholars have debated whether biases in AI systems should bar their use or if the potential net benefits, especially toward traditionally disadvantaged groups, justify even greater expansion. While this debate has become voluminous, no scholars of which we are aware have conducted experiments with the groups affected by these policies (...) about how they view the trade-offs. We conduct a set of two conjoint experiments with a high-quality sample of 973 Americans who identify as Black or African American in which we randomize the levels of inter-group disparity in outcomes and the net effect on such adverse outcomes in two highly controversial contexts: pre-trial detention and traffic camera ticketing. The results suggest that respondents are willing to tolerate some level of disparity in outcomes in exchange for certain net improvements for their community. These results turn this debate from an abstract ethical argument into an evaluation of political feasibility and policy design based on empirics. (shrink)

Consider the following examples of political activity: Immediately upon the recent passage of health care reform legislation by the United States House of Representatives, announcements were made by attorneys general in several states that they would be challenging the constitutionality of the law in court. South Carolina Attorney General Henry McMaster thus contended that the "health care legislation Congress passed tonight is an assault against the Constitution. A legal challenge by the states appears to be the only hope of protecting (...) the American people from this unprecedented attack on our system of government." While the specifics of the proposed lawsuits varied, they were united in their goal of overturning the new law via court decision. In so doing, they were advancing a particular line of argument against that bill to the public—an argument that appealed to the alleged conflict between the legislation and the United States Constitution. This study examined the effect of history of harsh parenting on readiness for aggression in young adults testing the mediating effect of emotional reaction to frustration and provocation that is assumed to arise in the context of a history of physical punishment and psychological aggression. Data were collected from 402 participants including 187 Poles and 215 Americans. Participants reported retrospectively on corporal punishment and psychological aggression experienced during childhood. Based on self-report instruments, sensitivity to provocation and frustration and three patterns (...) of readiness for aggression in adulthood were assessed. Contrary to the US sample, sensitivity to provocation and frustration were mediators in the Polish sample alone. The important role of contextual factors that define harsh parenting circumstances, such as cultural context and sex of the parent, are discussed. (shrink)
