Assim sobrepõe a importância da função regulatória como essencial ao desenvolvimento da sociedade. Neste sentido, fala-se de uma mudança de paradigma do estado positivo ao estado regulador, dentro do surgimento deste Estado regulador, acende-se o debate se algumas matérias seriam exclusivas do agente regulador com modelo de governança regulatória. O presente estudo (...) científico faz-se necessário ao trazer à arena o debate sobre a possibilidade de se falar ou não de reserva de regulação no âmbito das terapias gênicas, já que a matéria que seriam submetidas a essa reserva técnica não seriam taxativamente delimitadas pela Constituição, devendo ser discutida caso a caso, dentro deste novo ramo do direito chamado direito da regulação. 8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. The contribution of Jesuits to the different fields of knowledge, including philosophy, is historically well known. In fact, since the foundation of the Society of Jesus, in the 16th century, Jesuits from different generations and cultures have taken part in the philosophical debates of their time and their different contexts. Since the foundation of the Society of Jesus, in 1540, the Jesuits, individually and as a body, have engaged in a fruitful dialogue between the Christian tradition and different dimensions of (...) human culture. During almost five centuries, numerous Jesuits taught philosophy in academic institutions all over the world. Some of them have their names recorded in the history of philosophy. Of course, the majority of them is not anymore remembered, despite their valuable contribution to the development of the Jesuit intellectual tradition up to our times. In fact, as an heir of the Roman College, the first academic institution founded by the Society of Jesus, in 1551, the Pontifical Gregorian University, in Rome, is a witness to this tradition, which has been kept alive thanks to the discrete work of both Jesuits and lay intellectuals. Known as the University of the Nations, this institution corroborates not only the capacity of the Jesuit tradition to put faith in dialogue with reason, but also the option to take the concrete reality of each human culture and its historical context as its point of departure. The Jesuits’ willingness to engage in dialogue with different intellectual perspectives is underpinned by one of the most defining traits of the Jesuit charism, namely, the conviction that God can be found and served in all things. Accordingly, Jesuits have adopted, from the beginning, an amenable stance towards the world with its different cultures and intellectual trends. As such, Jesuits have, since the beginning, inhabited the frontiers of human thought. According to the contemporary philosopher Paul Gilbert, SJ, within the institutions under the leadership of the Society of Jesus, it was always possible to maintain an equilibrium between two principles: “intellectual unity” and “openness to the world.” Without detriment to the Jesuit identity, the companions of Ignatius have been willing to dwell in the various dimensions of human reality, in their multiplicity and plurality. Either in the renewal of Aristotle’s and Aquinas’ metaphysics, or in the dialogue with modern philosophers such as Descartes, Kant, or Hegel, and even in the inculturation in non-European contexts, the Jesuits have been able to preserve the Christian tradition through an original development of human culture in all its richness and diversity. With respect to the last century, it has to be acknowledged that a significant number of Jesuits made significant contributions, with recognized competence, to philosophy. Certainly, the 20th century was particularly complex in many respects. It would be enough to recall that this period, which brought with it unprecedented social, scientific, and technological developments, was also the stage for the two World Wars. With the emergence or consolidation of philosophical currents such as Marxism, Phenomenology, Existentialism, Structuralism, and Post-Modernism, the past century was, without any doubt, fascinating from the intellectual point of view. Jesuits such as Karl Rahner, Frederick Copleston, Bernard Lonergan, William Norris Clarke, John F. Kavanaugh, Teilhard de Chardin, Gaston Fessard, Jean Daniélou, Henri de Lubac, Michel de Certeau, Xavier Tilliette, Paul Valadier, Paweł Siwek, Ignacio Ellacuría, Francisco Taborda, Henrique de Lima Vaz and, in the Portuguese context, Diamantino Martins or Júlio Fragata, among many others, were able to engage different philosophical currents, problems and controversies of their times. Faithful to their long tradition of being present in the frontiers of thought, those Jesuits have engaged in a fruitful dialogue with these intellectual trends, offering relevant contributions to different ongoing debates. Within this context, the present volume recalls and discusses the philosophical contribution of some of the most prominent Jesuit protagonists of the intellectual interchange that took place in the 20th century. This volume also intends to celebrate the 75th anniversary of the Revista Portuguesa de Filosofia, which happens just before the inauguration of the Ignatian Year. Decreed by Father Arturo Sosa, the Superior General of the Society of Jesus, this celebratory Year will start on May 20, 2021, precisely 500 years after Ignatius of Loyola, the founder of the Jesuit Order, was wounded at the battle of Pamplona. We are happy that this volume could bring together outstanding specialists in the thought of some of the most prominent Jesuits philosophers of the last century, namely Paul Valadier, Paul Gilbert, Józef Bremer, Jacek Poznański, Alexander Maar, Patrick H. Byrne, M. Ross Romero, Carlos Alvarez, Hélio Pereira Lima, José Gama, Domingos Terra, Gabriel Flynn, Marie-Gabrielle Lemaire, José Sols Lucia, Lorena Zuchel Lovera, Pedro Pablo Achondo Moya, Enzo Solari, Massimo Borghesi, Mendo Castro Henriques, João Barbosa, and Dominique Lambert. In addition, in the celebration of the 100th anniversary of Júlio Fragata’s birth, Maria Teresa Fragata presents a memory of his life and thought. We hope that this volume may be useful to all those interested in the Jesuit philosophical tradition. Hopefully, it will stimulate scholars to pursue a fruitful and creative dialogue with contemporary philosophy, in the footsteps of the Jesuit philosophers featured here. In this brief commentary, however, I suggest that the conceptual thresholds of the meaningful learning give rise to a typical Boltzmann's weighting measure, which indicates astatistical verisimilitudeof quantum behavior in the human cognitive ensemble.

In this paper I identify a tension between the two sets of works by Kuhn regarding the genesis of the “new historiography” of science. In the first, it could be said that the change from the traditional to the new historiography is strictly endogenous. In the second, the change is predominantly exogenous. To address this question, I draw on a text that is considered to be less important among Kuhn’s works, but which, as shall be argued, allows some contact between (...) Kuhn’s two approaches via Koyré. I seek to point out and differentiate the roles of Koyré and Kuhn – from Kuhn’s point of view – in the development of the historiography of science and, as a complement, present some reflections regarding the justification of the new historiography. A proposal to allow prisoners to save their lives or to be eligible for commutation of sentence by donating kidneys for transplantation has been a subject of controversy in the Philippines. Notwithstanding the vulnerabilities associated with imprisonment, there are good reasons for allowing organ donations by prisoners. Under certain conditions, such donations can be very beneficial not only to the recipients but to the prisoners themselves. While protection needs to be given to avoid coercion and exploitation, overprotection has to be (...) avoided. The prohibition on the involvement of prisoners in organ transplantation constitutes unjustified overprotection. Under certain conditions, prisoners can make genuinely independent decisions. When it can be reasonably ascertained that they are able to decide freely, society should recognise an obligation to help them implement their decisions, such as when they intend to donate an organ as a way of asserting their religious faith and performing a sacrifice in atonement for their sins. This paper takes the view that compensated donation and altruism are not incompatible. In particular, it holds that the arguments against giving compensation stand on weak rational grounds: the charge that compensation fosters “commodification” has neither been specific enough to account for different types of monetary transactions nor sufficiently grounded in reality to be rationally convincing; although altruism is commendable, organ donors should not be compelled to act purely on the basis of altruistic motivations, especially if there are good reasons (...) to believe that significantly more lives can be saved and enhanced if incentives are put in place, and offering compensation for organs does not necessarily lead to exploitation—on the contrary, it may be regarded as a necessity in efforts to minimise the level of exploitation that already exists in current organ procurement systems. After more than 60 years, Shannon’s research continues to raise fundamental questions, such as the one formulated by R. Luce, which is still unanswered: “Why is information theory not very applicable to psychological problems, despite apparent similarities of concepts?” On this topic, S. Pinker, one of the foremost defenders of the widespread computational theory of mind, has argued that thought is simply a type of computation, and that the gap between human cognition and computational models may be illusory. In this (...) context, in his latest book, titled Thinking Fast and Slow, D. Kahneman provides further theoretical interpretation by differentiating the two assumed systems of the cognitive functioning of the human mind. He calls them intuition (system 1) determined to be an associative (automatic, fast and perceptual) machine, and reasoning (system 2) required to be voluntary and to operate logical-deductively. In this paper, we propose a mathematical approach inspired by Ausubel’s meaningful learning theory for investigating, from the constructivist perspective, information processing in the working memory of cognizers. Specifically, a thought experiment is performed utilizing the mind of a dual-natured creature known as Maxwell’s demon: a tiny “man–machine” solely equipped with the characteristics of system 1, which prevents it from reasoning. The calculation presented here shows that the Ausubelian learning schema, when inserted into the creature’s memory, leads to a Shannon-Hartley-like model that, in turn, converges exactly to the fundamental thermodynamic principle of computation, known as the Landauer limit. This result indicates that when the system 2 is shut down, both an intelligent being, as well as a binary machine, incur the same minimum energy cost per unit of information (knowledge) processed (acquired), which mathematically shows the computational attribute of the system 1, as Kahneman theorized. This finding links information theory to human psychological features and opens the possibility to experimentally test the computational theory of mind by means of Landauer’s energy cost, which can pave a way toward the conception of a multi-bit reasoning machine. No debate teórico sobre a empatia, há uma recente renovação do interesse pelo modelo husserliano. Após uma análise prévia sobre o lugar da empatia na fenomenologia transcendental, propõe-se uma investigação sobre como Husserl desenvolveu sua perspectiva, a partir de dois textos, em especial, nas Ideias II (Hua 4) e na Fenomenologia da Intersubjetividade (Hua 13, 14 e 15). Avalia-se inicialmente, nas Ideias II, qual é o papel da empatia, na constituição da realidade anímica. Em seguida, propõe-se, a partir da Fenomenologia (...) da Intersubjetividade, uma análise sobre como Husserl desenvolveu os argumentos da apercepção analógica e do emparelhamento originário. A noção de emparelhamento surge por volta de 1927, em conexão com os estudos de Husserl sobre a síntese passiva e o aprofundamento sobre a fenomenologia genética. A fenomenologia da empatia torna-se, para Husserl, o fundamento de uma monadologia “com janelas”. (shrink)

Disasters and public health emergencies raise a variety of ethical dilemmas, often including those that require balancing the best interests of individuals against those of groups or communities. The on-going COVID-19 pandemic provides examples of these ethical conflicts, as do other recent outbreaks. Decisions and actions in this context must address different ethical issues, ranging from those directly related to autonomy, consent, privacy and confidentiality to those related to interventions and technologies, such as efficacy, effectiveness, safety and fair access. This (...) paper aims to identify ethical conflicts with complex resolutions involving aspects related to values, rights and needs of individuals and the collective, and to suggest how such challenges could lead to more positive experiences and outcomes when confronted in future emergencies. Para ilustrar a problemática faz-se um recorte numa pesquisa etnográfica com nove meses de duração e acompanha-se uma “saída fotográfica”, uma passeio urbano de fotógrafos, transcorrido na noite da Trasladação, (...) que antecede a realização do Círio de Nazaré, em Belém. Using a fair allocation approach, this paper identifies and examines important concerns arising from the Philippines’ COVID‐19 response while focusing on difficulties encountered by various sectors in gaining fair access to needed societal resources. The effectiveness of different response measures is anchored on addressing inequities that have permeated Philippine society for a long time. Since most measures that are in place as part of the COVID‐19 response are meant to be temporary, these are unable to resolve the inequities that have (...) led to the magnitude of morbidity and mortality associated with the pandemic. These cannot improve the country’s readiness to deal with pandemics and other emergencies in the future.Transition to a new normal recognizes the possibility that other infectious diseases could come and endanger our health security. Our pandemic experiences are proving that having an egalitarian society will serve the interests not only of disadvantaged sectors but also of everybody else, including the privileged. Response measures should thus take the opportunity to promote equity by giving importance to the concerns of the underprivileged and vulnerable while giving preference to initiatives that can be sustained beyond the period of the current pandemic. Despite the importance of the “historiographical revolution” in Kuhn’s work, he did not carry out a specific study about it. Without a systematic investigation into it, he even affirms that the “old” historiography of science (OHS) is unhistorical, suggesting its summary disqualification in the face of his “new historiography” of science (NHS). My wider project, of which this paper is a part, is to better discuss the issue of the justification of the NHS. In this paper, I discuss the justification (...) (and the genesis) of the OHS, focusing on Condorcet and Comte and resorting especially to Koyré. This will allow us to understand that the relation between the OHS and the NHS is a new instance of inter-theoretical incommensurability. And, indeed, that the NHS is not stricto senso a new historiography. It is the same historiography used for other disciplines (art, philosophy), which in the twentieth century begins to be applied to science as well. (shrink)

Taking for granted that Marx’s economic theory enjoys a scientific status and, furthermore, that it installed a real Copernican revolution in sociology, the present paper explores the possibility of deriving a system of law deserving the name of “scientific” in so far as it would be in keeping with the theses of the latter scientific theory. In this context, the paper argues against a claim recently sustained by Fernández Liria and Alegre Zahonero, for whom a system of right compatible with (...) Marx’s theory would be compatible, too, with the classic juridical formulations conceived during the Enlightenment. The main reason why this paper testifies against such compatibility is that the enlightened concepts of “equality”, “liberty” and “autonomy” count with the individual as the realm for their juridical application. However, Marx’s subject matter being the social means of production (and not the individuals’ production of value), we conclude that the only juridical subject that could justifiably be derived from his economic investigation would be the “social class”. Finally, the paper suggests that the only way a scientific system of law could grant a juridical status to the individual would be by taking into account the other theory that also installed a Copernican revolution in the social sciences, though this time in the field of psychology: Freud’s psychoanalysis. The iconoclastic Brazilian anthropologist and theoretician Eduardo Viveiros de Castro, well known in his discipline for helping initiate its “ontological turn,” offers a vision of anthropology as “the practice of the permanent decolonization of thought.” After showing that Amazonian and other Amerindian groups inhabit a radically different conceptual universe than ours—in which nature and culture, human and nonhuman, subject and object are conceived in terms that reverse our own—he presents the case for anthropology as the study of such “other” (...) metaphysical schemes, and as the corresponding critique of the concepts imposed on them by the human sciences. Along the way, he spells out the consequences of this anthropology for thinking in general via a major reassessment of the work of Claude Lévi-Strauss, arguments for the continued relevance of Deleuze and Guattari, dialogues with the work of Philippe Descola, Bruno Latour, and Marilyn Strathern, and inventive treatments of problems of ontology, translation, and transformation. Resumen Como es muy conocido, Frege afirmó que la expresión ‘el concepto caballo’ se refiere a un objeto y no a un concepto. En este artículo, en primer lugar, mostramos cómo hay algunos barruntos de esta paradoja en textos anteriores a 1891. En segundo lugar, revisamos algunos argumentos que defienden que con el término ‘el concepto caballo’ Frege se refería a la extensión del mencionado concepto. Por último, sostendremos que, aun cuando el concepto caballo sea dicha extensión, es muy poco (...) lo que sabemos de su naturaleza. Esto último se debe a la forma fragmentaria en que Frege introduce las extensiones de concepto en los Grundgesetze y en ensayos previos.As is well known, Frege stated that the expression ‘the concept horse’ refers to an object and not to a concept. In this article we firstly show how there are some hints of this paradox in texts prior to 1891. Secondly we review some arguments given in the literature to hold that with ‘the concept horse’ Frege referred to the extension of the mentioned concept. Is there an Asian Bioethics? Some people might consider it blasphemous even to ask this question. But this paper asks it not so much to seek an answer as to clarify what it could actually mean. The idea is to sort out the presuppositions and possible implications of asserting the existence of an Asian bioethics. In the end, this paper makes the following points: (1) In the attempt to assert an Asian identity, one must be careful not to commit the (...) mistake of universalizing (among Asians) a single Asian perspective; and (2) In the face of pluralism and multi‐culturalism, there is some room for a kind of universalist ethics that is founded on a collage of culturally inspired perspectives rather than on a single standard of morality. El pasaje de la Elegía de Gray (PEG) en “On Denoting” es extremadamente obscuro y ha sido objeto de muy diversas interpretaciones. Aparentemente contiene una crítica devastadora contra la teoría de los conceptos denotativos que el propio Russell había postulado en The Principles of Mathematics (PM) (1903). En este artículo exponemos sucintamente dicha teoría semántica, examinamos detalladamente el pasaje en cuestión y exploramos algunas de las interpretaciones que pretenden desentrañar su sentido. Con ello mostramos, en primer lugar, que la crítica (...) se dirige directamente contra la teoría de PM; en segundo lugar, que no es posible hacer unos pocos cambios homogéneos para habilitar una lectura literal del pasaje; finalmente, que, si bien algunos de los argumentos que los intérpretes han aducido para abandonar la teoría de los conceptos denotativos son sólidos, no es obvio que todos ellos se encuentren en PEG. À paideia exaustivamente investigada por Werner Jaeger é imposta a interpretação do próprio Heidegger e de Danielle Montet. Enquanto a arete é reexaminada através de uma nova luz lançada pela obra de António Caeiro. Enfim, devidamente preparado pelo pensamento inusual destes pensadores sobre paideia e arete, se reabre o debate sobre a possibilidade ou não da virtude ser ensinada. (...) Concluímos com Sócrates que definitivamente ela não pode ser ensinada, não ao modo pretendido dos sofistas e dos “modernos” pensadores e educadores, mas que sim há certamente possibilidade de uma “paideia da arete”. O artigo de Keith S. Donnellan “Reference and Definite Descriptions” (1966) foi escrito com a intenção de mostrar que as teorias de Bertrand Russell e Peter F. Strawson falham por igual em capturar o uso linguístico efetivo das descrições definidas. Contudo, situação se complica para Donnellan à luz do fato de que muitos usos concebíveis de descrições definidas não parecem caber em nenhuma das duas categorias. Há usos que devem ser entendidos antes como motivados pela deferência do que como atributivos, (...) assim como há usos em que variadas falências referenciais cometidas pelos falantes têm como consequência situações em que a descrição simplesmente não dá conta da variedade de possibilidades, vale dizer, casos em que não cabe falar nem em uso referencial nem em uso atributivo. A razão para tanto parece ser a de que dificilmente há um uso atributivo “puro”. As descrições usadas nos exemplos corriqueiros contêm normalmente elementos referenciais, como nomes e indexicais. Quando estes são mal empregados, a insuficiência da distinção de Donnellan é exposta. A segunda tese aqui apresentada é a de que os usos atributivos previstos no artigo clássico de Donnellan se caracterizam por sua natureza inferencial distintiva, com a consequência de que o seu uso atributivo é em geral menos natural e plausível do que o uso referencial. Different theoretical approaches highlight the growing relevance of corporate reputation as strategic factor. Among these approaches the arguments of the Resource-Based View are special worthwhile (Grant, 1991, California Management Review 33(3), 114–135; Barney, 1999, Sloan Management Review Spring, 137–145). Nevertheless, this topic poses several methodological problems (Barney et al., 2001), as the unavailability to identify and measure this organizational factor, that is “socially complex” and intangible in its nature. In this work, using the findings of our empirical research on Spanish (...) biotechnology firms, we carry out an identification and measurement of corporate reputation, highlighting its two key components: “business reputation” and “social reputation”. A patient’s age serves as a very useful guide to physicians in deciding what disease manifestations to anticipate, what treatment to offer for certain conditions, and how to prepare for possible emergencies. In the context of the COVID-19 pandemic, determining treatment options on the basis of a patient’s chronological age can easily give rise to unjustified discrimination. This is of particular significance in situations where the allocation of scarce critical care resources could have a direct impact on who will live (...) and who will die. This paper examines the fairness of recommendations contained in resource allocation guidelines in the Philippines that have implications for the way elderly patients could be treated or excluded from some forms of critical care treatment in the context of the ongoing Corona virus emergency. Despite the unquestionable importance of technological progress in twenty-first-century society, the decision by many political leaders worldwide to treat natural sciences as an almost exclusive priority betrays a terrible misconception of the complexity of the contemporary world. As the Renaissance cannot be reduced to Copernicus’s or Galileo’s brilliant contributions, or Enlightenment to the works of such giants as Newton and Cavendish, contemporary society will hardly be remembered as just a series of amazing software and gadget updates. There are three categories (...) of questions today that only humanities are prone to answer. The first one, exploring the relations between subject and object mediated by the meaning of “property”, ultimately concerns the discussion between legality and legitimacy. Not long ago, teenagers were still being sued by the giants of the Entertainment Industry for downloading songs, and the practice of mash-ups or remixing even now arouses huge polemics. The second one, focused on the self-representations of the subject, concerns the changing meanings (and representations) of identity and cultural borders in a globalizing world. Finally, the inter-subjective interactions are the centre of the political tensions between democracy and demagogy, two opposed categories that have often been presented as hardly distinguishable from each other. This essay reexamines the four-principle approach to biomedical ethics in the context of ethics education in general and in relation to possible ethics discourse within a community of inquiry in particular. A community of inquiry is the setting for learning and education in philosophy for children. This community enables children to acquire critical thinking and other skills as part of democratic education. The use of the four principles approach tends to contribute to a practice that limits critical thinking skills because (...) of the constraints on the conceptual tools that tend to be used. It has also had the effect of promoting conceptual ambiguity by encouraging the use of limited conceptual molds, thus giving rise to the possibility of multiple interpretations among diverse users, especially in the field of global bioethics. While recognizing the continuing appeal of the approach as a conceptual tool for ethical decision-making the essay brings out the limitations that need to be overcome in order to promote the clarity that the four principles approach is meant to possess. Escrito em 1703, no ano anterior à morte de John Locke, este breve ensaio nos fornece uma visão das concepções pedagógicas maduras de Locke, que de certa forma complementam aquilo que podemos depreender da leitura dos seus “Alguns Pensamentos sobre a Educação”, obra datada de 1693. Estritamente ancorado nas concepções empiristas de Locke, este último tratado se ocupa da educação da criança e de sua relação com os pais ou, alternativamente, os preceptores. O texto que o leitor tem em mãos, (...) por seu turno, destina-se a não a educadores de crianças mas ao homem – ou, mais precisamente, ao “cavalheiro” (gentleman) inglês sequioso de obter uma boa educação. De caráter eminentemente prático, os conselhos de Locke aqui não se baseiam fundamentalmente nas suas teorias epistemológicas mas antes na sua vasta experiência como um homem de cultura e um homem do mundo, bem versado nas artes da política e da diplomacia. Nunca é demais enfatizar que a contribuição de Locke para o sucesso da Revolução Gloriosa, de 1688, não foi puramente teórica. Locke participou da conspiração que depôs Jaime II e levou ao trono Guilherme de Orange. (shrink)
