I critique Matthias Steup’s account of exercising direct voluntary control over coming to have doxastic attitudes via doxastic decisions. I show that the sort of agency Steup argues is exercised in doxastic decision-making is not sufficient for agents to exercise direct voluntary control over their doxastic attitudes. This counts against such putative decisions being the locus of direct control in doxastic agency. Finally, I briefly consider what, if any, consequences the failure of Steup’s theory of doxastic agency may have for (...) epistemic deontologism. (shrink)

Social conventions are those arbitrary rules and norms governing the countless behaviors all of us engage in every day without necessarily thinking about them, from shaking hands when greeting someone to driving on the right side of the road. In this book, Andrei Marmor offers a pathbreaking and comprehensive philosophical analysis of conventions and the roles they play in social life and practical reason, and in doing so challenges the dominant view of social conventions first laid out by David (...) Lewis. Marmor begins by giving a general account of the nature of conventions, explaining the differences between coordinative and constitutive conventions and between deep and surface conventions. He then applies this analysis to explain how conventions work in language, morality, and law. Marmor clearly demonstrates that many important semantic and pragmatic aspects of language assumed by many theorists to be conventional are in fact not, and that the role of conventions in the moral domain is surprisingly complex, playing mostly an auxiliary and supportive role. Importantly, he casts new light on the conventional foundations of law, arguing that the distinction between deep and surface conventions can be used to answer the prevalent objections to legal conventionalism. Social Conventions is a much-needed reappraisal of the nature of the rules that regulate virtually every aspect of human conduct. (shrink)

In some recent work on omissions, it has been argued that the causal theory of action cannot account for how agency is exercised in intentionally omitting to act in the same way it explains how agency is exercised in intentional action. Thus, causalism appears to provide us with an incomplete picture of intentional agency. I argue that causalists should distinguish causalism as a general theory of intentional agency from causalism as a theory of intentional action. Specifically, I argue that, while (...) intentional actions may best be understood as the causal products or outcomes of causings, we should identify exercises of intentional agency with causal processes. With a causalist account of intentional agency sketched, I respond to the challenge to causalism from omissions. I argue that when an agent intentionally omits there is a causal process that has a zero-sum outcome. But the causal process is sufficient to make it true that the agent exercises intentional agency in intentionally omitting. (shrink)

In recent years, there has been a growing interest in epistemic agency among philosophers. This development is in part owing to a growing interest in mental agency and epistemic normativity, along with associated concepts such as epistemic responsibility and the relationship between epistemic rationality and practical rationality. Most authors have focused solely on our agency exercised in the process of acquiring or forming beliefs in response to reasons. But some have examined temporally extended procedural epistemic agency, in particular our agency (...) exercised in the process of inquiry. In this article, I argue for an account of procedural epistemic normativity grounded in a conception of the constitutive aim of inquiry. In doing so I will examine how an account of the constitutive aim of inquiry may both differ from and be like accounts of the constitutive aim of belief and the constitutive aim of intentional action. I propose that the constitutive aim of inquiry is understanding and that the aim of understanding may provide us with the norms of inquiry. (shrink)

Mainstream political liberals hold that state coercion is legitimate only if it is justified on the grounds of reasons that all may reasonably be expected to accept. Critics argue that this public justification principle is self-defeating, because it depends on moral justifications that not all may reasonably be expected to accept. To rebut the self-defeat objection, I elaborate on the following disjunction: one either agrees or disagrees that it is wrong to impose one’s morality on others by the coercive power (...) of the state. Those who disagree reject PJP, they understand politics as war. Those who agree accept PJP, they understand politics as competition. Political competitors abide by PJP to avoid politics as war, by enforcing PJP on political combatants they engage in a war that is unavoidable. In both cases their exercise of political power has a justification that is reasonably acceptable to all. (shrink)

This Element focuses on some core conceptual and ontological issues related to pantheistic conceptions of God by engaging with recent work in analytic philosophy of religion on this topic. The conceptual and ontological commitments of pantheism are contrasted with those of other conceptions of God. The concept of God assumed by pantheism is clarified and the question about what type of unity the universe must exhibit in order to be identical with God receives the most attention. It is argued that (...) the sort of unity the universe must display is the sort of unity characteristic of conscious cognitive systems. Some alternative ontological frameworks for grounding such cognitive unity are considered. Further, the question of whether God can be understood as personal on pantheism is explored. (shrink)

ABSTRACT: Defending the distinction between believing and accepting a proposition, I argue that cases where agents allegedly exercise direct voluntary control over their beliefs are instances of agents exercising direct voluntary control over accepting a proposition. The upshot is that any decision to believe a proposition cannot result directly in one’s acquiring the belief. Accepting is an instrumental mental action the agent performs that may trigger belief. A model of the relationship between acceptance and belief is sketched and defended. We propose that human reasoning relies on an inherence heuristic, an implicit cognitive process that leads people to explain observed patterns (e.g., girls wear pink) in terms of the inherent features of their constituents (e.g., pink is an inherently feminine color). We then demonstrate how this proposed heuristic can provide a unified account for a broad set of findings spanning areas of research that might at first appear unrelated (e.g., system justification, nominal realism, is–ought errors in moral reasoning). By revealing (...) the deep commonalities among the diverse phenomena that fall under its scope, our account is able to generate new insights into these phenomena, as well as new empirical predictions. A second main goal of this paper, aside from introducing the inherence heuristic, is to articulate the proposal that the heuristic serves as a foundation for the development of psychological essentialism. More specifically, we propose that essentialism—which is the common belief that natural and social categories are underlain by hidden, causally powerful “essences”—emerges over the first few years of life as an elaboration of the earlier, and more open-ended, intuitions supplied by the inherence heuristic. In the final part of the paper, we distinguish our proposal from competing accounts (e.g., Strevens' K-laws) and clarify the relationship between the inherence heuristic and related cognitive tendencies (e.g., the correspondence bias). In sum, this paper illuminates a basic cognitive process that emerges early in life and is likely to have profound effects on many aspects of human psychology. (shrink)

. The purpose of this essay is to argue that considerations of fairness play an essential role in the justification of democratic decision procedures. The first part argues that considerations of fairness form part of a practical authority's legitimacy, and that in the political context, those considerations of fairness entail a principle of equal distribution of political power. Subsequently, the article elaborates on the kind of equality which is required in democratic procedures, arguing that different principles of equality should apply (...) to the deliberation and the decision stages of democracy. Finally, the article concludes with a few sketchy remarks on the possible relations between considerations of fairness and soundness of democratic procedures. (shrink)

ExcerptI remember it well. It was in the spring of 1987 when I commenced my lecture in Osnabrück on the German left with these remarks: “So that we understand each other: Regardless of my heavy criticisms and profound objections to many facets of its current affairs, I fully accept the existence of the Federal Republic of Germany and do not want its destruction!” People looked at me as if I had lost my mind!

The “Mind Matters” case study presents an opportunity for students in a wide range of courses such as business ethics, organizational behavior, leadership, marketing, and strategy to recognize and contemplate the difficult planning, the ethical challenges, and the high level of creativity necessary in many business decisions when bringing a new product or service to market. Also, this case study encourages its readers to formulate solutions and provide answers for complexproblems fraught with ethical dilemmas.

When the traditional distinction between a mathematical concept and a mathematical intuition is tested against examples taken from the real history of mathematics one can observe the following interesting phenomena. First, there are multiple examples where concepts and intuitions do not well fit together; some of these examples can be described as “poorly conceptualised intuitions” while some others can be described as “poorly intuited concepts”. Second, the historical development of mathematics involves two kinds of corresponding processes: poorly conceptualised intuitions are (...) further conceptualised while poorly intuited concepts are further intuited. In this paper I study this latter process in mathematics during the twentieth century and, more specifically, show the role of set theory and category theory in this process. I use this material for defending the following claims: (1) mathematical intuitions are subject to historical development just like mathematical concepts; (2) mathematical intuitions continue to play their traditional role in today's mathematics and will plausibly do so in the foreseeable future. This second claim implies that the popular view, according to which modern mathematical concepts, unlike their more traditional predecessors, cannot be directly intuited, is not justified. (shrink)

An account of what sort of causal integration is necessary for an agent to exercise agency is offered in support of a soft-line response to Derk Pereboom’s four-case argument against source-compatibilism. I argue that, in cases of manipulation, the manipulative activity affects the identity of the causal process of which it is a part. Specifically, I argue that causal processes involving direct manipulation fail to count as exercises of intentional agency because they involve heteromesial causal deviance. In contrast, standard deterministic (...) causal processes do not involve heteromesial causal deviance and are agency-preserving. The upshot is that there is a relevant difference between a causal process involving direct manipulation by another agent and a deterministic causal process that involves no such intervention. If this is right, then Pereboom’s four-case argument does not pose a threat to source-compatibilist theories of free will and moral responsibility. (shrink)

In this article I want to support a certain conception of legal authority. The question I want to address is this: Is it possible to attribute legal authority to a given norm if its authority does not derive from the authority of someone who has issued that norm? Basically, I will try to defend here a negative answer to this question, espousing a personal conception of authority.

In Philosophy of Law, Andrei Marmor provides a comprehensive analysis of contemporary debates about the fundamental nature of law—an issue that has been at the heart of legal philosophy for centuries. What the law is seems to be a matter of fact, but this fact has normative significance: it tells people what they ought to do. Marmor argues that the myriad questions raised by the factual and normative features of law actually depend on the possibility of reduction—whether the legal (...) domain can be explained in terms of something else, more foundational in nature. In addition to exploring the major issues in contemporary legal thought, Philosophy of Law provides a critical analysis of the people and ideas that have dominated the field in past centuries. In a recent article in this journal, John Bishop argues in defence of conceiving of Christian faith as a ‘doxastic venture’. That is, he defends the claim that, in exercising faith, agents believe beyond ‘what can be established rationally on the basis of evidence and argument’. Careful examination reveals that Bishop fails adequately to show that faith in the face of inadequate epistemic reasons for believing is, or can even be, a uniquely doxastic venture. I argue that faith is best (...) conceived of as a sub-doxastic venture that involves pragmatically assuming that God exists. (shrink)

Following the pioneering work of David Lewis, many philosophers believe that the rationale of following a convention consists in the fact that conventions are solutions to recurrent coordination problems. Margaret Gilbert has criticised this view, offering an alternative account of the nature of conventions and their normative aspect. In this paper I argue that Gilbert's criticism of Lewis and her alternative suggestions rest on serious misunderstandings. As between these two opposed views, Lewis's is closer to the truth, but I argue (...) only with respect to one type of convention. There is another, important type of conventions, whose normativity does not consist in the solution of coordination problems. The validity of conventions constituting (what I call) autonomous practices can only be derived from the values inherent in the practices they constitute and those values cannot be specified independently of the conventions themselves. We obtain an equivalent implicit characterization of Lp Banach spaces that is amenable to a logical treatment. Using that, we obtain an axiomatization for such spaces into a higher order logical system, the kind of which is used in proof mining, a research program that aims to obtain the hidden computational content of mathematical proofs using tools from mathematical logic. As an aside, we obtain a concrete way of formalizing Lp spaces in positive-bounded logic. The axiomatization is followed by a (...) corresponding metatheorem in the style of proof mining. We illustrate its use with the derivation for this class of spaces of the standard modulus of uniform convexity. (shrink)

Many powers-realists assume that the powers of objects are identical with the dispositions of objects and, hence, that ‘power’ and ‘disposition’ are interchangeable. In this article, I aim to disentangle dispositions from powers with the goal of getting a better sense of how powers and dispositions relate to one another. I present and defend a modest realism about dispositions built upon a standard strong realism about powers. In this paper I discuss appeals to nature, a particular kind of argument that has received little attention in argumentation theory. After a quick review of the existing literature, I focus on the use of such arguments in the public controversy over the acceptabil-ity of genetically-modified organisms in the food industry. Those who reject this biotechnology invoke its unnatural character. Such arguments have re-ceived attention in bioethics, where they have been analyzed by distinguishing different meanings that “nature” and “natural” might (...) have. I argue that in many such appeals to nature the main deficiency of these arguments is semantic, in particular, that these words cannot be assigned a determi-nate meaning at all. In doing so, I rely on semantic externalism, a widely accepted theory of linguistic meaning. (shrink)

The author of the article turns to the modern discourse about man and his place in the humanities system. A retrospective analysis of the modern discourse about man allows us to distinguish three stages in its development: anti-humanism, anti-anthropology and post-anthropology. Despite the fact that the main topics around which he is focused are concentrated on criticism of "anthropocentrism" and "eurocentrism", the author concludes that the anti-anthropological narrative retains all the features of cultural and epistemological "narcissism". The anti-anthropological narrative continues (...) to function as a system of "recognizing oneself", as a system of "differentiating oneself and the other" and as a system of "justifying oneself through the other". In this short review I present my personal reflections on Zeilinger–Brukner information interpretation of quantum mechanics.In general, this interpretation is very attractive for me. However, its rigid coupling to the notion of irreducible quantum randomness is a very complicated issue which I plan to address in more detail. This note may be useful for general public interested in quantum foundations, especially because I try to analyze essentials of the information interpretation critically. This review is written in non-physicist friendly manner. Experts (...) actively exploring this interpretation may be interested in the paper as well, as in the comments of “an external observer” who have been monitoring the development of this approach to QM during the last 18 years. The last part of this review is devoted to the general methodology of science with references to views of de Finetti, Wigner, and Peres. (shrink)

There is a commonly held endoxon that idealism did not exist and could not exist before Plato, since the «Presocratics» did not yet distinguish between the material and the ideal etc. This preconception is based on the misleading conception of «Presocratics» as physicalists and the simplistic evolutionist scheme of Aristotle’s Metaph. A. In fact, religious and idealist metaphysics are attested in different archaic traditions before Plato, whereas «simple» physical theories of elements of the Milesian type did not exist before (...) the 6th century B.C. scientific revolution. 2. Those who deny the existence of idealism in Greek philosophy commonly refer to Myles F. Burnyeat. We will argue against this article on the following grounds: a) it is based on a selective and incomplete data from early Greek philosophy, b) Burnyeat understands by «idealism» subjective idealism and anti-realism. But Greek idealism as a rule is a form of objective idealism and has nothing to do with anti-realism. The two basic forms are: dualstic idealism and monistic idealism. 3. We will argue against modern naturalist interpretations of the Pythagorean first principles by Huffmann and others. Both in the table of opposites and in Philolaus πέρας καὶ ἄπειρον denote self-subsistent mathematical essences, ‘out of which’ physical bodies are composed. It is impossible to interpret “the limit and the unlimited” as physical bodies themselves or as properties of physical bodies. 4. We will argue for the Pythagorean origin of the 5th centu-ry graffiti on bones’ plates from Olbia. According to this early table of oppo-site, the body is ψεῦδος, i.e., an illusion. 5. The Zeller-Burnet interpretation of Parmenides B3 is grammatically impossible. The fragment states the identity of νοεῖν καὶ εἶναι, i.e., affirms mental nature of Being.6.The basic opposition of Parmenides’ Aletheia exactly corresponds to the basic opposition of doxa. Light is the active and thinking element, night is the «heavy», dense, corporeal substance. Sine light corresponds to Being, night corresponds to non-Being. The philosophy of Parmenides is a radical form of immaterialism and idealistic monism. (shrink)

The target article is an elegant synthesis of the developmental and functional data and views on the evolutionary origin of the mammalian isocortex, integrating results from cell and molecular biology, experimental neuroanatomy, and chemoarchitectonic studies. Complementarily, we give here an account of two modes of isocortical evolution (prosomere reshuffling and invention) in terms of costs of radiation and neural tissue.

This article argues that, given the current pervasive uncertainty about the reliability of jury deliberation, we ought to treat it with epistemic humility. I further argue that epistemic humility should be expressed and enforced by turning jury deliberation from a mandatory rule of the jury trial to a waivable right of the defendant. I consider two main objections to my argument: the first one concerns the putative self-defeatingness of humility attitudes; the second objection points to the burdensomeness of granting an (...) unconditional jury deliberation waiver to the defendant. In addition to the “universal glue,” which is the local mechanical causation, the standard explanatory scheme of classical science presumes two “universal vessels,” which are global space and time. I call this outdated metaphysical setting “black-and-white” because it allows for only two principal scales. A prospective metaphysics able to bind existing sciences together needs to be “colored,” that is, allow for scale relativity and diversification by domain.

The research into the typical behavioral pattern, motivational structure, and the value system of psychopaths can shed light on at least three aspects related to the analysis of the moral agency. First, it can help elucidating the emotive and cognitive conditions necessary for moral performance. Secondly, it can provide empirical evidence supporting the externalist theories of moral motivation. Finally, it can bring into greater focus our intuitive notion of the limits of moral responsibility. In this paper I shall concentrate on (...) the last one—the question of responsibility of the amoralists, but the discussion will have an indirect bearing on the other two themes as well. My main reason for holding psychopaths morally responsible breaks down into two claims: the assumption that most ordinary people are morally responsible for their intentional actions and the denial that the psychopaths are qualitatively different from the non-psychopaths. This thesis is further defended against two objections. First, I am arguing that the genetically based emotive deficiency of the psychopaths cannot be seen the factor condemning them to amoral existence, and thus cannot be cited as an exempting condition. Secondly, my position is defended against the claim that psychopaths are partly responsible for their actions. It is argued that the notion of partial responsibility is either incoherent or else rests on a false empirical premise. My conclusion is in agreement with, and provides a theoretical justification for, the position of most classifications of the persons with antisocial personality disorder in the DSM IV. (shrink)
