Résumé Comment une histoire matérielle de l’abstraction peut-elle servir l’histoire intellectuelle ou bien l’histoire des sciences, cela à l’encontre de l’histoire des idées et des généalogies rétrospectives? L’objet est ici l’œuvre de connaissance telle qu’elle est ancrée dans son cadre historique. Cette histoire intellectuelle déborde les coupes disciplinaires. L’article en offre plusieurs exemples qui partent de la recherche de différenciations explicables entre des pratiques intellectuelles d’abstraction. Une séquence s’ouvre alors avec l’émergence d’une conception, puis la formation de théories et finalement (...) la consolidation d’un corpus de choses tenues pour évidentes. In this paper we examine the genealogy and transmission of moral duty in Western ethics. We begin with an uncontroversial account of the Stoic notion of the kathēkon, and then examine the pivotal moment of Cicero’s translation of it into Latin as ‘officium’. We take a deflationary view of the impact of Cicero’s translation and conclude that his translation does not mark a departure from the Stoic ideal. We find further confirmation of our deflationary position in the development of the (...) notion of ‘duty’ in Germany between the 16th and 18th centuries. We examine Pufendorf’s critique of ancient eudaimonism and his appropriation of officium, and claim that it foreshadows Kant’s rejection of Garve’s Ciceronian ethics. We demonstrate the undeniable parallels between Kant’s Groundwork and Garve’s influential translation of Cicero’s De Officiis, thereby indicating a novel way in which we should understand Cicero’s contribution to the development of modern moral philosophy. Many of our ideological, political, moral, religious, aesthetic, scientific beliefs, as well as those concerning everyday life, are controversial; other people do not share them. As a rule, that does not bother us much: we tend to retain our contestable beliefs even if we ascribe no less skill and well-informedness to those who represent other points of view than to ourselves. But is that really reasonable? Shouldn't we often admit that we might be as wrong as others? And if we (...) do, shouldn't this consequently lead us to give up many of our beliefs in favor of agnostic attitudes? Marc Andree Weber argues that in the face of disagreement with equally competent and well-informed interlocutors we should almost always refrain from insisting on our controversial beliefs – with the few exceptions being all the more remarkable. Kant’s postulate of the immortality of the soul has received strikingly little attention among Kant scholars, and only very few have regarded it positively. This is not surprising given the numerous problems associated with his argument. However, it is not the only argument for immortality that Kant offers in his critical philosophy. There is also a second argument that differs from the one furnished in the Second Critique and can be found both in the Critique of Pure Reason and later (...) texts from the 1790s. Kant also addresses here many of the problems that interpreters have found with his postulate of immortality in both earlier and later texts. This paper considers the main difficulties associated with the postulate and proposes a coherent interpretation of Kant’s argument. I show that despite the apparent change in his approach to immortality Kant did not in fact substantially alter his position during his critical period. (shrink)

When adopted in 1991, the French Loi Evin was pioneering as one of the first in the world to regulate alcohol marketing as extensively. This short contribution assesses whether it remains fit for purpose over 30 years later. To this effect, it assesses its main provisions, considers the legislative amendments that have ensued as well as the extensive interpretation French courts have given of its scope, before concluding that the prospects for its revisions are limited in the near future.

Face à l'histoire de Jésus, l'époque moderne se place sous la question de sa possibilité même. Au sortir de la Renaissance, marquée par un intérêt nouveau sur le texte saisi dans son ensemble, l'Écriture, dans sa suite narrative, reprenait sens sans se ployer devant la théologie. S'imposait alors le décalage entre le texte biblique reconnu dans ses multiples manuscrits, et l'affirmation des Églises. Ainsi, dès le XVIII° siècle, la distance ne pourra que se creuser entre les Églises qui désignent le (...) Christ qu'elle honorent et l'histoire que les rationnels entendent construire , ce qui n'ira pourtant pas sans délires d'imagination, surtout au XIX° siècle. Paradoxalement, la lecture suivie de la Bible en langue vulgaire, largement promue par les Réformateurs et finale­ment acceptée chez les catholiques après les hésitations du Concile de Trente, devenait parfois gênante sinon dangereuse, ce qui ne pouvait qu'être confirmé par les différentes tentatives, parfois contradictoires, pour saisir le jésus de l'histoire jusqu'à nier son existence.In face of the history of Jesus, modern times raises the question of its very possibility. At the end of the Renaissance, which was marked by a new interest in the text taken in its entirely, Scripture, in its narrative succession, again found meaning without giving way before theology. Then, the lag between the biblical text accepted in its multiple manuscripts and the affirmation of the Churches became evident. Thus, from the 18th century, the distance increased between the Churches that designated the Christ that they honored and the history that the rationalists meant to construct «the Jesus of history »). This did not happen, however without frenzies of imagination, especially in the 19th century. Paradoxically, the continuous reading of the Bible in the vernacular largely promoted by the reformers and finally accepted by Catholics after hesitations by the Council of Trent, sometimes became embarrassing if not dangerous. This was confirmed by different attemps, sometimes contradictory, to understand the Jesus of history to the point of denying his existence. (shrink)

On July 2021, the UK High Court of Justice heard the Case CO/2066/2020 on the application of Heidi Crowter who lives with Down’s syndrome, and Máire Lea-Wilson whose son Aidan has Down’s syndrome. Crowter and Lea-Wilson, with the support of the disability rights campaign, ‘Don’t Screen Us Out’, have been taking legal action against the Secretary of State for Health and Social Care (the UK Government) for a review of the 1967 Abortion Act: the removal of section 1(1)(d) making termination (...) of pregnancy lawful for ‘severe’ fetal indications detected after 24 weeks' gestation. On 23 September 2021, the High Court dismissed the claim. This action came at a time when non-invasive prenatal testing (NIPT) was introduced into the NHS England Fetal Anomaly Screening Programme for the trisomies 21, 13 and 18. The implementation of NIPT has been heavily criticised, in particular by ‘Don’t Screen Us Out’ campaigners, for increasing fetal selection and discrimination of people living with disabilities. The case of Crowter and Lea-Wilson echoes debates in other European countries such as in France and Germany, where the introduction of NIPT in the public healthcare system has provoked equally vehement public reactions and discussions. The comparison between these three countries allows contextualising the public discourses around NIPT and the ground for termination of pregnancy in relation to different socio-cultural and political contexts. We examine how each country, and particularly England, deals with the conflict between the principles of promoting the rights of people living with disabilities and preserving women’s reproductive autonomy. Die Zurückweisung, mit der viele frühneuzeitliche Autoren der aristotelischen Naturphilosophie begegnen, geht häufig mit einer emphatischen Aufnahme der hellenistischen Philosophie einher. Vor diesem Hintergrund fragt die vorliegende Untersuchung nach den prinzipiellen Unterschieden zwischen Aristoteles und seinen hellenistischen Nachfolgern. Ausgangspunkt ist die für die aristotelische Philosophie zentrale Analyse des Phänomens der Bewegung.

Andrée-Anne Cormier and Harry Brighouse explore the question of whether there are good reasons for schools to try and produce citizens disposed to use, and practiced in, civil discourse and behavior, and if so, what this implies for schools. First, the authors propose an account of the value (and disvalue) of civility, drawing on Cheshire Calhoun’s conception. They argue that civility is good in many circumstances, but not always. In some circumstances, it is neither beneficial nor morally required. Second, (...) they elucidate the reasons for teaching civility in schools and what they think that doing so would involve, what demands it would make on teachers, and how the aim of promoting civility would shape the structure of schools. Finally, they identify some reasons for pessimism that schools can be very successful in promoting civility. They do not think that these are conclusive reasons against teaching civility in schools, but they suggest that civility can only be taught well if educators are clear-eyed about the hurdles they will have to overcome. This paper examines the development of the modern concept of substance from Leibniz to Hegel. I will focus primarily on the problem of the inner and outer nature of substance. I will show that if one considers Hegel’s discussion of substance against the background of the controversy between Leibniz and Kant about the inner and outer nature of substance, it becomes clear that for Hegel both Leibniz and Kant grasped the whole concept of substance only partially and in its abstract (...) moments. This is because they both concentrate on one aspect of substance and absolutize it. Hegel, on the other hand, not only overcomes the fundamental difference between the inner and outer of substance, but also develops the connection between the different moments of substance, causality and interaction from the rationalist concept of substance itself. In the second half of the 18th century the voices criticizing the concept of simple substances as proposed by Leibniz and Wolff became increasingly louder. In response, Kant altered his theory of substances as first proposed in the 1750s. So for example, while his notion of substance in the Monadologia physica is simple and not merely in space, but fills space entirely, the Kantian position in the 1760s and early 1770s is quite different. This essay examines the solution Kant offers (...) in his Inaugural Dissertation for the problems raised by critics of simple substances. It shows how Kant removes substance from space and consequently from the empirical world and makes it into a concept of the understanding which leads to the knowledge of simple substances by employment of the pure understanding. During the past 25 years, the words “theory of action” and “agency theory” have become key-terms in a new branch of philosophy. The themes appear to gain a centrality and influence such that one is led to think that they should cover most of philosophy, including the foundation for all of the human sciences. The number of treatises on human action and on philosophical and special-scientific theories of action is staggering. For the most part inspired by analytic philosophy, the new (...) approach threatens to take over that school’s central place on the stage of international philosophical concern. Having ousted theory of science from that position with an avalanche of analytic studies, analytic philosophy, in turn, is now being overrun by philosophy of action as supposedly suitable basis for the sciences. With their landmark architectures, exhibitions and museums of science and technology partake in the spatial inscription of science in twentieth century landscapes. Unlike other beacons of progress, exhibitions and museums of science and technology double up, inside, as material arrangements of objects, visuals and texts aiming to confer meaning onto the modern world. They both embody and seek to order the spectacle of modernity while often being deployed with the aim of promoting particular visions of social and material progress. An (...) approach sensitive to the material, spatial, and experiential dimensions of displaying science and technology suggests that exhibitions and museums were in the twentieth century crucial sites for reflecting upon and promoting particular futures. This chapter argues that school should cease to be compulsory at age 16 and that an education resource account (ERA) should be established for students who leave school at that age. The ERA would be sufficient to cover three years of full-time education. It could be linked to inflation and early school leavers could use it in accredited non-profit educational institutions at any later point in their lives. Two sets of arguments are discussed in support of the proposal. The first, (...) building on the empirical literature, focuses on efficiency and highlights the advantages of an ERA with respect to the ‘disruptive’ students issue in particular. The second set of arguments is anti-paternalistic. The chapter distinguishes three anti-paternalistic arguments: the view that individuals are the best judges of their own welfare, the idea that autonomous decision-making is a component of well-being, and a respect-based view of what renders anti-paternalism wrong. This volume assesses the argument of Harry Brighouse and Adam Swift in their recent book, Family Values, taking up a number of controversial issues about autonomy, human flourishing, parental rights, and indeed the nature of childhood itself.

We comment on the preceding reviews of our book “ Memory Evolutive Systems ”, discussing the improvements proposed by some of the reviewers and answering to critics of others, in particular on the use of category theory for modeling living systems.

Already in antiquity the Aristotelian Philosophy was under attack by its philosophical opponents. The Stoics can surely be counted to the most important ones. Furthermore they can be regarded as one of the most influential philosophy schools of the Hellenistic time and in the early Roman Empire and their influenceeven on modern thinkers must not be neglected. It is well known that the Stoics not only advocated a physical monism but can also be described as determinists or, from a modern (...) point of view, even as compatibilists because they were the first who tried to harmonize moral responsibility with the thesis of a causal determinism. Therefore, the stoic concept of causality is of vast importance. In one of Seneca’s books a discussion of the Aristotelian theory of causality has come down to us. Although it is a quite short passage it proves itself to be very illuminating. This paper wants to shed light on the differences between the Aristotelian and the Stoic theory of causality and therefore help to clarify the historical background of the modern concept of causality which is of intense importance for the actual discussion about free will and determinism. The majority of current interpreters of Aristotle’s theory of perception assume that perception must be understood as a passive process. This assumption is mainly justified by systematic considerations. Particularly influential for the ongoing debate on the proper understanding of Aristotle’s theory is the work of Myles Burnyeat, whose interpretation amounts to a devastating critique of the Aristotelian philosophy of perception. This paper wants to shed some light on the kind of activity that is involved in perception. It will be shown (...) that by considering the special kind of activity with which Aristotle identifies perception many of the problems that are seen by Burnyeat and others can be circumvented and a coherent interpretation can be provided, which, in turn, must be considered to be essential in order to judge the systematic relevance of Aristotle’s theory of perception.
