In this article, I review A Theory of Legal Personhood, explaining what I see as its key contributions to animal law scholarship, while situating it against wider jurisprudential contributions that may be of interest to philosophers and legal scholars grappling with the oft-thorny idea of legal personhood, not just for nonhuman animals but for corporations, artificially intelligent machines, and late-term fetuses. The article will explain Kurki's “bundle” theory of legal personhood as a “cluster” concept and analyze the extremely helpful parsing (...) his theory provides in terms of the active and passive “incidents” of legal personhood. I focus much of the piece on Kurki's view of legal “nonpersons” who nonetheless have some rights or incidents of personhood in order to help clarify the challenge Kurki's theory raises for Steven M. Wise and the Nonhuman Rights Project, as the issues surrounding those litigation efforts will likely be familiar to readers here, who will be wondering how this theory interacts with what Wise seeks to achieve. Little has been studied on the relationship between affect and school problems related with attendance. This study aims to identify different affective profiles and to determine whether these profiles differ from each other based on the four functional conditions of school refusal behavior. Participants comprised 1,816 Spanish adolescents aged 15–18 years. The Positive and Negative Affect Schedule for Children-Short Form and the School Refusal Assessment Scale-Revised for Children were administered. Latent profile analysis revealed five affective profiles: low affective profile, self-fulfilling (...) profile, low positive affect profile, self-destructive profile, and high affective profile. The self-destructive profile revealed the highest average scores in the first three factors of the SRAS-R-C, whereas the high affective profile reached the highest average score in the fourth factor. On the contrary, the self-fulfilling profile obtained the lowest average scores in the first two factors of the SRAS-R-C, whereas the low affective profile revealed the lowest average scores in the last two factors. Findings suggest the relevance of developing more adaptative affective profiles, such as the self-fulfilling profile, which would contribute to diminishing school attendance problems. (shrink)

Background: The high level of satisfaction of users of a health service is largely due to the fact that they receive excellent care from healthcare professionals. Compassionate care is an essential component of excellent care. But what do nurses understand compassion to be? Research objectives: To analyse the concept of compassion from the perspective of nurses in the Andalusian Public Health System, Spain. Research design: This is a qualitative study following the grounded theory model. Four focus groups and 25 in-depth (...) interviews were conducted. Participants and research context: A total of 68 nursing professionals working in the Andalusian Public Health System (Spain) participated. Theoretical sampling was used, with participants being recruited using the snowball technique. Ethical considerations: This research was approved by the Research Ethics Committee of the Centro-Almería Health District (CEICA 27/9/17). Findings: From the analysis of the data, four themes emerged that helped to understand the concept of compassion according to nurses: ‘Negative perception of the term compassion’, ‘Compassion and empathy as synonyms’, ‘Beyond empathy’, and ‘Effects of having a compassionate attitude’. Discussion: Nurses perceive the concept of compassion differently to each other and even contradictorily. This concept is imbued with cultural elements, which adds confusion to understanding it, and is even perceived as something negative similar to pity. Conclusion: Nurses confuse the concepts of empathy and compassion as if they were synonymous. Before considering training in compassion for healthcare professionals, it is essential to clarify the concept of compassion through educational interventions. (shrink)

It can be stated that self-regulated learning (SRL) brings broad benefits to the process of students' learning and studying. However, research has yet to be undertaken in relation to one of its components, namely self-regulation of motivation and affectivity. The main objectives of this study are to examine the use of self-motivation strategies that involve classmates and to obtain models on the influence of academic goals and self-efficacy on such self-motivation strategies. To this end, was conducted a study using two (...) different samples of students in the compulsory secondary education or baccalaureate stages in Spain (N = 613 and N = 910). The results obtained indicate that, with regard to gender, differences only exist in the use of the strategy of deception (t = 5.450, p <.001, d =.364). That the two pairs of strategies positively and significantly correlated with one another (r =.239, p <.01 and r =.355, p <.01). That only the strategy of annulation of others correlates with a more adaptive type of motivation. Thus, the group of students that reported the greatest level in its use also did so in relation to task and ego self-enhancing goals, to self-efficacy, and being negatively associated with the goal of work avoidance. Finally, were offered models on relationships between academic goals, self-efficacy and enhancement and annulation strategies (χ² (8) = 5.204, p =.736) and deception and annulation strategies (χ² (4) = 3.228, p =.520). The concept of vital force – the immanent energy that promotes the processes of life in the body and in nature – has proved a source of endless fascination and controversy. Indeed, the question of what vitalizes the body has haunted humanity since antiquity, and became even more pressing during the Scientific Revolution and beyond. Examining the complexities and theories about vital force in Spanish modernity, Nicolás Fernández-Medina's Life Embodied offers a novel and provocative assessment of the question of (...) bodily life in Spain. In pursuit of the dream that patients' exercise of autonomy could extend beyond their span of competence, living wills have passed from controversy to conventional wisdom, to widely promoted policy. But the policy has not produced results, and should be abandoned.

This article argues that consent must be revocable. I present two arguments for this conclusion. On the argument from informed consent, irrevocable consent lacks validity because it cannot be sufficiently informed. On the argument from bodily integrity, irrevocable consent lacks validity because we do not have the authority to deny our future selves the ability to protect our bodily integrity. I explain why the argument from bodily integrity captures unique moral problems raised by irrevocable consent and illuminates an important but (...) undertheorized distinction between autonomy and bodily integrity. The purpose of this study is to examine how faith-led practices in family firms affect organizational stewardship. Current studies highlight the relevance of religious adherence for family businesses, yet provide limited understanding of how this shapes the key traits of these organizations. Drawing on six autobiographies of family business leaders who openly express their adherence to their faith, and adopting an open-systems analysis of these autobiographies, we demonstrate that faith-led values influence organizational and leadership practices. Overall, our study suggests that (...) the influence of religious beliefs in the organizational practices of family businesses have greater repercussions than previously thought. By introducing a faith-led approach to stewardship, we enrich the theoretical discussion around stewardship and the relevance of religion in family business. (shrink)

When we evaluate artworks, we often point to what an artist could have done or what a work could have been in order to say something about the work as it actually is. Call this counterfactual reasoning in art criticism. On my account, counterfactual claims about artworks involve comparative aesthetic judgments between actual artworks and hypothetical variations of those works. The practice of imagining what an artwork could have been is critically useful because it can help us understand how artworks (...) achieve specific aesthetic effects. I conclude by responding to an objection to my account on the basis that it violates the widely accepted acquaintance principle in aesthetics, on which aesthetic judgments must be based on firsthand perceptual encounters with their objects. This article draws attention to prior engagements with the geophysical and the political: the work of Simone Weil and of the editors of the Martinican cultural journal Tropiques, Suzanne and Aimé Césaire. Synthesizing the political and scientific shifts (...) in human-world relationships of their time, both projects are set against oppressive or narcissistic materialisms and experiment with the image of the ‘cosmic’ to cultivate a preoccupation not (only) with a tangible materialism but with an intangible one that emphasizes process and connectivity across wide spatial and temporal scales. In the following article, it will be argued that there are at least four clusters of arguments generally proposed to justify banning doping in sport and that Simon’s contribution has been of a seminal nature to at least two of the clusters.

The phenomenological movement originates with Edmund Husserl, and two of his young students and collaborators, Edith Stein and Hedwig Conrad-Martius, made a notable contribution to the very delineation of the phenomenological method, which pushed phenomenology in a “realistic” direction. This essay seeks to examine the decisive influence that these two thinkers had on two specific areas: the value of the sciences and certain metaphysical questions. Concerningthe former, I maintain that Stein, departing from a philosophical, phenomenological analysis of the human being, (...) is interested particularly in the formation of the cognitive value of the human sciences. Regarding the latter, Conrad-Martius, given her knowledge of biology, tackled the question of the role and meaning of the sciences of nature. The second question, related to metaphysical themes, became a specific and relevant object of research for both women phenomenologists.It will be investigated by comparing two works, one by each thinker, namely, the Metaphysische Gespräche by Conrad-Martius and Potenz und Akt by Edith Stein. Somatic or inherited mutations in the adenomatous polyposis coli (APC) gene are a frequent cause of colorectal cancer in humans. APC protein has an important tumor suppression function to reduce cellular levels of the signaling protein β‐catenin and, thereby, inhibit β‐catenin and T‐cell‐factor‐mediated gene expression. In addition, APC protein binds to microtubules in vertebrate cells and localizes to actin‐rich adherens junctions in epithelial cells of the fruit fly Drosophila (Fig. 1). Research suggests that people with psychopathic traits experience fear-inducing stimuli differently from others, seeming to interpret fear as more positive and less negative. We expected that this reaction, termed fear enjoyment, would impact the effect of fear-inducing stimuli on self-report risk-taking behaviour. Risk-taking was measured before and after viewing excitement- and fear-inducing videos (N = 825). As expected from research showing that fear induction tends to reduce risk-taking tendencies, participants showed reduced risk-taking scores following a fear-inducing stimulus. Importantly, this relationship (...) was moderated by psychopathic traits. Participants who did not decrease their risk-taking tendencies following the video scored significantly higher on psychopathic traits. Also, some of the variance in the relationship between psychopathic traits and change in risk-taking was partly accounted for by fear enjoyment, suggesting that future research should examine whether fear enjoyment may play a role in the relationship between psychopathy and risk-taking. Between 1920 and 1940, increasing proportions of urban Italian and Jewish women gave birth under the supervision of doctors in clinics and hospitals and limited the number of children they bore. We examine the role of women's informal conversation in accounting for the differences between Jewish and Italian women in the timing of these social changes. Women in both groups drew on relatives, friends, and neighbors for information and social support, but differences in the composition of Italian and Jewish networks (...) were relevant for the timing of change in these reproductive behaviors. This paper focuses on the link between systems criticism and anti-mathematicism in the French-speaking philosophical literature of the mid-18thcentury. Moving from Condillac’s omissions to the exemplary cases of Diderot and Buffon—as well as considering Formey’s crucial remarks—I reconsider the complex relationship that the authors of the French Enlightenment have with the Newtonian model. Finally, I inquire into the fate awaiting both mathematics and systems in this context after 1750.
