This chapter sets out to briefly introduce the theory of the legal form as originally conceived by Evgeny Pashukanis, a famous early Soviet legal scholar. Firstly, it will provide an account of Pashukanis's life, tragically cut short during the Great Terror. Secondly, it will move onto summarising his theory of the legal form through three theses: (i) Commodity Form Thesis, (ii) Bourgeois Law Thesis, and (iii) Withering Away Thesis. Thirdly, it will compare these theses to the positions on law and (...) state advanced by his various interlocutors, past and contemporary, namely Karl Marx and Friedrich Engels, Vladimir Lenin, Petr Stuchka, and Andrey Vyshinsky. Fourthly, it will analyse the similarities and differences identified in the previous section, drawing conclusions as to the cause of Pashukanis's downfall. It will be eventually pointed out that Pashukanis's theory was fundamentally unsuitable to the project of Soviet state-building, which explains why viewing law and state from Pashukanist lens was contested and eventually abandoned. This paper proposes a qualitative study exploring anomalous self and world-experiences in individuals with high levels of depersonalization experiences. Depersonalization (DP) is a condition characterized by distressing feelings of being a detached, neutral and disembodied onlooker of one’s mental and bodily processes. Our findings indicate the presence of a wide range of anomalous experiences traditionally understood to be core features of DP, such as disembodiment and disrupted self-awareness. However, our results also indicate experiential features that are less highlighted in previous (...) work, such as faster time perception and blurriness of the self/other boundaries which may play a key role in altering one’s sense of self and sense of presence in the world. Our qualitative study provides an in-depth examination of self-reported disturbances of one’s relatedness to one’s self and the world, thereby shedding further light on the nature of altered subjective experiences in DP. In doing so, this paper draws attention to key aspects yet overlooked that may prove valuable for shedding further light into the phenomenon of depersonalization. We conclude by highlighting limitations of this study and a number of open questions that further work needs to address in the future. (shrink)

Recent research has demonstrated an asymmetry between the origins and endpoints of motion events, with preferential attention given to endpoints rather than beginnings of motion in both language and memory. Two experiments explore this asymmetry further and test its implications for language production and comprehension. Experiment 1 shows that both adults and 4-year-old children detect fewer within-category changes in source than goal objects when tested for memory of motion events; furthermore, these groups produce fewer references to source than goal objects (...) when describing the same motion events. Experiment 2 asks whether the specificity of encoding source/goal relations differs in both spatial memory and the comprehension of novel spatial vocabulary. Results show that endpoint configuration changes are detected more accurately than source configuration changes by both adults and young children. Furthermore, when interpreting novel motion verbs, both age groups expect more fine-grained lexical distinctions in the domain of endpoint configurations compared to that of source configurations. These studies demonstrate that a cognitive-attentional bias in spatial representation and memory affects both the detail of linguistic encoding during the use of spatial language and the specificity of hypotheses about spatial referents that learners build during the acquisition of the spatial lexicon. Podejmując problem niejęzykowych myśli, Bermudez rozważa go przede wszystkim na dwóch płaszczyznach: epistemologicznej i eksplanacyjnej. Płaszczyzna epistemologiczna dotyczy tego, jak możliwe jest przypisywanie myśli do istot nieposługujących się językiem oraz czy możliwe jest poznanie treści niejęzykowych myśli. Do rozwiązania tego problemu Bermudez posłużył się koncepcją semantyki sukcesu, która umożliwia poznanie zawartości przekonań i pragnień oraz zastosowanie wyjaśniania psychologicznego. Płaszczyzna eksplanacyjna dotyczy natomiast takiej atrybucji myśli do NC, która odpowiednio wyjaśniałaby ich zachowanie. W tym celu Bermudez rozszerza pojęcie racjonalności do NC (...) przez wyróżnienie jej różnych poziomów. Ponadto wyodrębnia protologikę, ukazującą, jak praktyczne rozumowanie może być przypisywane do NC. Główne zarzuty w stosunku do jego stanowiska dotyczą m.in. relacji między myśleniem a wnioskowaniem, stosowanej metodologii oraz rozszerzonego pojęcia racjonalności. (shrink)

Abstract‘Little by Little’. Data Collection and Scales in Nineteenth‐Century Legal Anthropology. With the growing possibilities to measure and accumulate data, two strategies for a small discipline like the history of science are suggested: (1) It should facilitate and maintain the cooperation of specialists who pursue different subject matters and methods. (2) It should invite the recent history of quantification as an essential perspective. A large data collection on the anthropology of law by the German colonial office serves as example.

The aim of this study is to explore the relationship between affectivity and moral experience from a phenomenological perspective. I will start by showing how in a phenomenologically oriented account emotions can be conceived as intentional evaluative feelings which play a role in both moral epistemology and the motivation of moral behaviour. I will then move to discuss a particular kind of affect, "existential feelings" (Ratcliffe in Journal of Consciousness Studies 12(8–10), 43–60, 2005, 2008), which has not been considered so (...) far in the discourse on moral and affective experience. Relying on the notion of pre-intentionality through which Ratcliffe characterizes existential feelings (Inquiry: An Interdisciplinary Journal of Philosophy 53(6), 602–626, 2010) and on some insights into the relationship between affectivity and ethics developed by De Monticelli (2003, 2006), I suggest that key to the role played by existential feelings in moral experience is that they determine the kinds of evaluations that it is possible for us to make and the range of our possibilities of action. I then illustrate and further develop this idea through a phenomenological analysis of some forms of psychopathological experience. More specifically, by considering some experiential features of depression and borderline personality disorder, I claim that, by acquiring an existential character, emotions such as guilt, feelings of isolation, anger and shame can radically alter the structure of the individual evaluative perspective, having a deep impact on both moral judgements and behaviours. Following SOX, financial restatements increased dramatically. Prior research suggests that how investors respond to restatements, particularly those involving fraud, may mitigate or exacerbate damage suffered. We extend both accounting and management research by examining the joint effects of pre-restatement managerial reputation and the announcement of managerial corrective actions in response to a restatement on nonprofessional investors’ judgments. We find that pre-restatement managerial reputation and the announcement of managerial corrective actions jointly influence investors’ managerial fraud prevention assessments, which mediate their trust (...) in management. These trust perceptions in turn affect investors’ investment and CEO retention judgments. Our results have implications for firms that are concerned with lessening the negative consequences associated with issuing a restatement. (shrink)

The goal of the present study was to investigate the interaction between different senses of polysemous nouns (metonymies and metaphors) and different meanings of homonyms using the method of event-related potentials (ERPs) and a priming paradigm. Participants read two-word phrases containing ambiguous words and made a sensicality judgment. Phrases with polysemes highlighted their literal sense and were preceded by primes with either the same or different – metonymic or metaphorical – sense. Similarly, phrases with homonyms were primed by phrases with (...) a consistent or inconsistent meaning of the noun. The results demonstrated that polysemous phrases with literal senses preceded by metonymic primes did not differ in ERP responses from the control condition with the same literal primes. In contrast, processing phrases with the literal sense preceded by metaphorical primes resulted in N400 and P600 effects that might reflect a very limited priming effect. The priming effect observed between metonymic and literal senses supports the idea that these senses share a single representation in the mental lexicon. In contrast, the effects observed for polysemes with metaphorical primes characterize lexical access to the word’s target sense and competition between the two word senses. The processing of homonyms preceded by the prime with an inconsistent meaning, although it did not elicit an N400 effect, was accompanied by a P600 effect as compared to the control condition with a consistent meaning of the prime. We suppose that the absence of the N400 effect may result from inhibition of the target meaning by the inconsistent prime, whereas the P600 response might reflect processes of reanalysis, activation, and integration of the target meaning. Our results provide additional evidence for the difference in processing mechanisms between metonymies and metaphors that might have separate representations in the mental lexicon, although they are more related as compared to homonyms. Definition of the problemThe medical-ethical principle of beneficence is directed towards the well-being of patients. In clinical practice, the focus is often on the relief of pain, the elimination of symptoms and the restoration of bodily functioning. However, the significance of these health-related aspects for the overall well-being of patients also depends on individual values, desires, and life plans.ArgumentationAn overemphasis on the subjective perspective of patients on their well-being would admittedly lead to a strong substantial convergence of the two medical-ethical (...) principles of beneficence and respect for autonomy. In addition, it would not be compatible with some of the guiding principles of the medical profession. A mere objective perspective on patient well-being conversely carries the danger of imposing values on individual patients that they do not share. Consequently, actions that are intended to benefit patients instead harm them.ConclusionThrough a more detailed analysis of the relationship between health-related and overall well-being, this paper shows that health is only a relative value in our overall well-being. Basic health-related goods like a sound cardiovascular system or fully functioning lungs have special standing because they are seen as valuable independently of individual preferences and life plans, which means they are of objective value. This paper considers the relationship between institutions and the “sexual imaginary,” understood as the set of affective and imaginative resources that produce certain forms of sexual subjectivity. Drawing on the work of Cornelius Castoriadis and Moira Gatens, I argue that institutions play an important role in shaping sexual imaginaries. Historically, institutions have been sites in which unjust sexual norms have been reinforced and legitimized. I analyse the growing trend of consent education at Australian universities to explore how institutions may also (...) represent potential sites for contesting and reimagining these norms. Feminist critiques of consent suggest that consent education may in fact reproduce a narrow and conservative vision of sexuality, one that aligns with the neoliberal politics of the contemporary university. This paper contributes to these critiques by exploring how both the neoliberal university and consent theory are premised on a distorted vision of the subject as a rational, disembodied being. I argue that transforming dominant sexual imaginaries requires recognizing and interrogating both how desire permeates institutional spaces and the role of desire in ethical sexual relations. In anticipation of a new edition of the Passio apostolorum Petri et Pauli, this article analyzes the recensio conducted by Lipsius for his edition of 1891. The review of the main variants highlighted by the editor reverses his thesis: they depend on innovations by reduction, not by interpolation. Such innovations could perhaps depend on early medieval liturgical use of the work. With regard to the methodology, the comparison with the Greek tradition of the work, as an external criterion of evaluation, (...) appears misleading, since it is unlikely that Greek is the original language. Abstractabstract There are estimated to be five million vegetarians in the United Kingdom and another four million in the United States. There are numerous vegetarians elsewhere in the world: around fifteen million, for instance, in India. Some of these vegetarians are parents. And some of the vegetarian parents will bring up their children to be vegetarian, too. Is this a permissible course of action? Or should vegetarian parents raise omnivorous offspring? In this article, I consider three arguments that aim to (...) show that a parent should not raise a child on a vegetarian diet. None of these arguments are convincing and I know of no better ones — so I conclude that it is permissible for a parent to raise her child as a vegetarian. (shrink)

The present paper expounds the logic notation proposed by Augustus De Morgan in 1850 from within the original context of De Morgan’s account of syllogistic logic and his approach to quantification. The notational system of 1850 is shown to be a flexible tool to state inferences, to prove their validity and to derive formulæ of the respective system by ‘blind’ application of transformation rules. These pertain to the swapping of operator signs, which are of inverse ‘character’ in a two-fold sense: (...) The signs both represent inverse operations and exemplify oppositeness due to their very shapes. Thus, while De Morgan’s initial choice of symbol shapes is due to certain diagrammatic features, his notational system of 1850 leads to an account of logical operations as effected by manipulation of symbol tokens. It is concluded that as an instantiation of what De Morgan terms a ‘calculus of opposite relations’, his notation of 1850 may also be conceived of as a ‘graphicism’ affording for the working of a ‘symbolic machine’ on ‘de-semantification’. Fazekas and Overgaard () present a novel, multidimensional model that explains different ways in which conscious representations can be degraded. Moreover, the authors discuss possible mechanisms that underlie different kinds of degradation, primarily those related to attentional processing. In this letter, we argue that the proposed mechanisms are not sufficient. We propose that attentional mechanisms work differently at various processing stages; and factors that are independent of attentional ones, such as expectation, previous experience, and context, should be accounted for if (...) we are aiming to construct a comprehensive model of conscious visual perception. ABSTRACT In this survey we have investigated the experiences and attitudes of Danish physicians regarding end‐of life decisions. Most respondents have made decisions that involve hastening the death of a patient, and almost all find it acceptable to do so. Such decisions are made more often, and considered ethically more acceptable, with the informed consent of the patient than without. But both non‐resuscitation decisions, and decisions to provide pain relief in doses that will shorten the patient's life, have been made (...) and found acceptable by at least 50% of the respondents, even when there is no informed consent. Furthermore, 12% have doubled morphine dosages with fixed intervals, thus providing doses substantially higher than that necessary to control pain, without the informed consent of the patient. Two per cent have helped in assisted suicide, and 5% have administered a lethal injection at the patient's request. Respectively 37% and 34% find these last two practices ethically acceptable. Amongst those that do not find them acceptable, the most important reasons to be opposed are, the doctrine of double effect, the doctrine of doing and allowing, and the view that human life is sacred. Amongst supporters, the most important reasons mentioned are, that the patient's right to self‐determination should be respected, the view that a patient should not be forced to suffer, and the view that the patient has a right to be helped to a dignified death. My aim in the paper will be to better understand what faultless disagreement could possibly consist in and what speakers disagree over when they faultlessly do so. To that end, I will first look at various examples of faultless disagreement. Since I will eventually claim that different forms of faultless disagreement can be modeled semantically on different forms of context-sensitivity I will, in a second step, discuss three different semantic accounts that all promise to successfully accommodate certain forms of context-sensitivity: (...) Indexical Contextualism, Nonindexcal Contextualism and Radical Relativism. Focussing on the controversy between Indexical and Nonindexical Contextualists the remainder of the paper will be devoted to the question which theory is best suited to handle what kind of disagreement. This article addresses the underresearched issue of exclusion of a social group that consists of people experiencing involuntary childlessness, which has not been thoroughly researched in this perspective yet. Apart from the available literature on this subject, there were also used conclusions from research that represent only a small part of the author’s unpublished doctoral dissertation Niepłodność w narracjach małżeństw jako indywidualne i wspólne strategie uczenia się egzystencjalnego [Infertility in the accounts of married couples as individual and joint strategies of (...) existential learning]. The author argues that the marginalization of childless people is a consequence of receiving no external support from state organs and institutions (mostly from the educational and medical sector) that would make it possible to prevent infertility or, if it is diagnosed, to make available all possible ways to overcome it. Sa nature metaxu, située entre la durée et la limite, conduit à examiner l’autre notion temporelle de la deuxième partie du Parménide qui est metaxu, c’est-à-dire l’exaiphnês. J’explique pourquoi le nun et l’exaiphnês doivent être distingués et pourquoi il n’existe pas de modèle où les deux notions s’inscrivent simultanément, (...) mais plutôt un modèle rendant compte d’un saut et un modèle rendant compte d’un changement continu. The aim of this paper is to analyse the legal record on civil litigation from mid-March 2020 to mid-July 2021 and examine COVID-19 pandemic-related arguments in a sample of litigated cases heard in Polish courts, more precisely 41 cases. In an attempt to establish the number and types of court cases in which such arguments have been raised, the population of individual case records was accessed electronically from the Ordinary Courts Judgments Portal. The analysed research material consists of texts of (...) written justifications published along with rulings of courts of the first instance in the Portal, except for texts regarding criminal cases and widely understood labour cases. This paper refers to certain theoretical aspects of argument and argumentation. Then, it sheds light on the use of COVID-19 pandemic-related arguments by the parties involved in litigation—as reported by the courts in written justifications—considering, amongst others, whether those arguments were found convincing by the courts. Based on a survey of relevant cases, an attempt was made to identify categories of COVID-19 pandemic-related arguments of the parties involved in litigation, raised in their legal submissions. Also a look into the tendencies in this regard was taken to see whether any patterns emerge and it is possible to discern different trends in the analysed phenomena. The article is devoted to an analysis of Carpathian-Balkan studies conducted by the Russian Academy of Sciences since 2006. The Slovak tradition is an important one, as it displays characteristics which are common to the Carpathian region as a whole. Furthermore, there are a number of Carpathian-South Slavic and Carpathian-Balkan parallels in terminology and related phenomena in folk culture.

There are two main ways of understanding the function of surrogate decision making in a legal context: the Best Interests Standard and the Substituted Judgment Standard. First, we will argue that the Best Interests Standard is difficult to apply to unconscious patients. Application is difficult regardless of whether they have ever been conscious. Second, we will argue that if we accept the least problematic explanation of how unconscious patients can have interests, we are also obliged to accept that the Substituted (...) Judgment Standard can be coherently applied to patients who have never been conscious at the same extent as the Best Interests Standard. We then argue that acknowledging this result is important in order to show patients respect. (shrink)

A term with myriad associations, revolution is commonly understood in its intellectual, historical, and sociopolitical contexts. Until now, almost no attention has been paid to revolution and questions of geography. Geography and Revolution examines the ways that place and space matter in a variety of revolutionary situations. David N. Livingstone and Charles W. J. Withers assemble a set of essays that are themselves revolutionary in uncovering not only the geography of revolutions but the role of geography in revolutions. Here, (...) scientific revolutions—Copernican, Newtonian, and Darwinian—ordinarily thought of as placeless, are revealed to be rooted in specific sites and spaces. Technical revolutions—the advent of print, time-keeping, and photography—emerge as inventions that transformed the world's order without homogenizing it. Gathering insight from geographers, historians, and historians of science, Geography and Revolution is an invitation to take the where as seriously as the who and the when in examining the nature, shape, and location of revolutions. This article addresses Schmitt’s concept of sovereign dictatorship—a departure from the normal legal order aiming to bring about a new mode of legality—as applied to the Marxist, and then Soviet, “dictatorship of the proletariat.” Unlike Schmitt, Marx and Engels, as well as Soviet legal theorists, saw the space for law even while aiming to dispense with the legal form on the road to communism. This is best explained by Schmitt’s failure to recognize the importance of legal systems not only for (...) controlling social conflict, but also for coordination, the need for which does not disappear in extraordinary circumstances. To express this new view of the world, a new language is created, which uses such notions as “virtuality”, “virtual world”, “virtual reality”. These words have already worked in our colloquial speech and our thinking. However, they are used in various contexts and have a different meaning. The ability to be creative is often considered a unique characteristic of conscious beings and many efforts have been directed at demonstrating a relationship between creativity and the personality construct of psychoticism. The present study sought to investigate this link explicitly by focusing on discrete facets of creative cognition, namely the originality/novelty dimension and the practicality/usefulness dimension. Based on Eysenck’s conceptualisation of psychoticism as being characterised by an overinclusive cognitive style, it was expected that higher levels of psychoticism would accompany (...) a greater degree of conceptual expansion and elevated levels of originality in creative imagery, but would be unrelated to the practicality/usefulness of an idea. These hypotheses were confirmed in 80 healthy participants who were contrasted based on their EPQ psychoticism scale scores. Our findings suggest that the link between psychoticism and creativity is based on associative thinking and broader but weak top-down activation patterns rather than on goal-related thinking. In a range of digital creative productions and digital culture, questions of how to deal with finitude are on the rise. On the one hand, sectors of the digital entertainment industry – specifically computer games developers – are concerned with the question of how to manage `death' digitally. On the other hand, death and suicide have become the impetus for humorous artistic expression. This article tracks the emergence of a digital ethos that is cognizant of consequence, finitude and even death. (...) Rather than pit a 1990s `will to life' against an emerging `death drive', I argue that the shift to an ethos in which dark consequences ensue from digital actions must be understood by working through digital code's technicity and unfolding this relation of technics to both ethics and politics. Although Bernard Stiegler's analysis of technicity goes some way toward unfolding a political analysis of the aesthetics of digital code, his articulation of noopolitics fails to provide us with a way to conduct ourselves digitally in an era of cognitive capitalism. I look to critical software practices and their provisional networked publics, with potential lines of flight for contemporary technoculture via novel digital `codings'. (shrink)
