Drawing on previous empirical research, we provide an exemplary narrative to illustrate how patients have experienced hospital care organized according to evidence‐based fast‐track programmes. The aim of this paper was to analyse and discuss if and how it is possible to include patients’ individual perspectives in an evidence‐based practice as seen from the point of view of nursing theory. The paper highlights two conflicting courses of development. One is a course of standardization founded on evidence‐based recommendations, which specify a set (...) of rules that the patient must follow rigorously. The other is a course of democratization based on patients’ involvement in care. Referring to the analysis of the narrative, we argue that, in the current implementation of evidence‐based practice, the proposed involvement of patients resembles empty rhetoric. We argue that the principles and values from evidence‐based medicine are being lost in the transformation into the current evidence‐based hospital culture which potentially leads to a McDonaldization of nursing practice reflected as ‘one best way’. We argue for reviving ethics of care perspectives in today's evidence practice as the fundamental values of nursing may potentially bridge conflicts between evidence‐based practice and the ideals of patient participation thus preventing a practice of ‘McNursing’. The present paper explores patients’ experience of lived space at the hospital and at home. To expand the understanding of the existential meaning of lived space the study revisited two empirical studies and a study of a meta-synthesis on health and caring. Phenomenological philosophy was chosen as a theoretical framework for an excursive analysis. The paper demonstrates that existential dimensions of lived space at the hospital and at home differ significantly. For the patients, the hospital space means alien territory as (...) opposed to the familiar territory of home. To some extent the experienced differences are due to the physical environment; however, as our analysis shows, other and more significant meanings are also involved. For patients, lived space at the hospital primarily concerns the influence of complex institutional power structures and specific cultural and social conventions, e.g. the role of the good patient and the ambiance of hospitals. Home, on the other hand, offers familiar lived space in which patients feel protected and safe. Further, the paper relates patients’ experience of lived space to a phenomenological view of lived space in order to illustrate the radical influence of illness on patients’ lifeworld and experience of lived space. The combination of illness and general discomfort may influence patients’ experience of home negatively; the former experience of home as a sanctuary changes into feelings of being left on one’s own and burdened by too much responsibility. Consequently, in the light of the increasing focus on patients’ self-monitoring at home, it is important for healthcare professionals to recognize the influence of spatial aspects on patients’ well-being both at the hospital and at home. Background: Nursing care is rapidly evolving due to the advanced technological and medical development, and also due to an increased focus on standardization and the logic of production, permeating today’s hospital cultures. Nursing is rooted in a holistic approach with an ethical obligation to maintain and respect the individual’s dignity and integrity. However, working within time limits and heavy workload leads to burnout and ethical insensitivity among nurses, and may challenge nurses’ options to act on the basis of ethical and (...) moral grounds in the individual care situation. Aim: The aim of this study is to describe and discuss ethical dilemmas described and experienced by nurses in clinical practice today. Method: The study was performed as a literature review following the matrix method allowing to synthesize literature across methodological approaches. A literature search was performed, including relevant studies published between 2011 and 2016. A total of 15 articles were included and analyzed focusing on their description of ethical dilemmas. Ethical consideration: We have considered and respected ethical conduct when performing a literature review, respecting authorship and referencing sources. Results: The analysis revealed three themes, relating to important aspects of nursing practice, such as the nurse–patient relationship, organizational structures, and collaboration with colleagues. The findings are summarized in the following three themes: (1) balancing harm and care, (2) work overload affecting quality, and (3) navigating in disagreement. Ethically difficult situations are evident across settings and in very diverse environments from neonatal care to caring for the older people. Organizational structures and being caught in-between professional values, standardization, and busyness was evident, revealing the complexity of nursing practice and the diversity of ethical dilemmas, concerns, and distress experienced by clinical nurses. Conclusion: Nursing practice is challenged by organizational structures and the development of the health care system, inhibiting nurses’ professional decision-making and forcing them to compromise basic nursing values. Nurse researchers engaged in qualitative interviews with patients and spouses in healthcare may often experience being in unforeseen ethical dilemmas. Researchers are guided by the bioethical principles of justice, beneficence, non-maleficence, respect for human rights and respect for autonomy through the entire research process. However, these principles are not sufficient to prepare researchers for unanticipated ethical dilemmas related to qualitative research interviews. We describe and discuss ethically challenging and difficult moments embedded in two cases from our own phenomenological interview studies. (...) We argue that qualitative interviews involve navigation between being guided by bioethics as a researcher, being a therapist/nurse and being a fellow human being or even a friend. The researchers’ premises to react to unexpected situations and act in a sound ethical manner must be enhanced, and there is a need for an increased focus on the researchers’ ethical preparation and to continually address and discuss cases from their own interviews. We extend Tomasello's discussion of children's developing sense of obligation to testimonial learning. First, we review a battery of behaviors in testimonial exchanges that parallel those described by Tomasello. Second, we explore the variable ways in which children hold others accountable, suggestive that children's evaluations of moral and epistemic responsibilities in joint collaborative activities are distinct.

Based upon a brief outline of existential-phenomenological ontology we present a theoretical and practical understanding of humanbeing, which is suited for a methodologically reflected approach to qualitative research. We present the phenomenological distinction between threedimensions of corporeal intentionality(structural, generative and dialectic intentionality) that form elementary events and structures of meaning. Various aspects of human being are better scrutinized with these concepts of intentionality, such as the association of individual being or collective being (e.g. groups) with the less differentiated anonymity of (...) human being. The aim of our framework is to support the qualitative researcher in grasping the experience of the human life in closer accord with how this being actually unfolds and is lived. Application of the presented framework is illuminated with empirical examples from educational, health and psychological contexts. Finally, we discuss the methodological implications that our approach has for qualitative investigations of human being. (shrink)

Excessive alcohol consumption can have adverse effects on health, and patients who suffer from alcohol use disorders are subject to much stigmatization. Nurses are often the first point of contact when patients enter the acute medical unit, and it is pivotal that this contact establishes the basis for future collaboration. The aim of this study is to elucidate nurses’ lived experience of providing care to patients suffering from alcohol use disorders. This present study has a qualitative research design, anchored in (...) phenomenological and hermeneutical methodology as described in reflective lifeworld research. Ten in‐depth, open‐ended interviews with nurses working in an acute medical unit were conducted. The analysis showed that providing care to patients suffering from alcohol use disorders was a highly complex task to accomplish. This required the nurse to engage with the patient in a sensitive cooperation in order to be dealing with the intricacy of the patient's life situation and balancing care between standardized procedures and the complexity of the patients. Further, a two‐sided feeling of responsibility emerged: a professional responsibility and a personal responsibility causing the provision of care as being caught between feelings of despondency and resignation. Nurses lack opportunities for being creative in determining how to provide care; instead, patients' perspectives of well‐being should be taken into account and should guide the provision of a meaningful care. Nurses must call for opportunities to deviate from the firmly established procedures restraining the care of this population. (shrink)

Soft X‐ray tomography (SXT) is an imaging technique capable of characterizing and quantifying the structural phenotype of cells. In particular, SXT is used to visualize the internal architecture of fully hydrated, intact eukaryotic and prokaryotic cells at high spatial resolution (50 nm or better). Image contrast in SXT is derived from the biochemical composition of the cell, and obtained without the need to use potentially damaging contrast‐enhancing agents, such as heavy metals. The cells are simply cryopreserved prior to imaging, and (...) are therefore imaged in a near‐native state. As a complement to structural imaging by SXT, the same specimen can now be imaged by correlated cryo‐light microscopy. By combining data from these two modalities specific molecules can be localized directly within the framework of a high‐resolution, three‐dimensional reconstruction of the cell. This combination of data types allows sophisticated analyses to be carried out on the impact of environmental and/or genetic factors on cell phenotypes. (shrink)

On 17 May 2016 Lucy Welsh interviewed Annelise Riles about her work on the relationship between law and time as part of Welsh’s involvement with the AHRC Regulating Time network. Annelise Riles is the Jack G. Clarke Professor of Law in Far East Legal Studies and Professor of Anthropology at Cornell, and is Director of the Clarke Program in East Asian Law and Culture. Her work examines the transnational dimensions of laws, markets and culture across the fields of (...) comparative law, conflict of laws, the anthropology of law, public international law and international financial regulation. Most recently Professor Riles has been examining the nature and meaning of the settlement made on the so-called Comfort Women, and what impact that has for locating events in the past. The Comfort Women were Korean women who were essentially captured and forced to work as sexual slaves for the Japanese army during World War Two. In 2015, Japanese and South Korean ministers agreed a settlement in what they regarded as an irreversible and final settlement of the issue. Welsh and Riles exchange over their mutual interests in time and routinisation in this interview as they discuss what the story of the Comfort Women has to tell us. (shrink)

1. IntroductionIn his dissertation written under Wilhelm Hennis in 1991, Franz-Josef Ehrle was the first to write about the lecture “Probleme der Staatssoziolo-gie” (“Problems of State Sociology”) that Max Weber gave to the Vienna Sociological Society on October 25, 1917.1 Ehrle used as his source the report on the lecture published in the Neue Freie Presse on October 26, 1917.2 Ehrle also mentions a diary entry made by Josef Redlich, who was among the audience: “Thursday evening, a brilliant lecture (...) by Max Weber(Heidelberg) at the Sociological Society.”3 There exists a short biography of Redlich, taken from an excursus on “The Representatives of the (Bourgeois) Austrian Peace Movement” (“Die Vertreter der (bürgerlichen) österreichischen Friedensbewegung”): “Josef Redlich (1869–1936), jurist and politician, 1907–1918 MöAH (Deutsche Fortschrittspartei/German Progressive Party), Oct.–Nov. 1918, last Imperial and Royal Finance Minister.”4 Ehrle also indicates that Redlich met Max Weber in Vienna in 1909 at the General Congress of the Society for Social Politics (Verein für Sozialpolitik), but that Redlich’s acquaintance with Alfred Weber went back further (as shown in Redlich’s diary entry of September 2, 1909: “Saw Alfred Weber again”).5 Furthermore, a longer meeting with Max Weber is mentioned in Redlich’s diary in 1916 (on June 6).6 When Weber was staying in Vienna in 1917 and 1918, he also met privately with Redlich, and Arthur von Rosthorn attended one of these meetings with his wife (entry of May 9, 1918). Finally, Redlich wrote about his acquaintance with Max Weber in a letter to Hugo von Hofmannsthal on December 3, 1926. Ehrle summarizes Weber’s meetings in Vienna as being “limited primarily to his contacts from academia, economics (Hammerschlag), and politics (and, here, above all the economic field (Mataja, Riedl, Schüler)),” often encouraged by the fact that “academics held ministerial posts and ministers held academic posts.”7. Anthropological scholarship after Marilyn Strathern does something that might surprise lawyers schooled in the tradition of ‘law and society’, or ‘law in context’. Instead of construing law as an instrument of social forces, or as an expression of processes by which society maintains and reproduces itself, a new mode of anthropological enquiry focuses sharply on ‘law itself’, on what Annelise Riles calls the ‘technicalities’ of law. How might the legal scholar be inspired by this approach? In this article, I (...) explore one possible way of approaching law after anthropology, which is to find within law’s own archive a set of resources for an analogous representation of law itself. Drawing on the historical scholarship of Yan Thomas, I suggest that the Roman conception of law as object offers an engaging counterpart to the anthropological take on law as a specific set of tools or, technicalities, or as a particular art of making relations. In dieser Abhandlung unternehme ich den Versuch, an einigen Beispielen zu zeigen, dass die philosophische Anthropologie als eine Denkrichtung des 20. Jahrhunderts auf eine verblüffende Weise zwischen einer behaupteten Nähe zur empirischen Forschung und einer Übernahme von fundamentalen Überzeugungen und Setzungen steht. An der Stelle, wo Argumente und ein redliches Freilegen von Gründen zu erwarten wäre, erfolgt oftmals der Hinweis auf Vorannahmen, die einer empirischen Überprüfung nicht ausgesetzt werden und dieser auch nicht standhalten würden. Dieser Gestus widerspricht allerdings dem Anspruch (...) der philosophischen Anthropologie, eine Integration von empirischen und apriorischen Anteilen im Feld der anthropologischen Forschung integrieren zu können. Philosophische Diskurse können auf verschiedene Arten und aus verschiedenen Gründen missglücken. Sind Streitende in einen bloßen Streit um Worte verstrickt, so liegt ihrem Streit keine Uneinigkeit zugrunde. Aufgrund eines sprachlichen Missverständnisses reden sie bloß aneinander vorbei. Das vorliegende Buch entwirft in seinem ersten Teil erstmalig eine detaillierte Theorie bloßer Streite um Worte. Was zeichnet solch missglückte Streite aus? Und welche Indizien können den Verdacht eines bloßen Streits um Worte in der Philosophie stützen? Im zweiten Teil des Buches wendet die Autorin (...) die erarbeiteten Resultate dann in einer Fallstudie auf die Debatte um personale Identität an. Reden die beiden großen Streitlager der Debatte womöglich nur aneinander vorbei, weil sie Wörtchen wie „ich“, „wir“ oder „Person“ bloß unterschiedlich verwenden? Und besteht zwischen den Streitlagern also vielleicht gar keine Uneinigkeit darüber, welchen Persistenzbedingungen ‚wir‘ unterliegen? Die vorliegende Studie etabliert diese Interpretation der Debatte als einen zumindest ernstzunehmenden Vorschlag. Sie möchte jedoch auch verdeutlichen, wie schwer sich der Verdacht eines bloßen Streits um Worte in der Philosophie wirklich redlich belegen lässt. (shrink)

In diesem Band legt der bis zuletzt in Münster lehrende Philosoph und katholische Theologe Klaus Müller einen Gesamtentwurf seines Denkens und Schaffens vor. Wie kann heute eine intellektuell redliche Rede von Gott gelingen, ohne sich solcher Begriffe (...) wie Schöpfer, Personalität Gottes oder Freiheit des Menschen zu entledigen? Ausgehend von einer Zeitdiagnose, die diese und andere Herausforderungen der christlichen Gottesrede aufdeckt, zeigt sich, dass der hier entfaltete Lösungsvorschlag unter dem Label "Panentheismus" bereits aus zahlreichen verschütteten oder vernachlässigten Quellen unterschiedlicher Epochen schöpfen kann. Ausführlich lotet der Band das theologische Wagnis dieser Denkform aus, insofern er die Konsequenzen eines kritischen Panentheismus und die einhergehenden Transformationsprozesse im Blick auf Trinität, Christologie, Pneumatologie, Schöpfungslehre, Theodizee, Ekklesiologie, Eschatologie entfaltet. Auf beeindruckende Weise legt Klaus Müller in diesem Werk das Potential eines kritischen Panentheismus für Philosophie und Theologie, aber auch für den persönlichen Glauben eines Einzelnen frei. This book shows how the study of multi-hadron production phenomena in the years after the founding of CERN culminated in Hagedorn's pioneering idea of limiting temperature, leading on to the discovery of the quark-gluon plasma -- announced, in February 2000 at CERN. Following the foreword by Herwig Schopper -- the Director General (1981-1988) of CERN at the key historical juncture -- the first part is a tribute to Rolf Hagedorn (1919-2003) and includes contributions by contemporary friends and colleagues, and those (...) who were most touched by Hagedorn: Tamás Biró, Igor Dremin, Torleif Ericson, Marek Gaździcki, Mark Gorenstein, Hans Gutbrod, Maurice Jacob, István Montvay, Berndt Müller, Grazyna Odyniec, Emanuele Quercigh, Krzysztof Redlich, Helmut Satz, Luigi Sertorio, Ludwik Turko, and Gabriele Veneziano. The second and third parts retrace 20 years of developments that after discovery of the Hagedorn temperature in 1964 led to its recognition as the melting point of hadrons into boiling quarks, and to the rise of the experimental relativistic heavy ion collision program. These parts contain previously unpublished material authored by Hagedorn and Rafelski: conference retrospectives, research notes, workshop reports, in some instances abbreviated to avoid duplication of material, and rounded off with the editor's explanatory notes. About the editor: Johann Rafelski is a theoretical physicist working at The University of Arizona in Tucson, USA. Born in 1950 in Krakow, Poland, he received his Ph.D. with Walter Greiner in Frankfurt, Germany in 1973. Rafelski arrived at CERN in 1977, where in a joint effort with Hagedorn he contributed greatly to the establishment of the relativistic heavy ion collision, and quark-gluon plasma research fields. Moving on, with stops in Frankfurt and Cape Town, to Arizona, he invented and developed the strangeness quark flavor as the signature of quark-gluon plasma. (shrink)

Nietzsche considére les notions fondamentales sur lesquelles repose la connaissance humaine comme des fictions. Plutót que de souligner une novelle fois cette conclusion de sa pensée épistémologique, nous táchons dans cet article d'éclairer le cheminement qui l'y a conduit. En effet, lorsque Nietzsche caractérise les «vérités de l'homme» comme autant d'«erreurs irréfutables de l'homme», il adopte manifestement un double point de vue sur la vérité dont il importe de comprendre la logique. Cette double perspective doit selon nous être rapportée à (...) une réception du message de Kant dans la Critique de la raison pure. Nietzsche l'interprète comme une forme extrème de scepticisme aux termes de laquelle les conditions a priori de la possibilité de l'expérience n'ont pas d'auture légitimité, justement, que de rendre possible l'expérience, et de conserver ainsi l'étre contingent qu'est l'homme. En se présentant comme un défenseur de notre science des phénoménes, Kant aurait done reculé devant les conséquences transcendantales de sa critique, pour se replier dans une attitude simplement pragmatique. C'est dés lors une démarche plus radicale, et done plus probe, qui permet à Nietzsche d'élaborer la notion de volonté de puissance.Für Nietzsche sind die Grundbegriffe des menschlichen Wissens Fiktionen. Der Aufsatz will zeigen, wie Nietzsche zu dieser Auffassung kam. Wenn Nietzsche die 'menschelich Warheit' mit einem 'unvermeidlichen Irrtum des Menschen' verbindet, so bezieht er offensichtlich einen doppelten Standpunkt hinsichtlich der Wahrheit, dessen Logik aufgezeigt werden muss. Ich denke, diese doppelte Perspektive muss als eine Antword auf Kants Kritik der reinen Vernunft angeschen werden: Nietzsche interpretiert Kants Lehre als eine extreme Form des Skeptizismus, nach welcher die apriorischen Bedingungen möglicher Erfahrung nur eine Rechtfertigung haben, nämlich Erfahrung möglich zu machen, und damit den Menschen als ein kontingentes Wesen zu bestätigen. Kant erwies sich als Meister der phänomenalen Wissenschaft. Aber asl solcher hat er, für Nietzsche, gerade nicht die transzendentalen Konsequenzen seiner eigenen Fragestellung gezogen, sondern bloß eine pragmatische Antowrt gegeben. Eine rakikalerer und dami redlicher Ansatz wird Nietzsche dazu füren, den Begriff des Willens zur Macht zu entwicklen. (shrink)
