The two standard interpretations of Kant’s view of the relationship between external freedom and public law make one of the terms a means for the production of the other: either public law is justified as a means to external freedom, or external freedom is justified as a means for producing a system of public law. This article defends an alternative, constitutive interpretation: public law is justified because it is partly constitutive of external freedom. The constitutive view requires conceiving of external (...) freedom in a novel, second-personal way, that is, as an irreducibly relational norm. (shrink)

The leader integrity literature has described how professional behavior influences perceptions of integrity, yet behavior in leaders’ personal lives potentially affects those perceptions. The present paper examined how personal life behavior affects leaders. We assessed high profile political sex scandals to explore the research questions of how indiscretions in personal life affect leaders and how leaders recover from public revelations of sexual indiscretions. The results revealed that whether politicians survived the scandal depended on the degree to which the indiscretion deviated (...) from accepted norms, the degree to which the behavior departed from the politician’s expressed values, the leader’s political power, and whether the leader fully engaged in atonement under conditions when denying the allegations is not possible. These components were inter-related such that atonement was possible if the behavior was neither too extreme nor out of character and the leader had sufficient political power. The model was then tested with a sample of business executives engaged in sex scandals, finding support for its elements. (shrink)

A speaker wishes to persuade a listener to accept a certain request. The conditions under which the request is justified, from the listener’s point of view, depend on the values of two aspects. The values of the aspects are known only to the speaker and the listener can check the value of at most one. A mechanism specifies a set of messages that the speaker can send and a rule that determines the listener’s response, namely, which aspect he checks and (...) whether he accepts or rejects the speaker’s request. We study mechanisms that maximize the probability that the listener accepts the request when it is justified and rejects the request when it is unjustified, given that the speaker maximizes the probability that his request is accepted. We show that a simple optimal mechanism exists and can be found by solving a linear programming problem in which the set of constraints is derived from what we call the L-principle. (shrink)

In the 1960s, archaeologists excavating the Lower Nubian site of Qasr Ibrim uncovered, adjacent to the cathedral, a cemetery from the Christian era, which contained the well-preserved textiles of high-ranking ecclesiastics. Elisabeth G. Crowfoot (1914–2005) undertook analysis of this material, but her complete publication of it, Qasr Ibrim: The Textiles from the Cathedral Cemetery, was not published until 2011. The volume describes in meticulous detail the graves and materials unearthed. Working from excavators’ notes, photographs, and, in some fortunate cases, retained (...) garments, Crowfoot created an almost complete picture of the burials in the cathedral cemetery. The present essay relies on Crowfoot’s reconstruction for further interpretation of the cathedral cemetery’s textiles. A single burial, used here as a case study, frames the material in its larger cultural context, which yields information on what burial garments can teach about ecclesiastics’ roles in Christian Nubia. The study shows that the garments in this burial were carefully chosen to emphasize the status of the deceased, stressing especially their civic, religious, and economic authority. Prestige of these types emerge as having been closely linked in Christian Nubia and were key to the construction of ecclesiastical identity. (shrink)

Both traditional accounts of hope and some of their recent critics analyze hope exclusively in terms of attitudes that a hoper bears towards a hoped-for prospect, such as desire and probability assignment. I argue that all of these accounts misidentify cases of despair as cases of hope, and so misconstrue the nature of hope. I show that a more satisfactory view is arrived at by noticing that in addition to the aforementioned attitudes, hope involves a characteristic attitude towards an external (...) factor, on whose operation the hoper takes the prospect's realization to depend causally. In this paper I explore elements from Kant’s philosophy of right to develop a relational account of the wrong of poverty. Poverty is a relational wrong because it involves relations of problematic dependence, inequality, and humiliation. Such relations infringe the rights to freedom and equality of the poor. And the called-for response is one of public recognition and protection of the rights of the poor. This position means we must radically reconceptualize our individual duties to the poor: not _private beneficence_, (...) but _private remedies for public failures_. (shrink)

Generics are sentences such as Birds fly, which express generalizations. They are prevalent in speech, and as far as is known, no human language lacks generics. Yet, it is very far from clear what they mean. After all, not all birds fly—penguins don’t! -/- There are two general views about the meaning of generics in the literature, and each view encompasses many specific theories. According to the inductivist view, a generic states that a sufficient number of individuals satisfy a certain (...) property—in the example above, it says that sufficiently many birds fly. This view faces the complicated problem of spelling out exactly how many is “sufficiently many” in a way that correctly captures the intuitive truth conditions of generics. -/- An alternative, the rules and regulations view, despairs from this project and proposes instead that generics directly express rules in the world. Rules are taken to be abstract objects, which are not related to the properties of specific individuals. This view faces the difficult problem of explaining how people come to know of such rules when judging the truth of falsity of generics, and accounting for the strong intuition that a sentence such as Birds fly talks about birds, not abstract objects. -/- What seems to be beyond dispute is that generics, even if they do not express rules, are lawlike: they state non-accidental generalizations. Many scholars have taken this fact to indicate that generics are parametric on possible worlds: they refer to worlds other than the actual world. This, again, raises the problem of how people come to know about what happens in these other worlds. However, a rigorous application of standard tests for intensionality shows that generics are not, in fact, parametric on possible worlds, but only on time. This unusual property may explain much of the mystery surrounding generics. -/- Another mysterious property of generics is that although there is no language without them, there is no linguistic construction that is devoted to the expression of genericity. Rather, generics can be expressed in a variety of ways, each of which can also express nongenerics. Yet, each manifestation of generics differs subtly (or sometimes not so subtly) in its meaning from the others. -/- Even when these and other puzzles of genericity are solved, one mystery would remain: Why are generics, which are so easy to produce and understand in conversation, so difficult to analyze? Discourse and grammar often complement each other, each imposing a different set of constraints on speakers' utterances. Discourse constraints are global, pertaining to text coherence, and/or to interpersonal relations. Grammatical constraints are local, pertaining to possible versus impossible structures. Yet, the two must meet in natural discourse. At every point during interaction speakers must simultaneously satisfy both types of constraints in order to communicate properly. It is also during conversational interaction that language change somehow takes place. This overview first explains (...) and exemplifies how discourse constraints guide addressees in selecting specific grammatical forms at different points in the interaction. It then examines the relationship between discourse and grammar from a grammaticization point of view, demonstrating how a subset of discourse patterns turn grammatical. As spectators we perceive Oedipus, in Sophocles's Oedipus the King, 1 as one who upon discovering the identity (...) of his father and mother affirms that he bears guilt for killing the former and committing incest with the latter, and we typically concur in some vague way with his affirmation. 2 We do not, after all, think that his affirmation is merely the consequence of some confusion about morals on his part, and that he would have been more justified in treating his discovery with a light conscience. Furthermore, it seems that our conception of his greatness is intimately bound up with our being acquainted with him as someone who acted so as to render himself profoundly guilty in this way. What is paradoxical is that moral taint would be expected to reduce our admiration for a character and our attribution of greatness to it. Why then should noteworthy paradigms of greatness of character be morally tainted characters? Can we make sense of the idea that some kinds of guiltiness might be constitutive of greatness of character?As it is well-known, Aristotle says that in order for a tragedy best to achieve its desired effect, it should portray a protagonist "who is not pre-eminent in moral virtue, who passes to bad fortune not through vice or wickedness, but because of some hamartia...." 3 The term "hamartia" is variously translated as "piece of ignorance," "miscalculation," and "error of judgment," but as O. This article defends a novel, normative conception of the indivisibility of human rights. Human rights are indivisible because normative commitment to one mutually entails normative commitment to another. The normative conception enables us to defend three important theoretical and practical corollaries. First, as a conceptual thesis normative indivisibility lets us see how human rights constitute a unified system not liable to the typical counter-examples to indivisibility as mutual indispensability. Second, as a dialectical thesis, normative indivisibility can support linkage arguments in (...) defense of controversial human rights. And third, as a political thesis, normative indivisibility can show why the political thesis of indivisibility means that states lack discretion to ‘pick and choose’ which human rights to implement. Cognitive penetration of perception, broadly understood, is the influence that the cognitive system has on a perceptual system. The paper shows a form of cognitive penetration in the visual system which I call ‘architectural’. Architectural cognitive penetration is the process whereby the behaviour or the structure of the perceptual system is influenced by the cognitive system, which consequently may have an impact on the content of the perceptual experience. I scrutinize a study in perceptual learning that provides empirical evidence that (...) cognitive influences in the visual system produce neural reorganization in the primary visual cortex. Lecture audiences and students were asked to respond to virtual decision and game situations at gametheory.tau.ac.il. Several thousand observations were collected and the response time for each answer was recorded. There were significant differences in response time across responses. It is suggested that choices made instinctively, that is, on the basis of an emotional response, require less response time than choices that require the use of cognitive reasoning.

In this article, I develop three conceptual innovations within the area of formal metatheory, and present a computer program, called Reconstructor, that implements those developments. The first development consists in a methodology for testing formal reconstructions of scientific theories, which involves checking both whether translations of paradigmatically successful applications into models satisfy the formalisation of the laws, and also whether unsuccessful applications do not. I show how Reconstructor can help carry this out, since it allows the end-user to specify a (...) formal language, input axioms and models formulated in that language, and then ask if the models satisfy the axioms. The second innovation is the introduction of incomplete models (for which the denotation of some terms is missing) into scientific metatheory, in order to represent cases of missing information. I specify the paracomplete semantics built into Reconstructor to deal with sentences where denotation failures occur. The third development consists in a new way of explicating the structuralist notion of a determination method, by equating them with algorithms. This allows determination methods to be loaded into Reconstructor and then executed within a model to find out the value of a previously non-denoting term (i.e. it allows the formal reconstruction to make predictions). This, in turn, can help test the reconstruction in a different way. Finally, I conclude with some suggestions about additional uses the program may have. (shrink)

The standard economic choice model assumes that the decision maker chooses from sets of alternatives. In contrast, we analyze a choice model in which the decision maker encounters the alternatives in the form of a list. We present two axioms similar in nature to the classical axioms of choice from sets. We show that they characterize all the choice functions from lists that involve the choice of either the first or the last optimal alternative in the list according to some (...) preference relation. We then relate choice functions from lists to the classical notions of choice correspondences and random choice functions. (shrink)

Generics and frequency statements are puzzling phenomena: they are lawlike, yet contingent. They may be true even in the absence of any supporting instances, and extending the size of their domain does not change their truth conditions. Generics and frequency statements are parametric on time, but not on possible worlds; they cannot be applied to temporary generalizations, and yet are contingent. These constructions require a regular distribution of events along the time axis. Truth judgments of generics vary considerably across speakers, (...) whereas truth judgments of frequency statements are much more uniform. A generic may be false even if the vast majority of individuals in its domain satisfy the predicated property, whereas a frequency statement using, e.g., usually would be true. This paper argues that all these seemingly unrelated puzzles have a single underlying cause: generics and frequency statements express probability judgments, and these, in turn, are interpreted as statements of hypothetical relative frequency. A survey was carried out among two groups of undergraduate economics students and four groups of students in mathematics, law, philosophy and business administration. The main survey question involved a conflict between profit maximisation and the welfare of the workers who would be fired to achieve it. Significant differences were found between the choices of the groups. The results were reinforced by a survey conducted among readers of an Israeli business newspaper and PhD students of Harvard. It is widely agreed that generics tolerate exceptions. It turns out, however, that exceptions are tolerated only so long as they do not violate homogeneity: when the exceptions are not concentrated in a salient “chunk” of the domain of the generic. The criterion for salience of a chunk is cognitive: it is dependent on the way in which the domain is mentally represented. Findings of psychological experiments about the ways in which different domains are represented, and the actors affecting such (...) representations, account for judgments of generic sentences, facts which cannot be explained by linguistics alone. The reason for the homogeneity requirement itself is, in turn, also dependent on cognitive considerations. Generics express default rules, and psychological findings have shown that, the more homogeneous the domain, the easier it is for subjects to infer rules about it. Thus, cognitive results form a crucial part of a comprehensive account of the meaning of a linguistic expression. (shrink)

In this paper we show that focus structure determines the interpretation of bare plurals in English: topic bare plurals are interpreted generically, focused bare plurals are interpreted existentially. When bare plurals are topics they must be specific, i.e. they refer to kinds. After type-shifting they introduce variables which can be bound by the generic quantifier, yielding characterizing generics. Existentially interpreted bare plurals are not variables, but denote properties that are incorporated into the predicate.The type of predicate determines the interpretation of (...) its bare plural subject. The individual/stage-level distinction, though important, is not sufficient: since only arguments can be topics, only those stage-level predicates which have locative arguments can have existential bare plural subjects.Certain verbs (e.g., hate) fail to incorporate their bare plural objects; therefore no existential reading of the object is available. We provide a novel solution to this puzzle based on the following two claims: (i) incorporated bare plurals do not introduce discourse referents; (ii) nonincorporating verbs are presuppositional. En el marco de los estudios actuales sobre la relación entre teoría y práctica de mímesis en Platón, el objetivo es indagar la caracterización [ethopoiía] platónica de Sócrates. Para tal fin, por un lado, se analiza la tematización de la caracterización en los Progymnásmata para mostrar su función y el lugar que ocupa Platón en esta tradición. Por otro lado, se estudian algunos pasajes clave de Apología de Sócrates y República I para echar luz sobre la composición narrativa, mímesis, y, (...) a través de ella, intentar dar cuenta del quehacer filosófico en la caracterización socrática. La hipótesis es que la opción por el diálogo está ligada no solo al modo de comprender, sino también al modo de transmitir el saber filosófico, y que, en tal marco, el personaje Sócrates encarna un tipo de saber hacer o disposicional. Este tipo de saber no sería reductible a proposiciones, de manera que la opción por el diálogo cumpliría una función no meramente estilística, sino fundamentalmente propedéutico-filosófica. (shrink)
