The use of AI in legal systems: determining independent contractor vs. employee status.Maxime C. Cohen, Samuel Dahan, Warut Khern-Am-Nuai, Hajime Shimao & Jonathan Touboul - forthcoming - Artificial Intelligence and Law:1-30.
The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...)

War, Moderation, and Revenge in Thucydides.David Cohen - 2006 - Journal of Military Ethics 5 (4):270-289.
Thucydidean politicians recognize the difficulty posed by the uncertainties of the future in times of war, yet they differ sharply in their conclusions about how best to respond. Thucydides’ analysis of the rhetoric of wartime decision-making focuses upon the deterioration of political culture under a major national crisis, as well as the role of effective leadership in countering this tendency. The dilemma of Thucydidean politics is how to ensure a deliberative process that will not be taken captive by the pressures (...)

Understanding, Being, and Doing: Medical Ethics in Medical Education.Rosamond Rhodes & Devra S. Cohen - 2003 - Cambridge Quarterly of Healthcare Ethics 12 (1):39-53.
Over the past 15 years, medical schools have paid some attention to the importance of developing students' communication skills as part of their medical education. Over the past decade, medical ethics has been added to the curriculum of most U.S. medical schools, at least on paper. More recently, there has been growing discussion of the importance of professionalism in medical education. Yet, the nature and content of these fields and their relationship to one another remains confused and vague, and that (...)

Myles Burnyeat, Laurence Professor of Ancient Philosophy at Cambridge University, disputes functionalist interpretations of Aristotle. Moreover, he contends that a correct understanding of Aristotle’s philosophy of mind leads to the realization that the only thing to do with it is to reject it. This essay argues that Burnyeat has failed to refute either Aristotle or his functionalist interpreters.

The role of ethics in gathering corporate intelligence.William Cohen & Helena Czepiec - 1988 - Journal of Business Ethics 7 (3):199 - 203.
This paper analyzes business people's attitudes towards the tactics used for gathering competitive corporate intelligence both within their own and their competitors' corporations. Business people in large corporations are highly motivated to gather such intelligence. Their attitudes towards the ethicality of specific practices, however, are influenced by the corporate culture, their perceived effectiveness of the techniques, and their perception of the competitors' tactics. Interestingly enough, the most popular technique for securing information is socializing with competitors in nonbusiness settings. Business people (...)

The Identification of Mean Quantum Potential with Fisher Information Leads to a Strong Uncertainty Relation.Yakov Bloch & Eliahu Cohen - 2022 - Foundations of Physics 52 (6):1-11.
The Cramér–Rao bound, satisfied by classical Fisher information, a key quantity in information theory, has been shown in different contexts to give rise to the Heisenberg uncertainty principle of quantum mechanics. In this paper, we show that the identification of the mean quantum potential, an important notion in Bohmian mechanics, with the Fisher information, leads, through the Cramér–Rao bound, to an uncertainty principle which is stronger, in general, than both Heisenberg and Robertson–Schrödinger uncertainty relations, allowing to experimentally test the validity (...)

Decolonizing health care: Challenges of cultural and epistemic pluralism in medical decision-making with Indigenous communities.Sara Marie Cohen-Fournier, Gregory Brass & Laurence J. Kirmayer - 2021 - Bioethics 35 (8):767-778.
The Truth and Reconciliation Commission of Canada made it clear that understanding the historical, social, cultural, and political landscape that shapes the relationships between Indigenous peoples and social institutions, including the health care system, is crucial to achieving social justice. How to translate this recognition into more equitable health policy and practice remains a challenge. In particular, there is limited understanding of ways to respond to situations in which conventional practices mandated by the state and regulated by its legal apparatus (...)

In two studies we investigated the association between physical cleansing and moral and immoral behavior in real-life situations. In Study 1, after a workout at the gym, participants cheated more after taking a shower than before taking one. In the second study, participants donated more money to charity before rather than after they bathed for religious purification. The results extend previous findings about moral cleansing and moral licensing and are discussed within the framework of conceptual metaphor theory.

It is traditionally maintained that according to Aristotle, matter provides a principle of individuation. Objections of several sorts have been raised against this interpretation. One objection holds that for Aristotle it is form, rather than matter, that individuates. A more radical objection is that Aristotle does not propose any principle of individuation at all. Any adequate discussion of this issue must make clear precisely what problems such a principle is meant to address. This in turn requires that several important distinctions (...)

Bertrand Russell’s _Principles of Mathematics_ (1903) gives rise to several interpretational challenges, especially concerning the theory of denoting concepts. Only relatively recently, for instance, has it been properly realised that Russell accepted denoting concepts that do not denote anything. Such empty denoting concepts are sometimes thought to enable Russell, whether he was aware of it or not, to avoid commitment to some of the problematic non-existent entities he seems to accept, such as the Homeric gods and chimeras. In this paper, (...)

The use of charged-particle radiation therapy is an increasingly important development in the treatment of cancer. One of the most pressing controversies about the use of this technology is whether randomised controlled trials are required before this form of treatment can be considered to be the treatment of choice for a wide range of indications. Equipoise is the key ethical concept in determining which research studies are justified. However, there is a good deal of disagreement about how this concept is (...)

Evolution of the Parietal Lobe in the Formation of an Enhanced “Sense of Self”.Daniel Cohen & Brick Johnstone - 2024 - Journal of Cognition and Culture 24 (1-2):91-120.
Recent neuropaleontological research suggests that the parietal lobe has increased in size as much as the frontal lobes in Homo Sapiens over the past 150,000 years, but has not provided a neuropsychological explanation for the evolution of human socialization or the development of religion. Drawing from several areas of research, (i.e., neurodevelopment, neuropsychology, paleoneurology, cognitive science, archeology, and anthropology), we argue that parietal evolution in Homo sapiens integrated sensations and mental processes into a more integrated subjective “sense of self”. This (...)

This is an examination of Aristotle's notion of an "accidental being" -- something intermediate between a substance and a property. An accidental being (sometimes called "accidental compound" or "kooky object") is an ephemeral object, typically the compound of a substance and a property, that exists for only as long as its components are united. I set out the role that accidental beings play in Aristotle's solutions to several philosophical problems. I also investigate the similarity between these beings and the individual (...)

Through case studies of women from Muslim cultures, we explore the impact of cultural interaction in an adult learning program. Teaching these students has challenged our usual methods, provoking questions about our student-centered pedagogy, which values critical reflection and personal narrative. While their religion restricts women in public life, these students are educational innovators andentrepreneurs, eager to introduce more progressive practices back horne, yet as Muslims they respect their culture and do not advocate the abolition of traditional customs. We explore (...)

Continuing commentary raised several issues concerning our proposal that the hippocampus, parahippocampal region, and cortical association areas mediate different aspects of memory function. Recent relevant findings strengthen our argument that neocortical areas and the parahippocampal region maintain persistent encodings of specific single items and that the hippocampus mediates representations of the relations among these items. The reciprocally and closely interconnected structures that compose the hippocampal memory system work interactively to support flexible memory expression that is relevant to the natural behavior (...)

This paper aims to show that the notion of moral progress makes sense in Hume’s philosophy. And even though Hume suggests that this question is not central, in showing why it is not the case, I will conclude that, in concentrating on the question of the progress of civilisation, Hume was expressing a view on moral progress. To support this claim, I will begin by defending the claim that the notion of moral progress itself is consistent within Hume’s philosophical principles. (...)

Previous research has shown that participants in FWAs are perceived to be less likely to succeed in their careers in public accounting than individuals in public accounting who do not participate in FWAs (Cohen and Single, 2001). Research has also documented an increasing backlash against family–friendly policies in the workplace as placing unfair burdens on individuals without children. Building directly on a (...)
