Most accounts of why physicians have a duty to treat patients during a pandemic look to the special ethical standards of the medical profession. An adequate account must be deeper and broader: it must set the professional duty alongside other individual commitments and broader social values.

Social contract theory has been criticized as a “theory in search of application.” We argue that incorporating the nano- or individual level of analysis into social contract inquiry will yield more descriptive theory. We draw upon the psychological contract perspective to address two critiques of social contract theory: its rigid macro orientation and inattention to the process of contract formation. We demonstrate how a psychological contract approach offers practical insight into the impact of social contracting on day-today human interaction.

Martha Nussbaum has claimed that it is possible for a moral agent to be confronted, through no fault of his own, with an irresolvable conflict between his moral duties; and cites Kant as someone who takes the opposing view. Kant did indeed take the view that conflict between duties was inconceivable, but Nussbaum has failed to grasp his main reason for doing so, namely the principle that ‘ought’ implies ‘can’. When that principle is properly understood it can be seen that (...) a Kantian account, or one drawing upon Kantian resources, can make more sense of our being confronted, seemingly, by incompatible duties than the account Nussbaum herself offers. In the introduction to Aquinas on Friendship, Daniel Schwartz admits that his treatment of Aquinas’s theory of friendship is not exhaustive. His central argument is that Aquinas reworks several elements of Aristotle’s view of friendship in accordance with his Christian commitment to the ideal of friendship with God and to the theological virtue of charity . Does “community” contain an ineradicable memory of “communion,” and thereby inevitably have conceptual ties to Christianity, if not to fascism? Or can the word, rather, indicate a new way of being in common, one that became briefly visible in the communist experiment, understood first as the appearing of the truth of democracy before it collapsed under the weight of ideology and militarism? While Jean-Luc Nancy identifies motifs from Maurice Blanchot’s early right-wing political commitments in his later left-wing thought, this essay (...) addresses and critiques another of Nancy’s claims: that despite Blanchot’s affirmation of a community unregulated by a reference to unity, he is, in fact, committed to the Christian notion of communion. However, Blanchot distanced his notion of inter-subjectivity from any conception of God, proposing, instead, a “dissymmetric” rather than asymmetric relation, grounded in the encounter of the Other’s death rather than in some trace of the divine. Reflection is the basic attitude of transcendental phenomenology. However, as we shall see in this essay, prereflective experiencing may make a unique claim for philosophical foundations - albeit a claim which can only occur when mediated by reflection.

Can one say everything? Does one have the right to say everything? This essay distinguishes these two questions, and seeks to clarify them with reference to two French writers for whom the questions are central: Maurice Blanchot and Jacques Derrida. Blanchot considers the questions with respect to the Marquis de Sade and Louis‐René des Fore˘ts. For Blanchot, the right to say everything is not supported by an appeal to the integrity of the self; rather, it is linked to a kenosis (...) of the “I.” His account leaves important questions unaddressed. For Derrida, however, the right to say everything is enshrined in modern democracy and sustained by reference to a “democracy to come.” Brief as it is, Derrida's response to the questions is the most satisfactory that we have to date. Thomas Aquinas argues that baptism is necessary for salvation. However, he entertains a scenario described by Ambrose of Milan, such that Emperor Valentinian II converted to Christianity and was intending to be baptized but died before the sacrament could be performed. Aquinas argues that the Emperor could have achieved salvation without being baptized with water because he desired baptism and that desire was the result of his faith in God. In this paper, I offer a short treatment of Aquinas’s view (...) of baptism, his handling of the Valentinian II case, and his arguments concerning the efficacy of the baptism of desire. I conclude with a brief discussion of Aquinas’s treatment of the case of Cornelius the centurion, which illustrates how Aquinas’s view of baptism of desire and implicit faith can apply to those individuals who have no access to or connection with the Church. Engineering educators have long discussed the need to teach professional responsibility and the social context of engineering without adding to overcrowded curricula. One difficulty we face is the lack of appropriate teaching materials that can fit into existing courses. The PRiME (Professional Responsibility Modules for Engineering) Project (http://www.engr.utexas.edu/ethics/primeModules.cfm) described in this paper was initiated at the University of Texas, Austin to provide web-based modules that could be integrated into any undergraduate engineering class. Using HPL (How People Learn) theory, PRiME developed (...) and piloted four modules during the academic year 2004–2005. This article introduces the modules and the pilot, outlines the assessment process, analyzes the results, and describes how the modules are being revised in light of the initial assessment. In its first year of development and testing, PRiME made significant progress towards meeting its objectives. The PRiME Project can strengthen engineering education by providing faculty with an effective system for engaging students in learning about professional responsibility. (shrink)

Although the connections of Hedwig Conrad-Martius’ ontological phenomenology, what she called, “realontology,” to Husserl’s transcendental phenomenology were constant concerns that usually remained in the background of her work, on occasion they became foreground. Similarly the problems surrounding the individuation of the person and spirit were persistent but rather marginal in her writings. In this paper I want first to review some of the issues as they are connected to ontological and transcendental phenomenology. Accounts of solidarity typically defend it in teleological or loyalty terms, justifying it by invoking its goal of promoting justice or its expression of support for a shared community. Such solidarity seems to be a moral option rather than an obligation. In contrast, A Moral Theory of Solidarity develops a deontological theory grounded in equity. With extended reflection on the Spanish conquest of the Americas and the US Civil Rights movement, Kolers defines solidarity as political action on others' terms. Unlike (...) mere alliances and coalitions, solidarity involves a disposition to defer to others' judgment about the best course of action. Such deference overrides individual conscience. Yet such deference is dangerous; a core challenge is then to determine when deference becomes appropriate.Kolers defends defernce to those who suffer gravest inequity. Such deference constitutes equitable treatment, in three senses: it is Kantian equity, expressing each person's equal status; it is Aristotelian equity, correcting general rules for particular cases; and deference is 'being an equitable person,' sharing others' fate rather than seizing advantages that they are denied. Treating others equitably is a perfect duty; hence solidarity with victims of inequity is a perfect duty. Further, since equity is valuable in itself, irrespective of any other goal it might promote, such solidarity is intrinsically valuable, not merely instrumentally valuable. Solidarity is then not about promoting justice, but about treating people justly. A Moral Theory of Solidarity engages carefully with recent work on equity in the Kantian and Aristotelian traditions, as well as the demandingness of moral duties, collective action, and unjust benefits, and is a major contribution to a field of growing interest. Territorial disputes have defined modern politics, but political theorists and philosophers have said little about how to resolve such disputes fairly. Is it even possible to do so? If historical attachments or divine promises are decisive, it may not be. More significant than these largely subjective claims are the ways in which people interact with land over time. Building from this insight, Avery Kolers evaluates existing political theories and develops an attractive alternative. He presents a novel link between political (...) legitimacy and environmental stewardship, and applies these ideas in an extended and balanced discussion of the Israeli-Palestinian dispute. The result is the first systematic normative theory of territory, and an impressive example of applied philosophy.
