Il saggio prende in esame due punti della teorizzazione di Harry Frankfurt in merito alla moral agency. Il primo è la corretta concettualizzazione del momento della ‘decisione’ all’interno del­­la ca­tena deliberativa. Vengono esaminati tre passaggi critici: a) la base normativa a cui la decisione ri­spon­de; b) la teoria della ‘unificazione della persona’ attraverso la decisione e c) la distinzione fra ‘scelta’ e ‘decisione’. Il secondo punto è l’ambiguità in­sita nel concetto di ‘doveri d’amore’ pro­posto da Frankfurt. A questo pro­posito (...) vengono esaminate: a) la di­stin­zione fra amore ‘attivo’ e ‘passivo’ e b) la mancata tematizzazione della ‘legittimità del­l’a­more’, ovvero del rap­porto fra l’a­more in quanto relazione sociale e i quadri interpretativi del­la cul­tura entro cui si sviluppa.In this paper two aspects of Harry Frankfurt’s theory of moral agency will be examined. First, his conceptualization of the moment of ‘decision’ wi­thin the deliberative chain will be addressed. Three critical junctures will be dis­cussed: a) the normative basis of the actor’s ‘decision’; b) Frankfurt’s view of the ‘unification’ of the person via decision and c) his distinction of ‘choice’ and ‘decision’. The second point addressed is the ambiguity in­herent in Frankfurt’s notion of ‘duties of love’. With regard to this notion, the following points will be discussed: a) the distinction between ‘active’ and ‘passive’ love and b) Frankfurt’s neglect of the dimension of the ‘le­gi­timacy of love’, i.e. of the nexus of love qua social relation and the inter­pre­tive cadres of the culture within which it unfolds. The travel and tourism industry has, and will continue to play a vital and leading role toward this paradigm shift, and as the world's largest industry involving virtually every nation in the world — will be the central pillar of a Peace through Commerce movement. The dramatic growth of tourism in the past 60 years is one of the most remarkable economic and social phenomena of our time. The industry has grown from a total of 25 million international arrivals in 1950 to a projected 1 billion international arrivals in 2010, and a further projection to 1.6 billion by 2020. Beginning with the emergence of "Ecotourism" in the late 1980' s, there are an increasing number of tourism market segments which fall within a broad category that can be called "Peace Tourism," and classified within a framework that includes peace within ourselves, peace with others, peace with nature, peace with past generations, peace with future generations, and peace with our Creator. Since its birth in 1986, the International Institute for Peace through Tourism (IIPT) has been promoting these values of tourism together with its vision of Travel and Tourism as the world's first "Global Peace Industry" - an industry that promotes and supports the belief that every traveler is potentially an "Ambassador for Peace." This "higher purpose of tourism" includes the key role of tourism in promoting international understanding and collaboration among nations; environmental protection and preservation of biodiversity; enhancing cultures and valuing heritage; contributing to sustainable development and poverty reduction; and healing wounds of conflict. Contrasting the conflicting positions of Fink and Žižek, this article opens and closes with the question: is feminine jouissance ineffable? It solves the mystery of why Lacan associates the Other jouissance with women and presents an account of phallic and the Other jouissance informed by the work of Breuer and Freud. It argues that the satisfactions of Lacan’s feminine subject bear striking affinity to those of the hysteric, while phallic jouissance affords the same sort of enjoyment as that of Freud’s (...) obsessional neurotic. And, while “real” experiences make one lose one-self and may not be represented by one who was absent, this is not to say that we cannot shed light on characteristically feminine pleasure/pains. Machiavellians are often seen as manipulative people who contribute negatively to teams and ventures. However, recent work has shown that Machiavellians can also cooperate and act in pro-social ways in a team context. Thus, some aspects of Machiavellianism might be conducive for teams and team members’ intentions to start a business venture. Most studies in this area have failed to (a) assess the effect of Machiavellianism at the team level, (b) take into account the dimensional nature of Machiavellianism, and (c) (...) assess moderators of these effects. We propose that the combination of Machiavellianism and resilience in teams predict team entrepreneurial intentions (EI). Moreover, we propose that different team level dimensions of Machiavellianism (amoral manipulation, desire for status, desire for control, distrust of others) are differentially related to EI. More specifically, we expect at the team level that amoral manipulation and desire for status are positively related to changes in EI (as teams high on these dimensions feel that they can use unethical practices that give them an advantage in being successful), whereas desire for control and distrust of others should be negatively related to changes in EI (as entrepreneurial teams usually work in less structured situations and need to closely work together). Furthermore, all sub-dimensions of Machiavellianism should interact positively with team resilience as resilience acts as a buffer that protects teams from potential negative effects of Machiavellianism. In a multi-wave study among newly formed teams engaged in entrepreneurship projects, controlling for psychopathy and narcissism, we found partial support for our hypotheses. Results supported our expectations for the “amoral manipulation” and “desire for control” sub-dimensions, but not for the “desire for status” and the “distrust of others” sub-dimensions of Machiavellianism, with distrust of others showing unexpectedly opposite effects. This study contributes to the literature by looking at the dimensions of Machiavellianism at the level of entrepreneurial teams in conjunction with the more positive team characteristic, resilience. Our results indicate that the relationship between Machiavellianism and EI is more complex than previously hypothesized, as the sub-dimensions are sometimes positively and sometimes negatively related to entrepreneurial intentions and interact with team-level resilience. Amor Masovic, responsable de la commission de recherche des disparus en Bosnie-Herzégovine et ancien responsable de la commission pour l’échange des prisonniers pendant la guerre de 1992-1995, nous présente ensuite un tableau accablant des disparitions dans les guerres récentes en ex-Yougoslavie, et des pratiques pour faire en sorte que ceux-ci ne soient ni retrouvés ni, encore moins, identifiés (d’où des fosses communes de deux types : « primaires » – où les corps furent enterrés initialement – et « secondaires » (...) – où ces mêmes corps furent ré-enterrés, souvent démembrés, après avoir été déterrés pour être dispersés et moins aisés à repérer). 28 000 des 40 000 disparus ex-Yougoslaves relèvent du conflit en Bosnie et sont à 95 % des civils protégés par les conventions de Genève. Sur les 280 charniers identifiés la plupart se trouvaient à l’arrière et non sur le front et les disparitions sont datables à des périodes de non-combat. Le but de la commission est donc d’abord de retrouver et identifier les morts pour « faire savoir » et permettre le deuil (puisque la barbarisation qui a été exercée est double : contre les victimes et contre leurs familles qui ne peuvent « vivre » tant qu’elles n’ont pas de certitude). En outre, faute de disposition légale et d’une absence de droit spécifique des disparus personne ne peut être incriminé pour une disparition devant le TPIY où les « disparus » ne sont donc pas représentés. Amor Masovic tire quatre conclusions de son exposé : 1) la barbarie exprimée aujourd’hui est pour partie un résultat des manques de la justice à l’égard des crimes de guerre de la seconde guerre mondiale ; 2) la guerre contre les civils augmente en même temps qu’augmentent les dispositions internationales contre ces exactions qui restent donc purement formelles ; 3) en Bosnie, la barbarisation s’est exercée sur les corps des victimes de façon redoublée puisque l’anéantissement des preuves du crime fait que la mort n’est pas une vraie fin. D’où une forme particulière de barbarisation d’après-guerre ; 4) seul élément plus « positif » : en Bosnie des échanges de prisonniers eurent lieu pendant la guerre sans attendre la fin du conflit ce qui est rarissime et va au-delà des exigences posées par les conventions de Genève en matière de libération des prisonniers. The scope of noninvasive prenatal testing (NIPT) could expand in the future to include detailed analysis of the fetal genome. This will allow for the testing for virtually any trait with a genetic contribution, including “non-medical” traits. Here we discuss the potential use of NIPT for these traits. We outline a scenario which highlights possible inconsistencies with ethical decision-making. We then discuss the case against permitting these uses. The objections include practical problems; increasing inequities; increasing the burden of choice; negative (...) impacts on the child, family, and society; and issues with implementation. We then outline the case for permitting the use of NIPT for these traits. These include arguments for reproductive liberty and autonomy; questioning the labeling of traits as “non-medical”; and the principle of procreative beneficence. This summary of the case for and against can serve as a basis for the development of a consistent and coherent ethical framework. (shrink)

In addition to facing the known competitors in the formal economy, entrepreneurs must also be concerned with rivalry emanating from the informal economy. The informal economy is characterized by actions outside the normal scope of commerce, such as unsanctioned payments and gift-giving, as means of influencing competition. Scholars and policy makers alike have an interest in mitigating the impacts of such informal activity in that it might present an obstacle for legitimate commerce. Received theory suggests that country institutions can enable (...) and constrain productive activity, and, in doing so, influence competitive obstacles in a country. Leveraging 13,670 responses from entrepreneurs distributed across 59 countries, we provide evidence that two particular types of enabling institutions, countries’ property rights regulations and cooperative actions, are useful for lowering the obstacles presented by informal activity. We also find evidence that two constraining institutions, economic and financial regulations lead to more obstacles presented by informal activity. We describe implications for entrepreneurs, policy makers, and future researchers stemming from these findings. (shrink)

Rome and Carthage had established peaceful diplomatic relations before 300 b.c. — as early as the close of the sixth century according to Polybius, whose dating there no longer seems good cause to doubt. A second treaty was struck probably in 348. Both dealt essentially with traders' and travellers' obligations and entitlements, so any military or political terms sprang from that context. In both, the Carthaginians agreed to hand over any independent town they captured in Latium. In the first treaty (...) they were not to establish a fort in Latium either; in the second, the Romans were not to found a city in Carthaginian Africa, Spain or Sardinia. But independent military considerations are the stuff of a third treaty concluded during Rome's war with Pyrrhus. Rome and Carthage now pledged each other military aid in certain circumstances, as we shall see. And ‘geopolitical’ concerns of a very broad kind imbued a treaty which was reported by the third-century historian Philinus of Agrigentum. By this, he stated, ‘the Romans must keep out of the whole of Sicily, the Carthaginians out of Italy’ . This is Polybius' citation of Philinus' allegation; Polybius himself then roundly rejects the very existence of such a pact and declares himself at a loss to understand how his predecessor could record it, but modern scholarship is no longer all that ready to accept his view. A strong majority of historians prefer to follow the Agrigentine, and many see 306 b.c. as the likely year for the agreement because Livy records a ‘renewal’ then of a foedus with Carthage. (shrink)

In my first study of the borrowings from Athenian sacred treasure to finance the Archidamian War I assumed, in common with others, certain irregularities in the stoichedon order of IG. i. 324. The text has subsequently been amplified and improved by Tod, notably with the addition of one amount of interest due to Athena and of the total amounts of principal credited to the Other Gods and to all the gods . This further expansion, however, has introduced additional irregularities, the (...) restoration [τάδε τος λλοις θεος έλοσι τόκο ]ν νδεκα τεα[ιν:…] being too long by one letter in line 120 and the restoration [τάδε πασι τος θεος έλοσι τόκο ν] νδεκα τεσ[ιν:…] being likewise too long in line 123. Our hospital routine requires that all new admissions must be asked about their code status. It is not uncommon for an otherwise healthy patient to request that a do-not-resuscitate order be placed in their chart. Presumably, these patients who wish to have a DNR order are acting on the belief that should an unforeseen, irreversible condition occur that leads to a cardiac arrest, they would not want to undergo resuscitation. Tragically, we have witnessed several instances in which potentially life-saving interventions (...) were withheld in viable patients in non-arrest settings for reversible conditions because the patients had a DNR order in the chart. Unfortunately, this happens when the treating physicians are not aware of the limited scope of a DNR order and instead use the order as a blanket prohibition against all components of resuscitation. This communication failure is due to misconceptions that patients and their physicians have with regard to such orders. The medical community is well overdue to improve the end-of-life decisions offered to patients beyond relying on the outdated term DNR.LIMITATIONS OF DNR ORDERSDespite the major advances in critical care medicine in the past few decades, doctors have not substantially improved their ability to address end-of-life decisions any better than by using the all-encompassing term DNR. Currently, the term is generally accepted as an order to prohibit the use of interventions to reverse a cardiac or pulmonary arrest.1 2 What is frequently forgotten with the DNR order is that …. Sutton ( 2010 ) claims that on our analysis (2007), the problem in the two-envelope paradox is an error in counterfactual reasoning. In fact, we distinguish two formulations of the paradox, only one of which, on our account, involves an error in conditional reasoning. According to Sutton, it is conditional probabilities rather than subjunctive conditionals that are essential to the problem. We argue, however, that his strategy for assigning utilities on the basis of conditional probabilities leads to absurdity. In addition, (...) we show that a crucial presupposition of Sutton’s argument — namely, that one can know that envelope A contains n simply on the basis of a stipulation — is mistaken. (shrink)

The two epigraphical monuments which have preserved parts of the treaties of alliance between Athens, on the one hand, and Rhegion and Leontinoi, respectively, on the other, must be studied together, for both treaties had their old preambles erased in 433/2 and their validity reaffirmed as of that year. The new preambles, both dating from the same day, were inscribed in the erasures and juxtaposed, somewhat awkwardly, before the body of the old texts thatstill remained.
