My aim in this paper is to sketch, with a broad brush and in bare outlines, an approach to modal epistemology that is characterized by three distinctive features. First, the approach is agency-based: it locates the roots of our modal thought and knowledge in our experience of our own agency. Second, the approach is ambitious in that it takes the experience of certain modal properties in agency to be the sole distinctive feature of specifically modal thought and knowledge; everything that (...) we know about modality beyond the experience of agency is a matter of applying standard methods of inquiry such as deduction, induction and abductive methods for choosing between theories. Third, the account holds that modal thought and knowledge is, first and foremost, about modal properties that are sufficiently like those encountered in agency. (shrink)

The problem of collecting, analyzing and evaluating evidence on adverse drug reactions (ADRs) is an example of the more general class of epistemological problems related to scientific inference and prediction, as well as a central problem of the health-care practice. Philosophical discussions have critically analysed the methodological pitfalls and epistemological implications of evidence assessment in medicine, however they have mainly focused on evidence of treatment efficacy. Most of this work is devoted to statistical methods of causal inference with a special (...) attention to the privileged role assigned to randomized controlled trials in Evidence Based Medicine. Regardless of whether the RCT’s privilege holds for efficacy assessment, it is nevertheless important to make a distinction between causal inference of intended and unintended effects, in that the unknowns at stake are heterogonous in the two contexts. This point has been emphasized by epidemiologists in the last decade. Their main focus is methodological, and regards the fact that bias and confounding do not affect studies on intended and unintended effects in the same way. However, deeper concerns ground the intuition for such a distinction; these are related to the constraints which we impose on evidence and their epistemological justification. My thesis is that such constraints ought to be understood to be different in the case of evidence for risk vs. benefit assessment. I present the recent debate on the causal association between acetaminophen and asthma in order to illustrate the point at issue. (shrink)

This book considers the context of the colonial policies of Britain, Locke's contribution to them, and the importance of these ideas in his theory of property. It also reconsiders the debate about John Locke's influence in America. The book argues that Locke's theory of property must be understood in connection with the philosopher's political concerns, as part of his endeavour to justify the colonialist policies of Lord Shaftesbury's cabinet, with which he was personally associated. The author maintains that traditional scholarship (...) has failed to do justice to Locke by ignoring the implications of contemporary British imperial policy for the interpretation of his political thought. I am going to argue that it is time to come to terms with the difficulty of understanding what it means to be physical and start thinking about the mind-body problem from a new perspective. Instead of construing it as the problem of finding a place for mentality in a fundamentally physical world, we should think of it as the problem of finding a place for mentality in a fundamentally nonmental world, a world that is at its most fundamental level (...) entirely nonmental. The mind-body problem, I want to argue, is the problem of determining whether mentality can be accounted for in terms of nonmental phenomena. Plurals had a slow start in the history of formal semantics; a significant explosion of innovations didn’t come until the 1980s. In this paper, I offer a picture of developments by noting not only important achievements but also reflecting on the state of thinking about plurals at various periods—what issues or phenomena were not even noticed, what puzzles had started to get attention, and what innovations made the biggest changes in how people thought about plurals. I divide the epochs roughly (...) into decades: before formal semantics ; the first decade of formal semantics—the 1970s, with early work by Montague and Bennett and landmark work on bare plurals by Carlson; the 1980s, when work by Link, Scha, Krifka, Landman, Roberts, and others significantly changed the landscape; and the 1990s, where I mention some key work by Lasersohn and Schwarzschild and stop there, although there was much more work in the 1990s. Our earliest tools are our bodies. Our hands raise and turn and toss and carry and push and pull, our legs walk and climb and kick allowing us to move and act in the world and to create the multitude of artifacts that improve our lives. The list of actions made by our hands and feet and other parts of our bodies is long. What is more remarkable is we turn those actions in the world into actions on thought through (...) gestures, language, and graphics, thereby creating cognitive tools that expand the mind. The focus here is gesture; gestures transform actions on perceptible objects to actions on imagined thoughts, carrying meaning with them rapidly, precisely, and directly. We review evidence showing that gestures enhance our own thinking and change the thought of others. We illustrate the power of gestures in studies showing that gestures uniquely change conceptions of time, from sequential to simultaneous, from sequential to cyclical, and from a perspective embedded in a timeline to an external perspective looking on a timeline, and by so doing obviate the ambiguities of an embedded perspective. We draw parallels between representations in gesture and in graphics; both use marks or actions arrayed in space to communicate more immediately than symbolic language. (shrink)

Bayle reiterated a position taken in his criticism of the Jesuit Louis Maimbourg’s History of Calvinism. 5 In it Bayle first enunciated the principle that he noted frightened readers and caused a scandal, namely, that error disguised as truth must be allowed all the privileges of truth, i.e., must be permitted to be believed by those convinced they had found truth. This article situates Edward Gresham'sAstrostereon, or A Discourse of the Falling of the Planet(1603), a little-known English astronomical treatise, in the context of the cosmo-theological debate on the reconciliation of heliocentrism with the Bible, triggered by the publication of Nicholas Copernicus'sDe revolutionibus orbium coelestiumin 1543. Covering the period from the appearance of the ‘First Account’ of Copernican views presented in Georg Joachim Rheticus'sNarratio Prima(1540) to the composition ofAstrostereonin 1603, this paper places Edward Gresham's commentary and exegesis against the background of (...) the views expressed by his countrymen and the thinkers associated with the Wittenberg University – such as Philipp Melanchthon, Caspar Peucer, and Christoph Rothmann. Comparing the ways in which they employed certain biblical passages – either in favour of or against the Earth's mobility – the paper emphasizes Gresham's ingenious reading of the Hebrew version of the problematic excerpts, and his expansion of the accommodation principle. In a pioneering study Georges Duby showed how the system of justice that had prevailed in the Carolingian era ceased to function in the Mâconnais of the tenth century. His observations about the breakdown of public institutions opened up a new field of research, for they suggested the development in the tenth century of a unique set of judicial institutions and practices, different in kind from the traditional public order of the Roman and Roman-influenced Carolingian worlds. May 1, 2004 is a joyful day for the Polish society. Poland became a member of the European-Union! The Austrians did not enjoy the admission of the 10 countries of Central and Eastern Europe to the EU. At that time only 38% of Austrians were satisfied with EU membership. Before the enlargement of the Union Austria suggested a seven-year grace period for citizens from new member states who wish to work in the area of the EU and the protection period (...) for the four main industries. Members of the Austrian Government and the Commissioner, Franz Fischler expresses a hope that Austrian entrepreneurs would expand to the east. Sixty seven percent of entrepreneurs of small Austrian companies felt, however, that EU enlargement will not bring the country any benefits. They pressured the government to protect its own labor market, agriculture and border regions. (shrink)

Risk communication has been generally categorized as a warning act, which is performed in order to prevent or minimize risk. On the other side, risk analysis has also underscored the role played by information in reducing uncertainty about risk. In both approaches the safety aspects related to the protection of the right to health are on focus. However, it seems that there are cases where a risk cannot possibly be avoided or uncertainty reduced, this is for instance valid for the (...) declaration of side effects associated with pharmaceutical products or when a decision about drug approval or retirement must be delivered on the available evidence. In these cases, risk communication seems to accomplish other tasks than preventing risk or reducing uncertainty. The present paper analyzes the legal instruments which have been developed in order to control and manage the risks related to drugs – such as the notion of “development risk” or “residual risk” – and relates them to different kinds of uncertainty. These are conceptualized as epistemic, ecological, metric, ethical, and stochastic, depending on their nature. By referring to this taxonomy, different functions of pharmaceutical risk communication are identified and connected with the legal tools of uncertainty management. The purpose is to distinguish the different functions of risk communication and make explicit their different legal nature and implications. (shrink)

This essay uses Garland’s framework from The Culture of Control to suggest an agenda for critical penology. This includes, as well as the analysis of choices actually made and the cultural repertoire actually available, describing and advocating other possible choices, and analysing the conditions of possibility for the adoption of other (better) policies and practices; and examining the implications for the future of choices which are currently being made. Carlen’s Women and Punishment: The Struggle for Justice and Garland’s edited collection (...) Mass Imprisonment in the USA are examples of these penologies. Another way in which penologists, social theorists and philosophers can attempt to influence policy choices is to contribute to enlargement of the available cultural repertoire. The development and promotion of restorative justice is given as one example of this; another is work by philosophers such as Duff, Matravers and Norrie which addresses questions such as the source, nature and limits of penal communities; the basis of political obligation, and the relational nature of responsibility for crime. The literature on Kierkegaard is often content to paraphrase. By contrast, Michael Theunissen articulates one of Kierkegaard's central ideas, his theory of despair, in a detailed and comprehensible manner and confronts it with alternatives. Understanding what Kierkegaard wrote on despair is vital not only because it illuminates his thought as a whole, but because his account of despair in The Sickness unto Death is the cornerstone of existentialism. Theunissen's book, published in German in 1993, is widely regarded as the best (...) treatment of the subject in any language. Kierkegaard's Concept of Despair is also one of the few works on Kierkegaard that bridge the gap between the Continental and analytic traditions in philosophy. Theunissen argues that for Kierkegaard, the fundamental characteristic of despair is the desire of the self "not to be what it is." He sorts through the apparently chaotic text of The Sickness unto Death to explain what Kierkegaard meant by the "self," how and why individuals want to flee their selves, and how he believed they could reconnect with their selves. According to Theunissen, Kierkegaard thought that individuals in despair seek to deny their authentic selves to flee particular aspects of their character, their past, or the world, or in order to deny their "mission." In addition to articulating and evaluating Kierkegaard's concept of despair, Theunissen relates Kierkegaard's ideas to those of Heidegger, Sartre, and other twentieth-century philosophers. (shrink)

We are within nature and culture, conditioned simultaneously by genes and meanings. This form of our self-understanding is the result of fundamental modifications that happened in modern philosophical anthropology and of the impact of the natural Science. In modern philosophy three types of approaches to the human situation were constituted at different times: the idealist, the naturalist, and the culturalist, and the problem of whether humanity is natural (biological) or cultural has begun to take precedence over the issue of human (...) supernatural roots. Both approaches are presented, their presuppositions discussed, and arguments in favor of a version of the culturalist approach. Only the culturalist approach allows us to understand our own self-constitution and, in particular, our self-reflectivity, as well as the naturalist attempts to ignore them and immerse ourselves in nature. Medical diagnosis has been traditionally recognized as a privileged field of application for so called probabilistic induction. Consequently, the Bayesian theorem, which mathematically formalizes this form of inference, has been seen as the most adequate tool for quantifying the uncertainty surrounding the diagnosis by providing probabilities of different diagnostic hypotheses, given symptomatic or laboratory data. On the other side, it has also been remarked that differential diagnosis rather works by exclusion, e.g. by modus tollens, i.e. deductively. By drawing on a (...) case history, this paper aims at clarifying some points on the issue. Namely: 1) Medical diagnosis does not represent, strictly speaking, a form of induction, but a type, of what in Peircean terms should be called ‘abduction’ (identifying a case as the token of a specific type); 2) in performing the single diagnostic steps, however, different inferential methods are used for both inductive and deductive nature: modus tollens, hypothetical-deductive method, abduction; 3) Bayes’ theorem is a probabilized form of abduction which uses mathematics in order to justify the degree of confidence which can be entertained on a hypothesis given the available evidence; 4) although theoretically irreconcilable, in practice, both the hypothetical- deductive method and the Bayesian one, are used in the same diagnosis with no serious compromise for its correctness; 5) Medical diagnosis, especially differential diagnosis, also uses a kind of “probabilistic modus tollens”, in that, signs (symptoms or laboratory data) are taken as strong evidence for a given hypothesis not to be true: the focus is not on hypothesis confirmation, but instead on its refutation [Pr (¬ H/E1, E2, …, En)]. Especially at the beginning of a complicated case, odds are between the hypothesis that is potentially being excluded and a vague “other”. This procedure has the advantage of providing a clue of what evidence to look for and to eventually reduce the set of candidate hypotheses if conclusive negative evidence is found. 6) Bayes’ theorem in the hypothesis-confirmation form can more faithfully, although idealistically, represent the medical diagnosis when the diagnostic itinerary has come to a reduced set of plausible hypotheses after a process of progressive elimination of candidate hypotheses; 7) Bayes’ theorem is however indispensable in the case of litigation in order to assess doctor’s responsibility for medical error by taking into account the weight of the evidence at his disposal. Pace Dummett, the issue between molecularism and holism does not turn on whether a meaning theory is compositional, but on how successful communication is conceived. Given a notion of partial understanding, molecularism escapes the two most prevalent objections against holism (learnability and communication). Holism, too, can escape these objections, provided we also grant the holist a notion of partial understanding and suitably amend our conception of successful communication.

En este artículo discuto las conexiones entre el poeta, los personajes y los lectores. Mi enfoque se funda en lo siguiente: ¿Cómo se imaginan los lectores al autor, cómo imagina el autor a los personajes y de qué modo los lectores son inspirados por los personajes? He seleccionado ejemplos de la tradición homérica y, más específicamente, de algunas estrategias de interpretación en la exégesis antigua, particularmente lo que se ha dado en denominar “soluciones desde el personaje”, para proponer vinculaciones con (...) la interpretación literaria y la crítica textual moderna. In this article I discuss the connections between poet, characters and readers. My focus is based on the following question: How is the author imagined by readers, how are the characters imagined by the author and how the characters inspire readers? I have taken my examples from the Homeric tradition and, more specifically, from some manoeuvres of interpretation in ancient exegesis, particularly the so-called ‘solutions from character’, suggesting a connection with modern textual criticism and literary interpretation.
