Béatrice Longuenesse presents an original exploration of our understanding of ourselves and the way we talk about ourselves. In the first part of the book she discusses contemporary analyses of our use of 'I' in language and thought, and compares them to Kant's account of self-consciousness, especially the type of self-consciousness expressed in the proposition 'I think.' According to many contemporary philosophers, necessarily, any instance of our use of 'I' is backed by our consciousness of our own body. For Kant, (...) in contrast, 'I think' just expresses our consciousness of being engaged in bringing rational unity into the contents of our mental states. In the second part of the book, Longuenesse analyzes the details of Kant's view and argues that contemporary discussions in philosophy and psychology stand to benefit from Kant's insights into self-consciousness and the unity of consciousness. The third and final part of the book outlines similarities between Kant's view of the structure of mental life grounding our uses of 'I' in 'I think' and in the moral 'I ought to, ' on the one hand; and Freud's analysis of the organizations of mental processes he calls 'ego' and 'superego' on the other hand. Longuenesse argues that Freudian metapsychology offers a path to a naturalization of Kant's transcendental view of the mind. It offers a developmental account of the normative capacities that ground our uses of 'I, ' which Kant thought could not be accounted for without appealing to a world of pure intelligences, distinct from the empirical, natural world of physical entities. This book, written by the leading architect of `just deserts' sentencing theory, discusses how sentences may be scaled proportionately to the gravity of the crime. The troubling ethics and politics of philanthropy Is philanthropy, by its very nature, a threat to today’s democracy? Though we may laud wealthy individuals who give away their money for society’s benefit, Just Giving shows how such generosity not only isn’t the unassailable good we think it to be but might also undermine democratic values and set back aspirations of justice. Big philanthropy is often an exercise of power, the conversion of private assets into public influence. And it is a (...) form of power that is largely unaccountable, often perpetual, and lavishly tax-advantaged. The affluent—and their foundations—reap vast benefits even as they influence policy without accountability. And small philanthropy, or ordinary charitable giving, can be problematic as well. Charity, it turns out, does surprisingly little to provide for those in need and sometimes worsens inequality. These outcomes are shaped by the policies that define and structure philanthropy. When, how much, and to whom people give is influenced by laws governing everything from the creation of foundations and nonprofits to generous tax exemptions for donations of money and property. Rob Reich asks: What attitude and what policies should democracies have concerning individuals who give money away for public purposes? Philanthropy currently fails democracy in many ways, but Reich argues that it can be redeemed. Differentiating between individual philanthropy and private foundations, the aims of mass giving should be the decentralization of power in the production of public goods, such as the arts, education, and science. For foundations, the goal should be what Reich terms “discovery,” or long-time-horizon innovations that enhance democratic experimentalism. Philanthropy, when properly structured, can play a crucial role in supporting a strong liberal democracy. Quantifier variance is a well-known view in contemporary metaontology, but it remains very widely misunderstood by critics. Here we briefly and clearly explain the metasemantics of quantifier variance and distinguish between modest and strong forms of variance (Section I), explain some key applications (Section II), clear up some misunderstandings and address objections (Section III), and point the way toward future directions of quantifier-variance-related research (Section IV).

An article by Warren Reich in the December 1994 issue of this journal concludes that the word "bioethics" and the field of study it names experienced a "bilocated birth" in 1970/1971 under Van Rensselaer Potter, at the University of Wisconsin, and André Hellegers, at Georgetown University. Further historical inquiry confirms (1) that there were, from the start, some major differences—even clashes—between the Potter and the Hellegers/Georgetown understandings of bioethics; and (2) that the Hellegers/Georgetown approach came to be the more (...) widely accepted meaning of the term, while Potter's idea of bioethics remained largely marginalized. However, this inquiry also results in a third, unanticipated, conclusion: that Hellegers (in contrast to the dominant model offered by the Georgetown scholars) actually proposed a global approach to bioethics, bringing his vision much closer to Potter's evolving view than previously has been acknowledged. ​This book describes argumentative tools and strategies that can be used to guide policy decisions under conditions of great uncertainty. Contributing authors explore methods from philosophical analysis and in particular argumentation analysis, showing how it can be used to systematize discussions about policy issues involving great uncertainty. The first part of the work explores how to deal in a systematic way with decision-making when there may be plural perspectives on the decision problem, along with unknown consequences of what we do. Readers will see how argumentation tools can be used for prioritizing among uncertain dangers, for determining how decisions should be framed, for choosing a suitable time frame for a decision, and for systematically choosing among different decision options. Case studies are presented in the second part of the book, showing argumentation in practice in the areas of climate geoengineering, water governance, synthetic biology, nuclear waste, and financial markets. In one example, argumentation analysis is applied to proposals to solve the climate problem with various technological manipulations of the natural climate system, such as massive dispersion of reflective aerosols into the stratosphere. Even after a thorough investigation of such a proposal, doubt remains as to whether all the potential risks have been identified. In such discussions, conventional risk analysis does not have much to contribute since it presupposes that the risks have been identified, whereas the argumentative approach to uncertainty management can be used to systematize discussions. The Evans-Salmon position on vague identity has deservedly elicited a large response in the literature. I think it is in fact among the most provocative metaphysical ideas to appear in recent years. I will try to show in this paper, however, that the position is vulnerable to a fundamental criticism that seems to have been virtually ignored in the many discussions of it. I take the Evans-Salmon position to consist of the following two theses: Thesis I. There cannot be objects (...) x and y such that it is indeterminate whether x is (identical with) y. Thesis II. The only way for an identity sentence to be indeterminate in truth-value is if one of the expressions flanking the identity symbol is referentially ambiguous.] The argument for Thesis I is essentially as follows. We are assuming that the sense of identity under discussion satisfies the standard formal logic of identity including Leibniz's Law. Suppose, now, that it is indeterminate whether x is y. Since it is determinate that x is x, x differs from y with respect to the property of being determinately x, from which it follows by Leibniz's Law that x is not y. Since the supposition that it is indeterminate whether x is y leads to the conclusion that x is not y, this supposition is incoherent. (shrink)

This paper draws upon Hannah Arendt's idea of the 'right to have rights' to critique the current protection gap faced by refugees today. While refugees are protected from refoulement once they make it to the jurisdiction or territory of a state, they face an ever-increasing array of non-entrée policies designed to stymie access to state territory. Without being able to enter a state capable of securing their claims to safety and dignity, refugees cannot achieve the rights which ought to be (...) afforded to them under international law. Drawing upon both legal theory and political philosophy, this paper argues that refugees today, just as the stateless in Arendt’s time, must be afforded the ‘right to have rights’, understood as a right to enter state territory. In clinical practice, the focus is often on the relief of pain, the elimination of symptoms and the restoration of bodily functioning. However, the significance of these health-related aspects for the overall well-being of patients also depends on individual values, desires, and life plans.ArgumentationAn overemphasis on the subjective perspective of patients on their well-being would admittedly lead to a strong substantial convergence of the two medical-ethical (...) principles of beneficence and respect for autonomy. In addition, it would not be compatible with some of the guiding principles of the medical profession. A mere objective perspective on patient well-being conversely carries the danger of imposing values on individual patients that they do not share. Consequently, actions that are intended to benefit patients instead harm them.ConclusionThrough a more detailed analysis of the relationship between health-related and overall well-being, this paper shows that health is only a relative value in our overall well-being. Basic health-related goods like a sound cardiovascular system or fully functioning lungs have special standing because they are seen as valuable independently of individual preferences and life plans, which means they are of objective value. Milton Friedman's famous methodological essay contains, along with much else, some strands that look as though they were taken from the “empirical-scientific” fabric described by Karl Popper. Think, for example, of Friedman's conviction that the way to test a hypothesis is to compare its implications with experience. Or of his more or less explicit espousal of the view that while no amount of facts can ever prove a hypothesis true, a single “fact” may refute it. Or of his assertion that (...) hypotheses are to be accepted only as provisionally true, and then only after repeated efforts to refute them have failed. Hegel's Science of Logic has received less attention than his Phenomenology of Spirit, but Hegel himself took it to be his highest philosophical achievement and the backbone of his system. The present book focuses on this most difficult of Hegel’s published works. Béatrice Longuenesse offers a close analysis of core issues, including discussions of what Hegel means by ‘dialectical logic’, the role and meaning of ‘contradiction’ in Hegel’s philosophy, and Hegel’s justification for the provocative statement that ‘what is actual is (...) rational, what is rational is actual’. She examines both Hegel's debt and his polemical reaction to Kant, and shows in great detail how his project of a ‘dialectical’ logic can be understood only in light of its relation to Kant’s ‘transcendental’ logic. Extensive historical sleuthing reveals that the word "bioethics" and the field of study it names experienced, in 1970/1971, a "bilocated birth" in Madison, Wisconsin, and in Washington, D.C. Van Rensselaer Potter, at the University of Wisconsin first coined the term; and André Hellegers, at Georgetown University, at the very least, latched onto the already-existing word "bioethics" and first used it in an institutional way to designate the focused area of inquiry that became an academic field of learning and a movement (...) regarding public policy and the life sciences. The decline of the rehabilitative ethos in sentencing theory in the post_1960's is a story that has been told often, and need not be rehearsed here. Penal treatment programs, once tested for their effectiveness, showed scant success _ or at most, succeeded only in limited categories of cases. Doubts grew also about the fairness of making the severity of a person's sentence depend upon his responsiveness to treatment. As penal rehabilitation diminished in influence, the key question for penologists and reformers (...) became: what conception of sentencing should follow it? My article, as well as Michael Tonry's and John Donahue's in the present volume, is devoted to this question, of the choice of sentencing rationale.I will focus, particularly, on a sentencing theory that became influential in the late 1970's and 1980's in this country and western Europe, and continues to have considerable influence today : namely, the proportionalist or 'desert' model for sentencing. I shall address briefly what this theory's main tenets are and how it differs from traditional retributivism; what has made it attractive to liberal criminologists and penal reformers during the last three decades; and whether and to what degree it has continued value and usefulness for the future. Neoliberal cultural frames of individual choice inform mothers’ accounts of why they refuse state-mandated vaccines for their children. Using interviews with 25 mothers who reject recommended vaccines, this article examines the gendered discourse of vaccine refusal. First, I show how mothers, seeing themselves as experts on their children, weigh perceived risks of infection against those of vaccines and dismiss claims that vaccines are necessary. Second, I explicate how mothers see their own intensive mothering practices—particularly around feeding, nutrition, and natural living—as (...) an alternate and superior means of supporting their children’s immunity. Third, I show how they attempt to control risk through management of social exposure, as they envision disease risk to lie in “foreign” bodies outside their networks, and, therefore, individually manageable. Finally, I examine how these mothers focus solely on their own children by evaluating—and often rejecting—assertions that their choices undermine community health, while ignoring how their children benefit from the immunity of others. By analyzing the gendered discourse of vaccines, this article identifies how women’s insistence on individual maternal choice as evidence of commitment to their children draws on and replicates structural inequality in ways that remain invisible, but affect others. There are an increasing number of ways to enhance human abilities, characteristics, and performance. In recent years, the ethical debate on enhancement has focused mainly on the ethical evaluation of new enhancement technologies. Yet, the search for an adequate and shared understanding of enhancement has always remained an important part of the debate. It was initially undertaken with the intention of defining the ethical boundaries of enhancement, often by attempting to distinguish enhancements from medical treatments. One of the more recent (...) approaches comes from Julian Savulescu, Anders Sandberg, and Guy Kahane. With their welfarist account, they define enhancement in terms of its contribution to individual well-being: as any state of a person that increases the chances of living a good life in the given set of circumstances. The account aims to contribute both to a shared and clear understanding of enhancement and to answering the question of whether we should enhance in certain ways or not. I will argue that it cannot live up to either claim, in particular because of its inherent normativity and its failure to adequately define well-being. Nevertheless, it can make a valuable contribution to an ethics of enhancement. As I will show, the welfarist account refocuses the debate on a central value in health care: well-being, which can be a relevant aspect in assessing the permissibility of biomedical interventions – especially against the background of new bioethical challenges. To fulfil this function, however, a more differentiated understanding of well-being is needed. (shrink)

As the capabilities of artificial intelligence (AI) continue to expand, concerns are also growing about the ethical and social consequences of unregulated development and, above all, use of AI systems in a wide range of social areas. It is therefore indisputable that the application of AI requires social standardization and regulation. For years, innovation policy measures and the most diverse activities of European and German institutions have been directed toward this goal. Under the label “Trustworthy AI” (TAI), a promise is (...) formulated, according to which AI can meet criteria of transparency, legality, privacy, non-discrimination, and reliability. In this article, we ask what significance and scope the politically initiated concepts of TAI occupy in the current process of AI dynamics and to what extent they can stand for an independent, unique European or German development path of this technology. Hellegers’s approach to bioethics, as to morality generally and also to medicine and biomedical science, involved taking the “wider view”—a value-filled vision that integrated and gave (...) meaning to what otherwise was disparate, precarious, and conflicting. This article shows how Hellegers’s wider view of bioethics was shaped by events in his own life, his resultant sense of the precariousness of life and health, his commitment to religious inclusiveness, his research in fetal medicine, his clinical experience in obstetrics, his role in the struggle to change the teaching of the Roman Catholic Church on fertility control, and his developing concepts of health and disease. Hellegers was committed to and worked toward bioethics as a self-consciously interdisciplinary field in which the contributing disciplines adapt to each other—rather than sustain themselves as autonomous disciplines—to create a dynamic and complex intellectual, clinical, and social activity.André Hellegers’s personality and life were like that of a meteor: brief appearance on the scene; high-speed, flaming trajectory; quick burn-out; its smallest residue worth examining for ages to come. He had an unusually probing and unflagging mind, coupled with the ability to make people think; and in a very real sense, that is what he was always about. Like Astaire, he had a deep intensity and striving for perfection while making his art always look like great fun.
