The evidence most of us have for our beliefs on global climate change, the extent of human contribution to it, and appropriate anticipatory and mitigating actions turns crucially on epistemic trust. We extend trust or distrust to many varied others: scientists performing original research, intergovernmental agencies and those reviewing research, think tanks offering critique and advocating skepticism, journalists transmitting and interpreting claims, even social systems of modern science such as peer-reviewed publication and grant allocation. This paper defends an ‘opt-out’ scheme for organ procurement, by distinguishing this system from ‘presumed consent’ (which the author regards as an erroneous justification of it). It, first, stresses the moral importance of increasing the supply of organs and argues that making donation easier need not conflict with altruism. It then goes on to explore one way that donation can be increased, namely by adopting an opt-out system, in which cadaveric organs are used unless the deceased (or their family) registered (...) an objection. Such policies are often labelled ‘presumed consent’, but it is argued that critics are right to be sceptical of this idea—consent is shown to be an action, rather than a mental attitude, and thus not something that can be presumed. Either someone has consented or they have not, whatever their attitude to the use of their organs. Thankfully, an opt-out scheme need not rest on the presumption of consent. Actual consent can be given implicitly, by one's actions, so it is argued that the failure to register an objection (given certain background conditions) should itself be taken as sign of consent. Therefore, it is permissible to use the organs of someone who did not opt out, because they have—by their silence—actually consented. (shrink)

After rejecting prevailing approaches, the author presents his own viewpoint which may be characterized as direct, critical realism. Whole-genome analysis and whole-exome analysis generate many more clinically actionable findings than traditional targeted genetic analysis. These findings may be relevant to research participants themselves as well as for members of their families. Though researchers performing genomic analyses are likely to find medically significant genetic variations for nearly every research participant, what they will find for any given participant is unpredictable. The ubiquity and diversity of these findings complicate questions about disclosing individual genetic test results. We outline an approach for (...) disclosing a select range of genetic results to the relatives of research participants who have died, developed in response to relatives? requests during a pilot study of large-scale medical genetic sequencing. We also argue that studies that disclose individual research results to participants should, at a minimum, passively disclose individual results to deceased participants? relatives. (shrink)

If musical works are abstract objects, which cannot enter into causal relations, then how can we refer to musical works or know anything about them? Worse, how can any of our musical experiences be experiences of musical works? It would be nice to be able to sidestep these questions altogether. One way to do that would be to take musical works to be concrete objects. In this paper, we defend a theory according to which musical works are concrete objects. In (...) particular, the theory that we defend takes musical works to be fusions of performances. We defend this view from a series of objections, the first two of which are raised by Julian Dodd in a recent paper and the last of which is suggested by some comments of his in an earlier paper. For Kant right and ethics are two formally distinct departments of a single morality of reason and freedom. Unlike ethics, right involves an authorization to coerce, and this coercion serves as a pathological incentive. I argue that for Kant the distinctive character of right flows from the fact that juridical obligation has a different relational structure than ethical obligation. I argue that this relational structure explains the connection of right to coercion, and also explains how a categorical imperative can be (...) known a priori to issue in both a pathological and non-pathological incentive. Thus the justification of coercion and its special role as incentive are rooted in the relational character of juridical obligations, and so ultimately in categorical imperatives of reason. Since this pathological incentive has a moral basis in the structure of juridical obligations, and so ultimately in a representation of moral laws, I argue that Kant’s discussion of the juridical incentive of coercion is more continuous with his main discussion of moral incentives in the Critique of Practical Reason than it might at first appear. I illustrate the consequences of this reading by discussing the propensity to injustice, as Kant understands it, and the unique way in which the juridical incentive undermines it. (shrink)

Democracy is commonly associated with political equality and/or majority rule. This essay shows that these three ideas are conceptually separate, so the transition from any one to another stands in need of further substantive argument, which is not always adequately given. It does this by offering an alternative decision-making mechanism, called lottery voting, in which all individuals cast votes for their preferred options but, instead of these being counted, one is randomly selected and that vote determines the outcome. This procedure (...) is democratic and egalitarian, since all have an equal chance to influence outcomes, but obviously not majoritarian. (shrink)

This article argues that standard causal and functionalist definitions of realization fail to account for the realization of entities that cannot be individuated in causal or functional terms. By modifying such definitions to require that realizers also logically suffice for any historical properties of the entities they realize, one can provide for the realization of entities whose resistance to causal/functional individuation stems from their possession of individuative historical properties. But if qualia cannot be causally or functionally individuated, then qualia can (...) be physically realized only if the thesis that all things are physical or physically realized is insufficient for physicalism. The current note clarifies why, in committees, the prior probability of a correct collective choice might be of particular significance and possibly should sometimes even be the sole appropriate basis for making the collective decision. In particular, we present sufficient conditions for the superiority of a rule based solely on the prior relative to the simple majority rule, even when the decisional skills of the committee members are assumed to be homogeneous.

We characterize pairs of monotone generalized quantifiers Q1 and Q2 over finite domains that give rise to an entailment relation between their two relative scope construals. This relation between quantifiers, which is referred to as scope dominance, is used for identifying entailment relations between the two scopal interpretations of simple sentences of the form NP1–V–NP2. Simple numerical or set-theoretical considerations that follow from our main result are used for characterizing such relations. Ethical arguments about assisted dying often focus on whether or not respect for an individual’s autonomy gives a reason to offer them an assisted death if they want it. In this paper, I present an argument for legalising assisted dying which appeals to the autonomy of people who don’t want to die. Adding that option can transform the nature of someone’s choice set, enabling them to pursue other options voluntarily where that would otherwise be harder or impossible. This does not (...) contradict the more familiar arguments for legalising assisted dying based on the autonomy of those who seek to die. But it does suggest that a wider constituency of support for that legislative change might be created by emphasising that one need not be in that position to be benefited by the change. (shrink)

The Argument from Disagreement (AD) (Mackie, 1977) depends upon empirical evidence for ‘fundamental’ moral disagreement (FMD) (Doris and Stich, 2005; Doris and Plakias, 2008). Research on the Southern ‘culture of honour’ (Nisbett and Cohen, 1996) has been presented as evidence for FMD between Northerners and Southerners within the US. We raise some doubts about the usefulness of such data in settling AD. We offer an alternative based on recent work in moral psychology that targets the potential universality of morally significant (...) distinctions (e.g. means vs. side-effects, actions versus omissions). More specifically, we argue that a recent study showing that a rural Mayan population fails to perceive as morally significant the distinction between actions and omissions provides a plausible case of FMD between Mayans and Westerners. Utilitarianism directs us to act in ways that impartially maximize welfare or utility or at least aim to do that. Some find this view highly compelling. Others object that it has intuitively repugnant results; that it condones evildoing and injustice; that it is excessively imposing and controlling; that it is alienating; and that it fails to offer meaningful practical guidance. In this 'Little Debates' volume, James Lenman argues that utilitarianism's directive to improve the whole universe on a cosmic time scale (...) is apt to lead it down a path of imperious moral overreach. Lenman further maintains that the project ultimately shipwrecks upon an extreme lack of epistemic humility in framing the determinants of what is morally right and wrong beyond the limits of what we can ever hope to know. Utilitarianism thus leaves us morally clueless. In contrast, Ben Bramble seeks to develop and defend an original form of utilitarianism, less vulnerable than other, more familiar versions to a number of important objections (including those raised by Lenman). Bramble's form of utilitarianism aims to avoid other unappealing results by presenting it as a claim about what we have the most reason to do and not as a theory of right action (which Bramble urges we should understand quite differently by referencing what would motivate virtuous people). Sixteenth-century Florentines have left us a visual legacy showing them capable of imagining even the executions of criminals as redemptive deaths, with artistic representations of Christ’s own death and the martyrdoms of saints serving such interpretations. This article will look in detail at one such case, before asking whether there might be analogies to this construction of executions as ‘good deaths’ where other, less obviously dramatic kinds of dying are concerned. The comfort that Christian art about dying can give to (...) the dying is its ability to help them imagine their union with Christ in whatever death they must undergo. On the premise that art about dying can be of fundamental assistance to the art of dying, the article proposes examples of works of Christian art that may address the ‘long dying’ so common in our own medically advanced societies, thereby proclaiming the reach and inclusiveness of the hope of redemption. Philosophy & Social Criticism, Ahead of Print. If critical theory is to challenge capitalism’s corrosive commodification of labor and nature, then it should renew a sense of labor as a real bodily power with an internal telos, along the lines of an Aristotelian normativity of praxis. Recent thought however either rejects normativity altogether, or pits normative praxis against labor uncritically reduced to its commodification. Habermas’s work provides an exemplary case of the latter. While he rightly found the ‘production paradigm’ of (...) normativity problematic, his acceptance of the reified form of labor as total led to a severe divorce of praxis from the emerging contents of the body and nature. Although Aristotle also separated praxis from poiesis, his thought nevertheless harbors views of their dialectical integration without falling into the problematic production paradigm. Here the normativity of praxis emerges from poiesis understood non-reductively as the form of the self-organizing body already transforming nature and itself toward higher interactions. (shrink)

This article contends that close attention to music/language analogies allows us to perceive how language attempts to gain an understanding of its own cognitive nature. The article does so by closely reading Paul de Man's ‘The Rhetoric of Blindness’, an essay in which de Man suggests that a detailed look at the analogies between musical and linguistic structures made by Jean-Jacques Rousseau in his Essay On the Origin of Languages helps reveal how literary criticism becomes ‘blind’ to its own metaphysical (...) presuppositions. Scrutinizing the terms on which de Man engages Rousseau, the article argues that surface inconsistencies in de Man's use of musical concepts reveal a deeper pattern of ‘deafness’ which turns his notion of ‘empty’ subjectivity against itself. It concludes with some suggestions for how we might further develop the study of music/language analogies, a subject that has the potential to invigorate our understanding of the non-conceptual aspects of linguistic meaning. Two major features of emotions are their personal, interested nature and the centrality of the self-other relation. There seems to be a built-in tension between the two: this is evident, for example, in negative emotions such as envy and hate, where one person has a significant negative attitude toward another. This tension is also obvious in positive emotions, such as schadenfreude, where an individual is pleased about the other’s misfortune. Such tension may even be greater in romantic love, where the (...) lover should give special attention and status to the beloved. The tension gains further momentum when we assume that self-fulfillment is an essential feature of romantic relationships. Indeed, it seems that in many low-quality romantic relations, the tension between self-fulfillment and the needs of the beloved is real and toxic. However, in enduring profound love, which involves the personal growth of each partner, self-fulfillment is not egoistic, and the tension drives mutual thriving. (shrink)

This article studies the monotonicity behavior of plural determinersthat quantify over collections. Following previous work, we describe thecollective interpretation of determiners such as all, some andmost using generalized quantifiers of a higher type that areobtained systematically by applying a type shifting operator to thestandard meanings of determiners in Generalized Quantifier Theory. Twoprocesses of counting and existential quantification thatappear with plural quantifiers are unified into a single determinerfitting operator, which, unlike previous proposals, both capturesexistential quantification with plural determiners and respects theirmonotonicity (...) properties. However, some previously unnoticed factsindicate that monotonicity of plural determiners is not always preservedwhen they apply to collective predicates. We show that the proposedoperator describes this behavior correctly, and characterize themonotonicity of the collective determiners it derives. It is proved thatdeterminer fitting always preserves monotonicity properties ofdeterminers in their second argument, but monotonicity in the firstargument of a determiner is preserved if and only if it is monotonic inthe same direction in the second argument. We argue that this asymmetryfollows from the conservativity of generalized quantifiers innatural language. (shrink)
