If critical theory is to challenge capitalism’s corrosive commodification of labor and nature, then it should renew a sense of labor as a real bodily power with an internal telos, along the lines of an Aristotelian normativity of praxis. Recent thought however either rejects normativity altogether, or pits normative praxis against labor uncritically reduced to its commodification. Habermas’s work provides an exemplary case of the latter. While he rightly found the ‘production paradigm’ of (...) normativity problematic, his acceptance of the reified form of labor as total led to a severe divorce of praxis from the emerging contents of the body and nature. Although Aristotle also separated praxis from poiesis, his thought nevertheless harbors views of their dialectical integration without falling into the problematic production paradigm. Here the normativity of praxis emerges from poiesis understood non-reductively as the form of the self-organizing body already transforming nature and itself toward higher interactions. (shrink)

Is or has economics ever been the imperial social science? Could or should it ever be so? These are the central concerns of this book. It involves a critical reflection on the process of how economics became the way it is, in terms of a narrow and intolerant orthodoxy, that has, nonetheless, increasingly directed its attention to appropriating the subject matter of other social sciences through the process termed "economics imperialism". In other words, the book addresses the shifting boundaries between (...) economics and the other social sciences as seen from the confines of the dismal science, with some reflection on the responses to the economic imperialists by other disciplines. Significantly, an old economics imperialism is identified of the "as if market" style most closely associated with Gary Becker, the public choice theory of Buchanan and Tullock and cliometrics. But this has given way to a more "revolutionary" form of economics imperialism associated with the information-theoretic economics of Akerlof and Stiglitz, and the new institutional economics of Coase, Wiliamson and North. Embracing one "new" field after another, economics imperialism reaches its most extreme version in the form of "freakonomics", the economic theory of everything on the basis of the most shallow principles. By way of contrast and as a guiding critical thread, a thorough review is offered of the appropriate principles underpinning political economy and its relationship to social science, and how these have been and continue to be deployed. The case is made for political economy with an interdisciplinary character, able to bridge the gap between economics and other social sciences, and draw upon and interrogate the nature of contemporary capitalism. Background Voluntary assisted dying became lawful in Victoria, the first Australian state to permit this practice, in 2019 via the Voluntary Assisted Dying Act 2017 (Vic). While conscientious objection by individual health professionals is protected by the Victorian legislation, objections by institutions are governed by policy. No research has been conducted in Victoria, and very little research conducted internationally, on how institutional objection is experienced by patients seeking assisted dying. Methods 28 semi-structured interviews were conducted with 32 family caregivers and (...) one patient about the experience of 28 patients who sought assisted dying. Participants were interviewed during August-November 2021. Data from the 17 interviews (all with family caregivers) which reported institutional objection were analysed thematically. Results Participants reported institutional objection affecting eligibility assessments, medication access, and taking the medication or having it administered. Institutional objection occurred across health settings and was sometimes communicated obliquely. These objections resulted in delays, transfers, and choices between progressing an assisted dying application and receiving palliative or other care. Participants also reported objections causing adverse emotional experiences and distrust of objecting institutions. Six mediating influences on institutional objections were identified: staff views within objecting institutions; support of external medical practitioners and pharmacists providing assisted dying services; nature of a patient’s illness; progression or state of a patient’s illness; patient’s geographical location; and the capability and assertiveness of a patient and/or caregiver. Conclusions Institutional objection to assisted dying is much-debated yet empirically understudied. This research found that in Victoria, objections were regularly reported by participants and adversely affected access to assisted dying and the wider end-of-life experience for patients and caregivers. This barrier arises in an assisted dying system that is already procedurally challenging, particularly given the limited window patients have to apply. Better regulation may be needed as Victoria’s existing policy approach appears to preference institutional positions over patient’s choice given existing power dynamics. (shrink)

Lotteries have long been used to resolve competing claims, yet their recent implementation to allocate school places in Brighton and Hove, England led to considerable public outcry. This article argues that, given appropriate selection is impossible when parties have equal claims, a lottery is preferable to an auction because it excludes unjust influences. Three forms of contractualism are discussed and the fairness of lotteries is traced to the fact that they give each person an equal chance, as a surrogate for (...) their equal claim to the good. It is argued that this can be a reason to favour an artificially-constructed lottery to a 'natural' lottery where there is suspicion that the latter may be biased. (shrink)

This article provides a conceptual map of the affective terrain while focusing on enduring positive affective attitudes, such as love and happiness. The first section of the article examines the basic characteristics of affective attitudes, i.e., intentionality, feeling, and dispositionality, and classifies the various affective attitudes accordingly. An important distinction in this regard is between acute, extended, and enduring affective attitudes. Then a discussion on the temporality of affective attitudes is presented. The second section discusses major mechanisms that enable long-lasting (...) affective attitudes to endure. These mechanisms include, Hedonic adaptation, which reduces affective intensity, thereby enabling adaptation to a stable, average level of affective intensity; Positive mood offset, which maintains a moderate level of positive mood in the absence of adverse stimuli; The enduring mood of being dissatisfied, thereby keeping the agent’s interest high, and Meaningful development, which underlies the continuation and enhancement of the affective attitude. Each of these mechanisms sustains, in its own unique way, the balance required for enduring affective attitudes. The third section applies the above considerations to two major enduring positive affective attitudes: the mood of lasting happiness and the enduring emotion of profound romantic love. Time is typically a necessary condition for the creation and enhancement of such love. However, it is not a sufficient condition. So only in some cases, but not in all, does loving longer mean loving more. (shrink)

Interactive robots are used increasingly not only in entertainment and service robotics, but also in rehabilitation, therapy and education. The work presented in this paper is part of the Aurora project, rooted in assistive technology and robot-human interaction research. Our primary aim is to study if robots can potentially be used as therapeutically or educationally useful ‘toys’. In this paper we outline the aims of the project that this study belongs to, as well as the specific qualitative contextual perspective that (...) is being used. We then provide an in-depth evaluation, in part using Conversation Analysis, of segments of trials where three children with autism interacted with a robot as well as an adult. We focus our analysis primarily on joint attention which plays a fundamental role in human development and social understanding. Joint attention skills of children with autism have been studied extensively in autism research and therefore this behaviour provides a relevant focus for our study. In the setting used, joint attention emerges from natural and spontaneous interactions between a child and an adult. We present the data in the form of transcripts and photo stills. The examples were selected from extensive video footage for illustrative purposes, i.e. demonstrating how children with autism can respond to the changing behaviour of their co-participant, i.e. the experimenter. Furthermore, our data shows that the robot provides a salient object, or mediator for joint attention. The paper concludes with a discussion of implications of this work in the context of further studies with robots and children with autism within the Aurora project, as well as the potential contribution of robots to research into the nature of autism. In “The Desire Theory of Claim-Rights,” Brian Kierland presents an analysis of the concept of a claim-right according to which one person has a claim-right against another just in case there is a perfect correlation between (1) whether the second person has a duty owed to the first and (2) whether the first wants the second to do the act in question. I respond by suggesting that in certain cases, including a variant of the case of Ulysses and the Sirens, (...) the Desire Theory has seriously counter-intuitive implications. (shrink)

Suppose that at the moment of death, a person goes out of existence.1 This has been thought to pose a problem for the idea that death is bad for its victim. But what exactly is the problem? Harry Silverstein says the problem stems from the truth of the “Values Connect with Feelings” thesis (VCF), according to which it must be possible for someone to have feelings about a thing in order for that thing to be bad for that person (2000, (...) 122). But in order for a person to have feelings about a thing, the person and the thing must coexist in some way. Thus Silverstein feels compelled to endorse a metaphysical view he calls “four-dimensionalism,” but which I prefer to call “eternalism”: the view that purely past and purely future objects and events exist.2 I agree with Silverstein that the badness of death entails eternalism. But the reason is different. Eternalism must be true in order for there to be a time at which death is bad for its victim. Death is bad for its victim at all those times when the victim is worse off for having died: namely, the times when he would have been living a good life had that death not occurred.3 Silverstein rejects this view; he thinks there is something wrong with the very question of when death is bad for its victim. In what follows I argue that Silverstein has not shown the relevance of eternalism to VCF or the badness of death, and I defend my view about the time of death’s badness against Silverstein’s arguments. What's the Problem with Performance Legitimacy?Ci and I both accept that legitimacy is best understood in terms of Weber's "descriptively de jure legitimacy." Put simply, we both think that (...) a state is legitimate if and only if a large enough number of its constituents think it is legitimate. According to this view, therefore, a source of legitimacy is any type of belief—or narrative, as many political realists tend to prefer—that constituents take to give them sufficient reason for regarding the state as legitimate.On the surface, understanding legitimacy in this way seems open to the possibility of a very wide variety of sources of legitimacy. All that matters is whether the source of legitimacy can persuade people to regard the state as legitimate. Weber's study of legitimacy focuses on three particular sources: [End Page 165] legal, traditional, and charismatic. However, as Ci (2024, pp. 149–150) rightly points out, Weber can allow for other sources of legitimacy as well, provided that they have the requisite persuasive power.1The question that Ci and I are interested in here is whether the state's good performance can be a viable source of legitimacy. In my view, it might be possible for a government to secure its legitimacy in this fashion if two conditions are met:(1). the state can reliably maintain good performance—or at least can reliably convince its constituents that it maintains good performance.(2). the state has a sufficiently large constituency of people who possess a shared interest that is served by good performance.I previously expressed doubts about whether the second condition can be reliably met (Cross 2024, pp. 139–143). Hence, I am somewhat skeptical about the possibility of performance legitimacy, but this skepticism does not stem from a categorical distinction between performance and legitimacy. Nor does this skepticism stem from doubts about the ability of any state to maintain good performance. Rather, it stems from doubts about whether the existence of a shared interest is a reliable basis for identifying the constituency of legitimacy.Ci, on the other hand, does think that good performance and legitimacy are categorically distinct, albeit interrelated. He holds that good performance can enhance an existing source of legitimacy. He also holds that it can offer some compensation for the absence of an existing source of legitimacy. However, he denies that good performance can ever count as a source of legitimacy in its own right. Furthermore, Ci's arguments for this claim, as I understand them, are not reducible to the further claim that it is unlikely that any state can reliably sustain the kind of unwaveringly good performance that reliably serves the shared interests of its constituency. That is, although he appears highly skeptical of the state's capacity to satisfy (1) and (2), this skepticism is not, strictly speaking, essential to his arguments.Our main disagreement, then, concerns the correct basis for skepticism about performance legitimacy. Although I think it would be fair to say that Ci's skepticism is stronger and more general than my own, this appears to stem from our different reasons for this skepticism. Opponents of legalised assisted dying often assert that palliative care is worse in countries where assisted dying has been legalised, and imply that legalised assisted dying makes palliative care worse. This study considers five versions of this claim: that it is difficulty to access expert palliative care in countries where assisted dying has been legalised, that those countries rank low in their quality of end‐of‐life care; that legalising assisted dying doesn't expand patient choice in respect of palliative care; that growth (...) in palliative care services has stalled in countries where assisted dying has been legalised; and that legalised assisted dying impedes the growth of palliative care or causes it to decline. The importance of education and its profound effect on people's life make it a central issue in discussions of distributive justice. However, promoting distributive justice in education comes at a price: prioritising the education of some, as is often entailed by the principles of justice, inevitably has negative effects on the education of others. As a result, all theories of distributive justice in education face the challenge of balancing their requirements with conflicting interests. This article aims to contribute to developing (...) an account of conflicting interests by identifying a category of conflicting interests—non-positional conflicting interests—the realisation of which does not necessarily disrupt distributive justice. Non-positional conflicting interests include, for example, the interest in realising one's full potential and parents’ interest in familial relations. The article argues that the core dimensions of non-positional conflicting interests can usually be realised without upsetting distributive justice, and that actions that do upset distributive justice tend to be peripheral to these interests. Either way, there is no severe friction between distributive justice and non-positional conflicting interests: in the former cases, both are realised simultaneously. In the latter, tension exists; however, because the infringement on the conflicting interest is of relatively little weight, it is often justified, all things considered, in order to promote distributive justice. The conclusion is that while there are indeed cases in which distributive justice must retreat in the face of other interests, the friction between distributive justice and other interests is actually weaker than meets the eye. The state's commitment to educating all children can be framed as a matter of human capital development, or the economic benefits accrued to individuals and society as a result of educational attainment; it can be framed as a matter of capabilities, or the development of functionings that enable human flourishing; and it can be framed as a matter of rights. In this essay Sigal Ben-Porath considers the relative merits of the three approaches, elaborating the implications each of these different frameworks (...) has for the education of children with disabilities. While the capabilities approach, which arises from and relates to the rights approach, is sensitive to the needs of individuals with disabilities (more than the human capital approach is, in any case), Ben-Porath concludes that a rights framework can best express through educational policy the state's commitment to the education of all children, regardless of ability. Abstract This work is about the viability domain corresponding to a model of fisheries management. The dynamic is subject of two constraints. The biological constraint ensures the stock perennity where as the economic one ensures a minimum income for the fleets. Using the mathematical concept of viability kernel, we find out a viability domain which simultaneously enables the fleets to exploit the resource, to ensure a minimum income and stock perennity.
