This article focuses on a number of cases in international law in which US domestic courts have produced judgments that conflict with those given by the International Court of Justice. The nature of these courts’ judgments has been extremely closely tied to the interpretation given by the US national Executive to a certain international norm. This situation raises a number of questions, which can be broadly categorized into two spheres: the legal (regarding the overall legality of the courts’ decisions) and (...) the semiotic (regarding the manner in which a ‘meaning’ for the norm has been claimed by the courts). In this article we aim to provide answers to a number of these questions, both from the standpoint of international law and from that of a reader-response model of semiosis. This book presents a new theory of the relationship between vagueness, context-sensitivity, gradability, and scale structure in natural language. Heather Burnett argues that it is possible to distinguish between particular subclasses of adjectival predicatesDLrelative adjectives like tall, total adjectives like dry, partial adjectives like wet, and non-scalar adjectives like hexagonalDLon the basis of how their criteria of application vary depending on the context; how they display the characteristic properties of vague language; and what the properties of their associated orders (...) are. It has been known for a long time that there exist empirical connections between context-sensitivity, vagueness, and scale structure; however, a formal system that expresses these connections had yet to be developed. This volume sets out a new logical system, called DelTCS, that brings together insights from the Delineation Semantics framework and from the Tolerant, Classical, Strict non-classical framework, to arrive at a full theory of gradability and scale structure in the adjectival domain. The analysis is further extended to examine vagueness and gradability associated with particular classes of determiner phrases, showing that the correspondences that exist between the major adjectival scale structure classes and subclasses of determiner phrases can also be captured within the DelTCS system. In the wake of colonial fragmentation and genocide, Indigenous ‘Khoisan resurgence’ movements in South Africa have mobilised subversive forms of authenticity, including heteroglossic and inventive translanguaging from fragments of Khoekhoegowab. In our analysis of video ethnographic texts produced in collaboration with the Gamtkwa Khoisan Council (GKC) in Hankey, the birthplace of Sarah Baartman, we explore how memory, language politics, and environmental activism are interwoven in acts of linguistic citizenship that constitute the ‘rememorying’ of a history that has remained persistently obscured. We argue that rememorying advances a politics of reminding which counters the Rainbow Nation’s institutionalised politics of forgetting, as well as anthropological accounts that consider Indigenous activist invocations of history as merely ‘therapeutic’. Through an engagement with the memory activism of the GKC, we identify how reconstructing word-histories, reliving historical traumas, retelling histories of sites of memory, seeing oneself mirrored in one’s ancestors, and the nexus of land, memory, and time form the basis for shared meaning-making, bringing impetus, focus, and intergenerational continuity to struggles for environmental and land justice. This paper presents a new style of semantic analysis for slurs: linguistic expressions used to denigrate individuals based on some aspects of their identity. As an illustration, the author will focus on one slur in particular: dyke, which is generally considered to be a derogatory term for lesbians. The author argues that not enough attention in the literature has been paid to the use of dyke by members of the target group, who can often use it in a non-insulting manner; (...) secondly, the author argues not enough attention has been paid to the use of the “neutral” form, lesbian, which is generally treated as having a simple, clear meaning, such as “engage[s] in same-sex sex”. Following McConnell-Ginet, the author argues that taking into account all the uses of both dyke and lesbian requires a new semantics and pragmatics for both terms. More specifically, the author proposes that dyke and lesbian are associated with different sets of personae: abstract identities or stereotypes. Dyke is associated with an anti-mainstream persona, which the vast majority of speakers views negatively; whereas, lesbian is associated with a mainstream persona, which many speakers view favourably. The author proposes that the semantic puzzles associated with dyke and lesbian can be resolved through the combination of a theory of these personae and a theory of how listeners’ beliefs about their interlocutors’ ideologies affect utterance interpretation. This essay intervenes in the on-going debate over the power-knowledge entanglements of classifying emic Indigenous resurgence accounts of the past as “therapeutic history”. We refer to how “therapeutic history” was defined by Ronald Niezen in his 2009 book, The Rediscovered Self. We argue that despite the important refinement of the concept made by Rafael Verbuyst in his application of the term in his work on Khoisan resurgence in South Africa, we believe it to be a problematic category, especially in Western (...) knowledge production about Indigenous people. Our reasons are that the term conflates the use of history with its recovery, unfairly maligns Indigenous knowledge keepers as self-serving and uninterested in the truth, and introduces an insidious binary which has unwelcome discursive effects, in that longer chains of equivalence ultimately place Indigenous storying and knowledge keeping on the other side of an epistemological divide from “proper” history-writing. Evolving legal systems have consistently been forced to draw on (or defensibly away from) scientific knowledge, scientific methods, and scientific experts in the pursuit of truth and justice. At the same time, courts—in many ways the original site for the production of social facts—have to (...) a significant extent shaped both the theories and the practices of knowledge production central to the emergence of modern science. This paper develops a formal model of the subtle meaning differences that exist between grammatical alternatives in socially conditioned variation and how these variants can be used by speakers as resources for constructing personal linguistic styles. More specifically, this paper introduces a new formal system, called social meaning games, which allows for the unification of variationist sociolinguistics and game-theoretic pragmatics, two fields that have had very little interaction in the past. Although remarks have been made concerning the possible usefulness of (...) game-theoretic tools in the analysis of certain kinds of socially conditioned linguistic phenomena :645–668, 1977; Dror et al. in Lang Linguist Compass 7:561–579, 2013; in Lang Linguist Compass 8:230–242, 2014; Clark in Meaningful games: Exploring language with game theory, MIT Press, Cambridge, MA, 2014, among others), a general framework uniting game-theoretic pragmatics and quantitative sociolinguistics has yet to be developed. This paper constructs such a framework through giving a formalization of the Third Wave approach to the meaning of variation using signalling games and a probabilistic approach to speaker/listener beliefs of the kind commonly used in the Bayesian game-theoretic pragmatics framework :3–44, 2016, for recent overviews). Reverse mathematics is a program in mathematical logic that seeks to give precise answers to the question of which axioms are necessary in order to prove theorems of "ordinary mathematics": roughly speaking, those concerning structures that are either themselves countable, or which can be represented by countable "codes". This includes many fundamental theorems of real, complex, and functional analysis, countable algebra, countable infinitary combinatorics, descriptive set theory, and mathematical logic. The various recurring periods are provided, as they are described by Abu Ma‘shar in his Book on Religions and Dynasties (On the Great Conjunctions), and then the application of these doctrines to Bohemian history is illustrated.

This article asks about the conditions of a sociological operationalization of the capability approach developed by Amartya Sen and Martha Nussbaum. Raising the question of freedom and social opportunities, the capability approach has so far mainly been discussed by economists and philosophers. In order to adopt this approach for a sociological and pragmatist perspective, it engages with methodological and theoretical issues. Whereas capabilities have until now mainly been studied within quantitative frameworks, the author opts for a qualitative method of inquiry (...) that draws on a pragmatist and configurational approach. Such a shift towards qualitative inquiry is a key condition for a better sociological understanding of notions like freedom and opportunities that stand at the core of the capability approach. The early publication history of the very short Breviarium of Guillaume Budé's De asse et partibus eius is analysed and clarified, and the earliest versions are dated to c. 1520. Though short, it was an influential little work, and in particular its links with Cuthbert Tunstall's De arte supputandi are explored. It is argued that Bude himself was the author of the Brevianum, and that it may have a relevance to the Budé/Porzio controversy about the 'sestertius' and 'sestertium'.

The paper presents both new data and a new analysis of the semantic and pragmatic properties of the class of absolute scalar adjectives within an extension of a well-known logical framework for the analysis of gradable predicates: the delineation semantics framework . It has been long observed that the context-sensitivity, vagueness and gradability features of absolute scalar predicates give rise to certain puzzles for their analysis within most, if not all, modern formal semantic frameworks. While there exist proposals for solving (...) these puzzles within other major frameworks , it has been argued that some of their aspects are particularly challenging for the analysis of absolute scalar predicates within the delineation approach. By combining insights into the relationship between context-sensitivity and scalarity from the DelS framework with insights into the relationship between tolerance/similarity relations and the Sorites paradox from Cobreros et al.’s Tolerant, Classical, Strict framework, I propose a new logical system, called Delineation TCS , in which to set analyses of four classes of adjectival predicates. I argue that this new framework allows for an analysis of absolute scalar adjectives that answers these challenges for delineation-based frameworks, while still preserving the heart of the Klein-ian approach. The decades following the Second Vatican Council witnessed Catholic theology's break from classicism. Deductive, classical theology was replaced by an empirical, historically minded theology. The result was moral confusion and intellectual controversy whose effects are still felt by the Church. Benedict Ashely agreed that some revision in moral theology was necessary after Vatican II to formulate and integrate the mysteries of the Catholic faith. The question was how such teachings could be reformulated while preserving their substantive content. Ashley presents (...) a method of theological reflection that challenges the subjectivity, relationality, and language of historical mindedness with a tradition focusing on Scripture, the Magisterium, sound natural science, and a considered relationship between subjectivity and objectivity. Pindar’s songs were composed for men at play, but his poetry was political in its impulse and in its function. The men in question were rich and powerful, and their games were a display of exclusive class attributes, vicariously shared by lesser mortals who responded with gratitude and loyalty . Victories were counted as princely benefactions and laid up as city treasure like the wealth deposited in the treasuries at Delphi . Athletic victory was thus both a manifestation and an (...) enhancement of aristocratic domination, which meant that the poet who praised those who boxed and raced in pan-Hellenic games necessarily praised the social structure that depended on them.Pindar understood his political function and was proud of it—“I would consort with victors” .1 He believed in athletic contest as a model for all human life. He believed in the aristocratic system: “Inherited governance of cities lies properly with the nobility” . He believed also that praise poetry could regulate as well as laud that system, and he believed finally that such poetry was itself incorruptible. Games, song, and princely rulers were all parts of a single brilliant order, and this truth had a linguistic reflection, for the bit that tames a horse, the meter of a poetic line, and the moderation of a ruler were all called by the same name—metron. “Measure inheres in everything” . 1. Considers the literary genres in which logical texts were written in the post-classical period. Articles describe the kinds of texts that were written and the implications for educational practices, as well as the continuities and developments between one language culture and another.".

The formative period of Latin and Hebrew astrology occurred virtually simultaneously in both cultures. In the second quarter of the twelfth century the terminology of the subject was established and the textbooks which became authoritative were written. The responsibility for this lay almost entirely with two scholars: John of Seville for the Latins, and Abraham ibn Ezra for the Jews. It is unlikely to have been by coincidence that the same developments in astrology occurred in these two cultures. John of (...) Seville and Abraham ibn Ezra were both brought up within the Islamic culture of Spain, and their astrology was Arabic astrology. Moreover, some scholars have thought that John’s origins were Jewish, while Ibn Ezra is known to have collaborated with Latin scholars . It cannot be a coincidence that they forged the science of astrology for their respect co-religionists at almost the same time. Yet, very little research has been done on the possible relations between the two scholars. The purpose of this paper is to begin to explore this relationship, and to illustrate it in particular by their shared doctrine concern the location of pain. (shrink)
