However, pregnant women need to know that they are HIV-infected to take advantage of antiretroviral therapy, and many women do not know their HIV status. One-half of HIV-infected infants in the United States were bornto women who had not been tested for HIV or for whom the time of testing was not known. Although fewer than 400infants are infected (...) perinatally in the United States each year, that number could be reduced even further through policies aimed at HIV testing during pregnancy.The reasons toadopt such a policy are strong: the pathophysiology of perinatal transmission is clear, prophylaxis is effective and safe, and the intended beneficiaries of the intervention - babies - cannot protect themselves. This paper sets forth and advocates Bernard Lonergan’s understanding of Aquinas’s use of “intelligible emanations” as an analogy for processions in the Trinity. It argues that some of Lonergan’s views on consciousness, understanding, phronesis, and judgement are similar to views expressed in Hans-Georg Gadamer’s Truth and Method and John Henry Newman’s An Essay in Aid of a Grammar of Assent.

PORTER The image of Saint Thomas presented in these hagiographic and iconographic traditions is distinctly that of an intellect-at one time engrossed in speculative thought, at another time in mystic contemplation-but it is always the mind that is foremost engaged. The image is always that of the intellectual genius entirely taken up with recondite or divine ideas, far removed from this-worldly concerns or domestic distractions. These images cannot be easily dismissed, nor indeed should we want to do such a thing, for there is much truth in these images. Certainly Thomas was at times a mystic, and his powers of abstraction and concentration were nothing less than extraordinary. His own writings are the best witness to this. The method displayed therein-the dispassionate objectivity, the unrelenting logic, the economy of expression, the precise and telling distinctions, not to mention his encyclopedic knowledge of scriptural, mystical, and philosophical sources-makes for the impression of an almost disembodied intellect at work. No wonder he was given the title "angelic doctor"! However, the problem with such images and titles is that they never allude to the fact that Saint Thomas also had a human heart and human feelings, and that these, too, could at times have had an effect upon his thinking, especially when his feelings had been hurt. To illustrate this thesis, I propose to examine the interplay between thought and emotion, history and analysis, in the Summa Contra Gentiles III, especially as concerns Chapters 131-135. Chapters 131-135 constitute a small treatise on religious poverty and as such appear as a peculiarly recondite consideration amid Aquinas's much more general treatment there of the themes of divine providence and human freedom. I believe this peculiar feature can only be understood in relation to an historical controversy of the times, namely, the attack upon the new mendicant orders by the secular clergy. Indeed, I believe the true nuances of this small treatise can best be understood when it is seen more as the heartfelt response of Aquinas to a slur upon his dignity rather than as his dispassionate or purely reasoned response to a contest of ideas. This paper examines the case of Lawrence v. Texas to bring out the philosophical commitments of Justices Anthony Kennedy and Antonin Scalia. It is proposed that Justices Kennedy and Scalia, while both Catholics, represent fundamentally different visions of the “ends and reasons” of democratic law. A close reading of the Justices’ opinions in Lawrence indicates that Justice Scalia belongs to the tradition of the “ancients” and Justice Kennedy to the tradition of the “moderns.” The paper focuses in particular (...) on the Justices’ interpretations of the Due Process Clause of the Fourteenth Amendment. It is claimed that the interpretation of this clause turns on a philosophical commitment regarding the ends and reasons that the Constitution should be understood to serve, and thus that justices cannot help acting as “philosopher kings” here. Which of the two Justices is more consistent with the Catholic tradition is proposed as a question for another day. (shrink)

What capitalist economics call business or trade cycles with their recessions and depressions, and Marxists, in terms of surplus value and exploitation, call crises are fundamental misunderstandings of what Bernard Lonergan conceives as the true intelligibility of the rhythms of production and monetary circulation of the advanced exchange economy. In his circulation analysis he expresses the intelligibility of macroeconomic dynamics in terms of a pure cycle that involves the anti-egalitarian flows proper to new surplus or productive goods expansion and (...) the egalitarian flows proper to basic or consumer goods expansion, which Marxists correctly complain are not fully carried out. Crucial to the smooth expansion are (1) the crossover payments between surplus and basic monetary circuits in harmony with the phases of economic development, (2) the re-understanding of profit not as a criterion of economic activity but as involving a group interest that does not strictly 'belong' to capitalist entrepreneurs, and yet cannot be negotiated by a socialist bureaucracy. The issue is not greed on the part of either capitalists or workers but ignorance, which this analysis tries to correct. /// O presente artigo mostra de que modo aquilo que na economia capitalista é considerado como um ciclo de negócio ou de comércio com as suas respectivas reces-sões e depressões, e os Marxistas, interpretando o fenómeno em termos de mais-valia e de exploração, chamam de crises, é concebido por Bernard Lonergan nos termos de uma verdadeira inteligibilidade dos ritmos de produção e da circulação monetária próprios à economia de mercado avançada. If ever a prize is to be given for the most cantankerous figure in the history of science and medicine, Almroth Wright will surely be on the short list. With the exception of himself, Wright was a man who did not tolerate fools lightly. Even the author of this biography, who tries very hard to see Wright's point of view, becomes exasperated with him at times. More commonly known today as Sir Colenso Ridgeon in George Bernard Shaw's The Doctor's (...) Dilemma, Wright was born of stern, fanatical Irish Protestant parents in 1861. Extremely gifted, Wright graduated first in modern languages at Trinity College, Dublin. After switching to and qualifying in medicine, a gadfly postgraduate career followed. His first permanent job was as pathologist at the army's medical headquarters at Netley near Southampton, where Wright developed the agent for which his name remains inscribed on the bacteriologists' roll of honor: prophylactic typhoid vaccine. Its passage into common use, however, was far from easy. Statisticians, clinicians, and military authorities lined up against him. Wright's belief in the vaccine's value was vindicated in World War I. The controversy over its efficacy has been analyzed by J. Rosser Matthews in his Quantification and the Quest for Medical Certainty . Dunnill does not refer to this, but, there again, scarcely any modern secondary source is recognized in this book. This is not that sort of a biography, which is not to decry its great merits. Dunnill is a pathologist who sticks very close to the primary sources, including large amounts of hitherto‐unpublished manuscript material. His approach is very evaluative of what Wright got scientifically right and wrong by today's criteria, but the judgments are made in a subdued and relatively unobtrusive way. This is a great virtue in dealing with any aspect of the volatile Wright. His views on woman's place in the world and her claim for the right to vote would drive any intolerant feminist historian to apoplexy. Dunnill, however, takes great pains to situate Wright's views in context.A man like Wright was never going to be happy at Netley since the military hierarchy weighed on him, crushing his individualism. Only the dictatorial control of an autonomous empire would suit him, and this is what he eventually got. Wright became the head of the pathology department at St. Mary's Hospital, London, and there he was effectively responsible to nobody. This was possible because he turned his laboratory into a vaccine‐producing factory and used the drug company Parke Davies to market his products. These included not only prophylactic agents but now‐discredited ones for the treatment of the then‐common bacterial diseases such as pneumonia. The Great War saw Wright in France struggling to introduce another innovation that was finally accepted. “Listerian antisepsis” was a hallowed phrase among surgeons, and the more infected war wounds became the more intense became their antiseptic applications—sadly, to little effect. Wright campaigned for simple saline washing of wounds, a practice eventually adopted with much better results. After the war, separated from his wife, at odds with the Medical Research Council, and estranged from some of his colleagues , Wright turned to the consolations of philosophy—unfortunately writing rather than just reading it. His otiose productions solving the riddle of the universe now lie unread. This conventional but highly readable biography offers no new insights into the science of the period, but it does merit attention as a study of the relations of personality and empire building. Bernard Williams questioned whether impartial morality “can allow for the importance of individual character and personal relations in moral experience.” Underlying his position is a distinction between factual and practical deliberation. While factual deliberation is about the world and brings in a standpoint that is impartial, practical deliberation is, he claims, radically first‐personal; it “involves an I that [is] intimately the I of my desires.” While it may be thought that Williams's claim implies an unpalatable Humean subjectivism, the present (...) article argues that this does not follow: That first‐person practical deliberation is directed both by the “I of my desires” and by the world. Drawing on Peter Winch's argument against the universalizability of moral judgments and D. H. Lawrence's Lady Chatterley's Lover, the article argues that practical deliberations involve discovering value in the world, but that what is revealed about the world depends constitutively on the first‐person deliberations and decisions of particular agents. A new volume of philosophical essays by Bernard Williams. The book is a successor to Problems of the Self, but whereas that volume dealt mainly with questions of personal identity, Moral Luck centres on questions of moral philosophy and the theory of rational action. That whole area has of course been strikingly reinvigorated over the last deacde, and philosophers have both broadened and deepened their concerns in a way that now makes much earlier moral and political philosophy look sterile (...) and trivial. Moral Luck contains a number of essays that have contributed influentially to this development. Among the recurring themes are the moral and philosophical limitations of utilitarianism, the notion of integrity, relativism, and problems of moral conflict and rational choice. The work presented here is marked by a high degree of imagination and acuity, and also conveys a strong sense of psychological reality. The volume will be a stimulating source of ideas and arguments for all philosophers and a wide range of other readers. (shrink)

This new volume of philosophical papers by Bernard Williams is divided into three sections: the first Action, Freedom, Responsibility, the second Philosophy, Evolution and the Human Sciences; in which appears the essay which gives the collection its title; and the third Ethics, which contains essays closely related to his 1983 book Ethics and the Limits of Philosophy. Like the two earlier volumes of Williams's papers published by Cambridge University Press, Problems of the Self and Moral Luck, this volume will (...) be welcomed by all readers with a serious interest in philosophy. The language theory of Mikhail Bakhtin does not fall neatly under any single rubric - 'dialogism,' 'marxism,' 'prosaics,' 'authorship' - because the philosophic foundation of his writing rests ambivalently between phenomenology and Marxism. The theoretical tension of these positions creates philosophical impasses in Bakhtin's work, which have been neglected or ignored partly because these impasses are themselves mirrored by the problems of antifoundationalist and materialist tendencies in literary scholarship. In Mikhail Bakhtin: Between Phenomenology and Marxism Michael Bernard-Donals examines various (...) incarnations of phenomenological and materialist theory - including the work of Jauss, Fish, Rorty, Althusser, and Pecheux - and places them beside Bakhtin's work, providing a contextualised study of Bakhtin, a critique of the problems of contemporary critics, and an original contribution to literary theory. Organisms don't explore for exploration's sake: exploratory psychology is regulated by inputs from multiple adaptations dedicated to processing information from different domains of ancestral adaptive relevance. As holistic representations of environments, imaginary worlds simulate multiple adaptive problems, solutions, and outcomes, thereby engaging numerous emotional systems and providing potentially useful information. Their popularity is thus best understood in terms of the full spectrum of information domains they comprise.

Those who think of some aspects of the world as "physically necessary" usually think of this kind of necessity as being confined to the general law of nature, initial conditions being "contingent." Tachyon theory and general relativity provide independent but related reasons for thinking that some initial states are, however, "impossible." And statistical mechanics seems to lead us to conclude that some initial conditions are, if not impossible, "highly improbable." We are then, led from these aspects of physics to wonder (...) if initial conditions are always "freely specifiable" and in the domain of physical contingency. (shrink)

Listening to subject’s commentaries can be a useful spur to novel scientific departures, as in studies of blindsight. Recently further testing has been possible with subject DB, who was a blindsight patient tested intensively over a period of 10 years and who was the subject of the book, . Essentially his original capacity is the same or somewhat more sensitive. Some further types of discriminations have now been tested that were not possible in the original study. But a new feature (...) was discovered, namely that he describes conscious after-images of a wide range of inducing stimuli of which he is unconscious. The properties of the after-images are briefly described, such as their occurrence following unseen colour patches, luminance changes, shape, spatial frequency, their long durations, showing inter-ocular transfer, as well as their conforming to Emmert’s Law. Various approaches are discussed towards finding the source of their generation, such as the use of after-images of colour mixes of separate inputs to the two eyes . They are also discussed in terms of after-images in normal subjects that are generated by imagination. The discovery offers a rare potential opportunity to compare the brain activity associated with both the conscious and unconscious attributes of the precisely the same stimuli in the same locus in the same subject. This paper uses E. M. Forster’s novel Howards End to help articulate what I describe as a moral pluralist approach to moral conflict. Moral pluralism, I argue here, represents a way of responding to the moral conflicts we encounter in our lives, rather than the mere acknowledgment of their inevitability, as suggested by value pluralists like Isaiah Berlin. The tragic view of moral conflict epitomized by Sophocles’ Antigone and endorsed by most theories of value pluralism, tells us that we must (...) choose between moral commitments and reconcile ourselves to the moral regrets that inevitably follow from moral choice. The moral pluralist view, in contrast, suggests that we should seek means, however imperfect, of satisfying conflicting moral commitments and minimizing causes for moral regret. That view, I argue, drives the words and actions of Forster’s heroine in Howards End, Margaret Schlegel. Confronted with a battle between a willful patriarch and a self-righteous sister, a conflict that maps neatly onto the central conflict in Sophocles’ tragedy, Margaret refuses to take sides without refusing to make moral choices. And in doing so, she comes to exemplify an unexpected kind of moral heroism. (shrink)

For some decades, the concept of human dignity has been widely discussed in bioethical literature. Some authors think that this concept is central to questions of respect for human beings, whereas others are very critical of it. It should be noted that, in these debates, dignity is one component of a long-lasting and widespread conceptual construct used to support a stance on the ethical question of the moral status of an action or being. This construct has been used from Modernity (...) onward to condemn slavery and torture as violations of human dignity. In spelling it out, we can come to a better understanding of what “dignity” means and become aware that there exists a quite useful place for this notion in our ethical thought, albeit a modest one. Sustainability is typically viewed as consisting of three forces, economic, social, and ecological, in tension with one another. In this paper, we address the dangers posed to societal sustainability. The concern being addressed is the very survival of societies where the rights of individuals, personal and collective freedoms, an independent judiciary and media, and democracy, despite its messiness, are highly valued. We argue that, as a result of various technological innovations, a range of dysfunctional impacts are threatening social and political (...) stability. For instance, robotics and automation are replacing human labor and decision-making in a range of industries; search engines, monetized through advertising, have access to, and track, our interests and preferences; social media, in connecting us to one another often know more about us than we ourselves do, enabling them to profit in ways which may not coincide with our well-being; online retailers have not only acquired the ability to track and predict our buying choices, but also they can squeeze vendors based on their outsize bargaining power; and, in general, virtual technologies have changed both the way we think and our sense of self. With the rising deployment of the Internet of Things, and developments in machine learning and artificial intelligence, the threats to individual freedoms and rights, societal cohesion and harmony, employment and economic well-being, and trust in democracy are being ratcheted up. This paper lauds the benefits and addresses the harm wrought by the high tech giants in Information and Communication Technologies. The search for rapidly growing revenues drives firms to accelerate product innovation without fully investigating the entire gamut of their impacts. As greater wealth accrues to the leaders of tech firms, inequalities within firms and societies are widening, creating social tensions and political ferment. We explore the ethical nature of the challenge employing a simple utilitarian calculus, complemented by approaches rooted in rights, justice, and the common good. Various options to address the challenges posed by ICTs are considered and evaluated. We argue that regulation may do little more than slow down the damage to society, particularly since societal values and political preferences vary internationally. Firms need to establish ethical standards, imbuing the upholders of these standards with sufficient authority, while creating a culture of morality. User involvement and activism, and shareholders’ concerns for the sustainability of societies on whose continued prosperity they depend, are imperative to humanity’s ability to decide the future direction of technology. The interpretation-construction distinction, which marks the difference between linguistic meaning and legal effect, is much discussed these days. I shall argue that the distinction is both real and fundamental – that it marks a deep difference in two different stages in the way that legal and political actors process legal texts. My account of the distinction will not be precisely the same as some others, but I shall argue that it is the correct account and captures the essential insights of (...) its rivals. This Essay aims to mark the distinction clearly! The basic idea can be explained by distinguishing two different moments or stages that occur when an authoritative legal text is applied or explicated. The first of these moments is interpretation – which I shall stipulate is the process that recognizes or discovers the linguistic meaning or semantic content of the legal text. The second moment is construction – which I shall stipulate is the process that gives a text legal effect. I shall then claim that the difference between interpretation and construction is real and fundamental. Although the terminology could vary, legal theorists cannot do without the distinction. One more preliminary point: the topic of this Essay is narrow and conceptual. This Essay, has three goals: to explicate the nature of the interpretation-construction distinction, to argue that this distinction marks a real difference, and to suggest that the distinction is helpful in that it enables legal theorists to clarify the nature of important debates, for example debates about constitutional interpretation. The Essay does not offer any particular theory of interpretation or construction – that it is, it remains agnostic about questions as to how linguistic meaning can be discerned or how legal content ought to be determined. Nor does this theory offer an account of the history and origins of the distinction. Those topics are important, but raising them in this Essay might shift attention away from prior questions about the nature and value of the distinction itself. Here is the roadmap. In Part II, this Essay shall discuss two preliminary sets of ideas: vagueness and ambiguity, and semantic content and legal content. In Part III, this Essay shall use these preliminary ideas to answer the questions, "What is interpretation?" and "What is construction?" In Part IV, this Essay shall consider some objections to the interpretation-construction distinction. In Part V, this Essay shall develop the argument that the distinction is fundamental and indispensable. (shrink)
