This paper describes the automated classification of legal norms in German statutes with regard to their semantic type. We propose a semantic type taxonomy for norms in the German civil law domain consisting of nine different types focusing on functional aspects, such as Duties, Prohibitions, Permissions, etc. We performed four iterations in classifying legal norms with a rule-based approach using a manually labeled dataset, i.e., tenancy law, of the German Civil Code ). During this experiment the \ score continuously improved (...) from 0.52 to 0.78. In contrast, a machine learning based approach for the classification was implemented. A performance of \ was reached. Traditionally, machine learning classifiers lack of transparency with regard to their decisions. We extended our approach using so-called local linear approximations, which is a novel technique to analyze and inspect a trained classifier’s behavior. We can show that there are significant similarities of manually crafted knowledge, i.e., rules and pattern definitions, and the trained decision structures of machine learning approaches. (shrink)

The paper is interested in likely routes for the evolution of normative practice, which, it is here assumed, is a necessary precursor to the development of language. It argues that each normative practice requires a policing practice, consisting of, at least, moves of commendation, condemnation, and retraction, and it contrasts policing with mere monitoring practice. So the evolution of norms can be seen to be the development of policing from mere monitoring practice. It conjectures that a likely site for such (...) a development to take place is in the active transmission of technology, notably, toolmaking technology. Using data and observations drawn from the archaeological record and the psychology of mimicry, it attempts to illustrate the likely emergence of policing practices. (shrink)

In his critique of rational choice theory, Amartya Sen claims that committed agents do not (or not exclusively) pursue their own goals. This claim appears to be nonsensical since even strongly heteronomous or altruistic agents cannot pursue other people's goals without making them their own. It seems that self-goal choice is constitutive of any kind of agency. In this paper, Sen's radical claim is defended. It is argued that the objection raised against Sen's claim holds only with respect to individual (...) goals. Not all goals, however, are individual goals; there are shared goals, too. Shared goals are irreducible to individual goals, as the argument from we-derivativeness and the argument from normativity show. It is further claimed that an adequate account of committed action defies both internalism and externalism about practical reason. (shrink)

This article analyzes the relevance of a specific form of social networks, so-called innovative milieus, for the development of radical innovations. Two Swiss initiatives which developed highly energy-efficient means of individual transport in the past ten years are analyzed in terms of the resources they could mobilize and the risks they run. To assess the milieu's potential for radical innovation, we examine the construction of a lightweight safety system, the social construction of the product category "lightweight vehicle, " and the (...) management of the interface between prototype development and large-scale manufacturing. Any ethics directed to future demands is confronted with two main problems. Firstly, how can we conceive a kind of future which does not only hold the past and prolong the present, but remains open for something coming in an unexpected way. Secondly, how does it happen that demands of not yet existing people really concern us? This paper tries to answer to these questions from the perspective of a responsive phenomenology based on our responding to the Other’s demands which (...) precede and exceed our own initiative. This intimates a sort of anterior future according to which we are permanently what we have to be. Leading concepts, supported by authors like Husserl, Schutz, Merleau-Ponty, Levinas, Marx and Nietzsche, are the following: generativity of life crossing the thresholds between different generations; procreation which allows for surviving in the children; projects of responsive politics and economics which take care to keep the world habitable; finally, a sort of tele-moral stimulated by Fernstenliebe which discovers traces of a future humanity in the face of the Other. Solidarity is a complex theoretical and historical investigation of one of the most dynamic social movements in post-World War II Europe. For some time now, Touraine has attempted to develop a comprehensive theory of social movements. In Solidarity, he and fellow researchers François Dubet, Michel Wieviorka, and Jan Strezelecki, apply the theories of action, movement and sociological intervention elaborated in The Voice and The Eye to the situation in Poland 1980-1. Solidarity is one of many attempts by Touraine to combine (...) a comprehensive theory of social change and action with the history of a contemporary social movement. The article undertakes a rereading of Nietzsche’s Birth of Tragedy with a focus on its two central achievements – reviving the Dionysus myth and making the origin of tragedy evident – whose mutual interrelatedness has attracted only sparse critical attention to date. Working more as a myth-maker than a theorist, Nietzsche advances a groundbreaking portrayal of the story of Dionysus that allows him to lay bare the origins of tragedy. Simultaneously, his identification of tragedy’s ultimate source suggests a configuration that (...) lends the Dionysus myth new currency. In so doing, Nietzsche conceives the manifest presence of this myth – as well as that of the origins of tragedy – as a specific recombination of the Dionysian and the Apollonian: not as an Apollonian taming or sublimation of the Dionysian, nor yet as dialectical mediation, but rather as the Apollonian’s seizure by the Dionysian, which teeters on the threshold between lurching toward and postponing a new, more comprehensively Dionysian loss of boundaries. In this way, Nietzsche suggests, there is generated a »Schauen und Sehnen über das Schauen hinaus,« a mode of viewing amplified by longing, through which the specific form of the Dionysus myth from the perspective of tragedy and conversely of tragedy from the perspective of myth becomes apparent. Few would contest the fact that analytical philosophy has dominated philosophical practice in the English speaking world for about the last century. But dispute continues about both its origins and nature; whilst others question its value. Michael Dummett wholly embraced the analytical approach to philosophy, as he conceived of it. For him analytical philosophy marked itself off from its precursors and its alternatives, embodied in the Continental tradition, by taking the linguistic turn. And Frege was unequivocally the first philosopher to (...) take that auspicious turn, which ushered in a new method in philosophy. Henceforth philosophers were to approach the business of analyzing thought via the enterprise of analyzing language. So Dummett is presenting us with both a history lesson and a recommendation about how we ought to do philosophy. But is his reading of the history accurate? And is his conception of the nature of analytical philosophy viable? In order to reflect on these questions this collection brings together eight scholars who have made a serious business of reading Dummett. (shrink)
