Semantic types of legal norms in German laws: classification and analysis using local linear explanations.Bernhard Waltl, Georg Bonczek, Elena Scepankova & Florian Matthes - 2019 - Artificial Intelligence and Law 27 (1):43-71.
This paper describes the automated classification of legal norms in German statutes with regard to their semantic type. We propose a semantic type taxonomy for norms in the German civil law domain consisting of nine different types focusing on functional aspects, such as Duties, Prohibitions, Permissions, etc. We performed four iterations in classifying legal norms with a rule-based approach using a manually labeled dataset, i.e., tenancy law, of the German Civil Code ). During this experiment the \ score continuously improved (...)

    From Tools to Rules.Bernhard Weiss - 2022 - Philosophical Topics 50 (1):55-82.
The paper is interested in likely routes for the evolution of normative practice, which, it is here assumed, is a necessary precursor to the development of language. It argues that each normative practice requires a policing practice, consisting of, at least, moves of commendation, condemnation, and retraction, and it contrasts policing with mere monitoring practice. So the evolution of norms can be seen to be the development of policing from mere monitoring practice. It conjectures that a likely site for such (...)

Symposium on rationality and commitment: Introduction.Fabienne Peter & Hans Bernhard Schmid - 2005 - Economics and Philosophy 21 (1):1-3.
In his critique of rational choice theory, Amartya Sen claims that committed agents do not (or not exclusively) pursue their own goals. This claim appears to be nonsensical since even strongly heteronomous or altruistic agents cannot pursue other people's goals without making them their own. It seems that self-goal choice is constitutive of any kind of agency. In this paper, Sen's radical claim is defended. It is argued that the objection raised against Sen's claim holds only with respect to individual (...)

Sozialethik als Kritik.Michelle Becka, Bernhard Emunds, Johannes Eurich, Gisela Kubon-Gilke, Torsten Meireis & Matthias Möhring-Hesse (eds.) - 2020 - Baden-Baden: Nomos Verlagsgellschaft.

Bernhard Waldenfels - 2024 - Critical Hermeneutics 8.
Through a comparison of the phenomenological motif of the alien and the psychoanalytic motif of the unconscious, a critique is advanced against Cartesian dualism, which recurs today in the natural sciences and in the split of the contemporary individual, divided between spirit and nature, the proper world and the alien world, the inner sphere and the outer sphere. It is a matter of thinking of an original subtraction, an absent presence that begins with ourselves, in a slippage that achieves no (...)

Outsider Initiatives in the Reconstruction of the Car: The Case of Lightweight Vehicle Milieus in Switzerland.Gregor Dürrenberger & Bernhard Truffer - 1997 - Science, Technology and Human Values 22 (2):207-234.
This article analyzes the relevance of a specific form of social networks, so-called innovative milieus, for the development of radical innovations. Two Swiss initiatives which developed highly energy-efficient means of individual transport in the past ten years are analyzed in terms of the resources they could mobilize and the risks they run. To assess the milieu's potential for radical innovation, we examine the construction of a lightweight safety system, the social construction of the product category "lightweight vehicle, " and the (...)

Antworten auf Ansprüche Nachkommender.Waldenfels Bernhard - 2017 - Metodo. International Studies in Phenomenology and Philosophy 5 (2):19-45.
Any ethics directed to future demands is confronted with two main problems. Firstly, how can we conceive a kind of future which does not only hold the past and prolong the present, but remains open for something coming in an unexpected way. Secondly, how does it happen that demands of not yet existing people really concern us? This paper tries to answer to these questions from the perspective of a responsive phenomenology based on our responding to the Other’s demands which (...)

Solidarity: The Analysis of a Social Movement: Poland 1980-1.Michael Bernhard & Joseph McCahery - 1984 - Telos: Critical Theory of the Contemporary 1984 (62):231-240.
Solidarity is a complex theoretical and historical investigation of one of the most dynamic social movements in post-World War II Europe. For some time now, Touraine has attempted to develop a comprehensive theory of social movements. In Solidarity, he and fellow researchers François Dubet, Michel Wieviorka, and Jan Strezelecki, apply the theories of action, movement and sociological intervention elaborated in The Voice and The Eye to the situation in Poland 1980-1. Solidarity is one of many attempts by Touraine to combine (...)

Evidenz des Dionysos-Mythos als Begründung der Tragödie.Bernhard Greiner - 2013 - Zeitschrift für Ästhetik Und Allgemeine Kunstwissenschaft 58 (1):121-139.
The article undertakes a rereading of Nietzsche’s Birth of Tragedy with a focus on its two central achievements – reviving the Dionysus myth and making the origin of tragedy evident – whose mutual interrelatedness has attracted only sparse critical attention to date. Working more as a myth-maker than a theorist, Nietzsche advances a groundbreaking portrayal of the story of Dionysus that allows him to lay bare the origins of tragedy. Simultaneously, his identification of tragedy’s ultimate source suggests a configuration that (...)

Dummett on analytical philosophy.Bernhard Weiss (ed.) - 2015 - New York, New York: Palgrave-Macmillan.
Few would contest the fact that analytical philosophy has dominated philosophical practice in the English speaking world for about the last century. But dispute continues about both its origins and nature; whilst others question its value. Michael Dummett wholly embraced the analytical approach to philosophy, as he conceived of it. For him analytical philosophy marked itself off from its precursors and its alternatives, embodied in the Continental tradition, by taking the linguistic turn. And Frege was unequivocally the first philosopher to (...)
